Winners of the Distinctive Plan & Design and Pick of the Parade contests were announced as HBA members gathered at the Stoney Creek Hotel near Bass Pro in Independence for the Fall Parade of Homes Awards Celebration. Special thanks go to Jennifer Bertrand for announcing the winners and to Misty Hanson, Stewart Title, for distributing the award trophies. The contest winners were announced in the October 1 Kansas City Star and are featured on the KCHBA website, kchba.org. The Fall Parade features two contests: Distinctive Plan & Design which focuses on interior design and architecture and Pick of the Parade which ranks homes based on construction techniques, material selection, and craftsmanship. Housing professionals from outside the Kansas City area toured contest homes September 21st and 22nd. Criteria for Pick of the Parade contest include, among others: exterior flatwork and foundation, framing, window and door installation, cabinetry quality and installation, painting and floor covering. Judges in the Distinctive Plan & Design contest considered: curb appeal, layout and use of space, design and special features of the kitchen and bath, unique accent areas, lighting, furnishings
and window treatments. The Home Builders Association appreciates continuing support for the Parade from Stewart Title, presenting sponsor. Plans are now underway for the Spring 2018 Parade, to be held April 28 through May 13.

Congressman Cleaver Defender of Housing The HBA presented Congressman Emmanuel Cleaver II with NAHB’s Defender of Housing Award on Sept. 18 in appreciation of his ongoing support of the home building industry. The award presentation was coordinated with the Builders Development Corporation (BDC) and took place at a BDC rehab home in Independence. After receiving the award, Congressman Cleaver toured the home and then visited with HBA members and people from the neighborhood.

He has worked on numerous pieces of legislation concerning home affordability and flood insurance. Tamara Day—Tamara appeared at the 2017 home show and she’ll return for 2018 while a national audience gets acquainted with her through “Bargain Mansions”. Her DIY Network program will feature Tamara’s renovations of homes in Hyde Park, Leawood and near
Loose Park. Tamara lives with her husband and four children in Leawood. Chrysy Huff—Chrysy and her husband Jeff are the owners of the popular and growing Restoration Emporium (RE). RE has expanded from its West Bottoms original location to stores on the Plaza and at Park Place. Chrissie describes RE
as “a family-owned business curating antique, vintage and vintage-inspired, farmhouse and urban home decor all under one roof!” Jennifer Allwood—beginning as a decorative painter, Jen has combined her decorating expertise and vision with advice and support for small businesses. Her website states that “so often creative entrepreneurs have amazing creative services and products, but they struggle to grow their business online. Kansas Area Council Hears from Chris Kuehl
The Kansas Area Council on September 26 featured leading local economist Chris Kuehl, Ph.D. Dr. Kuehl is a managing director of Armada Corporate Intelligence and one of the co-founders of the company.
CAPS Classes Provide‌ The HBA office hosted Certified Aging in Place Specialist (CAPS) classes last month, taught by Shawn McGuire. In the CAPS I training, attendees learned how to identify opportunities and develop the skills to interact with customers that are 50+ years old in order to grow their businesses. They learned best practices in communicating and interacting with this exciting and evolving population.

Possible Liability Under Kansas Subcontractor Law A recent court case brought to light a Kansas statute dating back to 1973 that makes a builder liable when a subcontractor does not pay their workers. The Kansas Department of Labor is the government entity responsible for enforcing this law.

According to the statute, general contractors “shall be civilly liable to the employees of the subcontractor for wages due on account of the performance of work covered by the contract, but only if

and to the extent that the subcontractor fails to pay such wages.” Therefore, it requires builders to compensate the workers directly, despite already paying the subcontractor for the work. The law does provide builders the “right in the payor to recoupment from the subcontractor,” meaning they should be able to sue for the money back. However, this is not a perfect solution due to legal fees, difficulty in tracking the subcontractor down, etc. Continued on page 7

As this law does not seem well-known, please be aware of your potential liability. It is important to recognize ways to mitigate the risk, such as hiring reputable subcontractors with clean work histories. Builders should also have in place independent contractor agreements with all subcontractors used to perform work on a project. In the absence of an independent contractor agreement, it can be alleged by the attorney of a subcontractor that the builder exercised a level of control over what was done, how it was done, and when it was done, to the extent that the relationship was in reality that of an employee/employer. Misclassifying that relationship could open up numerous other problems for the builder, not just the issue of paying workers.
The HBA is continuing to investigate this statute and how builders can protect themselves from the increased liability.

NAHB Supports White House Efforts to Reduce Regulatory Burdens NAHB CEO Jerry Howard joined Administration and industry leaders at a White House event on October 2nd,
highlighting the need to reduce the regulatory burden on businesses and the economy. Vice President Mike Pence, who hosted the event, was joined by the entire cabinet, members of the Republican
congressional leadership, several governors and approximately 100 industry leaders. Pence cited the Administration’s progress on regulatory reform across federal agencies and its plans to continue working on regulatory relief moving forward.
After the White House event, NAHB was invited to participate in three of 10 breakout sessions hosted by federal agencies, including the Labor Department, Small Business Administration (SBA) and Treasury, to discuss the specific regulations in need of reform.
“Residential construction remains one of the most heavily regulated industries in the country,” Howard said. “We are pleased that the Trump administration recognizes the regulatory challenges placed on our industry and that it is taking steps to reduce these burdens.”
Submitted comments to the EPA recommending that the agency revise regulations governing wetlands, stormwater and lead-based paint.

It would only hurt the fiscal soundness of the NFIP and fail to ease taxpayer burdens. “NAHB will continue to work with Congress and the administration to achieve needed reforms to the NFIP that will ensure it remains efficient and effective in protecting property owners, creates more stability in the housing market, and improves the financial viability of the program.”

Silica Rule in Effect The U.S. Occupational Safety and Health Administration (OSHA) officially began enforcing the silica rule on Saturday, Sept. 23. The rule will apply to a wide range of employers who are involved with common residential construction tasks such as using masonry saws, grinders, drills, jackhammers, performing milling, and using heavy equipment for grading and excavating. Silica is a component of soil, sand and granite, and occurs in many commonly used building products such as mortar, concrete, bricks, blocks, rocks and stones. It can be disturbed by construction activities ranging from cutting concrete and brick to moving soil around the jobsite. OSHA has determined that the rule is needed to substantially reduce the risk of serious disease from exposure to airborne concentrations of silica dust.

The crystalline silica rule was originally issued in March 2016 with a delay on enforcement. It is the most far-reaching regulatory initiative ever finalized for construction with an industry-estimated cost of $5 billion per year — roughly $4 billion per year more than OSHA estimates. NAHB and the Construction Industry Safety Coalition have requested that OSHA withdraw the rule and talk frankly with the construction industry about a more feasible and economical approach to dealing with the silica hazards.

Residential Permit Growth Continues Local cities and counties issued 481 permits for new single-family units during August bringing the yearto-date total to 4,128, according to the Home Builders Association of Greater Kansas City’s monthly Residential Building Permit Statistics report. This total of 4,128 is a 7 percent increase over the same period in 2016. Kansas City, Mo., tops the list of permit issuers with 680, with the majority (504) of those in Clay County. While the number of single-family permits has increased compared to last year, multi-family construction has slowed down compared to 2016: new projects have decreased to 1,207 units permitted, compared with 3,062 units for the first seven months of 2016. Home builders and associates continue to report that the level of production is limited by a shortage of skilled employees. Local economist Chris Kuehl reported that this problem may be exacerbated as rebuilding in Houston and Florida attracts workers willing to move to those states.
