The Place to Have Your Voice Heard We hear in the media and from those around us that the average American doesnâ€™t feel they have a voice in what is happening in government or in the media. There is an old saw that there is strength in numbers. That is indeed true. The HBA is constantly representing you while inviting you to speak up so we can represent you well. It does make a difference. Our members let us know about issues facing them and we work to help them solve their problems. Letâ€™s look at some specific examples. Government In just the last year alone the HBA has been key in passing good legislation. We have had recent success in this past General Assembly in forming a task force to examine what statewide enforcement of the building code would look like. A Roofers Licensure bill was once again stopped that would have added to cost of doing business for small business owners. We wrapped up a five year effort in Kenton County that saved builders an average of $3,000 per home through the Kenton County Subdivision Regulations. In Boone County we are wrapping up a process to update their Subdivision Regulations that will save you time and money. We ended a multi year effort in Kenton County to pass a new Comprehensive Plan that puts the economy and property rights ahead of all else. Media The association has been interviewed, appeared on air, or in print on 37 occasions in the last 12 months. Every time we do so we are communicating a message that supports your industry. Whether our message on ways we connect you with your customers, the importance of using an HBA member, a Registered Builder or a Registered Remodeler, the economics of building, the impacts of regulations and legislation we are out in front of the media serving you. Our advertising includes promotions of our shows which we use to leverage the importance of using a Registered Builder or Registered Remodeler on 100â€™s of messages per show throughout the Tri-State. When not on air we are meeting with news directors of broadcast stations, on the phone and in person with reporters and blasting press releases throughout the year touting your professionalism and the activities you create at our association. Our Brand We have developed, free to members, a logo campaign that helps you tie into the reputation and awareness of the association and its professional reputation throughout the year. April Meet the Builder Event

n Wednesday, April 1st the Associates Committee welcomed members to a complimentary event known as “Meet the Builder”. The event was sponsored by L&N Federal Credit Union. SMC Annual Economic and Housing Outlook Breakfast

n April 15 the Sales & Marketing Council welcomed Dr. Julie Heath, Director of the Economics Center at the University of Cincinnati. Dr. Heath informed those in attendance about current housing and economic conditions as well as the future housing market in Northern Kentucky and the Cincinnati metropolitan area will fare in 2015. Notable information in Dr. Heath’s presentation included slow improvement in the market. Headwinds facing the millennial generation include a historic high amount of student loan debt. However the fact that there is 90 million of this generation nationally is important to note that they will influence the housing market in the very near future. The vast majority of this generation wants to own a home and according to Fannie Mae surveys most are either saving for home ownership or are renting because they view housing as unaffordable while rents continue to rise and will for the foreseeable future due to low rental stock. What’s in a Name? Potentially… A Lot!

While trademark rights exist from the moment you first use the mark (registration is not necessary to have these rights), a federal registration does offer many advantages. The availability of such a registration is determined by how good the mark is.

trademark or service mark is any word, name, phrase, symbol, device and/or design that serves as a source identifier. Trademarks and service marks serve to distinguish your products and/or services from those offered by others. When we choose a product and we like it, the next time we choose it we have an expectation that it will be the same as the last time. With this in mind, there is a level of quality control attached to the mark which is associated with the product. While trademark rights exist from the moment you first use the mark (registration is not necessary to have these rights), a federal registration does offer many advantages. The availability of such a registration is determined by how good the mark is. In the trademark field, discussions revolve around what is called a spectrum, in relation to the strength of the mark. On the one end, there are generic terms which can never function as a source identifier. The word “cracker”, for example, would not be capable of trademark protection for crackers, because this is the generic name of what the item is. Just up the spectrum from generic are descriptive marks. Descriptive marks are not considered registerable as a trademark, unless it can be shown that through extensive use, the mark has come to be known as serving as a source identifier. In other words, it has acquired distinctiveness. For example, “best buy” was considered descriptive of retail store services, but after extensive use in the marketplace and a large advertising budget spent on promoting the brand name, Best Buy had a mark that was deemed to have acquired distinctiveness. Hence, despite being descriptive, it was determined that it was functioning as a source identifier and was entitled to registration. The next level from descriptive marks on the spectrum are suggestive marks. Just as the name sounds, this would be a mark that doesn’t describe the product, 10

but it is suggestive of a quality or characteristic of the product. An example of a suggestive mark would be Sweet Lips for lipstick. Since the mark is not merely descriptive but just suggestive, it is entitled to registration without having to acquire distinctiveness. Finally, at the top of the spectrum are the best trademarks, both arbitrary and fanciful. Arbitrary marks are common terms, but used in a completely unrelated way. The most commonly cited example of an arbitrary mark is Apple for computers. We all know what an apple is, but fruit has nothing to do with computers. Thus, this is an arbitrary use of the word apple as a trademark for computers. Fanciful marks, the absolutely strongest type of mark, is a completely made up word that does not exist in language when it is coined, Kodak for example. While we are now familiar with this term, we still only know it as a brand name for cameras and other photography supplies. It has absolutely no meaning other than as a source identifier for that company’s products. While fanciful marks are the strongest, they are also the most susceptible to becoming generic and thus, are no longer entitled to trademark protection, particularly if it is a pioneer product. A very famous example is the little known fact that the word “escalator” was once a trademark of Otis Elevator Company. They did not, however, properly use a generic form with the trademark, or always refer to their product as escalator moving stairs, so the public associated the word “escalator” as the name for the moving stairs. Thus, it became the generic term for moving stairs and trademark protection was lost, never to be capable of being reacquired. In conclusion, trademarks and service marks are very useful because they serve as a source identifier for your business and/or products, which will enable customers to become return customers. When choosing your business name or product name, remember to keep in mind the distinctiveness spectrum to ensure that you make a choice that is capable of trademark protection.

Enzweiler Apprenticeship Program Graduates Over 50 New Tradespeople…Wins National Award

n April over 50 students of our trade school graduated proudly into their chosen professions. The evening was celebrated by dinner, a keynote address by Kris Knochelmann, Kenton County Judge Executive, HBA member and owner of Schneller Plumbing Heating and Air Conditioning, followed by presentation of our graduates’ journeyman’s certificates. Congratulations graduates and please stay around to enjoy what the HBA can do for you in your professional lives. In recent news the Home Builders Association has learned that it will receive NAHB’s Association Excellence Award for the Best Collaboration or Partnership between HBA’s. This was awarded to us as a result of our partnership with the HBA of Lexington to create the Building Institute of Central Kentucky. This new school is modeled after our trades programming. In 2014 they started courses in HVAC and Carpentry and in the fall of this year they will add Plumbing, Electric and Facilities Maintenance and Remodeling. The HBANKY 2015 HOMEFEST single site home show will be held at The Equestrian in Triple Crown County Club Community. HOMEFEST is a perfect trade show opportunity. This yearâ€™s event will feature an entry tent with exhibit space. All show attendees will be required to pass through the tent after purchasing or presenting tickets in order to enter the street that leads to the homes. There are five show homes.
