JUNE IS NATIONAL HOMEOWNERSHIP MONTH Homeownership is an Enduring Goal Since our nation’s first days as a newlyfledged republic, homeownership has been a cherished ideal. Reasons as diverse as our population have impelled generations of Americans to work hard and make the sacrifices necessary to own a home. That’s because the benefits of homeownership are many. Perhaps most important is that owning a home provides an unparalleled sense of well-being, security and achievement. Moreover, homeownership promotes social stability and is critical in creating wealth and providing upward mobility and financial security for many households. Even in the wake of the Great Recession with its severe housing market crisis, Americans continue to value homeownership. Almost all (96 percent) of the people polled in a survey conducted in 2012 for the National Association of Home Builders (NAHB) by two nationally-known polling firms said they are happy with their decision to own a home. That sentiment held true even among people whose homes are “under water.” Eighty-four percent of those who owe more on their mortgage than their home’s current value said they are happy with their decision to own a home. The nationwide survey also found that a significant majority – 76 percent – think owning a home is the best long-term investment they can make and is worth the ups and downs of the housing market. Among people who don’t currently own a home, 68 percent hope to own a home in the future, the poll found. Homeownership Generates Jobs and Strengthens the Economy Just as homeownership provides many benefits to individual families, it also benefits the nation. Whenever new homes are built, new jobs are created and a permanent source of ongoing revenue for local, state and federal government springs to life that supports local schools and communities across the land. Just consider: building 100 average single-family homes creates 305 jobs and generates more than $23 million in wage and business income as well as $8.9 million in taxes and revenue for state, local and federal governments. The employment impacts are broad based, extending far beyond the construction workers employed directly to build the homes. Jobs are generated in the industries that manufacture and supply the many products that go into building the home. They are also created when real estate agents, lawyers and brokers provide services to home builders and home buyers. And the benefits don’t stop there. When 100 families move into new homes, they spend $740,000 more than usual on appliances, furnishings, and property alterations, creating a further economic stimulus. In normal economic times, more than 17 percent of the nation’s economy relies on housing. Equally important, new homes are “Made in America.” Most of the products used in construction are manufactured right here at home in the U.S. by our countrymen.
Attacks on a Principle that Americans Hold Dear Despite the many benefits that homeownership provides for families, its potential to create millions of jobs and its value to the nation’s economy, it is under attack. Policymakers are pushing for sweeping tax code changes that could prevent millions of families from ever setting foot on the homeownership ladder. Some of the proposals under consideration include eliminating or reducing the mortgage interest deduction and the deductions for property taxes and the interest on home equity loans. This would hurt those who have played by the rules and sacrificed to get to where they are today, and it would send shockwaves through the economy. Although detractors claim that the mortgage interest deduction primarily benefits the wealthy, younger households and middle income home owners are actually the biggest beneficiaries. Abolishing or limiting the mortgage interest deduction would also inflict serious damage on millions of middle-class home owners and hurt the housing recovery by further depressing home values. It only takes a 6 percent drop in home values to wipe out $1 trillion in household wealth. Any policy change that makes it harder to buy a home, or forces young families to defer home purchases, will have a significant impact on wealth accumulation and the makeup of the middle class. Indirect but Equally Damaging Some of the other threats to homeownership may be less visible, but certainly are no less damaging. Some members of Congress support abolishing Fannie Mae and Freddie Mac without offering a new framework for housing finance system reform that would avoid further disruptions to an already fragile housing finance system. Even more disturbing is a push by some policymakers to end the federal backstop for housing. This would immediately drive up the cost of long-term financing and destabilize the housing market. A reliable supply of affordable 30-year, fixed-rate mortgage financing is essential to a vibrant housing market, and Congress should ensure that the federal government plays an appropriate role in keeping conventional fixed-rate home loans and adjustable rate mortgages readily available and affordable for America’s working families. The Bottom Line Americans continue to value homeownership. That’s a lesson that elected officials would do well to remember. The NAHB poll also showed that 75 percent of all respondents – both owners and renters – believe the federal government should provide tax incentives to promote homeownership. As the debate over housing policy unfolds, it is crucial to ensure that homeownership remains attainable and that access to safe, decent and affordable housing remains a national priority. Sincerely,

NEW MEMBER EVENT BBQ Throwdown and Hoedown
W
ho in the HBA makes the best tasting barbequed ribs, chicken or pulled pork? We are going to find out on Thursday, July 17th, as teams from builder and associate members compete in the first annual BBQ Throwdown. This is going to be a fun summer event to determine which builder or associate pitmaster can grill up the tastiest barbeque. The best part is, the membership gets to enjoy the savory meats of their labors. We are going to have some big time competitors who compete in several competitions each year, along with folks who just grill in the backyard. Big-time pitmaster Ryan Stoffel of Fischer Homes will be wowing folks with his special recipe barbequed ribs, while Roy Piercefield, Jr. of Forge Lumber, will be delighting fans with his fabulous pulled pork. Joe Halpin of the Drees Company will be cookin up some pork roast and Debbie Franxman and the Wiseway team will be turning out some delicious chicken. In addition, we will have some bluegrass music, corn hole, cold beer, wine and all the fixins to make this an outstanding summer HBA event that you won’t want to miss. Cost will be held at a minimum so it will be reasonable enough that you can bring out the whole office to support
the company team or just enjoy some great BBQ and meeting fellow HBA members. Look for a nice grill package to be raffled. If you would like to be a competitor, we are going to have a 6 hour time limit for you to grill up your favorite BBQ dish. If you need a grill, we can arrange for one. Each contestant will be supplying the meat that they will cook and a cooler to keep it in. Don’t wait, as we have about 6 teams already lined up and we will have a limit of 12 teams. For you long-time HBA members who remember the classic summer clambakes, this will be that same type of fun event you won’t want to miss. The BBQ Throwdown and Hoedown will take place at the HBA Parking lot on Thursday, July 17th beginning at 5:00 p.m. and dinner starting at 6:15 p.m. Mark your calendar now and don’t miss it.

LEGAL THE LIABILITY OF THE UNTRAINED MANAGER Written by Kelly Schoening
M
any companies reward good job performance with promotions. Often, the promotion involves some type of management or supervisory role. However, being a good employee does not always equate to being a good manager. Individuals who are not trained in management and employee relations can be a source of liability for companies. There is an art to managing people and not everyone is suited for the position. It is not easy to balance motivating employees in order to obtain optimal job performance and policy compliance at the same time. New managers should be trained on the company’s policies and various employment laws before ever managing one individual. The manager must know the company’s policies and how they have been applied to others to assure consistency. Managers need to find the middle ground between being too punitive or too lax on employees as both can cause problems. From a legal standpoint, the untrained manager can cause liability by not knowing about harassment, the Americans with Disabilities Act, Family and Medical Leave, worker’s compensation and the many other employment laws that we all must live with in today’s world. Over 10 years ago, the courts recognized that harassment can occur on the basis of all protected categories, not just gender. Therefore, it is unlawful to harass an individual on the basis of race, age, disability, national origin as well as sex or gender. Managers must be able to recognize when an individual is complaining of harassment and then has an obligation to investigate the complaints. Quite often an employee who complains will specifically ask that “nothing be done” or that it be kept quiet. This cannot be done, it must be investigated. All such complaints should be immediately referred to Human Resources or the appropriate person in the company. Managers must also know what the attendance requirements are for 16

the company and consistently enforce those. If the company has more than 50 employees and is subject to the Family and Medical Leave Act, the manager must know what can trigger an FMLA Leave so that paperwork is submitted with the required 5 day timeframe. Quite often, new managers are not aware of the FMLA and subsequently do not tell HR about the absences until the employee has been off for several weeks or numerous times. The FMLA is a very employee friendly law and requires strict compliance.
It is highly advisable to send new managers to a training class or to hold such trainings internally. Promoting an individual and not providing the training can be a recipe for disaster.
Along with the FMLA is the Americans with Disabilities Act which requires that disabled employees not be treated less favorably than non-disabled employees. The definition of disability is very liberal. The law also requires that all accommodation requests be considered and those that are reasonable, be granted. An accommodation can range from additional leave time to needing modified equipment in the workplace. The law itself is a web of confusion and each case must be evaluated on its own facts. Managers should know enough to spot an ADA issue or request for an accommodation by an employee in order to seek the appropriate advice. Ignoring requests for an accommodation or discriminating against the disabled employee can ensure a quick trip to the courthouse.
All workplace injuries must be reported immediately using the company’s reporting mechanism. Some injuries must be reported on the OSHA 300 form or be immediately called into OSHA depending on the severity and number of employees involved. Telling employees not to report an injury in order to “save the company money” is not the route to follow and happens quite often with the untrained manager. Good managers must also provide timely and honest feedback to employees. Most individuals do not like confrontation so it is natural to avoid difficult conversations when an employee is failing in the workplace. However, avoiding the issues only compounds the problems. It does not let the employee know that the work performance is substandard and most employees will honestly believe the work is acceptable until told otherwise. It also does not document the poor performance making it far more risky to terminate employment for performance issues later on. Juries will see such behavior as unfair to the employee and may question whether the termination was truly motivated by discrimination or poor performance if no documentation exists. Evaluations should be done at least annually and should be honest. Any rating should be supported by a narrative comment that explains the rating. Additionally, documentation of performance issues should be done contemporaneous with the event. The documentation should be fact based and fully explain the situation so that a third party reading it would know exactly what occurred. POLITICS 2014 GENERAL ASSEMBLY WRAP UP
T
he 2014 General Assembly recessed sine die on April 15, 2014. This session saw hundreds of pieces of legislation filed in the Capital. The HBA was involved in tracking around 100 of these bills as they related in some way to small business and the construction industry. We enjoy outstanding grassroots support from our members and know that statewide the Capital phone lines can become flooded as important legislation moves through the process in Frankfort. For that we are eternally grateful for your participation and worthwhile effort to helping to protect your industry and livelihood. Following are a few bills of note that we wanted to inform you about: House Bill 84 – sponsored by Rep. Mike Denham – This bill was amended in the Senate by Senator Jarrod Carpenter. The amendment, added to the original bill, mandated that the Commissioner of Workers Claims shall create a software system to enable contractors to be notified when a subcontractor’s Workers Compensation is changed or cancelled. The software must be in place by December 2015. The bill was signed into law by the Governor. House Bill 369 – sponsored by Brett Yates – This bill changed the statute of limitations on written contracts from 15 years to 10 years. The bill was signed into law by the Governor.
House Bill 207 – sponsored by Representative Steve Riggs. This bill would have created a Roofing Contractors Licensing and Permitting Program. The HBA was supportive of amendments that exempted new construction and permitted remodeling jobs but many HBA members felt that the added Government and cost to business was unnecessary. Your local association members were the most vocal group in working to stop this bill during this session. The bill died in the Senate. Brian Miller, Executive Vice President, and James Kegley, HBA President, will testify before the Joint Interim Committee on Licensing and Occupations on Friday June 13th in Frankfort regarding issues that the membership had with this bill to see if a compromise may be reached prior to the 2015 session. Senate Bill 51 – sponsored by Senator Julie Denton – This bill would have doubled the amount of continuing education from 6 hours to 12 hours annually for all REALTORS. The bill never received a hearing and died in the Senate. House Bill 430 –sponsored by Representative Steve Riggs – This bill made changes to the Call Before You Dig law. The original bill was worded such that either the excavator, or one who hired the excavator, could have been liable if a line was cut. The HBA amended the bill to make it clear that the excavator was liable. The bill was signed into law by the Governor.
House Bill 551 – Sponsored by Representative Tommy Thompson – This bill would have created enabling legislation allowing for a local option sales tax. This would have allowed local governments to levy a 1% tax for impactful projects. The tax would be voted upon by the voters in the legislative jurisdiction with sunset provisions once the projects were complete. The bill passed out of Committee but never received a vote on the House Floor and died. Senate Bill 137 – sponsored by Senator Julian Carroll – This bill would have doubled the amount of fees collected by attorneys for workers compensation claims both from the employee and the employer. The bill was assigned to a committee, reassigned to a separate committee then recommitted to the original committee where it died without a hearing. Senate Bill 144 – Sponsored by Senator David Givens – This bill mandates that planning commissions make a recommendation on zoning changes within 60 days of the application’s filing. The bill was altered to allow Louisville up to 120 days and for all other governments to create a local ordinance allowing for up to 90 or 120 days to address zone changes. The bill was signed into law by the Governor.

COMMUNITY Senator Rand Paul Visits the HBA
O
n Friday May 16th Senator Rand Paul spent time with the membership during an informal brown bag lunch. During the meeting the Senator covered a wide array of topics from environmental regulations, to the latest EPA rulemakings, business unfriendly practices in place in our Nation’s Capital, to his vision for the Republican Party as they near this election cycle and the 2016 Presidential elections. Senator Paul recounted that our HBA was one of his first stops when he first decided to run for National office and he considers his relationships here as beneficial and valuable. We are happy to enjoy an outstanding working relationships with the Senator and the other elected officials Nationally, Statewide and locally. This is all due to the hard work of our members and leadership that spend countless hours fostering relationship with not only elected officials but those appointed to important offices as well. The media was quick to capture Senator Paul in the HBA parking lot for quotes about this election cycle and his future plans in National Politics.
