ARMY CORPS OF ENGINEERS (USACOE) V. HAWKES CO., INC.
I
n a recent unanimous decision, the U.S. Supreme Court (SCOTUS) ratified NAHB’s long time held position that property owners should enjoy the right to the federal judicial process in determining if they have a right to develop their land. This has been a long time coming and is a testament to what NAHB can do well for you. We have been speaking with NAHB regulatory and legal staff regarding this decision and are here to help you understand what this may mean to you. The ruling basically says that you can challenge a clean water act (CWA) wetland determination prior to applying for a permit or going through the jurisdictional determination process. Recent change to the wetland plants list and soil chromatography scales have resulted in a two-year process of mechanical hydrological soil monitoring on many properties. Prior to this ruling you would have to exhaust a multi-year process and spend money on a case that is heard by a kangaroocourt within the USACOE itself, which as you can imagine is not tilted in your favor. There simply was no clear judicial remedy that was affordable or practical to address your land’s use. Throughout this process NAHB has filed amicus briefs, lobbied federal officials, and urged the USACOE and the courts that there are significant consequences for property owners should this judicial remedy come available. There have been two additional briefs filed throughout the process leading up to this recent and clear-cut victory. What are the outcomes you can expect? 1. USACOE Field representatives will continue to attempt to over claim wetlands (unlikely but possible) 2. USACOE Field representatives will be far more cautious when claiming wetlands (the most likely) 3. Property owners will become more likely to go through the process of developing their property or preparing the same for sale to developers (also likely) What can we do with this case locally? As an outcome of this case we should make an effort to work with the USACOE District office in Louisville to let them know that, due to this case, courts are going to be far more involved with wetlands claimed by USACOE. As a result, USACOE is opening itself up to two challenges: 1. “Arbitrary and capricious” field determinations where you can claim damages for loss of revenue 2. USACOE is simply claiming wetlands that aren’t and therefore are operating out of their scope of jurisdiction Both challenges open USACOE up for major hurdles that would further hamper their ability to do what they want to do with the CWA and initiate more litigation than what they are dealing with today. It is in their best interest to work with us to, at a minimum, have total unity with regard to how their field representatives interpret wetlands. Perhaps a good option is one that some members have maintained is that USACOE simply use lists created by the Commonwealth for wetlands and stream classifications. It is not but a hop, skip and a jump to apply these legal principles to the stream program as well. 4

2016 Cavalcade Featured 26 New Homes
T
he 2016 Cavalcade of Homes took place on the traditional dates of the first three weekends in May. For over 20 years HBA has produced Cavalcade. This multi-site home show has given consumers the opportunity to view the best homes on the market. Given the number of homes it is easy to understand the need for three weekends. The 2016 show was blessed with 26 new home entries. All communication has indicated good results from the Builders. Each Builder seemed pleased with the number of attendees. HBA believes the success in part is due to the amount of people who visit the website and the induction of technology. HBA offers a mobile app as well as a separate app for each home show. The show apps not only gives navigational driving directions to each entry but also allows the user to go directly to the Builders website by clicking on their logo. The goal for the 2017 Cavalcade of Homes Show is to have at least 35 entries. 12

Modern homebuyers who are looking at newly built homes expect them to be (at least) as up-to-date as the phone they are holding in their hands. Local technology experts weigh in on today's home technology musts...

he term, "smart home," used to be referred to in a futuristic reference, as if making a home "smarter" was only done for homebuyers who were on the cutting edge of technology and had extra money to invest in this amenity. But, today's newly built home needs to be smarter simply to keep up with the everyday consumer's demands. Local experts encourage builders to factor home technology into their list of offerings as homebuyers grow to expect houses to function on a modern level. Desiree Webster, Legrand, Adam Perkins, Masterpiece Audio/Video, and Mike Folzenlogen, MultiSource Home Electronics, are astute in the field of smart home technology. They offered their take on the market and suggestions for builders in positioning themselves to service homebuyers' needs and wants. "There's an app for nearly everything in the house, whether that's your TV, garage door, stove or fridge. Everything today has some type of network connection," Perkins explained. He said that, in general, the building community regionally hasn't focused on extending the network offerings in homes like it should. "We're still seeing things done like they were in 1982. Builders are still pulling regular coaxial wire to televisions. If you buy a TV today, you'll see that they all have smart features, and consumers expect that," he explained. Perkins said builders need to think about homes the way appliance manufacturers think about building their products for today's market and adjust their offerings to meet consumer demands. The popularity of streaming audio and video sources such as Pandora and Netflix, are a great example of how mainstream this technology needs to be. "No one is tethered to their DVD players anymore. They want to make sure their home is networked so they can stream content through their Apple TV," Perkins emphasized. The smart home in today's world ranges from achieving functional tasks from afar, such as making sure the garage door is closed and checking to see if the home is secure to customizing it to program the thermostat, lighting and audio to match specific family members' preferences. Smart home light switches can also trigger the lights to come on if a smoke detector goes off, prompting builders to consider these technologies as more than amenities, but truly functional and safety-focused as well. Why are Builders Hesitant? Webster travels across the country on a regular basis and has experienced initial resistance from some builders who are intimidated to build with smart technologies. According to Webster, builders may have been hesitant to incorporate smart home technology for a variety of reasons. "Many of them thought it might slow down the cycle of building the home or create a lot of follow up phone calls," she said, attributing lack of education on the evolution and reliability of products as a factor. "Everybody had previously thought it was a luxury, but the reality is that you have homebuyers in all stages of life, looking at and expecting home network systems," she explained. Home Security Smart Technology Tops the List of Wants for Buyers Home security using smart technologies has become increasingly popular in recent years, and it's not showing any signs of slowing down. "Smart

home lighting and integration with security systems was never something we did 15 years ago, but now almost every custom home we outfit has anywhere from four to 16 cameras," Perkins said. Home security is top on the list, according to Webster. She emphasized the need for builders to consider this upfront when planning a home, not only to help make things easier for the consumer, but so that builders can identify themselves in the marketplace. Home security systems, at all levels of complexity, are becoming more mainstream, especially as the boomer generation ages. Parents with kids who come home after school by themselves also place a big emphasis on being able to monitor their home when they're away. Smart home lighting and integration with security systems was never something we did 15 years ago, but now almost every custom home we outfit has anywhere from four to 16 cameras." – Adam Perkins, Masterpiece Audio/Video Folzenlogen echoed what his colleagues said about security and kids coming home to an empty house. He said that parents are willing to invest the money to ensure their children are safe, however, like any smart home technology feature, there are different levels. "There are key pads that kids can use to unlock the house with a code. You can step it up and create packages that can also disarm the alarm system and turn on their favorite music and let the parents know they got home safely. The level of service depends on the needs and wants of customers. Not only can you get a text when someone comes home, but you can get a video clip recording of who it was," he explained. Think 'Smart Home Technology' Will Price You Out of the Market? Adding smart home technology to a home's value might prompt builders to think it will price them out of their target market, but local experts encourage builders to think again. There are many ways to scale technology across a broad range of home prices. It can range from the extremely high end customized solution to products that are modular solutions, very quickly installed with little programming. The key is for builders to look at the base elements and package them into solutions for different price points that can be repeated in multiple houses." – Desiree Webster, Legrand The key, Webster said, is connecting with a manufacturer and installer that is reputable and reliable. From there, she advises builders to consider what components they can offer at different price levels and focus on customizing packages to fit different price points. "Someone who is buying a house for $150,000 might be willing to invest $2,000. For this type of consumer, you wouldn't create a package that includes remote shade control, but you would be able to get the foundational elements covered," Webster explained. "Someone who is buying a home at the $250-$300,000 price point might be interested in IP-based central command system with more advanced 5/2016

security cameras that will give them notifications when they aren't home," she added. For homes priced closer to $700,000 and up, Webster said a $10,000 base package investment in smart home technology seems more than reasonable for buyers in this price range. From there, they can build upon it to be as elaborate as they want. After the Build: Will Homeowners Wish They Had a Smarter Home? Perkins said that builders can benefit from studying up on the advances in appliances, and making preparations when planning a build. "Today's flat panel TVs don't have quality audio, so you really need to pull a CAT6 line, which is a fantastic catch-all cable that can connect data, phone or audio. Otherwise, the consumer is calling up Time Warner or someone to come out and do it after the build." He emphasized that builders should consider communicating the value of smart home technology in their bullet point of offerings. Perkins said that what happens when a home is built and it's not outfitted right to serve the consumer's technology needs is an after-the-build resentment on the part of the buyer, which lessens the appreciation of the wonderful architectural elements the home offers. If the homeowner is unsatisfied in one area of their investment, it summons a dark cloud to shadow the other areas. Webster agreed, emphasizing that what homebuyers end up doing after the sale is booking the cable or internet provider to outfit their home to meet their needs when their builder could have done it more effectively on the front end. "If they see a builder who is already offering it and the home is ready to go, they'll be more satisfied with their investment in the home afterwards," she explained. Using Smart Home Technology to Help Sell Homes is More Than Just going Wireless "What we're seeing from buyers is that everyone is interested and 16

looking for smart home technology. The foundation of that is entertainment, peace of mind and convenience. Those are the driving factors," Folzenlogen said. "My best advice for builders is to partner with a company that understands these systems and stays up-to-date on innovative was to incorporate the technology into the homes and can meet with their clients to make sure they communicate on how they want their home to function," he explained. That's a big misconception. It's a combination of hard and structured wiring as a backbone focused on voice, video and data and hardwired network portals. You piggyback that with WiFi access points." He too said the top requests from clients are security, distributed audio, home theater and smart features. "The most popular request is inside and outside security, then WiFi and configuring the home to be able to stream music content. Cameras are big today, and having the ability to view the inside and outside of your home remotely is what consumers are requesting," he explained. "The foundation is there for builders. They just have to pull the trigger on the peripherals. There's a huge marketing advantage for any builder to be able to market themselves to building smart home ready. There is so much money invested worldwide in the term 'smart home,' and consumers recognize it," Folzenlogen added. HBA SIGNATURE EVENT A WINNING NIGHT OUT WITH THE REDS
A
bout 35 HBA members and guests experienced a fantastic event at The Party Deck in the Great American Ballpark recently. The view was great from our reserved area. Although it was a cool evening, heaters and brewskies kept everyone warm. The Cincinnati Reds treated HBA members to a overwhelming victory against the Milwaukee Brewers, 9–5. The ballpark buffet was outstanding. The hot dogs, hamburgers, brats, red smokies with trimmings left everybody very satisfied. Everyone enjoyed the view and game while talking with their peers.
