NAHB MID-YEAR MEETING RECAP

The National Association of Home Builders held their mid-year Board of Directors meetings July Brian Miller 24th through the 28th. While there have been Executive Vice Presifdent more lively meetings of NAHB in the recent years this bmiller@buildersnky.com year’s meeting was rather smooth and free of controversy. Studies are currently taking place regarding online bill payments of dues and new membership models that will culminate in the coming years that will result in more spirited debate and disagreement. The Senior Officers and Association Planning Committee conducted their business on the 24th. National Area Chairs, State representatives and the National Housing Endowment met on the 35th with the Executive Board meeting immediately afterward. Thursday the 26th and Friday the 27th were the most active meeting days; accommodating 38 meetings for members and leadership and 8 meetings for Executive Officers.
A couple of environmental updates: • A new Endangered Species rule governing critical habitat is out and not as beneficial as we would like it to be. The Fish and Wildlife Service pared back the theory of protecting areas that “could” support endangered species but not as far as the “already” support endangered species model as we had once hoped. We will be filing comments to the FWS prior to their September 24th deadline that asserts that critical habitat should only include areas that currently support the species and where the species can physically be found. We urge you to do the same. •
At the committee meeting members spent about an hour with David Hobbie, US Army Corps of Engineers Chief Regulatory Official for the Alaska District. He has held the same position in Mobile and Jacksonville. He is a part of a small working group the Trump Administration has assembled to provide feedback on ways USACE can streamline the 404 program and its processes. We used our time together to address the issues specific to Northern Kentucky and the Louisville USACE District office. He is the first USACE Chief Regulatory official to use Clean Water Act Section 404 money for other CWA section projects as described in an MOA. The first instance is where he used funds to enlarge culverts. He stated he is going to use 404 funds to provide sewers on reservations where native Americans are simply using 5-gallon buckets for those purposes.

The Legacy House is going well. Thanks to all who helped with the Blitz Build. We have more work to do. Remember that our goal is to use as much donated materials and labor as possible to make this a quality affordable home for a low income working family. Other news, long time construction staffer Bob (Uncle Bob) Lutkenhoff retired at the end of August after 10 years of committed service to HONK’s Mission. He will be missed. Jim Broomall, an AmeriCorps volunteer here at HONK for the past four years, has joined our construction staff. He will assume some of Bob’s duties. Also, we are completing a rehab on West 15th St. in Covington and have just started rehabbing a four-bedroom, two-bath house on Greenup (next to a house we finished last year). Lead remediation has been completed on another Covington house which we will begin to rehab. Volunteers welcome. Thanks to all who support HONK.

NEWSROOM NFIP Extended Four Months The Senate voted July 31 to approve House-passed legislation that will extend the National Flood Insurance Program (NFIP) until Nov. 30. The Congressional action came just hours before the program was set to expire. It is anticipated that the four-month extension — which will keep home owners covered through the end of the hurricane season — will give the House and Senate time to hammer out a long-term reauthorization of the NFIP. NAHB has been at the forefront of this issue, working with lawmakers on a viable, long-term bill. The House last year approved a five-year reauthorization that would keep the NFIP fiscally sound and let builders provide safe and affordable housing. The Senate continues to work on its own version of a long-term reauthorization of the program. It is well known that in the 2013 cyber-attack on Target, hackers got access to credit and debit card information on 40 million consumers, an attack that cost Target more than $250 million. It is less well known that the hackers gained access to the Target payment system through an HVAC contractor. With nearly every aspect of the home building industry moving online and most information stored in digital formats, it’s time for every home builder to take a close look at their cyber security and potential exposure to liability. Home builders store and electronically share a trove of personal and financial data on clients, potential clients, vendors, suppliers, partners and more. Some of this data includes payment information. And most business-critical information – like building plans and proposals – is also kept in a digital format. It’s little wonder that a residential construction business might be a target for cyber criminals. “It really is not a matter of if, but when,” said Kristen Hilton, CIPP/US, an attorney with Sussman Shank LLP in Oregon. “And, of course, how much it will cost.” Loss of trade secrets, loss of reputation and even illicit bank account access are certainly huge concerns in a cyberattack. But the liability associated with exposing others’ personal and sensitive information to intrusions is where the greatest risk lies. “There are many state privacy law implications to storing information containing personal and financial data,” said Hilton. “If that data were to be exposed, there could be legal and civil liability.” Hilton notes that construction companies, like most other businesses, have numerous points of entry for malicious hackers. “Many people connect their company laptops and tablets to public Wi-Fi,” she noted. “That could be a vulnerability.” The first line of defense is strong digital information training for all employees, not just those who operate computers and other connected devices. DOL Officially Kills ‘Persuader Rule’ In a victory for NAHB, the Department of Labor in July officially rescinded the Obama-era “Persuader Rule" that would have re- uired lawyers to report to the DOL when counseling employers concerning union organizing. The regulation was issued in 2016. However, before it could be implemented, NAHB scored a major legal victory when the U.S. District Court for the Northern District of Texas granted a permanent stay of the Persuader Rule. 8

NAHB, HBI Pledge to Train 50,000 Workers Attending a White House event on workforce develop- ment, NAHB Chairman Randy Noel pledged that NAHB and HBI will educate and train 50,000 new workers over the next five yearsfor careers in the construction trades. President Trump signed an executive order that establishes the National Council for the American Worker, which will develop a national strategy for training and retraining workers for high-demand industries. As part of this initiative, the administration is asking companies and associations to sign a pledge committing them to expanding apprenticeships, increasing on-the-job training and providing students and workers the training and opportunities they need to succeed in the American workplace. The Home Builders Institute, NAHB’s workforce development arm, will expand its training, certification and job placement programs for underserved and at-risk youth, transitioning military, veterans, ex-offenders and displaced workers.
Looming $1 Billion Tax Increase on Housing President Trump’s proposed 10% tariffs on $200 billion worth of Chinese imports — including nearly 500 products used in residential construction — could have major ramifications for the housing industry. Of the planned $200 billion in tariffs, NAHB economists estimate that $10 billion of goods used by the home building community would be subject to the 10% levy. Put another way, if the tariffs take effect, this would represent a $1 billion tax increase on residential construction. This tax increase would come on top of the current 20% tariffs on softwood lumber imports from Canada. Since the beginning of last year, lumber prices are up more than 40%, due in large part to the tariffs.

New HBAK Life Directors
D
uring the recent summer HBAK meeting in Louisville, several HBA members were named HBAK life directors.
To receive this honor, a member must demonstrate dedication to the association by serving at multiple levels. They accumulate points by serving in at least two levels: local, state and national. The HBAK president and associate vice president automatically become life directors at the end of their terms.
The most recent recipients are good examples of the dedication required to become a life director. One recent inductee served as local president twice, served on and chaired many local committees, faithfully attended local meetings, served as state area vice president, rarely missed a state meeting in 20 years, attended HBAK Day at the Capitol each year and has attended the International Builders Show 10

more than 20 times. It’s easy to see that he is a committed member who understands the rewards of association membership. Without these members, our association would not be a strong force in our communities, state and nation. They have influenced politicians, at all levels, and are not only leaders of our association but within their communities. It is a great honor to be named an HBAK life director. Congratulations to them all. We hope that many more members will strive to become a part of this elite group. Large Local Peer Group to Visit NKY T
he Large Local Peer Group is a private shared knowledge group of 18 (give or take each year) of the most innovative association executives that serve builders associations not necessarily affiliated with the National Association of Home Builders (NAHB). NAHB does not endorse the group. The group is funded through the general funds of their local associations and by sponsorship.
The peer group are influencers among their local associations and on a national stage. Many in the group have served or are currently serving in the NAHB federation in various capacities of governance. Back home, they work to bring affinity programs, education and services to their members and can connect you with their membership. All together this attending this year’s Large Local Peer Group control $33.32 million between their combined budgets. Their combined memberships total over 12,000 builders and associates (10.6% of the NAHB federation), not to mention affiliate members totaling in the thousands. The group trades ideas and shares what is working well and not so well for their respective associations each year. The dialogue does not end at the annual retreat but carries on over emails, phone calls and NAHB meetings during the year. The retreat provides a forum where Executive Officers can focus on their performance and effectiveness that leads to better run associations. 12

ith the new school year about to start, it’s exciting to see all the progress and the plans for the upcoming year. With renewed participation from area school districts, to our daytime introductory to trades program, to our long-standing traditional evening adults program, exciting things are happening at EBI. We are especially excited to welcome Kenton County Plumbing inspector Pat Kennedy as our new plumbing instructor, Steve Borne for welding and to have a commitment from Greg Williams to take over our daytime HVAC and Plumbing courses.
The need has never been greater to train and hire skilled tradespeople into the construction field. With a workforce shortage approaching WWII levels, the Enzweiler Building Institute is ready to be your go-to source for hiring skilled trades people looking to enter our industry. The Kentucky room block is located at Paris Hotel and Casino. There is access to the monorail by going through the shops to Bally’s next door. The deadline to reserve a room within the room block is December 7th but we urge you to register your hotel stay soon as the block often sells out many years much earlier than the deadline. Education is one of the best opportunities for members at the show. Preshow courses occur beginning Saturday February 16th and run through Monday the 18th. Opening ceremonies are at 8:00am on Tuesday the 19th. The main schedule of education sessions run Tuesday through Thursday the 21st. At press time the full list of education sessions had not been announced. We recommend you log onto www.buildershow.com for information about the outstanding sessions at IBS. For those involved in NAHB Governance, the Senior Officers and Association Planning Committee begin on Friday February 15th. On the 16th State Representatives, National Area and Associate Chairs meet as well does NAHB’s Executive Board. The committees and subcommittees meet on both Sunday the 17th and on the 18th.
