2013 Year in Review

O

h what a difference a year makes! That sums up 2013 in the best way imaginable. The leaders of the HBA have guided your organization through some very troubled waters. Just a few years ago the association was challenged by numerous issues and has come out of the challenges much better than we were heading into the housing depression. This year was marked with improvements and smashing successes. We have implemented a newly structured Board of Directors and Executive and Nominating Committees, giving Associate Members a greater voice than what they enjoyed in the past. Leaders worked to identify where committees were duplicating processes, what committees were relevant and exactly how many meetings were necessary. Changes were made to create time to be successful in 2013 and it worked. This was the second year for HomeFest’s rebirth. The show had not been produced since 2005 and after a smaller scale version of the show gave the event life, 2013 saw an outstanding show at prestigious Triple Crown. Thousands of visitors came through the five homes featured at the show; creating top of mind awareness of new homes and new home communities. This allowed the HBA to connect members with their customers. The Parade of Homes was featured in Saylor Woods. The show created outstanding leads for the five builders invested in the show and was another valuable way to keep our industry at the top of the homebuyers’ minds. We have not had a Parade of Homes since 2007 and had not had both a Parade of Home and HomeFest during the same year since 2000. Now that’s saying something! Our Business to Business Events all saw improvement as we set an all-time attendance record for Table Top Night, held at the new Horseshoe Casino Downtown. In order to connect members with their customers we also saw improvements with the Annual Golf Outing, Annual Associates Outing at Elk Creek, and our Sales & Marketing Councils Annual Awards and their Builder/Realtor Bash. Advocacy services continued their high level of member support through the leadership of the Land Development Council Board of Governors, the State & Local Government Committee and the Building and Housing Codes Committee’s work. (see page 20 for a review of the LDC’s work in 2013). The HBA hosted dozens of State Representatives and Senators, Congressman Thomas Massie, County Judges/Executive and several Mayors, Administrators and appointed officials over the last year. For the first time in over a decade the HBA Leadership made a trip to Frankfort during the General Assembly to lobby our legislators on bills going through the political process. Of the two bills that were of importance for the leaders attending that day both were passed and our group was that more effective for the outreach. The Enzweiler Apprenticeship Program saw its highest enrollment EVER! 200 students are participating in the program. The program was awarded with its third Association Excellence Award for Workforce development in 4 years. For the 2012-2013 school year plumbing and welding programs have been added. Member education was improved by adding our new “Entrepreneurship Boot Camp” series which helps our professional member’s strengthen their ability to run their business more effectively. Staff changes have resulted in a more streamlined operation that works. I can honestly say this is one of the best HBA staff I have ever witnessed. Combined with the Leadership of the HBA this is one extremely talented and dedicated group of outstanding individuals I am proud to work with. As a result the HBA is far better off financially and will fund reserves in 2014 for the first time since the great recession. 2013 was a real turnaround year for our association. We began several new programs for members. We were only able to do so as a result of the changes our past leaders have been able to achieve. Our top line revenue is up, bottom line is up, consumer shows delivering, business to business events soaring, and education programming heading for the sky. We are all thankful for all of the members that helped us make 2013 a great year of success. We look forward to 2014 as we continue to make the HBA the place to be.

“Play or Pay” Mandate:

Get Informed Employers

T

he Patient Protection and Affordable Care Act, otherwise known as The Affordable Care Act or “Obamacare,” was signed into law by President Obama on March 23, 2010. For employers, the most important component of the Affordable Care Act is the “play or pay” mandate. Most people are aware of the law and its controversies, but most do not understand its requirements and impact. Notably, beginning in 2015, “play or pay” requires employers with fifty or more full-time employees to either offer their employees adequate health insurance or pay a penalty. “Play or pay” was originally planned to take effect in 2014, but on July 2, 2013, President Obama delayed its implementation until 2015. A full-time employee is defined as an employee who works at least thirty hours per week. Thirty hours may be less than an employer’s internal classification of full-time. Employers should take a close look at their employee classifications before quickly determining that it does not meet the fifty-employee threshold. Although “play or pay” does not take effect until 2015, employers should begin planning now, because it is a critical economic decision whether to offer adequate health insurance or accept the prescribed penalty (i.e. to play or pay). To “play” means to offer health insurance to

employees that meets the specific requirements of the Affordable Care Act. To comply, health insurance must meet three basic requirements: (1) the coverage must be offered under an employer group health plan (provided, dental and vision are not required), (2) the cost of the employee’s contribution cannot be more than 9.5% of its household income; and (3) the employer must pay at least 60% of the actuarially projected costs under the plan. Contrarily, to “pay” means payment of a penalty for failure to offer health insurance to employees or the failure to offer adequate health insurance to employees. If an employer fails to offer health insurance entirely, it must pay a penalty of $2,000 per year for each full-time employee, excluding the initial thirty employees. If an employer offers health insurance, but such health insurance does not meet the three requirements discussed above, then the employer must pay $3,000 per full-time employee that obtains a subsidy from the government. The Affordable Care Act, and particularly the “play or pay” mandate, is extremely complex and the above discussion only tips the iceberg. Employers who believe that they may have more than fifty fulltime employees are encouraged to seek additional information and advice sooner rather than later- 2015 will be here before we know it.

Entrepreneurship Bootcamp What is “Entrepreneurship Bootcamp”? Northern Kentucky HBA has a long standing commitment to its member companies, be they the smallest one man operation or the largest multi-state corporations. In an effort to help all of our members, we have developed a one year program that has a focus on helping every company navigate the economic recovery that is moving full steam ahead. For almost a decade, area businesses have been struggling to make it every day and learning to survive. Hundreds of companies folded and others had to shrink down and weather the storm. While those strategies were necessary at the time, all of the good that they did in help companies through hard times can be quickly undone if companies fail to restart and jump back into the marketplace. Being, “Stuck on Survive”, can destroy a company when others are embracing the new economy and moving ahead.

To combat this, we have created an education track taught by movers and shakers in their fields, here to not only help you our members, but to foster the continued growth of the Northern Kentucky/Greater Cincinnati Area. xciting times for HBA! For the first time in many years, HBA was able to produce TWO single site home shows. Two of the homes at the Parade of Homes were sold before the show began. More home shows, homes being sold and new Registered Builders are reasons for HBA to celebrate. The 2013 Parade of Homes presented by Adam Miller Homes was held October 11-26th. The single site show was held at Saylor Woods in Independence. Five Registered Builders came together to offer outstanding homes at affordable prices. Moranda Homes, Drees Homes, Arlinghaus Builders, Adam Miller Homes and Lunsford Custom Homes worked hard to make this a successful event.

Someone new to HBA and to the show is Rob Lunsford of Lunsford Custom Homes. Rob joined HBA prior to the Parade of Homes show when he had a buyer interested in building a home in Saylor Woods. HBA is pleased to welcome Lunsford Custom Homes as a Registered Builder. Hopefully you did not miss seeing the quality of work he displayed during the show. Wiseway graciously sponsored the People’s Choice Awards. Attendees were encouraged to vote before exiting the site for their favorite home and favorite interior. When the ballots were counted it was obvious that ticket holders liked all of the homes. The number of votes for each Builder made it a close race but two came out ahead. The Stonechase by Lunsford Custom Homes was voted Favorite Home and The Schible by Adam Miller Homes won Favorite Interior. Producing a show in October has its risk. Fall in Kentucky is sometimes challenging when it comes to weather. For the most part show goers enjoyed mild temperatures and pleasant conditions. The Realtors Day was the exception. American Mortgage sponsored a wonderful Realtors Day on the first Wednesday of the

show. Despite the dampness there were devoted Realtors who came out to enjoy a luncheon and view the five homes. HBA would like to thank NKAR for helping us get the word out to Realtors. NKAR is a great resource and partner for HBA. We appreciate the support and services they provide. We also want to give much deserved credit to the Developer of Saylor Woods, Terrace Holdings. Adam Chaney and Phil Drees have spent countless days preparing for the Parade of Homes. In the beginning stages they created and implemented a premarketing campaign focused on bringing home buyers to our Builders. With this program HBA was able to attract the five Builders needed to create another single site home show. Finally, thank you to all members who came out to show support for this show. From the preview party to the last day of the show our HBA membership proved strong. Without the sponsorships and volunteers this association would not have delivered a successful event. Northern Kentucky Home Builders Association is strong and has survived because our members pull together and make things happen.

Land Development Council Provides Valuable Advocacy Service to HBA Members in 2013

T

he Land Development Council (LDC) of the HBA was engaged in several efforts in 2013 that benefitted the homebuilding and commercial construction industry. About a dozen individuals from the LDC worked year round and in some occasions several weeks each month to provide comments on local and statewide regulations and agency rules in order to keep your industry going today and in the future.

The LDC met throughout the year resulting in some excellent learning experiences. The group met twice with Northern Kentucky infrastructure partners (developers, utility companies, city and county administrators, planning commissions, service providers, water districts, SD1, electric companies, etc.) to discuss challenges surrounding development and changes occurring within the partners’ specifications, regulations, rules and plans. They held an annual meeting with Sanitation District 1 where they presented their awards for developers and contractors. The LDC hosted the County Judges/Executive for an update about progress made in the counties and for the Judges to hear from the LDC regarding issues they face doing business in their respective counties. A presentation was given to the LDC regarding new piping and stormwater systems that address the increased mandates concerning stormwater. A large event was held at the Hofbrauhaus between the LDC and Greater Cincinnati HBA’s Ohio Valley Development Council where two NAHB regulatory staff were flown into town to explain to the group the changing regulatory situation coming from Washington D.C. in stormwater and endangered species that will affect our entire industry locally. The year is being capped of with a visit from the Northern Kentucky Caucus where the LDC, HBA Leadership and the HBA’s State & Local Government Committee will host our area’s State Representatives and Senators in order to communicate our industry’s positions and to hear what to expect from the upcoming 2014 General Assembly. The event will take place on December 18th at Noon at the HBA Building Center. Beyond the LDC meetings and committee meetings, members of the LDC were engaged throughout the community in Northern Kentucky. Several members met on multiple occasions with the Northern Kentucky Chamber of Commerce’s Energy and Environment Committee where our Executive Vice President, Brian Miller is involved on a monthly basis. Several members along with Miller have been on a special committee working with the Boone County Fiscal Court to have a dialogue and come up with solutions to sewer capacity problems facing Hebron. Currently, Hebron’s pump station complex cannot handle any additional connections which will shut down development in Hebron in the next year and a half to two years if the issue is not resolved. Innovative ways to fund sewer projects are being discussed and the committee continues to meet at press time. Boone County Planning Commission Committee Chairman; John Toebben, Toebben Companies The committee met over a series of weeks to read through and comment on the proposed Boone County Planning Commission’s Zoning Regulation update. The committee was successful in providing flexibility in the updated regulation. For instance, there is now the ability to build 20

attached housing in some commercial zones. More options were allowed throughout the conservation and open space/cluster subdivision language highlighting design incentives to create a more innovative and alternative style of community. Patio home options were expanded to include different designs and dimensional length. Also, exterior materials were expanded to allow for more variety in appearances. Many other items were changed in the regulations, too many to note here. Kenton County Planning Commission Committee Chairman; Matt Coppage, Coppage Construction Co-Chair: Mike Riegler, Len Riegler Blacktop The committee met some time ago to provide comment regarding the update of the County’s Subdivision Regulations. Over an elongated period of time several elected and appointed officials in Kenton County were requesting a street specification that would have increased the cost of a new home in Kenton County, on average, $3,800. Over a period of more than a year the LDC successfully changed the outcome of the specification. Work is still ongoing with several groups regarding the road specifications but the result is that we will end up with better roads in Kenton County, a model for Cities and the County to maintain their roads and a far lower cost to the homebuyer than the initial estimates. Dozens of other comments are being reviewed at press time and the outcome should be known shortly of the LDC’s efforts. At the same time members of the LDC have been engaged in the creation of a new Comprehensive Plan for Kenton County. For over a year these members have drafted comments, participated in committees at NKAPC, attended public forums and provided valuable feedback to the NKAPC staff regarding the direction that Kenton County may go towards over the next 30 years.


Get ready for the Land Development Council’s 2014’s Event LINEUP

Water Districts Committee Chairman; Bob Schroder, Arlinghaus Builders The committee worked with the Northern Kentucky Water District to create a more business friendly developer agreement. At press time work on this initiative is still ongoing. The committee provides feedback to the District every year regarding their standards and specifications. Powered Utilities Committee Chairman; Andy Casto, Thelen Associates The committee met with individuals from Duke Energy regarding street lights and a host of other issues. At press time changes to Duke Energy’s manuals were being made to clear up any ambiguity regarding with the choices developers have to pass on to homeowners. Environmental Issues Committee Chairperson, Michelle Bollmann, Viox & Viox The committee provided comment regarding potential changes in monitoring and identifying the presence of the Indiana Bat and Indiana Bat habitat. These comments were submitted to the US Fish & Wildlife Service and are being reviewed at press time. The committee just recently met to provide comment on US Environmental Protection Agency rulemaking considerations regarding Storm Water Quality Standards. Sanitary Sewer Committee Chairman, Mike Schoettelkotte, The Drees Company Co-Chair: Ron Difarig, Dudley Construction The committee has been engaged all year with Sanitation District 1 (SD1). The committee members have addressed the SD1 board for several months regarding what the industry sees as serious issues regarding regulations and sanitary sewer service. These issues include: • Sanitary Sewer Capacity in Hebron (currently there is no more ability to grant capacity beyond what has been reserved) • Post Construction Storm Water Facility Maintenance (SD1 regulations demand that all landowners take over responsibility for monitoring, maintaining, repairing, and replacing storm water systems) • Easement Language (LDC members are working on simpler and easier to use language) • Developers Agreement (LDC members are working to create a more business friendly agreement) • Procurement (LDC members have succeeded in easing procurement requirements resulting in a more cost effective and growth friendly process) • Inspection Reports (LDC members were successful in SD1 sending out initial and end of warranty reports) • Release of 10% taps (LDC members were successful in allowing 10% of taps to be released to a developer prior to testing; speeding up the time to build a model or market home by 30-60 days)

April 16th – Scott Smith, Smith Management Group, the State of Stormwater and the Development Community; noon, HBA Scott Smith founded SMG in 1989 to focus on environmental management issues facing industry and business in the US and Canada. At that time, Scott had been solving problems from water to air issues, from Texas to Ontario, for more than 15 years. Over time he has added industrial hygiene, health & safety services to help his clients address workplace issues. Scott served as Deputy Director of the Energy and Environment Cabinet under Governor Ernie Fletcher. Along the way, he translated his ability to connect with government, both on the regulatory side and in the legislative arena to build a government services practice. And as energy has become so important to us all, he has learned to solve problems and find practical, environmentally sound solutions to the increasing need for energy. May 21st – Joint LDC/OVDC annual meeting – Randal O’Toole, Senior Fellow, The CATO Institute, urban growth, public land, and transportation issues; 2 pm, Hofbrauhaus Newport O’Toole’s latest book is American Nightmare: How Government Undermines The Dream of Homeownership. O’Toole is the author of numerous Cato papers. He has also written for Regulation magazine as well as op-eds and articles for numerous other national journals and newspapers. O’Toole travels extensively and has spoken about free-market environmental issues in dozens of cities. An Oregon native, O’Toole was educated in forestry at Oregon State University and in economics at the University of Oregon. June 18th –Annual SD1 meeting; noon, HBA Come to learn about the latest in regulations, best management practices, developer mandates, and the future of SD1 at this informative meeting. SD1 will award a developer and a contractor their annual awards.
