An HBA Grass Roots Success Story

don’t have to tell you how difficult times have affected our industry. You know it. You’ve lived through it. At times like these our industry needs all the help it can get. Recently the home building federation achieved a great success in the passage of the Farm Bill. This victory could not have been accomplished without the grassroots network beginning with members in Northern Kentucky, throughout the Commonwealth and the legislative staff at NAHB. The issue was first brought to our attention by Ed Collins with Kentucky Federal Savings and Loan. To cover the details we are copying a recent letter sent by Ed to our HBA on the following page. Ed’s letter is spot on. Also, there was an active dialogue ongoing for years around the state and nation on this issue. First, not only did the federation begin to investigate the effects of this potential change we also began utilizing the strengths of our grassroots here in Kentucky. We talked with members around the state and through our relationship with Marshal Todd, a builder from Nancy, Kentucky began talking with the House Appropriator Hal Rogers. Congressman Rogers worked with us diligently with the aid of NAHB legislative staff to extend the previous lines through the series of Continuing Resolutions that occurred over the last few years. We worked to make the USDA RD 502 program a priority for NAHB and at the 2012 spring board and legislative conference were successful in having this program as part of our conversation while on Capital Hill and back here at home. Ultimately NAHB succeeded in getting this inserted in both the Senate and House versions of the Farm Bill and worked through the Conference Committee to its successful conclusion. In a recent press release NAHB noted…”NAHB estimates that in 2014 alone, this will generate $1.2 billion more investment in housing in these areas, including construction of new singlefamily and multifamily homes and remodeling. Breaking this down even further, it means that each of these 900-plus communities will receive on average an additional $1.3 million in economic activity this year in the form of loans and grants for new construction and remodeling.” The Home Builders Association of Northern Kentucky is pleased by the outcome of the work across the federation. This effort was one of the best examples of how the grassroots network, local, statewide and nationally, can be mobilized to achieve a victory for housing. We hope that as our industry continues to improve that we can achieve more accomplishments in the legislative arena that have a positive impact on our industry and your business. On behalf of the citizens of Northern Kentucky, I would personally like to thank the Home Builders Association of Northern Kentucky for their hard work and dedication to help save the USDA Section 502 Guarantee Loan Program for some of our local communities here in Northern Kentucky. As an Approved USDA Lender, in early 2012 we were being notified that based on the 2010 Census over 900 communities throughout the US and some here in Northern Kentucky could be eliminated as eligible areas for the USDA Guarantee Loan Program. For somebody that has been originating USDA Loans for nearly 20 years, I knew the loss of this program could have a big impact on our local housing market and hurt our local builders (as the areas that were due to be eliminated were located where much new construction is occurring). At that time I contacted Bob Schroder at Arlinghaus Builders to explain what may be occurring and to see if he could try and help us save this Program. Bob suggested I call the Home Builders Association of Northern Kentucky, which I did. That was the best piece of advice I received. After contacting the Home Builders and explaining this situation they said they would do some research to see if this Program was one that would be worth fighting to save. Apparently after talking to other Home Builders Associations throughout the US they found out it was. Over the next two years there were many meetings in Washington to try and have the current eligible areas grandfathered back in or some type of language added to provisions to save these areas. With the government in disarray this fight seemed to become harder and harder. But the persistence was there. Eventually they were able to get some Senators and Congressmen to agree that losing this Program could hurt the housing market in those 900 + communities. A new USDA Provision was created and that provision was attached to the Farm Bill. That Farm Bill finally passed the House at the end of January and was passed by the Senate in early February. It was signed into law by the President on February 7, 2014. The passage of this Farm Bill included the provision for grandfathering all current USDA Eligible Areas to remain Eligible until 2020 and changed the wording regarding eligible populations from 25,000 to 35,000 in areas outside an MSA. In doing so Independence and Burlington have now been deemed Eligible for the USDA Rural Housing Loan until 2020. According to the State Office approximately 4,300 USDA Loans were guaranteed in Kentucky in fiscal year 2013. Of those 4,300 approximately 30-35% were originated in the Northern Kentucky area. Itâ€™s impossible to say the exact amount of how many of those loans were guaranteed in Independence and Burlington (as those two areas are by far the most common for the USDA Rural Housing Loan in Northern Kentucky) but simple numbers will show that by saving these areas for a minimum of 6 more years it could have a staggering affect as to how many families will be able to buy a home in those areas in the future. In addition it should provide a huge stimulus to our local economy and a boost to the tax revenues for those Cities and Counties. Therefore the Home Builders Association of Northern Kentucky should be truly applauded for their hard work and dedication for taking on a difficult task and doing whatâ€™s best for their members and their local community.

In 2013 the HBA launched new advertising campaigns for its consumer event like the Cavalcade of Homes. As a result we have experienced greater consumer response in 2013. We will invest in $35,000 worth of media and combine that effort with an expanded public relations initiative that will result in greater exposure for the Cavalcade of Homes. The show guide will be distributed through Cincy Magazine and NKY Magazine.

Gold sponsors will receive exposure through our advertising campaign as their company will be mentioned as a sponsor of the show, and their project will be featured on any print, TV or digital advertising. HORSING AROUND IT’S NO JOKE IN WORKERS’ COMPENSATION By R. Stephen Burke Esq.

ou don’t have to watch reruns of “The Office” to know about odd things that can happen in the workplace. Perhaps you’ve seen employees arm-wrestle each other at work. Maybe you’ve seen co-workers chase each other down the hall or around the job site. If so, you have entered the grand domain of “horseplay,” and that one word alone can be a central issue as to whether workers’ compensation coverage exists. Most people believe any kind of injury at work is covered by workers’ compensation. Yet, there are dozens of exceptions. A heart attack on the job may not qualify for comp benefits, an unexplained fall may not be covered, and drug use or intoxication may negate coverage. Horseplay also is a widely recognized defense to a workers’ compensation claim. The courts generally recognize horseplay as a deviation from work. If the play is totally without a work-related purpose or sanction and it is ongoing, then resulting injuries probably are not compensable. In other words, if the horseplay is independent and unconnected with employment, then comp benefits may be denied. Here are some examples from cases in Kentucky, Ohio and even Tennessee: • Arm-wrestling – A worker suffered a broken arm in one of many arm-wrestling contests at a county jail. The jailer did have a policy requiring employees to be physically fit and did allow them to work out. However, the courts ruled there was no coverage because the jailer had never consented to the arm-wrestling or turned a blind-eye to it. Had the jailer known about the armwrestling and permitted it to continue, the outcome likely would have been different. • Chasing the office thief – An employee tripped after chasing a co-worker who had regularly pranked him by taking his stapler. There was no comp coverage because chasing the coworker went beyond the scope of anything that was expected on the job. There were other means available to recover the stapler, and chasing someone through the office was horseplay – especially when the other person was active in playing a prank. • Throwing the heavy tool – Comp coverage did exist when a construction worker asked a co-worker to hand him a hammer, but the hammer was thrown instead. This may have constituted horseplay on the part of the thrower, but by not the person on the wrong end of the hammer. There was coverage because the injured worker had not consented to the thrower’s horseplay. • Tough guys square off – Two warehouse workers were arguing about who was tougher, and both had playfully punched one another. One was seated on a forklift, and the other was standing beside it. The forklift operator told the other he was done arguing and to back off. The forklift driver then ran over the other worker’s foot. This was compensable, even though the co-worker had not yet backed away. The forklift driver had declared the argument over, and thus was no longer engaged in horseplay. He also had a duty to operate the forklift safely when he knew others were nearby. As can be seen, incidents of horseplay can be a close call. The most important lesson is to take statements as soon as possible after an incident, take scene photos if necessary, and consult your carrier or counsel about whether the horseplay defense might apply. The cast in “The Office” gets away with a lot of shenanigans, but of course, they don’t have to pay the bills! R.
