The New Year at the HBA
T
he leadership of the HBA has been working on the vision of the organization for a year and has developed their three year business plan of what the HBA will look like in the future. I would be remiss if I didn’t thank the large group of leaders that have met, reviewed and molded the plan into what it is today. The plan is a mission focused plan that centers on advocacy, political action, communication, education and connecting our members with their customers. Also, the plan will fund building reserves to maintain the HBA Building Center as a vibrant location our members can be proud of. Moreover, legal reserves and investments will begin being built. So what, you ask, will the HBA do as the first year of the plan takes place? First, the HBA will work on forming a Commercial Council. HBA leaders will spend the coming years meeting with commercial builders and developers to encourage them to participate in a new Council. The Council will function as a committee and will serve the members in advocacy as we meet with all local agencies involved in development and construction in a larger voice. The Council will also create a networking component allowing members to create business contacts and connect with their customers throughout the year. The Enzweiler Apprenticeship Trades School will expand its programming to include a two year masonry program to meet the demands of our growing workforce and the labor shortages in this important field. The school will look at funding resources to expand on capital improvements for future programming over the next three years. A daytime program for high school students will be pursued in order to repair broken career pathways to our industry as some high schools in our area have dropped traditional trades education as part of their curriculum and to continually communicate the possibilities of careers in our industry to students in other schools that have continued to provide traditional trades training opportunities. A new formalized peer to peer dialogue and problem solving program will be created this spring that allows for builders to meet with builders, remodelers with remodelers and developers with developers so that they may share new ways to help solve each other’s problems they face at their businesses. Many changes are afoot in communication. Expect changes to this publication, the Northern Kentucky Builder magazine as we look to engage a freelance writer to improve the content of the publication and turn this magazine into a true professional trade journal for Northern Kentucky. The focus of the Northern Kentucky Builder will be to better tell our story about what the HBA is doing for you and to recognize those volunteers working hard to represent you within the HBA. Expect to see regular reports from our councils, committees, our leadership and staff on what is going on today at the HBA, what happened recently and what you can expect from your HBA as we focus on what the organization does for you week in and week out. Our media and public relations will be improved through better strategies in media communications, social media, public policy positions, and a renewed “Do Business with a Member” campaign. We will be engaging the assistance from a freelance advertising professional in order to help drive advertising and sponsorship participation so that we may deliver relevant information in a valuable manner to our members. The HBA will focus on its brand by auditing its current brand, the same way large corporations do, so that we may manage the HBA brand and improve it if gaps exist in the future. We will seek out HBA members and relationships that wish to serve on appointed boards throughout Northern Kentucky in order to ensure that our area remains a business friendly environment in the face of ever changing regulations and policies of our local agencies. If you are interested in service on an appointed board please contact us to let us know so that we may connect you with elected officials charged with board appointments. Opportunities exist at planning commissions, SD1, Water Districts and so on. We have already launched a new tiered giving campaign for the Political Housing Club (see page 23) of Northern Kentucky where those contributing at higher levels will receive recognition and celebration at a higher level to thank them for their support of the Political Housing Club of Northern Kentucky. Lastly we will focus on continued improvements to our consumer shows and business to business events. We have had success bringing HomeFest back from a long slumber and will continue to use shows such as this, the Cavalcade of Homes and the Tour of Remodeled Homes as outstanding opportunities to connect you with your customer and raise the industry’s professionals up as the best there is to offer in new and remodeled homes in Northern Kentucky. These shows help you build your business and increase your sales as they are integral tools you cannot find anywhere else. Our business to business events like our Golf Outing, Table Top Night, Associates Outing and our Sales & Marketing Council’s Builder/Realtor Bash, Annual Awards, Mix and Mingles, and new Annual Economic and Housing Outlook are all growing and providing valuable face to face time with your current and new customers. That all sounds like a big challenge but I know that your staff, leadership and committees look forward to these challenges as we continue another exciting year upward at the Home Builders Association. LEGACY KITCHENS WINS STATE DESIGN & REMODELING AWARD
T
he Home Builders Association of Kentucky (HBAK) recently announced the winners of the 2013 Kentucky Design & Remodeling Awards. Under the category of Kitchen Remodel, the President’s Award was bestowed to Cheryl Stegman of Legacy Kitchens. Cheryl notes, “ I am so honored and grateful to have been awarded the HBAK Presidential Award for a Kitchen Remodel that I designed earlier this year. Every project that I have the privilege to work on is a special one. As you know, our kitchens are the hearts of our homes and most everyone has a different idea of what their “Dream Kitchen” would be like. It is my job to listen to my clients and to incorporate as much of their “wish list” as possible with an added “Wow-factor” in a practical but personalized design. I am passionate about Kitchen design and receiving an award like this encourages me even more.” We congratulate Cheryl on this outstanding accomplishment. THE NEW I-9 FORM Written by Nick Birkenhauerl
E
mployers should take note that they are now required to use a new I-9 Form. Effective this past May, the new form replaces all prior versions of the form and must be used for all newly hired employees. In addition, the new form must be used to re-verify employees whose documentation is expiring. The new form can be found on the U.S. Citizenship and Immigration Services (“USCIS”) website at http://www.uscis.gov/files/form/i-9.pdf. Employers should discard any unused copies of the old form, as it can no longer be used for any purpose. If you’re unsure whether or not you have the correct form, a simple way to verify you are using the new version of the form is by looking at the bottom left-hand corner of the document, which is stamped “Form I-9 03/08/13 N.” There are several changes to the form itself that employers should be aware of. The new I-9 Form reflects three changes. First, and most importantly, new information is requested about the employee, including email address, telephone number and foreign passport information. (Note, however, that the email address and telephone number fields are optional.) Second, the form’s instructions have been updated to provide a more detailed explanation of the information required. Finally, the form
reflects a new two-page format, with the first page relating to employee information and attestation, and the second page consisting of the employer’s authorization and re-verification. Employers should periodically check their files to ensure that they have a valid I-9 Form on file for every employee. Under federal law, employers are required to complete and maintain an I-9 Form for all newly hired employees, and to make those forms available for inspection during business hours to the U.S. Immigration and Customs Enforcement Bureau. Employers also must retain the I-9 Forms of former employees for a period of at least three years from the date of hire, or for one year after the employment relationship terminates, whichever is longer. Failure to properly maintain I-9 Forms for employees can lead to civil and, in some cases, criminal penalties. Likewise, failure to use the new I-9 form may also lead to penalties. In the wake of these changes, now is a great time for all employers to review their policies and procedures to ensure that they are in compliance with the law. Land Development Council Hosts Northern Kentucky Caucus
T
he Land Development Council hosted members of the HBA and its State & Local Government Committee at their annual Northern Kentucky Caucus meeting. Paul Metzger, President of the Land Development Council, of Fischer Homes, presided over the meeting. Dozens of HBA members attended the event to hear about what the Caucus members expect to see coming from the General Assembly in 2014. The 2014 session is a “long session” year, meaning that it is a session where the legislators will deal with the budget. As explained by the Caucus members in attendance the state is essentially broke. While Kentucky will receive more tax revenues than it did in prior years the increase will not be able to cover the increases of pension liabilities for public employees. While this issue will ease in upcoming years due to legislative fixes implemented in the 2013 session, 2014 and 2015 will prove to be very difficult and lean years in Frankfort. During a question and answer session subjects were addressed such as the Brent Spence Bridge, KY Route 536 construction funding, KYNECT the State Health Care Exchange, exempting Association Health Care Plan assessments for the exchange, workers compensation law, Sanitation District 1, environmental regulations, and other issues facing Northern Kentucky. During the meeting a document was handed out that represents the Statewide Policy Positions of the Home Builders Association of Northern Kentucky. The work was compiled by members of the HBA’s State & Local Government Committee lead by Chairman Walt Dunlevy, of Forge Lumber. O’Toole is the author of numerous Cato papers. He has also written for Regulation magazine as well as op-eds and articles for numerous other national journals and newspapers. O’Toole travels extensively and has spoken about free-market environmental issues in dozens of cities. An Oregon native, O’Toole was educated in forestry at Oregon State University and in economics at the University of Oregon. HOUSING MARKETS CONTINUE SLOW CLIMB BACK TO NORMAL
M
arkets in 54 out of the approximately 350 metro areas nationwide returned to or exceeded their last normal levels of economic and housing activity, according to the National Association of Home Builders/First American Leading Markets Index (LMI), released today. The index’s nationwide score of .86 indicates that, based on current permits, prices and employment data, the nationwide market is running at 86 percent of normal economic and housing activity. The LMI figures for November showed that 55 housing markets were operating at or above their last normal levels and the nationwide market was operating at 85 percent of normal growth. LMI data for the two months were released simultaneously because of the delay in collecting data during the partial government shutdown in October. “This index shows that most housing markets across the nation are continuing a slow, gradual climb back to normal levels,” said NAHB Chairman Rick Judson, a home builder from Charlotte, N.C. “Policymakers must guard against actions that could impede or even reverse the modest gains of the past year.” Noting that smaller metros accounted for most of the 54 markets on the current LMI that are at or above normal levels, NAHB Chief Economist David Crowe said that “smaller markets are leading the way, particularly where energy is the primary economic driver. Nearly half of the markets in the top 54 are in the energy states of Texas, Louisiana, North Dakota, Wyoming and Montana.” “The fact that more than 125 markets on this month’s LMI are showing activity levels of at least 90 percent of previous norms bodes well for a continuing housing recovery in 2014,” said Kurt Pfotenhauer, vice chairman of First American Title Insurance Co., which co-sponsors the LMI report. Baton Rouge, La., tops the list of major metros on the LMI, with a score of 1.42 – or 42 percent better than its last normal market level. Other major metros at the top of the list include Honolulu, Oklahoma City, Austin and Houston, Texas, as well as Pittsburgh – all of whose LMI scores indicate that their market activity now exceeds previous norms. Looking at smaller metros, both Odessa and Midland, Texas, boast LMI scores of 2.0 or better, meaning that their markets are now at double their strength prior to the recession. Also at the top of the list of smaller metros are Casper, Wyo.; Bismarck, N.D.; and Grand Forks, N.D., respectively. The LMI shifts the focus from identifying markets that have recently begun to recover, which was the aim of a previous gauge known as the Improving Markets Index, to identifying those areas that are now approaching and exceeding their previous normal levels of economic and housing activity. More than 350 metro areas are scored by taking their average permit, price and employment levels for the past 12 months and dividing each by their annual average over the last period of normal growth. For single-family permits and home prices, 2000-2003 is used as the last normal period, and for employment, 2007 is the base comparison. The three components are then averaged to provide an overall score for each market; a national score is calculated based on national measures of the three metrics. An index value above one indicates that a market has advanced beyond its previous normal level of economic activity. Meet Your 2014 Leadership James J. Kegley, President, The B.O.L.D. Company James is your 2014 President. He has previously chaired the Registered Builder, Education, Membership, Finance, and PAC Committees. James is also active at Hopeful Lutheran Church in Florence where he is on church council and will serve as treasurer this year. He is a co-owner of The Bold Company in Union Kentucky. Founded in 1986 The Bold Company is a design build residential and commercial contractor. Here James works as Chief Estimator, Project Manager and Sales Counselor. A fourth generation builder, James has a Bachelor’s degree in Construction Management from Bradley University and holds five designations from the National Association of Home Builders. In addition he has been both a student and teacher in the Enzweiler Apprenticeship Training Program. As president he will work to grow membership and increase member participation. According to James our Association’s advocacy and discounted Workers Comp and Heath Insurance are some of the association’s best benefits. In addition, membership is a symbol of professionalism to the consumer. James is the son of past local and state HBA president Mike Kegley. Jason Yeager, Vice President Ashley Construction Jason Yeager is a partner at Ashley Construction located in Edgewood, Kentucky working as a sales and marketing manager in the residential division. He is currently the Vice President of the HBA and has served as HBA Secretary/Treasurer, and Membership Chair. Jason is a 1990 graduate of Dixie Heights High School and a 1994 Graduate of the University of Kentucky. Past professional and civic involvement includes the following; Leadership Northern Kentucky 2002, Northern Kentucky Chamber of Commerce Membership Drive, Make A Wish, The Point and the Special Olympics. Jason is the son of John Yeager, 1992 HBA past president, and is partner with Paul Bogenschutz, 2009 HBA past president. Thomas Spille, Secretary/Treasurer Spille Builders & Developers Tom is your 2014 Secretary/Treasurer. In the past Tom has served on the Green Building, Cavalcade and Education Committees and has chaired the Education Committee. Ice Rescue Instructor. Tom is an avid SCUBA diver and Master SCUBA Diver Trainer teaching locally. In his spare time he also raises honey bees, having a number of hives. Tom likes the outdoors be it boating, camping or just enjoying nature. Spille Builders is a small family business that engages in the design/ build of energy efficient custom homes as well as building / leasing multifamily units in Northern Kentucky since the 1950’s with their office in Crescent Springs. Being a fourth generation builder encourages Tom to keep their good reputation by continuing to offer more than just a place to call home. Tom would like to see the HBA be recognized as “the place to be” by not only the local building community and suppliers but also the public. When someone needs anything done, he wishes to see them feel the importance of coming to a member first. Tom’s vision of the HBA is as a place for people to start. If they want a career or new start, they can come for education and subsequent employment. If someone wants a new home or remodel, they can come to our members. Our members can come to us for contacts and sales as well as help with the growing legislations and restrictions. Not to mention all the other benefits such as insurance and continuing education.
Adam Chaney, Immediate Past President Terrace Holdings, LLC Adam has served on the Land Development Council, the State and Local Government Committee, the Political Housing Club of Northern Kentucky, Membership Committee, Finance Committee, Board of Directors and most recently as 2013 President of the association. Adam has past chaired the State and Local Government Committee, Political Housing Club of Northern Kentucky, the Membership Committee, Finance Committee, and presided over the Board of Directors. He was awarded the 2010 Builder of the Year for his service to the association. He is the General Manager of the Northern Kentucky Panthers, SWOL American Silver, serves on the Northern Kentucky Consensus Committee, has been the Boone County Republican Party Precinct Captain, and is a current Candidate for Boone County Commissioner District #1. Adam is a partner/owner of Terrace Holdings, LLC, located in Erlanger. The company is involved in residential, office and retail land development and formed an investment company in 1999. He is also an owner/ partner with Receiver Services, LLC, which is a court appointed receiver for all classifications of business and real estate related foreclosure actions. Also Adam is an owner/partner in Commonwealth CD Fund, LLC, which is an alternative investment fund formed to purchase certificates of delinquency in our state under Kentucky Revised Statute 134 as investments primarily through selfdirected retirement accounts of its members. Adam’s vision for the future of the HBA is to increase awareness within the community that HBA membership is important when choosing a Builder, Remodeler, Supplier or Service Provider. Also we looks to expand networking and business to business opportunities within membership. Most of Adam’s free time is spent with his 3 children Spencer, Amber, Ashley and his wife of 14 years Suzanne watching and/or coaching Basketball, Baseball, Softball, Golf and Volleyball matches. Adam’s thing that people don’t know about him is that he used to shine shoes in airports to make a living.
Walt Dunlevy, Associate President Forge Lumber, LLC Walt is Chairman of the State and Local Government Committee, and member of the Building Codes Committee. He has served on several committees at the HBA since beginning his involvement in 1987, including Membership, Education (Co-Chair), Cavalcade of Homes (Co-Chair), Homefest and Land Development Council. Outside of the HBA Walt is the Vice Chairman of the Jolly Park Community Development Council. He has served on the Board of Directors of Holly Hill Children’s Services (Chairman in 2010) and on the Parish Council of St. Joseph Catholic Church, Cold Spring, Ky. (Past Council President). Walt’s career in our industry started upon high school graduation. He left the field for 7 years and worked as a staff member at the Northern Kentucky Chamber of Commerce, returning to the industry in 1987 in sales for a builder. In 1992 he joined Western Building Products, which became Builders FirstSource. In 2009 he joined Forge Lumber. Forge Lumber is a full service pro dealer, with a full complement of lumber, exterior and interior trim, windows, doors, millwork and trusses. They provide installed labor and do large turnkey projects with framing labor, exterior trim and interior trim. Walt’s vision for the HBA is to help make sure that we are on the right path in representing the interests of the HBA membership. Member engagement in the HBA is also a focus. He believes the HBA must be on the watch, be proactive and be active in the work that the HBA is doing in representing its members with advocacy. His hobbies include fishing, golf, working out at the gym and spending time with his grandkids, three dogs and his wife Karen. He has two sons, Ron, co-owner of Red Hawk Technologies and Brad employed at Verst Group Logistics. His most famous relative is Colonel Harlan D. Sanders, the founder of Kentucky Fried Chicken; a cousin to his grandfather.
Art Fischesser, Associate Vice President All-Rite Ready Mix Art joined the HBA of Northern Kentucky in 1977. Dewey Newport convinced him it would be rewarding both from a business standpoint and personally (social, building friendships) rewarding.He has served on the Associates Board of Governors twice (9 years), has chaired the Retention and Membership committees, vice chaired the Clam Bake committee and chaired the Golf Outing Committee in 1985. He is a Past President of the Associates Council in 1987 and received the Associate of the Year Award in 1990. Art has been a salesman at All-Rite Ready Mix since 1995. Founded in 1983, starting on Hopeful Church Road and one plant, All-Rite Ready Mix now operates 5 plants. Their main plant is in Florence on Route 25 and Aristocrat Drive. All-Rite is also operating plants in Wilder, Aurora, Indiana, Harrison, Ohio and Port Union, Ohio (just north of I-275). His company supplies ready mix concrete to the residential and commercial sectors. By getting involved, serving on various committees, Art has learned how important the HBA is in working for all associated in the building industry. It is better to give than receive, but for Art you get double back what you give at the HBA. He has been married to wife Nancy for 37 years and have 3 children and 4 grandchildren. Art’s first paying job was recapping tires; 40 hours a week for $25, when he was in the 7th grade.

POLITICAL HOUSING CLUB OF NORTHERN KENTUCKY LAUNCHES NEW CAMPAIGN
T
he Political Housing Club of Northern Kentucky (PHC) has started a new tiered giving campaign that recognizes individuals for their support of the PHC. The Political Housing Club’s voting members send questionnaires to candidates running for local and state offices. After questionnaires are replied to and reviewed, voting members of the Political Housing Club choose to support through contributions to those individuals it believes will best support the building industry. Your contribution to this endeavor is essential for our industry to maintain and grow a high profile by our elected officials. In addition to contributions to political campaigns the PHC may endorse a candidate. Endorsement by the Political Housing Club is cherished by those running for office and is another sign of how important political contributions are for our industry. Contributions can only be made by personal check or credit card or the same from a Limited Liability Corporation. In addition, the club has created fun and exciting ways to participate in fundraising. Depending upon the level of giving to the club you will gain access to special privileges, events and recognition year round. The PHC will hold its annual PAC Night! fundraiser in early March. Look for future issues of the Northern Kentucky Builder for details. A large cash prize highlights the evening. Prior to the giveaway there will be opportunities to win other prizes throughout the night. The event will be highlighted with great food and an open bar. Tickets for the evening are $100 each but for our tiered contributors more is included.

News & Notes Construction Jobs Are At Their Highest Level In Over Four Years Some great news from the U.S. Department of Labor! A rise in construction work signifies a healing economy. Construction payrolls climbed for the sixth-straight month in November, reaching a preliminary estimate of 5,851,000. That’s a 17,000-job gain from October’s 5,834,000 print, and the highest level since August 2009. We recently learned construction spending surged nearly 1% in October, the biggest jump since at least June. We are still well below where we were during last decade’s boom years. But, for what it’s worth, it also matches the figure from August 1997.
