Letter from the President

ARE YOU BEING TRUE TO YOURSELF? This year, the theme for the HAA Education Conference & Expo is “Be You” and though it might sound like a cliché, it’s a worthy goal. HAA’s biggest event of the year is all about finding your network, finding the best our industry has to offer and finding “you” in the process.

When you're joyful and excited about your life and career, and in a good place, it’s easy to be the best version of YOU; however, with all that we’ve been through the past two years and the rapid pace of change that we have experienced, it is so important to ask ourselves, “Am I being the absolute best version of myself?” To be self aware. We all know that when we bring our “A” game, it's going to inspire others and as leaders, that is so important. HAA and the Expo want to help you achieve that goal and find your passion.

I love HAA because it gives every person an opportunity to be themselves, serving as a volunteer, a committee member, a leader, an attendee or an exhibitor. Whether in the foreground or the background, there is a place for everyone in this great organization.

I'm really passionate about education and HAA is opening this year’s show with one of the best education programs in multifamily, the Apartment All Stars. I am so excited to see Kate Good, Lisa Trosien and Rommel Anacan in action again! When I was working onsite, the All Stars were such an inspiration to me. I remember listening to them and walking away feeling not only inspired, but rejuvenated. I could not wait to get back to my property and implement the things I learned, things that you can easily implement too.

The Apartment All Stars is a can’t miss program that will help inspire “you.”

The Expo show floor is another place to find the help you need to be a better you. Reach out and network with your peers and our awesome supplier exhibitors to find new products, new services, and most important, new friends in multifamily. You never know who you might meet or what new technology you might find to make your job and life easier.

It’s much easier to “be you” with a great support network.

And finally, I was a member of the Expo Committee for many, many years and I want to give a shout out to the committee. They work tirelessly to promote the show and to engage with our membership – they do it all. They sign up and assist exhibitors, promote the show to attendees and work the event for HAA, along with working their own booths. They work together as a group to make sure the show is a success for everyone and they're just so much fun, too!

I know it’s tough to get away from your property or your office, but the HAA Expo is worth your time. See more about the event at the QR code below right. I really want our industry’s biggest investment, our people, to hear the best education and to engage with our strong network. And the only way to do that is to show up.

FCC BROADBAND COMPETITION FCC ruling now has an effective date.

THE FEDERAL Communications Commission (FCC) regulates the activity of cable companies, other video services providers and telephone companies within residential and commercial multiple dwelling units (MDUs).

There are FCC rules governing the disposition of cable home wiring used within an MDU to serve an apartment after the cable company ceases to serve the resident.

FCC rules also ban common carriers from entering into or enforcing agreements with a building owner who restricts the right of the resident to obtain common carrier services (e.g., telephone service) from an alternative provider, and prohibit cable companies and other video services providers from enforcing or executing contractual provisions that grant them the exclusive right to provide any video programming service (alone or in combination with other services) to an MDU resident. The purposes of these various rules have been to promote resident choice in its selection of communications service providers and competition for subscribers in MDU environments.

On Feb. 15, 2022, the FCC released the Report and Order and Declaratory Ruling on broadband competition. The FCC expanded its regulatory guidelines to clarify that the sale-and-leaseback of cable home wiring is and has been subject to prohibition by FCC regulation; to ban exclusive revenue sharing agreements; to ban graduated revenue sharing agreements; and to require the disclosure of the terms of exclusive marketing agreements to residents.

On March 28, 2022, the FCC published official details of its recently unveiled Report and Order and Declaratory Ruling on broadband competition in multiple tenant environments (MTEs).

With its release in the federal register, the FCC’s actions now have an effective date whereby compliance will be mandatory.

After April 27, 2022, no common carrier of telecommunication services shall enter into any contract with an MTE that gives the premise www.haaonline.org

owner compensation on an exclusive or graduated basis. Parties to existing contracts, as of April 27, will have until September 26, 2022 to cancel, replace or void terms and obligations pertaining to compensation on an exclusive or graduated basis.

The FCC’s order also requires telecommunication service providers to disclose any exclusive marketing arrangements in material distributed to a MTE’s residents. Furthermore, the FCC reaffirms that sale-and-leaseback arrangements are an unlawful practice.

HUD to Require Carbon Monoxide Detectors by the End of 2022 In a notice published earlier this year, HUD has announced that all federally-assisted units must be equipped with carbon monoxide detection systems no later than December 27, 2022.

This requirement applies to units covered under Public Housing (PH), Housing Choice Voucher (HCV), Project-Based Voucher (PBV), ProjectBased Rental Assistance (PBRA), Section 202 Supportive Housing for the Elderly (Section 202) and Section 811 Supportive Housing for Persons with Disabilities (Section 811).

This new federal requirement comes after the passage of the Consolidated Appropriations Act of 2021. The Act set aside funds to assist in keeping Americans safe during the COVID-19 pandemic. A portion of those funds will be dedicated to rental owner and resident outreach and education about the dangers of carbon monoxide.

According to the National Center for Housing Management, public housing agencies and authorities may use their operating funds or capital funds to purchase and install carbon monoxide detectors. Owners of properties with units subsidized by either Project-Based or Tenant-Based Vouchers are responsible for covering the expense on their own. Projects covered under a Project-Based Rental Assistance contract or under the Section 202 or 811 programs can use their reserves for replacement, residual receipts,

general operating reserves, owner contributions or choose to seek secondary financing to fund the installation project.

The notice emphasizes the importance owners, agents and other public housing officials must place on properly installing and maintaining carbon monoxide-producing fixtures. A flyer on resident education is forthcoming and additional materials will continue to be made available on HUD’s website for free.

May 27 Primary Runoff Elections As we all know, elections have consequences and who we elect to offices up and down the ballot will have an impact on not only our industry, but our daily lives as well. Elections are important and this year is no different.

The Democratic and Republican Primary Elections in March were the beginning of a long political year. For those candidates that did not receive 50% plus one vote in the primary, they now face the Primary Runoff election.

Election Day for the Primary Runoff is May 24 with early voting beginning on May 16. Please consider supporting candidates who will support the economic growth of our local industry.

TROUBLESHOOTING EVICTIONS

Evictions are supposed to be a summary procedure that is inexpensive and speedy. So, what happened?

OVER THE PAST two years, the eviction process has been confusing, complicated, time consuming and frustrating. Delays in the eviction process have created problems for both landlords and residents. Residents have large (sometimes really large!) delinquencies.

Eviction delays have prevented landlords from reletting units to mitigate their damages. Residents are faced with increased credit and rental history problems that will be difficult (or impossible) to overcome.

How did we get here? Several issues have contributed to our current environment: • 30-day notice to vacate requirements for certain properties covered by the CARES Act and new HUD and Federal Housing Finance Agency requirements • Supreme Court Emergency Orders that have given judges flexibility leading to delays in the eviction process • Supreme Court Emergency Orders that have allowed judges to abate and dismiss cases while the parties wait for rental assistance that may or may not ever come.

• Judicial interpretations of the federal and state law, rules and orders.

Some delays can’t be avoided, but some can. To minimize unnecessary delays, it is more important than ever that an owner properly prepare for an eviction proceeding.

Here are a few tips to allow you to navigate through some of the most common problems owners have faced: 1. Service of the Notice to Vacate The Property Code requires that the notice to vacate be given in person or by mail at the premises in question. Notice in person may be by personal delivery to the resident or any person residing at the premises who is 16 years of age or older or personal delivery to the premises and affixing the notice to the inside of the www.haaonline.org

main entry door. Notice by mail may be by regular mail, registered mail or certified mail, return receipt requested, to the premises.

As an alternative, the owner may deliver the notice by securely affixing the notice to the outside of the main entry door; however, this method of delivery should be considered in only certain limited circumstances. Outside delivery can only be done if: (i) the premises has no mailbox and a keyless bolting device, alarm system or dangerous animal prevents the owner from entering the premises; or (ii) the owner reasonably believes that harm will result from personal delivery to the resident or by affixing the notice to the inside of the main entry door. Additionally, the notice must be placed in a sealed envelope with the resident’s name, address and in all capital letters, the words “IMPORTANT DOCUMENT” (or substantially similar language) and must be mailed no later than 5 p.m. on the same day from the same county in which the premises is located.

Since notice on the outside of the door requires that certain specific additional action be taken, and is only available in limited circumstances, the best approach, if possible, is to affix the notice to the inside of the door. Even if someone opens the door, if you are not sure if it’s the resident, the safest approach is to affix the notice to the inside of the door.

2. Be sure that the date and the number of days’ notice is correct The Property Code provides that the owner must give at least three days’ written notice to vacate before the owner files a forcible detainer suit unless the parties have contracted for a shorter or longer period in a written lease or agreement. The TAA lease provides for a 24hour notice to vacate. However, if your property is subject to the CARES Act or the applicable HUD or FHFA rules, you would be required to

give a 30-day notice in nonpayment of rent cases. Be sure that the date on the notice and the date that the resident is required to vacate properly reflect the number of days’ notice you are required to give.

3. Content of the notice Be sure that the notice is not a “pay or quit” notice stating that the resident can either pay or vacate. The Property Code provides that, if before the notice is given, the owner has given a written notice or reminder that rent is due and unpaid, the owner may include in the notice to vacate a demand that the resident pay the delinquent rent or vacate the premises by the date and time stated in the notice. In other words, under Texas law, if the notice contains a demand to pay rent or vacate, the notice would only be proper if there was a previous notice or reminder that rent is due and unpaid. To avoid having to give two notices in an eviction proceeding, it would be best to simply provide an unconditional notice (a notice that states what the default is and requires the resident to vacate).

4. Acceptance of partial payments during the eviction process The issue of waiver is presented when an owner accepts a partial payment of rent during the eviction process, after the notice to vacate is given. It is your choice whether or not to accept a partial payment. If you don’t accept the payment, you have solidified the argument that you want to go forward with recovering possession of the unit because of the resident’s delinquency. If you accept a partial payment, you run the risk of an argument that you have waived (given up) your right to continue with the existing eviction process for nonpayment of rent.

accept the partial payment. However, if you do, in order to put yourself in the best position to defend against a waiver argument, it would be beneficial to respond to the acceptance of the partial payment with a letter to the resident stating that you have accepted the payment as a partial payment only, the resident remains delinquent, and you intend to continue with the eviction process due to the outstanding delinquency.

By sending the letter, you will be able to show the judge that you were transparent with the resident, you had no intent of accepting the partial payment in exchange for giving up any rights in the pending eviction process and you did not have any intent of entering into a payment plan with the resident.

5. Be prepared to answer rental assistance questions The COVID rental assistance programs have been designed to keep a resident housed. They have not primarily been designed to pay the resident’s delinquency.

However, the programs keep residents housed by paying the delinquency.

Since the purpose of the programs have been to keep residents housed, it is unlikely that you

would be able to accept rental assistance while you are also evicting a resident.

Pursuant to the Supreme Court’s Emergency Order regarding rental assistance, a judge must, if the owner has a pending application for rental assistance or the owner and resident both express an interest in participating in an available rental assistance program, abate the eviction action for 60 days and dismiss the case with prejudice if the action is not reinstated within those 60 days.

Before you get to trial in an eviction case, a choice should be made. Do you want to continue to engage in the rental assistance process, which may involve waiting for rental assistance that may or may not ever come, or do you want possession of your unit?

If you decide not to accept rental assistance and go forward with the eviction, it may be beneficial to email the applicable rental assistance agency before trial to advise the agency that you are going forward with an eviction process and do not want rental assistance for that resident. Whether or not the agency responds, your email may be beneficial to show the judge that you have withdrawn any application for rental assistance with respect to that resident. The email, coupled with your state-

ment that you do not have an interest in participating in an available rental assistance program, may convince the judge that you want to go forward on the eviction process, rather than wait for rental assistance.

6. Be sure you are suing in the right name The lease should be in the name of the owner of the property or the owner’s assumed named.

Your notice to vacate and eviction petition should mirror the name of the owner on your lease.

7. If you use an assumed name in your petition, be sure an assumed name certificate is properly filed Most apartment communities are owned by a single asset entity. Texas has adopted the Assumed Business or Professional Name Act (“Act”). The Act provides that most organizational entities must file an assumed name certificate in the office of the Secretary of State if the entity regularly conducts business in Texas under an assumed name.

A RESIDENT FILED a complaint with HAA to dispute charges after moving out of an apartment due to a rodent infestation.

The resident claimed after two work orders and mitigation from management, the infestation was worse. She moved her child out while she and her partner remained until they could no longer deal with the situation.

She emailed her 30-days-notice. She offered payment of her remaining utility bills, fees for damages and cleaning. The resident provided a final account statement and photos.

Management Response Management responded to HAA that the resident called about a rodent issue and requested service, then cancelled the service,

stating she would take care of it and asked about terminating her contract. She was informed that she would have to provide a 60-days notice to vacate and pay a reletting fee. Property staff noted there was no contact from the resident, the resident was issued a move-out notice and skipped during eviction.

The management charges on the final statement included cleaning, late charges and utilities, along with a lease termination fee and insufficient notice penalty charges totaling $6,292,56. Management provided copies of the lease, application, final account statement, resident ledger and photos.

The Committee’s Decision The committee decided in favor of man-

agement with revisions. The committee adjusted the rent charge from $1,135 to $605.33 based on the 16 days at which the resident was removed from the management’s system. The committee also removed the lease termination fee of $2,270 because the lease did not mention a termination fee.

After adjustments, the other charges were found to be justified and the resident owed the property $3,492.89.

Speaker: Tyrone Poole, founder of OneAppGuarantee, didn’t develop his concept in a sleek Silicon Valley incubator.

He developed it in a Portland homeless shelter, as a resident. Nine years ago, while training to become a fireman, Tyrone suffered a serious leg injury that put him in a hospital bed for nine months and on crutches for nearly a year.

Upon his release he had lost everything.

He was evicted, his car had been repossessed, and he had incurred more than $20,000 in medical debt. After months of couch surfing, he checked himself into the YWCA homeless shelter. This is where the company was founded.

ave you ever had those moments in your career when you’ve felt stuck? You know that sinking feeling you get when you know you’ve tried everything you can to move forward, but it doesn’t seem to be working? When it feels like no matter what you do you keep running into a wall?

Or maybe you’ve started to experience a little (or a lot) of success in your career and now you’re wondering what you need to do to keep the good times going.

If either of these situations resonate with you, I can totally relate.

I remember a season in my career wasn’t progressing as quickly as I wanted it to. My work days were filled with stress, fear and frustration. I knew that something needed to change.

I also remember when I saw my career really start to take off. At first I was excited to finally see the results I always wanted. But then, I felt the pressure to have to constantly produce at a high level, to keep up with everyone else and to always have to be a better version of me show up every day, if I wanted to keep growing in my career.

Then I discovered and implemented some powerful strategies that helped me accelerate my success. Whether you’re trying to build momentum in your career or trying to keep the momentum going, these are the three powerful, yet often overlooked, steps to take that will help YOU accelerate your career success.

Step #1: Be AWARE After working with thousands of clients throughout my speaking, consulting and coaching career, one of the big

mistakes people make that prevent them from achieving the success they desire is not being AWARE. While there are many areas where lack of awareness causes problems, I want to focus on one big area right now, and those are the things that are holding you back from achieving your goals.

Do you need to grow in your leadership? People skills?

Closing the sale? Time management? Organization skills?

Emotional intelligence? Dealing with stress?

Once you’ve identified the big areas, identity the one area to start with that would have the biggest results in your career. Then move on to the next step.

Step #2: ACKNOWLEDGE Now that you’ve become aware of that thing that may be holding you back from experiencing all the success you really want, you want to make the decision to acknowledge it.

After I finished up a keynote talk on the secrets of winning with people, I had a gentleman who I could see wanted to speak to me, but it was clear he didn’t want anyone else around when he did. So, after the crowd dissipated, he came up to me, smiled and said, “I now understand why my wife is so irritated with me all the time!”

We both laughed. I told him that I appreciated his honesty and that honesty would serve him well as he tried to improve his level of communication and connection with his wife.

If you want to accelerate your career, you need to get honest and real with yourself, too. (I know…not fun!) The truth is, everyone has at least one area where they could

Do you need to grow in your leadership?

People skills?

use growth. In fact, most of us, myself included, have multiple areas!

The problem is we try so hard to hide those areas from ourselves and others, which prevents us from doing the powerful work of removing those defects from our careers and replacing them with assets that would accelerate us forward.

So, if you’ve discovered that you have “areas of opportunity” that could use a little attention, there’s nothing wrong with that. It means you’re normal!

What would be wrong would be to do nothing about it!

This takes us to our third and final step….

Step #3: Take ACTION When was the last time you rented a movie at Blockbuster? Is Radio Shack your “go-to” store for electronics? Are you still shopping for your Christmas presents from the Sears catalog? Do you even remember the Sears catalog?

There was a time when Blockbuster, Radio Shack and Sears were HUGE! Today, Blockbuster only has one store left. Radio Shack is a shell of itself. Sears is struggling just to stay afloat.

Those companies have one thing in common – they didn’t take enough action to respond to a changing marketplace, and it prevented them from moving forward.

What does this mean for you? It means that if you want to accelerate your career, you must take action today to prepare for your success tomorrow.

hese days, you don’t have to look far to find someone who’s ticked off about something or acting badly.

We’ve got air rage at the airports and on flights. Last year saw the highest number of unruly passenger incidents on record according to the FAA. Car thefts are up, nurses are asking for panic buttons in exam rooms, carjackings are on the rise and the rate of physical crime on people is up by almost a third across the US. Look at yourself and what you’ve had to deal with. Maybe it’s a resident who doesn’t like the way the grounds are kept. Or maybe it’s a coworker who’s not happy with the hours they have to work this week. Maybe it’s your spouse, partner, roommate, child, parent or someone else in your immediate circle who just seems to be more ‘on edge’ lately than usual. Or perhaps it’s YOU who’s unhappy, cranky or just a tad snappy with everyone. In short, it just seems like the world’s gotten a lot angrier lately. And it doesn’t seem to be getting any better.

We’ve got a lot to unpack here, so let’s take a look at what’s going on that could be creating all of this unhappiness.

The pandemic. It’s not really over. We still have to wear masks (sometimes). And then there’s the whole vaccine issue. It’s going to be with us for a while.

Political unrest. We’ve been going through this for what seems like FOREVER. And we all know someone who has lost a friend or two over politics. Is it ever going to get any better?

Social media. While social media can really be a wonderful thing, it can also be a pretty bad thing. Everyone’s got an opinion on everything, and they are more than willing to share it with you, argue with you or just plain

You Put Me in “Public” A recent study published in Forbes magazine found that people who work with the public are much more unhappy these days than people who don’t have to work with the public. Why? All of the anger that’s out there! So let’s look at a couple of ways to help you deal with the stress of working with angry people.

The late Steve Jobs found that one of the best ways to deal with stress was to take a walk. An actual walk, away from his desk, away from his stress. He found that not only did it reduce the stress he was feeling, but it actually helped his creativity. You have the perfect job for taking a walk. So, when you feel the stress creeping in, walk the vacants! Walk

the apartments that are ready for movein. Walk the amenities, the grounds, the hallways – just get away from your desk and walk. You’ll find the immediate change of scenery refreshing and you’ll probably go back to your desk with a better outlook than when you left.

Just like the television show, “Who Wants to be a Millionaire,” use this opportunity to “Phone a Friend.” Call a loved one, a fellow apartment industry colleague, your partner, spouse, loved one or anyone who’s usually willing to lend a listening ear. It’s amazing how therapeutic it can be just to verbalize your feelings. Tell them you need to vent and then just let it go.

Lastly, if you can’t make a quick call or take a walk, jump on YouTube and watch a funny video. My personal favorites?

ach year, the Education Advisory Council selects the content for HAA’s Education Conference. The EAC is a group of management and supplier members who believe in moving our industry forward through education. Many council members serve as volunteer facilitators for HAA, hold training roles within their organization or simply have a passion for learning and development. The EAC meets throughout the year and is tasked with reviewing existing courses and strategizing new educational opportunities.

Planning for this year’s Education Conference started around June of 2021. As in previous years, the EAC started brainstorming ideas, discussing what challenges we were facing and digging in to what topics seemed most relevant to HAA members. We knew the members needed something energetic and motivating, but there was also a sense of getting back to basics.

After sending a request for presentations, HAA Vice President of Education Emily Hilton presented the council with several options from nationally-renowned speakers. As we read through the selections, the Apartment All Stars quickly rose to the top of the list.

The Apartment All Stars were originally scheduled to appear in person at the 2020 HAA Education Conference, but COVID restrictions forced the conference into a remote program.

Like the rest of us, the All Stars pivoted and held a very motivating and highly attended virtual session.

Inviting them back, in person, for 2022 was a clear and easy choice.

I’m excited the All Stars are back in H-Town, baby! They offer the right mix of industry-focused, upbeat, highenergy content Houston needs, and just in time for peak leasing season!

The last time Apartment All Stars were face-to-face in Houston was 2014. I remember attending a morning session, in Dynamo stadium, leading up to the big Maintenance Mania event held that same afternoon. It was the first time I experienced Apartment All Stars. I remember leaving the session super pumped and implementing many of the ideas once I got back to my office.

I was also fortunate to attend the 2020 virtual conference. The information they shared was so appropriate for what we were all still trying to figure out. The Apartment All Stars are sure to have a fresh approach on how to get the best out of ourselves and others as we embrace this new normal in 2022.

If you are attending the show, the best advice I can give is come early, stay late and wear comfortable shoes! The Apartment All Stars will start at 9 a.m., but allow yourself enough time to park, get checked in and find a seat. You won’t want to miss a minute of the action.

After the education session ends, the Expo show will open. If you didn’t know already, NRG is BIG. There will be over more than 250 suppliers to visit and I recommend visiting each and every one. Even if you don’t think you need what a certain supplier has to offer right now, you most likely will someday. Knowing where to turn, who can help you achieve a goal, or who can quickly fix a problem is an important way to bring value to your role. Don’t be afraid to introduce yourself, ask questions, say thank you, and grab a business card!

The Education Advisory Council will soon start gathering ideas for 2023, so if you have thoughts on what you would like to see next year – send your feedback to education@haaonline.org. There will also be a survey distributed after this year’s conference, so be on the lookout!

He has always gone above and beyond, bein g his “YOUnique” self. I admire that about him. I want to enco urage every member of the association to be able to expr ess themselves confidently, finding what makes them beaYOUtifully stand out from the rest.

What are you most excited abo ut this year?

I can’t wait to see our “multi-FAMILY ” as they show up to build upon their ongoing relations hips and cultivate new ones. There are a lot of new face s and I am excited to see those partnerships flourish into ones that strengthen our industry.

What advice do you have for sup plier partners exhibiting at the 2022 HAA Edu cation Conference and Expo?

Wear comfortable shoes! Make sure you have business cards with you. I like to keep mine in my lanyard for easy access. Remember that you are your own walking advertisement, come with a smile and be ready to “#beyourownbrand”! ... and seriously, wear comforta ble shoes. ;)

hen you promote yourself to your peers and your potential clients, remember “you” first and attach the business or product to you, or rather the memory of you. In general humans are a very visual species.

Instinctively, we also are quick to notice whatever may be different or whatever stands out.

Event Specific Technology In 2021, the HAA Ambassadors were having our annual HAA Crawfish Boil. How do you market during a crawfish boil? I had ordered an NFC (near field communication) business card. This is a card that you simply tap on a phone and it shares your contact information. What is even cooler, my business card came with a its very own QR code. This is when I figured out a way to promote, sell, network and market all at the same time.

I ordered an XL t-shirt. I then placed my headshot on the front of the shirt and even bigger on the back.

I then made my QR code large enough to be placed on the front and back of my t-shirt with my photo.

It was a hit! It was all things. It was a conversation piece, it was funny, the QR code was scannable on the front and back. Everyone was curious to see if it even worked and it did.

I also stood out. How could I not?

I was wearing my face and QR code on my shirt!

Lessons were learned that day. I am sure that everyone has “pieces” of a marketing puzzle. Be it a headshot, a special business card, your own QR code. The secret marketing sauce is

to consider the event, like Expo, and combine these different assets and your personality in such a way that allows others to take notice and are compelled to engage. Remember to keep it creative, keep it simple, keep it fun and promote yourself.

Driving Traffic and Algorithms Be sure to invite, inform and entertain your audience about the upcoming Expo through social media. I highly recommend engaging with your clients and potential clients by creating short videos for content. The key here, in addition to the actual content, is frequency. How often your message is seen is “frequency.” The higher the frequency, the more likely your message will be at the top of attendees minds when they are at the Expo.

It is important to note that you cannot simply post content and magically have interactions. TikTok favors content that contains “trending audio” and hashtags. Instagram content will reach farther when you post to “reels” along with hashtags.

YouTube’s interactions are toughest and based on hashtags and subscribers. Twitter throws a curve ball, but its reach is better than Instagram.

Retweets are king with Twitter. Use your hashtags. BombBombs is newer and not a platform like Instagram or TikTok, but is great for a more personal video message and would be great to utilize proactively to drive Expo awareness and traffic.

Expo Execution It is the day of the Expo and you have been sending out your messages. What now?

QR codes are simple and effective way to either share or collect information. Do not be afraid to tie your QR codes to your website or company information. You can even create an online form that can be populated in real time.

NFC business cards are the rage – tap your visitor’s phone and voila! You just shared your contact and company information in real time.

Did you know you can even engage with attendees at the Expo that may not be physically at your booth with GeoFencing? Geofencing is a location-based service. An app or other software uses GPS, RFID, Wi-Fi or cellular data to trigger a pre-programmed action when a mobile device or RFID tag enters or exits a virtual boundary set up around a geographical location, known as a geofence. What does that mean? That means you could send messages raising your name profile, telling them about your booth or getting them connected to your brand!

After the Show By this point, you will know who and how many people were engaged.

You will also know who visited your booth and requested additional information. Maximize your efforts.

It is important to follow up with whoever was engaged. Some of the best advice I have received is to spend time with people/clients/ potential clients that want to spend time with you/your company.

Now go forth and be sure to leverage your marketing efforts before, during and after the Expo!

Exhibiting and showing up to Expo or any monthly HAA , event is a great way to promote businesses also are They es. brand, products and servic a great way to interact and engage face-toface with current and potential customers.

Here are some tips: Do your research – Find how many people will be attending so you can budget accordingly and look into the audience you will be targeting.

Promote your attendance – by email and/or social media.

Have your business cards ready – to hand out and come up with different ways to collect business cards. A great example could be a fun giveaway.

Find intriguing ways to attract people to your booth – with banners, giveaways, contests or prize drawings, cool swag or interactive items, such as touch screens, to gather customer information, demonstrate a product or conduct a survey. Choose a unique theme for your booth and have engaging activities. Create a memorable experience and be creative.

Now, any time I have a friend come into town, I try to take them there to impress them and for them to have a memorable experience.

Be engaging – I saw a Super Bowl commercial that had a QR code move around the TV screen. I sat there in awe as I watched everyone in my living room pull a out their phone to find out it was an ad to t abou think you If ite. webs ency ocurr crypt it, it was so simple yet engaging and memo-

rable. I guarantee, if you google “Super Bowl QR code commercial,” it will take you straight to the website. This is a great exam ple of how your marketing ideas don’t have to be complicated.

Do it better – You might be like me and not able to come up with new ideas on the spot. Perhaps you see someone else’s idea and find that you might have a better way of executing it and adding your own twist.

Try it. Google is my best friend when I need new ideas to bring together and make my own.

Go mobile – Find easy ways you can attract people through your mobile device, whether by creating an app or creating a social media page for your brand or company. Create a mobile website where peod ple can research your company and uploa their information for you to follow up.

Go social – The pandemic challenged me to find new ideas to market my brand.

Using our phones and social media to connect with others was a way to engage and stay close. With apps like TikTok, LinkedIn, BombBombs and YouTube you can reach out to so many different audiences while still making it fun. I love sending email videos to catch the eyes of my current client partners. At times, when I am out on the field, I love creating fun TikToks of my adventures while connecting with my communities and showing the audience a glimpse into my world. When finding new ways or new ideas for marketing, I take examples from TV commercials, YouTube videos, social media ads, TikToks or Story videos.

Get Tik Toking – You can connect with people in a broader way on TikTok and it gives us control of what we want the world to see. So many businesses have skyrocketed by just posting and going viral. TikTok has a way for you to attract a specific audience with their algorithms and can offer different ways for your videos to get seen.

The app itself gives you so many different filters, options for edits, extended video times, etc., to create unique videos. You can

become your own director, newscaster, influencer or celebrity.

Post pictures – When it comes to pictures or videos, you can never have enough.

The more pictures or videos that are on a site, the better experience visitors will have visually. I love when people submit pictures under the review section through Amazon.

At times, I find that the products Amazon sells are too good to be true, so I rely on other people’s reviews and pictures. It provides me with a better buying decision by showing me the real item through the customer’s perspective.

Connect with a bracelet – I recently learned you can upload your information, like a business card, onto a bracelet with a chip and have it connect with anyone by just taping it on the back of their phones.

Your information then gets saved into their contacts.

Stay on budget – If you want to stick to a budget, research products you would like to try, especially promotional swag.

There are affordable ways to create things on your own at a fraction of the price of buying a product. I always go to Pinterest, Google images or join a Facebook group if I am looking for affordable ways to create my own marketing material. You can find so many creative ideas that can help you save and create a successful marketing plan.

Put yourself in other people’s shoes – If you want to attract the younger generation of customers, do some research on things that they like or find interesting. My son is eight years old and he is very into the movie Five Nights at Freddy’s. I found out Five Night at Freddy’s has similarities to visiting a Chuck E. Cheese and decided to book his birthday party there to create a similar atmosphere. Doing research on what other people like goes a long way toward engagement and connection.

How can supplier partners best prepare for the 2022 HAA Education Conference and Expo?

Make sure you and your team know the message you are trying to convey to your audience before you set up for the show. You have less than a minute to catch the attention of the people walking on the show floor. Make sure your marketing catches their eye and that it allows them to know exactly what you do, right away. Make it stick!

Just as important is how you present yourself. You want to express professionalism in what you do. Have you and your team decide on what you will wear that compliments your booth. Look like a team! You can all go back to not liking each other after the show is over.

List your top three day-of-show dos and don’ts.

Dos • Make sure your booth is welcoming. Introverts and those that are not used to the crowds have anxiety walking into these things. You want to make sure you have the opportunity to talk to as many people as possible.

A booth that says “Welcome” goes a long way.

• In addition to the business card

exchange, I like to send emails to those interested in my services. It doesn't have to be long, just a one- or two-word subject title and a one-liner on what you two discussed. It is a little more personal than a business card and they can see it when they get back into the office. Not to mention, they get hundreds of cards at the show and may have trouble finding yours. This could also start a relationship after the show. We all know how difficult it is to have a lengthy conversation with anyone who is interested in your company on the show floor.

This can help with that.

• Send out emails to your customers and potential customers beforehand.

Let them know where your booth is located and to come say “hi.” You may have customers that you have not met in person and only through email or phone. This is the perfect opportunity to build on those relationships!

Don’ts • Do not be on your phone in the booth. If you need to use your phone, step away from the booth.

• Do not leave your booth unattended. It looks bad on the company and it gives off the vibe that your team does not care to be there.

How can supplier partners best prepare for the 2022 HAA Education Con ference and Expo?

Define your budget and create a strat egy. You should plan to market yourself befo re the show, have a plan of action for your boot h that creates engagement, have a follow up plan and a method of tracking so you can determine your ROI.

List your top day-of-show dos and don’ts.

• Don’t block your booth off with a table and chairs • Do create a space that is inviting, fun or entertaining. You want your booth to attra ct people.

• Set up early! Don’t wait until the final hour.

• Read the Expo show guidelines/pr ospectus!

Trade show guidelines vary from show to show. It’s important to know what you can have in your booth and what you can’t.

• Do not talk bad about other suppliers at the show. We all have the right to be at the show, competitors or not. There is plenty of business to go around. Be respectful of everyone.

What is the best thing supplier partners can do AFTER expo and why?

Reach out to all of the attendees that you have sparked a conversation with. Try and set up lunches and/or calls to discuss more about your company, What is the number one thing to keep in mind?

Make sure they do not forget you.

There is a chance that they may not need your services right away. They need to remember you when the time comes. At my company we call it a “pattern interrupt.” Everyone has a pattern, you want to stand out and interrupt that pattern. Be different from the rest. That is how people will remember you. Keep that in mind before, during and after the Expo.

his month, we interview HAA PSC members Shaun Callaway, CAS, with Earthworks, Tito Estrada, CAS, One Source Realty Advisors, and Liz Levins, CAS, Raza Floors, about the the Ambassador ONE Society.

What is the Ambassador One Society?

Shaun Callaway: A great group of supplier volunteers that get together monthly to network, discuss industry updates and information, make charitable contributions and make sure that on site teams are consistently informed on all info regarding HAA. Tito Estrada: The Ambassador ONE Society, at its core, is a friendly, open community of fellow suppliers. We connect and bond to share best practices, warm client introductions, industry news and information. It is one of the first, if not the first, committees most new suppliers join, so it is incumbent upon Ambassadors to extend a very warm welcome to our “rookies” to ensure their success within HAA. Liz Levins: You mean other than the best place a supplier can be on the first Wednesday of the month? Ambassador One Society is a an “Organized Network Exchange” among fellow supplier partners that get together to network for industry leads and knowledge. It is a wonderful place to get to know others outside of your dayto-day professional business and strengthen others by supporting their business as well.

Why is it beneficial for supplier partners to join the Ambassadors?

Shaun: I have gotten a great amount of new business through collaborating with other suppliers and having them help me get the opportunity to work with new clients that they have already built relationships with. You also get the opportunity to represent HAA and get in front of managers to do property surveys and that gives you the chance to drop off a business card as well as advertise your services.

Tito: It’s a “gateway” committee, created for suppliers that serve our HAA owners and managers. New members will immediately recognize that we, existing members, have been exactly where they are now. They can meet and network with other suppliers and we constantly mentor, nurture and engage new members.

Liz: Being a part of the Ambassadors not only grows your personal business, but helps you gain industry knowledge. Think about calling on a potential client and they are struggling with something not in your wheelhouse, but you have a referral to a supplier partner you met at Ambassadors that can help them. You are a hero!

Or that could be you they are calling from a referral from someone else. Plus, you get to meet some amazing people that just might have solutions to “getting in” with that client you find impossible to reach.

Do you have a favorite moment as an Ambassador?

Shaun: I have really enjoyed being a team captain! Also being on PSC, I have a passion for helping Estrada others and enjoy finding ways that new members can become more involved.

Tito: OMG! I was mentored by Ambassador Marcy Holmes. I was so lost, but I was engaged and Levins believed in what HAA and Ambassadors could do to help me grow my business. Through the Ambassadors, my engagement and Marcy, I was rewarded with a lead to a gentleman that I did not know would be our future HAA president.

I met John Boriack for lunch and I was neatly dressed with suit vest, double Windsor and handshined shoes (I am a former Marine). I was sure to bring my computer, marketing materials, contracts and expensive ink pens. I was happy to have secured a meeting and that my efforts were coming to fruition. After ordering lunch, my head started spinning as I came to the embarrassing realization that, in my excitement and for all my

Shaun As an ambassador you get the opportunity to do property surveys. You are able to represent HAA and make on site visits to make sure that managers are receiving all the important info that they need regarding HAA events, ABODE magazine and more. We also verify that we have the most accurate information about each property as well.

Tito: As Ambassadors, we establish links with each other. This leads to links with existing and potential clients. Information on ownership and management changes that may affect a community is commonly shared. Industry information is often relayed as well, such as how new legislation may affect our industry. Armed with this information we can utilize “word of mouth” to promote and support each other.

PSC, continued from Page 60 preparation, I had forgotten my wallet! Standing there I was borderline hyperventilating. I patted myself down like a TSA security guard. Frankly, I wished someone would have taken me away for this completely rookie move!

As I felt my moment worsening and fading away, John reached into his pocket and laughingly said, “Tito, it’s okay” and payed for lunch. Fast forward to the actual meeting. I made my presentation. He understood what I do and how I do it.

I had nothing to lose as I was as vulnerable as I could be, so I pulled out my engagement letter and handed it to John. He looked at me and then looked at the engagement letter. And guess what, John Boriack became my first HAA client and I have represented him ever since! This could not have happened without Marcy and the Ambassador ONE Society.

Liz: My favorite moment as an ambassador is every Ambassador meeting. I truly enjoy not only seeing familiar faces but meeting new supplier members that join. To hear all about the new services that are evolving our industry is amazing to me.

How does a supplier become an Ambassador?

Shaun: To become an ambassador, you need to attend one of the supplier orientation meetings that take place monthly. Then you must attend two meetings after completion. Once you complete these you will graduate to a full Ambassador One member!

Tito: There are a few, easy steps. The first step is to attend the Ambassador ONE orientation. The second step is to attend the actual Ambassador ONE meeting and then attend two meetings. The third step is to view the property survey tutorial.

Once the tutorial has been viewed, there is a small questionnaire to confirm understanding.

The rookie will then become an Ambassador and will receive their lanyard! Pro-Tip: Be sure to engage, take advantage of the mindshare and do not forget your wallet!

Liz: First, join the Houston Apartment Association. Ambassador ONE Society is a standing HAA committee and does not require preregistration, however you must attend the New Supplier Orientation Meeting to join the group. Law, continued from Page 12 proceeding in any court, but the entity may not maintain any action or proceeding arising out of a contract in which an assumed name was used until an original, new or renewed certificate has been filed as required by the Act. In other words, if you use an assumed name in your lease, but have not properly filed an assumed name certificate, you run the risk of delaying the eviction until you properly file the certificate.

8. Using fraudulent names We have faced a number of issues in the apartment industry regarding identity fraud. If you are evicting a resident who has used a false identity, and you are aware of your resident’s real name, it would be beneficial for the notice to vacate and the petition to identify both the real and false name used by the resident. This will give you consistency between your lease, notice to vacate and eviction petition. To avoid confusion, you might consider identifying the person as “(the resident’s real name) also known as (the resident’s fake name).”

9. Be sure to bring your witnesses to court Whether your eviction is remote or in person, be sure you have witnesses ready to present the evidence you need in your case. In a non-payment of rent case, you want to be able to prove that the lease was signed, the notice was delivered and the resident failed to pay rent. In other types of evictions, you would need to prove that the default occurred with credible evidence. If the only people in court are those that do not have personal knowledge of the default, you run the risk of losing the case.

10. If you make a deal, do it in writing Many owners have made payment plans over the past couple of years. If you are relying on a resident’s agreement to make regular payments, the agreement should be in writing. The agreement should also reflect what happens if the resident fails to comply.

Once you get to the eviction process, if a resident claims that a payment agreement has been made, it would be beneficial to have that agreement in writing so that there will be no confusion or misunderstanding with respect to the rights and responsibilities of the parties.

Evictions have become confusing, complicated and time consuming. By being properly prepared and doing certain things before and during the eviction process, you may be able to avoid unnecessary problems and delays.

THE FIRST TABLE ABOVE GIVES A SNAPSHOT of the current market conditions. The graph displays the overall occupancy and effective rental rates over the past 24 months. These statistics are derived from a continuous survey of all apartment communities in the Houston region. The effective rental rates are the calculated net of concessions and utility adjustments. The second table lists the five hottest submarkets in the Greater Houston area. There are a total of 42 submarkets, and the ranking is based on the best combination of rental rate growth and absorption over the past three months. The third table distributes and analyzes concessions (specials) by classification.

Concessions generally are represented by three types of specials: move-in, months free or floor plans. The effect of these specials is captured and prorated over a lease term to arrive at a percentage reduction in market or street rents.

Helping Spring ISD Students HAA School Supply Drive starts June 1 The HAA Community Relations Committee is holding a School Supply Drive for the Spring Independent School District beginning on June 1.

The Spring Independent School District serves over 35,000 prekindergarten through 12thgrade students in a diverse district located 20 miles north of central Houston. The district currently has 38 campuses that include 26 prekindergarten through 5th-grade elementary schools, seven 6ththrough 8th-grade middle schools and five 9th- through 12th-grade high schools.
