A

nother arrest of a former People’s Progressive Party (PPP) Government Minister has again sparked a debate about the motive behind these arrests by the Special organised Crime Unit (SOCU), and by extension, the David Grange-led Administration, which according to former Attorney General Anil Nandlall, is geared towards damaging the reputation of political opponents of the Government.

He said the recent arrest of former Finance Minister Sasenarine Kowlessar came as no surprise to members of the Opposition as they have always felt that the motive has been clear from day one.

“It is clear beyond any doubt that these investigations are driven by a political and vindictive motive.”

Nandlall said, ultimately, this strategy is designed to get to the period when Opposition Leader Bharrat Jagdeo was the Finance Minister. Jagdeo served as senior Finance Minister in May 1995 under Dr Cheddi Jagan. In December 1997, he was appointed as the second Vice President.

While noting that constitutional immunities prevent them from charging Jagdeo while he was President, Nandlall is of the opinion that the coalition Government will go as far as it takes, even if it means going as far back as two decades to persecute him for transactions done while he was Finance Minister.

But Nandlall said what is interesting to note is this period saw the sale of National Bank of Industry and Commerce Limited’s shares to Republic Bank, the sale of Stock Feeds and Neocal to Robert Badal, and the sale of Guyana Stores Limited to Tony Yassin; all of which are now labelled as “corrupt transactions.”

Further, the MP feels the Government may not stop at Jagdeo but could see former Finance Minister Asgar Ally being questioned as well. “What I do know is that they will stop at October 5, 1992,” he added.

“So they will not investigate the sale of Guyana Telecommunications Corporation to ATN; they will not investigate the

sale of Demerara Timbers Limited, or the sale of over seven State-owned rice mills, or the sale of the National Paint Company or the sale to Carl Greenidge, while he was Minister of Finance, of a property at Bel-Air Gardens by NICIL – none of which was the subject of any form of tender and none of which were sold pursuant to any valuation certificates, or even at market value.”

However, he reiterated that there is a principle of law which prevents investigations of certain transactions that took place several years ago, on the ground that it is unfair and against public policy to do so because of the lapse of time.

“The rationale is that if persons were to be charged as a result of those investigations, it would amount to an abuse of process to subject those persons to a trial because of the lapse of memory, absence of evidence and absence of witnesses, etc,” he explained.

He noted all of these will militate against an accused person having a fair trial which is guaranteed as a constitutional right because the law recognises that such a person may be unable to adequately defend himself in the circumstances. In addition to that, the local justice system protects against such eventuality in preservation of the doctrine of presumption of innocence.

Nandlall therefore concluded that it is unfortunate that the Office of the Director of Public Prosecutions (DPP) does not see it as part of its constitutional mandate to protect the citizenry from these types of investigations, which are widely regard-

ed as abusive and oppressive, but rather is part of the design that is promoting it. “If this is not the use of the criminal legal process to persecute political opponents, then I do not know what it is. Perhaps you can assist me,” he added.

Sasenarine Kowlessar, who was recently arrested

and questioned by SOCU, served as Jagdeo’s Finance Minister from 1999 to 2006.

Prior to Kowlessar’s arrest, Dr Ashni Singh – also a former Finance Minister, and NICIL’s CEO were arrested, charged and placed on bail.

The duo was charged for alleged misconduct in public office for the sale of several plots of land on the East Coast of Demerara without a valuation exercise. Jagdeo has declared that all three charges against Singh and Brassington are frivolous, and all three matters were approved by the Cabinet.

The Director of Public Prosecutions (DPP) is yet to respond to a written request by Nandlall to review the charges against Singh and Brassington. Yet, similar charges instituted by the PPP against five sitting Government Ministers have, on the other hand, been thrown out by the DPP.

Prison reform needed

ast week, a series of photographs and videos which depicted prisoners who were sentenced or were on remand for serious criminal offences enjoying their ‘time’ behind bars at what would appear to be a Mother’s Day “lime”.

The prisoners appear to be in a celebratory mood as they took shots of at least two high-priced alcoholic beverages, namely Ciroc Vodka and Hennessy. A portion of the video footage which later emerged showed the men watching cricket on television and bonding while another portion showed at least one prisoner counting a set of $5000 bills and placing them on a plate filled with marijuana and other illegal items.

While Guyanese were not taken aback by the fact that the prisoners had access to cellular devices and social media, they were shocked at the photographic and video evidence of what takes place behind the bars of prisons in Guyana. Many were concerned by the fact that criminals and persons on remand had access to alcoholic beverages and illicit drugs and items within the prison walls.

Also, the fact that prisoners felt that they could upload the video footage and photographs on social media without fear of being reprimanded or discovered is also appalling. The media’s reportage of the photographs and videos which went viral in Guyana has made headlines across the Region and within the Guyanese Diaspora abroad.

The entire episode had made a mockery of Guyana’s penal system and has emboldened the minds of those would-be criminals because they now see it is possible to have a “sweet life” behind bars. Also, it has exposed the fact that there are very serious security breaches taking place within our prison system almost daily, many of which remain unreported and underreported.

The incident has also left more questions than answers in the minds of all those who were puzzled by the Mother’s Day “lime”. Is this the norm when there are other holidays such as Christmas, Mashramani and Easter? Where were the prison wardens at the time the fiesta was taking place? Who was the senior officer on duty at the time? How did the prisoners manage to access cigarettes, marijuana, and money while in jail? Who was the mastermind behind the lucrative trade?

How are the prisoners managing to conceal cellular phones with Internet access when the prison authorities claim that they conduct regular routine and unscheduled searches of the prison quarters? Do the prisons have wifi?

That aside, the Government’s response to such a serious security breach could be described as indifferent and cavalier.

Apart from President David Granger expressing concern in passing over the issue and Public Security Minister Khemraj Ramjattan ordering a probe, the Government has not expressed outrage or demanded the resignation of the Prisons Director or the senior officers who were on duty. There has been no release of information from the prison itself which suggest that any official has been sent on leave or sanctioned as the internal probe gets underway.

While it is understandable that people are innocent until proven guilty, a situation of this nature demanded more assertive action and a constant release of information about what is being done to the public. Surely, these prisoners having access to social media, the outside world and other forms of illicit substances and improvised weapons could result in more harm being done to the public good and the country’s overall security sector.

More must be done on the part of the Government to pilot and implement prison reforms that would modernise this country’s holding facilities and penitentiaries. Surely, no right-thinking Guyanese would support recreational facilities for prisoners without first having enough programmes aimed at creating behavioural change and a paradigm shift in the psyches of the prisoners themselves.

Given all the unfortunate incidents that have taken place and the fatal events associated with the prisons, the Government should have demanded the resignation of those responsible from a policy and managerial level to send a strong signal that there is nothing to celebrate about being incarcerated or imprisoned for petty and serious offences.

When one is placed behind bars, one is there to be punished for a crime against humanity or the State. One should use that time as a period of introspection, for expressing remorse and regret, and as a means of changing one’s offensive behaviour.

Where are the signs of the good life?

Dear Editor, Twice within weeks, I have been forced to use the word disgraceful and the reasons being that the situation in Guyana is so appalling that the only description that can best describe it is the use of that single word, disgraceful!

Last Friday, D’Urban Street, Georgetown became the scene of another deadly confrontation between armed thieves and law enforcement.

Two bandits were shot dead, stopped short in their tracks in the act of committing a crime. This latest incident came fast on the heels of a deadly shootout mere months ago in another ward of the city.

Now, I would like you to contrast the above occurrences with the circumstances of some other folks right here within the city limits, I speak of those greens sellers in and around the Bourda Market area. These are or-

dinary people like anybody else, trying their level best to eke out a living selling from the back of their vehicles.

Those farmers, after paying the council fees, were given permission to sell their produce for a meagre four hours per day. However, soon after that they were faced with eviction from that area; very soon after the collection of their fees, these farmers were told that they were illegal sellers and trespassers on the city’s streets.

The forceful removal of the predominantly Indian vegetable farmers from selling along Alexander Street is an act of extreme provocation. It is a discriminatory and unconscionable act meted out to those farmers by City Council staff.

The Georgetown City Council is continuing along the same path of Central Government, who revel in the thought of hurting a certain select group of people. These vendors have now joined the

ranks of thousands of their counterparts in the sugar belt in being snuffed out of existence and the right to survive. This is outrageously evil!

I want you to consider the aggravation, that state of being pushed over the limit for doing something that is perfectly normal, perfectly legal. That state of being totally provoked is enough to cause one to turn to a life of crime, but they would not!

These people could have easily taken up arms like the thieves of D’Urban Street, but they would not! They could have easily resorted to a life of crime, but again they would not. They are like true patriots, hardworking people who would rather tough it out each day and somehow create a niche where they can survive against the odds. Though discriminated against, these people are showing the grit and determination that oppressed people show under extreme and

trying circumstances. These are persons who have families to take care of, mortgages to service, while at the same time send their children to school. These mounting costs are almost unbearable, but as persons of character they rally on.

They are weathering the onslaught of an uncaring, heavy-handed, blatantly-biased regime and their operators.

Well then, President Granger and his PNC-led coalition should be utterly ashamed of themselves seeing these goings-on are taking place right here in the seat of Government and all we can get is this bland token response "we are concerned about the crime situation" and nothing else. What about ensuring the safety of your citizens? Where are the signs of the "good life?" Where is the hope for the youths?

Can royal love do away with reparations?

Dear Editor, What a fairytale wedding the marriage between Prince Harry and Meghan Markle has been. This is a wish come true for both parties. Mostly, people on a global scale were happy for this couple and I must say I agreed with Rev Curry, who was one of the preachers who spoke at the royal wedding. Love indeed conquers all. Love is the nuclear weapon that unites humankind to live in peace. I have no doubt Meghan, the Duchess of Sussex, will be a unique ambassador for peace and goodwill for all nations. Good luck to the princess. Love is, however, strong like a nuclear weap-

In today's atmosphere within the African Diaspora, and most Caribbean nations and organisations like Guyana’s African Cultural and Development Association (ACDA) are demanding reparations and an apology from the British Crown of which Meghan Markle is

now part of. That will place Meghan in a very precarious position. When an outsider marries into the Royal British family it’s expected that they will have to follow in the shadow of the Queen and her royal family keeping their lips somewhat closed.

And for this particular reason the Pakistani Doctor Hashmat Khan (CCN aired 5/ 19 /18) refused to marry Princess Diana after a divorce from Prince Charles.

Doctor Hashmat Khan and his family thought logically marrying Diana would have dire consequences living in the shadow of British royalty. Obviously we witnessed Africans globally cel-

ebrating Meghan’s marriage into the British royal family , and the Queen breaking all traditions of royal ethics (Princess Diana must be virgin, King Edwards VIII's abdication, Princess Margaret forfeiting her rights to marry a divorcée) and Africans rejoicing they have now reached the Promised Land.

Are Africans now willing like the Queen and British royalty to break traditions in their demand for reparations and forgive the ugly time of British colonisation and slavery all in the name of one love?

Deplorable state of Agriculture Road

Dear Editor, I wrote several letters about the deplorable state of Agriculture Road last year, but it seemed to be going on deaf ears. This road continues to deteriorate daily. Last year, Project Engineer Anthony A Haynes started some road works from the beginning of Agriculture Road. He graded the road from the beginning to the end of NAREI, but he claimed to have repaired this road up to Block CC, Mon Repos.

According to his letter published in reply to my letter dated August 4, 2017, he said the following. ‘’For the benefit of the reverend and the general public, please be informed that the rehabilitation of Agriculture Road, Mon Repos/Triumph, is being undertaken by the Ministry of Public Infrastructure under its Miscellaneous Roads Programme, 2017. The Contractor is KP Thomas and Sons Incorporated, the Project Engineer is Anthony A Haynes, the contract sum is

$59,031,149 and the site extends a distance of approximately 1230m.

Carriageway works include the upgrading of the road structure with mixed loam and/or crusher run and sealing using asphaltic concrete. The contract is scheduled to end in September of 2017.’’

As I mentioned before the work executed for about 800 metres he claimed was 1230 metres cannot cost $59,031,149 or even if his 1230 metres was correct to just dig out bad broken concrete and fill the road with’ ‘crusher-run’ and rolled it over with asphalt cannot

cost that sum. I believe and many others as well that it cannot even cost $10 million.

My concern was this engineer graded from the beginning of Agriculture Road to NAREI that’s approximately two miles or 3000 metres but only completed 1230m from his own words: why did he refuse to complete the remaining 1770 metres of deplorable road, full of pot holes, he was paid to complete? He even went away with his machinery after he dug up the road and left it; it was when I wrote a second letter he returned to complete the work of 1230 metres he claimed that is still incomplete. I am calling on the Auditor General’s Office to carry out an audit on the $59,031,149 that was spent on one third of the job on Agriculture Road that is still incomplete.

Not long ago, I was sitting by a friend who lives near the roadway in Agriculture Road, I heard a sudden sound like a bomb; my friend

and I rushed to the scene. A young lady was driving her RAV4 vehicle and her tyre was punctured in a very deep pothole; her vehicle skidded around and hit a parked truck.

Potholes are all over this road just after Block CC going to NAREI if you are not familiar with these potholes while driving you can crash easily into another vehicle or land yourself into the trench. I have seen two such incidents already.

This is a road that has the Guyana School of Agriculture and NAREI, but it’s an eyesore to this area and nation as a whole. It’s only when the Minister of Agriculture or the President is coming to the School, the administrators will get the students to patch the holes with sand.

I believe they all should be fired because they can’t even use their machinery to even throw in some brick to patch these holes that can drown a child when it rains.

nationalistic, less narrow-politically motivated initiatives for the development of our country is indeed music to the ears for Guyanese who are tired

of bickering and back-biting and truly want to see us working together to address the problems of our nation.

It is a pity to read that

the expected response has not been forthcoming.

I am sure I reflect the views of most nationalistic Guyanese that not only the PSC, but all other na-

tional groupings including our trade unions, churches and other social groupings should insist that we eschew our divisive baggage of the past and work

towards new collaborative approaches for the development of Guyana.

Brothers on trial for attempted murder …older sibling claims victim verbally abused, attacked him

he High Court trial of Brian Joseph and his younger brother, Dequan Small is expected to conclude today – days after the duo denied allegations that their actions almost 11 years ago – nearly caused the death of the Virtual Complainant, Shawn Hussain at Diamond, East Bank Demerara.

The State’s case stated that following a confrontation, the then 17-year-old Joseph beat Hussain about the body with a wood on June 24, 2007 with intent to murder him or alternatively, tried to maim, disfigure or cause grievous bodily harm.

His younger sibling, who was 13 at the time, is accused of abetting and procuring his older sibling to commit the offence. The Prosecution on Tuesday stressed that in the presence of other persons, it was Small, who handed a piece of wood to Joseph, to commit the act. However, two men, now in their twenties disputed the case, painting a different picture as to what transpired.

Both gave unsworn statements to the 12-member jury, which meant that they could not be cross-examined by prosecutors or be questioned by the Judge or jury.

Small, who stood for just a

few minutes, told the court he was nowhere around when the beating took place.

He said all he could remember was being home on the day in question when Police arrived in the evening and were looking for his older brother, Brian Joseph.

Meanwhile, Joseph addressed the jury for over 20 minutes, telling members that he was now a father of four children. His account was that as he was passing Hussain, he verbally abused him. He indicated that the victim identified him by race and made certain derogatory remarks, which he expressed in open court.

Block maker slapped with attempted murder charge

n Albouystown, Georgetown block maker was on Tuesday remanded to prison after he was slapped with an attempted murder charge and placed before the Georgetown Magistrates’ Courts.

Twenty-seven-year-old Malcolm Culley, of Lot 154 Cooper Street, Albouystown, Georgetown, had the charge read to him by Chief Magistrate Ann McLennan.

The court heard that on May 18, 2018 at

Albouystown with intent to commit murder, Culley wounded Rawle Khan.

On Tuesday, the court was informed that the injured man was still hospitalised at the Georgetown Public Hospital suffering from a punctured lung.

In a bail application, Culley’s Attorney, George Thomas, told the court that his client, a father of one, was soon to be a parent again.

He highlighted that Culley had no previous mat-

ters in the courts and did not pose a flight risk.

However, Police Prosecutor Gordon Mansfield objected to bail and revealed that Khan was not out of danger. The Prosecutor added that the Virtual Complainant was nursing a punctured lung, broken ribs, and multiple lacerations about his body.

The prosecution’s submission was upheld, and bail was denied. The case will continue on June 11, 2018.

…and politicians ell, it’s certainly past time! Time for some group with clout to sit down this government and explain the facts of (economic) life for a country. The Private Sector Commission (PSC) decided to call in all the political parties for a palaver on what the politics of unilateralism is doing to the economic prospects of our country. The perspective goes beyond the specific poor decisions made in so many areas – such as dropping tax reform like a hot potato – but involves the context of business decisions. Of which, this government is clueless!!

The economists would like us to believe businessmen or entrepreneurs make their decisions to invest or not invest, or pull their funds from the market, etc…based on “rational choice”. That is, at every intersection of the variables in their business environment, they examine the pros and cons of the available choices and then make a “rational” choice. Sounds good, doesn’t it? For what it’s worth, the rational choice model was extended by the economists into every aspect of our lives. Looking at the supermarket shelf, are we going to buy the Heinz, Hunt’s or Del Monte Ketchup?

But your Eyewitness figures you’ve spotted the flaw in the argument – which has pulled the rug out from under the economists influencing governmental policy. You didn’t choose the Hunt’s because of that comparison of qualities, did you? You went with your GUT feeling. The decision was more emotional than rational. The irrelevance of the “rational choice” model becomes even clearer when we think about how we make our POLITICAL decisions. Did we really compare and contrast the PPP and the PNC according to some set of factors? Naaah!! You know we didn’t! Gut feeling, Budday!

And we return to the point about the PSC’s timely call to get the Government to stop with the schupidness it’s on. It’s been known from the days of Walter Raleigh that Guyana’s chock-full of resources. Rational choice theory would’ve predicted that businesses with capital and knowhow would’ve sat down and done their comparisons, etc…and invested! Some did, of course, but not nearly enough.

Why? They were scared away by their gut feeling about a country ruled by arbitrary despots like Burnham.

This loss of confidence can happen even in developed countries – like the Great Depression, which Keynes said was caused by “animal spirits” – his name for gut feeling.

Right now, the animal spirits pervading businesses in Guyana are driven by the feeling these yahoos in Government don’t know their ass from their elbow when it comes to investment.

The ongoing vendetta on old privatisation deals is a perfect example.

Why are PNC privatisations like Demerara Timbers, National Paints…getting free passes? …and oil negotiations Lumumba really made mincemeat out of Trotman when the Natural Resource Committee examined the bonus the latter had claimed he “negotiated” with Exxon, didn’t he? We discovered sooo many things.

Trotman let on as to how the US$18 million figure for the bonus was arrived at by some other department (most likely Foreign Affairs) because that’d be around the amount they’d need to handle Venezuela’s border controversy at the ICJ. Can you imagine NEGOTIATING for a bonus and not even connecting it to the amount of oil under the ground? Here we are, a certified shithole country that’s salivating for an injection of funds up front and we ASK for a measly US$18 million when we have 3.5 BILLION bbls?? It gets even scarier when we consider Trotman was the man who’d proposed early in the day that Exxon could extend funds to us up front against future revenues.

Your Eyewitness won’t even mention Trotman’s admission that there’s no “paper trail” on the bonus. It was all “verbal”!! …on CCJ PM Freundel Stuart on his intention to have Barbados withdraw from the CCJ: “I’m not going to have Barbados disrespected by any politicians wearing robes. It is not going to happen.”

Imagine the uproar if Jagdeo had said the same!!

nother woman is dead at the hands of her allegedly abusive partner – 32-year-old Lowtie Atwaroo, called “Mona”, of Lot 221 Plantation Walk, Herstelling New Housing Scheme, East Bank Demerara (EBD).

According to Police reports, the incident occurred about 21:00h on Monday when Atwaroo went to visit her reputed husband, 38-year-old Daniel Watson.

Investigations revealed that Atwaroo moved out of the couple’s home at Lot 1262 Plantation Walk, Herstelling over two months ago after

being allegedly abused by Watson. However, they allegedly continued a visiting relationship.

Reports are that about 20:30h on Monday, the woman went to visit her reputed husband and shortly after was seen submerged in a drain.

Watson reportedly fled the scene, but was later apprehended and was now in Police custody assisting with investigations.

Atwaroo’s body is at the Lyken Funeral Parlour awaiting a post-mortem examination.

old son heard a female’s voice calling out for help. They recalled that when they ran outside to investigate, they

saw the suspect submerging Atwaroo in a trench about 50 feet away from their house.

As such, the men reportedly

began to shout at him while running to their relative’s assistance. The suspect then fled the scene.

Atwaroo’s brother allegedly pulled her out of the trench after observing that she was motionless.

When Guyana Times visited the home the couple had shared, neighbours expressed their surprise at the incident and described Watson as “quiet and easygoing” while they claim that Atwaroo was an aggressor.

They confirmed the couple parted ways over two months ago, but revealed that the dead woman would frequent

the man’s home.

“Mother’s Day, she (Atwaroo) come here and jump the fence and then she start breaking up all he windows and so. He wasn’t home and we stand up right here and see that happening and when I holler on she, she start cussing up and get on.

Another neighbour told this publication that they last saw Watson about 18:30h on Monday.

The Police investigation is ongoing.

speeding pickup truck attached to the Mahaica Police Station driven by a Police Constable crashed into a house at De Hoop, Mahaica after the driver reportedly swerved to avoid hitting a cow.

Acting Police Commissioner David Ramnarine has ordered an investigation into the accident, which has left three officers with minor injuries and hundreds of thousands of dollars in damage.

The Police, in a statement, said the accident occurred about 08:15h on Tuesday on the De Hoop Public Road, East Coast Demerara (ECD), which resulted in the Force’s vehicle, PWW 5411, acquired through a grant from the Chinese Government, being extensively damaged.

“The vehicle, driven by a Police Constable under the command of a Police Corporal, was proceeding west along the southern side of the road when the driver reportedly swerved further south from a cow; in the process, he allegedly lost control and the vehicle careened off the road and came to a halt after it collided with a house and turned turtle. The two ranks, along with

another, who was seated in the back seat, received minor injuries. They were taken to the Mahaicony Cottage Hospital, where they were treated and sent away,” the Police stated.

It was reported that no one was at home at the time of the incident. In the past,

the Police have been accused of abusing their power when it comes to using the roadways and adhering to traffic regulations. Quite often, with the lack of an emergency, Police Officers would disregard stop signs, traffic lights and other traffic signs to avoid being stuck in any amount of traffic.

In November of last year, the Chinese Government donated 55 pickup trucks, 44 motorcycles, 35 All-Terrain Vehicles as well as 5 buses to the Guyana Police Force.

The entire donation amounted to US$2.6 million and was paired with scores of computers and other technical equipment, all aimed at improving the efficiency of the country’s crime-fighting force.

One day after the donation, a Police Officer in B Division (Berbice) crashed one of the pickup trucks. Investigations proved that the Officer was overtaking a lorry when he col-

lided with a car and caused the accident. He was in the company of another officer when the vehicle he was driving, PWW 5452, collided with motor car PJJ 5270 on Cane Field Public Road, East Canje, Berbice.

He was dragged before the courts where he was charged with dangerous driving, placed on $20,000 bail, and transferred to A Division (Georgetown-East Bank Demerara).

Last month, Public Security Minister Khemraj Ramjattan had cautioned ranks against

careless use of the vehicles, warning that charges would be laid against them for the misuse of same. The Police Force said that several ranks who were involved in accidents, which caused damage to the vehicles, were all made to pay for their repair.

Another rank in Linden, Region 10 (Upper DemeraraBerbice) was also in an accident with one of the GPF’s vehicles a day after the vehicles were handed over to that region. Ramjattan, who was back in December speaking at

the rolling-out ceremony of the vehicles hosted at the Tactical Services Unit (TSU), warned “these vehicles are going to give us use for many years ahead, but please take care of them! Too many times I notice even senior ranks crashing and some even dying as a result of bad driving”.

The Minister had further warned that “standard operating procedures are now being implemented, one of which is if you drive badly and damage the vehicles, you will be charged.”

Changes to exchange rates by GRA

Price hikes will be passed on to businesses, customers – MP T he Guyana Revenue Authority (GRA) has issued a notice announcing the a further dip of the Guyana currency versus the United States (US) dollar; which will see increases being borne by businesses when paying customs duties.

According to a notice taking effect from May 1, GY$208.05 is to be exchanged for US$1. In the case of the British currency, GY$287.19 is to be exchanged for £1. The chang-

es have not gone unnoticed.

Concerns have already been expressed by some that this change will have an adverse impact on business. According to former Minister within the Finance Ministry and Opposition Member of Parliament (MP) Juan Edghill, the increase will likely be passed down to consumers.

“If the GRA put out an exchange rate that is higher than before, it means that when they’re calculating the value of an item, for

instance if they’re calculating the duties and the taxes at the new rate, you will end up paying more,” he explained, during an interview on Tuesday.

“If you pay more, the business person will have to pass that cost on to the consumer. So, the consumer would end up paying more. And that is the exchange rate that would be used for the currency in the acquisition of fuel, all other commodities. That will be official in all mat-

ters of taxation.” According to Edghill, it was therefore important for the GRA to issue its notice, as this will be its new modus operandi.

The former Minister within the Finance Ministry noted that this latest development is an indication of what is taking place on the market.

“That rate is fixed and driven by what is taking place; the demand, as well as the availability. The dollar has to be backed by some commodity, in our case its gold.

The movement of the rate is determined by what is taking place in the market.

And once that rate goes up, prices will go up.”

Foreign currency

Following last year’s reported crisis regarding the availability of foreign currency in the local market, the Bank of Guyana (BoG) Governor, Dr Gobind Ganga had stated last month that the bank now has over US$75 million in foreign currency.

“Currently, we have almost US$75 million of excess supply of foreign currency in the market with commercial banks, and we are hoping that this excess supply will drag the rates down further than where it is. So, it is not in shortage; there is excess supply of 75 million or more US dollars in the market,” Dr Ganga had asserted. While both the Central Bank and

the Government had maintained that there was no foreign currency crisis, several commercial banks and cambio dealers had insisted otherwise, jacking up the exchange rate for US dollars.

In fact, business owners had also complained about the apparent foreign currency shortage, saying that they were unable to readily make overseas payments by draft or wire transfer for products and services from overseas. Even citizens had borne the backlash of the crisis by paying high exchange rates.

Government, through the Central Bank, issued a circular to cambios and the local banking sector informing them of the regulated rates for foreign currency trade. According to the circular seen by Guyana Times, non-bank cambios must reduce the spread between the buying and selling rates on foreign currency transactions to no more than GY$3. During his 2018 Budget presentation back in November, Finance Minister Winston Jordan had said that the Bank of Guyana’s exchange rate for the Guyana Dollar to the US Dollar is expected to remain stable at $206.5 throughout this year, while adding that the US Dollar had appreciated by 1.6 per cent against the Guyanese dollar.

Solicitor General (SG) Kym Kyte reported to the court that the State was unsuccessful in its bid to locate the missing diamonds as many persons involved in the two decades plus matter have since died.

She also contended that the Plaintiff has to prove that the missing items were indeed diamonds.

Khan filed legal action against the State in 2011 seeking to recoup his uncut diamonds which the Police found some time after his Ewang Creek, mining camp in Region Eight (PotaroSiparuni) was robbed in 1994. The precious merchandise was taken to the Mahdia Police Station and transported to Police in E (Linden-Kwakwani) and F (Interior locations) Divisions and Khan said he was told that the items were exhibits in the case.

ter the matter garnered increased attention, at least two retired Police Officers published statements earlier this year denying involvement as it pertains to the missing items.

The State in its submissions related that Khan’s decision to wait until 2011 to file his claim was not within the three-year timeframe as outlined in Section 6 and 8 of Chapter 7:02 of the Limitation Act. On Tuesday, the Solicitor General told the court that the onus was on the Plaintiff to bring his claim within that time, adding that photographs could have been taken of the alleged missing diamonds.

According to court documents seen by Guyana Times, Khan wrote the late Police Commissioner Henry Greene in 2010, requesting the return of his diamonds. The businessman said while his letter was acknowledged, his property was not returned.

The State will call two witnesses to the stand while Attorney Nigel Hughes will call the businessman to testify in the trial which begins on August 23. In the meantime, the Judge gave both sides time to file witness statements.

Further, the State has until July 6 to file submissions on the limitation arguments while the applicant, Khan, will respond by July 20.

olice are investigating the murder of a supply chain manager attached to Canadian Headquartered Guyana Goldfields Inc, whose body was found bound and naked in a pool of blood on Monday night.

Dead is 42-year-old Canadian-based Guyanese, Neil Whyte, who joined the staff at Guyana Goldfields in July 2017.

According to the Police, Whyte was murdered sometime between 22:20h and 23:45h on Monday at his Lot 258 Thomas Street, North Cummingsburg, Georgetown apartment.

Whyte was found lying naked on his back while his hands were bound in front of him with black plastic cable ties. His body bore stabs wounds to his neck and other parts of his body.

The suspect in the murder has been identified as a 25-year-old ex-employee of the company. The suspect was apprehended at about 06:30h on Tuesday at

He was passionate about supply chain; he was very well organised and very well respected among his peers.

He is quiet, he is a loving

person and one who has dedicated himself to being charitable,” Benny told media operatives.

He added that there were no breaches in the company’s security protocols but did commit to improving the

security strength if needed.

Benny further stated that the security guard on shift is cooperating with the Police to get to the bottom of the incident.

Police investigations are ongoing.

by Barbados Prime Minister Freundel Stuart in relation to withdrawing his country from the Caribbean Court of Justice (CCJ) as its final court has received mixed reviews.

Local commentator and Attorney Christopher Ram is one who is not too pleased with the timing nor the content of Stuart’s statement, which was made recently at a political meeting in St Michael.

“I think that is most unfortunate because we should be trying to develop some kind of Caribbean jurisprudence, which admittedly the CCJ has not been able to do or has failed to do,” he stated.

While the Barbadian Prime Minister did not go into details, he cited disrespect from the Port of Spainbased court and the limited number of cases being brought before it.

Barbados on the same level as every other (Caribbean Community) Caricom country by de-linking from the CCJ in its appellate jurisdiction. We went in first and we can come out first,” Stuart said.

But in the same breath, he also stated that he will ensure that Barbados does not return to the Privy Council, which in effect means the

Barbados Appeal Court could be made the country’s final court.

More worryingly, however, Ram said the timing of his statement comes almost immediately after a judgement of the CCJ, which he might have considered unpalatable.

Ram said this is a bad sign because politicians and political leaders must certainly defer to courts in matters of law.

But Stuart had made it clear that he is not commenting on the decisions of the CCJ, noting that as an officer of the court and as a lawyer, he respects the decisions that courts make.

“When I’ve disagreed with them I appeal them. But, I’m not going to have Barbados disrespected by any politicians wearing robes, it is not going to happen. And I spoke about this privately to the present President of the CCJ. I don’t want to influence any decisions, I don’t care what they decide,” Stuart said.

Stuart’s comment is important for another reason, especially when another Caricom member country is considering to make the CCJ its final court.

“I think it is a setback although at the moment, there is no guarantee that he would be able to effect his wish. But coming just before Antigua was supposed to go to referendum. The timing is bad,”

he opined.

Only recently, the Antigua and Barbuda Government said it intends to hold a referendum within the next four months on whether or not the island would adopt the CCJ as its final court.

The country’s Prime Minister Gaston Browne, in tabling the Constitutional Referendum Bill 2016 in Parliament in October 2016, urged locals to support the initiative to replace the Privy Council even as he admitted that two-thirds support in the referendum “is a tall order”.

“At this time we should point out what are the weaknesses of the CCJ and try to fix those weaknesses, not try to weaken the court which I think he has done. His (Stuart) decision is certainly sending a signal to Antigua that could have unfortunate consequences,” Ram added.

Nonetheless, Ram firmly believes all Caricom countries should adopt the CCJ, regardless of the current criticisms it is faced with right now. He said if the CCJ has set a precedence based on facts, law and logic, then Caribbean countries should accept it, but must understand that it is still in its early stages.

“I think we all should do that. But Stuart has just undermined that kind of commitment to join the CCJ.” In March, the Trinidadbased court began the first of several hearings into Guyana’s Government appeal of the sovereignty of the people case.

Guyanese Cedric Richardson had challenged

the Constitutional amendments by Parliament that limits the number of times a person can serve as President. He claimed that these amendments were unconstitutional and such a change should have been enacted via referendum. The CCJ is presently considering the case.

But much controversy erupted in Guyana after National Security Minister Khemraj Ramjattan announced at a Berbice, Region Six meeting that the CCJ will rule in the Government’s favour in the case.

This prompted Opposition Leader Bharrat Jagdeo to question how it was that Ramjattan could have made such a public statement and whether or not he had inside information.

“I don’t know whether it’s loose talk or they do have inside information as they say, but either way this could affect the credibility of the court. If they claim they have inside knowledge, it could also be entirely false,” Jagdeo told the media during a recent press conference.

The CCJ was established in 2001 to replace the London-based Privy Council as the region’s final court, but while many of the 15-member Caricom countries are signatories to the court’s original jurisdiction, only Barbados, Guyana, Belize and Dominica are members of its Appellate jurisdiction.

The CCJ also functions as an international tribunal interpreting the Revised Treaty of Chaguaramas that governs the regional integration movement.

Ramsammy’s Ruminations Guyana, Indonesia to strengthen relations APNU/AFC's on-and-off Amaila Hydroelectric Project is misconduct in office

E

ven their staunchest supporters are disappointed with the performance of the A Partnership for National Unity/Alliance For Change (APNU/AFC) Government, in office now for three years. One of the fierce supporters of the coalition, a person that vigorously campaigned in 2015 on behalf of the coalition, Dr David Hinds, this past week expressed his unequivocal disappointment in APNU/ AFC, accusing them of being painfully visionless. Indeed, not only has APNU/AFC been visionless, they have been utterly clueless. They have no plans and yet they opted at the beginning to abandon major projects simply because these projects were either started by the People’s Progressive Party (PPP) or planned by the PPP. The APNU/AFC's rejection of Dr Leslie Ramsammy these projects had nothing to do with the soundness of the projects, but everything to do with the projects being too deeply-rooted in the PPP's DNA. Minister Raphael Trotman this past week informed the Natural Resources Sector Committee in Parliament that the Amaila Hydroelectric Project is very much back on the table.

This is in spite of the fact that in October 2017, Minister Joseph Harmon had announced that the Amaila was "dead".

On several occasions, Minister Jordan had announced that APNU/AFC has totally rejected this project and that to continue it would be a "downright criminal act". Since taking office, Amaila has been on and off. In the three years since APNU/AFC took control of the Government, they have treated one of the most transformative projects for Guyana as a game of yo-yo. There is only one reason – they cannot stand the thought of yet another major PPP project being made into reality.

The handling of Amaila by APNU/AFC is a prime example of the character of this Government. Unfortunately, it is not just lack of vision, it is also spite and incompetency. From the start, they wanted to deny Guyana the benefits of the transformative impact that Amaila would have on the social, economic and infrastructural trajectory of our country and our people. The only reason for this vile decision was that Amaila is "too PPP" and too much rooted in Jagdeo's footprints. They knew that Amaila was critical, but they simply could not stomach the fact that the PPP developed the Amaila project. This is the genesis of their confusion, not wanting to complete a PPP project, but recognising the tremendous possibility of Amaila. To make matters worse, the only success this Government genuinely can talk about are all deeply-rooted in the PPP footprints – the new CJIA, the East Coast and East bank four lane roads, the East Bank Berbice Road, rice, and oil.

The Amaila Hydroelectricity Project, one of the premier infrastructural development projects, is partly funded by the Norway Agreement. It is intended to help Guyana reduce and eliminate our dependency on fossil fuel. There is, in fact, US$80 million at stake. If Guyana does not use it for Amaila, we lose it. Importantly, with the initial scuttling of the Amaila Hydroelectric Project, APNU/AFC gave clear signals that its talk of a green economy is a smokescreen to weaken Guyana's carbon footprint and carbon credit equity. Guyana's commitment at the Paris Climate Change Agreement in November 2015 to significantly reduced its dependence on fossil fuel and derive 90 per cent of its energy from clean fuel by 2025 cannot be achieved without Amaila. Norway has indicated that Amaila is the best way to achieve a fossil fuel-free energy architecture. APNU/AFC's stubborn refusal to embrace Amaila, therefore, jeopardises the Norwegian Agreement and in the process has caused an interruption of carbon credit funding. In fact, not only has replenishment of the US$200 million replenishment been interrupted, but APNU/AFC's recklessness is aborting Guyana's chances of earning more than US$250 million annually in carbon credit.

APNU/AFC has been downright ambivalent in their approach to the Norway Carbon Credit Agreement. APNU/ AFC's commitment to the Low Carbon Development Strategy (LCDS) has been lukewarm, if not a posture of outright rejection. Instead of embracing the LCDS and consolidating our pathway towards a carbon credit payment of US$250 million annually, APNU/AFC seems more interested in erasing the PPP footprints from this innovative and global best practice, one that earned Bharrat Jagdeo the UN Global award of Champion of the Earth. The consequence is severe, chief among them, is we are not certain that Amaila will ever happen. Had they continued the project, Amaila would have been producing electricity right now, our cost would have been reduced by at least 50 per cent and over the next 20 years we would have saved over $400 billion. The ambivalence shown towards Amaila, therefore, is a prime example of political malfeasance and misconduct in office.

uyana and Indonesia have expressed a common interest in strengthening bilateral relations between the two States.

This was discussed during a recent meeting between Guyana’s Foreign Affairs Minister, Carl Greenidge and Indonesia’s first female Foreign Affairs Minister, Retno Marsudi.

“Guyana is keen on strengthening its cooperation on the political, economic and commercial front in areas of preservation of the environment, energy, agro-processing, scholarship offers, and trade and investment,” Minister Greenidge said.

Further, Minister Marsudi shared her country’s commitment to further strengthening relations with Guyana through in-

creased trade relations and technical cooperation.

Guyana and Indonesia established formal diplomatic relations on August

27, and have collaborated in international fora such as the Non-Aligned Movement, the G-77 and China, and the United Nations, among other areas.

During the meeting, Minister Greenidge also used the opportunity to express condolences on behalf of the Guyana Government, on the loss of lives in recent terrorist attacks in Indonesia.

“Terrorism is a problem that affects everyone, thus there is an urgent need to strengthen international cooperation among States to fight against transnational organised crimes,” he stressed.

Pushcart vendor charged for stealing $2000

pushcart vendor who alleged that he was beaten after he reportedly stole $2000 was on Tuesday granted self-bail

when he appeared before Chief Magistrate Ann McLennan.

Forty-nine-year-old Lyndon Jagman of Lot 3010 North Ruimveldt,

Georgetown, denied that he stole the cash on May 8, 2018 at Lombard Street, Georgetown from Alesia Lawrence.

Govt stands firm on stability clause in oil contract …says clause meant to reassure ExxonMobil

overnment is standing firm against the avalanche of criticism that greeted the stability clause in the contract it signed with ExxonMobil.

According to the Government, the clause was intentionally meant to assuage the company’s concerns.

During a recent appear-

ance before the Natural Resources Committee, subject Minister Raphael Trotman was called upon to account for the much-maligned clause. According to

Trotman, Government needed to send a message that it was a trustworthy investment partner.

As a consequence, it agreed to the clause, which

has drawn criticism from sections of society given its favourability to the oil company. However, Trotman made comparisons between the Exxon Production Sharing Agreement (PSA) and the agreement with Anadarko Petroleum Corporation.

“Companies like Exxon and Anadarko want to know that there is a strong regime, that the Government of Guyana will not cave or try to renegotiate the clauses dealing with the signature bonus, given the history as to why the bonus appeared with that name,” he explained.

“The signature bonus was really a request made by the Government. The contract was not one given to Guyana or fed to us by Exxon. It was our contract which we used to update. I have spoken about the natural gas and what regime is there. We’ve spoken about local content and what fees.”

Stability clause

Article 32, known as the stability clause, stipulates that Government cannot modify the contract or increase any fiscal obligation the company has. This, therefore, puts a cap on the taxes, royalties, duties, fees, or charges outlined in the contract. Government also has to compensate the operator if a change to existing laws causes loss of revenue

for the company.

According to Article 32.3: “If at any time after the signing of this agreement, there is a change in the laws of Guyana … and such a change has a materially adverse effect on the economic benefits, including those resulting from the fiscal regime provided by this agreement … the government shall promptly take any and all affirmative actions to restore the lost or impaired economic benefits to contractor, so that contractor receives the same economic benefit under the agreement that it would have received prior to the change in law or its interpretation, application, or interpretation.”

The contract goes on to say “the foregoing obligation shall include the obligation to resolve promptly by whatever means may be necessary any conflict or anomaly between this agreement and any such new or amended legislation, including by way of exemption, legislation, decree and/or authoritative acts.”

In Article 15 of the contract, Exxon is exempt from paying Corporation, Excise or Value Added Tax on its earnings from petroleum.

Article 15.4 also provides for the Government itself to pay the company’s income tax. To facilitate this, the oil company has to submit tax returns to the Government.

Teen on $200,000 bail for narcotrafficking charge

A

19-year-old Linden resident found himself before Chief Magistrate Ann McLennan on Tuesday charged for trafficking in narcotics.

Junior Wilson, of Amelia’s Ward, Linden, denied that on May 18, 2018 at Omai Landing, Essequibo River, he had 749 grams of cannabis in his possession for the purpose of trafficking.

The court heard that Wilson was intercepted with the drug after a motor van in which he was travelling was stopped and searched

by Police.

His attorney, Dexter Todd, in a bail application, told the court that the cannabis was discovered inside a cooler that was in the said van, which had other occupants and as such, he requested that bail be granted to his client.

However, Police Prosecutor Gordon Mansfield revealed that Wilson admitted to being the owner of the drug.

Magistrate McLennan released the teen on $200,000 bail. The case was transferred to the Mahdia Magistrate’s Court for hearing on July 17, 2018.

ollowing allegations of malpractice and less than desirable treatment of the family of Dawn Cobis; the woman who died after giving birth at the New Amsterdam Hospital, the hospital’s Chief Executive Officer, Colin Bynoe said they are concerned hence, the reason an investigation was launched to “get to the bottom of things.”

Reports are the 31-yearold mother of one died last Wednesday after giving birth to a baby boy via a caesarean (C-section). Guyana Times understands that Cobis of Kimbia, Berbice River, reported to relatives that she was feeling unwell after being taken from the labour room to the maternity ward. Her relatives said she told them that when this was reported to nurses on duty, they told her that she was “playing tricks”.

Additionally, relatives that they are still awaiting a proper explanation from the hospital’s authorities and that both doctors and nurses are denying them a meeting.

When these accusations were put to Bynoe during a telephone interview on Tuesday, he said it would be preempting the findings of the investigation if he commented on the progress they are making. However, he did say that the investigation will take time since they have to sort out each member of staff that came into contact with Cobis during her stay at the medical institution.

Plans underway for martial arts film

s the Korean International Martial Arts Guyana (KIMAG) prepares to host its Guyana South America Undiscovered Martial Arts Championships, the organisation has disclosed that it is streamlining plans for a martial arts film that it is hoping to produce.

Local martial artists will have the opportunity come July to audition for a part in Guyana’s first martial arts film. The film will seek to paint Guyana as a tourist destination and showcase Guyana’s talents. At a press briefing on the eve of the match, Head Coach, Dr Ivan Joseph conveyed his team’s greatest asset will be their defence since he is a firm believer that a strong defence can win matches.

“You can score six goals, you can score eight goals but you can still lose the game. The only way to guarantee yourself a point is to allow none,” Dr Joseph vehemently stated.

The new head coach announced that though results are necessary, they are not everything, as he seeks to build a programme that develops other players so they can sustain success. On the other hand, Bermuda has been touted as Guyana’s biggest threat and are known for having a powerful Under-17 team which will be mixed with their seniors who play college football in the United States.

According to their head coach, Naquita Robinson, Bermuda will be playing the Jags for the first time based only on knowledge they acquired from watching videos.

Commenting on how she plans to unlock the touted “tight defence by Guyana”, she stated “they need goals too, at some point we will draw them out so we are able to attack the goal. I have complete faith we will able to unlock that defence”.

Should Guyana end at the top of their group, the

team would join the other first place winners in a battle to see which three teams will travel to the USA. That competition will run from August 25 to September 2.

Those top three teams will travel to Edinburgh and to Frisco in Texas to participate in the 2018 CONCACAF Women’s Championships which will qualify three teams for the FIFA 2019 Women’s World Cup in France.

From 17:00h, Barbados will play Suriname while from 19:30h, Guyana will play Bermuda. Guyana will face Suriname on May 25, and Barbados on May 27.

ormula Four driver Calvin Ming and hockey star Marzana Fiedtkou walked away with the top honours when the National Sports Commission (NSC) held its 2017 Awards ceremony on Tuesday evening at the Le Meridien Pegasus.

Both athletes dominated

their respective fields, bringing great recognition to the country.

Ming in particular has done a "solo" job by displaying the Golden Arrowhead by win the NACAM championship in Mexico, while Fiedtkou helped the country’s hockey team qualify for the Central

he Mayor and Town Council of Georgetown was bursting with pride on Tuesday afternoon as 2018 Commonwealth gold medallist Troy Doris graced the Council’s meeting chambers with a visit.

Doris, who is Americanborn to Guyanese parents, copped gold at the triple jump event with a leap of 16.88m.

Mayor of Georgetown Patricia Chase Green was all smiles when she met with the young man. Citing his recent success, Greene stated that Doris is in position to bring home an Olympic Gold in 2020. “I am certain that come 2020 that gold medal will be coming home to us after nearly 40 years,” she boasted.

Guyana’s last Olympic Gold was won by Michael Parris in 1980 for bantam weight boxing. The Mayor went on to pledge the municipality’s support to the young man for both his athletic and academic achievement.

A grateful Doris expressed appreciation for the overwhelming support he has received from the Guyanese populace. The triple jumper noted that he has set his sights on competing on a larger stage and coming out successful; “I don’t think this will be my last medal,” he stated.

Doris was presented with several plaques on behalf of the City of Georgetown prior to showcasing his Gold Coast 2018 medal.

The Junior Sportsman award was split between boxer Keevin Alicock and sprinter Compton Caesar while the female prize went to long jumper Chantoba Bright.
