ocal and international pressure continues to mount on Government, as President David Granger is yet to announce a date for early elections.

This time, both the European Union (EU) and the Private Sector Commission (PSC) are warning of the need for constitutional compliance.

In a statement on Monday, the EU’s local mission revealed that it was keeping an eye on developments following the vote. The EU urged that democratic procedures and the rule of law be respected and upheld.

Undermining the Constitution

T

he Constitution of a country is its highest law and has been called “the law of lawmaking” for the State. It structures and limits the powers of the three branches of Government – the Executive, the Legislature and the Judiciary – and between the organs of the State and the people. Our present Constitution was first promulgated in 1980 and was revised extensively in 2000, after countrywide hearings.

While there has been expressed dissatisfaction with aspects of our Constitution, and “constitutional change” has become a mantra during election campaigns, the unalloyed consensus in Guyana, and in all constitutional democracies, is that the laws of the Constitution must be obeyed by all the institutions its speaks to, if anarchy and the rule of the jungle are not to take over. Sometimes, the wording of a constitutional stipulation may be elliptical and gnomic and these, it is accepted, can be taken to the judicial branch of the Government for an authoritative interpretation, in concrete instances of its operation.

But in others, the Constitution speaks in clear, precise and unambiguous terms and these should not precipitate any controversy. So, for instance, when a “majority” in our 65-member House of Assembly was constitutionally required, it had always been accepted by all parties in that Assembly that this was 33 seats, since this number would always be greater that the highest possible alternative of 32 seats, configured in whatever possible permutation or combination. Thus in 2011, when the People’s Progressive Party (PPP) won the presidency on account of garnering the plurality of the popular votes, in the National Assembly, the A Partnership for National Unity’s (APNU) 26 seats and the Alliance For Change’s (AFC) seven seats automatically constituted a “majority”, which the PPP with 32 seats accepted, for instance when those two parties were allowed to name the Speaker of the House and have the majority in most standing committees.

In 2015, when the APNU and AFC formed a pre-election coalition and acquired 33 seats compared with the PPP’s 32, with that universally accepted majority of the House, they were able to name the President as well as use their majority in the House, to pass their budgets. Not a squeak was heard from that time to 2018 about the nature of the majority on which the Government’s legitimacy was based. And then came the Noconfidence Motion of December 21, 2018 when with all 65 MPs present, one MP from the Government benches voted with the Opposition’s 32 to give the latter the majority. And evidently having lost their reason, all judgement from the Government evidently fled to “brutish beasts”, after an initial acceptance of their new circumstance.

Tossed a straw, the Government now insisted that to obtain a majority of 65 MPs, one had to first divide them by two to obtain 33 plus one ½ person and then “round up” by presumably taking the other half body to make the latter “whole” and then add another body to give 34. In the concrete instance in the National Assembly, when the no-confidence vote was being taken when the Opposition received 33 votes one, the Government now insisted that one more vote from the Government benches was necessary to produce the “majority” of 34 to 31.

And it is this contention more than any other that the People’s National Congress-led Government raised in the courts, which demonstrated its callous betrayal of constitutional governance by debasing the constitutional rules in the eyes of the people.

As the Chief Justice noted in her oral judgement, if Charrandas Persaud had not voted with the Opposition, the Government would have blithely accepted that it had the “majority” of 33 to defeat the No-confidence Motion as had been touted by the PNC’s Chief Whip when she taunted the Opposition to “bring it on!”

After the Chief Justice ruling that 33 is the majority of 65, the Government signalled they would be appealing. It is our hope, that even at this late stage, the Government would recognise the cynicism it is engendering in the populace on democratic norms.

City Hall’s restoration study

eorgetown Mayor Ubraj Narine was on Wednesday presented with a concise document, created by the European Union, in relation to the restoration of City Hall’s deplorable structure and ways in which the space can be utilised to garner independent revenues. EU Ambassador to Guyana, Jernej Videtič made the presentation to the Mayor alongside Deputy Mayor Alfred Mentor.

Speaking with media operatives after discussions between the two parties, Videtič explained that some £280,000 was expended to craft the document, bringing new ideas to the restoration project. He noted that some plans include using the historic building as a tourism spot, where it can be booked for special events to earn money.

“We have handed over plans for the restoration of the City Hall. This cost the European Union £280,000 to produce. We were speaking on how to realise this plan and restore the City Hall to be used for tourism and how to use the City Hall for future generations for

weddings, concerts, receptions so that [it] can generate its own [revenue] and be sustainable. And other ways to fund this restoration because it’s not cheap. On the long term, the money that we invest will come back through this business model,” the Ambassador revealed.

Adding to these talks, implications of the impending oil sector was also discussed along with strategies to lure potential investors. Urban planning was mentioned as a key factor in this transition.

“We spoke about Georgetown and its future and where we could assist the city especially in the view of the future oil revenues and investments coming into Georgetown by foreign investors and European investors. We agreed that the city needs to plan better, especially the urban planning so that future investors would know where they could invest and build and how to make Georgetown a financial hub,” Videtič explained.

Narine, for his part, labelled the meeting as a fruitful one, highlighting that the

Council was working to execute these projects.

The Georgetown Mayor and City Council (M&CC) has pegged the overhaul of the City Hall building at over G$400 million, and noted that stakeholders would strive to attain funding for the rehabilitation works.

Last May saw the hosting of a two-day workshop at Duke Lodge to facilitate a study for a Comprehensive Restoration and Sustainable Conservation Management Plan for the 19th Century structure.

The project is an EU-funded initiative that was formed out of collaboration with the M&CC and the National Trust of Guyana. The assessment plan falls under a contract, which has special focus on the physical and structural state of City Hall and the City Engineer’s Building.

The building has suffered much neglect over the years even though millions of dollars have been allocated to facilitate repairs, including some G$20 million in 2012.

Exxon strikes more oil offshore Guyana

nited States oil giant ExxonMobil has made two more oil finds offshore Guyana, bringing the total number of discoveries in the Stabroek Block to 12.

The discoveries, which were made at the Tilapia-1 and Haimara-1 wells in the South-west section of the Stabroek Block, were announced by Director of Energy, Dr Mark Bynoe, in a statement on Wednesday. The US-based company also confirmed the finds on its Facebook page.

This new discovery, he said, reinforces the country’s potential to be able to produce more than 750,000 barrels of oil daily by 2025 with at least five floating, production storage and offloading vessels (FPSO) on the Stabroek Block.

According to Dr Bynoe, “this continues to be positive news for the people of the Co-operative Republic of Guyana, but the real substance of these finds will come when all Guyanese are able to benefit from these discoveries, whether directly and/or indirectly.”

The US oil giant’s 11th discovery in the Tilapia-1 well is the fourth discovery in the Turbot area that includes Turbot, Longtail and Pluma discoveries. Tilapia-1 encountered approximately 305 feet (93 metres) of high-quality oil-bearing sandstone reservoir and was drilled to a depth of 18,786 feet (5726 metres) in 5850 feet (1783 metres) of water. The well is located approximately 3.4 miles (5.5 ki-

lometres) West of the Longtail-1 well.

Dr Bynoe noted that the Noble Tom Madden drillship started drilling the well on January 7, 2019 and will next drill the Yellowtail-1 well, approximately six miles (10 kilometres) West of Tilapia-1 in the Turbot area.

Baseline 4-D seismic data acquisition is underway, he added.

Meanwhile, the 12th discovery was at the Haimara-1 well which encountered approximately 207 feet (63 metres) of high-quality gas condensate-bearing sandstone reservoir. The well was drilled to a depth of 18,289 feet (5575 metres) in 4590 feet (1399 metres) of water. The Director of Energy pointed out that being located approximately 19 miles (31 kilometres) East of the Pluma-1 discovery, the Haimara-1 is deemed a potential new area for development.

Furthermore, he added that the Stena Carron drillship began drilling the well on January 3, 2019.

These two discoveries come less than two months after ExxonMobil announced its 10th find back in December at the Pluma-1 well, which had increased the estimated recoverable resource for the Stabroek Block to more than five billion oil-equivalent barrels.

Guyana is now home to the world’s biggest new deepwater oil discovery.

ExxonMobil has been keen to push development of the oil reserves and is expected to commence production sometime later this year or early 2020.

ew York Governor Andrew M. Cuomo has announced that two major carriers; American Airlines and British Airways, will invest US$344M in the John F. Kennedy International Airport to expand and improve the customer experience at Terminal 8 as part of the Governor's comprehensive plan to make the airport a modern, 21st century gateway to the nation.

"Only four months ago, we announced plans to transform JFK Airport into a state-of-the-art global hub, with new and unified terminals adding

4 million square feet and increasing the airport's capacity by at least 15 million passengers annually.

"Today that transformation is well underway, with an extraordinary private investment that will turn JFK into a truly modern airport. This new investment is part and parcel with the State's broader efforts to modernize airports all across New York. From JFK and LaGuardia to Ithaca and Rochester, we are making historic progress rebuilding our airport infrastructure for the future and ensuring New York State remains the nation's front

door," Governor Cuomo was quoted by his office in a press release as saying.

"This significant investment continues our efforts to expand and modernize services at JFK Airport," said Lieutenant Governor Kathy Hochul.

"The project will create new jobs and new opportunities for thousands of New Yorkers, and continue to grow our state's economy and attract more visitors. This transformation of JFK and other airports across the state will ensure easier and safer travel and enhance the overall experience."

Guyana Govt should show Jagdeo has laid a solid foundation the world it subscribes to for Guyana’s tourism sector to thrive int’l democratic norms

Dear Editor, The APNU/AFC coalition should demit office and the President should set a date for elections within the stipulated time frame before March 21. It is the honourable and right thing to do.

When the coalition APNU/AFC Government lost the no-confidence motion on December 21, there was a lot of sympathy for it. People everywhere praised the Government when their spokespersons (the Prime Minister, President and others) announced they would respect the outcome of the no-confidence vote and invoke the steps outlined in the Constitution that speaks to such a defeat – their words suggested that democracy came before politics. The Government had not lost much of its traditional support at that time, and there were even some (sitting on the fences) who may have been thinking of giving it another chance. At the time, with their words that democracy was at work, people saw the Government as respecting the Constitution and subscribing to democratic credentials.

But then there was a change of tone from the Government side; the political beast in it stepped in. The Government announced it would not accept the outcome of the no-confidence vote, presenting a set of ridiculous, bare-faced nonsensical, idiotic arguments (of a half man, no-confidence vote illegal, dual citizenship, etc) – all acts undertaken by the Government show it is

clutching at straws to hold on to power at any cost. At a minimum, people see these arguments as trending towards dictatorial behaviour or anathema to democratic norms. More and more, this Government is losing sympathy over its hilarious claims. It is best if the Government spokespersons just shut up, resign, and hold elections. It still has a chance of doing very well.

The coalition is not going to win any of its arguments to stay in office. The Speaker of the House ruled against it.

The Chief Justice landed another telling blow on Thursday – with three different rulings against the Government.

The Chief Justice or any further court could not rule any other way – the Constitution is clear – when the Government loses a no-confidence vote, it must resign (President and Cabinet) and be a caretaker Government until elections which must be held within 90 days. The Court of Appeal and the CCJ will not render a much different verdict – as the Constitution is very straightforward on the absurd claims made by the Government.

Some forty-five days have passed since the no-confidence vote. The Government has less than forty-five days within which GECOM must hold elections. The Government should resign now and set a date for elections to show the world it subscribes to democratic parliamentary principles.

No skullduggery will be accepted at GECOM Dear Editor, In light of the ticking constitutional clock, the suspicious silence of the unilaterally appointed GECOM’s Chairman Justice (retired) James Patterson, puts GECOM under the radar for highest scrutiny. Whatever the reason for President David Granger’s unilateralism, no skullduggery will be accepted as we arrive at the crossroads.

The Chairman and Chief Executive Officer Mr Keith Lowenfield are bungling with the necessary preparation for Regional and National Elections which are constitutionally due not later than March 19, 2019. This lack of accountability and transparency is very awkward, invites a crisis, and will have significant consequences for all and sundry.

In the past, Chairman Patterson publically spoke about the confidence he has in the GECOM staff. Further, the GECOM Public Relations Officer (PRO) reassured Guyanese that GECOM will be ready to carry out its function when called upon. This column, therefore, demands in the interest of all citizens, drastic changes to their ‘pussyfooting’ approach by the CEO and Chairman. This column definitively calls for swift decisive action in executing the business of their ob-

ligated constitutional responsibilities.

We note the calls of Commissioners and Staff members at GECOM who are very worried and have asked serious questions about the inventory of the existing stocks at the GECOM head office located at Coldingen, East Coast Demerara. The fact that there ought to be tens of millions of dollars in stock there and the lack of audit over several years is of strongest concern. It sets up the pitch for limitless and the familiar fraudulent practices already exposed by the Auditor General to be repeated as an excuse for short procurement timelines.

I urge the immediate commencement of refresher updates for the thousands of staff recently trained and used at the Local Government Elections, and a strong criteria-based approach for persons who are selected to work by the Commissioners at the Secretariat.

GECOM must also move to procure voter education delivery service in a fair and transparent way, towards the mandatory polls.

Dear Editor, I noted in an article a few days ago, concerning the value of the refurbished convention centre to the tourism sector. In the same publication I also observed that visitors’ arrivals this year was almost 285,000. Coincidentally, an acquaintance of mine and many persons verily accuse President Jagdeo of not doing anything for Guyana. Today’s tourism’s performance is all due to the vision of, and the foundation laid by, President Jagdeo.

The market segments identified for tourists were – visiting family and friends, nature, sport, conferences, heritage and yachting At the time of building the convention centre, 85 per cent of the market for conference tourism was for conferences of 500 delegates or less. The (Caribbean Community) Caricom Secretariat’s location in Guyana was another factor. Another consideration was accommodation.

When I was given the tourism portfolio in June 2001, President Jagdeo tasked that a sector-leading hotel brand be delivered to the tourism sector.

With only the Le Meridien (Pegasus), there was need for additional accommodation of international standards.

That was the genesis of the Marriott.

The Marriott Hotel was never built to shut down anybody, but to complement the existing stock of rooms. The first visit by the Marriott team was in May 1-4, 2006. Exactly three years later, Pegasus was sold to the current own-

ers. Buddy’s coincidentally, started for World Cup 2007. Today, two internationally recognised brands (Marriott and Ramada) are here. The fruits of vision and action two decades earlier.

The improvements at the Convention Centre are upgrades which, yes, will make us access the conference market better and is complemented with sufficient rooms.

Back to the issue of reaping the fruits today after sowing seeds yesterday. The Guyana National Stadium has added immensely to the sport tourism, with Guyana so far being a host of three cricket world cups and constant inclusion in the CPL games. Vision and action laying that solid foundation.

Recognising that modern infrastructure is also a necessity, the Jagdeo Administration embarked on the biggest local Public Private Partnership by making the Ogle Airport available to local operators and facilitating some CAPEX funding. Complimenting is the Timehri Airport expansion project.

This, along with the marketing programmes of Government and the tourism stakeholders were recognised by the World Travel and Tourism which assessed Guyana most favourably on its tourism development indices.

Guyana must run off elections on or before April 30

Dear Editor, Responding to reporters’ query regarding the voters’ list, the Chief Elections Officer, Keith Lowenfield declared, “the list is clean; it has a life until the 30th of

April.”

I suggest that all stakeholders work assiduously to hold the elections on or before that date. This would be a significant landmark decision in the history of the

country and would send positive vibes to the people of Guyana and those elsewhere watching our political imbroglio.

President Granger must be held responsible if there is a constitutional crisis

Dear Editor, Guyana is quickly approaching constitutional crises because of the refusal of the APNU/AFC coalition Government to accept the passage of the no-confidence motion and respect the Constitution of Guyana.

President David Granger as Opposition Leader protested the then PPP/C Government to respect the Constitution on numerous occasions, but unfortunately, despite the Chief Justice ruling on the NCM and the interpretation of the Constitution, David Granger refused to dissolve Parliament and announce the date for the Regional and General Elections.

While some may suggest that Granger is a man of honesty, integrity, respect etc, the refusal to resign is definitive evidence to suggest that Granger and his Government are intoxicated with the perks, corruption, good life, etc and would do anything to ensure they remain in Government le-

gally or illegally.

GECOM as an autonomous institution and a creature of the Constitution must be prepared at all time for an election since the Constitution outlined the basis and eventuality for elections. GECOM at no time can refuse to respect the Constitution of Guyana, so the main culprit behind the deliberate delay of elections is solely David Granger.

David Granger, while addressing the staff at the Office of the Presidency, publicly stated that whatever the outcome of the courts is he would respect the decisions. Unfortunately, we can only have General Elections if there is a dissolution of Parliament by the President, in accordance with the Constitution. Besides that, we are quickly approaching a ‘constitutional crisis’.

A question to be answered

Dear Editor, I have a question and I would appreciate an answer from whoever wishes to educate me about this issue. My simple question is which political party will form the Government if after the next election,

the two major parties each end up with 32 seats and another party with one seat?

Ok. This number, 32, has been featured too much recently. What if the two major parties each end up with 30 seats and the other parties with a total of five

seats? Which party will form the Government?

Editor, pity my simplicity for asking this question which might be totally irrelevant.

More hardships for redundant sugar workers …forced to pay daily fee to access fishing lands

edundant workers of the Skeldon Sugar Estate are being charged a fee of G$500 to pass through a cultivation dam to catch fish.

The fee is being imposed by the Special Purpose Unit which was set up to oversee the privatisation of the sugar estates.

The workers who were made redundant when the estate closed are now facing major difficulties as they look for new employment. Those who have decided to turn to fishing are now being charged a fee to travel through the cultivation dam to ply their trade.

They catch fish and reap wild karela from the savannahs, which is located behind the cultivation area, but is only accessible through the Skeldon Sugar Estate’s dams.

According to the former workers, the SPU is holding out that the jobless men and women will not be given access if they do not have the pass which cost G$500. The SPU is also issuing one month passes at a cost of

G$15,000.

Already hit by hardship with the closure of the estate, many have turned to fishing to make a living while others catch fish in the savannahs to provide a meal for their families.

Manam Singh, a former cane harvester who worked with the estate for 22 years and is a father of four, told Guyana Times International on Wednesday that sometimes he buys the SPU pass and catches nothing. On Wednesday, he left home at 03:00h and at 10:00h returned home empty-handed.

“G$500 you have to pay plus you have to buy gas and carry thing to eat at the back dam; is more than G$1500 you spending and catching nothing. I can’t afford to pay G$500 per trip. It very hard, I got children going to school; three of them going to high school,” he told this publication.

Initially, the ex-workers were not required to pay a fee to pass through the cultivation area but then a fee of G$100 was charged which subsequently raised to G$500 for a one-time entry.

who worked as a cane harvester from 1982 to when the factory was closed, cried out that the fee is too high.

“Right now you getting nothing and to find G$500 it is very hard now. You have to get gas money and you not catching G$500 fish. It is very hard.” He added that while it was unreasonable to have to pay G$100 monthly just to pass, use the cultivation daily get to the savannahs; they were able to live and accept that fee.

Edwin Persaud, a pensioner, who has a sick wife, fishes for domestic purposes. According to

him, sometimes he tries to catch enough to be able to sell a portion, but those days are seldom.

“I have no other alternative. I have house rent to pay, water bill and light bill to pay. I have a sick wife and every month I have to find money for medication.

This is harassment. I use to pay G$100 to go in the backdam, now they want G$500. If you buy G$3000 for the month and you don’t get to go three or four days that that money confiscated.”

Dhanraj Chatterpaul, who worked as a Pallman with the Skeldon Estate, says being asked to pay

G$500 per trip has created financial pressure on himself and his family.

“Some days we leave home with G$1500 and rain fall and we have to turn back. You already pay G$500 for the pass and G$1000 for the gas; that is G$1500 you lost.

I don’t know what they trying to do with us, it working out to about G$15,000 every month.

That is like we paying a loan. Jobs are not available now. I don’t know what they want us to go and do,” the angry man said.

Chatterpaul said they were told that the SPU is charging the fee, so it can

have funds to pay rangers, who are employed to ensure that cows do not enter the cane fields.

Chatterpaul also related that the security employed with the Skeldon Estate would take away their catch, quakes and cast nets and take them to the Police station.

Mahadeo Singh compares their G$500 fee to go into the backdam with the G$7500 road service vehicles pay to use the road for an entire year and says it is not only unfair but unjust since it is the unemployed who are being asked to pay a fee.

Apart from those who go to the savannah to fish, women are also forced to pay the same fee to pick wild karela; some for commercial purposes and others to make a meal for their families.

“Is food and you don’t have to buy it, so we go and pick but if you don’t get a pass, the guards taking it away from you,” one woman said.

Guyana Times International was also shown several receipts from the former workers indicating that they have paid the fees as demanded by SPU.

JFK being transformed into ‘state-of-the-art... hancements will be made pursuant to an agreement between the Port Authority and American Airlines over the next three years in preparation for British Airways moving from their current location in Terminal 7, which will be replaced as part of JetBlue Airways' plan to build a new terminal on the airport's north side. No Port Authority funding is being committed to the Terminal 8 upgrade.

According to the Governor’s office, the announcement is the latest step in Governor Cuomo's sweeping $13 billion vision plan for the future of JFK unveiled in October 2018. This record investment, 90 percent of which is private funding, calls for a unified and interconnected airport featuring two new international terminals with state-ofthe-art passenger amenities, convenient ground transportation options, and vastly simplified roadways that will increase the airport's capacity by at least 15 million passengers per year.

including 33,000 square feet of public space.

Another 57,500 square feet of existing space will be refurbished. New amenities include premium lounges for both airlines, enhanced baggage systems, premium check-in space and upgraded concessions, the Governor’s office said.

There will be five additional wide-body gates to allow for more transatlantic flights and four nearby on-airfield plane parking/unloading areas to accommodate the added flights. As a result, passengers will have the increased flexibility of 14 daily flights to London from the same terminal.

The continuing investments come as JFK has been setting record passenger volumes in recent years, hitting an all-time high of more than 61 million passengers in 2018, up 2.5 percent from the prior year's record.

According to the Governor’s office, the Terminal 8 upgrade is expected to create 500 direct jobs and 750 total jobs over the project's life, adding to the 9,600 new jobs in the Governor's original $13 billion JFK vision plan.

he father of the newborn who was snatched from the Victoria Jubilee Hospital last month says he believes the child who was taken from a woman at the Registrar General Department (RGD) in Twickenham Park, St Catherine, on Tuesday is his.

“I am optimistic… I have a strong feeling is my baby, so me just a hope and pray for the best,” Sinclair Hutton told the Jamaica Observer yesterday following a DNA test.

Hutton and his common-law wife Suzzett Whyte will have to wait a couple more days to ascertain whether or not the almost one-month-old baby taken from a woman at the RGD is their second son.

The anxious father said his optimism grew when he and Whyte were Tuesday evening requested to do a DNA test by the Kingston Western Police Division.

“Me feel so good that me would a go down there and take me baby and say this is my baby, but I have to follow the process,” the father explained.

Even though Hutton did not get to see the baby yesterday, he said the fact that the child is a one-month-old boy was enough conformation for him.

rested a woman who attempted to register a child at the RGD on Tuesday. The woman and the baby were taken into custody after she was unable to provide officials at the RGD with the relevant information required for registration.

The baby was snatched from the Victoria Jubilee Hospital on January 8.

The 41-year-old mother told the Observer last month that approximately 5:00 am she was awakened after having a heavy flow of lochia.

By this time, she said the lights on the ward had been turned on while most of the exhausted moth-

ers slept. Not wanting to wake the mother who was immediately beside her, she said she trusted a woman clad in a denim skirt and a multi-coloured top who was standing and looking through the window and who offered to watch her baby while she went to the restroom. Whyte said she thought the woman was one of the mothers when she told her that she would have someone clean the area that was messed up.

“I left the soap and when mi come back [for it] I saw her standing up there, but me still nah look say something like that ago happen,” Whyte said then, adding that when she returned from her shower only the baby’s hat was left on the bed.

Hoping that the baby had been crying and that the nurse or a mother had taken him to try to comfort him, she said she started making checks, but the baby could not be found.

She said she alerted a nurse, who referred her to another nurse, after which the police were summoned.

Like Hutton, Whyte told the Observer Tuesday night that she thinks the child taken from the woman at the RGD is her second son.

“I am just keeping my fingers crossed. I really feel like it’s him.

I will sleep a little bit better tonight,” she said.

Government has since said it is not resigning until its efforts to overturn the no-confidence vote are adjudicated at the level of the Caribbean Court of Justice (CCJ).

It was only a few days ago that United Nations Resident Coordinator Mikiko Tanaka also urged Government to respect the Constitution of Guyana. Guyana’s PSC had also previously called for GECOM to open up about its readiness for elections.

As uncertainty continues to swirl over when elections will actually be held, the PSC in a strongly worded statement on Monday said it was growing increasingly concerned over the Government’s insistence on business as usual while it appeals the no-confidence cases it lost.

According to the PSC, these statements being made by the Government and its representatives are a matter of concern since the High Court has already refused Government’s request for a stay of judgment.

“The statement issued by the Government’s Department of Public Information clearly and, it appears, with deliberate intent, flies in the face of the decision of the Chief Justice. The ‘status quo’, meaning that nothing has changed, simply does not remain and the business of Government does not continue ‘as usual’. There have since been similar misleading statements made by senior

members of the governing party, which add to the Commission’s concern,” the PSC stated.

“We must underline the fact that when the Attorney General sought a conservatory order from the Chief Justice to preserve the ‘status quo ante’, his application was rejected … Clearly, therefore, in the view of the Commission, her ruling remains in place unless successfully appealed in a superior court. The Commission, as a consequence, expects the President and his Government to respect and honour the decision of the Chief Justice.”

In this vein, the PSC made it clear that Government must ensure elections are held no later than March 21, 2019 as required by Article 106 (7) of the Constitution of Guyana. It also reminded that the Chief Justice in her decision upheld Article 106 (6) and (7) of the Constitution, which state that the Government, while remaining in office with the President in place, does so without a functioning Cabinet.

“The Private Sector Commission speaks not only for the business community with hundreds of billions invested in the development of our economy and the employment of some 60 per cent of our workforce. In this case, we believe that we speak for the majority of the nation when we express our concern over public statements which deny the express ruling of the Chief Justice, statements which could lead our country into a situation of grave instability and an illegal government resulting,” the PSC said.

threw its support behind both the EU and the UN for throwing their weight behind calls for the Constitution of Guyana to be respected, the rule of law upheld and for free and fair elections.

Government fell to the no-confidence vote on December 21 last year. Article 106 (6) of the Constitution of Guyana states: “The Cabinet including the President shall resign if the Government is defeated by the vote of a majority of all the elected members of the National Assembly on a vote of confidence.”

Meanwhile, 106 (7) goes on to state that, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than two-thirds of the votes of all the elected members of the National Assembly determine, and shall resign after the President takes the oath of office following the election.”

Both the National Assembly and the High Court have refused Government’s attempts and arguments to overturn the no-confidence vote. Despite this, however, President Granger is yet to indicate a date for elections. GECOM successfully ran the Local Government Elections (LGE) in November 2018, less than three months ago.

It is the President of Guyana, who has to give a date for elections and not GECOM as being touted.

ixty-nine-yearold Renwick Alexander called “Pompey” who was handed a 56-year prison sentence for unlawfully killing his friend, Carl Thomas in 2014 was on Tuesday given a 12-anda-half-year sentence after he entered a guilty plea. Thomas was knifed to death on November 3, 2010, in Georgetown and Alexander was sentenced by Justice Navindra Singh after the jury found the accused guilty of murder.

However, when his matter came up for a High Court retrial on Tuesday; he opted to forego those proceedings and pleaded guilty to the lesser count of manslaughter.

Justice Singh, who presided again, sentenced him to 12-and-a-half-years imprisonment, ordering the prison service to deduct the time Alexander

spent on remand.

by Nigel Hughes while the State’s case was presented by Attorney Teriq Mohammed. Hughes, in a plea of mitigation told the jury that his client is remorseful for his actions. Alexander looked to the daughter of the deceased and apologised while on the verge of tears.

Thomas, 55, of Lot 35 John Street, Lodge, succumbed while receiving treatment at the Georgetown Public Hospital Corporation (GPHC).

He was said to have sustained a single stab wound which punctured vital organs at the hand of Alexander. Alexander and the deceased reportedly grew up together and were said to be fighting over missing clothes on the day of the incident.

Senior cop accused of raping 13-yrold granted bail

rustrated parents, who are fearful for their children’s lives after several threats of shootings and bombings were made to schools which they attend, on Tuesday picketed the Public Security Ministry where they told reporters that they are offering a reward of G$1 million to anyone who has information that may lead to the arrest of the perpetrator/s.

This comes in light of the shooting of School of the Nations’ Director, Dr Brian O’Toole, who was shot at his home as he was returning from a dinner meeting.

This step to offer a reward was taken by the parents, as they said they believe the police and the Education Ministry are not doing enough to cushion the wounds of their children caused by these threats and to help with the investigative process.

One parent, Anna Lisa Fraser-Phang, who is also the President of the Parent Teachers Association (PTA) of School of the Nations complained that the “PTA has actually spoken to the Assistant Commissioner.

We’ve asked and pleaded with him to make a statement since Friday night and we were chastised (and) told that we had no right to tell them what to do while we were just suggesting what they need to do to appease not only the parents of the children of School of the Nations but to the general pub-

lic”.

According to her, to date no official from the Public Security Ministry or the Guyana Police Force has spoken officially to the parents.

No help In addition, the President of the PTA argued that the Education Ministry has been doing nothing to help the situation.

She said a meeting was scheduled with the parents who have children attending School of the Nations where they were merely told “they would do whatever they can”.

Fraser Phang told this newspaper, “When Monday rolled around, and we were expecting and told that we would have the Mobile (Unit) and counsellors available to our children at the School of the Nation, we have not seen any of them.”

The parent said she understands that the counselling service was extended to other schools, although that school needs it just as much as any other school.

“We were offered very little and given even less, we demand more of our authorities,” the parents cried.

It is because of their belief that little is being done by the police that they have decided to offer a reward of G$1 million for any information on the threats.

Jerry Gouveia, a concerned parent said, “At this point in time what we’re looking for is just to get something done to put us in a position where people un-

derstand that we are under threat and we are serious about doing something about it”.

Meanwhile, John Ramsingh, another parent explained that the situation is worrisome.

“We would just like the authorities to give us some answers to tell us, you know, it’s safe to send your children back to school because we have ‘A, B, C’ in custody (and) we have questioned ‘X, Y, Z’. We need to know something,” the concerned parent said.

The parents used the opportunity to appeal to other parents to pay heed to the affairs of their children’s lives.

“Feel free to check their phones and see what they’re up to.

Be aware of who their friends are and see what their friends are up to,” the PTA Head posited.

Persons who have any information on the threats can make contact with the police who will filter to the information to the parents to provide the reward.

Last Friday, Queens College and the Bishops’ High School were on lockdown after social media accounts created on Whatsapp, Facebook and Instagram, issued threats to students there.

These accounts are reportedly the same which issued threats at School of the Nations.

The situation is being taken very seriously by parents since the Director of School of the Nations was shot at his home amid these worrying threats.

They arrived in the south coast fishing village of Morne Diablo early on Thursday.

The Express has learnt that the families of the fishermen paid for their lives.

In exchange for the fishermen, the kidnappers got US $60,000, several boat engines, and gold.

Six fishermen had initially been abducted but one – Jerry O’Brian – returned to Trinidad within two days, after a US$30,000 ransom was paid.

The families of the other fishermen were given a last Friday deadline to pay the rest of the US$200,000.

The men who came home today are O’Brian’s brother, Jason O’Brian, 38, Jagdesh Jude Jaikaran, 16, Brandon Arjoon, 28, and Ricky Rambharose, 35.

The Trinidad and Tobago Police Service (TTPS) had communicated with Interpol seeking its intervention to bring the men home.

And last Friday, the Ministry of National Security revealed that the fishermen who were kidnapped for ransom last month were up a river in Venezuela when they were taken.

National Security Minister Stuart Young warned nationals of Trinidad and Tobago that they should be aware of the risks of leaving T&T’s territorial waters and venturing into the territorial waters of other countries where this country has no jurisdiction.

Former health minister roasts Govt over ‘dire situation’ at NA mortuary

n light of the announcement that the mortuary at the New Amsterdam Hospital has been closed indefinitely, former Health Minister, Dr Leslie Ramsammy said that the facility’s administration and the Health Ministry have an obligation to immediately outline a plan for the beginning of mortuary services at the Hospital as soon as possible.

Director of Regional Health Services, Jevaughn Stephen has said that the decision to close the mortuary was taken on January 23, 2018. According to Stephens, the Hospital’s administration had been experiencing issues with the mortuary during the latter part of 2018 owing to a fluctuation in the electricity supply provided by the Guyana Power and Light (GPL).

The Health Services Director added that other equipment at the Hospital was also being affected by the fluctuation in electricity.

However, Dr Ramsammy described the situation as “unfortunate”, since he believes that it was allowed to deteriorate to the extent that the mortuary service has to be discontinued. According to him, the Hospital and the Ministry are obligated to put in place contingency arrangements at their cost, arguing that the discontinuation of service ought not

to add any further burden and trauma on families.

“I am particularly peeved that such a dire situation has arisen with bodies that were in the mortuary significantly deteriorated and now no service and the Ministers of Health have not found it necessary to address the matter. It cannot be that they have no time,” he added.

The former Health Minister pointed out that both Ministers Volda Lawrence and Dr Karen Cummings have been out in full election campaign mode but have neglected serious issues in the sector.

He said, “As I have consistently bemoaned, these Ministers are missing in action (MIA). This matter and other matters, like the death of three children at the Georgetown Hospital, are matters that must be addressed by the Ministers. Their absence and invisibility in these matters represent an egregious dereliction of duty, misconduct in office, and political malfeasance.”

Political malfeasance

Dr Ramsammy says he also believes that the mortuary situation at the New Amsterdam Hospital is another example of the long list of wrongs resulting from lack of leadership by the Ministers and mismanagement.

“I do believe the mismanagement results largely from the political policy of sending home proven and skilful managers and replacing them with handpicked managers who are party activists,” he added.

The New Amsterdam Hospital mortuary, he stated, is the result of political malfeasance and is only one of the many serious consequences of the total mismanagement of the health sector. “Whether it is in Region Six or anywhere else in the country, people have lost confidence and hope that this Government can improve lives of ordinary citizens.

an investigation. It was reported that at least four bodies decomposed while being stored in the mortuary.

The upset relatives of the deceased have called on the Ministry to launch an immediate investigation. The bodies include that of Rabindranauth Ramnarace, 47, who passed away on December 31, 2018.

His brother, Seepaul Ramlochan said he was unsure of the cause of his brother’s death, since a post-mortem examination was eventually not done to the body’s state of decomposition while being stored at the hospital.

Residents of New Amsterdam and surrounding areas have also been calling on the Government to address the rapidly deteriorating conditions at the New Amsterdam Hospital.

A protest was prompted after an elderly patient died last week after she was reportedly given nine injections. Further, the residents are alleging that several critical pieces of equipment are out of order in addition to a shortage of basic medicines leaving them to come to the conclusion that the institution’s affairs were not being properly managed.

As a consequence, they have called for the Chief Executive Officer (CEO), Dr Samantha Kennedy’s immediate resignation.

Mother of 2 who killed abusive boyfriend granted early release

ection D, South Sophia, Greater Georgetown mother of two, Tramangra Williams, known as “Queenie” has been granted early release from prison following her 18-year prison sentence over the unlawful killing of her Bajan boyfriend over 10 years ago. She was sentenced in January 2014 by Justice Navindra Singh for her criminal actions but after consideration of her behaviour and circumstances surrounding the case, she was paroled and released several years ahead of schedule.

She had mounted a challenge in the Appeal Court which came up on Monday. Chancellor of the Judiciary (ag) Yonette CummingsEdwards and fellow Appellate Justices Rishi Persaud and Dawn Gregory were set to hear the case.

However, the unrepresented woman, in a soft tone, informed the senior judges of her desire to withdraw her appeal.

that such leave was granted which meant the appeal was discontinued. Appearing on behalf of the Director of Public Prosecutions (DPP) was State Counsel, Teshanna Lake.

On December 27, 2008, “Queenie” stabbed Tyrone McDonald Best of Barbados at South Sophia. He died on January 3, 2009, while receiving treatment at the Georgetown Public Hospital Corporation (GPHC).

It was previously reported that after considering the evidence during the High Court trial, a 12-member mixed jury found her not guilty of murder but guilty of the lesser count of manslaughter.

Justice Singh’s sentence was initially 30 years, but he had deducted 12 years for provocation and remorse shown as the offender had told the jury via an unsworn statement that she was sorry for what happened.

It was revealed during the trial that the Bajan accused his Guyanese partner of having an affair with her cousin’s father on the afternoon “Queenie” asked the older man for money and marijuana.

Her story was that while on the way to the home of her friend, he slapped her across the head and beat her across the body. After they got home, Tyrone had reportedly aimed one of his boots at her head, but she suddenly turned around with a knife and he supposedly charged into it and received injuries to his abdomen.

Jeffrey urges Govt to do more for Venezuelan migrants G

iven the recent influx of Venezuelans into Guyana, a recommendation is being made to have Government provide more human and financial support to these individuals.

Former Foreign Affairs Minister, Dr Henry Jeffrey believes that the situation regarding the migration of these foreign nationals could be better managed.

However, he said that a proper needs assessment should be carried out to determine the priority, so as to ensure that a proper response to the situation is implemented.

“From my understanding, they are setting up some sort of camps for these people. But from the little that I saw, they are asking for more resources.

And Central (Government) should provide human and financial (resources) . I don’t think there is an immediate need to move them out,” he added.

Dr Jeffrey was referring to Government’s move to build a humanitarian centre for these migrants in Region Two (PomeroonSupenaam).

However, the Regional Chairman of Region One (BarimaWaini), Bretnol Ashley said if a centre was built in his region, it would give both the Regional Democratic Council (RDC) and the Central Government a better opportunity to monitor what these persons were actually doing.

A recent statement from the Ministry of the Presidency (MoTP) has outlined that instead of donating directly to the migrants, all donations should be sent to the Civil Defence Commission (CDC). While Ashley does not have an issue with this, he said representation from the region was imperative, so that the needs of those migrants could be properly met.

The Chairman had also stressed the lack of resources, adding that shortages of drugs and other medical supplies continued to plague the region as a result of the large number of Venezuelans.

While security remains a major concern for residents in those regions, Dr Jeffrey believes that the joint forces should respond to those concerns and Government must play a larger role in ensuring that any illegal practice being perpetrated by the foreigners was halted.

likely to happen given the current circumstances in neighbouring Venezuela.

The Region One Chairman has already called on Government to heighten security patrols at the country’s borders since a number of threats were recently made.

He warned that the threats should be taken seriously by the country’s security forces, declaring that his RDC (was very concerned with these threats, expressing the view that he believes that the Venezuelans would act on those threats and as such, all stops should be pulled out to ensure that Guyana could effectively defend itself.

“Government and residents must recognise that because of Venezuela’s grave economic challenges, they are evidently desperate. We have heard that there is a plan to hijack the ferry and this resulted in the ferry having to be escorted into here a few weeks ago, because there were reports that the Sindicatos were planning an attack,” the Regional Chairman stressed.

He stressed that the number of migrants continues to increase while pointing out the need for a holistic response by the Government to alleviate a number of fears and concerns.

Government had stated last week that the number of documented Venezuelan migrants in Guyana stands at 3868. But Ashley thinks that the number is much higher, and is, therefore, calling for there to be a greater presence of immigration officials to improve documentation.

This newspaper was told that while there are small numbers in the highly populated villages within Region One, other locations have also seen a steady rise in the number of migrants.

Last year, statistics showed pockets of 40-100, with White Water having probably the largest number.

Skeete also lived 182 metres from the Namdars and claimed that days before the attack, the men bought “some weed” from him and smoked at a tree in his backyard when he supposedly heard them discussing their robbery plan. He had also detailed that on September 10, 2013, the night of the attack, he had heard the men brandishing weapons, having stated that Croft had a long gun while the other had smaller weapons.

Furthermore, Ali noted that among the plans the PPP has for the oil and gas sector, should it return to office, includes ensuring that the local content policy and legislations relating to the emerging sector cater for all Guyanese.

Guyana is now home to the world’s biggest new deep water oil discovery and with principle explorer, ExxonMobil, pushing for the development of the oil reserves;

production is scheduled to begin in early 2020.

In fact only in December, the US oil giant announced its 10th discovery, reinforcing the country’s potential to be able to produce more than 750,000 barrels of oil daily by 2025.

Since the discovery of first oil back in 2015, local stakeholders and stakeholder bodies have been calling for the necessary frameworks and infrastructure be put

in place for the emerging sector. This includes a Local Content Policy, which is a guide seeking to protect local companies from being bypassed for contracts and services with foreign companies and workers being favoured.

Back in November, Head of the Government’s Energy Department, Dr Mark Bynoe had assured that a second draft policy would be finalised before the end of 2018.

fter hours of deliberation, discussions at the Guyana Elections Commission (GECOM) over various timelines for holding constitutionally due General and Regional Elections reached a dead end, with complaints that suggestions for expediting preparations were ignored and side-lined.

People’s Progressive Party (PPP) Commissioner Robeson Benn on Tuesday slammed GECOM over the fact that instead of looking for ways to speed up electoral preparations taking into account the

three months constitutional stipulation, efforts continue to be made to delay the process.

“I have said previously that in my view, a sinister and callous plan is afoot to delay the holding of elections on the constitutional mandated date,” Benn said. “I have said both at the GECOM meetings and elsewhere that GECOM is complicit in not achieving these dates.

“For today’s (Tuesday) meeting, I expected that GECOM would have taken account of a presentation I made which indicated that training for which they had put 105

days (latest duration) could be achieved in 32 days at the most. They

have not taken account of the presentations in relation to that.”

According to Benn, his presentation had demonstrated the overlap in the types of training GECOM would have to do. He said that instead of the nine weekends being proposed by GECOM to do training, only three weekends were needed.

Pulling strings to stymie elections Benn reminded that GECOM has a constitutional mandate and that the collective and individual members of

the Commission could be held liable for their failure to hold elections in keeping with the Constitution. He went on to note that a Commission of Inquiry is needed to determine who is pulling strings to stymie the elections.

“I have said that I am really not prepared to go to any other discussion on any other option until we look at the first option, and that is to hold elections on March 19, 2019. When we examine that and thoroughly dispense with that, then we can look at the other op-

tions.

“This situation could not be arrived at because they did not present the information which they were told they ought to have considered and put in the work plan. I think we are in a sorry state.”

Benn also zeroed in on GECOM Chairman, retired Justice James Patterson, who he revealed has been refusing to brief them on a meeting that was held between representatives from the diplomatic community and the Chairman.

undreds of protesters braved the sun, scattered showers and Police barricades on Tuesday to protest against the Guyana Elections Commission (GECOM), demanding that the Commission hold elections within the constitutionally stipulated timeline.

Police had erected barricades stretching from Lamaha to Parade Streets and blocked off all the cross streets early Tuesday morning in anticipation of protest action. Protesters were not deterred, however, marching along High Street chanting for GECOM to respect the Constitution of Guyana.

Protesters were accompanied by People’s Progressive Party (PPP) General Secretary Bharrat Jagdeo and the Party’s presidential candidate along with sev-

eral high-ranking Party officials. In an interview with the media, Jagdeo outlined that the objectives of the protest were to demonstrate how serious the people are about constitutional compliance.

“I think the President, GECOM need to understand how seriously we take this matter. The legislature has spoken. The judiciary has spoken. The President, over the weekend, seems to believe that none of this matters. And so we have to show him that we are serious about having him respect our Constitution,” Jagdeo said.

“So today (Tuesday), you see a tiny expression of this and it will grow if the Government continues to violate the Constitution. I saw the (July) timeline that GECOM gave and that’s out of the question. I no-

ticed the type of activities they have there, that can be done simultaneously to hold elections within the constitutionally due period.”

Jagdeo also noted GECOM Chief Elections Officer (CEO) Keith Lowenfield acknowledging that the current voters’ list is valid until April 30, 2019 – a month after elections are supposed to be held.

“He must know. He’s worked with this list.

There have been no complaints about the list for Local Government Elections. So this claim that the list is suddenly flawed is a spurious claim,” Jagdeo said.

“We made it clear that house-to-house registration is out of the question.

He presented an option for house-to-house registration that will take us into February, March of next year. That is the

implication if we go to house-to-house registration.”

According to Lowenfield, he will defer to the Commission when it makes a decision. However, he too acknowledged that discussions on these timelines have hit a roadblock.

“The operations subcommittee met this morning and deliberated on the submissions made by the Secretariat relative to the many options that are available.

Unfortunately, that subcommittee was unable to arrive at any decision. The subcommittee will be meeting again at

some time.

“Ours is to stay at a particular state of readiness…the Commission shall be responsible for the conduct of elections and the conduct of registration. Each of those subsets requires an order from the Commission.

The order will be published and gazetted and then we proceed with operations at the Secretariat,” he added.

The parliamentary Opposition and other observers have accused Government of attempting to delay the holding of the constitutionally mandated elections following the passage of no-confidence motion of December 21, 2018.

was validated by last Thursday’s ruling by acting Chief Justice Roxane George, who declared that the motion was validly passed 33-32.

The complaint has been that GECOM was not forthcoming about its preparedness for the mandatory elections despite being mandated by the Constitution of Guyana to hold elections within three months of the passage of a no-confidence motion.

In fact, during a previous meeting with the Opposition and Government Chief Whips, the GECOM Chairman abruptly ended a meeting on the Commission’s preparedness after he was pressed for answers.

Revenue body to undergo more staff shake-ups

oming on the heels of multiple dismissals last month, it seems that the Guyana Revenue Authority (GRA) is likely to go through more staffing shakeups as the entity tries to enhance its efficiency.

This was revealed by Commissioner General of the GRA, Godfrey Statia, during a recent press conference. Statia attributed this to the need for revamping the authority’s organisational chart.

“During 2019, you’ll see some executive staff changes. The entire organisational chart would be revamped so that it would provide for more efficient operations. We would continue with the staff rotations and improvements.”

“For the first time in 18 years, we have been able to put into place a performance appraisal system, whereby employees will be appraised now and on their past performance… that should be completed in March and they will then be in a position to get their increments.”

Statia also spoke of a debunching system that would ensure a level playing field is created when it comes to remuneration for staff.

“We have gone through and done a debunching exercise, whereby staff who have been complaining for years that those who enter with them have been getting the same pay as those who have been here for five, six or 10 years. We’ve gone through that exercise and we’ve remedied that and that is from December 31, 2018.”

Statia also noted

that they will continue to provide training for staff. The Commissioner General explained that while a number of Bachelor and Masters’ Degree holding persons are hired by the GRA, there still needs to be specialised tax training provided.

Shake-ups

It was only last month that reports emerged of nearly a dozen customs officers being given their marching orders over alleged corruption. According to reports in sections of the media, investigations were being conducted since last year into these officers.

It is understood that investigators had found instances of collusion, including the sidestepping of protocol when it comes to clearing goods.

Nor is it the first time reports of a shake-up at the entity emerged.

Last year, there was a reshuffling of several senior personnel in GRA… a reshuffling that touched some major departments including Customs, Excise and Trade operations, General Services and the Integrated Regional Tax Office.

It is understood that for last year, GRA collected almost G$199 billion in revenues as compared to the G$171 billion that the Authority garnered in 2017. At his press conference, Statia had also revealed that the Authority only projected to collect G$181 million for 2018.

Internal revenue is understood to account for G$88 million, while Customs and Trade administration raked in G$23 million. GRA also continued on page 24

Man fatally stabbed by nephew during argument over stolen phone Dead: Olrick Da Costa

A

26-year-old man was taken into custody in the wee hours of Sunday after he allegedly stabbed his uncle to death during an argument over a stolen mobile phone.

Olrick Da Costa, 39, of Lot 11 Public Road Somerset, Essequibo Coast, was stabbed once to the abdomen by the suspect.

Based on information received, the now dead man and his nephew were engaged in a heated argument at about 1:30h over a stolen mobile phone. During the argument, the now dead man reportedly took out a knife and hit the suspect to the face.

In retaliation, the young man collected a knife and dealt one blow to the Da Costa’s lower abdomen.

After realising that he was stabbed, he ran to the public road seeking assistance but collapsed. He was picked up and rushed to the Oscar Joseph District Hospital in Charity where he was pronounced dead on arrival.

The accused was arrested and taken to seek medical attention. The police have since recovered the murder weapon as they continue their investigations. The suspect remains in custody and is expected to be charged later in the week.

n light of the ruling of Justice Roxane George on the no-confidence resolution in favour of the Opposition, Minister of State Joseph Harmon continues to execute the Government’s business as normal.

In Saturday’s Official Gazette, dated February 2, 2019, under Government Notices, the Minister of State’s signature was affixed to Cabinet’s approval for the Board of Directors of several State bodies; some of which have life until the end of 2019 while others were extended into 2020.

that the Party is likely to address the measures implemented by Cabinet after December 21, 2018 to see if those actions are illegal. However, in the document reviewed by Guyana Times International, Minister Harmon’s cemented approval of Cabinet’s previous considerations for Board members on January 23, 2019 which would be some 33 days after the No-confidence Motion was passed. It was also one week before the acting Chief Justice handed down her determination in the no-confidence matter.

These potentially contentious State Boards that Government sought to give official approval in late January included the 15-member National Standards Council (January 1,

the Competition and Consumer Affairs Commission (CACC) (February 1 2019 to January 31, 2019) – both headed by attorney Ronald Burch-Smith.

Additionally, following submission by Finance Minister Winston Jordan, Cabinet considered Board members for the country’s lead financial institution, the Bank of Guyana, approving Governor Gobind Ganga as Chairman and Leslie Glenn as Deputy Chairman.

It is not clear if all or any of the appointments will stand if court action against Cabinet’s post-December 21, 2018 decisions is favourable.

“There is no Cabinet in force in Guyana currently and that is very important…if they are il-

legal, those are issues we will have to take into account and address,” Nandlall vehemently expressed last week when he stated that Cabinet has already been “resigned”.

It was after Justice George declared that the 33-32 majority meant the motion was carried, that she observed that the President and the Ministers cannot remain in Government after three months which expires in March. This, she said, is in keeping with Articles 106 (6) and 106 (7). Article 106 (6) of the Constitution states: “The Cabinet including the President shall resign if the Government is defeated by the vote of a majority of all the elected members of the National Assembly on a vote of confidence.”

Meanwhile, 106 (7) goes on to state that, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than twothirds of the votes of all the elected members of the National Assembly determine, and shall resign after the President takes the oath of office following the election.”

What this says is that Government will remain in office until the next President in sworn in but not the Cabinet which advises the President.

The Judge also held that the resignation of Cabinet does not result in the dissolution of Parliament as this is within the President’s remit to do so and call elections. It was further observed that resignation of the Cabinet does not result in the dissolution of Government as Cabinet is a subset of Government.

n the presence of about a 1000 supporters of the A Partnership for National Unity (APNU) at Vreeden-Hoop, West Coast Demerara, on Sunday, President David Granger reiterated that he will not resign and that the Government will remain in office as the no-confidence resolution is being appealed.

In fact, he told the gathering that his Government will exhaust all avenues and aspects of the law, while adding that there is no ‘caretaker government’. Granger said he will remain President until the next President is sworn in, as he grinned “I don’t know how they gon wuk that one out”.

In addition, the President noted that Parliament has not been dissolved and that the National Assembly will continue to do the work it is was duly elected to carry out.

This comes on the heels of the ruling by acting Chief Justice Roxane George who stated that the December 31, 2018 No-confidence Motion was validly passed in the National Assembly and Government has to resign in keeping with constitutional provisions of Article 106 and 106 (7) respectively.

She was at the time addressing the other case filed on behalf of the Government by Attorney General Basil Williams that sought to put a hold on the enforcement of the motion since he was contending whether the said motion was indeed carried by a majority of all elected members and whether or not the 33 to 32 breakdown means it was validly passed.

According to the acting Chief Justice, the Speaker, Dr Barton Scotland found that motion was carried by majority of 33-32. She noted that the validity of motion was not doubted when it was carried on December 21.

Moreover, she noted that when concerns were raised subsequently after and advanced before Speaker Scotland, he stood by the carried motion and digressed to the court for interpretation.

The CJ, however, outlined that the

President and the Ministers cannot remain in Government beyond three months in accordance with Articles 106 (6) and 106 (7) respectively.

Article 106 (6) states that “The Cabinet including the President shall resign if the Government is defeated by the vote of a majority of all the elected members of the National Assembly on a vote of confidence.”

Meanwhile, 106 (7) goes on to state that, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly agrees by not less than two thirds of all members.

However, Opposition Leader Bharrat Jagdeo welcomed the ruling by acting Chief Justice Roxane George saying this now paves the way for the Guyana Elections Commission (GECOM) to start preparation for the hosting of General and Regional Elections – constitutionally due in March.

According to the Opposition Leader, now that the Chief Justice has upheld the validity of the no-confidence resolution, and refuses to a stay the judgement as well as to refuse to issue a conservatory order for the Government to remain in office upon request of the Attorney General, focus must be placed on the elections body. “… the timeline remains valid and the clock keeps ticking… So now we need to turn our attention to GECOM and force GECOM to act in accordance with the Constitution. And so in the next couple of days, even if it means legal action to force GECOM to start the preparations for elections,” he stated.

According to Article 106 (7) of the Constitution, Government should call elections within three months of the passage of a no-confidence motion.

This means elections are to be held

by March 19 and insisted that the Elections Commission can be ready for polls within the next 50 days or so.

Deported mom blasts Jamaican Gov’t (Jamaica Gleaner)

ifty-five-year-old Pam (last name withheld), the lone female among 29 deported migrants who were processed at Harman Barracks after being sent from the United Kingdom on a charter flight to Kingston yesterday, has castigated the Jamaican Government for failing to protect the rights of emigrants.

“The Jamaican authorities don’t really care about us when we are in another country like Britain. They don’t fight for our rights. They feel once we are tagged as criminals, rightfully so in some cases, we must be treated like dogs. We are human beings and Jamaican first,” she said.

Speaking to The Gleaner after walking through the gates to embrace a long-time family friend, who waited more than four hours to see her, she said that having lived in England for 25 years, and being a single mother of five grown children, she had to resort to doing whatever she could to care for her family.

“Even if you committed a minor crime, and you’ve been there like the whole of your adult life, they show you no mercy.

You are just taken away like a piece of meat, and our Government here sides with them. Was there a payment for us, or what?” asked Pam. She said that the murder of one of her sons placed her on the British Home Office radar and that attempts at becoming regularised were turned down.

“I left my kids and

grandkids at home. They just came in and took me out the house with the kids there looking on. They are left traumatised because of this madness. I don’t know what will come of them now,” she said.

Pam, who declined to disclose the offence for which she was prosecuted, explained that she was taken to a de-

tention centre at 1 a.m. on Wednesday at a remote location before being transferred to a hangar where they boarded a plane for Jamaica.

“My application to stay has not been touched. I was refused, but it is still in the Home Office. I really don’t know how the children will manage there without me,” she lamented.

The Titan Airways charter flight with the 29 confirmed “serious foreign criminals” on board touched down at Norman Manley International Airport in Kingston, after which they were taken under police guard to the processing centre at Harman Barracks.

The criminal convictions of those deported include:

• 4 convicted of a sex offence, including rape • 6 convicted of violent crime, including grievous bodily harm • 1 convicted of murder • 1 convicted of attempted murder.

• 14 convicted of drug offences, including supplying Class A drugs.

• 1 convicted of robbery • 3 convicted of firearm and weapons offences • 1 convicted of dangerous driving None of the 29 was from the Windrush Generation, those Caribbean nationals who emigrated to the UK from the 1940s to 1970s.

Seven, including a Birmingham father of five, gained a last-minute reprieve, according to British news agencies.

Oswald Dawkins, president of the National Organisation of Deported Migrants, said that his organisation continues to offer support.

“We offer those who have nowhere to go a little stipend when we can, and, of course, a place to put their heads. But it’s a very tough thing coming here without family support,” Dawkins said.

n a public notice issued on Saturday, February 2, 2019, the Office of the Integrity Commission published the names of 66 persons who are required by law to declare their assets but failed to submit their declarations. Among the names of the identified defaulters whom the Integrity Commission publicly called out were 20 of Guyana’s diplomats. The published names were in accordance with Section 19 of the Integrity Commission Act, the Integrity Commission and the deadline was listed as January 25, 2019.

The diplomats included Guyana’s Ambassador to Brazil, George Talbot, Ambassador to Belgium, David Hales; Ambassador to Cuba, Halim Majeed; Ambassador to Kuwait, Dr Shamir Ally; Ambassador to Suriname, Keith George; Ambassador/

The Commission has the mandate to improve public confidence in the integrity of persons in public office by ensuring that they submit their declarations in compliance with the Integrity Commission Act. The Commission is responsible for the accountability of persons holding public office but prior to February 2018, the Body had been reportedly functioning with skeletal staff after the resignation of the Commission’s Chairman, Bishop Randolph George in 2006. Its current Commissioners are Chairman Kumar Doraisami, Rabindranauth Persaud, Rosemary Benjamin-Nobel and Thandi McAllister.

Berbice farmer stabbed to GTUC urges Govt, Opposition to ensure death during home invasion C calm, stability

he Guyana Trades Union Congress Union (GTUC) is calling on Government and the Opposition to ensure that the matter regarding the no-confidence ruling and the deadline for elections is addressed soon and treated as a matter of urgency, while maintaining calm and stability.

The GTUC has recommended that both parties return to the table to work out their differences and modalities. “The GTUC holds both sides equally responsible to get this right and not seek to benefit from what might be perceived as dilatory or aggressive tactics,” it said on Sunday in a missive.

The trade union body has also called on society not to examine the Constitution in isolation but to be guided by the acting Chief Justice Roxane George’s ruling which should be upheld.

“This issue is not about the President or Leader of the Opposition. It is not about the respective political party’s interests. It is about we the people, the working-class people, who deserve justice in every aspect of Guyana’s governance, for this in effect impacts on our collective wellbeing and our way forward as a united and productive nation,” a statement from the Union added.

In addition, the GTUC has called on the international community, business, peo-

ple, civil society and all others interested in Guyana’s well-being and the application of justice to respect the ruling that not only upheld Article 106(6) but in equal measure upheld 106(7).

“Individually and collectively we cannot afford to let Guyana down at this crucial juncture. In the midst of uncertainty navigating this period and the acting CJ’s ruling, society will continue to rely heavily on the media, the fourth estate, to play a pivotal role in averting undue tension by bringing credible understanding that would aid the ensuring of calm, stability and appropriate behaviours.”

While acknowledging that the no-confidence case was the first of its kind for Guyana, the GTUC noted that the determination is not guided by any local precedence, clear guidelines and law as to how the nation proceeds, and as acting CJ in her ruling stated, “functions.”

Constitutional duties

“It is that ‘how’ which we must as a nation determine that is important to our stability.

The Guyana Constitution places the President and Leader of the Opposition as part of the Executive (Title 5). Irrespective of the circumstance at this time, the holders of these offices will have to discharge their constitutional duties and seek to engage each other on issues perti-

nent to our national character and well-being,” the GTUC added.

Further, the GTUC said it has taken note of the Opposition which said it would protest the Guyana Elections Commission (GECOM) and the Government if elections are not held within three months.

While the GTUC said it respects the constitutional right to protest, at the same time, it wants the Opposition and Government to carry out its duties and responsibilities to ensure that they proceed through this period in constructive not destructive manner.

“Both sides must continue talking and working together because governance has not stopped. Either, in the interest of the people whom they serve, can initiate engagement to proceed in putting in place relevant guidelines, legislation or written convention that will establish parameters to deal with Article 106 (6) to expressly give meaning to the “functions of office” stated in the ruling of acting CJ,” it also added.

The acting CJ ruled on Thursday that the No-confidence Motion was validly passed 33-32 in the National Assembly and the Cabinet has to resign in keeping with constitutional provisions of Article 106 and 106 (7) respectively.

Consequent to the declaration that the 33-majority meant that the motion was carried, CJ George observed that the President and the Ministers cannot therefore remain in Government in accordance with Articles 106 (6) and 106 (7) after three months.

Meanwhile, the Government in a statement on Thursday evening said it notes and respects the rulings. “The ruling is not in favour of the Government’s position with regard to the vote on December 21, 2018; however, due process continues and the Government will file an appeal in the Court of Appeal. The Government continues to believe that the full adjudication of this issue is in the national interest,” the statement said.

Police were called and upon arrival found that the suspect removed vegetables from a freezer that was outside and placed the items along with some biscuits just outside the back door.

However, after the stabbing suspect escaped, leaving his loot as well as the murder weapon at the scene, the Police recovered a bloodied knife in the kitchen, a cutlass in the yard and a piece of clothing.

There were footprints leading from the house to the back fence of the yard.

Police are on the hunt for the suspect. The couple had been married for 37-years and has two children.

One outstanding matter is Guyana Stores Limited (GSL), which lost its court case against GRA concerning outstanding Corporation Tax payments totalling over G$3 billion. The matter arose in 2012 when GSL refused to pay the money after a notice of demand was sent to the company.

The GSL had moved to the local courts, but

both the High Court and the Court of Appeal had ruled against them, and ordered that it pay the G$3,807,346,397 in Corporation Taxes.

The GSL then moved to the Caribbean Court of Justice (CCJ).

However, the CCJ ruled that the two per cent Corporation Tax was not a forced loan, but the tax was constitutional. The CCJ stated that the Income Tax Act provides a specialised procedure for challenging assessments, and the GSL should have used that proce-

dure.

The CCJ had also held that the two per cent minimum Corporation Tax was not a loan, because the State does not repay the taxpayer, nor does the taxpayer have any right to repayment or redemption, which were crucial elements of any loan.

However, Statia revealed at his press conference that the company has in fact paid up a large portion of the money and that the two sides are presently negotiating how the remainder will be paid.

2 feared drowned after 1 'jumped' to save the other

wo friends are feared dead after one of them went to save the other who had fallen into the Essequibo River in the vicinity of Hogg Island on Tuesday last.

The two missing men have been identified as 50-year-old Ravie Chutie of Hogg Island and 56-year-old Ozard Russell of Aliki Essquibo River.

Based on reports received, the two men, along with Janet Robinson, the reputed wife of Chutie were travelling along the Essequibo River in a wooden boat powered by a 15-Horse Power Engine when they came into contact with the rough waters.

This however, caused Chutie to lose balance and fell overboard and in a bid to save his friend’s life, Russel went after him but none of them resurfaced.

The boat reportedly drifted to the Hogg Island Foreshore where Robinson alerted persons.

Without hesitation, a group of men went in search of the two men but came up empty handed. The police were contacted and based on reports received, the woman claimed that the two men were intoxicated since they drank a bottle of alcohol before they departed the Hubu Koker.

A search is on to recover the bodies of the men.

Ogle/Great Diamond road link draft for release - road link will have four access points – MoPI T

he draft designs, for the East Bank to East Coast road link network, will be acquired by the Ministry of Public Infrastructure and released before the end of February. This is according to the Technical Services Manager within the ministry, Nigel Erskine.

According to DPI, Erskine explained what can be expected after the draft design of the project is presented.

“Coming out of the feasibility study, the consultant has proposed that the main alignment will be four lanes from Diamond to Ogle and we will have four connectors that would connect the East Bank Demerara road to the new alignment. So, we will have a connection at Great Diamond, we will have a connection at Mocha, at Eccles, Haags-Bosch and one at Aubrey Barker,” Erskine said.

He added that acquisition of the designs would accelerate the bidding process which will result in works commencing in the early part of the third quarter of 2019.

the project was conceptualised to alleviate traffic congestion on the East Coast and East Bank of Demerara. Also, it will serve as an alternative bypass from Georgetown for persons traversing between these two areas.

In 2016, the government signed off on an G$11Billion loan (US$50M) from the ExportImport (EXIM) Bank of India for the construction of a 20km bypass road from Ogle on the East Coast of Demerara to Great Diamond on the East Bank Demerara.

The Chinese New Year, as the most important traditional festival in China, is part and parcel of the Chinese culture. Today, the Chinese New Year is celebrated by more and more people around the world, turning into a global event.

The year 2018 marked the 40th anniversary of China’s reform and opening up. China has been impressing the world with remarkable achievements which have brought tremendous benefits to its people, as well as contributed to the sustainable development of the world economy.

The year of 2018 witnessed the continuous development of China-Guyana friendly cooperative relations with frequent high-level visits. It has also been a productive year for the cooperation in economy, trade, health and

The ‘Year of the Pig’, which commences on February 5, 2019, would be celebrated not only by the People’s Republic of China, but also millions of Chinese descendants residing in all parts of the world, including Guyana.

The first set of Chinese arrived in Guyana 166 years ago as indentured labourers, and since then, people of Chinese origin have made indelible contributions to this ‘Land of Many Waters’. This includes the late President of Guyana, Arthur Chung.

Over the years, Guyana and China have been able to continuously strengthen bilateral ties that were established within just two years of Guyana gaining its Republican Status.

As a matter of fact, Guyana was the first English speaking country in the Caribbean to establish diplo-

matic relations with China.

These ties have seen both countries benefiting from a number of cooperation agreements in all areas including infrastructure, health, energy, education and technology, etc.

With China’s economic performance being a source of inspiration to many countries, Guyana also continues to benefit from deepening relations in this regard.

Even further, the two countries also enjoy a very fruitful partnership in the area of culture. With the beauty and vibrancy of the Chinese culture being part of the Guyanese identity, there was always the call for Chinese descendants to embrace their heritage and keep the splendour of it, alive.

Today is no different, and we encourage all Guyanese to participate in the festivities and observe the traditions of entering a New Year, with fresh perspectives and renewed hope.

hatever doubts your Eyewitness expressed about the PNC-led coalition Government’s intentions after the Chief Justice’s rulings on their challenges to the NCM – that President and Cabinet should’ve resigned immediately after Dec 21 – were swept away by PNC party leader Granger’s inelegant but emphatic announcement, “I ain’t goin’ no way!” Granger was in full campaign mode in front of a large throng of green-clad party faithful at the opening of a “Reg 3 Congress Place” and spoke in the vernacular to energise his bussed-in supporters.

He announced he was taking his delaying tactics all the way to the CCJ. Now that’s his right – everyone’s entitled to his day in court and all that – save when the case is an “abuse of process”, as this clearly is. But Guyana isn’t an island – figuratively and literally – and in behaving in such a cold, callous and opportunistic fashion, Granger’s burning up a lot of our hard-earned international social capital.

The UN Resident Representative, for instance, spoke directly to Granger when she announced: “The delivery of the decisions by the Chief Justice demonstrates the independence and integrity of the Judiciary in protecting the Constitution and upholding the rule of law. The Honourable Speaker’s earlier validation of the process of the controversial voting at the National Assembly was testimony of the integrity of the legislative arm of the State.

“It is hoped that the third arm of the State, the Executive, will demonstrate its integrity and respect for Guyana’s Constitution and the Judiciary that constitute the foundation for the rule of law.” But it’s clear Granger and his team have no regard for our Constitution and the Judiciary. Didn’t he already refer to a judgement of the Chief Justice as her “perception” and that he’s also entitled to his?? More than any other outburst, this illustrates his contempt for that co-equal branch of government.

But just as insidiously, Granger and company are undermining in our people, the very basis of democratic legitimacy in parliamentary governance – the principle of majority rule. He’s never questioned his winning Reg 8 by a SINGLE vote – 1837 to 1836 of the PPP’s. With that single vote, his coalition was awarded the SINGLE seat over the PPP – 33-32 – that made him President and in control of the Government.

Yet now that he was voted out on a no-confidence motion sanctioned by the Constitution, he ridicules the MP voting his conscience and his government falling by one vote: “There’s got to be something undemocratic about that; there got to be something cruel and callous about that… Yuh just jook, stab yuh in de back!”

What’s “undemocratic” about a procedure where his Chief Whip taunted: “Bring it on!!”?? …his AFC pal??

Your Eyewitness had broached the touchy subject of “every man for himself; and the Devil take the hindmost” attitude that enveloped the AFC after its “dead meat” status was confirmed following the LGE. This behaviour is also induced in rats in sinking ships!!

The phenomenon’s most starkly illustrated with the intra-AFC manoeuvrings to snag the PM slot in the upcoming elections.

Now, we’ve got to remind ourselves that this “PM position” has been transformed – after 2015 – into one where the incumbent – at this point Moses Nagamootoo – is always poised to be overlooked!!

Even though he’d earlier demurred from running again, Nagamootoo now coyly allows that he wouldn’t “mind it”. Interestingly, he’s now backed by AFC Leader Raphael Trotman – who’d pipped him for the Speakership back in 2011 – which alone should’ve made him question his decision.

But now, his rescuer from political oblivion – after he was cast out from the PPP – Ramjattan, has now said HE’S willing to be PM candidate!!

So, will Nagamootoo “do the right thing” and move aside?? Yeah, right!! …Guyanese in the eye Do GECOM Chair James Patterson and his CEO Lowenfield believe they have any shred of credibility left – with even PNC supporters – after deliberately dragging their feet on preparing for elections on March 19?

t does not matter which part of the world a Guyanese is, from the moment they find out that a fellow Guyanese is going to visit their area, their first request is “bring a fry rice fuh me nah”.

Without even thinking twice, one knows exactly what type of fried rice they are craving, since it is something distinctly associated with us Guyanese.

Nowhere in the world, not even in China, can you find the perfect chicken fried rice as you would in Guyana. It is something we are eternally grateful for - something we get to call our own.

When the Chinese arrived here in then British Guiana on

January 12, 1853 on board the “Glentanner”, they brought with them, like those before them, their culture and cuisine signalling the extension of Guyana as a diverse nation with a melting pot of different cultures. They brought their unique customs and food, but had to adapt to the harsh realities of then British Guiana.

The late Anthony Bourdain once said: “Food is everything we are. It’s an extension of nationalist feeling, ethnic feeling, your personal history, your province, your region, your tribe, your grandma.

It’s inseparable from those from the get-go,” and that is something that is very applicable

in Guyanese society and particularly with the Chinese culinary influence.

It does not matter where you are in Guyana, one thing

is certain: most of us Guyanese crave a chicken fried rice from our favourite Chinese restaurant. It is one of the most requested items from Guyana by Guyanese living overseas. A friend who works at the Cheddi Jagan International Airport once told me that on an average day they would see over one hundred parcels of Chinese fried rice frozen, wrapped in various types of packaging, stuffed away in suitcases with destinations all across the world.

But what is it that makes the Guyanese Chinese fried rice different from the rest of the world’s? Is it the

fresh ingredients or is it just the way it is prepared? We will never know. I have had the opportunity to have Chinese food from several places within the Caribbean region and it is true that none tasted like the one I get from Bright Star Restaurant at Vreed-en-Hoop on the West Coast of Demerara.

Over the years, the influence of Chinese cuisine continues to bridge the cultural divide in society between the Chinese and other ethnic groups. The way our Chinese prepare their fried rice is a secret one would never know and while many have come close to figuring out

always excited to walk into the restaurant and watch in amazement as they prepare my order. From the time they splash the wok with water to clean it, followed by the oil and veggies, I am intrigued. It always baffles me, since I am not sure whether they steam the rice before they fry it with the veggies, but that is a secret I and most Guyanese as a matter of fact would never know. But my bet is, it is steamed.

Chinese fried rice is a part of our Guyanese culture. It is part of our diverse identity as a people. So grab a ‘cokes’ and some fried rice and have a hearty meal.

Jamaica Opposition MP was stabbed 20 times (Jamaica Gleaner)

enior detectives probing the killing of two-term member of parliament (MP) for Eastern Portland, Dr Lynvale Bloomfield, are reportedly following strong leads.

A bloodied black vest was recovered along a pathway about 200 metres from the MP’s home, where his body was discovered on Saturday, was sent to the forensic lab for testing.

Additionally, investigators are trying to locate Bloomfield’s main cell phone, which has also been reported missing.

Another phone belonging to the MP was recovered at the house, along with items of jewellery.

The Major Investigation Division (MID), which is conducting a top-level probe into the murder, is tightlipped about the investigation so far.

A 17-year-old sec­ ondary school stu­ dent who is on sus­ pen­ sion has been gunned down by an un­ known gun­ man. De Shawn Hit­ lal, a Form 4 stu­dent of San­ gre Grande Sec­ ondary School was killed while lim­ ing with friends at North East­ern Set­tle­ ment, Ojoe Road, San­ gre Grande, on Sat­ur­day night.

He was shot mul­ ti­ ple times about his body and died while un­der­go­ ing emer­gency surgery at the San­gre Grande Hos­ pi­tal.

Po­lice re­port­ed that around 7:45 pm Hit­ lal was sit­ting with friends at the side of the road at the cor­ner of Ja­cob and Road 6 in North East­ern Set­tle­ment when a white Hilux pulled up in front of them. A man alight­ ed from the back seat of the ve­hi­cle and went straight to Hit­lal and be­ gan shoot­ ing him about his body. His friends scam­pered in­to the near­ by bush­es and hid un­til the fir­ing stop and the ve­hi­cle drove off.

When T&T Guardian vis­it­ed Hit­lal’s grand­ par­ ents at their home, they were in shock.

The grand­par­ents asked that their names be with­held and no pho­ tos tak­ en of them. “We are all de­vot­ed Mus­lims and as such avoid hav­ ing pic­tures tak­en,” they said.

The grand­fa­ther told Guardian Me­ dia that around 11:30 am on Sat­ ur­ day he was look­ ing at the test match be­ tween West In­ dies and Eng­ land on his tele­ vi­ sion set when Hit­lal told him he was step­ ping turn out and would re­ short­ly. Hit­lal nev­er re­ turned and around 8 pm, his grand­fa­ther was in­ formed that he was dead.

“I re­mained in shock and was on­ly con­vinced when a rel­ a­ tive came and told me,” his grand­ fa­ther said.

“He was a good boy, al­ways re­spect­ful and obe­di­ent. As young men they can­not re­main bored all the times…he had every­thing he want­ ed and on­ly this week he asked for a tele­vi­sion in his room.”

er said he lived with her since he was small. His par­ents are sep­a­rat­ed.

His moth­er lives at Mal­ abar and fa­ther at Arou­ ca.

She said he was sus­ pend­ed from school along with oth­er stu­dents, but did not dis­close for what.

She said Fri­ day he told her he was not go­ ing back to school and went to get reg­ is­ tered for the MIC pro­gramme.

“He re­ turned home and we spoke, he told me he prefers to learn a trade,” she said.

Hit­lal’s grand­moth­er said she al­ways en­gaged in con­ver­sa­tions with him and ad­vised him to be nice and kind to peo­ ple.

“De Shawn al­ ways make me smile when he feels I am sad. I will miss my son. I am shocked and still re­main in shock at the killing of my grand­ son.”

Hit­lal’s grand­par­ents are call­ing for jus­tice. lal’s body will be Hit­ tak­en to the Foren­sic Sci­ ence Cen­ tre, St James, to­day.

his year, China and Guyana are celebrating 47 years of diplomatic relations – a milestone in bilateral relations between the two countries.

Guyana was the first English-speaking country in the Caribbean to establish diplomatic ties with China in 1972, resulting in the establishment of an embassy in the capital Beijing.

China is the second largest trading partner of Latin America and the Caribbean, which is also a major destination for outbound Chinese investment, second only to Asia. Total China-Latin America trade increased from US$17 billion in

China’s diplomatic overtures in Latin America underpin China’s economic activities and help it to institutionalise its engagement in the region and garner support in international fora. Some analysts argue that China’s activities in the region reflect a global strategy to reduce US dominance, although they do not aim to challenge the United States directly or militarily.

China’s diplomatic efforts include being an observer at the Organisation of American States, a member of the Inter-

While enjoying deep diplomatic relations, China and Guyana hold similar views and have consistently echoed and supported each other’s positions, be they on key international issues such as UN reform, climate change, sustainable development, regional integration and cooperation between China and the Caribbean. Over the years, the strong, comprehensive programme of bilateral cooperation has resulted in Guyana

benefiting from the services of Chinese medical doctors and technicians, the donation of equipment to the health sector, the educational work of the Confucius Institute, the support given to the Bertram Collins College of the Public Service, infrastructural support for the expansion and renovation of the Cheddi Jagan International Airport (CJIA), the widening of the East Coast Demerara Public Road, and the donation of vehicles and other equipment to the Guyana Police Force and the Guyana Defence Force.

Latin America is driving faster on the path toward deeper involvement in and with China’s Belt and Road Initiative (BRI), this time with the Caribbean on board.

The Silk Road Economic Belt and the 21st Century Maritime Silk Road were launched in 2013 with routes from China through Asia and linking to Europe and Africa. But Latin America soon indicated interest, as did several other regions.

Elderly man 1 dead after car slams into parked truck charged for raping differently abled child

A

61-year-old man was on Monday remanded to prison after he was charged for engaging in sexual activity with a differently abled child without her consent in January.

Octavius Williams stood before Magistrate Sherdel Isaacs-Marcus at the Georgetown Magistrates’ Courts on Monday.

The prosecution’s case stated that the man engaged in sexual activity with the 13-year-old girl on January 31, 2019, at the child’s East Ruimveldt, Georgetown residence. According to the prosecution’s case, the 61-year-old man was seen entering the child’s bedroom by a neighbour. After hearing a strange sound, the neighbour told the girl’s father, who upon entering the child’s bedroom, saw the elderly man pulling up his trousers.

As such, a report was made to the East Ruimveldt Police Station and the child was taken for a medical examination. Williams was subsequently charged.

The case will continue on February 6, 2019.

You will find groups of young men around eighteen to thirty years old hanging out in a semi-circle on one or both sides of the public road. It is customary for young men, and sometimes older men, to form groups on the parapets of the main pub-

man is dead while a woman was listed in a serious condition after the vehicle in which they were travelling collided with a parked truck along Princes Street, Werk-en-Rust, Georgetown in the wee hours of Monday morning.

Dead is 35-year-old Trevon Butters of Caneville, South Ruimveldt, Georgetown. The injured woman has been identified as 25-year-old Natasha Roberts of Wales, West Bank Demerara.

The gathering of these young men is more than just about hanging out, more than idle talk

and speculation. It is an opportunity for them to discuss what is not said in their homes, what has not been allowed in their schools, temples, churches. It is also an opportunity for them to unlearn what they have learned, to learn about what they were not allowed to learn such as sex, dirty jokes, foul language, and the challenges of a budding masculinity. The roadside hangout is a sanctuary, a rite of passage in the absence of formal private dwellings for unemployed, perverse, progressive, inexperienced young men. One white American visitor to the Corentyne described this daily gathering of young men as “conversational corners of village life.” He was apparently confused as to why so many young men would rather hang out on the side of the road than attend his evening pastoral preaching.

No one is entirely sure where this tradition of young men hanging out on the roadside mornings and evenings comes from since it is uncommon in urban Guyana and in other Caribbean islands. In these latter places, the gathering tends to oc-

As a result, the motorcar reportedly spun several times before it came to a screeching halt. Both Butters and Roberts sustained injuries as a result of the collision.

Roberts was reportedly flung out of the vehicle and was later picked up and rushed to the Georgetown Public Hospital where she remains a patient.

Butters, on the other hand, was pinned in his seat and had to be removed from the wreckage by members of the Guyana Fire Service. He was pronounced dead at the scene.

An eyewitness told Guyana Times International that Butters and Roberts were seen leaving a popular Hadfield Street, Georgetown bar in the wee hours of Monday. The woman claimed that as the vehicle pulled off, they heard screams followed by a loud sound.

The vehicle, she added slammed into the lorry and as it spun, Roberts was flung out and landed on the roadway. At the time, she was conscious and even attempted to stand up. Soon after, she recalled, the ambulance arrived at the scene. The injured woman was picked up, placed on a stretcher and put into the ambulance.

“As they were trying to put her properly in the ambulance, she fell off the stretcher and onto the floor…’, she stated.

However, by the time the medical team attended to Butters, he had already died.

“Half of his body was in the driver’s seat and the other half leaning over the front passenger’s seat…his chest and neck was pressed against the badly damaged vehicle,” the woman told this newspaper.

A relative of the dead man said that his mother was expected in Guyana on Tuesday and that he had a one-year-old daughter.

The police are continuing their investigations.

Guyana records another mining tragedy …54-yr-old miner dies after mining pit collapses in Upper Mazaruni

54-year-old miner died on Monday after the mining pit in which he was working collapsed and he was covered with mud.

Dead is Timothy Hunter of Jawalla Village, Upper Mazaruni River.

According to Police, the incident occurred at about 16:30h on Monday at a mining pit located at Ominaik Village, Upper Mazaruni River.

The initial investigation revealed that Hunter and several other miners were “jetting” inside the pit when a wall collapsed and covered him.

Reports are the other miners attempted to rescue him but by the time they dug through the slush, he was unresponsive.

The body is presently at the Imbaimadai Health Post awaiting post-mortem.

On December 27, 2018, 11-yearold Tairon Terryl De Souza of Big Creek, Port Kaituma, Region One (Barima-Waini), died at Big Creek during a mining pit accident.

In October 2018, Lennox Douglas, 33, of Canvas City, Wismar, Linden, met his demise when a portion of rocks from a mining pit reportedly fell onto his head.

He was, however, quickly picked up and rushed to the Issano Health Centre

CCJ upholds High Court ruling on fraudulent titles

T

he Caribbean Court of Justice (CCJ) on Wednesday upheld a High Court decision that two titles for land at Mahaicony, Region Five (MahaicaBerbice), were fraudulently obtained since another party was in possession of the property.

The appeal was by Chandra filed Ramotar Singh against Bhagwantlall Mossai and Alvin Alves in relation to land at Lot 14 Mortice, Mahaicony River.

According to Court documents, while

Mossai obtained a transport for the land. becoming After aware of this, Singh filed court proceedings in May 2003, against Mossai and Alves claiming (i) damages for fraud committed by Alves in the 1994 petition; (ii) damages for trespass committed by both Mossai and Alves; and (iii) an injunction preventing Mossai and Alves from entering or attempting to enter upon the land or selling, mortgaging or otherwise alienating the land. However, he did not seek a cancellation of the fraudulent

failed to file his application for leave to appeal within the time specified by Rule 10.3 of the CCJ (Appellate Jurisdiction) Rules, Singh applied for and obtained permission from the Court of Appeal to extend the time for making the application. Both leave to extend time and leave to appeal were granted by the Court of Appeal.

As such, the CCJ was asked to determine (a) whether Singh had standing to bring a claim for trespass and fraud; and (b) whether the trial judge

However, unknown to him, Alves and Mossai had conspired to defraud him of the property. As such, the Region’s appellate court ruled that the titles held by the two respondents should be cancelled.

It was noted that Alves is the grandson of the Abrams heirs, who sold the land to Singh back in 1989, but in 1994 he filed proceedings for prescriptive title in the land court by petition, fraudulently claiming that he was in actual possession of the land.

The land court, being unaware that Singh was the person in possession, granted Alves a declaration of title in 1997. Alves then sold the land to Mossai, through his brother Ramrattan, two years later.

Nevertheless, the trial judge, Justice James Bovell-Drakes, having found fraud on the part of Alves, Mossai and Ramrattan, went ahead and cancelled the fraudulent titles while granting an award for damages for trespass as well as the requested injunction. Mossai and Alves then appealed Justice Bovell-Drakes’ order setting aside the transport and the Court of Appeal, by a majority, declined to cancel the fraudulent titles, because, among other things, Singh had not asked for them to be cancelled in his claim and because the claim was out of time.

But Justice Yonette Cummings-Edwards, who was the acting Chief Justice at the time, disagreed with the majority.

Following that ruling, Singh then applied to the Appeal Court for leave to appeal the majority’s decision to the CCJ. However, having

erred when he set aside the fraudulent transports either, because (i) Singh failed to bring his claim within 12 months after he discovered the fraud as required by section 22(1) of the Deeds Registry Act or (ii) Singh failed to request specifically that the transports be set aside.

The CCJ, in its judgment, found that Singh had capacity to commence court proceedings for trespass and fraud, that he was not out of time for filing his 2003 action and finally, that Justice Bovell-Drakes was correct in cancelling the fraudulent titles.

But the regional appellate court also handed down an important point of procedural law, that is, that the Court of Appeal of Guyana had no power to extend the time for the filing of an application in that Court for permission to appeal to the CCJ.

Dead are Deon Sproston, called “Jersey Joe”, 36, of Lot 133 Mon Repos, East Coast Demerara (ECD), and a miner only known as “Shawn”. The incident occurred at about 20:00h on September 17.

Guyana Times International understands that the two men and other persons were working the walls of the pit with metal detectors searching for gold while it was raining heavily.

While working, a large portion of the pit wall suddenly broke off and fell on both men, burying them alive.

In January 2018, 23-year-old Handel Payne, also called “Daggie”, of Kaneville Housing Scheme, East Bank Demerara (EBD), died after the mining pit in which he was working at 35 Miles, Konawaruk Backdam collapsed.

In April 2018, a miner named Kevin Adams, 25, of Linden, Region Ten (Upper Demerara-Berbice) died at Chinese Creek Backdam, Mazaruni

River, after a pit caved in and buried him alive.

One month later, in May, Ken Ranny, 20, a resident of Kamarang, Upper Mazaruni River, died after he was covered by mud after the wall of a mining pit in which he was working collapsed at Pepper Camp Backdam, Upper Mazaruni River.

Again, one month later, in June, miner Elmo Adams died after he too was buried alive after the walls of a pit in which he was working caved in at Imbaimadai, Upper Mazaruni.

Back in 2015, ten persons died in a mining pit in the Konawaruk area after it collapsed. The incident saw 17 miners being buried under a pile of dirt and rubble but seven managed to escape alive with various injuries.

The others remained trapped under the dirt, where they perished.

The ten miners were Leyland Jones, Jason Trotman, Vick Bernard, Frank Bernard, Desmond Martins, Raymond August, Brian Bank, Trevon Phillips, Nanmore Kurt and another man identified only as “Michael”.

The deaths were blamed on heavy rains in the area, improper mining design and poor safety practices at the mining camp.

indsor Forest is a small village on the West Coast of Demerara and it is also the first village the Chinese indentured immigrants settled it. Today, the village is predominantly occupied by Indo-Guyanese with very little trace of its Chinese heritage. However there is a monument in the compound of the Windsor Forest Primary School that is dedicated to the Chinese immigrants.

Windsor Forest is also the home of Guyana’s First President, Arthur Chung.

CAL launches ‘One Caribbean Identity’ in Guyana

hey were charged, ready to go, bursting with energy even before “Dr Mashup” made his way on the stage at the Stabroek Market Square in the capital city. It was a launch campaign like none other in the recent history of Guyana.

The music was right, the vibes was perfect, and the performances truly captured the essence of the entire campaign and left everyone feeling like “Hulk”.

The skies were overcast, it drizzled before it poured briefly but that did not stop the soca junkies as they made their way into the parking area at Stabroek Square for the launch of the Caribbean Airlines Limited (CAL) Caribbean Identity campaign.

One would question why would hundreds, possibly thousands, flock that small area for the launch of just a campaign promoting the Caribbean experience, but the attraction was not the campaign but rather it was the face of that campaign that attracted those in their

numbers.

That face was none other than the GOAT (Greatest of All Time) of Soca music, “Dr Mashup” himself, “Dr Monk” or “Dr of Soca” or as many know him – Machel Montano. He brought the vibes, he brought unity and most of all he created an experience that will most definitely make those in attendance remember CAL’s Caribbean Identity campaign.

There was very little hype around the launch since many did not know of it until reports surfaced on social media on Tuesday. Prior to Machel’s performance, Chief Executive Officer of Caribbean Airlines Garvin Madera underscored the importance of such a campaign, explaining that it embraces and celebrates the authenticity of the Caribbean region and all the elements that make

it unique.

“The Caribbean Identity is the culture and the spirit of our many diverse nations – united by a shared sea and our similar and powerful heritage. Through ‘The Caribbean Identity’, we will showcase the best of our Caribbean region and reflect it across our airline identity, from our branding, to our community activities, to our presence at festivals and major cultural and heritage events,” he noted.

Madera said Caribbean Airlines and Guyana enjoy a great relationship, explaining that throughout the Caribbean region, the airline operates over 600 flights on a weekly basis, with many of them to and from Guyana. He lauded the local staffers for their dedication towards advancing the service of the airline as well as their service to its customers.

“It speaks proudly and loudly to the vibrancy of our cultures, the energy of our music, the splendor of our landscapes and of course, the humour and heart of our people. For 2019 our core message as a business will be centred around the Caribbean Identity.

This is a concept to which we can all relate,” he said.

The Airline’s CEO related that the campaign is an affirmation of the uniqueness of the Caribbean region and its people, adding that just as the motto of Guyana is ‘One People, One Nation, One Destiny’ that the wider region as forged the Caribbean Identity.

During the launch it was revealed that CAL will be the official airline for Mashramani, as well as the Guyana Independence Carnival.

In addition, they have also partnered with the Park Side Steel

Orchestra which will be re-branded as the Caribbean Airlines Park Side Steel Orchestra.

Present at the launch was the Social Cohesion Minister, Dr George Norton, who lauded the Airline for its commitment to the Guyanese market as well as its contribution to the local cultural activities.

After the formal presentations were completed, it was a complete party. Hips were moving, people gyrating as the crowd which amassed to over one thousand people waited with bated breath to see Machel. However, before they could have seen the GOAT they were treated to entertainment from Guyanese Timeka Marshall as she served as the opening act for the much-anticipated main item.

Like every concert experience, the MC hyped up the main act and DJ Casual coupled with Selector Shizzle were nothing less than perfect as they set the stage for Machel to entertain.

Machel brought out the classics and even his newest tracks for Trinidad Carnival 2019. He had the entire Stabroek Square in a frenzy as he had them flying to the Caribbean Airlines jingle and left them wining and flinging it up.

Without a doubt, it was certainly a concert performance he delivered which immediately set the stage for Mashramani celebrations. There is no other like Machel Montano and the title “GOAT” suits perfectly.

Angels Caribbean Band rocks for 25th anniversary concert in Queens

he Angels Caribbean Band embarked on its 25th anniversary celebration with the Interfaith Harmony: A Time To Remember One Love/One God/One Music, concert celebrating World Interfaith Harmony Week.

The event was held at PS 268 in Jamaica Queens. The cast of musicians included the members of the Angels Caribbean Band accompanied by Geeta Bisram, Dexter Mohamed, Rick Ramdehal , Pally Dass and dance performances by the Taranng Dance Troupe. The show was directed and produced

by Vinod, Geeta and VJ Bisram.

Over the past 25 years, the Angels Caribbean Band has had the honor of performing at various events celebrating diverse faiths, and has been able to experience first hand the positive energy generated when music and people of diverse religions come together to celebrate peace, love, unity, strength and harmony for the greater good of all mankind.

The event was the true definition of a show celebrating the diversity of mankind and the performances were flawless. Highlights of the show included a repertoire of Christian, Hindu , Muslim, various genre, popular and contemporary music showcasing the group’s ability to simultaneously sing complicated melodies while displaying the individual talents of several members including the band’s lead singers Geeta Bisram and Dexter Mohammed.

said the universal power of interfaith music enables us to gain insight into other religions and aspects of their culture and faith.

…PNC’s bets

he PNC received a powerful punch to their solar plexus with the judgements of Chief Justice Roxane George on the three cases filed with the High Court on the NCM. But it wasn’t a sucker punch as some of their partisans are squealing!! It’s just they expected the CJ would suspend her professionalism – earned over decades, first in the DPP office and then on the bench – because of “kith and kin” calls!! But the good Judge is obviously possessed of the requisite qualities for a “fit and proper” Judge – ironically articulated by no other than President Granger – “impartiality, integrity and intelligence”!!

And she impartially skittled all the arguments thrown up by the PNC lawyers with such intelligence that most Guyanese were blown away by her bravura performance that emphasised integrity and fidelity to the rule of law!! The bottom line was clearly stated without any ambiguity: the Cabinet should’ve resigned immediately on December 21, 2018, at the successful passage of the NCM and elections scheduled three months later, hence – March 19, 2019!!

AG Basil Williams, however, immediately signalled that the Government would appeal in an obvious bid to delay the inevitable, since only 43 days remained out of the three-month stipulation for holding elections. He ignored the point that the CJ didn’t rely on any arcane and abstruse legal hermeneutics of legal maxims to reach her decisions – but merely looked at the evidence presented and made the obvious conclusions. Half bodies!! Really??!! What’s to appeal?

But it would appear that the rest of the Government partners – especially the PNC – have learnt their lesson on listening to Basil Williams’ advice!! The man has the worst record in the history of Guyanese Attorney Generals – going all the way back to the first one, the late great Sir Fenton Ramsahoye!! His support of the “dual citizenship” case against Charrandas Persaud has backfired, since some of the biggest names from his “side” wouldn’t be eligible for nominations as candidates for the National Assembly!

So suddenly, preparations for elections abound from their camp. A “Campaign Committee” was launched with PNC Leader, President Granger and all his APNU baby parties in attendance. Suddenly, the Ministers are leaving their snug, refurbished and air-conditioned offices in Georgetown in “fan out” exercises across the country!! Even Moses Nagamootoo was persuaded to visit rice farmers on the Essequibo Coast, to sell his snake oil!! At least he was wise enough not to venture into Berbice where his snake oil promises on sugar resulted in 7000 workers being fired!!

But it doesn’t appear the message has reached the PNC machinery in GECOM. The chair and CEO are still passing the buck to each other to delay the CJ’s timelines!! …on AFC and Nagamootoo AFC leader Raphael Trotman has come out in support of Moses Nagamootoo being the Prime Ministerial Candidate with Granger as the Presidential one on behalf of the coalition at the upcoming polls.

Can you believe this arrogance?? Or is it self-interest and spite to deny Khemraj Ramjattan his shot at the PM slot?? Remember back in 2011 when Trotman refused to go along with the “rotating” presidential nod from the AFC that would have pushed Ramjattan??

Nagamootoo’s entry into the AFC settled that pouting by Trotman – but he refused to campaign, claiming some mysterious “serious” illness. Which was miraculously cured when the PNC selected him ahead of Nagamootoo to be the Speaker of the House.

Power has been called a powerful “aphrodisiac”, so maybe this was Trotman’s “illness”?

Anyhow, isn’t all this talk about the AFC nominating the PM candidate just spinning wheels? Why would the PNC want to place a discredited, old, blowhard to pick up those crossover votes they need in the Indo community?

n her landmark judgement on the no-confidence vote, Chief Justice Roxane George cleared up a nettlesome issue that had been in suspended animation for decades – the status of dual citizen MPs. The Constitution, in Article 155(1), after all, had been crystal clear: “No person shall be qualified for election as a member of the National Assembly who – (a)is by virtue of his own act, under any acknowledgement of allegiance, obedience or adherence to a foreign power or state…”

Yet, here it was, from the moment the clause was introduced in 1980, dual citizens had been nominated and allowed to become MPs by their parties. Since the matter affected both sides, there was obviously a tacit agreement not to trouble this particular “ants’ nest”!! Your Eyewitness had wondered whether the CJ would’ve invoked the legal doctrine of “desuetude” by which a law may be abrogated because of its long disuse.

But no, the CJ decided to call a spade a spade and let the chips fall where they may!! Anyone who holds dual citizenship CANNOT be a Member of Parliament!!

And immediately this disqualified not just some regular MPs but a few with higher ambitions. From the Government benches, it knocked out Joe Harmon and Carl Greenidge, who’d been touted as possible PNC presidential candidates if President Granger dropped out of the race. Over in the PPP, dual citizen Gail Teixeira had bowed out of their presidential nomination and has now announced she’ll “renounce” her Canadian citizenship.

And, of course, this is an avenue open to Harmon, Greenidge and any other dual citizen presently in the House. The problem for them in this election, however, is the process takes at least six months and for sure the elections boat would “done gone ah watah”!! There’s also a lot of ink spilled recently that only those who’d explicitly taken an oath of allegiance to another country were disqualified – and not those who attained the status by birth. In the CJ’s judgement, following precedent from Jamaica, the distinction is immaterial: the issuance of the passport by the second country presumed allegiance. So that eliminates Dominick Gaskin, the President’s son-inlaw.

But as the Opposition Leader pointed out, with Guyana needing the services of its (relatively) massive Diaspora, we may need to relook at Article 155 (1).

In the meantime, the CJ clarified the impact of having MPs who were disqualified from being so on legislation or Budgets passed with their votes. This was addressed by Article 165 (2) which states “…the presence or participation of any person not entitled to be present at or to participate in the proceedings of the Assembly shall not invalidate those proceedings.”

The Opposition got its cake and could eat it too!! …not walking There are some who’ve maintained that because of President Granger’s “goodness”, he would have obeyed the clear language of the Constitution’s Article 106 (6) and resigned with his Cabinet immediately after the NCM was passed. This was, in fact, his (and his PMs) immediate reaction. But he disappointed those optimists when he latched on to the ridiculous claim of 33 not being the majority of 65, even though the same majority had made him President!! It exposed, once again, that his amiability was only skin deep and he was as opportunistic as any of his predecessors in the PNC leadership.

Wasn’t he the one who’d already called the ruling of Justice George on the qualification necessary for the GECOM chair (doesn’t HAVE to be a Judge) her “perception”?? And this is what he’ll also dub her rulings on the NCM and refuse to “walk”, as we say in cricket. In this, he’s spitting on our WI traditions of fair play.

And acting like a banana republic dictator! …on ANUG The ANUG’s founders are nothing, if not “well meaning”. However, Timothy Jonas, is now disqualified by the dual citizenship ruling, and – with 50 per cent voters under 35 – Guyana’s “no country for old men”.

Who’ll be the presidential and PM candidates??

This proclivity to struggle is ineradicable because humans, pace the liberal view, do not only act out of cold, rational calculus.

There is always the messy business of predispositions, feelings, and emotions that coalesce in group solidarities, exclusions and antagonisms. All societies are therefore “plural” to a lesser or greater degree.

ethnicity and religion – going to the very heart of ascriptive identities – the emotional affects are with us in spades because of incommensurable values.

Consequently the always latent tendency for our political struggles – and all the other struggles are ultimately over questions of power and so “political” – is to careen out of control.

This view of politics that places conflict at the centre goes beyond the old, familiar school of “conflict theorists” such as the Marxists. The latter, for instance, propose while class conflict is immanent in the present capitalist conjuncture, once the working class assume power, the conflict will disappear. Utopia would have arrived. I believe this to be a fairy tale. Humans will always find one or other reason to divide themselves and deal with the “other” aggressively.

There is now a school of thought that accepts this tendency of humans to cleave into groups that manifest hostility towards each other: agonism. But rather than treating each other as enemies to be obliterated, the “other” is considered as adversaries with positions we cannot agree on but yet respect.

Rather that pretending, as liberalism does, that we can always rationally discuss away the immanent hostility between deeply divided groups, agonistic politics aim to challenge and channel it in nondestructive, institutionalised ways. If this is not done, then violence will erupt periodically, or large sections of some subaltern groups will have to be locked away as in the US. The goal is not to find consensus at any cost but to manage dissensus.

Each polity has its unique blend of incommensurable pluralism generating its own volatile melange of conflicts and consequently there is no one silver bullet to confront them all. However, we can observe the trends in polities that have exposed the hollowness of both Marxist and liberal utopian thinking to deal with deep pluralism. Britain has devolved. India continues to do so. Sudan has just fissioned as has Czechoslovakia earlier; not to mention Bosnia a tad more violently. Kenya went into a government of national unity – but that has not stopped the corruption and tensions among the groups. It was a coalition of the elites that just broadened the pillage.

ACDA has grasped the inadequacy of our specific political model to deal with our pluralism but their solution is still firmly positioned within the aforementioned failed liberal premises. I’ve asked on several occasions as to why they invoke the advice of Sir Arthur Lewis on plural societies re coalitions but never about Federalism. In our specific case, I have advocated we carry the devolution all the way down to the village level. The extensive deep, institutionalised devolution should facilitate agonistic politics at the grassroots level and hopefully defuse the build-up of hostilities that can tear the country apart. Local Government should spend greater portion of the budget than the Central Government.

Thus far from saying that we should have a love fest going, I am suggesting the ever present simmering hostility ought not to be fanned but given expression institutionally. Worse, it ought not to be moralised as a struggle between “good” and “evil” as is presently the case. This reinforces the feeling that the “other” is the “enemy” to be eliminated. No one gains when there are explosions. More pertinently, for peaceful political change, open hostilities scare away key constituencies that can secure victory of the “other”.

I am further saying that the present political arrangements will ensure that whichever side wins the election, unless a system is introduced that equitably distributes power among the various groups, we are ensuring that the inevitable resentment in the “remainders” will erupt sooner or later.

fter making an appearance on The Ellen Degeneres Show, Priyanka Chopra sat down for a chat with Jimmy Fallon on The Tonight Show on Tuesday. From talking about her married life to the release of her book titled Unfinished, the actor shared it all.

On being asked about taking husband Nick Jonas’ name, Priyanka replied, “I always wanted to add his name to mine. I’m a little traditional and old school like that. But I don’t take away my identity. He gets added to who I am.”

Avengers Endgame directors: We have had great responses from our test audiences

T

he release o f Avengers: Endgame is just a few months away, and the test screen-

ings for the film have already started.

Co-director Joe Russo spoke to Collider and confirmed that the film’s current run time is “three hours.” The run-time for Avengers Infinity War was two hours and forty minutes making it the longest MCU film yet, but it looks like with the upcoming film, we will have a new record.

Directors Joe and Anthony Russo told Collider, “I think the studio is down with what the best story is. Right now, we think the movie is playing well and we’ve had great responses from our test audiences and we’re feeling

very good about where it is. We’re still doing work to it. We’re not done with it.”

They further added, “Again, this is a culmination film of 22 movies, it’s a lot of storytelling to work into it. Emotion is an intrinsic part of that to us. When you have to tell a really complicated story and you want strong emotional moments with the characters, it just requires a certain amount of real estate. This one, in particular, feels like three hours worth of real estate.”

Even with a three-hour run-time, not a single person got up during the first three test screenings. Anthony Russo said, “We have screened the movie four times for audiences now.

For the first three screenings, not a single person got up to go to the bathroom.”

Avengers Endgame has a big ensemble cast comprising all the superheroes of the Marvel Cinematic Universe and even though we saw many of them perish in Avengers Infinity War, it is being speculated that most of them might come back to defeat Thanos.

Dottin could surpass Taylor as top T20 all-rounder – 32 points behind skipper on ICC list

indies Women’s star Deandra Dottin lived up to her rank as one of the better T20 allrounders in the world as her heroics in the T20I series against Pakistan helped the tourists snatch their first series win of 2019.

With a series ending 2-1, Windies will be gunning when the final OneDay International Series bowls off on February 7. One player in particular could surge to the top of the International Cricket Council (ICC) T20 rankings and possibly dethrone her skipper and current leader – Stafanie Taylor.

The combined strength of Dottin and company, namely Guyanese Shemaine Campbell who won Most Valuable Player (MVP) for leading the chase with a top-score of 41, helped Windies seize the series 2-0. The final match saw Pakistan outdo the visitors, but Dottin remained resolute in her gameplay.

Dottin ended the three matches with 176 runs and a similar average to match, from just the three innings played. The all-rounder also bagged three wickets in the series.

ave Cameron, the president of CWI, has called on the ICC to review its policy of suspending captains who oversee slow over rates, after describing Jason Holder's absence from next week's third Test in St Lucia as a "crippling" decision that will overshadow a famous series win over England.

Holder was handed a one-match suspension by the ICC in the wake of their ten-wicket victory in Antigua last week, after it was deemed that West Indies had been two overs short of fulfilling their quota of overs, after time allowances were taken into consideration.

It means that their bid for a memorable 3-0 clean sweep will be undermined by the absence of the outstanding player of the series to date.

Holder dominated the first Test with an unbeaten 202, his highest Test innings and first century on his home island of Barbados, and has also claimed seven wickets at 17.85, including a key haul of 4 for 43 in the second innings in Antigua.

In addition, his captaincy has been integral in gelling a young and motivated team. Kraigg Brathwaite will lead the side in St Lucia in Holder's absence, with the Guyanese allrounder Keemo Paul coming into the squad as cover.

Holder is expected to remain with the squad during the St Lucia Test, and will be available to provide motivation behind the scenes, but Cameron did not hide his frustration at his captain's impending absence.

"We will, of course, abide by the ICC ruling, but we have to wonder if such punitive action at a pivotal stage of the series is good for cricket," he said. "What a shame if the series is remembered not for the sparkling play of the reinvigorated West Indies players but for a crippling decision made by a rule that ought to be modified.

"Jason now has the opportunity to benefit from resting his body over the period of the next Test, and be well

prepared for the upcoming ODI series against England which begins on February 20."

CWI is also braced for the ICC's report into the pitch prepared for the Antigua Test. With a perceived ridge just short of a good length, it was a surface which proved particularly lively in the first innings, with Joe Root receiving an unplayable lifter from Alzarri Joseph, while Roston Chase was bowled by a shooter from Stuart Broad on the second day.

However, CWI is hopeful of avoiding a demerit point for a "poor" surface, after West Indies' own batsmen proved that decent runscoring was possible in making 306 in their only completed innings.

CPL makes over US$20.8M impact on Barbados’ economy

ero Caribbean Premier League (CPL) announced that the tournament’s economic impact for Barbados last year was US$20,841,961. The tournament was staged between August 8 and 16 September 16. Organisers said that figure represented an increase on the 2017 figure of nearly 40 per cent.

This figure has been calculated using organiser spend, visitor spend and media value and was collated for Hero CPL by world-renowned researchers, SMGInsight.

In addition to that economic impact figure the Hero CPL employed 361 staff in Barbados and filled 4,579 hotel rooms during the 2018 event. The value of media exposure and mentions of Barbados from

the coverage was US$10,438,503; almost double that achieved in 2017. This was due in part to the unique sponsorship of the Sky Sports CPL coverage in the United Kingdom by the Visit Barbados campaign.

The Hero CPL spent US$2,644,411 in Barbados during the 2018 event with the tournament hosting five matches in the island.

Speaking about the report from SMG Insight the Hero CPL Chief Operating Officer, Pete Russell said: “Barbados has been such a large part of CPL since the tournament started in 2013 and we are delighted to be providing tangible benefits to the economy of the country. We have already started our plans for the 2019 tournament, and we are certain we can improve on these figures.”

First started in 2013, the Hero Caribbean Premier League (CPL) is a franchise-based T20 format cricket tournament that combines two of the most compelling aspects of Caribbean life – dramatic cricket and a vibrant Carnival atmosphere.

rchery Guyana continues to maintain a strong relationship with the National Sports Commission (NSC) in order to facilitate the growth and development of the sport.

In its most recent interaction, Archery Guyana President Mohamed Khan and Secretary Vidushi PersaudMcKinnon paid a courtesy call to Director of Sport, Christopher Jones at the NSC to discuss plans, initiatives and the direction that Archery Guyana will be heading in.

During this visit, the pair from Archery Guyana updated the Director of Sport on the progress of the body as they discussed their development plans, including the proposed Junior Archery Programme, Schools Programme and Para-Archery Programme.

Archery Guyana took the opportunity to advise the Director of Sport of its plans to host an International Olympic Archery Judges Seminar in collaboration with World Archery Americas.

It was agreed that this would benefit many Guyanese and has the potential to lift Guyana’s profile in the international sporting community. At the end of this Seminar, Archery Guyana intends to host an International Archery Competition.

Among some of the conclusions that

were drawn in the audience with the Director of Sport, a consensus was arrived at to pursue greater outreach programmes in collaboration. It was also agreed that Archery Guyana would endeavour to take outdoor archery to other facilities outside the capital city with the possibility of collaborating to develop archery in all regions of Guyana.

Additionally, the Director of Sport confirmed arrangements were in place for Archery Guyana to have access to the National Gymnasium for indoor archery and to the Leonora Track and Field Facility for outdoor archery.

The Director and Archery Guyana agreed to collaborate to build a stronger working relationship in promoting and developing the novel sport for the benefit of all Guyanese. The Directors of Archery Guyana committed to continuing to maintain the highest standards of governance and transparency in all their activities.

In this regard, Khan took the opportunity to lay over a copy of Archery Guyana’s recent Audited Financial Statement duly audited by an external auditor pursuant to NSC requirements and other supporting documents, thereby being the first sporting body in Guyana to comply with the 2019 requirements.

The teams include League champions from Regional Member Associations (RMAs) including Riverview FC (Bartica FA); Soesdyke Falcons (East Bank FA); Buxton Stars FC (East Demerara FA); FC Eagles (West Demerara FA); NA United (Berbice FA) and Police FC, Georgetown Football Club (GFC) and Santos FC respectively from the Georgetown FA. In an invited comment, GFF’s Competitions Director Ian Alves explained the inclusion of two additional clubs from the

GFA: “The Berbice and Essequibo-Pomeroon FAs could not field a champion club in the year-end tournament, but contested as an Association. The opportunity was, therefore, utilised to involved two of the GFA clubs that performed creditably during 2018.”

Following the official draw of the playoffs held on Tuesday at the GFF’s Boardroom in the presence of participating clubs’ representatives, the event will see Santos FC battle FC Eagles at 10:00h, GFC face Buxton Stars at 12:00h, Riverview FC oppose Police FC at 14:00h and NA United FC take on Soesdyke Falcons at 16:00h.

On Sunday, the schedule will see the winner of Match 1 versus the winner of Match 2 at 10:00h and the winner of Match 3 versus the winner of Match 4 at 12:00h.

The play-offs became

necessary as per the GFF Elite League Rules & Regulations, which speak to relegation and promotion at the end of the League.

According to the rules, “the top eight clubs based on their points standing at the end of the tournament will automatically qualify for the next season.

The 10th-placed team will be automatically relegated and the winner of the Association Level Championship (ALC) will be promoted. The 9th -placed team will have a playoff with the runner-up of the ALC to determine promotion and relegation.”

As per the current points standing, Cougars FC have been relegated while NA United will fight for their chance to remain in the Elite League. The GFF Elite League is scheduled to commence in early March.

achin Tendulkar believes India are "the favourites" to win the 2019 World Cup. Tendulkar's comments came two days after his former India team-mate Rahul Dravid, too, backed Virat Kohli's men to win a third World Cup for India.

"As far as our chances are concerned, I will not hesitate in saying that we are the favourites," Tendulkar told PTI on Sunday. "I have gone on record saying that we have a perfect balance in the team where we will be competitive in any part of the world or on any surface."

Tendulkar believes hosts England will provide India with their toughest challenge, while New Zealand too are a team to watch despite them having just lost 4-1 to India at home.

"I know New Zealand have struggled in this series but it's a good unit, one needs to be on their toes [when playing them]," Tendulkar said. "It's

all about getting the early momentum.

My judgement on the toughest contenders would be England, while New Zealand would be the dark horse."

India have had a successful 12 months in ODI cricket. he Guyana Football Federation (GFF) is moving full steam ahead with preparations for its final CONCACAF Nations League match against Belize on March 23, 2019 as the Federation has released a 26-man Guyana-based Golden Jaguars squad that has been shortlisted, at the Leonora Track and Field Facility.

The squad includes three goalkeepers, eight defenders, six midfielders and nine forwards who have been shortlisted from an initial 35man squad that has been in training for the last two weeks.

Former national defender Charles Pollard, who has been appointed Assistant Coach and has been working with the team, said the shortlisted squad was solid while noting “players being able to perform at a high level under instruction” was among the criteria used for selection.

The team will be engaged in an eight-week weekly training programme before the final squad is announced to

engage Belize. Pollard said that the time should be good to enable the team to be in shape for final selection.

“In the next eight weeks, it will give everyone a level playing field and an equal chance to make the final 23. Fitness, developing their football IQ, awareness and tactical soundness will be the focus,” the former national player stated.

For his part, Pollard was happy to be back in the national setup and contributing to football development in Guyana: “I’m excited to go work with the team; it’s a very good group of guys. They are very excited to be part of the programme, so I’m looking forward to a good eight-week preparation and, at the end of the preparation, the best guys will be selected.”
