Attorney General Anil Nandlall, SC, has initiated legal proceedings against BK Marine - a subsidiary of the BK Group of Companies for trespass over its occupation of a bond at Lot 5 Water Street, Kingston, Georgetown, in the compound of the Transport and Harbours Department (T&HD).
Nandlall has also claimed rent arrears against BK Marine in the sum of $8.4 million for the period August 1, 2009, to January 15, 2021. In a Statement of Claim, he deposed that he is entitled to possession of the bond and is therefore asking the High Court for an order evicting BK Marine from the property.
Also, the Attorney General has asked the court to award damages for trespass, mesne profits from August 1, 2009, until BK Marine vacates the bond, interest in accordance with Section 12 of the Law Reform Miscellaneous Act, such further or other orders as the court deems just and reasonable as well as costs.
Nandlall said that on August 1, 2003, T&HD entered into an agreement with BK Marine for the rental of the bond which measures 43,966 square feet at an annual rental price of $600,000.

2-year-old dies suddenly after suffering from high fever
Atwo-year-old lad was pronounced dead on Sunday after his mother rushed him to the Mabaruma Regional Hospital, Region One (Barima-Waini) with high a temperature. The dead lad is of Barima Kariabo, North West District (NWD).
Police preliminary investigations revealed that the infant’s mother, Nicole Campbell, took him home on February 9, 2021. However, at about 16:00h on the said day, the child started to develop a high fever. On February, 13 at about 23:30h, the woman said that her child’s condition worsened.
Soon after, she explained that the child became motionless and it was then, he was rushed to the Barima Kariabo Health Centre where he was immediately taken to the Mabaruma Regional Hospital.
At about 12:00h on Sunday, he was examined by a doctor, who pronounced him dead. The body is at the hospital’s mortuary awaiting a post-mortem. Sixty-two-yearold Cheryl Barker of Hummingbird Street, Festival City, South Ruimveldt, Georgetown, was left traumatised after three armed men invaded her property and robbed her in the wee hours of Monday.
The incident occurred at about 01:30h by the three men - one of whom was armed with a handgun and another a cutlass. They reportedly escaped with $160,000, one mobile phone and one 32-inch television set.
Based on reports received, the elderly woman was awakened by the sounds of persons walking in her living room and she started to scream.
At that point, she was confronted by the three men, who held her down on the bed and demanded money and jewellery.
The Police stated that one of the suspects then placed the gun into the victim’s mouth while the others ransacked the apartment.
After finding the cash and other items, they made good their escape. After leaving, the Police were contacted and upon checking the surroundings, it is believed that the men gained entry into the house by removing several louvre panes from a window.
No arrest was made but the area has been dusted for fingerprints.

Nandlall, however, said that BK Marine stopped paying rent for the bond space from August 1, 2009, and as a consequence, the agreement was immediately terminated by T&HD.
According to Nandlall, notwithstanding the termination of the agreement, BK Marine continues to occupy the property and has failed and/or neglected to vacate the premises or pay an annual rent of $600,000. Taking this into consideration, Nandlall submitted that BK Marine has incurred the sum of $8.4 million in arrears of rent from August 1, 2009, to January 15, 2021.
He further submitted that as a result of BK Marine’s occupation of the bond, he was unable to use or rent it and as a consequence, claimed loss and mesne profit. He is also asking for a declaration that BK Marine committed a trespass in its continued occupation of the bond. (G1)
