ith just two more months before the calendar flips to February 2019, the Guyana National Broadcasting Authority (GNBA) on Friday announced that all broadcasting agencies must have at least one newscast which caters for persons who are differently abled.

According to the GNBA Chairman, Leslie Sobers, broadcasting agencies will be required to have an inset on the newscast with persons using sign language, to cater for persons with hearing disabilities.

He also noted that closed caption may also be used to cater for such persons.

Sobers said these provisions are being imposed as the entity seeks to have an equitable access of information to persons regardless of their circumstances.

While acquainting his audience on the matter, he noted, “It is quite clear that the world of broadcasting is changing with new chan-

nels and content producers transforming the media landscape and with the impending digital changeover, what also needs to change is how we cater for the information needs of Guyanese; in particular, those with disabilities”.

It was here that the Chairman quoted the section of the law, which states that provisions should be made for such persons. “Section 26 of the Persons with Disabilities Act Chapter 36:05 says ‘that within 10 years of the coming into operation of the Act or a later date, the Minister may prescribe, the person in charge of every national television station shall provide sign language inset or subtitles in at least one newscast daily and special programmes covering events of national significance’”.

He was keen to note that broadcasters, who fail to meet this requirement commits an offence and will be liable to a fine of $100,000

and imprisonment for six months. He however did not comment on whether there was consultations with local broadcasters on the matter and who will stand the extra cost for the additional feature.

“All broadcasters are therefore bound by law to ensure that somebody is doing sign language on at least

one newscast per day,” he added.

Sobers was at the time giving a presentation at GNBA’s Broadcasters’ Engagement and Christmas Luncheon at Herdmanston Lodge, Peter Rose Street, Queenstown, Georgetown.

It was explained by the Chairman that this Act came into being in 2012,

which means all broadcasters should be compliant by 2022 in keeping with the 10 year-period.

The Broadcasting Agency is adamant that persons with disabilities face challenges when it comes to accessing information, employment, education and entertainment, among other areas which can be mitigated with the implementation of this law.

Sobers was sure to include that just about 50,000 people comprise Guyana’s differently abled population. Of this population, 9.1 per cent or 4406 people suffer from hearing impediment. Moreover 30 per cent or 14,525 persons, he noted, suffer from visual impairment.

“If one thinks carefully about those numbers, one can imagine that persons with disabilities can make significant differences in certain spheres,” the Chairman asserted.

According to him, technologies are available to help persons who are visually impaired understand what is happening on television, although such is expensive.

As explained by him, the GNBA is working to develop a policy framework by

February 2019, with the goal of encouraging broadcasters nationally to allow for greater accessibility to information for the differently abled.

While the intentions of the Agency may be for good, many broadcasters have already complained of this move, citing little or no consultation on the matter was done. Many broadcasters on Friday said that with the exorbitant fees that are already demanded will now be compounded with the cost to add this new feature to their newscast. While several agreed that indeed persons who are differently-abled should be carted for, they however noted that there should be a reduction in the yearly GNBA fees to compensate for this stipulation.

Although, Sobers, quoted sections of the law on the matter, some broadcasters are furious over the move by the GNBA. Guyana Times was told that the GNBA has not consulted with local broadcasters on the matter, with some saying they are not even aware of any such law. Several broadcasters said that were shocked by the announcement by Sobers and will be seeking legal advice on the matter.

Teen miner dies in Mabura accident

S

ixteen-year-old Clayton Docton Skybar, a miner, of 111 Mahdia, Region Eight (Potaro-Siparuni) was killed in an accident along the Mabura Road on Friday after two trucks collided in the vicinity of 58 Miles, at Region Ten (Upper Demerara-Berbice).

The incident occurred at about 11:30h on Friday.

Police reports stated that Skybar was seated along with three other passengers in the tray of a truck with licence plate number GPP 4923, with trailer THH 9317 driven by a 23-yearold of Helena, Number 1, East Coast, Demerara (ECD) when it collided with pick-up truck GTT 2531.

The pick-up was driven by a 41-year-old Timehri Public Road, East Bank Demerara (EBD) resident.

While details of the accident are sketchy, the vehicles were said to be negotiating a turn at the time of the collision. The truck in which Skybar was a passenger, was reportedly lad-

en with lumber and heading to Linden while the other vehicle was said to be heading into Mabura.

Following the incident, Skybar was rushed to the Linden Hospital where he was pronounced dead on arrival.

He suffered numerous injuries to his head, elbow and hip. The driver of the pick-up truck was later taken into Police custody at Linden where he was said to be assisting with investigations.

fter a week of crutiny from the parliamentary Opposition, the National Assembly on Friday approved the $300.7 billion Budget estimates. But the final day saw some fireworks as the Finance and Public Security Ministries were scrutinised.

In the case of the Finance Ministry, the parliamentary Opposition was especially concerned about the finances of the National Industrial and Commercial Investments Limited’s (NICIL) Special Purpose Unit (SPU).

“When we established the SPU, which is a temporary arrangement until they finalise the sale of the assets no longer under the purview of [Guyana Sugar Corporation] GuySuCo. And so technically to separate the activities of the general NICIL from the arrangement, we decided to fund that out of the Treasury,” Finance Minister Winston Jordan explained.

“NICIL would not have been in a position, out of its cash flow, to fund the activities of the SPU. Taking into consideration some of the recommendations from the inquiry into NICIL, most of the funding that went there are now paid directly into the Treasury. So they do not command the kind of resources they commanded prior to 2015.”

Queries from Opposition parliamentarian Juan Edghill revealed that Government has yet to begin repaying the interest on the $30 billion syndicated bond it borrowed for GuySuCo, much less the principle.

However, the Finance Minister indicated that they have a deadline of May 2019 to begin repaying the bond.

In light of this, the Minister insisted that they were not in default.

Already there has been tremendous interest for land based on tenders, but Cabinet is considering the mechanism that will trigger these sales,” he said.

Giving some insight into the new designs that will replace the razed Georgetown prisons, Ramjattan said the steel cells which will be built will be portable. Hence, he noted that if need be, these

cells can be transported to different locations.

Justifying the portable steel cell model, Ramjattan said at present they do not have an appropriately large location to construct a new prison that can be close enough to transport remand prisons to court in Georgetown. In the interim, however, he said the experts are in discussion with them for a suitable location for such a prison in Demerara.

Budget 2019, themed ‘Transforming the Economy, Empowering People, Building Sustainable Communities for Good Life’ is the Administration’s fifth since coming to office in 2015. It is also the largest.

A

new report by a global coalition, which includes UNICEF and WHO, has stated that nearly 30 million babies are born too soon, too small; or become sick every year and need specialised care to survive. The report, ‘Survive and Thrive: Transforming care for every small and sick newborn’, finds that among the newborn babies, most at risk of death and disability are those with complications from prematurity, brain injury during childbirth, severe bacterial infection or jaundice, and those with congenital conditions.

At the launch of the report, Omar Abdi, UNICEF Deputy Executive Director, noted that when it comes to babies and their mothers, the right care at the right time in the right place can make all the difference; yet, millions of small and sick babies and women are dying every year simply because they do not receive the quality care that is their right and our collective responsibility.

According to the report, for every mother and baby, a healthy start from pregnancy through childbirth and the first months after birth is essential. Without specialised treatment, many at-risk newborns won’t survive their first month of life. In 2017, some 2.5 million newborns died, mostly from preventable causes. Almost two-thirds of babies who die were born premature. And even if they survive, these babies face chronic diseases or developmental delays.

In addition, an estimated 1 million small and sick newborns survive with a long-term disability.

The health experts have made it clear that, with nurturing care, these babies can live without major complications. The report shows that, by 2030, in 81 countries, the lives of 2.9 million women, stillborns and newborns can be saved with smarter strategies. For example, if the same health team cares for both mother and baby through labour, birth and beyond, they can identify problems early on.

In addition, according to the report, almost 68 per cent of newborn’s deaths could be averted by 2030 with simple fixes, such as exclusive breastfeeding; skin-to-skin contact between the mother or father and the baby; medicines and essential equipment; and access to clean, well-equipped health facilities staffed by skilled health workers. Other measures, like resuscitating a baby who cannot breathe properly; giving the mother an injection to prevent bleeding; or delaying the cutting of the umbilical cord, could also save millions.

The report notes that the world will not achieve the global target of health for all unless it transforms care for every newborn. Without rapid progress, some countries will not meet this target for another 11 decades.

In Guyana, despite progress achieved during the last decade, this country continues to experience one of the highest maternal and infant mortality rates in Latin America and the Caribbean, with a maternal mortality rate estimated at 121 per 1,000 live births and an infant mortality rate at 22 per 1,000 live births. Just recently, the media carried reports of relatives complaining of the poor care that was provided to pregnant mothers at the hospital. While we have had several such cases in the past, very little has been done to remedy the situation; at least this seems to be the general feeling of the populace.

To reduce the number of newborn’s deaths, the report has made a number of recommendations which would be useful to Guyana and other countries. These include: Providing round-the-clock in-patient care for newborns seven days a week; training nurses to provide hands-on care working in partnership with families; harnessing the power of parents and families by teaching them how to become expert caregivers and care for their babies -- which can reduce stress, help babies gain weight, and allow their brains to develop properly. Providing good quality of care should be part of a country’s policies, and a lifelong investment for those who are born small or sick; and allocating the necessary resources as an additional investment of US$ 0.20 cents per person can save 2 of every 3 newborns in low- and middle-income countries by 2030.

It is hoped that renewed efforts will be made by health authorities worldwide, including in Guyana, to ensure that legislative, medical, human and financial resources are in place to save our newborns from death and diseases.

Khashoggi killer heard saying “I know how to cut” on audio – Erdoğan

Jamal Khashoggi ne of the killers of the Saudi journalist Jamal Khashoggi was heard saying “I know how to cut” on the audio of the murder, which Turkey has shared with US and European officials, the Turkish president, Recep Tayyip Erdoğan, said on Friday.

Erdoğan criticised Riyadh for its changing account of how Khashoggi, a Washington Post columnist and prominent critic of the Saudi crown prince, Mohammed bin Salman, was murdered at the Saudi consulate in Istanbul on October 2, 2018. The journalist had gone there to collect documents for his forthcoming marriage.

The case has caused global outrage and damaged the international standing of Prince Mohammed, 33, the kingdom’s de facto ruler. The US Senate delivered a rare rebuke to Donald Trump for his support of

the crown prince, whom it blamed for the killing.

“The United States, Germany, France, Canada, we made them all listen ... The man clearly says ‘I know how to cut’. This man is a soldier. These are all in the audio recordings,” Erdoğan said in a speech in Istanbul. He did not give further details about the recording.

Istanbul’s chief prosecutor has said Khashoggi was suffocated by his killers in the consulate, before his body was dismembered and disposed of. His remains have not been found.

Khashoggi repeatedly told his killers “I can’t breathe” during his final moments, CNN reported on Monday, quoting a source who had reportedly read the full translated transcript of the audio recording.

Saudi Arabia has said the prince had no prior knowledge of the mur-

der. After offering numerous contradictory explanations, Riyadh later said Khashoggi had been killed when negotiations to persuade him to return to Saudi Arabia failed.

Erdoğan renewed his criticism of Riyadh’s explanation of the killing.

Originally it had said Khashoggi had left the consulate. That was disputed by his Turkish fiancee, who had waited outside the building and said he never emerged.

“The prince says Jamal Khashoggi left the consulate. Is Jamal Khashoggi a kid? His fiancee is waiting outside,” Erdoğan said.

“They think the world is dumb. This nation isn’t dumb and it knows how to hold people accountable.”

Turkish officials said last week the Istanbul prosecutor’s office had concluded there was “strong suspicion” that Saud al-Qahtani, a top aide to Prince Mohammed, and Gen Ahmed al-Asiri, who served as the deputy head of foreign intelligence, were among the planners of Khashoggi’s killing.

After Riyadh ruled out extraditing the two men, Turkey said this week that the international community should seek out justice for Khashoggi under international law.

Erdoğan has repeatedly said he would not give up the case. Trump has said he wants Washington to stand by the Saudi Government and the prince, despite the CIA’s assessment that it was probably the prince who ordered Khashoggi’s killing. (The Guardian)

Berbice Bridge take over

High Court gives Govt additional time to respond to BBCI’s legal challenge

overnment has been granted additional time to respond to aspects of the legal challenge filed by the Berbice Bridge Company Incorporated (BBCI) in its bid to retake operations of the bridge.

In October, the BBCI disclosed that it was facing bankruptcy and as such proposed to increase its tolls, to keep the bridge company afloat.

However, Public Infrastructure Minister David Patterson issued the Berbice River Bridge (Public Safety) Toll Order, which took effect on November 1,

2018.

The Order sought to prevent the BBCI from increasing the tolls for vehicles to cross the bridge and as such, Government took over the functions of maintaining and operating the Bridge, while ordering that the tolls remain the same. According to Government, this was done in the best interest of the people.

However, the BBCI approached the High Court late last month and asked the court to quash the Minister’s order, thus allowing them to resume responsibility for the bridge and also

implement the toll hikes.

Both Minister Patterson and Attorney General Basil Williams were named defendants in the court action and were served with notices.

This application came up for hearing on December 5, 2018, before Justice Gino Persaud. But before the case could have been heard, lawyers from the Attorney General’s Chambers filed an application for an extension of time to file an affidavit in answer to the application for facts and reasons.

Justice Persaud granted that application, thus giving the State an additional 10

days to respond to the BBCI. As such, the matter will be called again on Wednesday December 19, for hearing.

In its application, the BBCI is asking the court to quash the order freezing the tolls, to prohibit the Minister and Government from exercising the functions of maintaining and operating the Bridge, a declaration that the order is unconstitutional, an order that the Minister supply the facts and reasons for the decision to promulgate the Order and several other related orders.

The BBCI also asked for

immediate interim relief by way of an application to the court for Minister Patterson to supply the facts and reasons for the decision which is provided for by section 15 of the Judicial Review Act. The company had explained that after the promulgation of the Toll Order, the BBCI had written to the Minister asking for the facts and reasons within 14 days as provided for by section 15, but the Minister did not respond.

While Government is adamant in not allowing the increases, outspoken political activist and former

Presidential Advisor, Ramon Gaskin, had suggesting a total buyout of the bridge company by Government so as to resolve the issue.

Guyana Times understands that the BBCI, in which the National Insurance Scheme (NIS) has majority voting rights on the Board of Directors, was forced to push for the increase in tolls in order to protect its investment. To this end, Gaskin suggested that an alternative can be for Government and the NIS to solely-own the bridge, thus buying the shares from all the other shareholders.

GuySuCo bonus not a novel idea as industry production edges higher Dear Editor, The Guyana Agricultural and General Workers Union (GAWU) has recognised that several sections of the media have reported that the Guyana Sugar Corporation Inc (GuySuCo) is seeking to pay workers what it deems as a bonus arising from its higher level of sugar production this year.

For the thousands of sugar workers still employed by the Corporation, the news that the sugar company is considering such an idea was indeed welcome, and, at the same time, it was received with some skepticism.

The bonus, as the Corporation terms it, is by no means a new initiative. In fact, the arrangement under consideration is identical to the Annual Production Incentive (API) scheme which was suspended for a few years now. The API, as GAWU shared before, dates back to colonial times, and is a form of deferred earnings premised on annual sugar production.

For the workers, the fact that the Corporation has offered such an incentive is a clear indication that their collective voices and actions could not be ignored by the GuySuCo hierarchy, and possibly by the powersthat-be.

As the Corporation’s release pointed out, the industry is nearing its revised 2018 production target. It is welcome news for the industry, and is a clear demonstration of the commitment of the workers, whose dedicated efforts have allowed the GuySuCo to reach where it is today.

We noted, too, that the Corporation, in its release, acknowledged this reality.

Moreover, the GAWU believes such performances need to be rewarded, as the

Corporation seemingly recognizes as well.

At this time, the Union and the GuySuCo are engaged in discussions towards finding an amicable arrangement in the interest of all parties. We sincerely hope our engagements would result in an acceptable agreement.

While happy about this (bonus) development, workers remain concerned that the Corporation has yet to consider the Union’s claim for a 15 per cent rise-in-pay retroactive to January 01, 2018. As is well known, sugar workers remain the only workers in the state sector to have not gotten any pay increase since the Coalition

took office three and a half years ago.

At this time, the GAWU and GuySuCo have already concluded discussions on the non-wage benefits.

Those engagements resulted in a few improvements being secured. Our discussions this year, the GAWU notes, have been conducted in a more amicable environment. Whether the improvement could be attributed to the change in the Corporation’s leadership or other factors we are not sure, but we are, nevertheless, pleased with the new attitude of the GuySuCo. We sincerely hope that our current and future dis-

cussions can be conducted in a similar or improved atmosphere, as this augurs well for the GAWU/GuySuCo relations. The Union has pointed out on several occasions that our now 42-year relationship with GuySuCo had reached possibly its lowest ebb in recent years, and the GAWU had expressed its commitment to resuming the generally respectful and fruitful relations in the interest of the workers, the Corporation and the industry.

At this time the GAWU

has put forward a counter-proposal regarding the ‘bonus’, and the Corporation has committed to examining our suggestion; and expectedly, we will meet soon.

The Union, nevertheless, believes that this stop-gap measure cannot be deemed a substitute for a pay rise, which has been denied for far too long though the workers, in spite of the circumstance, continue to demonstrate their importance to the successes being recorded.

Also, it is reasonable

to expect that the present leadership, having recognised the value of the API incentive, would undertake the removal of the suspension, and see such a practice as good for the industry’s progress. The GAWU, at this time, looks forward to the Corporation, in a similar vein, positively considering a pay rise.

Increase in fatal accidents recorded for 2018 – Top Cop …says crime rate declined by 11%

here has been an overall spike in the number of fatal accidents recorded for 2018, when compared to the same period last year.

This was revealed by Police Commissioner Leslie James on Friday during his remarks at the A Division (Georgetown-East Bank Demerara) annual award ceremony, where he gave a breakdown of some crime and accident statistics for this year.

According to the Top Cop, serious crime on the other hand has decreased by 11 per cent. “We’ve had a spike in the fatal accidents… We have seen a decrease of 11 per cent in serious crimes overall. Even the specific types of serious crimes we’ve seen a reduction.”

While examining these statistics, James informed that next year will see a “much reformed” Guyana Police Force (GPF). This is given into consideration since their main goal is to improve capacity in training, infrastructure and human resource; areas which are crucially essential at this time.

“The main aspect that we’re addressing at this point in time up to the end of 2018 would be training, infrastructure and human resources management. We’ve recognised that there is a need for those things to be addressed almost immediately.”

He used his platform to make some requests, which can affect how the GPF can function in a positive manner. This includes provisions for a traffic advisory board, training board and promo-

tion board. At present, consultations were convened to determine whether these panels should be reinstated.

‘There is need for the Traffic Advisory Board.

There is need for a training board and of course, a promotion board. We have strongly recommended the resuscitation of those Boards. If we are an organisation that can be recognised as a prudent organisation, those Boards ought to be in place,” the Police Commissioner insisted.

Christmas preparations

For the approaching holiday season, calls were made for persons to monitor the use of the roadways and desist from driving under the influence of alcohol. It was noted that special attention will be given in an effort to reduce fatalities and moreover, avoid a surge in these offences for 2018.

“I would like to take the opportunity to urge the motorists and pedestrians to especially at this point in time, when there is this urge to imbibe excessively, to be careful on our roadways.

If you have to drink, don’t drive.”

Close attention will be paid to entertainment establishments and other individuals who play music at an “unacceptable” volume.

James explained, “I’m also taking the opportunity to call on establishments to conform with the laws of Guyana which at a time, when you are required to cease the playing of music.

Equally, I will call on individuals who will be hosting barbecues and other activities.”

“Your permit would have has a stipulated time. I’m asking that you cooperate with your staff when they approach you to remind you of the time when your music should be shut off,” he further stated.

His “Christmas message” was, “I would urge all of us to take some time out to be with our loved ones and the persons who mean the most to you. It is a time of sharing, a time of giving. Visit the older folks [and] gain some knowledge from the older folks and show them love.”

hairman of the Guyana Elections Commission (GECOM), retired Justice James Patterson has been hospitalised and placed in the Intensive Care Unit (ICU) of a private city hospital.

Sources confirmed on Friday that Patterson was admitted to a city hospital where he was immediately sent to the ICU. He was reportedly diagnosed with prostate cancer.

The 84-year-old retired Justice was appointed as the GECOM Chairman by President David Granger in October 2017.

Following his appointment, PPP’s Executive Secretary, Zulfikar Mustapha filed a legal challenge since the appointed was considered unilateral.

However, after several months of submissions in the High Court, the Chief Justice (ag) Roxane George on June 8, 2018, ruled that the Constitution of Guyana allows for the President to unilaterally appoint someone to fill the position of GECOM chair.

Apart from asking that the appointment of Patterson be rescinded, the PPP had

argued that he was unqualified for the post, and had petitioned the court to order the President to choose a person from the 18 names submitted by Opposition Leader, Bharrat Jagdeo prior to his appointment.

However, the Chief Justice, in her ruling, stated that there was nothing before the court to support a finding that the President had acted unlawfully or irrationally in resorting to the proviso to Art 161(2); and there was nothing to rebut the presumption that Justice Patterson is qualified to be appointed to the post of Chairman of GECOM. According to the Chief Justice, the Opposition did not produce evidence to sup-

port the contention that Patterson was unqualified for the position.

She added that even if she had agreed with the contention that the appointment was unlawful, it would not have been “permissible for this court to usurp the function of the President by directing him to choose a nominee from the third, or any, list.”

However, she did outline in her ruling that the President should have given reasons for his rejection of the 18 nominees submitted by Opposition Leader Bharrat Jagdeo in three separate lists, all of whom were rejected.

Attorney-at-law, Anil Nandlall on behalf of his client appealed the decision stating that the learned Chief Justice misconstrued and misinterpreted the role of the Leader of the Opposition in Article 161 (2) of the Constitution of the Cooperative Republic of Guyana and as such, was asking the court to overturn the High Court ruling.

However, the Court of Appeal upheld the Chief Justice’s ruling. The PPP has since appealed that decision in the Caribbean Court of Justice (CCJ).

Campbellville resident to spend Christmas in prison

2 5 - y e a r - o l d Campbellville, Georgetown resident will spend Christmas behind bars after he was remanded to prison on Friday by Senior Magistrate Leron Daly for allegedly trying to smuggle marijuana into the Georgetown Magistrates’

Chris Otto denied the charge. According to facts presented by Police Prosecutor Sanj Singh, the defendant went to the Georgetown Magistrates’ Courts lockups on December 11, 2018, to provide a meal for a relative,

who has a pending court matter.

However, he was denied entry because he did not adhere to the dress code.

According to the prosecutor, Otto then asked several persons to take the black plastic bag containing the food into the compound.

One person assisted and

took the food in but when it was searched, marijuana was found in the box.

Otto was reportedly identified as the person who sent the food into the lockups.

He was later arrested and charged for the offence.

The case will continue on January 18, 2019.

Wife charged for attempting to kill husband

3 9 - y e a r - o l d West Ruimveldt, Georgetown woman, who allegedly stabbed her husband in the ribs during a heated argument over his ex-wife, was on Friday arraigned on an attempted murder charge at the Georgetown Magistrates’ Courts.

The mother of seven,

Kendrea Grant, stood before Senior Magistrate Fabayo Azore where the charge stated that on November 12, 2018, at their West Ruimveldt, Georgetown home, with intent to commit murder, she wounded Otis Bailey.

The prosecution is contending that Grant and Bailey were involved in a

heated argument over his exwife whom he reportedly allowed in their home. The argument escalated and Grant reportedly stabbed Bailey in the ribs. He was rushed to the Georgetown Public Hospital where he underwent emergency surgery.

Defence lawyer Stanley Moore in a bail application told the court that his client

is a clerk and poses no flight risk.

However, an objection to bail was made by Police Prosecutor Simone Payne, who cited the seriousness of the charge.

Magistrate Azore released the mother of seven on $150,000 bail. The case will continue on December 21.

Missing the point…

…on Parliamentary protocols he Speaker and the Clerk – and a host of commentators -- made a big stink about “the Protocols of Parliament” during the Budget Debate.

The Clerk even issued a detailed list of “dos and don’ts” for the Parliamentarians. Nothing wrong with that, your Eyewitness is as peeved as anyone else at MPs eating in Parliament; (painfully) reading their speeches, or not genuflecting to the Speaker when leaving the Chamber etc.

But he’s even more peeved that none of these guardians of Parliamentary propriety is concerned about the trammeling of the more substantive rules with the tacit acceptance of the Speaker. Take the matter of Prime Minister Moses Nagamootoo, who was sworn in to perform the duties of the President when the latter was away in Cuba. The Opposition made cogent arguments, citing the relevant sections of the Constitution, which ineluctably concluded this “squatting” just wasn’t kosher.

They then formally petitioned the Speaker to order Mr Nagamootoo to remove himself from the premises and not participate in the debate. The Speaker duly solemnly PROMISED to give a ruling on the petition. It’s a good thing the Opposition MPs weren’t holding their breaths waiting for the ruling; because, five days down the road, with the final aspect of the Budget – consideration of the Estimates – about to end, nothing’s been said by the Speaker.

And this is what’s so hypocritical about the big brouhaha over some MPs picking their noses in the National Assembly. Sure, it’s gross, but is that the alpha and omega of the “rightness” of Parliamentary behaviour?

All the rules of Parliamentary practices that are intended to facilitate the fundamental values of constitutionalism are adhered to; and the most important is the “rule of law” – that no one is above the law -- and it should be applied without fear or favour.

The Prime Minister, acting for the President, is not above the strictures of the Constitution. There has been one opinion proffered that the PRIME Minister is not a “Minister” and the Constitutional Articles cited by the Opposition refer to “Minister”. This is like saying a Prime number isn’t a number!! Nagamootoo might be a specific type of minister – the PRIME one – but he’s still a Minister who’s been sworn in to act as President.

Now, if the Speaker disagrees with the Opposition’s argument in their petition, he should so state, as he promised. By remaining mute, he’s allowing the matter to become moot, since the debate is going to be over. This is tantamount to ruling in favour of the Government, but without any stated reasons.

By worrying about form, he ignores the substance of Parliamentary procedures, and commits the sin of “ignoratio elenchi”, or missing the point. …on gas for electricity generation This fellow Patterson’s definitely full of gas on the 200MW gas-fired electricity plant he keeps mouthing off about. From the very beginning, Exxon’s been pointing out that our gas will be coming up with the oil – hence “associated gas” -- and will be separated in their Floating Production and Storage Unit (FPSU). They’ve made it clear that it’s in Guyana’s interest to reinject the gas into the field to bring up more oil, rather than using far more expensive specialised “muds”. Since we’re receiving 50% of oil profits, and oil has a far greater selling price than natural gas, it’s in our interest to go along with it.

So, one wonders at the idee fixe of Patterson on his gaseous idea. Did he consider costs? There has to be the power plant; a liquefaction plant to convert and store the gas to LPG, then a regassification plant to supply the gas.

Costing at least US$500M!!

And let’s not even talk about the transmission costs!! …on Constitutional Change Guyanese ought to heed this folk wisdom: “wha rain na full, dew cyaan full”!” when they hear about the Government summoning two meetings of the “Parliamentary Committee on Constitutional Change” in as many weeks, when they only had one in the last YEAR!!

PM’s “squatting” in Parliament

Opposition likely to mount legal challenge – after Speaker refers matter to parliamentary committee

he parliamentary Opposition People’s Progressive Party is not happy with the Speaker’s referral of the legality of Prime Minister Moses Nagamootoo’s presence in the National Assembly while acting as President, to a committee, and are likely to go to court over it.

Speaker of the National Assembly, Dr Barton Scotland announced on the final day of examining the budget estimates that he was referring the matter to a Parliamentary Standing Committee. In his letter to the Opposition, which he read out, Scotland urged both sides to resolve the matter in the Standing Committee on Constitutional Reform.

Scotland also recommended in his letter that no approach be made to the justice system to resolve the matter. But in an interview after the Speaker made his statement, Opposition Chief Whip Gail Teixeira expressed her disappointment with the decision and noted that the Party is left with little choice but to approach the courts.

“I don’t think we have any other choice but to do that. I can’t say when and where and if it’s going to be tomorrow, but I don’t think we have any other choice. The language (of the Constitution) is so clear that if the Speaker is not prepared to just carry out the requirements of the Constitution, then we have to go to the next level.”

“All week you have been asking me have I got an answer (from the Speaker).

And I kept saying, we’re giving him time. We didn’t want to be pushing him and saying in the press, he’s not answering. We were giving him a chance. Well he had all week for his chance. For him to say there’s no proof to do with Prime Minister Sam Hinds means for the whole week, no research was done.”

According to Teixeira, it should have been easy

“And they would have found their proof. Prime Minister Sam Hinds did not come to this house when he was carrying out the functions of President because of these constitutional primers.”

Respect for Parliament

to prove that former Prime Minister Samuel Hinds set a precedent by excusing himself whenever acting as President. She noted that for one, documents to these effects are right at Parliament.

“It would have been very simple. The instruments that swear in a Prime Minister comes here. A copy comes here. All they had to do was go and pick out any time between 1992 and 2015, pull out a couple dates and check the minutes.”

Meanwhile, former Attorney General Anil Nandlall noted that much more is at stake than Nagamootoo. According to Nandlall in a statement on the issue, the respect for a National Assembly that upholds the rule of law without fear or favour is at stake.

“In a letter to the press, I detailed the relevant provisions of the Constitution in support of (our) contention.

No one has since proffered a conflicting opinion. Indeed, former Speaker, Mr Ralph Ramkarran, SC, who once expressed a contrary view, finally concurred with me.

The relevant constitutional provisions were explicitly set out in our letter to the Speaker. After five days, today, the Speaker responded. The response was disap-

Nandlall observed that rather than address the simply issue raised, the Speaker “vacillated for three long pages”. Nandlall noted that the Standing Committee on Constitutional Reform, to which the matter was referred, has a mandate to consider proposals for constitutional reform.

“So rather than ensuring compliance with the Constitution in its current form, the Speaker, apparently, is recommending its

reform,” Nandlall said.

“Our Parliament must be the laughing stock of the Commonwealth. How can the public have respect for our Parliament… and the laws of this land, when the makers of the law are treating the supreme law with such disregard?”

When President David Granger is out of the jurisdiction, Prime Minister Nagamootoo usually leads Government even while acting as President. With the budget estimates being examined and a no-confidence motion scheduled, the parliamentary Opposition finally demanded he vacate his seat until the President returned.

The Prime Minister has consistently defended his presence, saying this only applies for a Minister. The Committee, meanwhile, is chaired by Attorney General

Baby injured as car turns turtle WBD man nabbed with 12lbs ganja in car after slamming into truck

A

t least five persons, including a baby, were rushed to the Diamond Diagnostic Centre on Friday afternoon after the motorcar in which they were travelling reportedly slammed into the back of a truck before turning turtle.

The accident occurred at about 15:40h on the Providence Public Road, East Bank Demerara.

According to eyewitnesses, the truck bearing registration numbers GMM 8660 was heading North along the access road in the inner lane when the motor car PLL 3653 heading in the same direction attempted to switch lanes and swerved into the back of the truck.

The driver of the truck, Omar Bynoe declined to comment on the incident.

Public-spirited citizens pulled several persons from the wreckage, including a baby, and rushed them to

the hospital. Guyana Times was told that the injured persons did not suffer any life-threatening injuries.

Police have since launched an investigation into the accident.

olice in A Division (Georgetown-East Bank Demerara) arrested a 37-year-old man on Thursday evening after several parcels of marijuana were found in the vehicle he was driving.

The discovery was made during an intelligence-led operation, coordinated by a senior officer and conducted by ranks of a Police patrol commanded by a Sergeant.

According to Police reports, at about 20:20h, the ranks intercepted a Toyota Allion motorcar on the Grove Public Road, East Bank Demerara (EBD). They carried out a search of the vehicle, during which 10 sealed parcels of cannabis was found in the trunk.

The prohibited substance weighed and amounted to 12 pounds.

The driver, who hails from Westminster, La Parfaite Harmonie, West Bank Demerara, was taken into custody and is being processed for court.

olice ranks in ‘D’ Division (West Demerara) on Friday morning arrested a man who was found in possession of some electronic appliances that were suspected to be stolen.

According to reports, under the command of Divisional Commander, Senior Superintendent Edmond Cooper, ranks conducted a stop and search operation at the western end of the Demerara Harbour Bridge at about 03:45h.

During the operation, they observed the suspect with a 32” Toshiba flat screen television and a Digital Video Recorder (DVR) player. At the time, he was a passenger inside a taxi which was about to cross the bridge.

GA-FDD to destroy “life threatening” Del Monte corn …after recall issued by company

ne day after the US branded Del Monte Fiesta Corn was exposed, prompting more than 60,000 incompletely sterilized cans to be recalled, the Government Analyst-Food and Drug Department (GAFDD) has assured that these will be destroyed.

In a statement to the media on Friday, the Department said it has, “Since granted approval for the distributor to initiate a voluntary recall of the affected products. All affected products will be destroyed under the supervision of this department at the completion of the recall and detaining exercise”.

It added that it has been in contact with the local distributor of the product.

Toucan Industries has so far imported “204 cases X 12 cans X 15.25 oz or 432g”. Of this amount, 150 cases were distributed nationally, and 54 cases have been placed on hold in the distributor’s warehouse.

Moreover, Guyana Times was told that 408 additional cases of the product were on its way to Guyana. GA-FDD said the distributing company was instructed to notify the Department on arrival of these cases.

It said a central concern with under-processing canned food is the potential

growth of bacteria, including clostridium botulinum, which creates toxins that cause botulism poisoning, according to the Centre for Disease Control and Prevention.

hirty-three-year-old Sawak Maraj, the Trinidadian, who came to Guyana and allegedly faked his own kidnapping was on Friday given permission by Magistrate Fabayo Azore to go home for Christmas with his family in the twin island republic.

The successful application was made by Defence Attorney, Bernard De Santos, who in his submissions to the court said that his client is experiencing financial difficulties in Guyana and is asking to return home to be with his family for the holidays, in order to replenish his money.

Magistrate Daly upheld the prosecution’s submission and remanded the defendant to prison. The case will continue on January 18, 2019.

Govt admits SOCU agents get a “top up” outside of salaries

n Friday, the Public Security Ministry’s contract workers and increases in revised budget estimates were scrutinised by the Opposition. During the proceedings, it was revealed that apart from hiring nine new officers for the Special Organised Crime Unit (SOCU), officers are also paid a “top up” or bonus by the Public Security Ministry outside of their regular salaries.

Making the admission was Public Security Minister Khemraj Ramjattan, on the final day of the Budget Debates.

Opposition Member of Parliament (MP) Juan Edghill had questioned why salaries were being paid under a line item called ‘other’, at which point Ramjattan noted that this was a “top up.”

“I understand that it is not a salary, it is what is called a top up for working at SOCU,” Ramjattan said, adding that it was inherited.

Edghill sought clarity on whether these were already serving members of the Guyana Police Force and Ramjattan noted that some were retirees while others were serving members, though he requested time to lay over the information.

According to Ramjattan, while SOCU is part of the Police Force, these officers are usually versed in financial matters and have expertise. As such, he said a system for incentivising them is required.

“We continued working with this arrangement and

it is an arrangement that attracts certain people with qualifications in finance and a number of officers who had retired. And we have to do that special arrangement; otherwise we’re not going to get good quality. Indeed, SOCU comes under the Police Force.”

Last year, SOCU brought several persons with ties to the parliamentary Opposition to court. In April 2017, former Attorney General Anil Nandlall was arraigned before Georgetown

Magistrate Fabayo Azore on a charge instituted by SOCU, which detailed that between May 15 and May 29, 2015, while being a bailee (custodian), he had converted to his own use and benefit 14 Commonwealth Law Reports, valued at $2.3 million – which he allegedly unlawfully retained after demitting office in 2015.

This is despite both Nandlall and former President Donald Ramotar

affirming that the subscription for the law books was paid for as a condition of his service as Attorney General.

Nandlall’s ownership of the books was also recognised by the High Court when it granted an order prohibiting SOCU from carrying out searches and seizing the law books.

The following month, People’s Progressive Party/ Civic (PPP/C) Members of Parliament Dharamkumar Seeraj and Nigel Dharamlall; former Deputy General Manager of the Guyana Rice Development Board (GRDB), Ricky Ramraj; former GRDB General Manager Jagnarine Singh; former GRDB Board member Badrie Persaud; and former Deputy Permanent Secretary (Finance) of the Agriculture Ministry, Prema Roopnarine, were before the Georgetown Magistrates’ Courts to answer several charges of fraudulent omission.

The charges were indictable, laid in relation to the operations of the GRDB between the years 2011 and 2015. They came one day after the officials had been summoned by SOCU for questioning. Police hunting Chinese national in hit-and-run accident

lmost one week after striking two teenage boys, killing one, and failing to render assistance, the driver of minibus GWW 2140 is still in the run.

Traffic Chief Linden Isles has confirmed that the Police is currently hunting a known suspect involved in the fatal hit-and-run, which occurred at Annandale, East Coast Demerara (ECD) on Sunday last.

Isles told Guyana Times that the identity of the man – a Chinese national – was revealed after the minibus involved in the accident, GWW 2140, was discovered hidden in a bond at Mon Repos, ECD, on Thursday afternoon.

The silver Pitbull was found covered with a tarpaulin, he noted, adding that after an inspection was done, the vehicle was confiscated.

New public servants warned against using office for private gain N

ew recruits of the Public Service College were warned against using the public office for private gain and encouraged to take steps to curb any instances of misappropriation of office that they may encounter during their training.

This warning was issued at Friday’s graduation ceremony where Senior Director of the Bertram Collins College of the Public Service (BCCPS), Colonel Lawrence Paul cautioned the new recruits. The ceremony was held for the second batch of young cadets which saw 60 new recruits entering the Public service system.

Colonel Paul charged the cadets to learn all that they can so that they can help to transform the public service into a professional institution, which will serve the citizenry.

Apart from content, we will be working on your attitudes, behaviours, and values system and to understand the importance of these things and what is corruption and bribery. You will be the change in the delivery of public service in Guyana. You will be the carriers of change,” Somersall noted.

The award for exemplary conduct went to Audlie Waterton, while best attendance went to Cassandra DeFlorimonte, Lorean Harris, Maurissa McCalmon, Diane Manawar and Audlie Waterton.

The most improved student for 2018 was Maurissa McCalmon.

New online payment system launched way to Guyana.

Nobel laureate Murad to build hospital in her hometown in Iraq

adia Murad, an Iraqi Yazidi woman held as a sex slave by Islamic State militants who won this year’s Nobel Peace Prize, said on Friday she intended to use the prize money to build a hospital for victims of sexual abuse in her hometown.

The Yazidi survivor was speaking to a crowd of hundreds in Sinjar, her hometown in northern Iraq.

“With the money I got from the Nobel Peace prize, I will build a hospital in Sinjar to treat ill people, mainly widows and women who were exposed to sexual abuses by Islamic State militants,” she told the crowd and gathered journalists.

She thanked the Iraqi and Kurdistan governments for agreeing to her plan and said she would be contacting humanitarian organisations “soon” to start construction.

The students, journeying from Guyana, Jamaica, Trinidad and Tobago, St Kitts and Nevis, Antigua and Barbuda and Grenada, were praised during the Caribbean Examination Council’s (CXC’s) presentation of awards for outstanding performances in the May/June 2018 examinations.

The Caribbean Secondary Education Certificate’s (CSEC’s) most outstanding candidate overall was Keondre Herbert of the St Joseph’s Academy, Antigua and Barbuda.

Keondre achieved Grade One passes in 20 subjects.

The most outstanding CSEC candidate in sciences was Daniel Baldeo-Thorne of Queen’s College, Guyana.

He had 13 Grade Ones and two Grade Twos.

Rebekah Persaud of St Rose’s High School, also in Guyana, won the award for Most Outstanding CSEC Candidate in Business Education with nine Grade Ones, two Grade Twos and one Grade Three.

Salma Majeed of ISA Islamic School, Guyana copped the award for the Most Outstanding CSEC Candidate in Humanities with 18 Grade Ones.

Kae-Shanae Virgo of Montego Bay High School, Jamaica won the Best Short Story award in the English A examination with a story entitled “Betrayal.” Two other Jamaican students copped the Visual Arts awards.

Brazilian Judge on Friday issued an arrest warrant for a famed Brazilian faith healer who has been accused of sexual abuses by more than 200 women in what prosecutors say could be the worst serial sex crimes case in the country’s history, authorities said.

João Teixeira de Faria, known as “John of God”, became a celebrity when Oprah Winfrey broadcast a report of his healing methods in 2013.

He drew thousands of Brazilians and foreigners to the spiritual centre he has led since 1976 in Abadiania, a small town in the central Brazilian state of Goias where a court authorised his arrest.

State prosecutors told Reuters they have taken statements from more than

30 women who say they were sexually abused or assaulted while seeking spiritual guidance or psychic healing from him.

“More than 230 women have contacted us by email and another 50 by telephone,” said prosecutor Luciano Miranda. “If their stories are proven, this will be the worst sex crime case that Brazil has had.”

The alleged victims include women from the United States, Germany, Belgium, Switzerland and Bolivia, he said.

Faria denied the accusations on Thursday when he visited his centre and spoke to a crowd of followers. He said he would comply with the law.

Faria, 76, could face charges of rape, with a prison sentence of 10 years if convicted, and rape of a vul-

nerable person, which carries a sentence of up to 15 years.

Dutch choreographer Zahira Maus on a TV Globo programme on Friday alleged Faria sexually assaulted her. Globo TV spent three months investigating the story and interviewed a dozen other women who said they had been abused by the healer.

His fame has been boosted by supposedly miraculous surgeries he claims to have performed with his hands and without anesthesia.

Winfrey said in a statement that she visited Faria’s centre in 2012 to explore his controversial healing methods for an programme that aired the following year.

Hope for 'decent' climate talks outcome T he likelihood of a deal at global climate talks in Poland has increased after a new draft text was released.

The outline decision contains plans for a common rulebook for all countries, with flexibility for poorer nations.

There are also calls for all countries to increase their carbon cutting commitments by 2020.

But many issues are not yet settled and negotiators were preparing to work well past the official close of the conference on Friday evening.

Most ministers here believe the strength or weakness of the final outcome is still in the balance. Among the key issues not yet decided is the question of loss and damage.

This issue has bedevilled climate negotiations for many years as developing countries seek recognition and compensation for the damages caused by rising temperatures.

The idea of being legally liable for causing climate change has long been rejected by richer nations, who fear huge bills well into the future.

At these talks, the question of loss and damage only features as a footnote in the text at present, something that has irritated developing countries.

But many observers believed that overall, some progress is being made.

"It was never going to be great, not least because the US is playing a laggard role, but I think we can get a decent outcome, if it's framed in the right way," said Alden Meyer from the Union of Concerned Scientists.

Earlier, the former president of the Maldives, and now their lead negotiator, Mohamed Nasheed, made an impassioned plea for urgent progress on cutting carbon.

"It's just madness for us to allow global CO2 levels (in the atmosphere) to go beyond 450 parts per million, and temperatures to shoot past 1.5 degrees," he told a press briefing

on Thursday.

"That can still be prevented. If we come together on the basis of the emergency facing us, we can do it.

"Every country at this summit will have hell to pay if we don't."

What are the delegates trying to decide?

Representatives from 196 states are here trying to sort out some very tricky questions pertaining to the rulebook of the Paris agreement which comes into force in 2020.

These are the regulations that will govern the nuts and bolts of how countries cut carbon, provide finance to poorer nations and ensure that everyone is doing what they say they are doing.

It sounds easy but it is very technical. At the moment countries often have different definitions and timetables for their carbon cutting actions.

However some progress is being seen in shaping the rules.

"Some of the text that is key to the rulebook, in terms of the transparency of countries reporting their mitigating actions are pretty strong.

It is better than it was a week ago," said one senior negotiator.

But there are significant holdups. Poorer countries want some "flexibility" in the rules so that they are not overwhelmed with regulations that they don't have the capacity to put into practice.

"The rulebook right now hangs in the balance, because

you need all countries on board and you need to support developing countries," said Jennifer Morgan from Greenpeace.

"Flexibility can mean a lot of things and I think some countries are using that word to delay having to implement rules, and others are worried because they don't have the capacity to do it, when you don't have a clear signal from developed countries that they are going to provide that support it just brings a lot of uncertainty."

As well as the rulebook, what else needs to be decided?

There's a strong push to recognise the science of the IPCC, which earlier this year produced a critical report on how the world would be impacted by temperatures rising by 1.5C this century.

The decision to welcome this report was rejected amid controversy earlier in the conference when Saudi Arabia, the US, Kuwait and Russia wanted to just take note of the report.

When consensus couldn't be found, the text about the IPCC was dropped - much to the surprise of a majority of countries. There is a determination here to ensure that at the end of this meeting a "COP decision" will recognise the IPCC. "There are 196 countries in the UN and 192 counties agree," said Mohamed Nasheed. The girl vomited and stopped breathing in the custody of US Customs and Border Protection (CBP) before being transferred to a hospital, where she suffered brain swelling and cardiac arrest, according to CBP. The CBP commissioner, Kevin McAleenan, identified the girl as Jakelin Caal Maquin. The girl and her father, both from Guatemala, were traveling in a group of 163 people, including 50 children who were traveling without a parent, when they were apprehended at around 21:15h on December

6, 2018.

Four border patrol agents were on the scene, according to CBP and Department of Homeland Security (DHS) officials, who said it was not unusual for a small group of agents to confront large groups of migrants.

The agents conducted a screening that included a health observation. Her father indicated his daughter was healthy on a form officials said was in English but would have been marked according to a Spanish interview with the father.

They were held in a small facility near the border before being transferred by bus to a border patrol station 95 miles away. At that facility, officials said people had access to food, water and restrooms.

Officials said later that morning Jakelin went into

Vendors help Cops foil abduction, robbery in T&T

quick response from members of the public helped Police arrest three men who had abducted a 71-year-old Port of Spain businessman they planned to rob on Thursday night.

Police said they received calls around 21:00h after witnesses saw two men accost the owner of Samuel’s Jewellery Store, which is located on Charlotte Street, after he had locked up his business and went to a George

Street carpark where his car was parked.

As the man was about the get into his vehicle he was approached by two men, one of the armed with a gun, who took the keys to his business before bundling him into his car and driving off. The driver stopped a short distance away and gave the keys to the man’s business to another suspect. The first two suspects then left the scene with the businessman.

But street vendors who had seen what happened called the Police and Port of Spain City Police and Port of Spain CID responded to the scene. After getting information from eyewitnesses, police put out an allpoints bulletin was put out for the vehicle. The MultiOperational Task Force led

Prime Minister Dean Barrow told the leaders from the seven countries that form the Central American Integrated System (SICA) conference that it was necessary for there to be greater collaboration or face the prospect of “hanging separately”.

He said migration for example had been a major talking point in the region as citizens from the Central America move towards in a bid to secure a better way of life and escape the criminal gang violence.

“Many of our citizens have been seeking under the most onerous conditions to go north in search of security or economic opportunities or both.

“I should underscore that large scale migration is neither unique to this moment

in history nor to our region. Nevertheless, the current flows and the response they have engendered are huge stressors of both the international human rights framework and hemispheric geopolitical relations,” Barrow said.

He told the summit that crime and violence remains another regional problem and “it is one of the obvious push factors propelling the Central American to migrate.

Barrow said as a result, in the most affected communities “citizens are forced to make the Hobson choice of uprooting and fleeing the dangers terrorising the only homes they have ever known, only to have to brave that incredibly perilous journey northwards to seek a more secure future”.

The Belize Prime Minister said it was therefore imperative for the Central American countries to come collaborate much more “if we are to provide citizen safety conditions for our peoples”. (Excerpt from St Lucia News

enezuela’s El Nacional newspaper, which has been heavily critical of the ruling Socialist Party, on Friday published its last print edition after struggling for years under Government pressure and a collapsing economy.

The paper, which is transitioning to a web format, has found it increasingly difficult to obtain newsprint due to exchange controls that make imports nearly impossible, and has potentially massive payments in a defamation lawsuit brought by Socialist Party No 2 Diosdado Cabello.

“I want to think that this is a pause,” said the editor-in-chief of the newspaper, Patricia Spadaro, at a press conference in the paper’s empty offices.

El Nacional said it will resume its print edition “when the country returns to democracy,” a reference to growing global criticism that President Nicolás Maduro has created a dictatorship.

aribbean Community (Caricom) Secretary General Irwin LaRocque met on Wednesday with Prime Minister of Aruba, Evelyn Wever-Croes, on associate membership in the Community for the Dutch territory. The secretary-general will also visit Curacao and St Maarten this week.

Caricom heads of government earlier this year mandated the secretary-general

to begin the process of negotiations with the Dutch territories in order to better determine their expectations of associate membership, and what benefits the relationship could yield for the Community.

The heads of government have also agreed to continue to examine the issue of an enlargement policy for Caricom, which currently has 15 full members and five associate members.

Antigua PM invites Scotiabank to meet with banks interested in purchasing local operations

rime Minister Gaston Browne has invited officials of Scotiabank to a January 7, 2019 meeting to discuss the purchase of the bank’s branch holdings in Antigua and Barbuda.

The invitation is contained in a letter sent yesterday

by Browne to Scotiabank’s branch manager in Antigua, Suzan Snaggs-Wilson. It was

dispatched 17 days after the bank announced that it plans to sell its banking operations in Antigua and Barbuda, Anguilla, Dominica, Grenada, Guyana, St Kitts and Nevis, St Lucia, St Maarten, and St Vincent and the Grenadines – to Trinidadian banking conglomerate Republic Financial Holdings Limited (RFHL), for US$123 million.

Prime Minister Browne has taken the position that his government will not give the vesting order to facilitate the bank’s divestment unless a consortium of local banks is given the first right of refusal to acquire the bank’s operations.

And in his letter, he said that the proposed meeting would be between high of-

ficials of the Bank of Nova Scotia and representatives of a “consortium comprising the Government, local banks and other qualified and competent local institutions” desirous of purchasing Scotiabank’s branch holdings in Antigua.

Explaining the Government’s position to the Bank of Nova Scotia, he added: “The Government of

Antigua and Barbuda makes it clear that its primary concern is to build resilience in the local banking sector and reduce its vulnerability to de-risking strategies employed by foreign owned entities that weaken our national capacity to participate in the global financial and trading system effectively. Shakira charged with tax evasion in Spain

panish prosecutors have charged the Colombian singer and philanthropist Shakira with tax evasion, alleging she avoided €14.5 million (£13 million) in taxes by claiming to live in the Bahamas while actually resident in Catalonia.

Shakira changed residences in 2015 from The Bahamas to Barcelona, where she lives with her partner, the Barcelona footballer Gerard Piqué, and the couple’s two sons.

But prosecutors allege that she was already living in the Catalan capital between 2012 and

2014, and should have paid tax on her worldwide income for those years in Spain.

They argue she was resident in Spain for most of the year, only travelling abroad for short periods. A Judge will decide whether there is enough evidence to put Shakira on trial.

Shakira’s representatives told the Associated Press they had no immediate comment to make. The decision comes 11 months after Spanish judicial authorities announced an investigation into the singer’s tax status.

Last year, Shakira appeared in the Paradise Papers, an investigation by the Guardian and other news organisations into the world of offshore finance. According to the papers, she was listed as a resident of The Bahamas despite living in Barcelona.

Asked at the time about Shakira’s listed residence in The Bahamas, her lawyer said the artist had lived in a variety of places “throughout her professional career and, in every case, has fully met the laws of all the jurisdictions where she has resided”.

UN alarmed by Congo violence as Government steps up election security

he United Nations (UN) human rights chief on Friday called on Congolese authorities to halt violence and inflammatory speech ahead of the country’s December 23 presidential election, while the government said it was beefing up security for the vote.

Campaigning for the long-delayed poll to choose President Joseph Kabila’s successor had been mostly peaceful until this week, when security forces opened fire to disperse opposition gatherings and a fire in the capital Kinshasa destroyed thousands of voting machines and ballot boxes.

The vote could mark Democratic Republic of Congo’s first democratic transfer of power, but the violence and chaotic preparations have raised fears of a repeat of the trouble that marred the 2006 and 2011 polls.

“In an already tense electoral environment, I urge the government to send a clear signal that threats and violence against political opponents will not be tolerated,” UN human rights chief Michelle Bachelet said in a statement.

In a news conference, government spokesman Lambert Mende said the

government was reinforcing security, without giving details. He suggested opposition leaders were responsible for the latest violence.

The election to replace the term-limited Kabila was supposed to take place in 2016 but was repeatedly delayed, sparking demonstrations in which security forces killed dozens of protesters.

Over those two years, security has broken down across much of the vast country, particularly its volatile eastern borderlands with Rwanda and Uganda, where dozens of militia groups are active. (Excerpt from Reuters)

13 young miners feared dead in India's remote North-east

hirteen young miners were missing and feared dead following the collapse of a shaft and flooding of a coal mine they were digging illegally in India's remote northeast, Police said Friday.

Rescuers were attempting to pump water out of the mine, which flooded Wednesday, Police said.

National Disaster Response Force workers joined local authorities in the rescue effort.

Police said rescuers can only reach the miners after the water is removed from the mine. Those missing are believed to be teenage boys used by illegal mining groups to enter "rat hole'" mines with small openings.

They said digging at the mine was banned four years ago, but illegal and unsafe activity by private landowners and the local community is rife. The area in Meghalaya state is about 130 kilometers (80 miles) North of Shillong, the state

Johnson & Johnson shares drop after asbestos report

hares in Johnson & Johnson plunged more than 10 per cent on Friday, after Reuters reported that the US pharmaceutical giant had known about asbestos tainting its talcum powder for decades.

The report comes as the company faces thousands of lawsuits claiming that its talc products caused cancer. Reuters' review of documents found the company was aware of trace amounts of asbestos since at least 1971.

Attorney Peter Bicks told Reuters in an email, "The scientific consensus is that the talc used in talc-based body powders does not cause cancer, regardless of what is in that talc.

"This is true even if – and it does not – Johnson & Johnson's cosmetic talc had ever contained minute, undetectable amounts of asbestos."

Internal tests

Reuters reviewed Johnson & Johnson docu-

ments produced as part of the trials, many of which had been shielded from view by court orders. The documents revealed that from at least 1971 to the early 2000s the firm's internal tests sometimes found small amounts of asbestos in its raw talc and finished powders.

Most of the firm's tests did not find asbestos, and it did not disclose the tests that did to regulators, Reuters found.

Bicks said the tests cited

by Reuters article were "outlier" results. In court, the

firm has argued that some of the documents referred to industrial talc products.

The investor reaction wiped 10 per cent off the firm's market value at one point, making it the biggest loser on the Dow. Legal cases against Johnson & Johnson have had mixed results.

ontrasting half-centuries from local boy Marcus Harris, Aaron Finch and Travis Head helped Australia overcome a mini-collapse of 4 for 36 and made India feel the heat - both literally and figuratively - on a 39-degree day at the new Perth Stadium.

Despite the late dismissals of Shaun Marsh (45) and Head (58) on a pitch where one ball exploded and the next rolled at shin height, Australia progressed to 6 for 277 at stumps on day one.

After India went into a Test without a frontline spinner for only the third time in their history, Harris and Finch, perhaps, made them rue the decision by putting on a 112-run opening stand. Although part-time

However, three overs before the second new ball was due, Marsh chased a wide offbreak from Vihari and sent a thick outside edge flying to Ajinkya Rahane for a chesthigh grab at first slip.

Head pressed on to follow his first-innings 72 in Adelaide with an equally vital fifty here. However, he threw his wicket away when he went after a wide ball from Ishant and carved it to third man in the 83rd over.

ocky Fielding says he will relish the chance to upset the odds and silence doubters when he takes on Saul 'Canelo' Alvarez at a venue he could once only dream of competing in.

The Briton, 31, faces Alvarez at New York's Madison

Square Garden in the early hours of Sunday and BBC Sport's pundits believe only a lack of focus from the formidable Mexican can offer Fielding hope.

Fielding will put his minor version of the WBA world super-middleweight title on the

line against the highest-paid fighter in boxing in a contest which shocked the sport - and the Liverpudlian - when it was announced.

"He doesn't make many mistakes but it's boxing. He could make one and I could get to him," said Fielding.

"I was here three years ago, sitting high up watching the New York Knicks, dreaming one day of fighting here. I have put so much work in, had setbacks and kept positive - and here I am with my name all around the arena."

Alvarez - beaten once in 53 bouts - starts as 1-20 favourite for a contest which will be covered in a live text commentary on the BBC Sport website from about 02:00 GMT on Sunday.

This is an unbelievable chance for Rocky Fielding, who owns the minor version of the WBA title, with the main version held by Callum Smith.

You get the sense that all Fielding can hope for is a lack of motivation or focus, that Canelo has greatly underestimated him.

Some of the greatest upsets in boxing history have needed the under-estimation factor with someone in one corner who gets it wrong. It has happened before. Rocky needs a bit of luck but he wouldn't be the

first.

When asked if the fight could be billed as 'Canelo v Rocky' rather than feature his surname, Fielding simply replied: "Sound, do what you want."

Likewise he chose not to complain at the fact his name did not come first on the billing, as is the norm for a champion. Both instances point to the focus and hype attached to Alvarez, who returned from a six-month doping ban to earn a win against Gennady Golovkin in September which highlighted his vast skill set.

Indeed, Fielding's promoter Eddie Hearn has even spoken of his disgust at some of the social media abuse his fighter has received from those who believe he has no chance against a 28-year-old who has only ever been beaten by Floyd Mayweather.

Alvarez, who has knocked out the likes of Britain's Amir Khan and Liam Smith, will move up to the 168lbs su-

per-middleweight division for the first time. And he faces some pressure in the first outing since signing a remarkable $365m five-year fight deal which his promoters say makes him the highest paid athlete in all of sport.

"This new phase in my career I'm happy and motivated," said Alvarez, who still holds two of the four world titles in the 160lbs middleweight division. "I like the challenge and know we are going to make history."

A win - albeit for a minor world belt - would see him become a three-weight world champion, a prospect he has spoken of fondly. It would bolster his hopes of one day being viewed among the finest fighters to come out of a country steeped in boxing history.

wo more corporate partners have committed to the successful execution of the GFFExxonMobil International Futsal Festival scheduled for December 27- 30 at the Cliff Anderson Sports Hall.

The four-day festival will kick off with six matches being played between the period 18:00hrs and 00:00hrs, with each match being played on the hour, culminating with the final match at 23:00hrs.

The teams, which include Morvant Caledonia United from Trinidad and Tobago, ZV AllStars from Suriname, and a São Paulo selection from Brazil, will be placed in two groups.

The local teams participating are an East Coast All-Stars, Linden All-Stars, Georgetown All-Stars and West Demerara All-Stars.

The winning team will pocket $1.2 million, while the losing finalist will receive half that amount. Third and fourth-placed finishers will pocket $300,000 and $100,000 respectively.

US Senate panel asks FBI to probe US Olympic chief A

former head of the U.S. Olympic Committee made “materially false statements” to a U.S. Senate subcommittee investigating sexual abuse in gymnastics, the panel said on Friday, and it said it would refer the matter to the FBI. In a joint statement, Republican Senator Jerry Moran, chairman of the Senate subcommittee on commerce, and Senator Richard Blumenthal, its Democratic ranking member, said they made the referral detailing potential violations of the law against Olympic Committee CEO Scott Blackmun.

The move comes after a report released on Monday said the United States Olympics Committee (USOC) failed to protect athletes from the threat of sexual abuse, with some executives taking no actions following allegations of sexual abuse against Larry Nassar, a team doctor for USA Gymnastics.

Nassar was sentenced to up to 300 years in prison in two different trials last winter after more than 350 women testified about abuse at his hands. The witnesses included Olympic champions Aly Raisman and Jordyn

Wieber.

“It appears Mr. Blackmun has made false claims and misled our subcommittee – harming the investigation and our ability to develop policy,” Moran and Blumenthal said in the statement.

“Survivors of abuse have had to wait longer for the truth and longer for systemic changes to help prevent others from similar injury.”

In a June 5 statement to the subcommittee, which oversees the USOC, Blackmun wrote that when he heard of allegations

against Nassar through a July 2015 phone call from then-USA Gymnastics CEO Steve Penny, he spoke to the USOC’s “SafeSport staff,” the statement said.

SafeSport oversees abuse claims in Olympic sports.

But the Monday report by law firm Ropes & Gray found that after hearing about the allegations against Nassar, Blackmun did not inform anyone else at the USOC of the allegations.

The report said dozens of girls and young women were abused during the yearlong period between the allegations surfacing in mid2015 and September 2016 when the Nassar story broke. Nassar was arrested two months later. (Reuters)

Are “chess engines” killing originality; or has learning advanced?

T

he world is advancing every day, thus individuals are finding various methods to improve their chess game, such as “chess engines”.

Many persons hold different views on this topic, the predominant positive view being that engines are a form of improvement to the game, while the negative counterpart view is that engines are the killer of all originality in the game.

Many chess players have

shared the view that engines, at a certain level, are destroying the human cognitive process of figuring out moves by themselves over the board, mostly in regard to their opening moves.

Programmes such as Houdini and Rybka can trash any chess grandmaster in a simple chess match, even current World Chess Champion Magnus Carlsen, since the ELO ratings on such programmes are 500 more than that of the highest rated human; thus proving that modern day chess players, espe-

cially at highest level of the game, lack originality, and just seem to consult chess engines for new ideas to beat their fellow human competitors.

They execute their plans by memorising those lines, and the one with the best memory wins; unlike in olden times, when players tried new things over the board and used their skills and originality to win games. Therefore, regardless of the use of engines, the computer should really take credit for the victory, as the competitors are now

self-dependent on the engines and can’t use their brain power.

Some would disagree with this reasoning because they believe that using engines is just an advanced form of learning compared to the olden days. Yes, engines have definitely raised the quality of players' home preparation, as engines have been proven to do a lot of heavy lifting; but the engines are still just tools that strong players use to aid their creative opening endeavours.

The same is true of prepa-

ration in eras aided only by books and periodicals. Then, too, games were sometimes won simply from superior opening preparation. The world is currently in its technological state, and the use of chess engines now can be seen as the resort to books and periodicals in olden days.

At the end of the day, whatever moves are plugged into the system, the option is always given to the player, as they would be the ones who would have to choose what moves they should make.

Softball cricket rising to the occasion – Ramsingh calls for more awareness

any successful softball tournaments have taken place across the length and breadth of Guyana in 2018. Among those are the Prime Minister’s Cup and the Guyana Softball Cup 8, which offered competing teams lucrative cash prizes of $500,000 and above.

Guyana Times Sport asked media personality John Ramsingh his opinion on the growth of Softball cricket; and he had this to say, “Softball cricket will always have a place on the sporting circuit. It is really

the first form of cricket we are exposed to as soon as we begin to walk. It is the first choice in many areas, and as such it is very popular. The popularity is boosted, since it's inexpensive to play. All we need is a ball and anything that resembles a bat.

“Other forms of cricket require gear. The love of softball cricket has seen it taking on an international flare. In fact, in Florida, the finals of the marquee tournaments are played at the international cricket venue, the Central Broward Regional Park”.

Ramsingh went on to state that the popularity of the sport has grown so much that teams from Canada, various parts of USA and Guyana have four tournaments annually. He was referring to the Orlando Cup, Fort Lauderhill Cup, New York Cup and Canadian Cup; 1 each in Guyana and Canada and 1each in New York and Florida.

According to Ramsingh, one of the main reasons why softball draws such a large crowd is mainly because of the overall prize monies.

Involved with the sport,

Ramsingh disclosed that there is usually TV coverage and live ball-by-ball commentary via a public address system; but to bring more awareness, he would like to see more matches displayed on television more often.

Salah named BBC African Footballer of the Year 2018 E gypt and Liverpool forward Mohamed Salah has been voted BBC African Footballer of the Year for the second time in a row.

The 26-year-old beat Medhi Benatia, Kalidou Koulibaly, Sadio Mane and Thomas Partey to the prize.

The Premier League's player of the year scored 44 goals in 52 games for Liverpool last season.

"It's a great feeling to win again. I'm happy and I would like to win it also next year!" said Salah.

As well as inspiring his club to the Champions League final, Salah scored twice for Egypt at this year's World Cup, having netted both goals in the match which took his country to the tournament for the first time since 1990.

"There have been many good moments in 2018,"

he added. "The game against Roma at Anfield [Champions League semi-final first leg] was unbelievable. I'm scoring goals and helping the team to get the points to be top of the league. That's always a great feeling."

Salah said his aim for 2019 is "to win something with the club so everyone is excited".

"I try to push myself every day to help the team win something," he added.

The BBC received more than 650,000 votes this year - a record for the award.

Salah becomes the first player since Nigerian JayJay Okocha to win in consecutive years.

The former Chelsea player signed for the Reds from Roma in the summer of 2017. He scored 15 goals and made 11 others for the Italian side in 2016-17 as

they finished second in Serie A, their best league placing for seven years.

In a phenomenal start to his Liverpool career, Salah scored 19 goals in his first 24 appearances. He went on to beat the previous record of 31 goals in a 38-game Premier League season shared by Luis Suarez for the Reds in 201314, Cristiano Ronaldo for Manchester United in 2 0 0 7 - 0 8 and Alan Shearer for Newcastle in 1995-96.

Mehidy, Soumya, Tamim give Bangladesh series win

oumya Sarkar and Tamim Iqbal chose the scenic route to Bangladesh's eight-wicket win over West Indies in Sylhet to clinch the threematch ODI series 2-1.

Soumya's attacking 80 was complemented by Tamim's unbeaten 81, which came after Mehidy Hasan dipped his offbreaks to perfection in a career-best bowling performance.

It was Bangladesh's eighth bilateral series win (out of 12) since the 2015 World Cup, with two of those now coming against West Indies this year. Shai Hope's unbeaten century was West Indies' only moment of happiness as the visitors lost both Tests and ODI series in Bangladesh, a first for any major side touring the country.

Bangladesh first sparked

a batting collapse during the middle overs as West Indies lost three wickets for three runs in 22 balls. They slipped from 96 for 2 in the 23rd over to 99 for 5 in the 26th. Hope, who made an unbeaten 108 playing the full 50 overs, had to rely on the lower order to reach his fourth ODI hundred, but it was hardly going to take the control out of Bangladesh's grip.

Tamim then did what an experienced batsman should do in a 199 chase.

He batted sensibly, while Liton Das and Soumya blasted the bowlers at the other end. At times, Tamim too drove down the ground and flicked off his pads for fours but he largely focused on collecting singles.

Liton's punches through cover and mid-off fetched him four of his five fours.

But his impulsive strokeplay - this time a swipe across the line that was caught at mid-on - cut short his stay at the crease, for a 33-ball 23.

Soumya, who had started off with a sublime ondrive off Keemo Paul, was otherwise devastating against spin. He lifted Marlon Samuels, Fabien Allen and Devendra Bishoo for five sixes.

Samuels was hit over midwicket and long-off, while the two off Allen were sent high over the midwicket boundary. In the 34th over of the innings, he launched Bishoo over cover for his fifth six, before striking him for two fours to finish off the over. Paul eventually got him for an 81-ball 80, ending the 131-run second-wicket stand.

Ravens clinch First Division title – Guardians beat Kobras to take third place

he Rainforest Water/Malta Supreme/ Georgetown Amateur Basketball Association (GABA) League culminated its First Division leg of the tournament on Thursday night with the Ravens sinking the Pacesetters by eight points to claim the championship.

Ravens looked confident on the court with a good season’s performance in the bag, having won seven of their eight games in the preliminary stages compared to the Pacesetters’ winning six games; and they expectedly closed it out in the final-four showdown by romping to a convincing 83-75 win over their opposition at the final buzzer.

The match was a see-saw battle in the opening quarter, with scores being level at 19 going into the second quarter. Both teams looked for consistent scoring to try

take the lead, but the eventual victors got acclimatised and thereafter asserted their dominance. At the half, Ravens were leading 42-31.

It was more of the same in the third quarter, with Ravens comfortably outscoring the Pacesetters 25-14, which saw the final quarter starting at 67- 45.

Sensing victory in the air, Ravens eased off the gas pedal and held their form to complete the win.

Third place playoff saw the Guardians defeating the Kobras 68-60.

Ravens now joins the list of division victors for the 2018 edition of the tournament, following the UG Trojans’ triumph in the Under 23 division and the Guardians’ winning the title in the Second Division league.

scored a painstaking 29 from 156 balls. He was trapped in front by leg-spinner Damion Jacobs, the Hurricanes proving that the strength of their team lies in the bowling department.

With the score on 1284 after 54.6 overs, Singh was partnered by seasoned all-rounder Christopher Barnwell, and the Jaguars’ scoring rate moved onwards.

Barnwell was the most attacking batsman of the day, his savagery causing Hurricanes captain Devon Thomas to spread the field.

Singh and Barnwell added 69 runs before Barnwell was dismissed for a 61-ball 46, hitting three boundaries and one six. In the context of the game, his innings was invaluable to the Jaguars after their top order had failed.

In the process, Singh held things together, bringing up his second half-century in as many matches. Anthony Bramble entered the fray with the score on 197-5 to ensure the Jaguars lose no other wicket at stumps.

Bramble, who scored his maiden century against this same opposition, looked tentative in his stroke-play, failing to time the cricket ball sweetly.

No further hiccups occurred, as the day, which began with an early delay, ended with the beautiful sunshine beating a dignified retreat from Antigua. Singh ended on a composed 68 from 157 balls, hitting seven

boundaries; while Bramble is on 11.

Rahkeem Cornwall was the Hurricanes most successful bowler, ending day two with 2-39 from 16 overs, including two maidens, while Damion Jacobs and Elvin Beeridge has one wicket each. The third day of play in Antigua will commence from 10:00h Eastern Caribbean time.

Players, organisers and sponsors excited at KFC Goodwill Tournament

n the eve of today’s kick-off of the KFC Goodwill Football tournament, stakeholders who are making The Petra Organization’s vision a reality gathered to have a final interaction.

At a press conference held after that interaction, Co-Director of Petra, Troy Mendonca, shared his expectations for this year’s competition.

“We also think that a tournament of this nature (does) well for our school programme and football on the whole: for us to measure where we’re at; compare and see areas where we can improve, and have an idea of where to go in terms of our development programme,” Mendonca explained.

Four teams will be involved in three days of gruelling action when the KFC Goodwill tournament is kicked off at the Ministry of Education Ground from 5pm today.

Mendonca, in sharing his hopes for the future of this Goodwill tournament, hinted at inclusion of other regional teams.

“We hope to make this an annual event. We hope that, come next year and the other years, we see this tournament develop

from strength to strength.

Hopefully, come next year, we’re able to invite another country. We hope that we (can) put together a select squad along with the first and second, and we will continue to extend an invitation to the champion team in the Rupununi region.”

The tournament’s sponsors: KFC; ANSA McAL, under their Smalta and iCool water brands; and Caribbean Airlines, all expressed hope that the tournament would be successful and beneficial to the participants.

KFC’s Wendy Fernandes also shared the company’s

expectations for the tournament, whilst pledging its continued commitment to the competition.

“KFC, in our commitment to sport and developing our Guyanese reputation as producing world-class champions, has invested substantially to make the event the most successful. We are confident that the series of matches will be an exciting exhibition of skills and competition that will result in a thrilling experience for all football fans,” she said.

ANSA McAL’s Errol Nelson also declared that company’s continued com-

mitment to the sport. “I would like to let the members of the football fraternity know that for many years ANSA McAL has supported the development of football in Guyana, and…rest assured…we will continue to be heavily involved for many more years to come,” he explained.

Caribbean Airlines’ representative, Dion Inniss, highlighted the possibility of including other regional teams in staging this tournament in years to come.

“I think when we look back in future we can safely say this Goodwill tournament will be the begin-

ning of a regional school tournament, and The Petra Organisation would obviously have to take credit for that. And if that’s the case, Caribbean Airlines would obviously be shouldering with you to ensure that it’s a reality,” he declared.

A representative each from Annai and Annandale Secondary schools was present, and both young men expressed excitement at being a part of the impending tournament.

“I’m very happy to know that my team placed first in the Guyoil tournament, and have been promoted to this tournament. I’d like to

say thanks to the coach and organisers. I’m happy that we’re coming against the top teams to showcase our talents and play very competitive football,” Jerome Harrigon of Annandale Secondary said.

Orville Daniels of Annai Secondary noted that his team members have their sights set on winning.

“I’m happy to be here as the captain. I know we travelled a far distance, and we’ll do our best in this tournament. Hopefully, after all three games, (we’d have done) our best to win,” he declared.

On the first day of play, today, the visiting Shiva Boys will take on Annai Secondary at 5pm, while Christianburg-Wismar will take on Annandale Secondary at 7pm. The second day of competition (December 18) will see Christianburg-Wismar battling Annai at 5pm, and Shiva Boys coming up against Annandale Secondary at 7pm.

The final day of KFC Goodwill action will be on Saturday, December 22, when Annai Secondary will face off with Annandale Secondary, while Shiva Boys engage Linden’s Christianburg-Wismar Secondary.
