In face of bad oil deal, Guyana should at least protect its environment
…new legal challenge highlights citizens' growing concerns - IEEFA

With another court challenge filed, this time againsttherecentissuanceof theenvironmentalpermitfor the Liza One offshore oil project, the Institute for Energy Economics and Financial Analysis (IEEFA) believes that the action is a reflection of citizen's growing concern regarding the handling of the local oil sector
The International Agency which has been paying attention to the local oil industry and offering its advice, reminded that Guyana already has a bad dealthatcoverstheLizaOne project and offered therefore, that the country should have at least been a bitmoremindfulofnegative environmental impacts Frederick Collins and Godfrey Whyte, just weeks ago, filed court action against the Environmental Protection Agency (EPA) to forcethemtoprovethatthey didnotapprovetheLizaOne environmental permit w ithout the legal requirement of full oil spill liabilitybeinginplace.
Andifthiswasdone, the litigants are also asking the court to have the EPA fully c o m p l y w i t h t h e requirements. In its latest writing, the IEEFA said however that based on the
plaintiffs'contention, whena permit expires, the law requires a new permit application and review, particularlywhenconditions havechanged.Itsaidthaton May 31, Guyana's Governmentsimplyissueda newpermitfortheLiza1oil field, without conducting a new review “The requirementforanewpermit processforLiza1isnotjust paperwork, ” IEEFA submitted. “It is essential to protectthepublic.Giventhat greenhouse gas emissions are at the center of the discussion of this project, it is also essential for addressingclimateimpacts,” the organisation continued. It highlighted that a major controversy that surrounded the Liza One project is its unplanned (non routine) flaring of gas to the atmosphere. In an original environmental impact assessment, ExxonMobil, the field operator, told Guyana it could guarantee zeronon-routinegasflaring.

“Faulty equipment, h o w e v e r , c a u s e d ExxonMobil to flare gas from almost the first day of production in 2019.” And amid public outcry, the Government imposed a fine on the company, but also changed the permit to allow some flaring a decision
that is the subject of another legal challenge brought earlierthisyear, andisstillto bedetermined.
IEEFA offered however, that “It would have been more prudent for Guyana to

IEEFAsaidthatwhilethe recent case is a challenge to the Government of Guyana, “it is also an example of continued mismanagement by ExxonMobil.”It said too that “the Government's decision to ignore public concerns about the project and to push the new permit through without a proper review only makes matters worse for the people of Guyana ”The organisation saidthatGuyanaisinahurry to develop its oil and gas reserves as it faces an eventual major reduction in demand for oil and gas as a
result of global responses to climate change. “Its failure toconductaproperreviewof the new Liza 1 permit, however, leaves pollution and climate risks unaddressed.”
Guyana has already lost one lawsuit regarding the Liza One project which was originally granted a more than 20 year permit which would have cut corners on the review process. Citizens however challenged that permit and won; meaning that Guyana must now reviewtheconditionsofLiza 1 permit every five years. IEEFA says that failure to conduct a proper review of the project before the latest permitwasissuedfliesinthe face of the court's earlier directive.

The unwelcome stepmother, and witch that is rightly feared, is none other than American oil superpower ExxonMobil. What is ExxonMobil and its peoples doing near to our national shrines? Why are some Guyanese proudly (or shamelessly) wearing the clothing of our enslavers, exploiters, and predators? We say proudly, as if theyarenotawareofthecallousdisregardforourwellbeing that the people of ExxonMobil harbour in their hearts, notwithstandingtheirsmooth, practiceddeceptions. Look at what has become of the Environmental ProtectionAgency (EPA) and one has to go no farther. Guyana’s Vice President has transformed into a walking, breathing, 24-hour commercial for Exxon’s draining Guyana’s riches and interests. His position is compressed into a phrase that he favours heavily: investors must get a return that compensates for their risk.Agreed, but we disagree that the returns must be so many multiples for the risks they are taking, and what they cart away.

Senior Magistrate Daly then recalled the matter, ordered the Prosecutor Moore be released from custody and gave him 24hours to submit theevidencetothecourt.
In response to the Magistrate's action, the DPP wrote a letter to the
Chancellor of the Judiciary, Yonette Cummings Edwards, requesting that the matterbeassignedtoanother magistrate.
In her letter, the DPP highlighted that while she recognises that the Magistratedoesnotappearto haveapersonalinterestinthe matter, her conduct thus far, constitutes as sufficient reason for the Chancellor to

People must exist...
From page 5 nobody’s song; not for a Bolivar, not for a billion. I pray to God that I never become a pimp, or find myself prostituting myself for a piece of silver.
The hard road travelled for so long and so far, cannot be wasted by turning back now, and turning over and playing dead. For what?
What pearl could be so precious that principle is pulverized for a million pennies?
I don’t own a single piece of jewellery, and as much as I appreciate like the next man or woman the gems –Mercedes and Omegas and Las Vegas – those have their own people whose hearts flutter, and resolve crumble, at the sight and sparkle of those trophies.
I am content with a Honda and a plain ole Seiko, both now run of the mill, and having been through the mill. It is called contentment, and I urge my fellow Guyanese to try it sometime or come and let’s have a chat.
No charge, folks. Here is the first free lesson: if I take some people’s, some leader’s, job, find purpose and place because of its call, then it follows that if the Venezuelans make an offer, it stands to reason that I would accept again.
Turning traitor to Venezuela is how I equate working
for some locals, the degree of the betrayal in the financial floor crossings and whatever other justifications are employed. When we have Politicians and parties that betray this country so cavalierly, and people still join hands with them, then selling out country is not such a tough proposition.
Yes, I agree that everyone has to live. It is said that everyone has a price; it depends on what is being bartered.
Some things are not, and that is that.
But to each his own. I don’t have to live like that, the mere thought of which brings out the sweats.
Some ways of life are just not worth living, and there it is said in black and white. I don’t know, and don’t care, what the rest of Guyana stands for, but I do know where I stand, and it is liked. It is not the best, will not make it into the intelligentsia conversation, or the cognoscenti playbooks, but I am alright with that too.
Better to be a hungry man standing on own feet, than a fraud falling flat on face, or kowtowing abjectly on one’s belly.
I prefer the unpaid, unrecognised public service that is, in its substance, an extension of earlier hospice work, which is what this country needs.
When honour and principle are bargainable, then perhaps neither was really that at all. Sure, we all sell at some time or the other, the challenge is to whom?
Cost to construction new Child Care Centre at Mahaica pegged at $49M

During the presentation of this year’s budget it was revealed that a new Care centre will be constructed at the Mahaica Hospital for children living with disabilities. From this year’s budgetary allocation some $200 million was set aside for persons living with disabilities. The Ministry of Human Services and Social
Security is gearing to spend some $49 million out of that to build the new childcare facility.
At the opening of tenders recently it was revealed that 16 contractors are vying to construct the building. The Ministry of Finance Mid-Year Report had stated that works on this building is expected to commence later this year and this will be first of several such centres across the country.

On Thursday when then matter was called, Senior Magistrate Daly informed the court that she has received a letter from the DPP requesting that she recuses herself from the case. However, Attorney-at-Law Nigel Hughes objected to the DPP's letter and called it a breach of the Hierarchy of the Judiciary. He stated too that the DPP did not give appropriate grounds in her letter for the Magistrate to recuse herself from his client's case.
The lawyer reminded the court of his client's right to a fair trial and indicated that he would challenge the move in the High Court.

…restates call for internal review of controversial 2020 elections
O p p o s i t i o n
Commissioner Vincent Alexander has reiterated the position that the Guyana Election Commission (GECOM)iswithinitslegal rightifitchoosestoconduct a review of its performance during the controversial 2020 general elections. He reaffirmed this stance in a public missive, as he addressed this and another issue which he said that GECOM as well as G o v e r n m e n t

Commissioners are using in their perpetuation of falsehoods.
The GECOM and representatives of the governing People's Progressive Party
Government recently made public statements accusing A l e x a n d e r o f misrepresenting a position oftheGECOMChairperson, Justice (retired) Claudette Singh. They alleged that Alexander was being untruthful when he accused the Chair of refusing to extend the recently concluded claims period However, despite clearing up the matter, Alexander is adamant that the two sides not only continued to perpetuate the untruth, but continued to misrepresent his position on another matter

In the missive, Alexander said that what was being spewed is of a partisan nature, which does
not reflect “a consensus or u n a n i m i t y o f t h e Commission”.Heexplained that recently, he had drawn attention to the erroneous nature of a GECOM release and a release from the three P P P / C a p p o i n t e d Commissioners, both of which purported that he had accused the Chairperson of taking a decision not to extendtheperiodforClaims. Whathappened, hesaid, was thatthepublisherofhisletter attributed a headline to the letter that did not reflect its content.Alexander said that theEditorsnormallycointhe headline/title for letters to theEditor
“Yet GECOM, and the three Commissioners erroneously, out of c a r e l e s s n e s s o r propagandistic mal intent attributed to me, and dwelt onwhatwasin, theheadline, whileignoringthecontentof my letter, which did not accuse the Chairperson of the purported decision- not to extent the period for Claims.”
The Commissioner said that while such occurrence may be forgiven as an error or oversight, any reoccurrence can only be construed as intentional and unethical, at least. “This is undoubtedly the case with GECOM`smostrecentPress Release,” he continued. He said GECOM sought to convey the impression that the Opposition appointed
Commissioners were insisting that GECOM conductaninvestigationinto electoral malfeasance, in d e f i a n c e o f t h e Chairperson`s 'Ruling' that such investigations are the sole purview of the High Court.
“The first observation to bemadeinthatregard, isthat the Court does not investigate, it adjudicates hence an investigation does necessarilynotflyintheface of the constitutional provisions in relation to the jurisdiction of the High Court, ” Alexander submitted. “However, let's assume that I am wrong in my aforementioned contention, that does not relieve GECOM and the P P P / C a p p o i n t e d Commissioners of their notoriety”, he said He contended that “the fact of the matter is that the call of the Opposition appointed Commissioners is for a review of GECOM` s operations to determine whethertherearediscernible weaknessesinitssystemthat need to be addressed if GECOMistoimproveonits system in pursuit of the constitutional requirement for GECOM to ensure impartiality, fairness and complianceintheconductof elections.” He said it is grossly misleading for GECOM to equate the call, bytheOppositionappointed Commissioners, for it to
conduct 'an independent review ' and the recommendations to improve on the methods employed in the electoral system, asacallforGECOM to conduct internal investigations into allegationsofelectoralfraud that were reported to have occurred during the 2nd March, 2020 General and RegionalElections.
He said that GECOM is not only misleading the public on what is being called for by the Opposition appointed Commissioners, but that “it is guilty of dereliction, in so far as it is unprepared to review /evaluate its own performance as a basis for enhancingitssystemsandits operations.” GECOM has embarked upon a campaign that is designed to justify its intentional omissions, such as a review of its operations and the introduction of biometric (finger print) identification at the place of poll,”Alexandercharged.

He claimed that persons were not appreciative of the recognitionhewasreceiving due to the positive changes occurringatthecreditunion and that there was a deliberateefforttohavehim removed from his post. The majority of Committee Members voted Benn out in his absence. They said that Benn was not the only one responsible for the changes at the Credit Union and that he had engaged in activities unbecoming of his office. Theyaccusedhimofleaking confidential information from the organisation and that he wanted to merge his Chairmanship with the post of Chief Executive Officer and allegedly became difficult toward the board when they refused his proposal.
Benn had denied the claimsandwentontosecure hundreds of names of credit union members calling for an emergency general meeting. Numerous public servants turned out to sign Benn's petition in an
overwhelming show of support for him to remain chairman of the board Several public servants spoke about changes within the organization and attributed it to Benn's presence.
The members spoke especially about the mortgage and vehicle loans and how beneficial it was to them The credit union memberswhoalsoprotested in front of the GPSCCU building,inMay,hadpraised Bennfortheinitiative.
The petition had called forthegeneralmeetingin14 days, and it was there that credit union members were expected to vote in a new Management Committee Giventhefeudingfactionsof the board, a date for the general meeting was published and later rescinded. The matter has since engaged the attention of the courts as some Credit Unionmembershavesought legal redress. They want the court to order the GPSCCU to call the general meeting which is legally required once a certain number of Credit Union members have requestedit.
