PROTESTS IN IRAN – GUYANA BEWARE

Though violence has seeped intotheprotestsagainsttheIranianGovernment,thewomen havekeptupthefight. Itinvolvessomuchmorethanabout compulsoryheadwearforwomenventuringoutintopublic spaces.

The first thing to be said is that it takes a lot of force to shakeupthingsinIran. Thegovernmentofclericsandtheir guardsmen are usually very good at keeping things under wraps,lockingdowndissent,inahurry Insummary,thereis neitherpatiencenortoleranceforthoseessentialingredients sohighlyprizedbytheWesternworld. Dr. Williams said it is tamed by “fairness and conscionability.” Expounding further, he said courts commonly go behind the protective wall of sanctity of contract in the absence of provisions of contracts that are patently unconscionable.

“For example, though the U.S. Federal Energy Regulatory Commission (FERC) recognises the sanctity of contract as a general policy, (but) the Natural Gas Act gives it the authority to modify contracts within it re-

mit that are unjust, unreasonable, unduly discriminatory, or preferential. In the case of the PSA between ExxonMobil and Guyana, there is a head-on collision between the sanctity of contract doctrine and the principle of unconscionability if one accepts the position articulated by the ruling party when in opposition,” noted Dr. Williams.

Further, he said the consensus from global experts is that the contract is lopsided and grossly unfair to Guyana. Dr. Williams recalled that the current government agreed with this characterization while in opposition. He said too that the players in the former APNU+AFC adminis-

tration initially pushed back on this characterization but now seems to join the call for renegotiation.

Overall, he posited that, “A country that has persistently encountered exploitation of its natural resources by foreign actors, should not elevate sanctity of contract above conscionability and fair dealing.

In doing so, the government is escalating the error of its predecessor.”

At a time when the country is a magnet for foreign investment, Dr. Williams said he agrees that the government must send the right message. He said that message should not be that investors who obtain unconscionable and

unfair contract terms, whether through corruption or power asymmetry will be able to get away with it.

Furthermore, Dr. Williams said the current narrative about sanctity of contract sends the wrong message. “It is saying to foreign investors – if you succeed in duping us, we will roll over and accept your unscrupulous and unconscionable conduct.”

Dr. Williams said this is likely to invite enterprising foreign investors to extract unconscionable deals either through corrupt practices or power and information asymmetry.

He reiterated that is not the message the government should be sending.

The issue all started with the removal of Trevor Benn as the chairman of the Committee.

It was noted that the majority of Committee members had voted to have Benn removed as head of the Board; a decision that was said to be taken in the absence of the then chairman.

The Committee had highlighted a few reasons for their decisions, which the members felt were frivolous to warrant the removal of the chairman.

The Management Committee had said that Benn became hostile towards them when t hey refused to allow him to merge the office of the chairmanship with that of the organisation’s Chief Executive Office.

They claimed that he had also

made public sensitive information relating to the organisation.

Their excuses were obviously not enough for the members of the cooperative body because Benn was later able to secure over 200 names of members, way more than the 25 that is required, to call for a special general meeting. During the signing of the petition which was done in the vicinity of the GPSCCU building, several members expressed dissatisfaction at the removal of Benn as chairman. They were especially upset since they submitted that Benn’s position on the Committee had seen numerous changes effected.

Apart from some physical and operational upgrades at the organisation, members were particularly excited over the availability of loans for housing and vehicle purchases; opportunities which they said were not so easily available to public servants who the body serves.

Several persons spoke of the benefits of the new provisions.

They spoke about upgrading and expanding their homes, while others spoke about being able to finance their homes for the first time.

Since the removal of Benn from the Committee, the Kaieteur News was told that the provision was removed. The new chairman, Karen Vanslutyman-Corbin said that the loans were put on pause as it was being reviewed.

Patrick Mentore, while acting as chairman in Benn’s removal, had issued a date for the special general meeting after the Committee received the member’s signatures asking for the meeting within 14 days.

Another faction of the Committee rescinded the notice for the meeting, which forced the organisation’s members to approach the court.

It should be noted that the members have already stated their intention to vote out the entire Management

Committee.

In their petition, the members’ advised that the objective of the proposed meeting “shall be to vote for or against the recall of the Committee of Management of the GPSCCU…” Further, without prejudice, the petition said, it recommends that “the following nine officers not be reelected to serve on the Committee of Man agement: Ms. Gillian Pollard – Secretary, Ms. Karen VansluytmanCorbin, Ms. Ruth Howard, Ms. O. Saskia EastmanOnwuzirike, Mr. Charles Ogle, Mr. Kirwyn Mars, Jermain Hermanstyne, Ms. Leslyn Noble and Mr. Arthur Gibbs.”

The members demanded that the meeting be held virtually and inperson in all 10 Administrative Re gions, utilising the same mechanism used to conduct the 2021 Annual General Meeting at which the present Committee of Management members were elected, and that the same e-voting service provider be utilised.

King’s regal unbeaten 83 gives Tallawahs CPL Crown

A magnificent unbeaten 83 decorated with 15 fours and two sixes from Hero of the Match Brandon King and an attractive 47 with six fours and two sixes from Shamarh Brooks along with threewickethaulsfromFabionAllenand Nicholson Gordon powered Jamaica Tallawahs to an emphatic eight-wicket win over Barbados Royals at Providence last night to lifttheirthirdHeroCPLtittle.

King finished with 422 runs (theonlybatterwith400runsinthe tournament) and was one of three batterstoscoreacentury;allmade

againsttheWarriors.

Themajorityofacrowdofover 10,000 fans which included PresidentDrIrfaanAliandMachel Manteno were supporting Jamaica andlustilywavedJamaicanflagsas they danced to pulsating music in thebiggestpartyinSports.

Barbados Royals, arguable the strongest team in the tournament were restricted 167-7 as 24-year old Azam Khan struck four fours and three sixes in a 40-ball 51 to reach his ninth 50 and third at Providence.

But only Rakeem Cornwall, with 36 from 21 balls with two fours and fours sixes and Kyle

Mayers who hit six fours in a 19ball28reached20.

The pair had galloped to a 63 run opening stand in just 36 balls before left arm spinner Fabian Allen(3-24)andNicholsonGordon (3-33) restricted the Royals to just 61inthelast7.3overs.

Kingledthechaseandsharedin fifty stands with Brooks and RomanPowelltoleadtheirteamto 162-2with23ballstospare.

BarbadosRoyals,whowonthe lastoftheirtwotitlesin2016,won the toss and batted on a good pitch and lightning fast outfield, burly Antiguan Cornwall and Mayers provided Barbados with a royal start as the as Cornwall was the butcherandMayersthesurgeon.

The pugnacious Cornwall clobberedfourmassivesixeswhile the left hander Mayers stroked SouthAfricanMigaelPretoriusfor

an imperious drive to the extra cover boundary…it was arguable theshotofnight…especiallyinthe T20format.

The 50 was brought up in 26 balls with Cornwall, who smashed Imad Wasim over the Red Stand, doing the bulk of the scoring with 36 while Mayers was content to playthesupportingroleon18.

But with the score on 63 Cornwall was removed by Allen and at the end of the first six-over power-play, the Royals were 63-1 aseightfourandfoursixeswerehit.

Mayers was soon bowled as Allenwhostruckintheeighthover at69-2afterwhichKhanandJason Holderjoinedforces.After10overs thescorewas82-2.

Holder (17) struck a couple of

Khan, the son of former Pakistan Keeper Moin Khan, kept goingbigbutNajibullahZadran(6) didnotlastlong,fallingtoGordon at140-4.

The150cameupoff19.1overs when Devon Thomas pulled Gordon for six before Khan pulled Allen for four to reach his 50 from 39 balls, but walked past one that turned away from him next ball, and was stumped at 146-5 in the 19thover.
