...as Exxon, Shell walk away from California wells American oil giant, ExxonMobil Corporation and British oil giant Shell are selling their California wells and officials are worry that the reason behind their departures is the looming liability for environmental cleanup – which can be left on taxpayers to foot the bill.

Decommissioning is the process of ending offshore oil and gas operations at an offshore platform and returning the ocean and seafloor to its pre-lease condition.

ProPublica, a non-profit newsroom that investigates abuses of power particularly in the oil and gas industry – reported that despite the price of oil produced in California this year reached its highest level in a decade, – Exxon and Shell who have done business in the State for more than a century, are selling assets and beginning

to pull out of California.

ProPublica also reported that the oil giants agreed to sell more than 23,000 wells in California, which they owned through a joint venture called Aera Energy, to German asset management group, IKAV, for an estimated US$4 billion.

While Exxon and Shell say the deal will strengthen their businesses – Greg Rogers, an Attorney and Accountant who researches the oil and gas industry, said the deal allows the sellers to shed decommissioning costs. “You got bad assets with big liabilities, and you can get rid of both at the same time. That’s a win for Exxon and Shell,” he said.

Other industry experts, l a w m a k e r s a n d environmentalists are concerned about the deals, noting that the sales shift

environmental liability from corporate powerhouses to less-capitalized firms, increasing the risk that aging wells will be left orphaned, unplugged and leaking oil, brine and climate-warming methane. They see a threat that the State’s oil industry could repeat a pattern seen in other extractive industries like coal mining and lead to taxpayers bearing cleanup costs.

California Assembly Member, Steve Bennett, a Democrat who has long worked on oil policy, has seen oil companies in his Ventura district walk away from environmental liability.

“It gets passed on to a smaller company and to a smaller company until someone declares bankruptcy and the public is stuck with the cleanup bill,” he said.

ProPublica, if it’s not profitable to return wells to production, they need to be plugged. But if a company does not plug its wells before walking away, wells are orphaned and the cleanup costs ultimately fall to taxpayers and current operators through fees.

It was stated that in order to minimize the Government’s exposure if wells are orphaned, producers must put up a bond, typically held as cash

or a surety policy. The bonds act like a security deposit in which the company gets its bond back if it cleans up its mess, but the Government keeps the money if the company orphans its wells.

Exxon’s affiliate, Esso Exploration and Production Guyana Limited (EEPGL) has been taking out money f r o m G u y a n a ’s o i l p r o d u c t i o n f o r decommissioning – this money is being controlled by the company.

While California has the authority to ask for an additional US$30 million in financial security from a single operator – Shell and Exxon’s joint venture holds a US$3 million bond. As a result, Aera’s bonds cover way less than what would be required to plug the wells.

Opposition Leader, Aubrey Norton As American oil giant, ExxonMobil continues to reap exponential profits from Guyana’s lucrative Stabroek Block and the lopsided contract it signed with Government in 2016, stakeholders are beginning to challenge the terms the country got and are demanding more wealth from all future projects to be approved by the Government.

Leader of the Opposition for instance yesterday in an invited comment told this publication that all addition projects Exxon wants to pursue in the Stabroek Block, must adhere to the new terms announced by Government to rake in more wealth for the country.

He explained that when the contract was signed by the Coalition Administration six years ago, the company

was operating in an ‘uncertain’ environment where the possibility of discovering large deposits of oil was a mere hope.

However, since more than 11 billion barrels of oil resource have been found in that Block alone, Norton argued that the environment has changed, meaning that Exxon should now match the royalty and tax rates Government wants from the other oil blocks.

“While I have stressed previously that I wouldn’t use the concept renegotiation, I have consistently argued that the existing Exxon contract has a mechanism in which the Government can engage Exxon and get better terms,” Norton said. He continued to explain that not only should new companies entering Guyana be required to

adhere to the new PSA but the American oil giant as well.

Given that the company is still seeking approval for its fifth project, the Opposition Leader believes this is the perfect opportunity for the country to demand more on its resources.

In fact he argued that the Vice President has used the terms of the new PSA as a “smokescreen” to avoid pressuring Exxon into giving Guyanese more wealth from the Stabroek Block.

Road safety It is Road Safety Month, and Guyanese are reminded of how dangerous, even deadly, travelling on our roads can be.

It could be in the city or a rural area, and the life and limb of young and old are endangered. There are two major contributory factors, speeding drivers and drunk drivers. In both situations, those behind the wheel engage in what is reckless and destructive to themselves and anyone in their vicinity. This is a severe problem in Guyana, and one that does not look like it has any end in sight.

The Traffic Department of the Guyana Police Force (GPF) has done its part, through informing citizens of the need to exercise greater care, more discipline, and with regard for others. The advice of the GPF has largely fallen on deaf ears, given the continuing stream of accidents and, too frequently, road fatalities. Citizens are seriously injured, breadwinners killed, and survivors left hanging by a thread, and managing however they can. We are not equipped, as yet, to deal with some of the horrible injuries that are caused by accidents on the road, since we lack extensive facilities and skills to handle the carnage that crushes bone, body, and life itself. Concerned Guyanese have lent their voices, given of their time and energies, to shed light on the dangers of speeding and drunk driving, but again with little success for their efforts.

We highlight road safety and road wreckage, and the great costs to property and body, and to use such circumstances to speak to an environment beyond our roads. It is people operating above of our streets, who are even more dangerous than drunk or speeding drivers. In fact, we take the position that because the entire nation could be endangered in many ways, and pays the bitterest of prices the men responsible are potentially deadlier than those who drive dangerously on our roads.

These would be the Leaders in this PPP/C Government, who captain our national oil vessel. Because of their reckless actions, their resistance to listening, hearing, and acting appropriately, and their hostility to those who call them out on our national oil journey, these men, these Leaders, pose a greater danger to all Guyanese. It is more than any speeding minibus driver, reckless truck driver, and drunk and out of control vehicle driver (of any type), through the decisions they make, the things they do, and those that they refuse to do.

When Leaders in this PPP/C Government race at breakneck speeds with oil production when we, including themselves, know so little about the oil industry, how it works, what are its tricks, and how we need to protect ourselves, there is the great danger that severe injuries of different kinds will follow.

There are financial injuries which the foreign oil companies can and will inflict upon us, and of which we are ignorant. It makes sense, therefore, for Government and Leaders to slowdown to get feet wet, and for them to be able to wrap their minds around the complexities of a demanding and sophisticated business. Further, when Guyana rushes forward as rapidly as it has done, then the oil companies are given the go ahead to speed up processes and practices to the point where safety becomes secondary. Just as how speeding road users throw caution to the winds and cut corners, only to end up badly wounded or kill others, this is what the PPP/C Government practices. The risk, the probability, of a disastrous oil spill is sharply higher at accelerated production levels. There is potentially untold danger to our environment and future, to that of our tourism-dependent neighbors and their way of life, and there could be the likelihood of this oil meaning nothing to us due to national bankruptcy hanging over our heads. Guyana would be like a man that has a Mercedes, but who has injured himself so badly that he cant drive it anymore, experience its joys anymore.

Leaders in the PPP/C Government must slow down, they must not be so drunk from power. They must learn, and discipline themselves to listen and observe for the betterment of all. They must cease being the most dangerous people in Guyana.

Headache to uplift pension book DEAR EDITOR, The visit to the Christ Church compound to uplift the 2023 Pension Book was an exercise in exasperation.

In American lingo, it would be labeled a cluster-bomb situation, the regular, old snafu. In Guyanese lingo: confusion, frustration, and agitation, It takes a lot to trouble nowadays, but the Christ Church experience last Friday was infuriating, disappointing and disgusting. I place the blame squarely with where it should be, viz., the Hon. Minister of Human Services.

What was delivered there to Guyanese Pensioners was not human, but inhumane.

The Minister can consult with her A-team on the whys, whereases, and wherefores that I have learned is plaguing this year s 2023 Pension Book activity in several locations.

I start with the positives.

The seven female officers engaged in processing were focused, disciplined, and involved throughout. I dont think I saw them leaving their workstations once in the three plus hours I was there. I thank them for eating on the run, and in

sporadic, hurriedly gobbled spurts, at their tables, with upset and impatient people clustered around them.

Special thanks to Ms. Leshaun James, who was tireless, courteous, and professional in answering questions from all angles, and on her feet for hours. I watched Ms. James and two o t h e r f e m a l e o ff i c e r s extending a willing hand to those who were struggling, and couldnt manage with waiting their turn. Though not universally practiced, it was still welcomed. Mr. McBean, who I concluded was a senior officer, was professional in responding when I pressed why some people were being processed before those who were there before. His words were that they were those who couldnt be dealt with at other sites, so the spillover was directed to Christ Church. I thanked him thinking that this was for Alberttown alone, only to hear that Wortmanville, South Cummingsburg, and elsewhere were all present, for a cramped processing area that had none of those places named in the newspapers.

I am now withdrawing what I told him,

namely, that I understand, and it was acceptable. It is not, and for a couple reasons.

For what was interpreted to be managerial discretion and accommodation of those missing out at their home centers omitted a key detail.

For example, present was a female Pensioner turned away at Alberttown, and advised (with spouse) to go to Christ Church on Friday.

Nothing was said about them jumping the line, and she patiently waited her turn for hours. This jumping the line was what all of us observed occurring continually throughout the day. This left us thinking that these were special arrangements for special people possibly sent by the powers that be; or private arrangements and associated considerations. I regret that Mr. McBeans explanation fell short.

Now, it took three and a half hours to collect the pension book. Three and a half hours, and this was less than what others experienced at Trinity Methodist Church on High Street, and elsewhere. I heard angry Pensioners. I saw Pensioners who could barely see, or hardly walk,

but submitted to an ordeal involving hours. What makes this even more unsatisfactory is that the Ministry of Human Services had a smooth and efficient process in 2021, when arrangements, process, organization, and structure were all in place and hummed efficiently. Why change what wasnt broke? I understand cash, thumbprints, and some slowing the process, but it shouldnt take ten minutes or upwards to sign ones name and three hours to collect a book.

This was the experience that Pensioners were treated to, and it was appalling.

The Minister should be embarrassed to preside over this. I point to her because it is her watch, her portfolio. I hope that her Public Relations people dont take offense and respond. I am holding back some other negative elements of the day at Christ Church. It might be better to take the experience shared and learn from mistakes.

Perhaps distribution was held in houses of worship to limit cursing.

The NY State Attorney General meddling in Guyana’s internal affairs, should focus on crime in NY DEAR EDITOR, The NY Attorney General should focus on solving crimes in New York State that affect AfroA m e r i c a n s disproportionately rather than meddling in Guyana’s internal affairs. She has crossed the line, is playing politics, and involved in incitement. Why does this lady think she has jurisdiction to run her mouth about Guyana? In brief remarks at an event organized by political miscreants in New York, one of whom is a subject of concern to the Guyana authorities, the New York AG said, “Hello Guyana! Let them know you would not tolerate racism, Hello Guyana.

Hello Guyana! Let them know [we would] not tolerate corruption! Hello Guyana! Let them know that you believe in democracy.

Hello Guyana! Let them know you believe in fair elections, come on Guyana, let them hear you roar!” That was how Attorney General James began her address on Sunday.

Now the PPP is not a

poster child or candidate for sainthood. But to say the PPP is engaged in racism and discrimination is vexatious, mischievous, and reprehensible. The closest we came to apartheid was under the rigged years of the PNC. Many feel that the PPP at its worst would always be better than the PNC at its best. The PPPs biggest, unpardonable sin and major blunder is its failure to renegotiate the oil contracts as it promised in the 2020 election campaign. The PPP has been elected fairly in elections that have been certified by CARICOM, the International Community and the Caribbean Court of Justice (CCJ). The only party that has rigged elections and tried to do that in plain sight of observers in 2020 was the PNC. For the NY Attorney General and some members of the Black Caucus to make false charges about racism and discrimination, based on poisonous propaganda from New York mischief-makers to my mind, is what is racist.

From my observations, the PPPs cash grants, GOAL scholarships, award of house lots mostly to blacks, village

outreaches, and infrastructure programs are implemented with a high degree of representativeness across all communities.

I have noticed the PPP responds quickly to requests when they visit communities that dont vote for them. In their supporters communities, they are told to wait. Whim is still waiting for concrete drains and asphalted streets.

In fact, we can probably make a case that if the PPP is discriminating, it is against Indo-Guyanese. The PPP refuses to add “Indian” to “Arrival Day” although the PNC supports that. The PPP failed to ensure the Police charged those that brutalized Indians during the West Coast Berbice riots. At Mon Repos, the PPP Government failed to stop protesters, and allowed them to reach Mon Repos where Indian vendors were terrorized.

They promised that more offenders will be charged.

We are still waiting to see that, although an abundance of video footage exists that show the terrorists in action.

Under the PPPs watch, an Indian woman was allegedly

gun-butted by a PPP operative who was allowed to make a quick exit back to New York.

The PPP has no plan to diversify the Government services.

Now we find out that PNC supporters in GECOM have ducked videos and wiped computers of key information. We have not heard the Black Caucus or NY Attorney General make any pronouncements about these matters.

The Government should let that meddling AG know it was a top PNC Leader who said, “The only friends I got is PNC, so the only people I gon give wuk to is PNC, and right now I looking for a Doctor who can talk Spanish or Portuguese, and ah want one that is PNC.” That NY Attorney General eyepass Guyana. I hope the Government is using its lobbyists and diplomatic corps to reprimand that lady and her friends who think they can run their mouth based on political fiction. Stand up for Guyana!

Elections COI, Kwayana stands by his representations on Terms of Reference DEAR EDITOR, On September 17, 2022, a letter written by me appeared in the Stabroek and Kaieteur News on the subject of the Commission of Inquiry (CoI) into the Regional and General Elections of 2020, in which I noted that the CoI Act gives the President the power to create the terms of reference, and emphasised that, “The members of the Commission are not chosen by the Guyanese electorate, and cannot be presumed to be competent to devise terms of reference answering to their concerns.”

I welcome the opportunity to respond, if somewhat belatedly, to the explanation given by a member of the staff of the Commission of Inquiry that appeared in the Guyana Chronicle of September 20, 2022, refuting my claim as inaccurate and noting “that on the very same day the CoI was appointed, the Instrument appointing the Commission, in which the Terms of Reference were duly and expansively set out, was published in the Official Gazette of 13th September, 2022.”

However, my comments had been made on the basis of reports carried in the Stabroek News of July 17, 2022 (and also on the website of the Guyana High Commission in South Africa that same month), in which President Irfaan Ali “announced the establishment of a CoI into the 2020 elections,” and stated that it “will be headed

by retired Trinidad Justice of Appeal Stanley John and includes former Attorney General, High Court Judge and Acting Justice of Appeal in the Eastern Caribbean, Godfrey P. Smith SC, former Chair and Chief Elections Commissioner of India, Dr. S. Y. Quraishi, and former Chancellor (ag.) of the Guyana Judiciary, Carl Singh.”

S i g n i f i c a n t l y, t h e newspaper reported President Ali as saying that, “when he last spoke to the Chairman, retired Trinidad Justice of Appeal, Stanley John, in the previous week, it was indicated [to him] that the Commissioners are working to have a ToR in place.”President Ali was quoted as saying that, “They are now working with each other, talking with each other, crystallising the Terms of Reference. The Terms of Reference have to be in keeping with all the other things that is (sic) happening around the issues surrounding the elections.”

To be clear, these reports and quoted statements of President Ali were made two months prior to the official appointment of Commissioners that was announced in the Official (Extraordinary) Gazette of September 13, 2022, and also two months prior to the publication of the Terms of Reference of the CoI in the local media. None of these reports or statements has so far been corrected by anyone in the Government. I want to emphasise my point of view that this is a most unusual

procedure, and one which resulted in my letter of September 17.

The Commissions of Inquiry Act, Chapter 19:03 of the Laws of Guyana, says that: 2. (1) The President may issue a Commission appointing one or more Commissioners and authorising such Commissioner or Commissioners to inquire into any matter in which an inquiry would, in the opinion of the President, be for the public welfare.

(2) Every such Commission shall specify the subject, nature and extent of the inquiry…

The news report of July 17 raises serious questions about the propriety of having Commissioners (named but not yet formally appointed) work out their own Terms of Reference (in effect, participating in the drafting of their job descriptions), and ahead of the time when it was convenient for the Government of Guyana to p u b l i s h t h e Te r m s o f Reference in the Official Gazette.

Not only will they not necessarily know enough about the background and context for the inquiry, there is also the risk, if they are well informed of the matters to be investigated, of whether they can properly be (Continued on page 6)

Paul Slowe responds to Gail Teixeira DEAR EDITOR, Please permit me space to respond to the recent Press Release issued by Ms. Gail Te i x e i r a , M i n i s t e r o f Parliamentary Affairs and Governance.

On Sunday October 30, 2022, I attended a town hall meeting in Brooklyn, New York, USA. I was invited by the moderator to make some brief remarks on the current state of the rule of law in Guyana. In my brief presentation, I made reference to my encounter with members of the Special Organised Crime Unit (SOCU) of the Guyana Police Force, when I attended the Georgetown Magistrate Court on October 15, 2021, to answer the t r u m p e d - u p c h a rg e o f conspiracy to commit fraud, which was instituted against me and other retired and serving officers of the Guyana Police Force. I recounted that I was intercepted in the compound of the Georgetown Magistrate Court by Superintendent Krishnadat Ramana and other members of SOCU. Ramana informed me that I was being arrested for the same matter that I was at the court for. He also informed me that I was also being arrested to be cautioned after charge. It must be noted that my attendance at court was in response to a summons, which was applied for by the

very Ramana.

I also made reference to the well-publicized incident, which has gained international attention, where ranks of SOCU, on the instructions of Ramana, arrested Attorney-at-Law Tamieka Clarke because she advised her client, who was being investigated by SOCU, not to sign a statement which was given to him. I expressed the view that those two incidents are an indication that the rule of law in Guyana is under serious threat. My accurate recount of my experience with the ranks of SOCU and the arrest of the Attorney, seems to have angered the Government of Guyana.

In the statement, Minister Teixeira stated that I am charged with sexual assault of a woman in Guyana.

E d i t o r, w h i l e t h e statement is true, in the context of its use, I can only conclude that it was made to convey the impression that I am a person of ill repute and therefore lacks credibility.

Nothing can be further from the truth. The matter she referenced is an allegation made by a female Police Officer in April of 2021, that

on March 26 and 29, 2019, and April 2 of the same year I touched her leg and foot, during meetings at Police Headquarters, at which several other persons, including retired and serving P o l i c e O ff i c e r s , w e r e present.

The matters are still working their way through the legal system, so I am unable to go into further details at this time. The allegations are false, and I will continue to mount a vigorous defence to clear my name. Minister Teixeira should be reminded that in any Country governed by the rule of law, a person is presumed innocent until proved guilty by a competent court.

It was also stated that I was suspended as Chairman of the Police Service Commission because I refused to promote senior police officers recommended by the then Commissioner of Police acting, ninety percent of whom were Afro-Guyanese.

Why didn’t these local elected officials call-out Slowe for holding back the upward mobility of many of his fellow Afro-Guyanese (Continued on page 16)

Home ownership transcends Sasenarine Singh singing for his supper the physical realm DEAR EDITOR, Reference is made to a letter in the Guyanese Press written by Mr. Sasenarine Singh where he condemns a Report by the United Nations environmental programme titled, ‘Is Natural Gas a good investment for Latin America and The Caribbean?’

The letter writer states in his letter: “The UN Report sought to lecture the Latin American countries on what they should and should not do concerning their energy development plan. But history will prove that this same UN conveniently chose not to steer China, India, Europe, Australia and North America for too many decades away from their climate destructive energy development plan. The m a i n s t r e a m environmentalists have labelled these plans as the primary cause for the current destruction of the environment.”

The comprehensive report which draws data from various countries in the named Region makes a compelling, supported, and quite cohesive argument that seeks to present n it’s executive summary three areas, emissions, costs and job creation; as to why renewable energy is recommended compared to the use of natural gas and current sources of electricity generation, heating and power with three countries case studies of Argentina, Panama and Grenada.

The letter closes with this statement: “Enough said, but I cannot, without a clear conscience, remain silent on an economically and scientifically sound attempt

by Dr. Jagdeo to provide lower cost and more reliable energy to this nation using a bridge fuel called natural gas which is in abundance in our jurisdiction. Every patriotic, pro-Guyana, progressive Guyanese must stand up and support the Wales-based

Gas-to-Shore Power Generation Project. I call on all Guyanese to put all of our energies into completing it before 2024.”

Mr. Sasenarine Singh, who referred to himself as an international financial analyst in the past, such ubiquitous outburst does not merit a response here except to say in 2015 if I may recall that when he was with the Alliance For Change supporting the then Coalition Government of Guyana withholding vital information from the Guyanese nation, said that the people must have confidence and trust in its Government to which I wrote on social media in response that it is actually the other way around.

This political novice is clearly singing for his supper and is constantly embroiled in agonizing bouts of incompetency in the politically implanted position as the Chief Executive Officer of Guyana (Continued on page 16)

DEAR EDITOR, What a tremendous achievement? It is that the Government has thus far distributed some 18,000 house lots since coming into office, and it is now like a given that the PPP/C (Peoples Progressive Party/Civic) Administration will deliver their promised 20,000 house lots by yearend. I say this, as again the robust housing plan of the Government unfolded with another episode, giving some 700 more house lots to residents of Region Five (Mahaica-Berbice). The house lots were allocated during the second Dream Realised housing drive in the region for the year. As we can remember, the first phase was held earlier in the year, and this saw at least 400 persons receiving house lots.

Readers this is huge, as we all know that on the socio-psychological level, a good home provides protection. Children are less at risk of violence and sexual abuse. They are also less likely to be forced into child labour, married off at a young age or forcibly recruited by stealthy groups and persons, to be exploited.

Then a home ensures that

displaced people have better access to humanitarian aid.

So, what is happening is that the housing sector is preempting these evils from encroaching the society.

According to the Minister within the Ministry of Housing and Water, Susan Rodrigues, “… the land that is (currently) being developed was acquired by the Ministry back in May 2021 … (and just) several months later, we (the Government) are here to allocate 700 house lots to you the residents” Simply put, this is testimony “… to the expediency in which we (the Government) are working; this demonstrates the commitment of the Ministry to reaching its target of distributing 50,000 house lots by 2025.”

Another factor here is that housing is a basis for taxation-often local Government taxation, and this is a significant contributor to the fiscal health of local Governments and their capacity to deliver basic urban services. Due to its size, the housing sector has a major impact on any country’s macroeconomy.

Noting what has been happening, as far as housing

Guyana is concerned, great dividends, of a perpetual nature, will eventually descend on the economy. I need to add, that the actual building of these houses, with their relevant amenities, is also a boost to the workforce and the sale of building materials.

Editor, the conception of a house as a home being a place of comfort and security is global. This established view of shelter reinforces the idea that many other qualities derive from the place we call home. In fact, the home has come to symbolize family, stability, wealth. As the largest single investment for most families, and the driver of demand in enormous sectors of the economy, housing has therefore played a huge role in the economies of many nations. It is nothing to be t a k e n l i g h t l y. O n t h e contrary, being without homes or finding them unaffordable is stressful and creates negative tolls on peoples mental health. 33 per cent say housing costs cause stress and depression in their family, with 25 per cent being kept awake at night by the stress of paying their rent or mortgage. Building a better life begins with a safe environment to call home.

Don’t rejoice over new PSA terms yet, wait to see the fine print - Patterson cautions Guyanese The Alliance For Change (AFC) has not given the new Production Sharing Agreement (PSA) a passing grade just yet, based on the preliminary provisions announced by Vice President Bharrat Jagdeo last Thursday.

In fact, the political party believes that the entire deal must be scrutinized in-depth, before Guyanese laud the contract a ‘better deal’ compared to the 2016 ExxonMobil contract.

Putting this into perspective was Shadow Oil and Gas Minister, David Patterson, during the party’s most recent Press Conference. Patterson was

keen to point out that while 10 percent royalty for instance may sound exciting for the country, Guyana could be losing out big in other areas.

In an invited comment on Friday, the Member of Parliament (MP) explained, “It is a step in the right direction but as I said before the devil is in the details. You have to look at everything holistically. Somebody may shout 10 percent is a good number but then when you do actually award the PSA there is no clause in there for unlimited liability insurance, there is no clause for studies, for waste water management and those things like that.”

Patterson has been the Coalition’s key spokesperson on natural resources issues in Parliament, and has been arguing the need for those provisions to be included, to guide the ongoing production of oil by ExxonMobil in the Stabroek Block.

He reasoned, “You may just look at the number, 10 percent, and people might shout that they have done a good job... (but) you could be charging them 10 percent, and you be giving away 50, 60, 70 percent with loose regulations and policies, so don’t be caught up with the number.”

The former Minister believes that a proper PSA should specifically address full liability coverage in the event of an oil spill, and a clear no-flaring policy or a hefty fine around $3 million per tonne or carbon dioxide emissions, to deter operators from this dangerous activity offshore. Additionally, the new deal should also insist that there is no dumping of waste into the country’s waters, as well as outline specific local content targets to ensure more money “stays locally”.

To t h i s e n d , h e concluded, “We have to look at it in the entire package and if all other conditions- I’m talking about flaring, no dumping, unlimited (liability) coverage etcetera and ring-fencing- if all of those are satisfied then we

will feature a 10 percent royalty rate (up from the existing two percent), a 10 percent corporation tax and ring-fencing provision among others. Ring-fencing would allow for the earnings from one project to cover the expenses in that specific development only, which would allow the country to see more annual revenue. In the absence of this key clause, Exxon is allowed to recover expenses from multiple projects from the revenue earned by oil producing project.

While it cannot be said that these were intimate relations, it was not unknown for platonic relationships to develop between Teachers and Students. At the time, this was not frowned upon as much as it is today because in those days the age of consent was much lower. But some Headteachers would have the occasional chat with the Teacher when they saw him becoming too friendly or affectionate with a female student.

It was not unknown then also for some students to end up marrying their Teachers.

There are known cases of this too. But this was not a regular occurrence and if the two decided to get married it would not have been while the Student was attending school. I am sure that most readers would have known about the rare case of a Teacher marrying a Student.

And while such relations are not tolerated today, it is not unknown for this to be happening even though the relationship would have to be kept secretive.

The Ministry of Education should, if it has not done so already, establish some ground rules outlawing certain types of relations between teachers and students. This certainty would be consistent with ethical conduct which is expected of teachers.

The issue of ethical relationships is now a major issue not only in schools but also, as we have seen

recently, in international organizations. Two cases one involving the InterAmerican Development Bank (IDB) and the second involving the Organization of American States (OAS) have directed the spotlight on the issue of what constitutes appropriate intimate relationships in the workplace. In the latter case, a top official of the OAS has been linked to a relationship with a staffer.

The OAS strictly forbids any Official from supervising another person with whom the Official has an intimate relationship. It also forbids the Official from participating in decisions concerning benefits or appointments to the staffer where there exists an intimate relationship between the two.

Just recently the InterAmerican Development Bank was forced to let go a Senior Official after it was discovered that he had an intimate relationship with a staffer.

If that were the basis for letting go Officials in Guyana, a great many of them would be given marching orders. It is known that some Senior Executives and Officials in both the private and public sector have been known to have affairs, including extramarital affairs. Persons have been known to enjoy accelerated promotion and special benefits as a result of those relationships.

The two cases mentioned above highlight the need for ground rules to be established to govern intimate relations between staffers and their

superiors in both the public and private sectors. But the Government has the obligation to set the standard and to establish the necessary rules.

It is not as if such relationships should be outlawed but surely there should be rules guarding against persons benefitting from such relationships on the job. You do not expect for example, that a secretary who has a relationship with her Boss should be promoted over and above a more deserving candidate.

To guard against such things, it is necessary to have rules concerning a conflict of interest.

In such cases, the boss should withdraw from being part of the decisions concerning a staffer with whom the Boss has an intimate relationship or special friendship.

Readers will recall that many years ago, that when the close friend of the then President tendered for the purchase of a privatized entity, the President said he withdrew from the consideration of the matter when it came before Cabinet.

But greater caution should have been employed in this particular case because even though the then President said he withdrew, the mere fact that he occupies such a powerful position can exert indirect influence.

The time has come for the Ministry of Education to outlaw any love affairs between teachers and students. It is hard to prevent people from falling in love but once they do in school, one has to be removed from

believe in any e l e c t i o n , o n e ’s choice is limited by party structure. I support the Labour Party in the UK and the Democratic Party in the US. But there are individuals in every party that voters have problems with.

The Democratic Party is billions of miles ahead of the Republican Party on issues on class, colour, rights, trade unionism, gender equality, immigration, etc. But there are persons in the Democratic Party I would have a hard time voting for if those persons are running as individuals and not part of a party slate like proportional representation (PR).

In this context, the firstpast-the-post (FPTP) format or constituency system has its advantage over PR. In PR, if you like a party and dislike a few names on the list, then you have no choice because you are voting for a slate.

In FTPT, parties in order to win will have to put up mavericks or rebels or antiestablishment even though the elites in the party do not like them. It is what the constituency wants.

For example, if Guyana h a d F P T P, M i c h a e l Carrington would win his seat for the AFC up the Linden highway because he is a popular and likeable figure.

The elitists in the AFC who do n o t l i k e C a r r i n g t o n ’s independent style will have to select him up if they want the seat.

The US primary system is a workable solution that ensures the option to choose a n i n d i v i d u al. In the primaries, one can vote for and against a particular candidate. If I had to vote, there is no way in the primaries I would choose Kamala Harris over Elizabeth Warren.

Harris is half-East Indian

and half West Indian but colour and race never mattered and will never matter to me. I think in terms of policies, Warren would serve the interests of the lower and middle classes in the US more effectively.

In tomorrow’s race, Guyanese who usually vote for candidates from the Democratic Party are faced with a worrying choice. It is a difficult task facing them tomorrow but they should punish Letitia James for her intellectual mediocrity.

Guyanese should not abstain but vote against James. I think the Guyanese franchise is large enough to weaken James. She is running again for Attorney-General but she is an enemy of democracy in Guyana.

Ms. James is unsure of her capacity, ability and intellectual competence.

Surinamese among four men busted with $14M in ganja

Two Surinamese men are among four busted on Sunday, November 6, 2022, allegedly transporting some $14.3M worth of marijuana in two boats along coast of Corentyne Berbice, Region Six. The bust was made by the Customs Anti-Narcotics Unit (CANU) and the Guyana Defence Force (GDF) Coast Guard, during the morning hours, in the vicinity of Number 47 Village, Corentyne. CANU ranks also found a shotgun and ammunition onboard one of the vessels.

Detained by the CANU ranks are, Surinamese Mohan Soaren, 41, and Faizel Imami, 48.

The other two men arrested are from Berbice, and were identified as Adrian Hetmyer, 44 and Daniel Persaud, 20.

According to CANU, they decided to intercept the vessels after suspecting that they might be transporting

illegal drugs. On board one of the boats were the two the Surinamese men, while the Guyanese men were in the other.

Inside one of the vessels the ranks found over 105 kilograms of suspected cannabis, while the second had 11.2kilos, along with the shotgun and bullets. The total street value of the drugs was estimated at $14.3M.

Supreme Court seeking persons with direct interest in case filed against EPA over liability coverage

A

notice has been placed in the newspaper by Supreme Court of Judicature seeking persons with a direct interest in the case where two Guyanese citizens, President of the Transparency Institute of Guyana Inc (TIGI) Frederick Collins and another citizen, Godfrey Whyte, have taken the Environmental Protection Agency (EPA) to court to enforce a critical clause in the Liza Phase One environmental permit, recently issued to Esso Exploration and Production Guyana Limited (EEPGL).

According to the notice any person with direct interest in the matter may file a similar application or apply to be joined as a party to the proceedings within 14 days of the publication of the notice dated October 27, 2022. The matter is being heard by Justice Sandil Kissoon at 3:00pm.

Under the law of the land, each company or corporation is a separate legal entity from its shareholders and creditors must look to the company/corporation to liquidate its liabilities, parlous as its financial state may be, and not to its billionaire shareholders.

That provision says ExxonMobil Corporation, the parent company for EEPGL, must cover costs for all environmental loss and damage that might result from a well blowout, oil spill or other failure in the Liza Phase One Development P r o j e c t i n G u y a n a ’s Stabroek Block.

On this basis, the case was filed in the High Court on September 13 by Attorneys Seenath Jairam,

shocked to learn that Esso has been using a faulty gas compressor and flaring billions of cubic feet of gas instead of re-injecting it.

Citizens have also gone to court to challenge the flaring in a separate court case. Furthermore, Esso has also admitted to operating above the safety level of its production vessel.

Melinda Janki, an International Lawyer, who is representing the litigants,

A statement from the litigants said that the resort to the courts is to make sure that the company takes full financial responsibility in case of harm, loss and damage to the environment.

It added that Esso is registered offshore and its financial position is unclear as it has been filing what it calls ‘branch’ accounts in Guyana.

In the case, Mr. Collins, a former Insurance Professional said, “An oil spill would be devastating for our country and Region as many Guyanese and Caribbean peoples depend on the Ocean for their livelihoods. That is why we have decided that the time has come to take matters to the court for relief.”

Motorcyclist, pillion rider critically injured after collision at Friendship Two persons are currently hospitalized with severe injuries following a horrific accident at Friendship East Bank Demerara (EBD) on Saturday night.

Police identified the two individuals as a male motorcyclist and a female pillion rider. Investigators said that the last update received from Doctors on their condition was that they were stable.

Janki further stated that communities in Guyana are taking lessons from major disasters like the BP Deep Water Horizon in 2010, which cost the company over

US$65 billion and destroyed the environment and livelihoods.

Unlike the United States of America, Janki posits that Guyana has no experience of oil and no oil/gas experts, engineers and other necessary technical staff to run an oil sector.

She said too that Guyana also lacks the infrastructure to swiftly cap a well and mitigate the damage caused by a potential oil disaster.

Pastor recounts near death experience after being robbed by bandits

A

fter being viciously robbed by bandits last Wednesday, November 2, 2022, Pastor Wendell Jeffrey recounted the traumatic events that took place that day. He said the incident occurred at the Festival City Exit, South Ruimveldt, just a few houses away from his home.

The Pastor recalled that it was approximately 06:00 hrs, when he was taking an early morning walk down his regular route, that he was jumped by three young men on two motorcycles.

“They pulled up from at the side of me and from behind. One of them jumped off from the back of the bike and began violently firing stabs at me with a knife, even as he demanded that I give him what I had,” says Jeffrey.

He said the scary part was that even as he was in the process of handing over his belongings (a cell phone, an electric drill and a book), the man kept trying to stab him and he had to keep evading his knife.

He told Kaietuer News that while this robbery was taking place he mentioned to them that he was a Pastor and conduct activities to rehabilitate men like them.

His words however fell on deaf ears as the robbers had no interest in what he was saying.

described as, “what felt like hours” for a Police Investigator to come see him and he eventually became frustrated waiting and left the station, and refused to further pursue the report he made. He said that since he left the outpost, he has not been contacted by the Police Ranks to follow up.

“I’m done with that (the investigation), I came and made a report as I’m supposed to do. Why would you take my name, number and address in the report and not follow through and contact me? These are the things the Police do. That is why they lose the cooperation of the public” said Jeffrey to Kaieteur News.

700 house lots allocated to Region Five residents DPI - The Central Housing and Planning Authority (CH&PA) took its ‘dream realised’ house lot allocation and title distribution exercise to Shieldstown, Blairmont, Region, Five on Friday.

Some 700 persons were allocated low-income and moderate-income house lots within the Shieldstown Housing Scheme. The lands cost between $200,000 to $500,000 each.

Demi Ameer, a young professional of Rosignol Village was overjoyed to finally receive her land.

Ameer told the Department of Public Information that she is currently living in an overseas-based relative’s home, and achieving homeownership has always been one of her goals.

“It feels really great to finally own a land that I can afford…I want thank the Government for the opportunity to own a piece of land,” she said.

Another beneficiary, Quinland Morian of Number Three Village said he felt proud to finally own land for the first time. He noted that it is a great experience and hopes that other young people make use of the opportunity the Government is offering to attain homeownership.

“It is good for me and my family to own land so we can build a house. I feel proud of myself. What the Government is doing is good,” Morian said.

During opening remarks, Housing and Water Minister, Collin Croal said that the allocation of house lots in the Region will further reduce the backlog of just about 4,000 applications within the CH&PA database.

He said that in just 11 months, at least 1,100 house lots have been allocated to residents of the MahaicaBerbice, with millions of dollars spent to develop the new and existing housing schemes By the end of 2023, Minister Croal noted that at least $4 million will be invested in infrastructure works in areas including Shieldstown and a new area identified in Burma. Among the works to be done will be the construction of roads, drainage, culverts, and electricity and water connections.

This is in addition to a number of infrastructure works being done through other sectors.

In this Region, in various communities, we will see within the next three to four months 138 roads being done,” he told the gathering.

Meanwhile, Minister within the Ministry Susan Rodrigues also spoke of large investments in community infrastructure since the PPP/C Government took office in 2020.

In Region Five alone, she said $800 million was

expended on the development of new housing areas to meet the housing needs within the Region.

“This speaks to the expediency at which we are working. This demonstrates the commitment of the Ministry of Housing…in ensuring that we contribute towards our target of 50,000 house lots by 2025,” she asserted.

CDB calls for new financing solutions US officials worry taxpayers will... to combat climate change impacts

T

he Caribbean Development Bank (CDB) continues to work with countries in the Region to build resilience recognising the impact of climate change on all aspects of economies says Mr Ian Durant, the B a n k ’s D i r e c t o r o f Economics.

“Climate change represents one of the greatest challenges in human history...It is no longer a hypothesis, but a fact that Small Island Developing States (SIDS) are among the most vulnerable to climate change, with Caribbean SIDS especially being exposed to more frequent and intense climate events. Paradise as we know it is under severe threat,” he stated.

Speaking at the Conference on the Economy hosted by the University of the West Indies, Saint Augustine on November 3, Mr. Durant highlighted the Bank’s interventions in the area and advocated for diverse strategies to safeguard the Region’s future. “Sustainable sources of funding for disaster risk management, including increasing access to concessional resources and targeted instruments, is a critical imperative to help the Region build adaptive and climate-resilient infrastructure,” he said.

Building resilience also involves advanced budgeting and planning, The Director indicated, adding that disaster risk management strategies in the economic domain must be

developed and can include natural disaster and pandemic escape clauses in financing instruments, as well as budget reallocation, external credit, temporary tax increases, and donor assistance.

According to Mr. Durant “In small, open economies… where foreign exchange earnings are critical to the orderly functioning of the economy, the interruption and extended loss of earnings erode foreign exchange buffers, interrupt livelihoods, create unemployment and usher in additional complications for m a c r o e c o n o m i c management, frequently requiring countries to seek foreign exchange support, reorder development priorities and postpone the implementation of mediumterm strategies.”

The CDB Executive also said that the Bank recognises that climate change is affecting not only the growth performance and fiscal and foreign exchange buffers, but it is also posing challenges for labour markets and eroding an already fragile physical capital stock. The finance focused initiatives would therefore seek to further curb the negative impact of climate events in the Caribbean.

Employment, income generation, the natural environment, quality of life, food security and production, were among the areas Mr. Durant cited as being negatively affected by climate change.

The Bank has mainstreamed climate change and Disaster Risk Management into its operations, mobilised increased levels of concessionary resources, improved climate resilience in vulnerable sectors, strengthened the environment to support climate resilient measures, and improved the capacity in its Borrowing Member Countries to deliver in this area.

Additionally, CDB has provided technical assistance to support improvements and build resilience capacity in critical areas such as physical infrastructure through building code development, and implementation alongside partner agencies.

Furthermore, CDB has actively pursued research in priority areas to aid in building resilience through expanding access to concessional finance.

It has advanced the Internal Resilience Capacity (IRC) and Recovery Duration Adjuster (RDA) Vulnerability and Resilience Framework to the international community.

These tools incorporate both vulnerability and resilience in addressing development challenges and provide a more equitable yardstick for providing access to concessional finance.

On the local front, Exxon’s affiliate, EEPGL is the operator of Guyana’s lucrative Stabroek Block which has over 11 billion proven barrels of oil. Under a signed deal – the Production Sharing Agreement (PSA) – the oil giant has been taking out money from

day one (2019) of production to set aside as a decommissioning fee.

Based on its 2021 financial statements, for 2020 and 2021, ExxonMobil and its partners, Hess Corporation and CNOOC Group, have recovered a whopping US$355.7 million for decommissioning costs which would be incurred in another 18 years for the Liza Phase One Project.

During an engagement with media operatives in June, ExxonMobil Guyana acknowledged that decommissioning funds are not needed until 20 to 30 years down the line. Be that as it may, the company noted that the provisions of the 2016 Stabroek Block deal allow for early recovery.

The oil giant assured nonetheless that when Guyana needs that money for cleanup, the money will be handed over.

The following day (June 29) the Attorney General, Anil Nandlall SC, MP, announced that the Government would not recognize the promotions

that were made by the Police Service Commission.

The Government has still not recognized those promotions. Some of the ranks have retired and have not benefitted from the increases in salary and other benefits which they would have received had the promotions been recognized by the Government.

How uncaring!

I must add that the Police Service Commission that I chaired promoted hundreds of ranks on December 31, 2018 and 2019.

Had it not been for the order of the court following the challenge by Senior Superintendent Brutus and the other ranks, promotions would have been made on December 31, 2020.

Having regards to the sequence of events outlined above, it is disingenuous of Minister Teixeira to blame Paul Slowe for not promoting ranks.

The Police Service Commission that I chaired did not

consider ethnicity in our deliberations on promotions, or any other matter.

We looked at the criteria as stated in Standing Order 22 of the Guyana Police Force, which includes ranks passing the Appropriate Qualifying Examination, not having disciplinary and other matters pending, demonstrated competence, and not known to be involved in corrupt activities, among others.

I have noted that in the recent promotions, which were hurriedly made by the current Police Service Commission on July 2, 2022, those criteria seem to have gone through the window.

The Minister and her colleagues are very good at propaganda.

Fortunately, the independent and social media provide the opportunity for the truth and facts to be made known.

Baker killed in accident with Ministry’s vehicle A

44-year-old baker was on Saturday killed at Enmore, East Coast Demerara (ECD), in an accident that involved a pickup vehicle attached to the Ministry of Public Works and another car.

The dead man was identified as Anil Ramanand, a father of one, of Logwood Squatting Area, Enmore, who was reportedly heading back to work on his bicycle, when he met his demise in the accident around 16:15hrs.

Speaking with Kaieteur N e w s o n S u n d a y, Ramanand’s mother (name provided) said that her son had left his home that afternoon to complete some work at Budram’s bakery where he was employed.

“He just left he house and was heading back to finish off some work for the boss”, the woman said.

Moments later, they received news that Ramanand was killed in an accident, just meters away

from the bakery.

According to Police, Ramanand was attempting to cross over the Enmore Public Road when the Ministry’s vehicle struck the rear end of his bicycle and flung him into the path of another car.

The driver of the car reportedly could not have stopped in time, and slammed into Ramanand and his bicycle.

The Baker was reportedly killed on the spot after sustaining visible injuries to his head and body.

Ranks who arrived at the scene shortly after, called an ambulance, but the doctor onboard told them that Ramanand was already dead.

His body was removed and taken to Georgetown Public Hospital Corporation (GPHC) mortuary.

Meanwhile, an investigation conducted by the police has revealed that the Ministry’s pick-up was driven by Denzil Mc Bean, 30, of ‘C’ Field Sophia,

Noise alerts resident to find murdered man in front home Late noises on Saturday alerted a resident of Lusignan, East Coast Demerara, to find a murdered man in front of his home.

The dead man was described as an individual of Amerindian decent and according to police is unidentified.

His remains were found around 23:40hrs bleeding from what looked like multiple stab wounds to his neck.

The resident who found the dead man reportedly told police that he was sitting in his living room watching TV, when he heard some noises

coming from outside his home. He went outside to investigate and saw a man lying on the road.

He noticed that the person was bleeding from wounds and contacted Police immediately to respond to and investigate the scene.

The body was clad in a yellow three-quarter pants and a jersey. So far Police have not been able to obtain any information regarding how the man was killed.

Detectives have canvassed the area for security cameras and some were seen close by, but the footage captured on them are yet to be reviewed.

Georgetown, and was the third in a convoy of four Government vehicles with flashing lights and sirens, transporting staff to the city.

The driver of the other car involved was identified as Dorynl Dublin, 24, of Haslington, ECD. Police reported that both drivers were arrested and taken into custody and tested for alcohol in their system but the results came back negative.

As investigations continue into the accident, Minister of Public Works, Juan Edghill assured the dead man’s relatives that his Ministry will allow the police to do their job and not interfere.

He told them this while he and other officials from the Ministry visited their home on Saturday day night to extend condolences.

Edghill also promised the relatives, full support from the Ministry during

their time of grief.

Meanwhile Ramanand’s mother, who could not hold back tears, told Kaieteur News that all she wants is to receive her son’s body and bury it next to his father who had died some two years ago.

She recalled that Ramanand had visited her home on Friday last to discuss plans for his 45th birthday this month.

“He birthday is the 16th ah dis month… He come by we Friday and he tell ah we that he would come the 15th, the day before he birthday, fuh collect he gift and go home back”, recalled the woman.

Ramanand worked as a Baker for many years and was described as excellent one, who loved to make his family laugh with funny jokes.

Ramanand is the 89th victim killed this year in a road accident.

HL Latinoamerica Furniture backs GSCL Inc Prime Minister’s T20 Cup HL Latinoamerica Furniture of Panama has supported the Georgetown Softball Cricket League Inc Prime Minister’s T20 Cup which is set for next weekend in Georgetown.

The entity recently presented a cheque to the organisers and their representative Rafael Chung said they are happy to part of a tournament of such magnitude.

He added that they are looking forward to successful competition.

President of the GSCL Inc Ian John thanked the

entity for their support and said the competition is expected to be keenly contested.

The event, which is being held in collaboration with the Office of the Prime Minister and the Ministry of Culture, Youth and Sport, is expected to comprise a large number of local and overseas teams.

Over one million dollars in prizes will be up for grabs and there will be no entrance fee.

The clubs that benefited are Providence, Farm and Eccles; they received cricket equipment.

The clubs welcomed the gesture and thanked the association.

Individual members may affiliate separately to Archery Guyana if their club does not wish to affiliate but urges more clubs that have been recently formed to affiliate since this expands participation opportunities for club members.

An action packed Saturday evening unfolded at the National Gymnasium as the Petra organized MVP Sports Futsal Tournament continued in both male and female divisions. A total of 28 goals were scored by the ladies on their second night as Fruta Conquerors, GT Panthers and Police romped to victories while the other match ended in a draw.

In the mens division, their six matches also produced a total of 28 goals as the Group stage concluded.

Picking up wins were Tiger Bay, Campbellville, Bent Street and Stabroek Ballers while the other two nail biting encounters ended in ties.

Womens Division…

Fruta Conquerors started the night off with a bang as they demolished Herstelling, 14 0.

Helmet-tricks from the opening scorer, Sandra Johnson (2, 4, 18, 19), and Shania Thornhill (6, 9, 11, 20) led the way for the victorious side. Braces from Jessica Teasdale

(8, 12) and Sabrina Johnson (10, 17) along with a goal each from Hash Holder (7) and Jalade Trim (14) ensured a comfortable triumph by the Conquerors.

The Men s Division produced a total of 28 goals on the final night of the Group-stage.

Stabroek Ballers, Bent Street, Gold is Money, Future Stars, Back Circle and Campbellville were the top teams in each Group, which means they automatically advanced to the next round, while Sparta and Sophia, the best two third place finishers, advanced as well. This means that the victor of each Group has won $50,000, while the second place finishers claimed $30,000, third place finishers pocketed $20,000 and fourth received $10,000.
