

Appeal Court Justice Rishi Persaud on Monday refusedtooverturntheruling of Justice Sandil Kissoon in which he ordered that ExxonMobil Corporation to provide an unlimited parent companyguaranteeforitsoil operations in the Stabroek Blockwithin30days.
When the matter was calledforcasemanagement, a t t o r n e y f o r t h e Environmental Protection Agency (EPA) Sanjeev Datadin requested a Stay of Justice Kissoon’s Order but his request was bluntly refused.
Datadin had asked the Appeal Court to issue the Stay on or before May 9, 2023. Had the Stay been granted, it would have put a holdontheJudge’sOrderfor the company to provide, within 30 days, unlimited Parent Company Guarantee Agreementand/orunlimited liability Affiliate Company Guarantee, together with environmental liability insurance,asiscustomaryin the international petroleum industry Datadin’s Application for the judgment to be suspended pending the hearinganddeterminationof
the appeal was, however, refused, with the Judge indicating that he intends to hear arguments on the reasonable prospect of successandrenderhisruling beforeJune10—thelastday for compliance with Justice Kissoon’sruling.
“We’re opposing any OrderforaStay,”saidSenior CounselSeenathJairam,one of the lawyers representing therespondents,Presidentof theTransparencyInstituteof Guyana Inc (TIGI), Fredericks Collins, and Guyanese citizen Godfrey Whyte.

The EPA had filed a NoticeofAppealagainstthe High Court ruling that is in favour of Guyana receiving unlimited parent company guaranteefrom.EEPGLand its parent company, Exxon Mobil in the event of an oil spill.
In the document seen by this newspaper, the EPA is seeking to reverse the High Court decision on the grounds that the trial court erredinlawininterpretation,
consideration and application of the combined effect of Clause 14 of the Environmental Permit issued to EEPGL, and erroneously concluded that the financial assurance must beprovidedbyEEPGL.

Thatnotwithstanding,he brings into question, his ability to comprehend the Judge's ruling written in plainvanillaEnglish,andthe permit which the Judge describes as “clear and unambiguous terms, words and phrases used in their ordinary,literalmeaningand context.” Nevertheless, for theneedsoftheVP,Iwilltry to simplify the ruling. The meat of the ruling is, as verbatim:
“The Court holds that the Permit Holder is by Condition14:02and14:05 mandated to provide environmental liability insurance”
“The Court further holds and finds that the Permit Holder is mandated to provide by Conditions 14:02, 14:03 and 14:10 a further financial assurance in the form of an unlimited parent or affiliate company guarantee to indemnify and keep indemnified the Agency and the Government of Guyana”
The above, orders enforcement of the existing law compelling: (1) liability insurance;and(2)unlimited PCG to cover all costs for which the insurance is not enough to cover. Note that the Order calls for “liability insurance” and says absolutely nothing about “unlimited insurance” and the bunk about an insurance premium cost to result in “economic disruption”. But that is not stopping the VP from irresponsibly spreading this mischievous untruth. The fact is that the PCGissimplyasignedpiece of paper that doesn't cost a dime, but is downright necessary, because EEPGL, the Permit Holder and operator, does not have any assets (called “assetless” by the Judge) to cover a large spill.Itissolelyasubsidiary
(child) set up as a Limited LiabilityCompany(LLC)of its parent Exxon. LLCs are mainly formed to protect their parent companies like Exxon from liabilities Resultingly, since child EEPGListhelonesigneron alldocuments,parentExxon has no legal connection, obligations or liabilities; thence,whyitisamust-have to hook in Exxon, as the parent guaranteeing coverage of all costs not coveredbyinsurance.
As the distinguished Judgestressed“ifthePCGis inplace,andthereisanevent resulting in the release of hydrocarbons,thenEEPGL, totheextentthatitisunable to do so, as it is largely an assetless subsidiary without financial resources, then EXXON, the Parent Company comes into play. Recently, readers have been supplied with many comments concerning the ratings of our country Guyana in the international concept of freedom of expressionasrepresentedby thenewspapers.
What particularly attracted me, because it was notstrangetousascitizens, was a statement by a highly placedstatesmanwithmuch executive power, the Vice PresidentMr Jagdeo.
This executive member is reported as saying that he blames the Guyana Press Association for reducing Guyana's place in the international ratings of where countries stand in freedomofexpression.
This may look like a chance remark from a politician,butitismorethan thattome.
When the appointments of acting members of the judiciaryandthewholeidea of their appointments as
permanent jurists were last aired this very functionary, the Vice President, Mr Jagdeo, made a comment excusing the delay on the part of the President in gettingdowntonegotiations abouttheappointmentofthe actingjudicialfunctionaries. Mr Jagdeo said something to this effect that the Presidentwasnotreadyyet; he had to look at the track record of the persons concerned.
In other words, he is tellingusthatwhenitcomes to appointing judges, the presidenthastolookathow theydecidedcasestolookat their track records. I don't knowwhatelsehemeansby trackrecord.
So, is this an admission that the president, in appointing the Chancellor and the Chief Justice, will Americanize the system, so to speak, and takes note of how judges have decided cases?Idonotwanttodraw further conclusions, but this

Attorney Jairam submitted that the EPA (Appellants) was in contemptoftheordersmade by the High Court His contention was that the Agency ought to bring itself into compliance with the rulingoftheHighCourt.
It was made known by Datadin at the hearing yesterday, that our PPP's Attorney General has filed a motion to join the substantive appeal when it comes up before the full bench of the Court of Appeal. So, the People of Guyana has won Round 2. EPA/Exxon must comply withourrules.

In GPA's database, there are a total of 223 persons listed,andthoughtherecords show that more than half of themareactivelyengagedin journalism as set out by the Constitution of the Press Association, a significant percentage has transitioned to other professions within the field of Communication and are, therefore, no longer full members, but rather associatemembers.Itshould be noted that only full membersareeligibletovote accordingtotheConstitution
On April 27, 2023, Mr Marks made representation for persons practising journalism for three or more years to be allowed to register, and to have their applicationsprocessed.
Taking Mr Marks' concerns into consideration, theExecutiveagreedtoopen the process to new members as well However, as p r e s c r i b e d i n t h e Constitution, those applicationswouldfirsthave tobevettedbytheExecutive before approval could be granted,astheprocessisnot automatic. In the past, the association received applications from social media commentators and even drivers. In some cases, applicants failed to provide any details to aid in the processing of the applications.

Given that the deadline for the payment of dues was quickly approaching, as Secretary, I made contact withtheChiefReporteratthe Guyana Chronicle, and indicated that I would be visiting the media house to uplift dues. Upon doing so, six persons had their dues updated, one of whom has been a practising journalist and editor for well over two decades and had served on the Press Association in years gone by Another five have been in the profession for well over eight years. Importantly though, GPA's financial records show that all of them prior to May, 2023,hadupdatedtheirdues in2017,2018and2019,and therefore could not be deemednewmembers.
AttheNewsRoom,dues werepaidforthreemembers, two of whom had served on the Executive of the Press Association The other person has been a long-time member of the association andhasparticipatedinmany of our training programmes and awards. In fact, Mr Markswaspresentwhenthe dues were uplifted, and he wouldagreeduesfornonew memberwerereceived.
At the Kaieteur News, the company paid for 17 existing members of the Association, all of whom have been in the field of journalism for well over three years, some stretching decades, and the records would show that no new member was registered duringthatvisit.
The Guyana Times was subsequently visited, and there, dues for four editors were uplifted – all of whom are existing members of the Association.

ThisisaccordingtoFormerAmbassador and Professor, Dr KenrickHunte. In a letter published in Tuesday’s edition of this newspaper, Dr Hunte used the estimated number of barrels of oil in the fifth oil field, Uaru, along with other variables to draw his conclusion.
Referencing two previous articles published by Kaieteur News, the Professor said he was specifically disappointed that Guyanese are being taken advantage of “in broad daylight” as the country is being left with“crumbs”whileExxontakesthe“cake”.
He said, “I was again disappointed that thepeopleofGuyana,inbroaddaylight,were being taken advantage of, given the small share of the total revenue (14.5%) that Guyana will receive from a non-renewable resource that will be exhausted in or before 2034.”
Theformerdiplomat,whoholdsaPhDin Economics / Rural Finance Markets, a Masters in Economics from the Ohio State University and M Sc and B Sc in
Agricultural Economics from the Utah State University, compiled his findings in a table, attachedtohiscomments.
He pointed out that approximately 812 millionbarrels of oil will be produced at the Uaru development at an average of US$70 per barrel. This relates to a total revenue of US$56,840,000,000. Notably, he outlined that Guyana’s share is only 14.5 percent of this amount, which accounts for US$8,241,800,000 Meanwhile, Esso ExplorationandProductionGuyanaLimited
(EEPGL),theoperatoroftheStabroekBlock andExxon’ssubsidiary,isestimatedtobaga share of US$48,598,200,000. In asserting Guyana’s “disappointing” share from its resource, Dr. Hunte highlighted, “For every US$1.00 that Guyana receives for its oil, EEPGLreceivesUS$5.90.”
The Professor described the situation as “inequity and unfairness” since out of Guyana’s share of US$8.24 billion it must pay the taxes of Exxon, pay insurance costs andfortheconductofoilaudits.Thenationis alsoexpectedto“allocatemoneyforclean-up costatdecommissioning;disbursemoneyto fishermenforthelossinincome;andsetaside moneyforfuturegenerations,”heargued.
Dr Hunte said Exxon’s comment that “the company’s approach has resulted in tremendous financial success…” and Hess that“successfulexecutionofourstrategy(at EEPGL) has uniquely positioned our company to deliver significant value to shareholders for years to come…” has allowed Guyana to see the inequity in
distribution of the resources being extracted from the Stabroek Block. He said, “Thank you Kathy Mikells, and John Hess for opening the door for us to see the cake EEPGL will receive as against our crumbs; for out of every 100 barrels of oil extracted from our patrimony, EEPGL captures 85.5 barrels,whilepoorGuyana,theownerofthe resource,receives14.5barrels.”
In light of Guyana’s meager share of its oil resource, Guyanese have been calling on the government to renegotiate the 2016 ProductionSharingAgreement(PSA)signed with Exxon and its partners to rake in additionalrevenueforthecountry.

Two recent incidents indicate that nothing has changed. The first was last Sunday's election of the Guyana Press Association (GPA).
The second was the comments on the social media blog of one of Guyana's leading media personalities, concerning the end of the tour of the outgoing United States AmbassadortoGuyana.
The election of the executive of the Guyana
Press Association was marred by controversy One of the major areas of contention was the failure of the GPA to make public the list of persons who were eligibletovote.
The GPAsaid that it was not going to do so in order becausesomeofitsmembers wanted their membership to be kept confidential. That was a cock-and-bull explanation because their names and participation in the poll would have been made public in any event on thedayoftheelection.
ThisisthesameGPAthat forms part of the press in Guyanathathasanobligation to exercise oversight over government.
Yet, the GPAdid not see how the failure to make public the names of the eligible voters would render theelectionasnotbeingfree.
Each prospective candidate has a right to be abletolobbypersonstovote forhimorher Ifonlycertain persons have access or knowledge of those who are eligible to vote, then these persons have an unfair advantage, one that is sufficienttocallintoquestion thefreenessofthepoll.
Also, the failure to publish or make public the names of the eligible voters means that the list could not
be scrutinised to determine whetheritwasclean. Itdoes notmatterthattheincumbent won the elections convincingly What is disconcerting is that membersoftheFourthEstate who are supposed to be watchdogs of public and political morality could remain so relatively silent in what was clearly and unfair decision.

Several teachers across Guyana will benefitfroma‘trainthetrainers’programme through the Guyana National Road Safety Council (GNRSC), allowing them to incorporate road safety into their teaching sessions.
The initiative is geared towards increasing awareness of the importance of road safety at the nursery, primary and secondary levels, the Department of Public Informationhasreported. Under the syndicated loan agreement, the preferred rights go tothoseinvestors–meaningthatin the event of the hotel being unable to service the loan – the unknown investors would have the first lien ontheproceedsofanysale.

One month later, NICIL announced the Government’s decisiontosellthehotel.InMarch 2023, Jagdeo revealed that despite the criticism the hotel faced when
the construction was announced –the hotel has emerged as a profitableventure,butjustifiedthe sale of the hotel by stating that it wasabusinessdecision.
In fact, the VP said during a press conference that while the hotel is making a profit, it is of no supremebenefittotheGovernment owning it anymore Jagdeo continued by saying that within a few years several hotels are expectedtocomeonstreamandin order to avoid competition, this is thebesttimetomaximisetheprofit andsellthehotel.
According to Jagdeo, the proceeds of the sale is to be used, “toclearofftheremainingloanand some of it will come back to the Treasury to be used back for
whateverpurposeisdetermined.” Notably, a decision by the former administration has resulted inUS$1.1million($226million)of taxpayers’dollarscomingoutevery six months (since 2017) to service the US$27 million loan from the bank – for a 13-year period. This was after the hotel was unable to servicetheloan.Inordertoprevent the hotel from being acquired by thebank,theformerGovernmentin April 2017 made the decision to transfer the hotel’s financial obligations to the Central Government. However,VPJagdeo statedthatwhileinOpposition,the People’s Progressive Party (PPP) administration was opposed to the hotel’s financial obligation being transferred.

Jordan was freed of the charge alleging he misconducthimselfinpublic office by selling State property way below market valuetoBKMarinesLimited at a price that was grossly undervalued.

Mr. Marks alleged that during the AGM, the Secretary admitted that she signed up members on the spot, meaning new members. This claim is nothing but baseless.
At the General Members Meeting, I explained that while at NCN, an editor, who is no stranger to the media fraternity having practised for many, many years, indicated that she was a member and had participated in previous elections. Though the document in my possession did not include her name, the editor's dues were received, solely on the grounds that she was an existing member. The Executive was informed, and subsequent checks confirmed that the editor joined the association on March 1, 2015.
Mr. Marks claimed that while the 'outreach' was done at some media houses, it was not done at others where the Executive believed members would have voted for him. Again, I would like to point to the fact that only five media houses were visited by the Secretary – NCN, Guyana Chronicle, Guyana Times, Kaieteur News, and the News Room, where Mr. Marks works as an editor.
It should also be noted, that a purported petition issued by Mr. Marks was signed by four of the five media houses visited by the Secretary. No editor signed or was part of any petition. It just stated "editors" so we could not even verify whether those unnamed “editors” are currently financial, non-financial or aspiring members. There was absolutely no evidence upon which to act. Again, an absence of names. No self-respecting person should provide such vague information, and neither should any selfrespecting individual or organisation take such drivel
seriously.
In his letter, Mr. Marks made claims that persons who were not qualified to vote – a taxi driver, a farmer and a handyman – voted. It is clear that Mr. Marks has made a total mockery of himself by making such wild allegations.
Importantly, many media workers not only engage in their core responsibilities of gathering and dissemination of news, but also produce and host other programmes, even while serving as a full-time member of a media house.
The GPA is a voluntary professional organisation. Membership is voluntary and so it is the onus of members of the media to be registered and become financial. No sitting executive is required or compelled to go anywhere to collect dues.
Based on legal advice sought, the membership list or the list of eligible persons could not have been provided beforehand to a third party. However, any member is free to call and ask about his or her membership status.
The decision not to disclose the list prior to the elections was further reinforced after receiving additional information and confirmation from Executives at the GPA's last executive meeting about prevailing fears by a number of State Media operatives about their membership of the association being known prior.
Indeed, the fear is so deep that a number of State Media
workers had in the past requested their participation in workshops and other training exercises be kept strictly confidential. We are advised that State Media journalism practitioners have been prevented from participating in GPAorganised training sessions and workshops. Similarly, practitioners from a number of privately-owned media houses have not participated.
Mr. Marks knows all too well that electoral victory never comes on a platter. He should stop behaving like a champagne socialist and go out and campaign with policies and programmes that will hopefully be a true reflection of what he stands for. In previous competitive elections, Mr. Denis Chabrol and his team travelled throughout Guyana and did not request or depended on the existing membership register.
That said, no election is perfect but clearly the numbers were stacked against Mr. Marks. The electorate rejected him resoundingly. Based on the results of the elections, 25 members voted for Mr. Marks while the majority, some 70 members, voted for Ms. Nazima Raghubir to be reelected President. There was one spoilt ballot.
Mr. Marks clearly appears to be part of wider historical campaign to discredit the GPA as the alternative to certain defeat and independence.

Despite his deep-seated concerns about Electoral malpractice, he must be commended for contesting the elections and participating in the meeting after the results were declared. Had he won the elections with the same arrangements that he challenged before balloting, would he have challenged his own victory with such worn out and baseless arguments?
In conclusion, as former Secretary of the Press Association, I reject Mr. Marks' baseless claims that the members register/voters' list was padded and that the Association's elections were rigged. This is a mischievous lie.

We have seen in this country many times over, where some media, owned by individuals that have political or commercial interests, deliberately choose to provide coverage that is favorable to their interests. These actions usually result in the suppression of stories that are unflattering to the organization or the individuals that own it. Some media owners have even weaponised their private media to attract individuals, political parties, and organizations they are opposed to. These observations must compel the GPA to act to curb those occurrences.

Editor, with the press having such a crucial role to play in society, it is extremely important that press associations remain independent. Equally so, for Guyana's Press Association to also exhibit independence in every sense and have an apolitical posture, especially those in the leadership and who aspire to be.
The independence of Guyana's press is critical for it to serve effectively and be respected as the fourth estate of the country. This means that it is vital for them not to be seen as supporting any political party, in government or not. Equally, so be in supporting the interests of any political leader or interest
Mr. Editor, the aforementioned factors are of utmost importance for press associations to remain independent where ever they exist. The public expects and therefore exhibits confidence that the media provide it with information that is objective and credible. This cannot happen if the media is perceived to be partisan. The independence of press organisations is also instrumental in promoting media plurality, which is vital for the promotion of democracy. This requires the media to reflect the diversity of opinions within society and to cover events from different angles. Hence, the opposition positions must also be given equal space in the media. The Guyana Press Association and several independent media have a lot to do to gain public confidence. Don't throw stones when you live in a glass house. The body of boat captain Lloyd Obermuller, one of three men who went missing after the boat they were travelling in collided with another on Monday has been found.Thetwoothermissing menareyettobelocated.

The Caribbean Regional AntiDoping Organization (RADO) has announceditsfocusforthenextsix months, with Code Compliance, Education, and Testing being the toppriorities.
The organization, in a release, saidtheyaimtoprovidesupportto its Member Countries in completing the upcoming World Anti-Doping Code Compliance Questionnaire (CCQ), which will assess the implementation of the 2021 Code and International Standards.
PatrickWerleman,Chairmanof Caribbean RADO, emphasized the importance of compliance and stated that his organization would help its member countries throughout the process to ensure that they are not deemed noncompliant In addition to compliance,education,testing,and training are also high on the regionalagenda.
Werleman highlighted the challenges facing anti-doping programs in the region, with resourcesbeingamajorhurdle.

Course is set to bowl off at 9:00hourssharp,dailywith the first session commencing on Thursday, May 18, and wrapping up on Sunday, May 21. The theory component of this CWI Level 2 Coaching Course will be held in the Conference Room of the GNS,Providence.

The three-team event also included Jai Hind CC of Albion and was sponsored by former Guyana player, Hemnarine Chattergoon, in memoryofhisparents.
Rain delayed the start by over three hours and forced the board to reduce the first matchtotenoverspersideand the finals to thirteen overs a side.
In the first match, Fyrish chalked up 117 for 3 off their ten overs with K Subramanie stroking an attractive 70 not out.D.Ramoutartook2for16 for Jai Hinds, who in reply reached 90 all out in 10 overs as Hassan Hussain scored an attractive 50.
