Exxon contract silent on whether royalty is recoverable ...but clearly states what can or cannot be deducted T

he Production S h a r i n g Agreement (PSA) that Guyana signed with ExxonMobil subsidiary Esso Exploration and Production Guyana Limited (EEPGL) and their partners for the Stabroek Block, Hess Guyana Exploration Limited is very specific on cost recovery.

Under the terms of the PSA signed in 2016, up to 75 percent of the gross production of crude oil can be deducted as cost oil for e x p e n s e s .

In that PSA, there are essentially two categories, spending that can be recovered by the contractor, “without the Approval of the Minister,” instances where deduction can be made subject to the approval of the minister.

A third category exists however where there are very specific exceptions where there is no recovery whatsoever such as provided for under Article 3 of the PSA which demands a Guarantee to be paid over to the state shortly after signing.

Another specific spending that has been blocked for deduction out of oil such as penalties to be imposed on the company by a Guyana

GRA Commissioner General, Godfrey Statia court, or the costs related to arbitration.

Other specific spending that has been explicitly spelled out as not for recovery is that of costs incurred as a result of negligence on the part of the oil operator.

In total, in the Annex of the PSA, which outlines which items are specifically not to be recovered, there are seven such instances.

Another aspect of the criteria for recovery or not can be gleaned from the charges that have been identified and specifically earmarked for Ministerial Approval.

These include,

Commission payments made to intermediaries, contributions or donations to organisations in Guyana, and expenditure on research into, and development of new equipment and techniques for the oil operations.

There are also a total of 13 wide-ranging clauses, with even more sub-clauses highlighting in detail what the company is allowed to recover without the approval of the minister ranging from surface rights cost in acquiring the oil block to decommissioning costs to be used some 20 years later.

In such detail is the breakdown of spending that from holidays and transportation of staff, travel and expense of expatriate staff. Charges for payments for services and the hiring of affiliate companies have been catered for in the PSA as being recoverable, purchases of materials to run the operations. There is even a provision for the recovery when buying used goods.

The contract says those can be recovered providing the item purchased is had at 75 percent of the cost of a brand-new item. Rentals, duties, levies, taxes, insurance and losses, legal expenses, training costs,

general and administrative costs, production costs, development costs, exploration costs, pre contract costs and even interest payments have been identified as being recoverable without the approval of the Minister, “including any other assessments and charges levied by the government in connection with the petroleum operation and paid directly by the contractor.”

Royalty is not mentioned a single time when it comes to what is recovered with or without the approval of the minister or explicitly barred altogether.

Commissioner General of the Guyana Revenue Authority (GRA) Godfrey Statia over the weekend in anattempt to provide some clarity on the matter of royalty had said, even though Section 3.4 of Annex C, vests the power in the Minister to

determine the recoverability of an expense not covered under the provisions of Section 3, “such discretion has not been exercised by the Minister relative to Royalty.”

He did confirm that royalty is not explicitly mentioned as cost recoverable under Annex C, Section 3.1 (without further approval of the Minister) or 3.2 (with approval of the Minister).

is name is Rusty Bowers and it is an unknown one to most Guyanese. But he is the Arizona House Speaker, a Republican party member, a voter for the former American President, and a man who plans to do so again. But one thing that he will not and cannot do is be a part of any scheme that makes him “a winner by cheating.”

This is what Mr. Bowers spoke of in tearful testimony before the House of Representatives January 6 panel investigating the stormy, and still dispute-filled, U.S. presidential elections of 2020. “I do not want to be a winner by cheating” has the ring of a man of impeccable honour and one of deep beliefs. Mr. Bowers comes across as just such a man. He stands as an example that puts to shame his fellow Republicans in America, who extend and deepen the polarisation ripping that country apart. It is of a man, a political figure no less, and one caught in the furnace of a most trying personal and national political moment, who rose above the rest of his peers.

Again, the Arizona Speaker stands as that standard, that role model, to which not only Americans should aspire to and strive for, but also all of us everywhere. This includes Guyanese over here in this tiny, torn, and tortured land.

Guyanese have experienced repeatedly, in elections after elections, the wounds that will not heal, and which only widen and ripen and poison one and all still some more.

There is so much we can learn from a stalwart like a Mr. Bowers, in whatever form he or she takes and comes, from a figure as determinedly and powerfully luminous when the times are raging, and at their darkest, most dangerous.

For when we have that kind of honour and that kind of bearing before whatever God is believed in, then it is what brings us to a place where we can be comfortable in ourselves with saying: not this way, not this time, not on this watch. Leaders are not forced to backtrack or hide; they are not put in that position where they have to create new lies to plaster over old lies.

Since they were not about lying or falsifying in the first place, then there is no need to waste time and energy in defending the record or any revelation that points to some twisted practice. Any claim that come from any corner would be what can only be of the distorted, and so dismissed with disdain (and without any further need for more deceptions).

Leaders don't have to play games with what they did or didn't do with oil wealth and oil prospects. The truth is the truth, and so are facts that are irrefutable because they are irreversible, and no one can contest their authenticity or their validity. Supporters do not have to bend over backwards, and come up with any kind of craftiness, to prove how loyal there are. Rather they stand for what is straight and true, and like Speaker Bowers, know that there is only one way to go, a place that they must. It is for what is right, and what will not tolerate any interference or resistance from any source, no matter how powerful, no matter how loved.

It is clear that Speaker Bowers, a man of that rarest of mixes, a politician and a practising and devout Mormon, knows where his first priority, his closest allegiance must be to, and that is what places him on this earth, and prompts him to live by a certain infallible code. Man can be disobeyed and distanced from, especially when he engages in the questionable, the borderline, and what is outright wrongdoing.

But one's code of conduct, laced with integrity and honesty and honour, are what will see through any day, and against whatever comes.

We have our terrible troubles here, and we will fuel them when we continue to go down the same road and not stand up for ourselves. When we refuse to be shining lights for what could make our society better, then we drag it down and destroy it, like we have always done.

Dear Editor, In my opinion, this contract should be considered null and void for the following interim reasons: 1) This contract was not made in good faith, good intention, is biased and is not consistent with minimum international contracting requirements, practice, guidelines, procedures and laws.

2) This contract is a production sharing contract/royalty (PSA), where Guyana is technically a partner, a beneficiary, and must have a full time staff/inspection for

verification of quantities/quality of the product, all resources, all works and costs, from the upstream to midstream to downstream. The fact that this is not in the contract is enough to legally terminate this contract. This will be construed as a deliberate attempt to hood wink the reasonable share of Guyana.

3) Further, with item two above, Exxon stipulated that the government must give a number of days of notice for inspection. This is enough to pronounce this contract null and void. Was a deliberate act.

4) The scope of work was

not well defined, into unit rates, lump sum, variations, extra work, estimated quantities, a bill of quantities, resources, etc.

Items of work must be quantified and qualified.

5) The contract did not itemise nor clearly generalise activities with resources and estimated cost 6) The general conditions and special conditions were not elaborated minimally, to give an ample picture of the activities of the contract, as stated above, this appear to be deliberate.

7) The government must have the authority to verify the activity of work,

resources and cost per activity, and all expenditures, give an approval/no objection, an inspection team.

8) The contract did not state that the government inspection team must meet certain qualifications/criteria, training, organisation chart, metre calibration and reading, number of inspection staff at a time on site so that they will not be an obstruction to works, health and safety issue, etc.

9) The exploration cost is the cost of Exxon and not Guyana. What if no oil was (Continued on page 6)

PAY-ON-BEHALF AS A TAX CONCEPT? IT IS A FRAUD DEAR EDITOR, The Executive branch of government and the GRA, a government agency, have finally decided to come clean on some very important provisions on the Oil Contract. They are at once revealing – and they are outrageous frauds and violations of all standards of decency.

How well known is the Pay-on-Behalf concept in Oil Contracts – as in 'GoG is required to pay Oil Companies' legal obligations to itself'? Further GoG is required to pay it out of its (GoG's) share of profits. From Commissioner Statia's press release, it goes like this: Oil Companies figure out their tax liability,

prepare a tax invoice, send it GoG – and the GoG, with no money received, issues a tax receipt for the full amount of taxes due. This is not confusing. It is in fact very clear. And, it is fraud perpetrated on host country, Guyana.

Why not say, GoG waives all O.C. taxes for the life of the contract. No, it needs tax receipts whose only purpose is to commit another fraud, so it devises/invents concepts like “Pay-on-Behalf”. And, to implement this concept, it throws the whole National Accounting system into a dark hole.

Mr. Statia went on to explain: The effect of this procedure of complying

with the provisions of the contract will be nil on the Consolidated Account.

What Statia means to say is that there will be no bookkeeping entries on the books of Guyana – but a tax receipt will be issued to the Oil Companies.

No cheque for taxes paid will be issued by dept of C. F. to GRA. And, that's the only reason the “effect will be nil”. No cheque issued; no book-keeping entry. Impact on Consolidated Fund: Nil. It is a well-planned, well executed fraud. This fraud is inserted into the Contract, which VP Jagdeo is in the habit of defending under the b a n n e r, “ S a n c t i t y o f Contract”. He is sanctifying fraud.Steve Coll in his

Exxon book (page 159) devoted much space to describing this Oil Contract.

He did not use the word, scam – but what he described is the exact definition of a scam pulled off on oil-host countries on Chad and now, Guyana.

Mr. Jagdeo should now feel emboldened to take action to have all the fraudulent clauses in the contract removed. It is at once cheating GoG of billions of dollars on the fiscal terms of the contract, and worse, it is national humiliation of the Guyanese people.

This fraud must not be allowed to be swept under the rug.

DEAR EDITOR, First, let me be clear, the agenda of the Organization for the Victory of the People (OVP) is not set by Vice News.

This US based media outfit is well-known for going into socalled Third World countries such as Guyana, with their Western bias and agenda. It is time the people of Guyana set their own agenda and stop allowing themselves to be mired in the false narratives and confusion perpetrated by the two major political parties and foreign entities - both business and media outlets.

We did not need Vice News to tell us that our politicians are corrupt. This is not news to the people of Guyana. Every Guyanese, from seasoned political commentators to any man or woman stopped in the streets for a comment, could tell you this.

It is important to note that corruption is not something specific to so-called Third World countries. The idea that it is only countries in the Global South that suffer from corruption, and that Western countries are somehow upright and squeaky clean is absurd. It is an idea used to reinforce the West’s racist and paternalistic narrative.

‘Corrupt politicians’ is a global phenomenon that is brushed under the carpet when it occurs in the US, Canada and Europe. Cases such as the recent debacle with UK Chancellor of the Exchequer, Rishi Sunak and his wife, the US President’s son Hunter Biden and his contracts in the Ukraine, the Clinton’s in Haiti, the many corporations who made a fortune from the destruction of Iraq, Afghanistan, Libya and other countries are just a few examples. Of course, the Vice News documentary will be used as a political football by the two major parties, and as always, the real and important issues at stake will be lost.

Bharrat Jagdeo, in his interview with Vice News, talks about Guyana’s undemocratic culture going back to the early days of PNC/R rule, stating that this came to an end when the PPP/C was elected in 1992. The question becomes how much longer are we Guyanese going to tolerate such blatant falsehoods

and outright nonsense? The truth is both major parties have engaged in wholesale corruption, can be accused of treasonous behaviour and have sold out Guyana’s patrimony since the PNC/R government of Desmond Hoyte came to power in 1985. In fact, the PPP government from 1999-2011, led by Jagdeo, was arguably one of the most corrupt governments Guyana has ever seen. During that period, we all know that Guyana was turned into a narco-state, where political assassination became the order of the day.

We, the people of Guyana, need to understand two things about the recent Vice News exposé. One, is that if we are going to examine the idea of “Guyana for Sale”, then we should look at every instance where foreign capital has been allowed to enter Guyana and plunder our resources and how this has been facilitated by both major parties and their surrogates. OVP has been talking about this “plunder by invitation” for years. There was the Canadian based gold mining company, Omai, extracting an estimated 3.9 million ounces of gold between 1993 and 2017 and never paying a cent in taxes, claiming they never made a profit. In October 2020, they entered into negotiations with the present government to return to Guyana. We must demand an answer from APNU+AFC Minister of Natural Resources, Raphael Trotman, as to who ordered him to sign the treasonous contract, one of the most exploitative and lop-sided contracts in the history of the global oil and gas industry, with the US imperial entity, ExxonMobil. There was Barama and Bai Shan Lin, and the list goes on. Then there is the issue of local big business passing fat envelopes of money as ‘donations’ to both parties every election, and reaping the rewards of these ‘donations’ with big contracts, concessions, tax breaks, land handouts, etc., no matter which party forms the new government.

As OVP has always pointed out to the Guyanese people, we too often focus on our domestic situation as if

the outside world does not exist and does not impact us.

Right now, a global reset is taking place. The US and West European countries are in decline, and Russia and China are asserting themselves economically and militarily, challenging the unilateralism and hegemony of the US Empire. In this context, Vice News exclusively focusing on Chinese investment in Guyana, while failing to mention US, Canadian and UK-based companies and their well-documented corrupt dealings in Guyana is most interesting and revealing. The anti-Chinese rhetoric comes as no surprise. It is fuelled by the ABC countries and is being propagated all over Africa, the Caribbean, Central and South America and throughout the Global South. Hillary Clinton, during her time as US Secretary of State, toured Africa, to warn African leaders to beware of China’s agenda in Africa. She insinuated that unlike the US, China would not uphold democracy and human rights.

African leaders could not hide their amusement. After all, despite the fact that all superpowers have their downside, it could not be ignored that China did not have colonies in Africa, or for that matter anywhere in the Global South, as Europe did. China did not capture and enslave Africans as the West Europeans did, and did not benefit for more than two hundred years from the free labour of captured Africans as the US did. And the fact remains that China assisted many colonised countries in Africa and throughout the Global South during their struggle for independence and against Apartheid.

Many globally renowned political commentators have pointed to the fact that the US and Western Europe are clearly threatened by the reality that countries in Africa and throughout the Global South are increasingly opting to deal with China. This is not (Continued on page 6)

Evidence suggests that Minister of Amerindian Affairs Honourable Pauline Sukhai has launched out on a mission to remove elected Indigenous Leaders whom she perceive as non-supporters of the PPP. In this regard, the minister is treating with politically inspired petitions calling for the removal of selected leaders in the Rupununi, perceived as non-supporters of the PPP. Swiftly and maliciously, these petitions are resulting in the establishment of unlawful committees of investigation and the suspension of elected leaders. The determining authority is the Sukhai Court of (In)Justice (SCJ).

The most recent victims are Marlon Edwards, Toshao of Karasabai and Erlene McDonald, Senior Councillor of Parishara.

In Edwards’ case, he stands accused of financial impropriety. In the case of McDonald, it is alleged that, “Ms McDonald has been observed to be anti-government without remorse. She does things contrary to expectations of the current government (administration).”

The minister’s decision to suspend McDonald is a clear indication that it is now an offence for an elected Indigenous leader to do “things contrary to the expectations” of the PPP. While allegations of financial impropriety are serious and require investigation, it is ridiculous to remove someone from office for allegedly doing things contrary to the PPP’s expectations. It is not provided for in the law. It

When Indigenous Peoples in the Berbice River Villages of Hururu and Wikki/ Calcuni presented petitions seeking the removal of their (PPP aligned) respective Toshaos, the minister shut down those petitions. In the case of Wikki/Calcuni the allegations relate to, among other things, the harvesting and removal of the merchantable timber stand – the Village forest - without the approval of its owners, the people of the Village. The forest repopulation could take as long as forty to eighty years.

The allegations against the Wikki/Calcuni Toshao are grave and the damage that the inaction of the minister will cause will take multiple generations to repair. Why did the minister omit to order an investigation in this particular case?

The allegations against the Toshao of Hururu are very similar to those made against Toshao Marlon Edwards of Karasabai. The Hururu matter was swept under the rug while the Karasabai matter resulted in the suspension of the Toshao and the ordering of an investigation. By what logic does the minister determine that two matters which are so very similar in nature be subjected to totally opposite treatment?

Investigation committee: With respect to the establishment of a committee to in-

a petition for the removal of an elected leader from office, the Amerindian Act provides at Section 28 (1) and (2) as follows: 28. (1) “The Minister shall appoint a committee of three persons to carry out an investigation under section 27.

(2) “The National Toshaos’ Council and the Regional Democratic Council may each nominate a member to the committee”.

There was the malicious removal of Toshao Marbel Thomas of Campbelltown, a Village in Region Eight soon after the PPP took up office.

That was a kangaroo court – a Sukhai Court of (In) Justice.

Justice was denied from the establishment of the committee of investigation based on questionable allegations right down to the Toshao’s eventual removal from office.

The RDC was not in place.

Councillors had not taken the oath of office and could not have lawfully identified a representative to serve on that bogus committee. This time, there is no constituted National Toshaos’ Council executive body in place. The NTC is not in a position to identify a representative at this time. There is no statutory body to name the representative. It is clear that, these investigation committees are not properly constituted and anything that flows from them will obviously be of no legal effect.

Regardless of how one views this issue, it is clear that, the minister is abusing the powers of her office and (Continued on page 6)

No one must be allowed to monkey around with the criminal justice process DEAR EDITOR, I recently read with keen interest articles in the Stabroek and Kaieteur News about Justice Sandil Kissoon setting free Marlon Garnette, a murder accused who pleaded guilty to the lesser count of manslaughter. In the opinion of the judge, the prosecution did not produce enough evidence to convict Marlon Garnette of the charge, so the accused walked free.

According to both articles, the Director of Public

Prosecutions (DPP) said, “Self-defence is an issue to be decided by the jury. The jury is the judge of the facts of the case. The trial judge is the judge of the law.” If those words were in fact uttered by the DPP, it is shocking.

I had a little bit of legal training, benefited from direct legal instructions, did some research and also learn by osmosis. Therefore, I can understand simple legal process and most of all, I have some amount of commonsense which is not always common

in everyone or common places. Criminal prosecutions have a rigorous standard: proof beyond a reasonable doubt. That is the basis on which someone is charged or not charged. There must be no exceptions and no one must be allowed to monkey around with the criminal justice process - who to prosecute, who not to prosecute. There must be a massive wall between criminal justice decisions and politics. We must not tolerate anyone to break through that wall. It must be absolute. Article 187

of the Constitution of the Cooperative Republic of Guyana gives the DPP the supreme authority as it relates to criminal prosecutions apart from court-martial, if he or she considers it desirable to do so. Whenever there is any doubt about any matter, the DPP must not send the case for a magistrate or judge or jury to deal with it. The DPP must cause the doubt to be cleared up or nolle pross the proceedings as was done on numerous occasions. In local language, “stop the dance

right there.” We have had too many cases in court whereby persons were charged without proof beyond a reasonable doubt. The cases were sent to magistrates or committed for judge and jury trials. We are aware of the expected outcomes - no conviction. In many instances, the accused after years of continuous incarceration was set free, because there was no evidence to convict them. The case alluded to above is a prime example. In many cases, the Government was compelled to pay millions

of dollars in compensation to the victims whose personal and family lives were shattered.

However, they successfully sought and obtained legal redress against the State. The Attorney General recently lamented about this fact. Let us stop the miscarriage of justice. The rule of law must prevail.

I rest my case.

Only thanks and gratitude for the lower levels of public servants DEAR EDITOR, Please allow me a space to wish each and every public servant in this country a happy belated Public Service Day. Special kudos to the teachers, the doctors, the nurses and the police for doing the job, particularly those who found a way to make their work meaningful. We should not just keep our thanks for the seniors; however, as the cleaners, the typist clerks, the labourers, drivers and office assistants as well.

Editor, I note with deep concern that only thanks and gratitude is being expressed to the lower classes of public servants, many of whom go beyond the call of duty to serve the public, and yet do not get paid any overtime.

Many serve for years and years and never see a promotion. I recall a Ministry thanking someone for serving 20+ years...as an Accounts Clerk.

Imagine that, serving for 20+ years and getting the retirement package of a GS 2 employee. That Ministry ought

to be ashamed of themselves.

And not just that Ministry.

Nearly every Ministry and Government Agency in this country practice this same nonsense. It is no wonder that the young people use the public service to just save and get out as soon as possible.

There is no incentive for them to move up and have a career in the public service. All this is frustration for these young people who simply want to do good, efficient and effective work. Instead, what they get is an insecure bunch of su-

contaminants, oil spill as an example, contaminants will be transported to land, where non porous containers is required temporarily to hold, then to incinerators, then to clarifiers and must be done under protection for the air and the high water table of Guyana.

13) Exxon past record of doing business with integrity leave much to be desired.

14) The taxation, local content was not well defined, leave the government so opened, that this is not a contract.

15) In layman's terms, a contract must have activities/ scope of works, resources, legal descriptions, costs/estimated costs, so that when the quality/quantity, costs of the undertakings are assessed and verified, you have a basis to compare and evaluate. The 4 m's(man, machine, material, money).

16) The airfare on the American Airline recently, tells the story of a biased contract, not binding.

17) The PPP is not saying much, the Coalition is tightlipped, despite the demand of the public not only to see the contract, but to renegotiate the contract. This is sending a message to the public that the politicians PPP/ Coalition conscience is under the table, as the track record of Exxon would suggest.

to attend UG and scholarships provided but how can you afford the $20,000 passage per month for Berbicians, for example, to attend UG? With only two campuses, only residents in Regions 3, 4 and 6 can really benefit.

There can and should be a reimbursement scheme for Public Servants who are pursuing studies at their own expenses. Why is it that the government is not doing this, instead of taking on GOAL Scholarships? Would it not be more rewarding and money

well spent? Editor, I do not mean for this letter to be taken maliciously, but I do believe that Guyanese do not respect public servants and rightly or wrongly, our leaders need to get busy working on this aspect, since their image will ultimately be affected by the performance of public servants. Finally, the long and much awaited delay of the appointment of the Public Service Commission has not gone unnoticed.

The fairness envisioned by the drafters of the law when they included the RDC and NTC is conspicuously absent. There is no regard for the will or best interests of Indigenous

Peoples, their Village management or system of governance across Guyana. The mission of the PPP is clear. Remove those leaders who are not supportive of the PPP while strengthening those who support the PPP, regardless of the wrongs they commit. The wider objective is to manipulate the election for the NTC executive council to achieve total dominance and control of that body, through

From page 5 only because of their more amicable relations with China historically, but also because the Chinese, unlike the US and their West European allies, do not interfere in the internal affairs of sovereign nation-states, and offer far less exploitative deals than has been the case with US and West European investments.

Obviously, the very existence of superpowers is less than ideal and in the real world, all foreign governments and companies will do their best to get the most advantageous deal for themselves and those they represent. The onus is therefore on the Government of Guyana to represent Guyana and its people, and stand firm in terms of getting a fair deal for us.

Unfortunately, we have not been able to rely on either PNC/R or PPP/C led governments to defend our sovereign rights and national dignity. We most certainly do need to open an investigation

into the sale of Guyana, but let us not simply scapegoat one man and China, as Vice News would have us do, and then pretend all is well and justice has been served. For once, let us not fall into the PPP/C versus PNC/R trap that has taken us nowhere for too long. Let us have the courage to call into question the entire gamut of corrupt and treasonous deals of successive governments with both local and foreign companies.

Meaningful change in Guyana can only occur when we, as a nation, are finally able to confront the difficult truth facing us, which is that neither of the two leviathans, PPP/C and PNCR, are interested in or capable of the type of transformational politics that can deliver economic justice, dignity and true independence. We have to stop bickering over falsehoods and have the courage to speak the truth. Even Forbes Burnham’s most aggressive detractors are forced to admit that his was the only

government that did not allow the plunder of Guyana’s resources at the expense of the Guyanese people. Every successive government since his death has failed us in this respect.

This is a matter of fact not opinion. To quote Burnham: “We have seen in Guyana and in other underdeveloped countries, foreign owned extractive industries prosper, while the native population remains poor and destitute…we must now get the large share of the cake, otherwise what is the difference between Guyana and a colony? Last week we witnessed several protest actions by citizens for various causes.

Among these issues were the lopsided oil contract with ExxonMobil; the scandalous revelations in the Vice News interview that ensnared Vice President, Bharrat Jagdeo and the gunning down of Quindon Bacchus by police some weeks ago at Haslington, East Coast Demerara.

We expect these protests to continue this week and perhaps with greater fervor.

We at Kaieteur News are in full support of citizens standing up for their rights and fighting injustices in our society. For too long we have been silent, while allowing our leaders to run roughshod over us.

'Contract with Exxon makes a mockery of ...Yog Mahdeo says deal attempts to our constitution' shackle govt. into more unfair provisions

By Davina Bagot The Production Sharing Agreement (PSA) that the government signed with US oil major ExxonMobil is a mockery to the country's constitution as it attempts to shackle this country into more unfair provisions or benefits for the petroleum companies operating in Stabroek Block.

This is the view of Dr. Yo g M a h a d e o , a transparency advocate and co-founder of the civil society body- Article 13. He gave this conclusion in an invited comment yesterday while citing the necessity for the contract to be renegotiated.

Mahadeo explained, “Of critical importance to me is the fact that we have not only allowed the Exxon contract to remove our wealth but are allowing them to effectively remove our constitutional right to elect a government that can create and enact laws on our behalf – that is, the contract mocks and neuters our Parliament's ability to pass laws.” According to him, the PSA attempts to shackle the Government into financial and other lopsided deals.

“It also attempts, in Article 32, to handcuff the Government away from contemplating changing any laws that can impact the Agreement to the economic detriment of the Contractor.

By attempting to shackle the Government, it therefore attempts to fetter the entire population from getting a Government in place that can pass laws as desired by and for the people. This unconstitutionality threatens

Article 32, which lists out conditions for 'Stability of the Agreement' states at 32.1 that “Except as may be expressly provided herein, the Government shall not amend, modify, rescind, terminate, declare invalid or unenforceable, require renegotiation of, compel replacement or substitution, or otherwise seek to avoid, alter, or limit this Agreement without the prior written consent of Contractor.”

The agreement goes on to say at 32.2 that “after the signing of this Agreement and in conformance with Article 15, the Government shall not increase the economic burdens of Contractor under this Agreement by applying to this Agreement or the operations conducted thereunder any increase of or any new petroleum related fiscal obligation, including but not limited to, any new

taxes whatsoever, any new royalty, duties, fees, charges, value-added tax (VAT) or other imposts.”

The advocate pointed out that a clear example of this case is seen in the matter where Guyana's Attorney General and Minister of Legal Affairs, Anil Nandlall S.C is representing the Government alongside ExxonMobil against Kaieteur News Publisher, Mr. Glenn Lall who has c h a l l e n g e d t h e “discriminatory” tax holidays being enjoyed by the oil company.

As such, Mahadeo noted that the contract is not only lopsided due to the unfair benefits to the people of Guyana, but also due to the terms outlined that seek to block the passage of new laws that can affect the company's profits. He argued, “It is also bad for us as Guyanese because it exemplifies how close the People's Progressive Party, the People's National Congress and the Alliance For Change are all on this, defending each other's position and doing everything to make a wrong look and feel right. [Vice President Bharrat] Jagdeo, [President Irfaan] Ali et al. were well aware of the Contract's terms and conditions when they made the election promise to renegotiate. They either blatantly lied to the people then- before elections- or are lying now that they are the prime beneficiaries of all the oil revenues since they direct, at will, the use of these funds and the preservation of Exxon's Contract against us.”

According to Mahadeo,

Section 32 of the oil contract that 'mocks' the laws of Guyana, according to Mahadeo. the main terms used in the 2016 contract mirrors terms and conditions in the 1999 contract, meaning that the present administration was well aware of what they were getting into when the promise was made to renegotiate the deal.

The co-founder of the

civil society body has launched a series of protest action calling on the government to honour its campaign promise to renegotiate the deal. Last Tuesday, the group took to the streets demanding a renegotiation. The exercise, in front of the Ministry of

Natural Resources' Duke Street, Kingston, Georgetown office was held by the citizens to publicly register their disapproval of the contract. Mahadeo said that the protest is slated to continue today at 11:30am; however, the venue was not finalized up to press time.

Missing bartender found dead ...police say red marks seen around her neck The search for 19-year-old mother of one, Anisa Miguel who went missing on June 17 last, came to a tragic end on Sunday after a Brazilian miner spotted her remains floating in the Mazaruni River, Region Seven.

Her decomposing body was located around 10:30hrs some four miles away from Martin's Landing, the place where she was last seen alive, and bore a red mark around the neck, police have confirmed. The miner had contacted police and ranks headed to the area known as Baboon Island, Middle Mazaruni. They reported that the remains were afloat in a facedown position and clad in a pair of blue jeans and pink top. She had no footwear on and there was a red mark around her neck leading detectives to suspect that there could be some foul play involved.

Miguel's body was taken to the Enachu Police Station where it awaits transportation to Georgetown for an autopsy. Meanwhile, the bar owner and two sales girls who were last seen with her on the night she went missing remain in police custody as the investigation continue. Miguel's employer had alleged that she had left her business place on June 17 to accompany two salesgirls on a trip to Martin's Landing. They were taken in a speedboat captained by one of her employer's workers. One of the sales girls had even taken a “selfie” of them travelling together in the boat heading to the location.

They had reportedly gone there to sell perfumes.

Miguel was later seen drinking with them and other individuals at a bar. The boat

captain had returned to pick them up but reportedly saw all of them drunk. It was further alleged that Miguel was “knocked out” and the boat captain did not want to take her on his boat. The owner of the establishment where she was seen drinking had reportedly taken the girl in and promised to take care of her but she went missing.

Claims were also made that she was last seen dancing with a male patron before she disappeared. However, since the media reports surfaced, many persons have come forward claiming otherwise. They agreed that Miguel was indeed intoxicated but was never left at the business place. Instead, they are alleging that Miguel had left the drinking spot with the sales girls and headed for the boat.

President Ali has much to learn

This past week, one of the Caribbean’s elder statesmen, Keith Mitchell, was defeated in his country’s General Elections. He lost to a baby-faced, 44-year-old political newcomer, Dickon Mitchell (no relation).

The election of the youthful attorney-at-law has set tongues wagging. Many local bloggers were in ‘oohs and aahs’ about the election of such a young person to high political office.

It must have escaped their attention that Guyana has a President who is younger than Dickon Mitchell. President Irfaan Ali was in the spotlight this past weekend in Rwanda. He was selected to be at the head table for the closing g press conference of the Commonwealth Heads of Government Meeting (CHOGM).

I can hardly recall any Guyanese leader - Burnham, Hoyte, Jagdeo or Jagan – ever being accorded that honour.

It should have been a moment of great pride that Guyana’s youthful President was given such a signal privilege.

I wondered whether it was too good to be true. During the question segment of the presser, a journalist asked a question about the takeaways of the Conference.

He had prefaced the question with what appeared to be an attempt at fishing for compliments about Rwanda’s achievements since the end of the genocide in 1994.

Interestingly, the reelected Secretary General in her response said that she would pass the mic on to President Ali for him to deal with Rwanda’s inspirational leadership in rebuilding the country [following the geno-

cide]. That moment, at least to me, appeared all too scripted. President Irfaan Ali was eloquent and lucid in his response. He noted that what the Commonwealth needed at present was stability and bold, innovative and visionary thinking. He said that the combination of the Secretary General and the incoming Chair, Paul Kagme provided these qualities. Perhaps, it should have ended there.

It is normal for invited Heads to give some praise to the host country and its leadership. But President Ali decided to lather the praise on thickly. He said that when you look at what President Kagame has achieved in Rwanda, it speaks to a leader and a country that has a vision, and who pursues bold and creative initiatives. President Ali continued that, given the food, energy, climate, and inequality crises facing the world, such leadership is required today.

This was overreach at its finest.

The President had in his delegation to CHOGM persons skilled in international relations. They would have been a better position to advise him to moderate his praises for Kagame and Rwanda. They would know that the hosting of the CHOGM in Rwanda was by no means uncontroversial. In the run-up to the Meeting, serious concerns arose about the political situation in Rwanda.

These concerns may not have been seen as serious when Rwanda was selected to host the 2020 Summit. Then Rwanda was the poster-child of neo-liberalism and democracy, the twin concepts which

the western world was offering as the prescription for African development. Since 2020, however, Rwanda’s star has dimmed. This has been mainly on account of concerns over political excesses and human rights and the state of the country’s economic underbelly. When Kagame decided to pursue neo-liberal economic policies, he became the darling of the West. But Rwanda is no fairytale story. Even when it comes to ending the genocide, the verdict is out. The microscope is zeroing in on the role of Kagame’s Rwanda Democratic Front during the latter days of the genocide.

Rwanda is now seen as a threat to stability. Rwanda is now being accused of aiding violent anti-democratic rebels in the Democratic Republic of Congo.

Kagame’s government recently attracted displeasure by its signing of an agreement with the United Kingdom (UK). Like the government of Sierra Leone did years ago with Australia, Rwanda is poised to become an offshoring processing centre for UK asylum seekers from Africa and the Middle East.

Kagame’s government is being accused of suppressing the opposition, engaging in human rights and democratic freedoms. Kagame himself is viewed as a tight-fisted ruler. Strong-armed tactics is being credited with aiding in the country’s so-called economic success. But the economy has long been floated by extremely generous foreign aid, a steep climb in personal remittances and high dependence on foreign direct investment including from China. President Irfaan Ali is the Caribbean’s youngest Head of Government. He has much to learn, as his recent forays in Rwanda indicate.

He is a humble and approachable person who should not be afraid of seeking advice.

I'm old now; don't want another confrontation with Minister Edghill In my compound, the huge garbage truck was facing me and I just needed a tiny space on the parapet to proceed. But that parapet had huge boulders sitting on the edge of the parapet in close proximity to the road. This happened on two occasions.

This is a ubiquitous annoyance throughout Guyana. But it is also a dangerous thing. It is dangerous in the sense that the encumbrances literally stop the police, and private security services from overtaking a criminal vehicle that they are in pursuit of.

The fire trucks will have a difficult task negotiating those boulders. The ambulance will also be hindered.

Minister Edghill announced that today his ministry will be removing all types on parapet encumbrances throughout Guyana. I quote his words and I am asking the minister, the president, the entire Cabinet, civil society and the media landscape to pay meticulous attention to his words.

Before I quote him, I am directly appealing to his

conscience to be fair and not to discriminate against the poor and powerless and the ordinary folks.

Here is what he said: “If somebody comes out with a dog food stand or a cart selling food or somebody decides to go on the reserve and wash a car and call it a car wash, should we allow that, as a country, to stop G u y a n a ' s development?…We can't allow that … As of Monday, the Ministry of Public Works will begin to move derelicts, sand, stone, debris; everything that is in the path and is encumbering the road shoulders throughout the length and breadth of Guyana… we have to bring an end to the lawlessness while we develop Guyana.”

One can hardly disagree with those thoughts if a country is going to have law and order.

But law and order must never be class-based. State action against defaulters must never be class-based.

Righting wrongs must never be class-based. Developing a country to achieve modernisation must never be class-based. Distribution of

justice must never be classbased.

If a citizen put a stand on the parapet, selling dog food near the edge of the roadway hindering traffic that is wrong. If you put pillars on the parapet outside your home near the edge of the roadway, that is wrong too. If you take the parapet outside your home and utilise every inch of the parapet by cultivating a humongous garden on it that juts out onto the street, hindering the free flow of traffic, then that is as wrong as the dog-food seller.

Go to Peter Rose Street, one corner south of Lamaha Street and you will see two houses opposite each other that have used up the entire parapet in front of their homes. So large is one of those floral architectures that it is sitting on the edge of the street. It is possible that snakes and bees have made a cocoon in there.

I don't know who own those places. For all you know, it could be someone I know well. But my fear is that it is located in an area where the rich and powerful live and in those fancy districts, the bulldozer will

Nursing and Midwives Council appointed under new law In accordance with the Nurses and Midwives Act No. 7 of 2022, Minister of Health, Dr. Frank Anthony has appointed a board to serve as members of the Nursing Council from July 1, 2022, to June 30, 2025.

Chemical spill reported at Exxon’s Stabroek block operations A

pproximately 925 gallons of chemical asphaltene inhibitor is said to have spilled during its supply to one of the floating production storage and offloading (FPSO) involved in oil production in the offshore Stabroek Block.

Information reaching the newspaper is that the 925 gallons, approximately 18.5 barrels of the chemical was being delivered from a supply boat when a leakage seemed to have occurred.

“A supply ship was discharging chemicals to the FPSO and approximately 925 gallons were spilled which is around 18.5 drums. The chemical asphaltene inhibitor resulted in several fishes dying and floating to the surface,” a source related.

The information stated further, “I gather no one was paying attention and the hose that linked the two vessels leaked.”

“The captain of the supply ship has left Guyana I understand, and we also heard that no report was made to the Environmental Protection Agency (EPA).”

Minister of Natural Resources Vickram Bharrat told the Kaieteur News that this spill would have occurred “a few months ago”. He had c o m m i t t e d t o g e t t i n g

...Minister Bharrat says EPA dealt with matter information about the spill, and later confirmed that it happened months ago, that “there is no recent one (spill),” and that what is now being reported might be from what occurred previously now making the rounds.

H o w e v e r, c h e c k s h a v e provided no reports highlighting such an occurrence in recent months.

Minister Bharrat reiterated however that he would have checked around and confirmed that the matter is not recent.

Kaieteur News was unable to ascertain what procedures, legal or financial penalties were imposed, if necessary, but the minister did confirm too that, “the EPA had dealt with it (spill).”

Corrosionpedia describes an asphaltene inhibitor as a chemical used in the oil and gas industry to remove asphaltenes from crude oil. Asphaltenes are the impurities found in crude oil that if not removed can choke refining equipment.

Asphaltenes, are the insoluble compounds that are always present in crude oil and must be removed before and during the processing phase in a refinery.

The online chemical dictionary

says that in the petroleum industry, asphaltenes can cause significant damage to machinery as they tend to clog highly capitalized infrastructure such as well tubulars, crude oil pipelines and subsurface equipment such as

pumps and compressors.

This clogging can eventually halt the crude oil refining process.

Both light and heavy crude contain asphaltenes.

The asphaltene concentration is higher in heavy crude oil but the concentration usually remains stable during heavy crude oil production and therefore does not lead to well clogging.

However, the chances of well clogging are said to be very high for light crude oil, which is the quality produced here in Guyana, because it has varying amounts of asphaltene, which may become deposited in the production tubular.

During the crude processing, asphaltene is produced in the form of asphalt and is considered to be a waste material or byproduct.

Asphaltene inhibitor is said to exhibit no toxicity to human body and/or environment, but precautions must be taken to avoid inhalation, ingestion, or contact with skin or eyes, it was further stated.

'Elections COI should be free from political interference' President Irfaan Ali

...Article 13 urges clear Terms of reference Article 13 has congratulated President Irfaan Ali for taking what they called a “bold step” towards the establishment of a Commission of Inquiry (CoI) into the contentious 2020 General elections.

was informed by Attorney General Anil Nandlall that “all these matters will be addressed upon the President (Irfaan Ali's) return [from state business overseas]” The Head of State went to Kigali, Rwanda, attending the Commonwealth Heads of Government Meeting (CHOGM), and is expected to hit Suriname for that country's two -day Energy, Oil & Gas Summit & Exhibition (SEOGS) 2022 commencing in Paramaribo today. “ We h o p e t h a t t h e Commission will be unfettered from political interference and will conduct a comprehensive and transparent review of the conduct of the 2020 elections and of GECOM itself,” Article 13 related in a statement to this newspaper.

The civil society organisation insisted that, “no one must be above the law and no one must hide behind the skirt of immunity

with impunity.”

It is expected that GECOM itself will be reviewed - in the process and the roles it played to facilitate the six-month -long impasse as well as “the public and private statements of the Commission and Commissioners, the statements of (former President David) Granger and (Vice President Bharrat) Jagdeo as head of their lists; the public statements of the main persons engaged during the recount; the evaluation of the Statement of Polls (SOPs) and their veracity visà-vis their publication by various parties.”

Article 13 said that it welcomed to the COI and “now eagerly await their Terms of Reference (ToRs).”

“I must say though, they (government) took all of two years, firstly refusing to accept the fact of a COI, then acquiescing but refusing to consult; refusing to have an open door on naming the

personnel that comprise the commission. This is why it is my fervent hope to see the TOR and that the Commission acts independently and openly. It is not a (People's Progressive Party) PPP commission, but a commission for the betterment of all of Guyana,” the civil group said.

In the letter to the diplomatic community, Article 13 had stated that billions of dollars was spent on the 2020 Elections, during which the legislation and regulations were subverted for partisan and personal gain.

The reality of those elections included attempted rigging and the politicisation of the Commission, its members and employees.

The group said that observers, diplomats and a g e n t s w e r e unceremoniously ejected from the GECOM building to bar independent scrutiny.

“Guyanese were amazed and

ashamed that it took the Diplomatic Community to intervene to uphold our sovereign nation's constitution. It was the Diplomatic community that directed the Chairman's attention to District Four Officer Clairmont Mingo's actions, and it was the threat of sanctions from the diplomatic community that ultimately brought an end to the saga.”

They said that the prosecution of three former employees of GECOM is not enough. “It is imperative to identify and address the systemic problems that led to these actions so that Guyanese voters can be

assured that it will never be repeated in future elections.”

President Ali has picked retired Justice of Appeal, Stanley John of the Turks and Caicos to be Chairman of the CoI, while its other members are former Attorney General, High Court Judge and Acting Justice of Appeal in the Eastern Caribbean, Godfrey P. Smith, Senior Counsel; former Chair and Chief Elections Commissioner of India, Dr. S Y Quraishi and former acting Chancellor of Guyana's Judiciary, Carl Singh. Dr. Afari Jayan and Dr. Nasim Zaidi will serve as resource personnel to assist the Commission with its work.

Wedding gone wild! ...After 20 years on the run, man who killed wife captured while marrying another Guests on Saturday night were stunned when police barged into a wedding party and arrested the bridegroom who was on the run for twenty years for allegedly killing his wife.

The wanted suspect identified as Gautier Jerome Fernandes, 51, was captured by police while marrying another woman at Onderneeming/Sand Pit area on the Essequibo Coast, Region Two. Fernandes had allegedly almost severed the neck of his first wife, Roshinie Sooklall, with a knife on January 25, 2002, in the Diamond, East Bank Demerara (EBD) Squatting Community while she was heading to her brother's home in the company of a female friend.

Sooklall was only 22years-old when she was brutally murdered. She had started living home with Fernandes at the age of 18

Solar power 20 to 50% cheaper than coal and gas - IEA The International Energy Agency (IEA) World Energy Outlook (WOE) 2020 had projected that the world's best solar power schemes offer the “cheapest… electricity in history” being 20 to 50 percent cheaper than coal and gas.

The IEA had stated that in every year from 2020, there will be recordbreaking additions of new solar capacity. In fact, the agency's remarks are being proven as recently, the world has been pushing to transition towards renewable energy. In fact, taking its lead from Germany, the European Union (EU) has signaled its intention to embrace renewable energy much faster than was planned, a direct result of the war being waged between Russian and Ukraine. Russia provides much of Europe with its Natural Gas. As such, the EU is now looking in the interim to make its purchases from other sources, such as Israel but even those supplies would not be adequate leading to the now stated position of accelerating its push towards renewable sources of energy such as solar, wind and hydro among other forms of new clean energy technology being developed.

To this end, the EU, Israel and Egypt recently signed a tripartite natural gas export deal as the bloc seeks to diversify away from Russian energy.

The deal, finalised at the East Mediterranean regional energy conference in Cairo, will allow “significant” exports of Israeli gas to Europe for the first time, the Israeli

energy ministry said.

Coming on heels as the world is pushing to transition towards renewable energy, the President of the Caribbean Development Bank (CDB), Dr. Hyginus 'Gene' Leon, has recently underscored the urgent need for the Caribbean to accelerate the transition to renewable energy. Notably, the Government of Barbados inked a deal that in the near future will see the country realising some 178 megawatts of electricity using hydrogen and solar energy at a cost of some US$100M, while in Ethiopia, that country will soon realise 6,500 MW of hydro power electricity at a cost of just over US$600,000 per MW. With the world on a pathway towards reducing carbon emissions as a

result of burning fossil fuels primarily for electricity generation and transportation, Barbados is now leading the Caribbean region with the announcement that it will soon be building the largest clean hybrid power plant in the Caribbean, producing base load power for 16,000 Barbadian households from solar and locally produced green hydrogen.

Moreover, the IEA had pointed out that 43% more solar output is expected by 2040, which is more than it had projected for in 2018; partly due to detailed 2020 analysis showing that solar power is 20-50% cheaper than thought. Guyanese killed by Venezuelans during street brawl

h i r t y - f o u r- y e a r- o l d Lindsford Kenwayne Duguid was on Sunday morning killed allegedly by three Venezuelan nationals during a brawl.

According to the police, the incident occurred between 03:00hrs and 03:45hours at Lot 12 De Kindren Housing Scheme, West Coast Demerara. It was stated that about 22:00hrs on Saturday June 25, 2022, Duguid visited the location and asked for 22-year-old Jessica Ortiz, a female Venezuelan national who lives in De Kinderen.

However, the woman was not at the house and the landlord informed him that she was not there.

The report further stated that the around 03:30hrs Sunday, the landlord said that he heard loud screams. He indicated to the police that when he checked, he noticed Duguid pulling the 22-year-old woman by her hair, while another Venezuelan woman held on to his waist from the back.

Kaieteur News understands that the landlord then rushed to the area and he witnessed Duguid and two women fighting in a drain. One of the women was reportedly armed with a knife which she used to stab

According to the police report, the man then armed himself with a cutlass and dealt Duguid several chops about his body. The suspects then used a rope and tied Duguid's legs and left him in the drain.

the drain. The police reported that chop wounds were seen on the left and right fingers, hand, four stab wounds to his chest, three stab wounds to his right leg and multiple chops to his head and a rope was tied around his legs and neck.

Moreover, one brown-handle knife was found on the grass parapet some distance from where the body was found.

A search of the drain by the

police ranks unearthed a Samsung cellphone and a pair of female running boots.

Checks were made for the male suspect at his residence in De Kindren but he was not located.

However, while searching the location, the police recovered a cutlass near a plastic barrel along with a pair of long pants and one shirt with mud. One of the female suspects has been arrested.

Countries depending on oil can brace for lower revenue - EITI report As countries around the world speed up the transition to renewable energy, the Extractive Industries Transparency Initiative (EITI), a global watchdog for the governance of oil and gas and mineral resources, in its 2022 Progress Report has highlighted that oil producing nations that depend on revenue garnered from the sector can brace for a decline from that stream.

Guyana, being a fairly new kid on the block when it comes to the production of oil has been pushing to speed up production rates, with the backing from United States oil giant, ExxonMobil. But while the country has been racing down that path, nations around the world have turned in another direction; moving swiftly to renewable energy options to generate electricity and even power vehicles.

The Extractive Industries Progress Report notes, “The global energy transition will transform the extractive industries, exposing producer countries to new risks and opportunities. As global consumption of fossil fuels declines, countries that rely on revenues from petroleum and coal will have to contend with a decline in revenue from

those sectors.”

Further, it also highlights that the rates of production have declined in some nations. Over two years, Guyana received US$638 million in oil profits and an additional US$81 million in royalty payments. Last month, the country made its first withdrawal from the Natural Resource Fund (NRF) - some US$200 million, equivalent to $41.7 billion in local currency.

During the Budget 2022 process, Parliamentary approval was granted for the sum of US$607.6 million to be transferred during the fiscal year 2022. The speedy transition to renewable energy is largely owed to the Russian invasion of Ukraine. Due to the ongoing war between the two European states, countries have imposed sanctions on Russia, blocking the export of the country’s resources. Russia has also blocked Ukrainian ports, hampering exports and imports. In addition, the

United Nations (UN) have also put countries on guard that as climate change advances, global emissions must be reduced. In fact, the UN Secretary General, Antonio Guterres, during COP26 last October warned that the pledges made thus far by countries are ‘far from enough’. Speaking to the closing of the 26th United Nations Framework Convention on Climate Change (UNFCCC), sponsored Conference of Parties (COP26), Guterres noted that “The climate action struggle requires all hands on deck. It is everyone’s responsibility.” According to Guterres, “We cannot settle for the lowest common denominator; we know what must be done. Keeping the 1.5 goal within reach means reducing emissions globally by 45 percent by 2030.”

$1.9B estimated to widen road between Conversation Tree and Sheriff Street

mong some of the big infrastructural projects the Ministry of Public Works is preparing to undertake is the widening of the road from Conversation Tree to Dennis Street connecting it to Sheriff Street.

Roach takes 250 test wickets for West Indies; Bangladesh in trouble at 132-6

GROS ISLET, Saint Lucia (AP) — Kemar Roach reached the landmark of 250 test wickets as West Indies dominated the third day of the second test with Bangladesh fighting to avoid an innings defeat.

Bangladesh were reduced to 132-6 in its second innings at stumps yesterday and still trailed the hosts by 42 runs at Daren Sammy Stadium.

Roach took the first three wickets to finish the day on 3-32 in 10 overs and move to 252 wickets for West Indies.

Bangladesh opener Tamim Iqbal (4) was caught behind to give Roach his 250th wicket. The pacer is now the sixth-highest test wicket-taker for West Indies.

Serena Williams is back, but Iga Swiatek still reigns

Yahoo Sports - Since April, the biggest story surrounding Wimbledon was their decision to ban all Russian and Belarusian players from competing due to Russian president Vladimir Putin’s invasion of Ukraine.

The WTA and ATP won’t be awarding any ranking points to anyone who plays at the All England Club next week, defanging the third calendar Grand Slam and reducing it to a two-week exhibition tournament with monetary prizes and a big trophy.

But that’s not the biggest story anymore. Because after sustaining a leg injury at last year’s Wimbledon, Serena Williams is finally back. The GOAT herself was awarded a Wimbledon wild-card and competed in doubles with Ons Jabeur at Easbourne. She and Jabeur made it to the semifinals, but were forced to withdraw due to Jabeur’s knee injury. Williams, despite her comeback attempt, is no longer the dominant force in women’s tennis, and number of American women have risen through the ranks in her absence. Danielle Collins and Jessica Pegula are now in the top 10, and Coco Gauff sits at No. 12. Madison Keys, Amanda Anisimova, Alison Riske and Shelby Rogers are in the top 40. None of them have come close to filling Williams’ shoes (only Poland’s Iga Swiatek can claim that), but Collins, Pegula and Gauff have all shown they have what it takes to make a deep run at Wimbledon and inch closer to the WTA top five. The last American to hold the Wimbledon women’s singles title was Serena in 2016. Since then, a different player has won each year, and we may be on track to see another first-time winner in 2022. Ash Barty, the 2021 champ, has retired. Angelique Kerber and Simona Halep (champs in 2018 and 2019 respectively) haven’t been serious threats all year. Only Garbiñe Muguruza, who won in 2017, remains in the top 10.

Even with Swiatek’s recent dominance, it feels like anything could happen at the All England Club this year.

Players to watch at Wimbledon 2022 Serena Williams It’s hard to set expectations for Williams. Until last week, she hadn’t set foot on a competitive court for nearly a year. She looked good playing doubles with Ons Jabeur at Eastbourne — tentative at times, but still fierce and competitive. But we have no idea how she’ll fare playing singles against a crop of competitors she hasn’t faced in over a year, if ever. Plus, her

future plans are a mystery. Is Wimbledon just a test balloon to see if she’s ready to dive back into competing, even on a part time basis? Has she chosen this as her swan song?

Or will she say goodbye at the US Open? She’s one Grand Slam win away from tying Margaret Court’s all-time record of 24, a mark she desperately wants to reach. Until she actually starts to play singles, we won’t know if that’s even a possibility. But if there’s someone who can do it, it’s the woman who won the 2017 Australian Open while eight weeks pregnant, and made four finals and two semifinals after returning from maternity leave.

Iga Swiatek Watching how Swiatek absolutely mowed down the competition at the French Open, the only players who could have stopped her were pre-retirement Ash Barty and pre-knee injury Serena Williams. That’s how dominant she was, and how dominant she’s been since her last loss in February. And since that straight-sets win over Coco Gauff in the Roland Garros final, Swiatek hasn’t competed at all, choosing to rest a shoulder injury so she can be at full strength for Wimbledon. She’s competed at theAll England Club as a pro just twice before, making it as far as the fourth round, but she won the Wimbledon junior title in 2018. But while resting up means no grass court warmup, it also means that she’ll be fresh as a daisy in Round 1, and her 35-match winning will still be intact.

Coco Gauff At Roland Garros, the 18year-old Gauff graduated from high school and made her first Grand Slam final. While she’s now had more success at the French Open, Wimbledon is where Gauff broke out as a pro for the first time in 2019 as a 15-year-old. She’s had two fourth-round finishes at the All England Club, but seems poised to make a leap into the later rounds this year. She made it to the semifinals in Berlin recently, her best-ever result at a grass court tournament. Anett Kontaveit Kontaveit is now the No. 2 tennis player in the world, despite her early-round loss at Roland Garros. She’s also earned a No. 2 seed at Wimbledon, which should get her something she might need: a favorable first-round matchup. Kontaveit hasn’t played since her first-round loss at the French Open nearly a month ago. She dropped out of Eastbourne, the warmup for Wimbledon, because she was still suffering after-effects from her recent bout with COVID-19. At the very least she’ll be wellrested for Wimbledon, even though she hasn’t played a single grass match this year.

She made the quarterfinals at the Australian Open for the second straight year, and made the quarterfinalsattheFrenchOpenfor thefirsttime.She also has a semifinal and a final on the WTA 1000, and she’s made it into the top ten in the WTA rankings for the first time in her career. She hasn’t played since Roland Garros, but the confidence she showed in Paris will almost certainly be on display at Wimbledon.

Emma Raducanu It continues to be a tough year for the 2021 U.S. Open champ. She’s been under constant scrutiny by the British media (including tabloids), split with two coaches (one happened right before Roland Garros), and struggled on the court.

She had to retire from the Nottingham Open with a side strain, and pulled out of Eastbourne to continue recovering. There are always high hopes for any Brits playing at Wimbledon, but the upside of that is the support she’ll get by playing in front of a home country crowd.

Absences Naomi Osaka Osaka’s mission to get back on track keeps hitting potholes. She was hoping to make a triumphant return at the French Open, the same place she’d started a worldwide conversation about athlete mental health in 2021, but lost in the first round. Then she had to pull out of Wimbledon with an achilles injury, so we don’t know when we’ll see her again. She’ll have plenty to keep her busy though, since she recently co-founded a sports agency and launched a media venture with LeBron James. Aryna Sabalenka Sabalenka has lived in the WTA top 10 for the last two years, but we won’t get to see her at Wimbledon at all. The world No. 6 is from Belarus, and has been banned from competing at the All England Club.

Bagnaia wins Dutch MotoGP after Quartararo crashes out AFP - Italy’s Francesco Bagnaia won the Dutch MotoGP yesterday to reignite his title challenge after championship leader Fabio Quartararo crashed out of an incident-packed race.

Frenchman Quartararo fell twice, flipping spectacularly over his handlebars in the second incident although he walked away afterwards, shaking his fists in anger at his error.

Bagnaia, in contrast, stayed out of trouble on his Ducati to record his third victory of the season and a welcome full points score after failing to finish in the last two races.

“I am so happy after two difficult races,” the Italian said.

“It was really hard maintaining my pace and little by little I slipped out of the fight,” he said.

“So I’m disappointed, obviou s l y, b u t i t ’s good to get another three points on the board and to see I’m still in third place in the standings.

“But it’s no fun to come in an exhausted 13th!”

Injury scare for Tajay Gayle in long jump KINGSTON, Jamaica, (Reuters) - Reigning world championship long jump gold medallist Tajay Gayle suffered an injury scare to his left knee while attempting to win his third national title on day three of the Jamaican trials.

After fouling his first two jumps and struggling to get up to 8 metres on his third and fourth attempts, Gayle landed badly on his fifth jump.

He walked away from the sand pit, before being taken to the medical area via wheelchair to be assessed. Gayle later walked back to the warm-up area on his own.

“His ligaments are intact, but we will continue to evaluate for the next 48 hours,” a member of Gayle’s management team told Reuters.

The injury scare for Gayle, who has a wildcard entry to defend his world title, comes three weeks ahead of the start of the World Championships in Oregon on July 15.

Gayle, who retired injured at last summer’s Tokyo Olympic final with an injury to the same knee, has not registered a mark close to his career best of 8.69 metres that won the world title in Doha, Qatar, in 2019.

His effort of 7.97 metres for second place on Saturday was his best jump of the season.

By Sean Devers Last Saturday evening at the Poolside of the Ramada Princess Hotel in Guyana the ambience was absolutely stunning as the Guyana Cricket Board (GCB) pulled out all the stops to organise a Gala Closing and Presentation Dinner to honour the Ladies from the six teams that participated in just concluded CG United Super50 and T20 Blaze and those who helped to make the Event a success story.

President of GCB Bissoon Singh noted that his team had hastily arranged the Event which included musical renditions performed by one of Guyana's most talented singers, Calvin Burnette, since CWI felt time

limitations would have been an issue since the teams were set to depart Guyana early yesterday.

Singh congrautled Jamaica for dethroning Barbados in the T20 Blaze and Barbados for retaining their 50-over title, adding the GCB has noted with great satisfaction that the games were all played with high levels of competitiveness and in true sporting spirit reflective of the Caribbean Unity.

“We at the GCB are proud to have hosted these tournaments and although the Weather wasn't always favourable, most of the games were played to completion and for that we extend thanks to our hard working ground staff at the Guyana National Stadium.

World Badminton Day tournament staged

he Guyana Badminton Association Friday ran off the World Badminton Day Tournament to commemorate World Badminton Day, this being the first of its kind. The tournament was sponsored

by Total Solutions and it included students of the Nursery Badminton Academy a brainchild of the Minister of Culture Youth & Sports, Charles Ramson Jr. The enthusiasm shown by the students to be participating in a national badminton tournament was overwhelming, a release from the association noted.

The Guyana Badminton Association is very pleased with their progress.

What is World Badminton Day? According to the Badminton World Federation World Badminton Day brings people and communities together to experience fun and inclusive badminton, through a variety of active, engaging, and innovative badminton events. These events will take place globally over the same period of time. While events may range in size, location, and focus; the common theme to celebrate and promote badminton will be shared by all.

When is World Badminton Day? 05 July The International Badminton Federation (IBF), as it was originally named (now Badminton World Federation – BWF), was established on 05 July 1934 with nine founding Member Associations. In recognition of this significant date in badminton's history, World Badminton Day will be

celebrated annually on 05 July, with activities and events delivered throughout this week.

The BWF is also promoting Gender Equality in Badminton through this tournament hence it was ranoff by the women of the Guyana Badminton Association. Mrs. Ayanna Watson (VP), Ms. Priyanna Ramdhani (National Ladies Champion & Coach at the Badminton Academy) and Mrs. Emelia Ramdhani with the assistance of the other wonderful, strong and powerful women in the sport of Badminton in Guyana.
