CCJ disappointed with GECOM's “anytime after Dec. 25” timeframe for elections D

espite the Parliamentary Opposition advocating that General and Regional Elections has to, and can be held within three months, given that the Caribbean Court of Justice (CCJ) has ruled that the Government was defeated on a No-Confidence Motion, the Guyana Elections Commission (GECOM) has insisted that it would be ready to hold fair and credible elections anytime after Christmas Day December 25, 2019.

This was related to the CCJ yesterday by GECOM's lawyer Senior Counsel Stanley Marcus, who was among the lawyers that addressed the regional court yesterday on the way forward in respect to consequential orders stemming from the court's declaration that the NoConfidence Motion against the government was properly passed with a majority of 33 votes from the 65 members of the National Assembly. The CCJ also ruled that the President's unilateral appointment of retired Judge James Patterson as Chairman of GECOM was flawed.

For one, Senior Counsel Marcus is adamant that a new Official List of Electors (OLE) has to be created before general elections are held. He said that GECOM has to abide by certain laws, one of which specifies that there be a new list, since the previous one which was used for Local Government Elections last year, expired on April 30, 2019.

E x p r e s s i n g dissatisfaction at the timeframe put forward by Marcus, President of the CCJ Justice Adrian Saunders said, “This is disappointing.

Because as Mr. (Douglas) Mendes (lawyer for the Opposition) says, the Constitution of Guyana suggests that these elections should have been held sometime in March. So you're suggesting an outside date that carries us nine more months.”

Responding, Marcus told the court that elections could not have been held in March, since the matters arising out of the passage of the NoConfidence Motion were engaging the attention of the Court of Appeal.

CCJ's President Justice Adrian Saunders Justice Saunders stressed that he did not want to say GECOM was negligent, but noted that it should always be in state of readiness in the event of snap elections.

Justice Saunders noted, “The Commission ought always to be on standby that the President of his own deliberate motion or upon a motion of confidence which it loses renders his government no more. The Commission ought always to be on standby that, that likelihood could occur and if and when that likelihood occurs, it is a little strange that the Commission is saying we won't be ready for 90 days. We would be ready for maybe nine months, maybe a year, and leave the country in limbo for that period of time.”

Senior Counsel Marcus, however, disagreed with Justice Saunders' view. In fact, he believes that the country would not be left in limbo since there is still a government, and it shall continue in office until elections are held in accordance with Article 106 (7) of the Constitution. He said that after analysing the provisions of Article 106 (7), to his understanding, the government “stays until it

goes”.

According to Article 106 (6), “The Cabinet including the President shall resign if the Government is defeated by the vote of a majority of all elected members of the National Assembly on a vote of confidence.”

The consequences of Article 106 (6) are laid out in Article 106 (7) which says, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than two-thirds of the votes of all the elected members of the National Assembly, and shall resign after the President takes the oath of office following the election.”

For his part, Justice Jacob Wit also expressed his disappointment. He pointed out that as far he sees it, the government is in caretaker mode. According to the CCJ judge, although this is not expressly stated in the Constitution, it is implied, and this is the case in many Constitutions around the world. Justice Wit reasoned that Article 106 (7) spells out the timeframe for which

elections must be held to avoid having a caretaker government for a year, since important decisions have to be made in the country.

Justice Winston Anderson, who was also not pleased with the further delaying of elections, suggested to Marcus that elections could probably be held earlier if more resources were deployed to fast track GECOM's efforts in creating a new list of electors. Marcus submitted that this was not possible. He held firm that December 25, 2019 is the earliest date that the election can be held.

He explained that there are certain processes and procedures prescribed by law that GECOM has to follow. One of which he says is putting out electionsrelated advertisements to the public.

Marcus maintained that GECOM intends to comply with the laws in the execution of its mandates.

whether he could resist Mendes' submissions that the court should invoke consequential orders in terms of the provisions in Article 106 (7), Marcus stated, “That the court should impose three months…”

It should be noted that Senior Counsel Marcus believes that the provisions of Article 106 (7) is more d i r e c t o r y, a n d n o t compulsory At this juncture, President Saunders sought to clarify that the court was not imposing anything. Justice Saunders explained, “No No No… we are not imposing anything. We are not involved in politics.” Our remit is to uphold this document (the Constitution) and if it has a clear provision, then what do you want us to do. To ignore it? (the Constitution) To reject it? To rewrite it?” Saunders queried of Marcus.

“No my Lord (Justice Saunders). But I ask you to

give effect to what it says. He added that the framers of the Constitution contemplated that there would be a situation where the three months for whatever reason might not be complied with.

He also added that the Constitution also says that the time for the holding of elections can be extended by National Assembly.

Question as to what consequential orders the court should hand down, Marcus told Justice Anderson that GECOM needs more time to consult with the relevant parties.

Marcus said that following the court's ruling last week Tuesday, June 18, GECOM was unable to meet with anyone because of the intervention of an awkward weekend among other things .

He said that Senior Counsel Mendes had promised to send him a draft order, but he has not received same, and has had cause to pen a letter to him.

IMF notes – a mixed bag The IMF had good things to say from a recent visit to Guyana. Small steps, certainly; but any plaudits from such an organisation has to be seized, listened to, and built upon, through more doing.

First, the good news, as extracted mainly from a Kaieteur News item dated June 20. There was in excess of a “50 percent increase in assets declarations for politically exposed persons.” That is encouraging and bolsters the efforts of the Integrity Commission. Whenever more public officials step forward and do the right thing then, once submissions are aboveboard, the commingled interests of state and taxpayers are well served.

Second, there was a favourable comment on “the progress made in strengthening public procurement.” As an aside, and a heavy drizzle on the parade, reports allege that one procurement official caught in flagrante delicto during the commission of violations is since back on the job, as if nothing happened. Third, the IMF reported that, “commendable progress has been made in strengthening the framework for anti-money laundering and counter terrorism financing.” These enhancements are all laudable.

Unfortunately, that is far as matters go. Now there needs to be robust follow-up actions relative to implementation.

Laws and regulations, policies and procedures are all well and good. But now there must be a record of sanctions applied: violators charged and prosecuted; meaningful penalties levied, including hefty fines, asset seizure, and imprisonment or extradition. The areas of money laundering and terrorist financing have been subjected to relentless scrutiny in the international arena. Overseas agencies analyse countries for details of the reach of the law, and then its sting when material breaches have occurred.

As the IMF report indicated, this country “is scheduled to undertake a mutual evaluation by the Caribbean Financial Action Task Force in 2022”.

That Task Force knows and expects rules and regulations and risk assessments and enhanced due diligence are in place. Cumulatively, those are nice, but only the start.

The relevant and non-negotiable questions in 2022 are sure to be: what has Guyana done with all of that? What does Guyana have to show for all that paper and all those volumes? And how many offenders have felt the full force of the law? That is where the rubber hits the road, as the saying goes. And though 2022 looks to the disengaged and naïve to be far into the distance, it is too close for those who are in the know.

Guyana has a long way to go with delivering warm bodies. Indeed, the country has covered a solid distance for, as the IMF also confirmed, “Guyana has been officially removed from the European Commission’s Money Laundering Blacklist in February 2019.”

Unless the bar is kept sensitively high, it is easy to collapse back into the utterly lawless place where things existed before.

Proceeding still farther afield, the IMF report pointed to “skilled labour shortages and weaknesses in electricity supply as major obstacles to growth.”

Every citizen can attest to the accuracy of those points.

More tellingly, the IMF indicated that, “simultaneous investment in upgrading the education system is critical and would enhance skills and employment prospects.”

There is a crucial phrase there that must not be missed. It is “upgrading the education system”.

The education system produces a small percentage of superior performers, who can compete anywhere in the world. These would be the gifted, dedicated, and those self-starters or students who have the right combination of home environment, parental care, and other assets that combine to deliver a rewarding result.

Rather sadly, the bulk of the audience is unable to come out of the existing system with academic ingredients that prepares and recommends for the world beyond the classroom.

This is a problem for Guyana as it braces for oil, the ferocity of globalisation, and political and social anxieties.

So much more has to be done. The IMF shared goodies; major gaps came alongside.

My last words on things CCJ relative to Chair, dates, lists, and the rest DEAR EDITOR, I am ashamed. I am not sure, nor do I care, how many Guyanese I speak for but I am insulted and embarrassed at some of what came through from the CCJ today. Any selfrespecting Guyanese, and I am not certain as to how many are still around, should feel the same way. Did matters really have to come to this humiliating state?

From some of the quotes in the Demerara Waves’ coverage titled, “Caribbean Court gives Granger, Jagdeo more time to find consensus on elections date; GECOM says general elections not possible until after Christmas” (June 24), it is clear that Guyanese leaders, and by extension all of the Guyanese people, have been given a public dressing down. It is one that reeks of impatience, disappointment, condescension, and frustration. The language was civil, even genteel, throughout; but there should be no mistaking the grim tones, and the mockeries that will mount for hapless Guyana and Guyanese when either come up in serious

conversation. From this distance, I can feel the contempt, sense the ridicule.

Some extracts attributed to the President of the CCJ speaking on behalf of his brethren should be helpful to appreciate my own anger and disgust. First, “Everybody says these are important issues but it seems as though the same degree of urgency and deliberation that are expected from the courts, we don’t see them reflected in the behaviour of the political directorate and that, I think, is unfortunate.” Regardless of who I appreciate or don’t in the Guyanese political directorate, all have been reduced to errant, immature schoolboys, and in a rather smooth, but telling, putdown.

And that is a putdown.

And next from Justice Saunders, “This puts the court in a very awkward position because we don’t want to make political decisions but at the same time, we feel that it is our remit to assist in seeing the rule of law observed in Guyana but the observance of rule of law…also requires the political actors to conform

with the rule of law and demonstrate a sense of compromise and reasonableness that allow for the rule of law to take effect.”

Not the smoothest or most elegant language from the learned jurist, but effective in the thrust of its messages and devastatingly so. Even wickedly so.

Did matters have to come to these degrading observations that are the equivalent of mule kicks in the noggin? That local leaders lack the sagacity and capacity to recognise that some degree of movement, of consensus, of cooperating, are absolutely necessary to get anywhere on any matter of substance?

And on particularly on these matters that bedevil Guyanese society? If I am the leader of government or opposition (and the supporting casts), I would hang my head in shame.

For what Justice Saunders is saying is that Guyanese politicians want the CCJ to do de “dutty wuk fuh dem”. To make decisions with which they can engage in more endless rounds of circular and useless

pontifications and posturing, and then congratulate themselves on how clever they are. And further, that Guyanese leaders are skilled at sheltering under and spouting about constitution and law and the accompanying nonsense without putting any skin in the game. In other words, that Guyanese leaders are about all sound and fury (big mouth and big talk) but no concrete action that corroborates those words.

And that Guyanese leaders do not have the guts to make their decisions by stepping forward into the fire and delivering; that they don’t have what it takes.

Now I am totally disgusted with where I always suspected that things would end up.

Quite frankly, I have had my share on this. I did lend my voice. I have had enough.

I have just said my last word on things CCJ relative to Chair, dates, lists, and the rest.

Ayuh try deh. May God in His mercy be kind to this country.

Addressing some serious misunderstandings on the Professor Griffith issue DEAR EDITOR, This letter follows the one letter I sent to you just under a week ago. I have noted responses to that letter, published on Wednesday, 19 June 2019, and I feel obliged to ensure that some serious misunderstandings are addressed. In particular, I must address the letter published under the name Dennis Paul. Unfortunately work and family demands do not allow me to be as swift as I might wish to be with my responses.

Let me begin by underscoring a fact mentioned in my previous letter. While the internal process unfolded with regards to Professor Griffith’s tenure with the University of Guyana (UG), despite the misleading public campaign, I remained publicly silent. It was my expectation that, with the choice exercised by Professor Griffith to withdraw his request the campaign would stop and the UG could move on. What has continued to occur sends several false messages to the public: 1.

Professor Griffith was the greatest thing that has ever happened to the UG; 2. significant elements of the UG have been resistant to the positively transformational

leadership he brought; 3. the UG does not value the Guyanese diaspora; 4. the UG is not the place for anyone who wants to do well; and, 5. now that he is gone everything good at UG will crumble and it will sink into a dark abyss.

The issue I sought to address is now external to the University yet it has potentially significant negative impacts as the public can be misled.

It would be out of character for me to simply jump to the public to provide the gory details to prove what was wrong with Professor Griffith’s leadership at the UG. I ask though that those who would speak to it, speak honestly from what they know first-hand rather than deceitfully or peddling hearsay. I was therefore not pointing anyone to social media for ‘dirt’. If the author of the Dennis Paul letter would read carefully, he/she would note that I guided you to search the internet, which is not the same as social media.

I guided you to search the internet in relation to specific appointments of Professor Griffith so as to have some insight as to what happened at the UG without

me berating his leadership at UG in the public.

On the matter of the Vice Chancellor being a member of Council and therefore have all right to the information referred to, the author of the Dennis Paul letter overlooks simple things. Because the matter of evaluation in particular concerned Professor Griffith, he was not part of those deliberations and should only have been informed of the end product.

As bad as it was that he was informed, he had no right to have it published and really should apologise publicly for doing so.

It is a shame that the author of the letter in reference would seek to drag Professor Fraser into this matter. It is no secret that Professor Fraser worked with the UG before 2016, during that time he worked with me on a number of initiatives and had previously applied for the job of Vice-Chancellor. It is no secret that we have remained friends to this day. I would have likely voiced my opinion on his application in 2012 when I was not part of the University governance or central administration.

However, to suggest that I would have lobbied for him against Griffith in 2016 is a lie

from the pit of hell.

Editor, I would suggest that the author of the Dennis Paul letter really meant to say that lecturers have a hypothesis for which there is need for evidence to support it or not. It is important to note, however, that I have no such hypothesis. I have a fair bit of evidence. I had shared much of that evidence with the Council prior to Professor Griffith withdrawing his expression of interest.

Importantly, unlike those alike Mr. Pat Dyal, I can go to a court of law and be a valid witness to his leadership of the University.

Editor, let me reiterate what I said in my previous letter, “While I could write about my personal experiences and observations of Professor Griffith as Vice-Chancellor (Academic and Administrative Head of the University), I will not do so at this time because there is no reason to publicly berate his tenure at the UG now that he poses no serious direct threat to the University.” All I ask is, now that he is departed from the UG, let us all focus on continuing to move the UG forward.

I first wish to confirm that the Customs Anti Narcotic Unit (CANU) is appreciative of, and welcomes feedback from the public relative to its operations. However as it relates to the matter highlighted by Mr. Reginald Matthews, citing an aggressive and unpleasant interaction at the Cheddi Jagan International Airport (CJIA), with a CANU Officer, it must be noted that investigations by CANU revealed that no member of CANU interacted with Mr. Matthews on May 10, 2019 or any other day within the past six months.

It is unfortunate that Mr.

Matthews had an unpleasant experience while departing Guyana at the CJIA. However, it would have been prudent for him to establish and ascertain during his encounter, the name of the Officer and agency represented before launching an attack on CANU Officers and their operations, thereby attempting to besmirch the image of the Unit.

There are several agencies working at the CJIA conducting their respective and specific functions and it is inevitable that the travelling public will have interactions with members of these varying agencies.

Thus it is understandable that passengers, who more often than not are focused on getting through the stages of the check-in process, may not necessarily pay keen attention to the various officers with whom they

interact. However, it must be noted that CANU Officers are mandated, while on duty, to prominently display their CANU Identification Cards and verbally identify the agency they represent when approaching individuals.

In closing, I reiterate that CANU welcomes feedback from the public and I wish to remind the public that whenever they are approached by anyone claiming to be a CANU Officer, whether at ports, vessels, buildings or on the road, it is their right to ask to be shown CANU’s Identification Card, thereby ascertaining the authenticity of the Officer as well as the agency he/she represents.

Unannounced change of venue for private CXC candidates DEAR EDITOR, I am writing this letter as a concerned parent whose daughter wrote the Caribbean Examination 2019 (CXC) privately. There were two major centres given to them: Transport Sports Club and Postal and Telecommunications Workers Union, (PTWU). On Monday the 3rd of June, she had Biology paper 3 and knew that she had to go to the Transport Sports Club, Thomas Lands. She found no one there, so she went to the PTWU Centre on East Street and no one was there either, so she came to my work place

around nine thirty (9:30) frustrated to say that she wouldn’t be able to write the exams because no one is at either places.

I had to make contact with the teacher from the Premium Academy to find out if he knew that there was a change in venue, which he did not, but he gave me a number to make contact with Ms. Robertson who was in charge of distribution of papers for his exam students.

Ms. Robertson informed me that my daughter should go to St. Rose’s. I accompanied, my daughter and we got to St. Rose’s about 10:55. My

main concern is that she did not get back her time to complete the paper even though her late start was not her fault. There were some other children who also encountered the same problem with the change of venue about which they were not informed. They also were not allowed the “make-up” time. I’m sure you would (Continued on page 6)

have said that Guyana is a sovereign country (whatever that means) the CCJ cannot instruct Guyana how to run its affairs (including holding elections or replacing the Chairman of GECOM). In other words, the Ministers feel the CCJ has no sovereignty over Guyana.

The Ministers are wrong and are on a war footing for which there is no justification. The statements were made out of complete ignorance. By the way, a court or another nation or regional or international body does not need jurisdiction to intervene in the affairs of another country.

There are ample precedents for intervention especially when basic rules are not followed like following orders of the CCJ. Although I am not a lawyer, I am versed in constitutional matters and the concept of sovereignty.

When I was doing doctoral studies in political science, my field of specialisation was international relations. But students were also mandated to take doctoral courses in each of at least three of five subfields. Two sub-fields I did were American constitutional law and international law. And when I undertook graduate studies in educational management to become an Administrator in Higher Education, one requirement was courses in American Educational Law that focused heavily on Education Constitutional Law. I also taught

can say without any fear of being contradicted that the CCJ has sovereignty over Guyana because of a treaty the government signed (the PNC government at that) in 1973.

Contrary to what the Ministers feel and say, the fact is, for the record, the CCJ is Guyana’s final court of appeal.

The CCJ is part of Guyana’s sovereignty that happens to be located in another territory – not different from say when the Privy Council was Guyana’s final court of appeal. So those two Ministers must be reprimanded for their statements – words of defiance against the court and should be sanctioned (served with into contempt charges for attacking the court which is a separate and independent branch of our government). Can you imagine government officers telling the Privy Council it had no jurisdiction over Guyana when the court had standing before Forbes Burnham broke the link without legitimate approval? No wonder the white people laugh at us for our stupidity.

Already the judges in Guyana have shown they don’t know simple Math on how to calculate a majority and experience challenges in understanding what they read in the constitution. I travel to UK, India, Singapore, Malaysia, and throughout the Caribbean,

and insulted. Now, Ministers of government are adding to the embarrassment. They revealing their ignorance that they don’t know that the CCJ is Guyana’s court.

Those of us who study international law or “domestic law” would now that the CCJ has jurisdiction and even if you are not schooled in law commonsense tells you that the CCJ has jurisdiction over Guyana’s and can compel government officials or citizens to carry out acts. The CCJ can also order the arrest of officials for contempt although it has never done so in its history – that is the power of the court. And come Monday, the court should issue firm consequential orders and oversee their implementation itself since the Guyana courts seem to lack the ability to understand simple language.

The two Ministers and others who made idiotic statements need a lesson on the concept of sovereignty and judicial jurisdiction. How can we have regional integration if we dismiss the rulings of the CCJ? Chastising or even firing the Ministers will send a signal that the government respects the rulings.

Local political leaders must evolve DEAR EDITOR, There have been reports of the current United States Ambassador being an activist one, and who is constantly on the move; she has appeared in many places, some surprising to watching citizens.

In spite of her relatively young tenure in this part of the world, Her Excellency, Sarah Ann Lynch, has made more than the usual rounds, and has been most visible in places political and otherwise. I think this is exemplary, as well as telling.

First, there were images of the US Ambassador visiting the Office of the Leader of the Opposition close to the time of last Tuesday’s CCJ announcement. To the unknowing, that prompted raised eyebrows. But it shouldn’t have been so.

Regardless of timing, optics and local sensitivities, protocols have to be observed, and it must be emphasized, whether appreciated or not, that the political opposition is an integral part of the nation’s

governance mechanism. I don’t see how this can be otherwise, and which makes the lack of any joint leadership proposals to the CCJ’s [June 24th] deadline so incomprehensible, so unacceptable.

In the specific instance of the Office of the Leader of the Opposition, the visit was in response to an existing invitation.

I think that this speaks favourably towards all the talk of inclusion and partnership, which has been continually fostered by the diplomatic corps, with the most senior United States envoy taking a very prominent lead in this regard.

This is so, even though she has only recently arrived.

In addition, there are reports of a visit to the residence of the Opposition’s presidential candidate in honour of the Eid-al-Fitr holiday. This is positive, with the US Ambassador walking the talk, and distinctively so.

It is a far cry from the time of several decades ago, immediately after communism

and conflict, domestic power shifts and hard lines, and ostracism and isolation.

The political veterans on both sides of the then pulsating divide will remember that the then Leader of the Opposition was persona non grata at Embassy functions, and even entry into the United States. That was the time when US visa applications contained a question about communist affiliation. And since there was a diehard Marxist in the house, that was the kiss of death. That took over a decade to sort itself out with new priorities, new vital interests, and new visions both in the local and big power arenas. I don’t have to say this, but the world has changed.

In contrast, today there is outreach to everyone; even with recent rancor and differences still unhealed and unaddressed.

The first message is simple and unambiguous: the United States chief representative will meet with anyone, any place, and at any

time to assist in extricating from the political quicksand, to get to some place that represents higher and safer ground.

The second message is just as uncomplicated: there has to be working together in the local circle. There has to be reciprocal listening among the local players.

There must be partnering towards progressive local objectives. For the umpteenth time, I urge from my little corner that Guyanese leaders must change towards what are worthwhile goals. It does not have to be the compulsion (and overreach) of the CCJ handing down directives to children.

In Guyana’s thorny and intractable circumstances, I see the circumstances where, once again, the international community setting the stage

of openness through listening to the positions of the major players, while withholding its own collective inclinations.

There are no special friends (even when there are); only what offers the greatest probability of acceptability, given broader, superseding vital interests. I submit that this has to be the mindsets of local leaders, whether liked or not. They know what they have to do.

The challenge is for Guyanese politicians to reach deep within themselves, proceed beyond the usual power formulas and limiting governance confines, and embark upon a vision and programme that seeks to leverage available assets and resources towards what is best for this society.

Political leaders cannot

continue to operate in sealed silos, and to turn a deaf ear to the sustained diplomatic appeals (along with corroborating actions) to make things happen.

And local political leaders cannot pretend at possessing a blind eye and, thus, not seeing what is unfolding all around, through public overtures and private exhortations.

The immovable reality, is whether believed or not, Guyana is no longer an island on which leaders can either barricade or maroon themselves in defiance (willful ignorance) of all that is evolving around them, sometimes subtly, other times concretely. I say to local political leaders, you must evolve, too.

Guyana’s positive IMF assessment nails Jagdeo’s lies DEAR EDITOR, I stand corrected, when I say that I am certain of listening to part of a telecast, in which I heard the monotonous and uninspiring voice of opposition leader, Bharat Jagdeo, criticising the recent International Monetary Fund’s (IMF) visit to Guyana, and their release of the results of their country visit.

And what do we have to expect as reaction to the multilateral organisation’s very laudable commendations about the Guyana economy, which has been projected to achieve a 4.4% growth for 2019? Criticism’s about the agency’s alleged failure to take into consideration his particular comments/ observations etcetera about the local economy. This would mean his self-ascribed status as economic guru, from whom all plans and predictions flow.

But says who?

It is not altogether unexpected, for Jagdeo believes that he is the only

economist who can manage this country’s economy, and set it on its correct path to rejuvenation. Well, he had twenty-three years to prove such a self-ascribed ability.

And what were we left with after over two decades of PPP/ C governance – an economy that had been built mainly on the proceeds of narcotrafficking, which presented a false veneer of an economy on real solid economic footing?

Editor, Jagdeo understands clearly that every IMF country visit and assessment, is an independent exercise, carried out in a free and independent manner, and without prejudice, which conclusions about the state of the national economy would have been concluded after discussions with all the major players of the particular country, in review. And if one were to judge from Jagdeo’s statements, it is both a disappointment to his selfprojected expectations of an economy which he has always misleadingly reported to his followers/supporters as not doing well, because of mismanagement etcetera. It must be that the positives of the report, particularly that

there is growth across all sectors, has shook Jagdeo from the torpor of his-selfdelusion. Of course, there is so much more to be done, given the gargantuan tasks of denuding the economy of its false veneer, inherent of primarily the proceeds of the narco-trade, while concomitantly restoring its proper structures. But there is no doubt that there is a bright future ahead for Guyana, and all Guyanese, irrespective of the attempts at fake news and other devious acts intended to sow seeds of national dissension, compliments of Jagdeo.

CCJ decision on consequential orders by July 12 - Parties required to file submissions by July 1

By Feona Morrison Lawyers were ordered by the Caribbean Court of Justice (CCJ) to provide written submissions on what should be the consequential orders following last Tuesdays landmark rulingsthat government was defeated by the NoConfidence Motion which was passed in the National Assembly on the night of December 21, 2018and that the Presidents unilateral appointment of a Chairman of the Guyana Elections Commission (GECOM) was flawed, in other words, unconstitutional.

The parties have to file submissions by July 1, and the court is expected to hand down its ruling by July 12.

Apart from the submissions, the CCJ indicated to the lawyers that it would

be open to receiving their suggestions as to a consensual referral between the parties. But in the meantime, the court says it expects to receive those submissions just in case that consensus is not arrived at.

During a post-ruling hearing yesterday at the courts Trinidad-based headquarters, Belizean lawyer Eamon Courtenay, who is representing the government, advocated for the parties to file submissions on the issues before the court makes any directions. He told the CCJ that the matters at hand involve some very serious constitutional issues that resound in politics. In this regard, the CCJ was in full accord.

From page 6 of the PPP, there is one fact that cannot be contested, which is that the PPP, unlike the PNC, has consistently abided by the democratic norms of our country as reflected in free and fair elections.

This coming elections will be the first since the historic 1992 elections in which the PPP will not be in the seat of power. In the May 2015 elections, the PPP narrowly lost the elections to the APNU-AFC coalition albeit under questionable

circumstances which is being challenged by the PPP/C in the Court. This matter is still to be heard and seems unlikely to come up given the successful passage of the noconfidence vote.

It is in the above context that the issue of a politically neutral Chairman of the Guyana Elections Commission has to be seen.

The fact that both the political opposition and the ruling coalition has equal representation on the Commission meant that the appointment of a mutually

agreed Chairman is a necessary condition for there to be any level of confidence in the ability of GECOM to deliver free and credible elections. The CCJ has ruled that the current GECOM Chairman was unconstitutionally appointed but despite the ruling there is no indication that the Chairman is about to take his leave anytime soon.

The CCJ, in its most recent hearing on June 24, deferred the issue of the consequential orders on both the no-confidence vote and

the appointment of the GECOM Chairman until July 12. Many Guyanese were expecting the CCJ to deliver on its Orders much earlier. The fact that the Court was unable to do so is indicative of the difficulty of arriving at that delicate balance ‘between practicality and principles’ as alluded to earlier by the Court.

Justice Saunders explained that politicians must adhere to the rule of law, and in doing so, must dis p l a y a spirit of compromise to ensure that same is upheld at all times.

In relation to the G u y a n a E l e ctions Commissions contention that there needs to be a new Official List of Electors (OLE) before credible elections can be held, Justice Saunders stated that persons now qualified to vote should be registered to do so, while noting that the government was defeated by a motion of no confidence and the Constitution stipulates t h a t e l e c t i o n s must be held within three months from the passing of such a motion.

In this regard, Justice Saunders pointed out that there must be compromise between these Constitutional principles. Furthermore, Courtenay submitted that if the court should adapt Mendes submission, it would mean that the court would have to make a coercive order against the President directing him to dissolve parliament and to set a date for elections.

In concluding, Mendes urged the court to move with all deliberate speed on this highly sensitive, highly political issue. He added that there “cannot and should not be a play down for the need for a new list of electors”. According to the lawyer, anything short of this is a prescription for GECOM saying the date for elections has to be postponed.

Courtenay advanced, “I urge caution. I urge deliberation and I urge the opportunity for the parties to work at a solution.”

Opposition proposes CCJ fix date for elections

By Feona Morrison Lawyer for the Parliamentary Opposition, Senior Counsel Douglas Mendes told the Caribbean Court of Justice (CCJ)s judges yesterday that the respective parties (Opposition and Government) were unable to meet consensus in relation to the courts rulings on the No-Confidence Motion and the Presidents unilateral appointment of Justice James Patterson as chairman of the Guyana Elections Commission.

Addressing the CCJ yesterday at a post-ruling hearing, Mendes said, “We were not able to meet consensus on consequential orders on any of the matters before you.

We would suggest that the orders would flow from the

findings,” while proposing that the court should fix a date for elections.

During the hearing, President of the CCJ, Justice Adrian Saunders pointed out that GECOM is currently headless.

Justice Saunders noted, “There isnt a GECOM chairman and that process has to be reengaged. So in this vein, is it possible or tenable for elections to be held within three months without a GECOM chairman?”

Mendes responded, “Yes, one of the issues that has arisen I can say broadly speaking is what list (of voters) is to be used. We submit that the law is very clear on that question and therefore there is no discretion or deci-

sion to be made by anyone.”

Considering that the CCJ has now ruled that the NoConfidence Motion was properly passed on December 21, 2018 in the National Assembly, the Trinidad and Tobagobased Senior Counsel said that elections ought to have been held since March 21, 2019 since the National Assembly did not meet and agree on an extension.

According to Mendes, at the time the No-Confidence Motion was invalidated by the Court of Appeal, there was a valid list of electors which was used for Local Government Elections, last year. He explained that, that list expired on April 30, 2019, meaning that it was now available for update in terms of

“There is quite a bit of disappointment that we have to wait an additional two weeks before we have clarity on some matters,” Jagdeo added.He went on to say that they do have clarity on some issues, the first being that the government became illegal the moment the CCJ ruled that the No Confidence Motion was validly passed.

“The only way they can

change their illegal status is by fresh elections. So from now until those elections are held they will remain illegal, and therefore all acts committed and anything done outside the holding of elections will be deemed illegal by a new PPP government.

Jagdeo said that the second issue they have clarity on is that the [GECOM] chairman was unconstitutionally appointed “and as of now he should not make any decision in relation to elections. In fact, this is a form of justice, and if decency prevailed, by now he should have demitted (Comtinued on page 22)

During his submissions, Senior Counsel Mendes held that certain provisions in the Elections Act should be applied and the court should fix a date for when elections should be held in accordance with Article 106 (7) of the Constitution. He is of the view that elections should be held three months from yesterdays date on the basis of the list of electors that was in existence as of March 21.

Article 106 (7) states, “Notwithstanding its defeat, the Government shall remain in office and shall hold an election within three months, or such longer period as the National Assembly shall by resolution supported by not less than two-thirds of the votes of all the elected members of the National Assembly, and shall resign after the President takes the oath of office following the election.”

Justice Winston Anderson sought to clarify from

Mendes if he was suggesting that the court should stipulate three months for the holding of elections without hearing from GECOM as to whether credible elections can be held within that timeframe. At this point, the Senior Counsel said he was not certain as to what constitutes credible elections.

The CCJ judge explained that a credible election would be one in which the people of Guyana have confidence.

Referencing the provisions of Article 106 (7) of the Constitution again, Mendes said that the Constitution is very clear and the court is required to uphold it.

The Senior Counsel added, “We are trying to do our best to comply with the Constitution having regard to the fact that the three months period has already passed. We are suggesting that the most reasonable way is to direct in accordance with the Constitution. It says that the President and Cabinet must re-

sign and elections must be held within three months and the government should continue for the purposes of holding elections.”

Nonetheless, the Senior Counsel asked the court to give directions as to the list to be used for general elections. He submitted that this issue has stirred some controversy.

Mendes said, “Because there is controversy raging on what list is to be used. I have not been referred to any provisions which give the commission (GECOM) the power to delay an election because it considers it is not ready with a list. If the President under normal circumstances decides in his discretion to dissolve Parliament and to declare an election then the commission must comply. I have not seen any provisions which give the commission the power to say to the president that the date in invalid (and) you must fix another date.”

Furthermore, Mendes suggested that the court should fix a timetable for the President and Opposition leader to agree on a list of six names for appointing a Chairman for GECOM within seven days from yesterday.

Thereafter, he suggested that the President be given three days to appoint a chairman. He stated that the court should direct the President and Opposition Leader to act in good faith. The Senior Counsel is of the firm belief that the consequential orders he suggested would give effect to the spirit of the Constitution.

The Coalition Govt. has more to lose by house-to-house registration The demand for house-tohouse registration is counterproductive to the APNU +AFC coalitions chances at the next elections.APNU+AFC is intent on using house-tohouse registration as a pretext for delaying elections, but in so doing, it may be acting against its own best interests.

House-to-house registration will disenfranchise more PNCR than PPPC supporters. Disenfranchisement will affect PNCR supporters more than it will the PPPC supporters. For example, it is known that many of the supporters of the PNCR are working in the hinterland, but are registered elsewhere at their place of

residence. As such, if they are not a home at the time when the enumerators come around, they will not be registered in their districts.

Second, house-to-house registration will result in an inordinate delay in the holding of the elections. GECOM cannot complete house-to-house registration and the corresponding processes such as fingerprint verification within one year. The idea that house-to-house registration can be completed within six months is more optimistic than realistic.

House-to-house registration is likely to be completed after the five-year life of the government

would have expired next May. A constitutional crisis will develop, one that will be more severe than the present crisis.

Third, the longer APNU+AFC stays in office, the more its approval will suffer. The APNU+AFC Government is scandal-stricken. Hardly a week goes by without some damaging allegation. The latest one is the bombshell allegation that the Production Sharing Agreement between Exxon Mobil and the Government of Guyana may have been done without the knowledge of President Granger. If this allegation turns out to be true, it throws a completely different complexion

on the workings of the government - one that destroys the credibility of the President and some of his Ministers.

Fourth, a delay in elections will mean that the financial advantage of incumbency is lost.

It takes money to run an election campaign. And the PPPC will find it difficult to mobilise over a short period of time the billions of dollars it needs for an elections campaign. It is not in power and has always found problems raising campaign finance when it is out of power.

APNU+AFC on the other hand is in power and can use this to leverage resources from the private sector faster than the PPPC can. A delay in elections, however, will allow the PPPC to have more time to raise campaign finances.

Fifth, the supporters of APNU+AFC feel stung by the no-confidence motion.

APNU+AFC can capitalise on these feelings. The longer the elections take to be held, the less galvanised will be the APNU+AFC supporters.

Sixth, APNU+AFC believes that oil production will commence next year. And as such, may be waiting for the oil revenues to boost popu-

larity. But the coalition does not seem to understand that investors are wary of the political risks of investments.

ExxonMobil said that production will begin next year. But that can be pushed back one year, since the oil companies do not wish to be making a massive investment when the future political configuration is uncertain. APNU+AFC may therefore be waiting in vain for oil production to commence next year.

Seventh, there are divisions at present within the PPPC camp. There are factions that are displeased with the PPPCs presidential choice. A delay in elections will give the PPPC time to overcome these divisions.

It may therefore not be necessarily in the interests of APNU and the AFC to delay the holding of elections. They are likely to suffer greater disenfranchisement than the PPP. The coalition government, in delaying elections, may end up in a far more serious constitutional crisis as a result of the expiry of its fiveyear term before the completion of house-to-house registration.

The longer elections are

delayed the greater the risk of more misconduct being exposed and affecting their approval ratings. The financial advantage they now hold over the PPPC can evaporate by giving the PPPC more time to raise campaign finances.

And it hard to see how in the short-term an Irfaan Ali can beat a David Granger.

Right now the supporters of APNU are election-ready.

They may not be as ready within the next year given the economic crisis. The coalition can also end up disappointing their supporters who believe that billions of dollars are going to flow into the governments coffers next year.

With political tensions high, ExxonMobil may be forced to push back its production timelines.

APNU+AFC believes that it is best to delay elections.

Sometimes when you are traumatised you do not think straight.

They do absolutely nothing for the country when they get power There aren’t adjectives to describe the type of struggle that is currently taking place between the PNC+AFC and the PPP for power, since the ruling by the CCJ. But what do they do with this power?

They do any and everything with it, except to use it to make Guyana a better place, to socially elevate the citizenry, develop a physically modern country.

People who fought with Cheddi Jagan participated conspiratorially in the building of a Marriott Hotel, costing over sixty million American dollars, when they knew that an international hotel was

not one of the last things, but the very last thing a poor country like Guyana needed.

When that building was going up, a majority of Guyana’s streets were (and are still) without street lamps; the country’s only university had (still has) dilapidated laboratories; the main hospital in Georgetown was still way below a tenth rate hospital in the developed world; state-run schools were in a rundown state (they still are); the country was still getting frequent blackouts (they have increased over the years).

Amidst this backward-

ness, the protégés of Cheddi Jagan built a Marriott Hotel, where tourism is hardly a money-making industry and does not attract sufficient numbers to fill even one of the other two major hotels (Pegasus and Princess) on any given day, except when there is Te s t c r i c k e t o r C P L matches.

Then Jagan’s protégés lost power in 2015 and one of the very first policy-making acts of the new government was to spend more than a billion dollars erecting D’Urban Park. It made no sense, when the biology of the country was in identical shape when the Marriott was going up. Guyana has a National Park and the Providence Stadium. It simply made no sense in nation-building to spend that mammoth amount on another structure similar to the National Park and the Providence Stadium.

That is what the PPP did with power. This is what the PNC and AFC are doing with power. To put their

bankrupt ideology on display, the Minister of Public Infrastructure, in justifying D’Urban Park, said the numbers the Golden Jubilee of Independence would attract could not be accommodated at the National Park or the Stadium.

So a poor country builds a massive structure just to facilitate the crowds that would gather for an event that would last just one day, and will then never be seen again.

What will the PPP and now the PNC and AFC do with this power they are fighting for? A country’s leader has to be a complete idiot not to see where the fire service is situated is a disaster. Jagdeo had 12 years.

Ramotar almost five years and neither of these leaders possessed the commonsense to see that the service would have fit in most beautifully where D’Urban Park now stands. Guyana’s fire service must be the only facility in the world that is situated in the very heart of the busiest stop in the downtown area. The

Georgetown abattoir is a national disgrace. The present regime tore down a two-level post office on Alexander Street, Kitty. It replaced it with a one-level building, eighty feet by seventy feet. Yet this very administration is renting a three-storey building next to the Foreign Ministry to house the Gaming Authority.

The rent is in the millions.

How can this country take off into the future when you have such intellectually barren leaders? It doesn’t need even a secondary education to inform you that a threestorey structure could have gone up in Kitty. The first floor would be the post office and the other two levels could have gone to the Gaming Authority.

For twenty three years the PPP was in power, and the evidence that under it Guyana remained an essentially backward country was overwhelming. Under the Jagdeo administration in the 21st century, the Berbice River was bridged. The bridge was an early 20th century entity that the military would construct

Frederick Kissoon during war. See the 1957 movie, “The Bridge on the River Kwai.” The Berbice structure is the identical one the British military prisoners built for their Japanese captors.

Now the PPP is gone from power, and in the same 21st century, the new APNU+AFC regime is constructing another bridge on the Demerara River at Houston on the East Bank. The Chinese ambassador saw the drawing of the bridge and almost had a heart attack. He immediately exclaimed; “that is not a 21st century bridge.”

We end with the question; what do they do with the power they fight for? Check the cars they drive and the size of their bank accounts.

CAROSAI tasked with being regional vanguard of auditing reforms …as Guyana’s Deodat Sharma named new Chairman Guyana yesterday challenged the Region’s premier auditing body, the Caribbean Organisation of Supreme Audit Institutions [CAROSAI] to embrace change and champion modernisation of the legal framework to help position the Caribbean to maximise benefits from the efficient allocation of financial capital.

CAROSAI opened its 11th Congress at the Ramada Princess Hotel, Providence, East Bank Demerara with Chairman of the Parliamentary Public Accounts Committee [PAC], Mr. Mohamed Irfaan Ali, and PAC member, Public Health Minister, Mrs. Volda Lawrence, urging realignment with global trends to avoid negative outcomes.

“CAROSAI as the umbrella and guiding organisation of the Region must ensure that the auditing standards and techniques are in sync and on par with international guidelines, so that the Caribbean is not left behind and our member states can optimise their auditing ability to derive the best possible outcomes…the efficient allocation of capital,” Lawrence told her colleagues who represented the 23 countries of the 31-year-old body.

“In this regard, reforms to auditing are widespread in the United Kingdom, in the United States, in Continental Europe, and it is incumbent upon CAROSAI to become au fait with these reforms and in turn to apprise member states of same, so that evaluations can be done on how those reforms can be utilised to enhance our audit mechanism given its intrinsic value to the capital markets and the a u d i t o r s ’ opinion upon which investors rely heavily,” Lawrence said in

Lawrence, nevertheless, praised the work of G u y a n a ’s PA C , e v e n though she pointed out that it is still a work in progress as members are still learning about the vagaries of the parliamentary body. In her deliberation she also called on auditing bodies of the Caribbean to familiarise themselves with the role of parliamentary PACs “and the need for them to be incorporated in their Accounting Framework”.

“I am aware that in the smaller SAI [Supreme Audit Institutions] member states, the turnover of representatives in office is rapid, and hence PACs are challenged to operate in an e ff e c t i v e m a n n e r.

CAROSAI must therefore find solutions to address the deficiencies in the Region. Some Member SAI States, because of the construct of Parliamentary systems, have many challenges in terms of how the Auditor General’s report is addressed,” Lawrence said.

For this reason, she insisted that CAROSAI must be able to operate outside the box and ambit of SAIs. “CAROSAI must impress upon Governments in the Region the need to reform laws and legislation which are no longer relevant and which impede progress,” said Minister Lawrence, in stressing the vanguard role of the body.

Man accused of nine armed robberies, other charges remanded

26-year-old m a n w a s yesterday remanded to prison when he appeared in a city court, where 11 charges were read to him. He is accused of nine armed robberies, discharging a firearm and escaping lawful police custody.

The second charge read that on October 10, 2018, also at West Ruimveldt, armed with a knife, he robbed Mohammed Ishmael of a Samsung cell phone

valued at $40,000.

The third charge stated that on October 11, 2018, at East Ruimveldt Police Outpost, Payne, while being in lawful custody of the police for the offence of robbery under arms, escaped from custody.

It was also alleged that on November 28, 2018, at North East La Penitence, armed with a gun, he robbed Colin Edwards of articles amounting to $362,000.

Night shelter programme to have concentrated focus on depression

epression is an issue prevalent in society that does not receive much focus and in some cases isn't acknowledged.

The Night Shelter, under the Ministry of Social Protection, is continuing to provide its 2-hour service to residents and is striving to address their social needs, while preparing them for reintegration into society.

The programme, set to commence in August, is to help the residents curb social struggles that they battle with. Probation and Social Services Officer, Ms Natasha Mansfield, who was attached to the shelter three months ago, noted that the said programme is slated to cover topics including depression, substance abuse and mental illness and health. She further went on to explain that when she commenced her work at the shelter, she met with residents and had one-on-one discussions with them in order to identify their social needs. “When I interacted with the residents I began to understand their challenges,� she said, while adding that she found that some of them were depressed and had mental illnesses. Counselling was done and they were able to engage in physical exercise and group discussions.

She is aiming to have professionals come in and talk with the residents.

The programme will kick start with a concentrated focus on depression, which is most prevalent among the residents, and this will be followed by other topics. Mansfield said she will be liaising with professionals in

It was also alleged that on April 12, 2019 at West Ruimveldt, armed with a g u n , h e r o bbed Faith DeSouza of articles amounting to $48,000.

The final charge stated that on May 23, 2019, at Tucville, Georgetown, he discharged a loaded firearm at Roxcell Nichol with intent to maim, disfigure, disable or to cause grievous bodily harm to the said victim.

Travis Payne Harris objected to bail being granted to the defendant based on the grounds of the seriousness, penalties and the prevalence of the offences. He then stated that the events took place over a period of months, and that the defendant was sentenced before on an offence of similar nature. He added that it is clear that he didn't learn anything from the time spent in prison Prosecutor Harris further mentioned that the defendant was positively identified by all of the virtual complainants.

Payne then told the court that he was arrested and

taken to the Kitty Seawall where he claims that police officers beat him in his abdomen. According to Payne, he still has injuries to his toes from big bricks that were thrown on them.

The magistrate then allowed him to come out of the prisoner's docks and approach her so she could take a look at the alleged injuries.

After listening to the prosecutor and what the defendant had to say, Principal Magistrate Marcus remanded Payne to prison until July 15, when he is expected to make his next court appearance.

Two Berbice students in final stages of US Youth Ambassador Programme 2018/ 2019

T

wo of three students from Berbice, who were selected to be a part of the United Sta tes Ambassador Programme 2018/2019, are in the final phases of the undertaking.

The students, Daniel Narsaiah and Raquel Meenkum, are both from Berbice High School.

They would have recently written their CSEC exams and are set to pursue CAPE. The third stu d e n t h a s since migrated. Their term in the programme was started under former United States Ambassador to Guyana, Perry Holloway.

I n i t i a l l y six youths from Guyana were selected after applying online to the US website in G u y a n a .

They were subsequently interviewed and after going through other processes, were selected. They were taken to the United States where they participated in an intensive and highly interactive cultural and leadership

exchange on civic education, community service, and youth leadership development among other activities, before returning home.

Follow-on activities are an integral part of the programme, as the students apply the knowledge and skills they would have learned to implement projects that serve needs in their communities under the guidance of their mentor.

The Berbice Chamber of Commerce and Development Association (BCCDA) under t h e n P r e s i d e n t , Ry a n Alexander, had pledged its support and collaborated with the teens in fulfilling their goals.

During that time the students had visited a number of schools, both Primary and Secondary, and Clubs across Berbice, and concentrated on topics such as the environment, racial integration and social issues among others.

At the end of the programme they are expected to continue with their community and youth activism work. Certificates are also expected to be presented to the participants.

She appealed to them to use their knowledge as a teachable tool to guide the younger public servants.

Alleged chicken thief granted bail

man yesterday appeared in the Georgetown Magistrates' Courts before Principal Magistrate Sherdel Isaacs Marcus, where he was made to answer to a simple larceny charge. Twenty-sixyear-old Omalo Dick, a car wash operator of 'A' Field Sophia, Georgetown, pleaded not guilty to the charge that was read to him.

The charge stated that on June 22, 2019, at Mandela Avenue, Georgetown, he stole 170 lbs of chicken valued at $51,680, property of Rawle Birkett.

Police prosecutor Adunni Inniss made no objection to bail being granted to the defendant and Principal Magistrate Marcus

Omalo Dick granted the defendant bail in the sum of $10,000.

Dick is expected to make his next court appearance on July 8, when his trial is expected to commence.

orty-two year-old Joel Bond was yesterday granted bail after he appeared in the Sparendaam Magistrate's Court before Magistrate Alicia George on a charge of causing death by dangerous driving.

Bond pleaded not guilty to the charge which alleged that on June 11, last, at the Rupert Craig Highway, East Coast Demerara, he drove motor car PPP 8909 in a manner dangerous to the public, thereby causing the death of Mitford Cambridge.

Magistrate George granted bail to the tune of $100,000 and adjourned the matter to July 31, when the defendant is expected to return to court for

continuation of the matter.

According to reports on the day in question, Bond was driving on the Rupert Craig Highway in the vicinity of MovieTowne in a Sport Utility Vehicle (SUV) assigned to city mayor, Pandit Ubraj Narine.

At the time of the accident, the mayor was not in the vehicle. It is alleged that Bond lost control of the vehicle and he slammed into three parked vehicles, one of which Cambridge was in.

Cambridge, who was a 53-year-old resident of Section 'C' Middle Walk, Buxton, East Coast Demerara, succumbed to his injuries the next day. The mayor's vehicle suffered extensive damage to the front and rear.

As stated by Alves, the constable will be charged departmentally; and a disciplinary charge will be issued as directed under the Police Act. He further stated that under such a charge, if a rank is found guilty, the charge will be directed by the Police Commissioner.

According to Alves, the rank can be fined, dismissed or demoted, but that will depend on the discretion of the organization and the nature of the charge.

The constable was confronted at his workplace after the raid and was subsequently placed under close arrest. This later changed to an 'open arrest' and as such the rank, who

still remains on the job, has been given a change of duties.

This, according to police sources, is in keeping with the law when it relates to the rights of ranks who are being investigated for breaking the law.

Sources are suggesting that the constable may have been involved in 'underhand business' with members of the public, thus resulting in the passports being found at his home.

Casinos, betting shops targeted for more money laundering scrutiny

s the noose continues to tighten on money laundering, the Gaming Authority has announced a tougher regime for the sector.

In early 2022, less than three years' time, the Caribbean Financial Action Task Force (CFATF) which monitors member states and make pronouncement on their money laundering fight, will be evaluating the gaming sector.

Guyana, with its single casino at Providence, and with betting shops and other operations, will be readying itself for those “mutual evaluations�.

Failure to get the house in order could see Guyana facing a poor categorisation which in turn could impact funding and good standing with donor agencies.

The gaming sector is considered high risk when it comes to money laundering.

Yesterday, the Gaming Authority held a stakeholders' forum at The P e g a s u s , w i t h representatives of the entity, the Financial Intelligence Unit and others gathered.

The event is part of the preparations for the first quarter of 2022 when CFATF will be holding the evaluations for Guyana.

According to Chief Executive Officer of the Gaming Authority, Lloyd Moore, national assessments have identified the gaming sector as a high risk sector.

He explained that the authority has been given supervisory mandate over the sector, which includes casinos, lotteries and betting shops.As part of the responsibilities, the Gaming Authority has to help make preparations, as well as provide training and monitoring for the sector.

The stakeholder forum, he explained, forms a part of the preparatory process allowing reporting entities to

understand of the role and responsibilities of preparing for the 2022 evaluations.

According to Moore, there are currently 11 licensed reporting entities in the gaming sector.

Speaking to reporters after the first session, Moore disclosed that the authority is stressing on ensuring it knows early who are the beneficial owners and directors, as part of the monitoring phase.

The monitoring can see verbal or written warnings, and later escalate to even revocation of licences, Moore said. He said that part of the monitoring includes looking for sudden injections of funds and (continued on page 17)

Guyana-ExxonMobil PSA has the most unusual decommissioning provisions - Must be urgently corrected in all contracts - University of Houston Instructor

h e n a n offshore oil production project is nearing its end, the operators prepare for an a c t i v i t y c a l l e d decommissioning. This involves the safe draining and removal of pipelines, partial or complete dismantling of platforms, and the safe capping of wells. It is an activity that can cost billions of dollars.

In light of this, oilproducing nations across the world establish special funds or accounts that the oil operator contributes an annual fee to so that when that abandonment period comes,

Guyana's Production Sharing Agreement (PSA) makes no provision for the pre-funding of this activity.

As such, University of Houston Instructor, Tom Mitro says Guyana finds itself in a most dangerous situation. He said that at the earliest opportunity, Guyana should correct this loophole that leaves it open to high risk in all contracts, and even its model PSA going forward.

Mitro said, “So what normally happens is that they have an agreement on what will happen with the funding relating to abandonment.

Most places require financial security in terms of a fund that the oil company contributes to or a bond or guarantee from a bank. But in Guyana, there is nothing. There is no guarantee other than Exxon and its partners saying 'trust

us, we will pay for that.' The fact that no pre-funding is required under Section 20.1(ff) of the PSA is highly unusual by today's industry standards.”

The consultant added, “...It is important to also note that if a large, financially sound company like ExxonMobil ever sells its interests, which it almost certainly will one day, to a smaller, less financially secure or environmentally conscious company, then this represents a significant financial and environment risk to Guyana.”

She noted that the President in his address to a CFATF plenary meeting in November 2017 had made the same call.

According to the minister, money laundering is all about deception, with the aim to mislead the authorities about the existence of illegal sources of income and the subsequent processing of that income to make it appear to be legitimately earned.

In fact, she reminded, money laundering plays a critical role in furtherance of drug traffickers, terrorists, organised crime and tax

evaders. She urged the stakeholders to ensure that the sector does not succumb to money laundering.

20.1(d)(gg) and Accounting Procedure Section 3.1 of the Guyana-ExxonMobil deal, the oil giant can tabulate a budget for abandonment , and recover a portion of that budget in the form of oil, years before it is time for decommissioning.

The Petroleum Consultant pointed out that best practice dictates that some cost recovery for abandonment is important to establish, since there will be no production once a field is abandoned.

He stressed however that this only happens after the company starts pre-funding into some sort of escrow account.

“But this provision of allowing them to begin cost recovery, in some cases, 2030 years before they actually fund the costs is a very

significant benefit for the companies from a cash flow and net present value standpoint... It is not the norm. It is the most unusual provision I have ever seen in a PSA,” Mitro stated.

The University Instructor further emphasized that costs to fully decommission large offshore platforms and pipelines can be in the hundreds of millions of US dollars. He noted that the company may end up selling its equity interest prior to the time of decommissioning/ abandonment. If that was to happen, Mitro noted that the way Guyana's PSA is set up, Exxon and its partners would have fully recovered all the costs associated with that activity. In short, only Guyana stands to lose in this type of arrangement.

Agreement signed for local auditors to benefit from Canadian training A

Memorandum o f Understanding (MOU) has been signed between the Audit Office of Guyana and the Canadian Audit and Accountability Foundation (CAAF) to ensure improved transparency in the management of public resources.

It was emphasised that the MOU, which was inked on June 23, signals the CAAF's continued commitment to the development of the Audit Office of Guyana.

The two agencies share a mutual goal; to contribute to the improvement of transparency, effectiveness and accountability across the board as well as governance and management of public resources.

This goal is being

realised through the effective partnership of the two organisations.

The alliance allows several local officers to attend training in Canada to contribute to CAAF through integration.

While there, they undergo active training programmes in the field to provide greater exposure and experience.

Auditor General of Guyana, Deodat Sharma explained: “CAAF has provided unwavering capacity building support through training and other resources which has buttressed the performance audit practice of the Audit Office.”

Recent sexual assault allegations bring laws sharply into focus

T

he recent sexual a s s a u l t allegations have brought the laws related to sexual offences sharply back into focus. According to the provisions under the Sexual Offences Act 2010, sexual assault is ranked as a severe offence which carries a penalty of imprisonment.

Chapter 8:03, of Sexual Offences Act specifically states that a person commits the offence of sexual assault if he/she touches another person (the complainant) in a sexual way; causes the complainant to touch them in a sexual way; causes the complainant to touch a third party in a sexual way; or otherwise indecently assaults the complainant within the meaning of any other law.

The law specifies that in the instance of sexual assault, the complainant cannot consent in any way to touching or act which constitutes the crime and the accused does not reasonably believe that the complainant consents.

Further the section reads that once a person is convicted of the sexual

assault, he/she is liable on imprisonment of five years in the Magistrate's Court and ten years in the High Court.

Although the law is clear of the offence of sexual assault and penalties attached, society is still generally ignorant as regards matters of sexual crimes.

A high incidence of rape and sexual assault committed in Guyana remains unreported. The US State Department in its 2015 report had emphasised that a large number of cases of rape and other forms of sexual assaults are unreported to authorities, most likely due to fear of stigma, a lack of confidence in authorities, retribution, or further violence.

The US State Department sought to highlight the need for more public education and awareness with regard to sexual crimes.

At a recen t f o r u m organised by The United Nations Children's Fund (UNICEF), members of the Judiciary sought to remind media operatives of their role as the nation's informants.

Given her role in

Criminal Courts, Justice Jo Ann Barlow, who addressed the gathering extensively on the issues and consequences of sexual offences, pointed to the lack of awareness, misinformation and misconceptions in the public domain as it relates to the laws of sexual offences.

The Judge noted there are a number of “sweeping changes” made to the Sexual Offences Act which was amended in 2010. She dictated that the Act was revised to include a number of other sexual crimes.

According to the Judge, among them, persons who abuse their position of trust were included as violators of the law.

“Persons who stand in a position of trust include teachers church leaders/other religious leaders, caregivers, guardians, social workers, coaches; any person who has some instruction or supervisory role to play in the lives of others…”

Justice Barlow said that the Act was amended to include family members, who can be liable of sexual offences. She noted that the

old law prohibits incest, but was primarily focused on sexual contact between parents and their child/children. But now the legislation has been expanded to include stepparents, grandparents, and other blood relatives as well, as those close family ties.

Additionally the Judge noted that the act of voyeurism, (peeping) which is not a well known offence, is also added to list of sexual offences.

“Vouyerism occurs if a person peeps at another person for sexual gratification; so if a person peeps for sexual gratification at another person who is naked or is engaged in sexual intercourse, he/she is liable of an offence.”

She noted too that Rape, which is the most popular offence, has seen drastic changes. According to Justice Barlow, under the old law, rape only relates to unlawful placement of a penis into a vagina. However under the present legislation, it is if there is sexual penetration of the vagina or anus of a person or any part of that person's body by

another person.

She stressed too that penetration through the use of foreign objects--- a pen, a stick, or any other item is also prohibited.

The Judge said that the law was amended to include unwanted sexual acts committed orally--- for instance, a man forcing women to perform oral sex on him is deemed unlawful.

During the forum, it was noted too that the judiciary has been working assiduously to ensure the public confidence in the court system. The Sexual Offences Court has been installed for this reason.

The Sexual Offences Court, a specialised feature, is equipped with audiovisual devices to aid the testimony of witnesses.

Prior to the establishment of the court, a notable number of sexual offences matters were nolle prosequi, often because of complainants' unwillingness to testify before the High Court. Due to the sensitive nature of such cases, sexual assault victims are often terrified of reporting their experiences to the police and

The Sexual Offences Court was specifically designed to help victims, who may decline to continue with the matter due to how traumatising the experience can be. The Court has been equipped with screens and monitors, which help to separate the victims from the accused persons as they testify.

At the opening of the Court, Chancellor of the Judiciary Justice Yonnette Cummings-Edwards had noted that victims and witnesses of sexual offences may require counseling. The Chancellor noted that NGOs like Help and Shelter can help by providing psychosocial services to the victims and witnesses.

NAREI, IICA fighting fruit fly to allow easy trade of fresh produce Participants at the Carambola Fruit Fly programme workshop

emoving any trade issues against certain fresh crops produced by Guyanese farmers is the vision of the Carambola Fruit Fly (CFF) programme being implemented by the National Agricultural Research and Extension Institute (NAREI) in collaboration with the InterAmerican Institute for Cooperation on Agriculture (IICA).

Dr. Oudho Homenauth, Chief Executive Officer of NAREI during his presentation at a CFF Workshop held yesterday at Regency Suites, Georgetown, emphasised the economic hardship that the infestation of this pest has caused farmers. The control and ultimate eradication of the Carambola Fruit Fly is crucial to improve the livelihoods of farmers, particularly those in the hinterland, where the pest has a high population, he added.

Speaking to the gathering comprising Quarantine Officers, Extension Officers and farmers, Dr. Homenauth said that careful inspection is required for commodities entering Guyana from Brazil. He pointed out that the pest was first observed in Region Six in 1993, an indication it had entered from Suriname.

The Carambola Fruit Fly

has since spread to other parts of the country via the movement of people and commodities. In fact, a recent survey conducted by the Institute proved that the pest is prevalent in Regions Six, Eight and Nine. The findings of the survey formed the basis of the workshop.

NAREI and IICA have collaborated to enhance public awareness of the pest through social media, radio broadcast, posters and community outreaches.

Furthermore, officers as well

as community leaders will be trained to better control the CFF. H o w e v e r, G u y a n a cannot tackle the spread of this pest in isolation owing to its porous borders.

According to IICA Country Representative, Mr. Wilmot Garnett, Guyana, Brazil and Suriname have signed a Memorandum of Understanding outlining areas of collaboration to control this pest, of economic importance. One area that would benefit both Guyana and Suriname is the

creation of a support structure for Suriname to implement an effective CFF programme.

Mr. Garnett indicated that the formation of two five-year plans to combat the CFF is in the pipeline.

This is in line with the strategic approach the Ministry of Agriculture wants. Permanent Secretary of the Ministry of Agriculture, Ms. Delma Nedd has charged NAREI to include the CFF programme as a line item in the Institute's budget.

Ms. Nedd stated that citrus are among the fresh fruits with the greatest export potential, however, exporting same is a major challenge for the country in view of the need to comply with the Phytosanitary requirements demanded by the importing country.

She added that the agriculture sector is somewhat stymied by the limited exportation of nontraditional fruits due to the uncontrolled presence of the CFF. Only recently the list of fruits with restrictions due to

this pest has increased in the United States of America, due to the published information on a new host range.

Farmer Charlton Nurse, whose farm is located in West Watooka, Region 10, is contemplating cutting down his cashew and citrus trees if the CFF is not controlled.

For some time his ability to earn from the crops is being impeded owing to the pest.

One year later…

No efforts made to correct defects in Lima Sands road

A

fter more than a year, the condition of the uncompleted Lima Sands road on the Essequibo Coast, has drastically worsened, leaving residents to question the interest of the authorities. During March 2018, residents had complained bitterly about the substandard work, done on the road.

Lima Sands is home to more than 300 Essequibians; located just a few miles inland. It is believed that the construction of the road, which was supposed to be asphalted, would've aided significantly in boosting the community's economic activities, namely logging and farming.

The project was reportedly budgeted for at $8.2 million. It was noted, however, that the project was awarded for less than $6 million dollars in 2018. The road surface was prepared, but the project was abandoned within months. Eventually the incomplete

road eroded.

Today, the stretch of road is riddled with huge potholes, and appears to be in an even worse state, compared to when the original complaints were made.

“This road was much better before dem come and mess it up… now it got some big potholes and with the rain, now it just full with a set ah water.”

Residents are stressing that they should've been consulted before works commenced within their community; underscoring the fact that adequate consultation would have led to a suitable and acceptable design and outcome.

One resident noted, “nobody ever talk to us saying that they going to do road. All we see is people come in, grade out, and put in… now we have a road two vehicles can't even pass side by side on this empty, even more so with people on the road.”

20 Lombard St. families to get homes at Prospect - CH&PA, Food for the Poor Inc. to fund construction

About 20 families will soon own their own homes after the Central Housing and Planning Authority (CH&PA) has partnered with Food for the Poor (Guyana) Incorporated (FFTP) to fund the construction of the houses.

The families are among those who are being relocated from the Broad and Lombard Street Squatting area.

In July 2017, a court order was issued in favour of the De Freitas and Gonsalves company, ordering more than 140 persons to vacate the Lot 17-18 Broad and Lombard Street property.

Just about two years later, a Memorandum of Understanding (MIU) was signed between CH&PA and the FFTP to relocate the residents.

Phase one of this MOU will see an initial 20 families being housed in Prospect on the East Bank of Demerara by November 2019.

Phase two will see homes for the remaining 50 families constructed in Cummings Lodge.

Minister within the Ministry of Communities with responsibility for Housing, Annette Ferguson noted: “Even though it has been ap-

proximately two years, finally the dream has come to fruition. I have been advised that these residents have been living in that area for approximately 30 years.”

She added that this step taken to address a very serious housing issue, “moves the ball closer to the goalpost” of governments continued thrust to ensure every Guyanese is provided with affordable and suitable housing.

According to the party, it wishes to stress that the reports by whistleblowers, published by the local media corps, provide enough justification for a wider probe to be ordered, particularly since what is at stake is public confidence in the leadership of the force and a test of the commitment to address the issue of corruption.

They made allegations of bribes being paid to duck evidence and even for tips when police are on operations. There were other allegations of police ranks escorting drug shipments and even being made to pay superior officers a monthly fee by collecting kickbacks from traffic offenders.

“Housing is a fundamental right; housing is a basic need, because one of the first things that anyone would wish to have is a shelter over his head and it is for this reason, we at CH&PA are compelled to provide housing for the people of Guyana,” he said.

Chief Executive Officer of FFTP, Kent Vincent remarked

that the organisation which he represents has built more than 3,900 homes countrywide for families.

He added that this partnership with the CH&PA is the first of its kind and looks forward to similar ventures in the future.

“Food for the Poor will be financing 41% of the total cost of the homes and each parcel of land FFTP will be financing the cost for the land at $58,000 for each parcel as well as we will be paying the conveyance fee and the transports at $8,000 each so we are making sure we make it very easy for these residents,” Vincent explained.

New surgical technique piloted in Guyana Four surgeons officially trained to perform thyroidectomy procedure Four specialised surgeons attached to the Georgetown Public Hospital Corporation (GPHC)s Department of Surgery have been trained to perform thyroidectomy procedure.

Their training was part of a one-day workshop hosted by the Caribbean College of Surgeons (CCOS), a day before the start of their 17th Annual scientific conference which ran from June 20 to 22 in Guyana.

As a result of this pilot, four surgeries were performed.

A team of visiting surgeons did the first operation while the local team conducted the other three procedures under the supervision of the visiting team of surgeons.

Surgery Consultant, Dr. Shailendra Rajkumar explained that “this workshop was the first of its kind where they actually removed thyroid glands from persons who had diseased thyroids with a suture-less technique. It is the first time it has ever been done here [in Guyana] and we managed to operate on four patients without any complications, to the benefit of the entire department of surgery

“The reason why we never did it [thyroidectomy] was

because we could never afford the device prior. So, now, we are reducing operating time by almost one-third. A surgery would normally last one and a half hours, could be done in just under an hour with the same outcome, so the patients stay less time asleep, and they go home earlier.”

A thyroidectomy is a surgical procedure to remove all or part of the thyroid gland

Gold band snatcher to know fate on July 8 A father of two was yesterday remanded to prison and instructed to return to court on July 8 to know his fate, after he admitted to pulling off a womans gold band to obtain money to take care of his children.

Jason Thomas, 26, was arraigned in the Georgetown Magistrates Courts before Principal Magistrate Sherdel Isaacs-Marcus who read the charge to him The court heard that on June 22, 2019 at Regent and Wellington Streets, Georgetown, he stole from the person of Clareann Rambarran, a gold band valued at $120,000.

Police prosecutor Adunni Inniss stated that on the day in question at about 13:10hrs, Rambarran was walking along Regent Street, and while at the intersection with Wellington Street, Thomas walked up alongside her and held onto her right arm. He then pulled off her gold band and attempted to run away. However, Rambarrans sister, who was with her, raised an alarm.

Police ranks on patrol in the area at the time responded and were able to apprehend Thomas.

Thomas pleaded guilty to

The probation officer related that although he was not able to make contact with the woman, he made contact with the defendants mother.

According to the mother, she only knows about one child and she is ashamed of her sons actions. He visits her with the child and she was shocked to hear that he was caught up in bad dealings.

Moreover, the probation officer indicated that a talk with the investigating rank into this matter highlighted that Thomas has previous matters before the court, of a similar nature.

After listening to the information, the magistrate instructed the prosecutor to get more details on the previous charges and report to her on July 8, when Thomas will be sentenced.

Some of the participants in the 17th Annual scientific conference of the Caribbean College of Surgeons and is used to treat diseases of the thyroid gland, including thyroid cancer. The thyroid gland regulates metabolism by secreting hormones.

When diseases affect the thyroid, its size or activity may become abnormal.

This is just one of many new developments resulting from CCOS conferences which were recently held. At these meetings or educational symposiums, as members of the college refer to them, Caribbean surgeons share information regarding new procedures as well as new devel-

opments to methods that were practised for many years.

The Caribbean College of Surgeons 17th annual scientific conference was held at the Guyana Marriott Hotel.

Out of its membership of 250plus surgeons, more than 150 attended the conference, making this the largest convention held.

Vice President of the CCOS, Professor Shamir Cawich explained that the goal of the meeting was to contribute to the improvement of healthcare packages

across the Caribbean.

“This educational symposium covers a wide range of topics in surgery, and it ranges from cutting edge techniques that are now being discovered like single incision laparoscopy all the way to transplantation, so it covers a very wide range of surgical specialities.”

Guns missing from security firm linked to accused in Lethem businessman murder plot A number of guns that belonged to a security firm linked to a city hotel owner, who is implicated in a murder plot, are reportedly missing.

According to officials, the police have launched an investigation to determine what happened.

Mark Grimmond, the owner of Rockies International Hotel on Light Street, Georgetown, was arrested along with an alleged contracted hit man earlier this m o n t h .

Grimmond, 57, from Lot 320 Grove Housing Scheme, East Bank Demerara (EBD); and Chatterpaul Singh, 36, a miner who resides at Lot 1 First Street Cummingsburg were recently before the court. They were not required to plead to the indictable charge. It was alleged that between April 1, 2018 and June 7, 2019, at Georgetown, they conspired with each other and persons unknown to murder Dwayne Grant, a businessman from Lethem.

He was granted licences for almost 100 guns, among them handguns. The security firm was asked to hand over the guns to the CID headquarters at Eve Leary.

However, according to

police officials, the checks have revealed that not all the guns have been accounted for. As such a probe is underway.

With regards to the charges, it was reported earlier this month that Grant, the Lethem businessman, received certain information that the men were plotting to kill him. He reported it to the police. The police ranks acting on the report went to a hotel where they made contact with the number two defendant, Singh. Singh was arrested and at that point in time he was reportedly found with a firearm.

In a detailed conversation with the police, Singh alleged that he was contracted by Grimmond to kill Grant.

Grimmond was subsequently arrested and the allegation of conspiracy to commit murder was put to him. Telephone conversations between the two defendants were obtained by the police.

Based on advice from the Director of Public Prosecutions, the charges were instituted.

United States government reacts to Trinidad and Tobago’s criticism PORT OF SPAIN, Trinidad - CMC – The United States government says it looks forward to working with the Trinidad and Tobago government after Port of Spain reacted angrily to a report by the US State Department that placed the oil-rich twin island republic among several Caribbean countries not in compliance with the minimum standards for the elimination of trafficking in persons (TIP).

Of the Caribbean countries listed in the “2019 Trafficking in Persons Report,” only the Bahamas and Guyana “fully” met the minimum standards for the elimination of trafficking.

The report noted that the Antigua and Barbuda, Barbados, Belize, Jamaica, Haiti, St. Lucia, St. Vincent and the Grenadines, Suriname and Trinidad and Tobago had been placed on Tier 2.

But Prime Minister Dr. Keith Rowley, speaking at a ceremony here on last Friday, wondered whether or not the country that gave Port of Spain a failing grade was doing much better with its own migration and TIP situation.

“Well if I was marking their paper what would I give them? They have the same problem we have – thousands of migrants rushing your border wanting to come into your country because they see a greener grass on your side than on their side. That is the number one political issue in America,” Rowley said. “ Children are dying on the border, some of them in cages, hundreds of people in a room that is built for 10, the temperature is 41 degrees and, of course, they have a bigger military, they have a bigger security system, they have an army, a navy, an air force and they got a bigger treasury than Trinidad and Tobago,” he

said, asking “how have they handled their situation better than ours?”

However, in a brief statement, the US Embassy, while it did not directly responded to Rowley, made mention of an earlier statement issued by National Security Minister Stuart Young, saying “we appreciate the Minister of National Security’s balanced approach to the issues raised in the TIP report and look forward to working with the Government of Trinidad and Tobago to continue fighting this crime against universal human rights”.

The two paragraph statement added that the “2019 Trafficking in Persons (TIP) report covers the period up to March 2019,” and that “the report notes progress made

by Trinidad and Tobago in multiple areas while acknowledging how Trinidad and Tobago, and many other countries, can continue taking steps to end the scourge of modern day slavery”.

The report had been critical of Trinidad and Tobago’s

dealing with Venezuelans fleeing their homeland where opposition forces backed by Washington are seeking to remove President Nicolas Maduro from office.

Washington said Trinidad and Tobago “did not adequately screen migrants, asylum-seekers, or refugees for trafficking indicators, including among Venezuelans.

“The government decreased the amount of funding for victim services and did not provide adequate victim care in some cases,” the report added.

But Rowley said that Trinidad and Tobago had maintained an open border with Venezuela until last Monday when the country initiated its registration programme with 15,000 Venezuelans registered under the programme.

“A little Caribbean nation like Trinidad and Tobago, we have 15,000 Venezuelans authorised now to be in our borders and we treat them like human beings within Trinidad and Tobago,” Rowley said.

Govt. wants to buy out Digicel operation ST. JOHN’S, Antigua CMC – The Antigua and Barbuda government says it remains committed to buying out the operations here of the Irish-owned telecommunication company, Digicel, as the authorities announce new initiatives in its ongoing battle to have the two foreign owned companies share the spectrum space in Antigua and Barbuda with a state-entity.

Last month, Digicel, defended its decision to secure a High Court order preventing the government from sharing any of the 850 MHz spectrum it has been allocated with the state-owned Antigua Public Utilities Authority (APUA).

But speaking on his privately-owned radio station over the last weekend, Prime Minister Gaston Browne said he believes that Digicel “is showing an inclination to have possibly a 49-51 percentage situation.

“That’s the sticking point because we want the majority,” he said, adding that if the Digicel officials are prepared to “look at the possibility APUA…acquiring Digicel Antigua then we may have a deal”.

Earlier, Senior Counsel Anthony Astaphan told radio listeners that the government is moving to amend the Telecommunications Bill so as to provide further protection for APUA. Astaphan, who is among lawyers representing the state in the court battle, said the government is seeking to provide some level of protection for the only telecommunication company in the Eastern Caribbean, not owned by foreign interests.

“So that is something, with the Prime Minister’s specific permission, we will spend the next five to seven days looking at to see how best we can reformulate some of the provisions to give some protection to a local asset which is APUA and not open it up to the extent that they may or may not be unfairly prejudiced by having to comply with certain things,” Astaphan added.

He said the proposed legislation would allow for the authorities to make an order that “spectrum already allocated to a provider should be distributed or shared with somebody else to create an

even playing field in the public interest subject only to the condition of compensation…”

Earlier this month, the government said it expects the High Court matter involving the two foreign telecommunications companies objecting to the plan to share the 850 megahertz spectrum with the state-owned utility company to “be heard over several years”.

Digicel said that it had taken the legal action because it wanted to shield its customers from “significant service disruption and a negative impact on coverage.”

Digicel claims that APUA has almost twice as much spectrum as either of the other two operators in the market, despite having less than 25 per cent.

“APUA is hoarding a scarce and valuable resource,” the Digicel said, adding “in any other market, this would be a cause for concern for the regulator, but uniquely in Antigua & Barbuda, APUA is also the Regulator”.

Russia warns of repeat of 1962 Cuban missile crisis MOSCOW (Reuters) The U.S. deployment of landbased missile systems near Russia’s borders could lead to a stand-off comparable to the 1962 Cuban missile crisis, Russian Deputy Foreign Minister Sergei Ryabkov was quoted as saying on Monday.

Russia has been fiercely critical of U.S. plans to deploy missile systems in Eastern Europe, and of Washington’s withdrawal from the INF arms control treaty.

The Cuban missile crisis erupted in 1962 when the Soviet Union responded to a U.S. missile deployment in Turkey by sending ballistic missiles to Cuba, sparking a standoff that brought the world to the brink of nuclear

war.

The crisis was defused when Soviet ships headed for Cuba turned back in the face of a U.S. naval blockade.

Eventually, the Soviet Union agreed to remove its missiles from Cuba; in return, the United States promised not to invade Cuba and, secretly, said it would remove the U.S. missiles from Turkey.

“If things get as far as an actual deployment on the ground of these sorts of systems, then the situation won’t just get more complicated, it will escalate right to the limit,” RIA news agency quoted Ryabkov as saying.

Bernie Sanders calls for canceling $1.6 trillion in student loan debt WASHINGTON (Reuters) - U.S. presidential contender Bernie Sanders proposed a plan on Monday to cancel $1.6 trillion in student loans and pay for it with a tax on Wall Street, elevating the issue in the 2020 debate and going beyond proposals from his Democratic White House rivals. Sanders, an independent U.S. senator from Vermont, said his plan would wipe out college debt for 45 million Americans and be funded with a tax on stock, bond and derivatives transactions that would raise about $2.2 trillion over 10 years.

The proposal builds on Sanders’ longstanding call to make public universities and colleges tuition-free, an issue he has highlighted since his first presidential run in 2016.

He said student loan debt was economically crippling young Americans.

“This proposal completely eliminates student debt in this country and ends the absurdity of sentencing an entire generation, the millennial generation, to a lifetime of debt,” Sanders said at the unveiling of his U.S. Senate bill.

“The American people bailed out Wall Street. Now, it is time for Wall Street to come to the aid of the middle class of this country,” he said.

Other liberal Democrats, including presidential rivals Elizabeth Warren and Julian Castro, have taken up the call and proposed smaller student-debt cancellation plans.

Warren has proposed canceling $50,000 in student loan

debt for anyone with annual household income under $100,000 and give substantial cancellation to those between $100,000 and $250,000. She proposed paying for the plan with a tax on wealthy families.

The Sanders proposal comes two days before the first debates involving candidates seeking the Democratic nomination for the right to challenge Republican President Donald Trump in November 2020. Ten candidates each will meet in back-to-back debates on Wednesday and Thursday nights in Miami, Florida.

Cyprus serial killer Nikos Metaxas handed seven life sentences (BBC) A Greek-Cypriot army officer has been handed multiple life sentences for the premeditated murder of five foreign women and two of their children. Nikos Metaxas, 35, pleaded guilty in court on Monday to 12 charges relating to the abduction and killing of seven women and girls in Cyprus over three years.

In tears, he apologised to the victims’ families and said he did not know why he committed the “hateful crimes”.

The case, Cyprus’s first trial of a serial killer, has stunned the island.

Trump imposes new U.S. sanctions on Iran’s supreme leader, other top officials WASHINGTON/RIYADH (Reuters) - U.S. President Donald Trump targeted Iranian Supreme Leader Ayatollah Ali Khamenei and other senior Iranian officials with new U.S. sanctions on Monday, looking for a fresh blow to Iran’s economy after Tehran’s downing of an unmanned American drone.

With tensions running high between the two countries, Trump signed an executive order imposing the sanctions, which U.S. Treasury Secretary Steven Mnuchin said would lock billions of dollars more in Iranian assets.

Trump told reporters the sanctions were in part a response to last week’s downing of a U.S. drone by Iran, but would have happened anyway. He said Khamenei was ultimately responsible for what Trump called “the hostile conduct of the regime” in the Middle East.

“Sanctions imposed through the executive order ... will deny the Supreme Leader and the Supreme Leader’s office, and those closely affiliated with him and the office, access to key financial resources and support,” Trump said.

Iran’s Foreign Minister Mohammad Javad Zarif responded in a Twitter post that

hawkish politicians close to Trump “despise diplomacy, and thirst for war.” Last year, Trump withdrew the United States from a 2015 international accord to restrict Tehran’s pathway to a nuclear bomb and has since been ramping up sanctions to throttle the Iranian economy.

The latest sanctions are aimed at denying Iran’s leadership access to financial resources, blocking them from using the United States financial system or having access to any assets in the United States.

“Anybody who conducts significant transactions with these sanctioned individuals may be exposed to sanctions themselves,” the White House said.

Some policy analysts say that earlier sanctions issued under Trump’s “maximum pressure” campaign are why Iran has felt compelled to adopt more aggressive tactics as its economy feels the crunch. The Trump administration wants to force Tehran to open talks on its nuclear and missile programs and its activities in the region, saying the 2015 deal did not go far enough.

Trump said the sanctions are a “strong and proportionate response to Iran’s increasingly provocative actions.”

Ethiopia Amhara ‘coup ringleader killed’

(BBC) The suspected ringleader of Saturday’s failed coup attempt in Ethiopia’s Amhara region has been shot dead, police say.

Brig-Gen Asaminew Tsige was killed as he attempted to escape from his hideout in Amhara’s capital, police added.

Ethiopia’s army chief Gen Seare Mekonnen was killed while trying to foil the coup, the government said.

Prime Minister Abiy Ahmed has urged Ethiopians to unite against “evil” forces set on dividing the country.

Flags are flying at half-mast after the government declared a day of mourning to mark the deaths of loyalists.

Gen Seare and Amhara governor Ambachew Mekonnen, who was also killed on Saturday, were seen as close allies of the prime minister. A heavy contingent of pro-government forces has been deployed in Amhara’s capital, Bahir Dar, and the federal capital, Addis Ababa.

The internet has been shut across the country, days after services resumed following an unexplained blackout of more than a week.

The US state department has warned its staff in Addis Ababa to stay inside.

Jimenez leads way as Mexico tops Martinique CHARLOTTE, North Carolina – Raul Jimenez scored a goal and had an assist to lead Mexico to a 3-2 win over Martinique in 2019 Concacaf Gold Cup Group A on Sunday night at Bank of America Stadium in Charlotte, North Carolina.

Mexico came racing out of the gates but had to wait until the 29’ minute for its first goal when Uriel Antuna fired in a strike for a 1-0 lead.

Sweden sink Canada to set up Germany clash PARIS (Reuters) - Sweden’s Stina Blackstenius struck in the second half as they won 1-0 against Canada, who missed a late penalty, at the women’s World Cup to set up a quarter-final against Germany.

In sweltering conditions at the Parc des Princes, the two teams struggled to register any shots on target in a first half despite Canada dominating possession.

That all changed after the break when the Swedes stepped up a level and they were finally rewarded in the 55th minute when the Canadians lost possession of the ball in midfield.

Kosovare Asllani played an inch perfect diagonal ball to striker Blackstenius, who prodded the ball past onrushing keeper Stephanie Labbe.

It was her first goal of the tournament and it freed the Swedish team, which almost added a second with a thunderous drive from Fridolina Rolfo in the 61st minute.

Canada had a chance to get back into the game after 68 minutes when they were awarded a penalty after a lengthy VAR review ruled that Asllani had handled the ball.

However, veteran Sweden keeper Hedvig Lindahl dived to her right to tip Janine Beckie’s spot kick away.

“If they doubted I could make any penalty saves, that proved them wrong,” Lindahl told reporters. “I had to stretch fully and it worked. It was pure joy. We got a lot more energy because of that.”

The save appeared to suck the spirit out of the Canadians who struggled to create much beyond a few half chances and Asllani almost scored for Sweden five minutes from time as she volleyed in from a corner, but her shot was cleared off the line.

It was the first time Canada had failed to score in a World Cup knockout match and coach Kenneth Heiner-Moller said his young squad would learn from the experience.

“We have a lot of players with a bright future.

They didn’t get their chance, but it’s given them a thicker skin.

Sweden will now face two-time champions Germany on Saturday in Rennes in a repeat of the 2003 final. The Swedes have not beaten the Germans since 1995.

LAUSANNE, Switzerland (Reuters) - Milan and Cortina d’Ampezzo are promising an Italian Olympics packed with style and elan after winning the right to stage the 2026 Winter Games yesterday.

Milan earned 47 votes from the International Olympic Committee membership, compared to Stockholm’s 34, prompting loud celebrations from the bid team, that had earlier included Prime Minister Giuseppe Conte.

“Italy, the future and sport have won,” Italy’s Deputy Prime Minister Matteo Salvini said back in Italy.

“Thanks to those who believed in it right away, especially in the Municipalities and Regions, and a pity for those who gave

up.”

“There will be at least five billion (euros) in added value, 20,000 jobs, as well as many new roads and sports facilities. With the Winter Olympics we will confirm our excellence and our skills to the world.”

Milan and Stockholm were the only candidates left after four other cities — Swiss city Sion, Japan’s Sapporo, Austria’s Graz and 1988 hosts Calgary in Canada — had dropped out of the race with concerns over the size and cost of the event.

Italy last hosted the winter Olympics in 2006 in Turin while Cortina hosted the winter Games back in 1956.

Thompson, who won the 100m in another w o r l d leading 10.73 on Friday night, once again confirmed her superiority over Shelly-Ann FraserPryce who was second in a s e a s o n ’s best in 22.22.

Schillonie Calvert-Powell grabbed third spot in 22.92 and booked her spot to the World Championships.

Fraser-Pryce, drawn in lane four, started quickly and went past Thompson in lane five, but the reigning 200m Olympic champion turned on the afterburners in the straight and went away for a most impressive win and looked to be back to her brilliant best.

Meanwhile, Dwyer, the 2014 Commonwealth Games 200m champion, who was

third in the 100m on Friday, exact some level of revenge and won the 200m in 20.23 as he and Yohan Blake charged to the line. Blake was second in 20.27 with Andre Ewers of Florida State University third in 20.48 running from lane eight.

Julian Forte was fourth in 20.63 with Akeem Bloomfield, who has a personal best of 19.81, left back in fifth with 20.81 running from lane one.

World Championships bronze medallist Shericka Jackson ran a lifetime best of 49.78 and captured the women’s 400m, which makes her the second best in the world behind Shaunae MillerUibo’s 49.05.

Jackson, who started slowly as usual, initiated her winning run at the 250m mark and swept by Stephenie McPherson and won going away for a most emphatic victory.

Anastasia LeRoy fought on for second from lane three in 50.94 with the fading McPherson back in third in 51.01. Ronesha McGregor finished fourth in 51.36.

Christine Day was fifth 51.60 and Tiffany James sixth in 51.73, which means that Jamaica’s top-six runners all

dipped below the qualifying mark of 51.80.

Having finished second last year to schoolboy prodigy Christopher Taylor, Demish Gaye of Sprintec got it right and captured his first national 400m title in 44.83 as he moved impressively away from the field.

Terry Thomas of Racers Track club closed fast and snatched second in 45.47.

Cameroon face inquiry and possible action after England defeat (Reuters) - Cameroon face an inquiry and possible disciplinary action from soccer authorities after a 3-0 loss to England in the last 16 of the women’s World Cup on Sunday when they reacted furiously to two VAR decisions, initially refusing to restart the game.

After England’s second

goal was ruled offside then allowed after a VAR review, several Cameroon players remonstrated with the referee and for a long time refused to restart the match.

Batsman Sunil Ambris will take the place of Russell, who has failed to replicate his stunning Indian Premier League (IPL) form during the World Cup in England and Wales.

“The International Cricket Council has confirmed that the Event Technical Committee of the ICC Men’s Cricket World Cup 2019 has approved Sunil Ambris as a replacement player for Andre Russell in the West Indies squad for the remainder of the tournament,” the ICC said in a statement.

After just one victory in their opening six games, the West Indies need to win all of their remaining three group matches against India, Sri Lanka and Afghanistan to have any chance of progressing to the semi-finals.

Rapinoe on the spot to take Players buoyant ahead of final Group D CGC match against T&T U.S. into quarter-finals - First training session in Kansas an extended one REIMS, France (Reuters) - The United States needed two Megan Rapinoe penalties, one of them controversially confirmed after a lengthy VAR review, to beat Spain 2-1 yesterday and set up a quarter-final clash with hosts France at the women’s World Cup. The winning spot kick was subject to much debate but Rapinoe converted it with 15 minutes left after her opening penalty had been cancelled out by Jennifer Hermoso early in the first half.

After breezing through the group phase, including a record 13-0 win over Thailand, holders the U.S. lacked inspiration and conceded their first goal of the tournament as Spain rose to the occasion in searing heat at the Stade AugusteDelaune.

France, who the U.S. will meet in Paris on Friday for a place in the semi-finals, scraped through the last 16 with a 2-1 win against Brazil after extra time on Sunday.

“You can talk tactics but heart, grit and resolve - that’s a big part of World Cup soccer. No game is ever easy in this tournament,” said U.S. coach Jill Ellis.

“We know that, we’ve learned that. So part of it is the mental piece and I thought they were great tonight.”

Rapinoe added: “That’s World Cup level grit right there. You can’t replicate it, there’s no way to express it or teach it.

“The game’s only getting harder and more intense from here. Everybody is playing for their lives. That’s the best part about it honestly. I love it. This is the best stage.”

Kansas, USA: Guyana’s Golden Jaguars held an extended training session yesterday afternoon at the Children’s Mercy Training Center.

The team, following their 2-4 loss to Panama on Saturday in Cleveland, Ohio, arrived in Kansas City on Sunday afternoon and will oppose fellow Caribbean side and rivals, Trinidad and Tobago in their final Group D match tomorrow afternoon from 17:30hrs (18:30 Guyana time) at the Children’s Mercy Park, Kansas City.

Head Coach Michael Johnson commenting on the training session said it was an extended one given the fact that they had travelled from Cleveland on Sunday following Saturday’s match: “After our last travel we had to try and taper the training down because a lot of the players were recovering. This time, players are in a lot better place with no reports of any stiffness, a lot of the lads had a really good night’s sleep which allowed us to do more. They’re in a buoyant mood and we are

looking to do well in our final game.”

Johnson disclosed that the Golden Jaguars would have to have an improved game with regard to passing the ball which he was not pleased with in the Panama match: “Not only that, we have to be able to stop the silly mundane mistakes we keep making.

When you look at the last game and the second goal, you look at the penalty whether it was a penalty or not, the two goals that could have been stamped out and then you’ve got a result, and then you take that result into your final game. So if we can cut out a lot of the silly mistakes then I believe that we can get good results.”

The next session, which would be the final one before the match tomorrow, Johnson said would be used to iron out some of

the past mistakes and simplify their game so that they are ready for Trinidad and Tobago.

Barring some of mistakes made by his charges in this their debut at the level, Johnson said that they have done well so far and will be positive in their approach come tomorrow: “There are a lot of lessons to be learnt from this tournament but what is great is that the players have actually had a taste of the big stage and they want more now. So we need to now make sure that this is not just a one-off but that we’re here on a regular basis and obviously, all roads lead to the World Cup.” For this match, Johnson said that the team would see changes: “Definitely, one and two faces will now come in and try get us that victory against Trinidad, it’s a fixture that we want to win and I have got full belief in all twentythree players as I have said before. I want to give a chance to those who didn’t feature to now come out there and prove me wrong that they should have played in the first two.”

Fisherman Masters claim Enterprise Busta SC softball title Fisherman Masters concluded their preparation for the upcoming New York Softball Cricket League with victory in the Enterprise Busta Sports Club 20-over softball competition which was contested on Sunday.

Fisherman Masters defeated Success Masters by 10 runs in the final of the three-team tournament.

Batting first, Fisherman

Masters managed 121 all out in 15 overs with John Sumair scoring 39. Success Masters were bowled out for 111 in 13 overs, in reply. Greg De Franca and man-of-the-match Danny Thomas picked up three wickets each.

Earlier, Fisherman Masters beat Success Masters by three wickets.

A number of hygienic kits and other personal items were recently donated to Linden’s lone senior folks recreational facility by local biker group, Assasin Riders Motorcycle Club.

Linden’s Dorfolk Home for the Elderly had subventions to the facility cut several years ago and is run on donations. Due to

insufficient funds the home is in a dilapidated state, unable to house any of the over 40 persons who use the facility and is only able to host recreational activities once a week.

President of the bikers club, Curtis ‘Casual’ Jackson and Vice President, Paul McAdam, say they are interested in assisting the home further.

The tournament follows the unique concept of teams being awarded goal handicaps prior to commencement and therefore allows junior sides to compete against the more mature and experienced sides.

GCC Vintage return as the defending men’s champions with a five goal handicap (5) and will face top ranked side PEPSI Hikers (0), SHC Slick Sticks(8), YMCA OFHC Pacesetters (11) and YMCA OFHC Champs (12) in Group A of the men’s competition. Group B comprises of last tournament’s finalists, Bounty GCC (3), YMCA OFHC Top Form (5), SHC Splinters (9) and the Hikers Generals (9).

unday night was an auspicious one for the talented 22-year-old former Junior Champion Gavin Lewis, when at the Guyana Bank for Trade & Industry (GBTI) Lawn Tennis Court in Bel Air, he beat 24-yearold Frenchman Gregoire Vincent in the tenth GBTI Open Men’s Singles Final.

Under lights, in strong breeze and with a fair size gathering which included

former Caribbean Squash Queen Nicolette Fernandes, urging the pair on, Lewis won the first set, lost the second and won the third to spark celebrations for the clear crowd favourite.

The highly talented Lewis, who lived for a while in the USA while on Scholarship to study and play Tennis, had caused the upset of the tournament when he dethroned seven times defending Champion Anthony Downes during his march to Sunday’s Final.

The Multitalented 18year-old Afruka Gentle, who also is member of the National Women’s Cricket Squad, had beaten Number one seed Cristy Campbell in the Women’s Singles Final after teaming up with her to take the Women’s doubles title.

The big hitting Gentle completed an outstanding tournament when pair off with Lewis to take the Mixed Double title.

In the much anticipated Men’s Final, Vincent won

the Racket spin and chose to serve and Lewis broke in the first game to up 3-0 before it was 3-1 when Vincent held serve.

Lewis went up 4-1 in the first and Vincent fought his way back and pushed it to 34 before Lewis closed out in the next two games.

In the second set Vincent came out aggressively; throwing down some very hard severs which he forced Lewis to hit out on the returns.

Vincent executed some

excellent inside-out forehands and down the line backhands which seemed to confuse Lewis who looked a bit laboured after a hard tournament as Vincent, in about 22 minutes, rushed through to a 6-1 second set.

In the third set Vincent came out with the same momentum and broke Lewis in the first game and held serve and broke Lewis again to go up 3-0.

On the switch over, with Lewis fans offering plenty of encouragement at the side of

the Court, Lewis broke him back, held serve and got the other break to go up to 5-3 before Vincent again held serve.

The raucous support for Lewis seemed to have on effect on Vincent, who seemed nervous and made some unforced errors as Lewis romped to a 6-4 win in the last set.

Meanwhile, the Presentation Ceremony will be held at the GBTI Club in Bel Air tomorrow afternoon.

Fisherman Masters depart for NYSCL Independence Cup

T

he fast improving Fisherman Masters were scheduled to depart Guyana this morning for the United States of America where they will take part in the New York Softball Cricket League Independence cup.

The team, which is based on the East Coast of Demerara, will join Regal Masters of Georgetown as the two teams from Guyana in the tournament which is set to commence Friday and conclude on Sunday with matches being played at Canarsie and Roy Wilkins Park.

Fisherman Masters’ Marketing Manager Zameer Hassan and the team’s owner Pooran Singh expressed gratitude to all those who have assisted in making their trip a reality.

Speaking with Kaieteur Sport, Hassan said that despite this being their debut trip overseas, they are confident of doing well and will not take any team for granted.
