In an analysis published on Wednesday, Sanzillo underscored that among several controversies involving ExxonMobil Esso Exploration and Product Limited (EEPGL),HessandChinaNational Offshore Oil Corporation's (CNOOC) offshore oil drilling project and the oil spill cleanup insurance litigation in Guyana has takencenterstage.

Sanzillo explained that the High Court here excoriated ExxonMobil and the Guyana

Environmental Protection Agency (EPA) for its lax enforcement of permit provisions that protected Guyana in the event of an oil spill, making it clear that the company would be responsible for the costs ofacleanup.

“The oil giant's environmental permit issued by Guyana required two forms of financial assurance industry standard environmental liability insurance for a stated amount, and a separate p a r e n t c o m p a n y guarantee/indemnity from ExxonMobil to cover everything not paid by its local affiliate and to indemnify the government of Guyana and the regulator for all costs in the event of a spill,” Sanzilloadded.

Sanzillo added that Guyana's agreements with ExxonMobil are contractsandasmanyhavepointed out, the profit-sharing agreement gave away many rights to ExxonMobil.“Akeyelementofthe contract is to clearly define what happens in the event of an oil spill, but the government of Guyana has apparently chosen to ignore this responsibility The industry, and ExxonMobil in particular, has addressed the issue of liability in other settings many times in the past The lawsuit and appeal demonstrate that the terms of the contract related to oil spill cleanup of Guyana and its neighbors is shrouded in in secrecy and confusion,” the Financial Analyst said.

ExxonMobil has two accounting books for Guyana reflecting different profits for 2022

...One says $578Binprofitsandtheother$106B; Exxon says Guyana should focus on the $106B

The 2022 financial statements for ExxonMobil's affiliate, Esso Exploration and Production Guyana Limited (EEPGL) show that it made a jaw-dropping profit totalling $577B However, officials at the company are saying that this figure is not reflective of the true picture of expenses, investments, and profits made.

In order to get a holistic picture, one has to apply the accounting rules governing the Stabroek Block Production Sharing Agreement (PSA) which wouldshowEEPGL'sprofits for 2022 being roughly US$500M or approximately GY$106B(dependingonthe currency conversion rate used).

E x p l a i n i n g t h e foregoing, and in great detail, was EEPGL's Vice President and Business Service Manager, Phillip Rietema. He stressed that there are two separate accounting standards, one governing the preparation of financial statements and the other for the Stabroek Block PSA.

The two are so distinct thathecalledthem“applesto oranges.”

During a briefing with media operatives yesterday, the official said, “There are really two different accounting standards. For

our accounting books, we follow the International Financial Reporting Standards(IFRS).

It specifies how we are to show our operations.” With IFRS rules, he said the financial statements reflect 100 percent of the revenues achieved in 2022 and 100 percent of expenses incurred hence one might see royalty payments,anon-recoverable expense, reflected in those statements.

Under the Stabroek B l o c k P e t r o l e u m Agreement, he said the accounting standards are different.

The Vice President explained that 75 percent of the revenues made go towards cost oil, a term that refers to the pool of expenses/investments made by the oil companies which they are entitled to recover overtime.

The remaining 25 percent of the revenues is consideredprofitoilwhichis split between the State and theoilcompanies50/50.

Out of its share of profit oil, the companies pay Guyanese authorities a two percentroyalty.

The Vice President said the government therefore gets a 14.5 percent take while the co-venture partners, which include Exxon, Hess and CNOOC, get 10.5 percent. When this formula is applied, the Vice President said EEPGL's profitisroughlyUS$500M.

It was agreed during the press briefing that the US$500M figure, as well as the application of the accounting standards of the Stabroek Block contract, are what provide a more accurate picture of how much EEPGL is getting versus that of the country's

Tuschen resident dies in Greenwich Park accident

Joseph Shako of Tuschen North, East Bank Essequibo (EBE) was on Tuesday killedafterhewasstruckoffhisbicycleby a speeding car along the Greenwich Park PublicRoad,EBE.

According to reports the accident occurredaround20:40hrsonTuesdayand involved motorcar PAC 3849, which is owned and driven by 20-year-old Vashan Dhaniram of Tuschen Housing Scheme, EBE. It was reported to the police that the motorcar was travelling east along the northern side of the road, reportedly at a fastrateofspeedwhenitisallegedthatthe pedal cyclist suddenly rode out from the northernsideoftheroadwayinanattempt tocrosstheroadandendedupintothepath ofthemotorcar

causing Shako to fall onto the front windscreen ofthecarandthenintoanearbytrenchwherehe becamemotionless.

The police reported that as a result of the impact, Shako's right foot was broken off from the ankle and he received a wound to his head. He was picked up by residents in the area in an unconscious state and placed into a motorcar which took him to the Leonora Cottage Hospital.

There he was examined by a doctor who pronounced him dead on arrival. His body was then taken to the Ezekiel Mortuary for storage awaiting,apostmortemexamination.

The police further revealed that a breathalyzer test was done on Dhaniram and he was found to be above the prescribed limit with .049% micrograms of alcohol. He is in custody at Leonora Police Station, as an investigation is ongoing.

The EEPG official explained that the partners are making accelerated investments into the block whichhasresultedinanasset baseofover$2.3Trillion.

CallingPresidentAli.CallingPresidentDr.Mohammed IrfaanAli.WhathashappenedtothePresidentofGuyana,the national head? What has been done to him that he finds sanctuaryinsilence,inhistellingprolongedabsence,when therearesomanystirringeventsgoingon? Thiscannotbe goodforGuyanese,notatthepresenttime,norforthefuture.

Whentheissueunderreviewisfinance,itisnotPresident Ali,norisitMinisterwithResponsibilityforFinanceinthe Office of the President, Guyana scholar, Dr Ashni Singh, himselfanotherdisappearingact.

When there are difficulties with the hallowed Fourth Estate, the independent portion of it, the President sees the betterchoiceastakingflight.Whenthesubjectathandisthe central, all-important, paramount management of the nation’s enormous oil wealth, President Ali is again either missing in action and neither seen nor heard. This does not augur well for Guyana, at what looks like his involuntary abdication of responsibility, his forced relinquishment of authority President Ali must resist being reduced to the equivalentofaceremonialheadofstate,aleaderwithachest offirst-classflyingmiles,andlittlemuscularpresence.

Freshfromthepolls,cametheresultsofthemuch-talked aboutLocalGovernmentElections(LGE),andPresidentAli ismysteriouslyoutofthepicture.ThePresidentstandsatthe head of the governance apparatus in Guyana and it is reasonable to assert that LGE results must have some meaning for him. In some respects, LGE is Guyana’s equivalentofamid-termassessment,asgleanedfromvoter reaction to the positives and negatives of his government’s tenure.

Though much can be rightly said about the traditional, mostly inflexible, race-based nature of voting patterns in Guyana,LGEresultsstillhavelinkagestothePresidentand are a measurement of his leadership. For President Ali therefore, to be so conspicuously absent, begs the question aboutwhoisreallyrunningthiscountry Worse,ifasthetalk goes, it is not he himself, to where does that consign him, condemn him to what role? At the very least, it cannot be whatisgood

We have much appreciation for the fact that Vice President, Bharrat Jagdeo, is also the General Secretary of the PPP It falls within his purview to be around LGE activities, and LGE results. But it has gotten to the point where the General Secretary has become the results. Most GuyaneseshouldrecallthatPresidentAlihimselfwasinthe thickofthingsduringtheLGEcampaigns,butattheclimax, when the curtain calls came, he was nowhere to be seen. In identical fashion, other PPPC Government Ministers did much legwork on the East Coast Demerara and elsewhere and they also have been sidelined in this time of selfproclaimed‘massive victory’and leaving the Opposition in thedust.

Attorney General, Anil Nandlall, was among the most conspicuous for his LGE energies.Yet, as has now become thecustomandpractice,justabouteverythingtiersuptoVice President and General Secretary Jagdeo.While this may be understood, and excusable, in the instance of ministers and otherpartymembers,thesamecannotbesaidwhenitisthe national leader, President Ali that is the one pushed to the margins of quiet and seemingly frail existence. From all appearances,thenation’sVicePresident,BharratJagdeo,is nowthe1stcitizenandleaderofGuyana,forallpurposesand intents, considering the range of the duties that he has arrogated onto himself, and the limitless nature of his very obviouspower

WethinkthatPresidentAlihashisplaceandtheprestige of his office, the highest in the land. Though there are significantdifferenceswithhowhehasgovernedsomeareas, we still believe that there are times and places, when the President must be present. LGE developments, especially resultsthathavepowerfulresonanceisonesuchsituations.

Many Guyanese have been concerned about the PPPC Government’s push for total control. When the sitting Presidenthastotakeabackseat,thenitisnotsomuchabout thegovernment’spushanymore,butofoneman’sobsession withpower.

POLLUTER PAYS PRINCIPLE; TRANSBOUNDARYRESPONSIBILITY

The President and VicePresident have repeatedly assertedthatthepetroleumin the deep offshore fields belongstoGuyana.

EEPGL, and its coventurers (Hess Corporation (USA) and CNOOC), have the right under the 2016 Production Sharing Agreement to explore for, extract, and sell the oil and gas, leaving a “small piece” of royalty and shared profit

for the owner Ownership carries responsibilities which cannot be disclaimed becauseofthePSA.

Suppose that you own a house with a garden. You have trees on or near the fence line, which overhang your neighbour’s property. You hire a contractor to p r u n e t h e t r e e s Accidentally, the contractor drops a tree branch onto the neighbour’s house and causes damage to the guest rooms which the neighbour rentsout.

The neighbour demands compensation for the damage to his house and for the loss of income from his rentedrooms.

Acting sensibly, you haveprotectedyourselfwith house insurance and you have required the pruning contractor also to carry insurance. Thedamagewas done but the insurance has coveredthecostofrepairand for the neighbour’s temporary loss of income. This is a parallel with the hazard to the beach-based tourism of the Caribbean Islands, demonstrated graphicallyinEEPGL’sown environmental impact assessments.

This homely example is paralleled internationally The first major case was about the poisonous fumes

from a privately-owned metal smelter in a community named ‘Trail’in British Columbia, Canada. The suphur dioxide fumes drifted south across the border into the State of Washington, USA. In 1935 the USA made a successful legal claim for damages to cropsandtrees.

In 1941, the arbitration Tribunal formulated the seminal Principle of customary international law, that‘NoStatehastherightto use or permit the use of its territoryinsuchamanneras tocauseinjury inortothe territoryofanother[State]or the properties of persons therein, when the case is of serious consequence …’ I can provide examples of international legal cases where this Principle [ t r a n s b o u n d a r y responsibility of the sovereign state; polluter pays] was cited in judgments.

Asecond majorexample is ‘Principle 21’ from the Declarationcomingfromthe United Nations Conference on the Human Environment at Stockholm in June 1972:

‘States have, in accordance with the Charter of the United Nations and the principles of international law, the sovereign right to exploit their own resources

pursuant to their own environmental policies, and the responsibility to ensure that activities within their jurisdictionorcontroldonot cause damage to the environment of other states orofareasbeyondthelimits ofnationaljurisdiction.’

So, in response to the blogger,itisnotrelevantthat theStateofGuyanadoesnot o w n d i r e c t l y t h e infrastructure for oil extraction installed in the Exclusive Economic Zone. Guyana has international responsibility Guyana can be sued by its Caribbean Island neighbours for damages cause by the activities of EEPGL. It is required in the EPA’s environmental (operating) permit that EEPGL and coventurers provide complete liability cover for those damages.

LGE results indicate the good and bad of competing political parties

Local Government Elections have always been the barometer or benchmark to measure the success of a politicalpartyattheGeneral Elections It is either a harbinger of good or bad news,oreitheratriumphora disaster to that party-a resounding verdict submitted by a large section of the population. Hence, LocalGovernmentElections are the large-scale opinion polls on political parties which will contest the GeneralElections.

In Guyana, the LGE has alwaysbeenagoodindicator howwellorbadlyapolitical party will do at the General Elections It is also an indicatorofhowmuchmore workneedstobedoneandin whichareas.

We have seen that in 2016,thePPP/Cwon48out of the 80 LAAs, in 2018 it won52andin2023itwon66

of the LAAs. It must be recalled that the massive increase in the gap between APNU/AFC from 24,000 votesto50,000votesin2018 despite gerrymandering efforts by the Coalition, and this formed the basis for the No Confidence Motion in December 2018. The LGE Result in 2018 signaled to thePPP/Cthattheirtenureas an Opposition Party was at anend.

OnDecember21st,2018, thesuccessfulpassingofthe NCMsawthecollapseofthe Coalition Government whichpavedthewayforthe 2020GeneralElectionsafter many legal dramas from the High Court, the Appeal Court in Guyana and eventually to the CCJ. The Coalition supporters witnessed a most dastardly attempt to rig the 2020 Elections and thereafter the many lies spun to them.The nasty past of the PNC was

brought live and direct to them and the seed of disappointment, distrust and disillusionwassownintheir minds.

This seed begun to germinate and in 2023, the PPP/C has increased its LAAsfrom52to66.

What does this indicate?

ThesupportforthePPP/Cis increasing massively whilst that for the APNU is dwindling drastically, as is evidenced even in the support of their traditional strongholds.

This is also testimony to thefactthatthePPPhasbeen successful in convincing

APNU members and supporters that the PPP/C is the only multiracial Party which is capable of transforming the lives of each and every Guyanese and that its ONE GUYANA initiative is the way forward in promoting racial and religious harmony across

Guyana regardless of one’s class, gender or political affiliation and so achieve social and economic prosperity for all. We have seen that the PPP/C’s Government and Leaders have reached out to every nook and cranny in this country distributing economic resources in a mostequitablemanner.

Guyanese have seen the true nature of the beast and have moved away and distanced themselves from thedestructiveagendaofthe PNC.

PPP/C put in the time, reap the rewards

I published an article a few days ago on how the PPP/CwillwintheLGEbya wide margin. Here is what I said on June 8 – “The HOW of the victory [will be] because the PPP/C is an exceptionally wellorganized political party, with an extraordinary groundgame.

Well, it turned out to be exactly that, a victory built around exceptional organization, and a brilliant ‘ground-game.’

At the PPP/C press conference on June 13, General Secretary Dr Bharrat Jagdeo expressed thanks to the party activists, the candidates, and their 26,000 ‘backers’. He also thanked street captains, and the thousands of volunteers whowerepartofthelogistics on E—Day, delivering food, transporting elderly voters, the cleaning-up crews, and thelike.

Typical of the PPP/C leadership, they hardly acknowledged their own tireless efforts, at times wading through mud and raintothefarcornersofthis vast land with such a prodigious terrain. President Ali,PrimeMinisterPhillips, andVicePresident(andPPP General Secretary) Bharrat Jagdeo formed an indomitable team and led their cabinet and party

officials in a dizzying country-wide campaign to securethevictorythatisnow evident.

Allow me to offer a few analytical points on LGE 2023. First, I agree with FreddieKissoonthatrace,as talked about by the likes of David Hinds, did not have theswaytheyhadhopedfor Younger Afro-Guyanese voters ignored the “blackpudding approach” to political consciousness and certainly, political behavior Even the late-breaking ‘Trench Crappo’and “CoolAid” rhetoric for ethnic mobilization by APNU did notwork.Instead,thePPP/C made step-level gains in Georgetown, Linden, New Amsterdam, Bartica, and alsoinRegion1.

Oneoftherealstoriesfor this 2023 LGE is the RATE of increase (not only the magnitude) in APNU to PPP/C turnover between 2016 and 2023. The pace of thecross-overisquickening, andthetime-seriesdatamust be of the greatest concern to the languishing APNU, and theAFC which is in now on assistedliving.

On Monday night I remarked on NCN that Professor Stuart Hall’s ‘politicswithoutguarantees’ is likely to take hold in Guyana. Hall,aJamaicanby birth who became a worldrenowned scholar on political sociology (among other things) had warned Afro-centered activists and politicians not to expect “Black”folkstohaveaoneway,one-trackmindwhenit comes to culture, ideology, andpolitics.

Hall advocated for a politics that is democratic and rational, not one that is ‘tribal’.

His key point was that political identities are not

fixed. In the United States, for example, hundreds of thousands of racial minorities are politically conservative Being a minority does not, should not,andhasnot‘guaranteed’ the politics and voting behavior of African Americans, Latinos, and Asians,amongothers.

More often than not, economic modernization facilitatesthetransitionfrom ‘traditionalism’ to ‘modernity’.

In the former, folk cultureisdominant,andhere one can expect great resistance to change. With modernity, people become moreopentoideasotherthan the ones they grew up in. Theytendtobecome‘utility maximizers,’ meaning that they make decisions based onrationalself-interest.

YoungerGuyaneseofall ethnic backgrounds are quickly moving away from embedded traditionalism, towardsformsofmodernity While the former is ‘backward-looking,’ the latter is based on what lies ahead, the future, grounded i n q u e s t i o n s a n d considerations such as upwardsocialmobility

Guyanaisgoingthrough rapid economic, cultural, and social transformation. It is no accident that President Ali’sfavoriteword(actually it is a concept) is ‘transformational’ The PPP/Cwonasbigasitdidin this LGE because its leadership understood well the shifts that have been takingplaceintheGuyanese economy and corresponding shifts in the minds of the electorate.

Throughout the LGE campaign, the PPP/C leadership constantly remindedtheircandidatesto “stay on message.” Well,

whatwasthemessage?

Inanutshell,themessage was that voters should make the most of the new opportunities that are now availableinthecountry The PPP/Cimploredvoterstoput aside past ways of thinking about things and to embrace a new vision based on looking after their own affairs,aswellasthatoftheir families, and their communities It was not aboutstickingtoyour‘own.’

The APNU, by contrast, stuck to its old political technology, sharing out the same cool aid, as Jagdeo labeledit.

The APNU formula and their message was - vote for the same folks your parents votedfor,evenifthosefolks had destroyed the economy and ruled through the rigging. They wanted the people in Georgetown, Linden, Bartica, New Amsterdam, and beyond, to stand still, fixed forever where they have always been,lookingbackatthebad old days and, somehow, miraculously feeling good about that dastardly past. Thousands walked in the other direction, towards change, towards the future, towardsprogress.

CGX's Wei-1 well in Corentyne Block to cost US$195M

Canadian oil explorer, CGX Energy Inc , announced this week that it encountered an aggregate of approximately 71 feet of net oil pay after drilling theWei-1 bypass wellintheCorentyneblock.

In a statement the company said the original or initial Wei-1 wellbore reached a depth of 19,142'. However, bypass explorationandappraisalwellwas drilled from 18,757' to total depth and penetrated the primary Santoniantargets of thewellin the western complex in the northern portionoftheCorentyneblock.

In Guyana today, development is imbalanced because of the excessive focus on infrastructural development and the crass inequalities that are being created because of lopsided development policies.One man-leadership creates a crisis of succession and is now obvious within the PPPC. Whenpersonswield power from behind the

scenes when one man can dictate the outcome of a party’s deliberations on its presidential candidate and whenthatonemancanexert a controlling and domineering influence behindthescenes,thenthere isaseriousthreattopolitical successionandstability

Guyana is showing the signs and symptoms of oneman rule. It is now fast approaching three years since the PPPC assumed office and onto now major diplomatic appointments havenotbeenmade.Almost three weeks ago, we were told that there would be a Commission of Inquiry into thefireatMadhia.Nofurther announcement has been made. Is there a decisionmaking gridlock within the government?Whataboutthe outstanding constitutional

appointments? Why is more progress being made in this front?

UNCONCERNED EXXON SHAREHOLDERS

The Exxon lobbying machine sprang into action, andtherestishistory Greed takesover,thingsfallinline.

D e e p - p o c k e t e d , heavyweight stakeholders and shareholders in Exxon did their own fact-checking and liked the results. No need to worry, Guyana is golden, there is no threat.

Not from those people over there.

Even if there is an oil spill of considerable volume, what is Guyana going to do? Who is it capable of conquering?

CertainlynotExxon,andits combined strengths in politics, legal legions, oil

smarts, and financial firepower?

I t i s w h y t h e shareholdersofExxonvoted so overwhelmingly against two proposals that sought insights into oil spill risks and related litigation; even an actuarial assessment proposalwasshotdown.

Guyanesemaybeasking themselveswhythislevelof unconcern? Iofferaninside viewfromactualexperience as to how these things unfold, conclude. Absorb this scenario that I share (again).

There is a product and activitythatisrisky,causing concern. The questions are

fastandfurious. ‘Howisthe risk rated? What is the probability of regulatory discovery? If discovered, whatisthedamage/penalty? What about other fallouts? How much is this product estimatedtomake?

The last question is crucial because it incorporates the most relevant,mostsensitive,and most vital interest? It is of risks versus rewards. A US$25-50M fine will always be trumped by US$100M in projected revenues, especially when risktakers and revenue enhancershavethefinalsay; the name of the game is

makingmoney InGuyana’s instance,theriskofaspillis real, particularly with increased production, and a tight cluster of wells in a smalloperatingspace.

The risk is neither remote nor imminent, but it is practical to slow down with a bow to the conservative, and Guyana havingthekindofprotection that insulates its citizens from carrying any burdens due to Exxon’s “gross negligence” and possible recklessness.

The investors in Exxon, who are mostly fiercely vigilant about, and protective of, the monies entrusted to them, would have also factor into their risk analysis, what I call the Guyanacondition.

There is a PPP Government that is so proE x x o n a s t o b e indistinguishable from the company itself, its senior officers, its top lobbyists, anditsleadingcheerleaders.

Though there are some pockets of local concern about an oil spill, the environment is favorable to Exxon because the kind of compulsory insurance that shouldbeobtainedisfought againstbyamajorityblocin Guyana’sparliament.

T h e n a t i o n a l governmentitselfhasjoined arms with Exxon to fight against the country and its own citizens and prevent them getting the proper coverage (company guarantee). Allthisishighly favorable to Exxon and its n o w u n c o n c e r n e d shareholders. But there is another reason, one of even

moreconsiderable weight, which

shareholders of Exxontobecausalwith theirconcerns. Ithastodo withthelaw

Guyana is heavily handicapped in mounting the kind of legal challenge, orembarkingonaprolonged war footing, in the various court systems that a case could reach in the event of an actual oil spill of cataclysmicproportions. In

more nuts-and-bolts language, Guyana does not havewhatittakestoemerge victorious in a vicious court fightofjunkyarddogflavor Whateverlegalskillsmaybe recruited, Exxon could outlast and outfight such, evenifithastocalluponits deep stable of far-flung relationships and lean on golfcoursepartnerstosway mattersitsway

Why endorse any payment to a set of backwardpeopleofacertain stripe? Whatwouldtheydo with all that money? Who cares about them, once the cash registers ring constantly? I take the liberty of reminding my fellow Guyanese (again) of Union Carbide and Bhopal, India Some lives are cheaper than some, and because some standards of living are lower than that of others, then pittances for compensation close out all arguments, condemnations, and fallouts. This is why thatUS$2billionmaximum is bandied about, as being a mostattractiveproposition.

Further, it is now common knowledge that

there is little leadership and political will to confront Exxonandforceitshandon this coverage guarantee issue Guyana’s Vice President Jagdeo has asserted that he would take Exxon to court should circumstances necessitate Good luck with a 20-year battleinthatrealm.

Ag o v e r n i n g principle of the United Nations (UN), of which Guyana became a member in September 1966 states that while countries have a sovereign right to develop their resources, they have a responsibility to ensure that these activities, within their jurisdiction, do not cause damage to the environment ofotherstates.

This point has been restated by prominent environmental activist, Dr Janette Bulkhan in a letter to this publication Bulkan holds a doctorate from Yale University School of Forestry and Environmental Studies. She is also member of the Oil and Gas

Governance Network (OGGN) and has been advocating for good managementofthecountry's newfoundoilresources.

In her missive, Bulkhan said she observed an opinion piece published by Stabroek News in which the author attempted to persuade the public that the government will not be held liable for an oil spill disaster, since it is not the owner of the assets operatingoffshore.

The blogger wrote, “Ms. Bulkanisfullyawarethatthe Gov't. of Guyana does not own, operate or is in custody

of any offshore oil well in our EEZ. Also, the GoG, neither owns, operate, control or is in custody of any oil field vessel or oil tanker

Therefore, Guyana will not be liable to any third party in the event of a well blow-out or any spill from tankers and vessels. Guyana bearsabsolutelynovicarious liability exposure, here. I am not sure what this highly educated lady is speaking about.”

T h a t w r i t e r w a s responding to Dr Bulkhan's letter, published on June 13, 2023, in which she warned that Guyana could foot costs close to US$29 billion to compensate 10 Caribbean states for losses accrued as a result of oiled beaches and therefore a severe hit to their tourism industry She was keen to note that further costs may be required for damages to the fisheries' sectors of these affected islandsaswell.

In a bid to shed light on G u y a n a ' s t r u e responsibilities, the activist quoted 'Principle 21' from Declaration of the United Nations Conference on the Human Environment at Stockholm in June 1972. It notes, “States have, in accordance with the Charter oftheUnitedNationsandthe

principles of international law, the sovereign right to exploit their own resources pursuant to their own environmental policies, and the responsibility to ensure that activities within their jurisdiction or control do not cause damage to the environment of other states or of areas beyond the limits ofnationaljurisdiction.”

Dr Bulkhan therefore made the point that it is Guyana who is mandated to ensure its activities do not c a u s e h a r m t o t h e environment of others, rather than an operator. She explained, “It is not relevant thattheStateofGuyanadoes not own directly the infrastructure for oil extraction installed in the Exclusive Economic Zone. Guyana has international responsibility.”

Tothisend,sheindicated that Guyana can be sued by its Caribbean neighbours for damages caused by the a c t i v i t i e s o f E s s o Exploration and Production Guyana Limited (EEPGL)the operator of the Stabroek Block. For this reason, she has been lobbying for the company to provide a parent company guarantee that compensates for any damages caused by an oil spill.

In further making her

point, Bulkhan pointed out that internationally, countrieswereheldliablefor environmental damage caused to other states. She explained, “The first major case was about the poisonous fumes from a privately-owned metal smelter in a community named 'Trail' in British Columbia, Canada. The sulphur dioxide fumes drifted south across the border into the State of Washington, USA. In 1935 the USA made a successful legal claim for damages to crops and trees. In 1941, the arbitration Tribunal formulated the seminal Principle of customary international law, that 'No State has the right to use or permit the use of its territory in such a manner as to cause injury inortotheterritory of another [State] or the properties of persons therein, when the case is of seriousconsequence…”.

The activist is adamant that ExxonMobil must provide unlimited liability coverageforitsoperationsin Guyana.

Unlimited parent companyguarantee

ExxonMobil Guyana, the Government of Guyana ( G o G ) a n d t h e Environmental Protection Agency (EPA) has appealed a ruling by the High Court for the oil company to provide an unlimited parent company guarantee to cover the costs associated with an oilspill.

The ruling came months after President of the Transparency Institute of Guyana Inc (TIGI), Frederick Collins and another citizen, Godfrey Whyte,tooktheEPAtocourt to enforce a critical clause in

the Liza Phase One renewed permit,issuedtoEEPGL.

The citizens had filed the matter and won the case through their Lawyers, SeenathJairam,SC,Melinda Janki, and Abiola WongInniss.

Mr. Collins, a former insurance professional said, “an oil spill would be devastating for our country and Region as many Guyanese and Caribbean peoples depend on the ocean for their livelihoods. That is why we have decided that the time has come to take matters to the court for relief.” The litigants said thattheirresorttothecourtis to make sure that the company takes full financial responsibility in case of harm,lossanddamagetothe environment.

High Court Judge, Justice Sandil Kissoon, had ordered the company to provide the parent guarantee by June 10, 2023 however the Appeal Court granted a stay of the order and has in the meantime directed Exxon to supply the EPA with the US$2 billion parent guarantee. The matter is still ongoingintheAppealCourt.

Exxon uses subsidiary to stand US$2B oil spill guarantee for Stabroek Block

ExxonMobil Corporation's affiliate, Esso Exploration and Production Guyana Limited (EEPGL) lodged a US$2B affiliate company guarantee for oil spills in the Stabroek Block This was confirmed by EEPGL's Vice President and Business Service Manager,PhillipRietema.

During a press briefing yesterday at the company's Kingstownoffice,Rietemasaidthe guarantee was lodged last Friday with the Environmental Protection Agency (EPA). This was done in keeping with an order from Appellate Court Judge, Justice RishiPersaud.

President Dr Irfaan Ali said that the CARICOM Region has the competitive advantagetopositionitsfood market as high-value and specialised.

The President said that with a consensus across the regionontheneedtoenhance foodsecurity,effortscouldbe made to overhaul the system and revolutionise food production. He told investors at the Caribbean Agri-Food Investors Conference that countries need to create a structure, where agriculture production is one component of a “highly integrated food productionsystem”.

The region, he noted, needs to think big and envision an ecosystem of development, which will amplify the production of traditionalcrops,enhancethe growth of non-traditional crops and facilitate their rapid movement while lowering their overall production cost. He listed the proximity of the region to

the North American market and highlighted the potential of the production of fish and shrimp (via aquaculture), honey, spices, cocoa, coffee, barley, corn, and soya, among local fruits and vegetables and nontraditionalcrops.

“How do we use these opportunities to create value, expand the market and produce high-value crops?

Businessman found dead in apartment was beaten to death - autopsy finds

An autopsy conducted on the body of young city businessman, Nakema Dimitri Deonauth, revealed that he was beaten to death.

According to the autopsy results, Deonauth died from brain hemorrhage (bleeding in the brain) due to blunt force trauma to the head. The fatal hit to the head was further compounded by compression injuries to the neck meaning that his killer might have choked or attempted to strangle him.

Police told Kaieteur News that the doctor who performed the autopsy opined that his “fatal injuries were caused by either cuffs or a hit with a hard object”. Deonauth was found dead on Monday in his Regent and Cummings Street, Georgetown apartment.

Kaieteur News understands that Deonauth was found dead by his father who visited his apartment with the intent of taking him to breakfast, a frequent practice. Re-

ports are that Deonauth was unreachable and his father, Rajindra Deonauth solicited the spare keys to the apartment from the landlord. Upon entry to the apartment he found his son’s lifeless body in the apartment and he summoned the police.Upon seeing the young businessman’s dead body,

the elder Deonauth behaved disorderly causing police to detain him. The 39-year-old was his father’s only son. Deonauth’s body reportedly bore multiple marks of violence. He was last seen alive on Sunday evening after closing up one of the family’s businesses. Investigations are ongoing.

Taking place ahead of the UN General Assembly Highlevel meeting on Universal Health Coverage in September 2023, the conference will also feed into preparatory processes leading to the fourth High-level meeting on NCDs in 2025 and to future global summits on mental health.

Police are to seek legal advice today on the way forward regarding their investigation into the killing of a soldier by his colleague at the Guyana Defence

(Reuters) - Senegal’s Fatma Samoura will step down from her role as FIFA Secretary General at the end of the year, world soccer’s governing body said yesterday

Samoura, who was a United Nations veteran, became the first woman to be named FIFA secretary general and was tasked with its day-to-day running as the body looked to fix its reputation after being embroiled in corruption scandals.

Her predecessor Jerome Valcke was fired in 2016 and banned for ethics violations

“I had intended to share my news first withtheFIFACouncilmembersnextweek,

“For now, I am fully focused on the preparationanddeliveryoftheupcoming Women’sWorldCupinAustraliaandNew Zealand.”

Samoura, who began her U N career with the World Food Programme in 1995 and served as country representative or director in six African countries, was heavily involved in improving women’s football.
