Arbitration renders audit of ExxonMobil expenses meaningless - former Auditor General
The 2016 Production Sharing Agreement (PSA) Guyana signed with United States oil major, ExxonMobil and its partners grant the country a two-year period, followingtheendofanyfiscalyear, toconductareviewoftheexpenses incurred by the operator of the Stabroek Block, Esso Exploration and Production Guyana Limited (EEPGL).
That arrangement also allows for a majority of the revenue earned- 75 percent- to be deducted towards cost recovery, or repaying the oil companies for its investments to extract the resources. The remaining revenue is then shared equally as profits between the state and the Stabroek Blockpartners.
Giventhatthelion'sshareofthe resources are directed to the recoveryofcosts,Guyana'spriority should therefore be to ensure that these bills were not inflated or that it did not pay for goods or services contrary to the provisions of the PSA.

Former Auditor General (AG), Anand Goolsarran in his weekly column published by Stabroek News on Monday concluded his review on the new Petroleum Activities Bill released by the Government of Guyana (GoG) on June 19, 2023. In his final analysis

of the draft document, Goolsarran highlighted that the proposed legislation does not feature provisionsrelatingtoproductionor profit sharing which he noted would be left to be negotiated between government and petroleum companies in future PSAs.
To this end, he noted: “we have seen how the 2016 PSA with ExxonMobil's subsidiaries was overwhelmingly weighted in favour of the U.S. oil giant. In particular, 75 percent of monthly production of crude oil goes towards the recovery of costs, leavingtheremaining25percentas profit oil to be shared equally between Exxon and the Government.”
After establishing the importance of the cost recovery sum, the former Auditor General went on to point out that the provisions of the PSA have been widelycriticizedastheabsenceofa ring-fencing clause leaves the door openforcoststobeoverstated.
He wrote, “Several aspects of the 2016 PSA have been severely criticized by many stakeholders. One such criticism relates to the possibility of recoverable costs being over stated due to several loopholes in the agreement, especially the absence of ringfencingprovisions.”
Goolsarran was keen to note in his column that while the oil contract provides for the auditing of such expenditure to ensure the accuracy of the amounts shown in thecoststatements,therehasbeena “laissez-faire attitude” towards enforcing this requirement and actingontheresults.
The former AG, who has over 30yearsofprofessionalexperience in public sector financial management locally and internationally, pointed out that when auditors were finally appointed to review the US$1.6

billion expenses incurred by ExxonMobil during the period 1999 to 2016, the authorities failed to get the company to adjust the amounts shown as recoverable in the Report compiled by the British auditingfirm,IHS-Markit.
That report indicated that some US$214M in costs could be contested by State authorities Shortly after, Vice President Bharrat Jagdeo indicated that government is prepared to challenge disputed costs claimed by ExxonMobil through the processofinternationalarbitration.
This is so as it refuses to renegotiate the terms of the lopsided agreement signed by the former Coalition government According to the contract, costs that have been flagged in an audit and deemed unacceptable can be recovered by the Contractor until the dispute is resolved. Goolsarran has therefore asserted, “This attitude renders the auditing provisions ineffective, if not meaningless.”
TheAGtoldhisreadersthatdue to the difficulties in verifying recoverable costs, a number of countries have moved away from the profit-sharing model, or are about to do so, to one of revenue sharing.

Through ExxonMobil’s mouthpieces, he made surethathiscompany’sascendantandunassailableposition was rammed home. It was more than a dismissive putdown by ExxonMobil, it was a finger twisted in the eye of all Guyana,particularlyitssacredjudiciary
“The grant of the reliefs sought is in any event discretionary The land acquisition process for the Project has been completed, and to require the quashing of the Permit, and its re-application, in circumstances in which it would almost automatically be reissued would be a waste of public time and resources.” In more basic language, what ExxonMobilsaidtherewasthis:regardlessofhowthecourts ofGuyanaadjudicatedonthematterathand,asitrelatedto theWalesgas-to-energyproject,itdidnotmatter,itwasofno consequence, possessed no meaning, had no standing, and was nothing but useless. For, whatever the decision of Guyana’s court, it was going to be undone, and unceremoniously kicked into the garbage can, as in quickly reversed. This is what our courts have been reduced to, a formality, this is what our oil wealth is to ExxonMobil, a pawnpushedaroundatitsconvenience.
It is where an American company, with the raucous arrogance of ExxonMobil, can talk about “waste of public time and resources” in disdainful condemnation of our processes, and get away with it. Because we have one national leader that is a conspicuous example of a collaborator, and pronounced impotency Because Guyanese have another national leader that is so entwined with ExxonMobil that there would be extreme difficulty detecting which anatomy is Guyanese, and which is American. Becausethereisathirdnationalleaderthatisthe equivalent of an eclipse during the height of the blazing midday sun. Meaning, not one soul can observe presence, haveanyconfidenceofexistence,orthatthereissubstance.
This is why an ExxonMobil can be so scornful, so disrespectful,sorecklessastospeakuncaringlyabout“waste of public time and resources” because Guyana’s EnvironmentalProtectionAgency(EPA)willdowhatisright forthecompany EvenifsuchisattheexpenseofGuyanese best interests, regardless whether such action furnishes additionalconfirmationoftheshackledandsorrystateofthe EPA. We have these foreign carpetbaggers rushing here to establishthemselvesandfeastontherichmilkofthepassive Guyana cow, and we have the shameless Guyanese scalawagswhoaidandabetthemeverystepoftheway,and comfortthem,too.
Things have degraded so far that a multinational corporation with the global stature of ExxonMobil could cometothiscountryandinsultourdaughtersandsisterswith theslurof“busybodies.” Thus,theDaughtersoftheGuyana Revolution are smeared and tarred for having no legal standing, no rights of ownership, and are merely nuisances. The Confederacy may be making a comeback inTexas, the home of ExxonMobil, but courageous and conscientious Guyanese must devote every thought, concentrate every fiber,atthwartingtheseoppressors,mockers,andexploiters. The vision of those fromAmerica is to turn back the clock two hundred years, and bring back the yoke of slavery on Guyanesefortheirwealth.Guyanesespeakoutandtheyare treated to the contempt of “obstructionists” by one of their ownbrothersoftheGuyanesesoil. AndwhenGuyanesewith the necessary abdominal fortitude appeal to the court for relief,theyarelaughedat,andmadefunof,withtheassertion thatsuchisa“wasteofpublictimeandresources.”Guyanese have a stark choice before them: rollover and pretend to go alonghappily(likesomesickdog)attheabusesandassaults that come from both domestic and foreign sources for their preciousproperty Ortheycangetup,standup,andshutup allthosewhotakethemforgranted.
IF THERE ISARENEGOTIATION WOULD THE GOVERNMENT WOULD STAND UP FOR GUYANAOR GIVE IN TO EXXON?

Mr Raphael Trotman will probably go down in history as the government minister who signed the agreement for the worst petroleumdealeverinflicted onasovereignstate.
Mr Jagdeo, (then Leader of the Opposition) correctly stated in Parliament on 21st December 2018, “Our incompetent Government trudged in there unprepared and stuck us with a contract that would harm us for decadesintothefuture.They soldourpatrimony…”
Mr Trotman has now published a book, ‘From Destiny to Prosperity’sycophantically named after Esso’s Floating Production Storage Offloading vessels, oneofwhichisthesubjectof a court case regarding unwantedgas.

Justice (ag) following the hearing in May 2022. Yes, 2022.)
According to Kaieteur NewsMrTrotmansaysinhis book, “My own view is that nocontractisinviolable,and therefore, it can be renegotiated.” Mr Trotman is entirely correct. As any law student knows, the parties to a contract can always agree to change it. There is no ‘sanctity of contract’ in Guyana’s law beyondtherequirementtodo in good faith what you have promised to do Mr Trotman should have read the Petroleum Agreement 2016(PA)beforehesignedit andbeforehewrotehisbook.
IfMr Trotmanhadreadit at any time then he would know thatArticle 32.1 says: “Exceptasmaybeexpressly provided herein, the Government shall not require renegotiation
of…this Agreement without the prior written consent of Contractor.”
The PA defines the
Contractor as Esso Exploration and Production GuyanaLtd.(incorporatedin Bahamas), Hess Guyana
E x p l o r a t i o n L t d (incorporated in Cayman Islands) , and CNOOC Petroleum Guyana Ltd (incorporated in Barbados).
These are offshore subsidiaries who exist to makemoneyfortheirparent companies. First question: How will the Government force these 3 companies to consent to renegotiate in order to give Guyana more money and take less money forthemselves?
Kaieteur News reports that Mr Trotman says in his book that, “Undoubtedly, if Guyana,asasovereignstate wishes to renegotiate the contracttoget‘better’terms,
thenIwouldsupportsuchan initiative.”
Leaving aside for now that ‘wishing’ is not an ‘initiative’,secondquestion: do people trust Mr Trotman with any aspect of renegotiation? The Government of Guyana has publicly opposed the court orderwhichrequiresEssoto provide(amongotherthings) an unlimited guarantee agreement from its parent ExxonMobil requiring ExxonMobil to indemnify the Government of Guyana against all environmental obligations of Esso and its Co-venturers.
Third question: IF there was a renegotiation, do people believe that the Government would stand up for Guyana or give in to Esso? The answer would seemobvious.

Even though penalties for murder are life imprisonment, charges of murder are too frequently r e d u c e d d o w n t o manslaughter charges by courtsinGuyana.
Many of these cases of murder reduced to manslaughter involves femicides and brutal physical attacks and torture ofwomenbymalepartners.
What part of rebuffing a person who makes sexual advances to a woman and who is then knifed to death, fits the description of an unlawful killing without an intention to kill or cause grievousbodilyharm.
It is clear that when Raymond O’Selmo was rejected by Nadira Kalamadeen he then most certainlyhadtheintentionto harmherandcausegrievous bodily harm. Is this the type of person who should be walkingaroundGuyanafree to commit further acts of violenceinjustafewyears.
There is nothing normal about such a reaction to rejection, was a psychiatric evaluationcarriedoutonthis

He should be put on the registerasaconvictedsexual offendersowomen,girlsand communities can be notified when this person is released and take all necessary precautions.
And what of Nadira Kalamadeen’s 5 children, their beloved mother was rippedawayfromthem.The children of all those women killed by their partners are theforgottenvictimsofthese murdersandkillings,istheir pain, suffering, grief, and loss of the most important person in their lives taken intoaccount.

Research has shown that the loss of a mother is the most devastating of experiences forchildrenassuchchildren are more prone to be abused including sexually abused and suffer emotionally, psychologically, physically andsociallyinGuyana.
The longest and most detailed study of pediatric grief following parental loss by the University of Pittsburgh, found that the death of a parent is an incrediblystressfuleventfor achildandonethatcanhave profound consequences for the child’s future well -
being.
Itwasfoundthatchildren who lost a parent had the highest levels of depression and higher rates of posttraumatic stress disorder (PTSD). The justice system must do better in sentencing on sexual and gender-based violence cases. It should not be left solely up to the discretion of a judge or magistrate to determine penalties, there must be a system which is consistent and in keeping with the crime.
The lives and well-being of children must be taken into account in sentencing for crimes of femicides and grievousbodilyharm.Letus notforgetthatmanychildren witness the horrific violence and what terror must this unleash on the sanity and well-being of any child of

Unfair characterization of PPPand Jagdeo

Political commentary in a newspaper with a national reach should have a strong evidentiary basis in support of sweeping claims. While onecanappreciatethatinthe world of politics anything is fair,thelimitsofthepossible are quite stretched when there are unsupported accusationsofcorruption.In this context, I think Ubraj Narine owes the PPP a formalapologyforthedirect attackputforthinhisletterin the media on July 24, 2023. Mr. Narine is also encouraged to review his mediocre performance as MayorofGeorgetown.
UbrajNarineshouldalso apologise to the people of Georgetownfortherudeway he demitted office. Protocol and tradition are important things in good governance. Arrogance and contempt from an outgoing public official are performances of immaturityandshouldnotbe tolerated.
Narine should also reflect on the inferior performance and legacy of his own tenure, and those of his comrades. The Auditor General Report found that
“[f]rom 2006 to 2011, no financial statements were submitted;duringtheperiod of 2012 to 2015 financial statements were submitted but the information required could not have allowed auditors to express an opinion; and no financial statements were submitted 2016 to 2020. In 2021, a special audit into M&CC r e v e a l e d s i m i l a r discrepancies” (Guyana Chronicle,5/26/2021).
There are specific instances of warped governancebyM&CCunder Narine evidenced in a $21 million solid waste contract that was not properly reviewed.
According to a reliable report, “Mayor Narine openly declared that the Council ignored his request for an additional review of the figure and went ahead andendorsedthe$21million contract” (Ibid) Narine’s explanation for not examining the contract as is required by standard operating procedures is that “…he and Chairman of the Finance Committee, Oscar Clarke had to leave the country…”(April1,2023).
What Ubraj Narine fails to state is that without PPP support Georgetown would have been in a much deeper state of disrepair and drudgery Between 2016-
2019 City Hall received $1 billion from the Central Government under the Georgetown Restoration Programme “Under the GRP,CityHallhadreceived incremental disbursements of $300 million in 2015, $200 million in 2016, $200 million in 2018, and $300 million in 2019. He said another option is going to their employers to garnish wages/salaries due to them monthly, or depending on how they receivetheirremuneration.”

...Police launch aggressive road safety campaign to curb lawlessness
In an effort to curb the lawlessness that has been occurring on the roadways, the Guyana Police Force (GPF) in collaboration with others on Monday launched the 'Respect the Road' campaign under the theme “Slow Down. Drive Cautiously.”

The police force has partnered with the National Road Safety Council, Impressions Inc. as well as other stakeholders to launch the traffic campaign The road safety campaign, which launched at the Police Officers' Mess Annex, Eve L e a r y, G e o r g e t o w n comprises of several components such as: educating children and others, about the safe use of theroad.Thiswillbedonevia billboards, signs, bumper stickers,andothermedia.
Also, streets and roadways will be saturated with reminders to be vigilant, cautious, and respectful on theroads.
During his address, Acting Commissioner of Police, Clifton Hicken, said that by working together, safer roads can be created for all. According to Hicken the police have collaborated with optimum agencies like DigicelandGT&Ttohavean E-ticketing system on the four-lanehighways.
He shared that while the initiative is a work in progress, he noted that soon, “You will have SMS (message) telling you when

you're speeding and the Eticketingsystemwillwork.”
Hicken said too, “I believe that together, as a nation, we can make a difference and create safer roadsforallusers.
Butbeforewecanmakea difference, we must understand the gravity of the situation as road accidents remain a significant global publichealthissue,leadingto millions of deaths and injurieseachyear.”
Commissioner Hicken highlighted that “speeding, driving under the influence, poor driver behaviour, distracted driving, and i n a d e q u a t e r o a d infrastructure are just a few factors contributing to these tragedies.”
This, he noted, can have significant negative consequences, such as physical, emotional, financial, and social impacts on those involved in road accidents Commissioner Hicken underscored the need for collaboration to improve roadsafety
The police chief suggested that by following international best practices, Guyana roadways can become safer He suggested that having Safe Road Designs by separating vulnerable road users like pedestrians and cyclists from motorizedtraffic.

Hicken added, “Next, we must implement effective Speed Management and Traffic Calming measures such as speed bumps, which can help to reduce vehicle speed, thus reducing the risk of injury if an accident does occur.”

Moreover, Hicken underscored, “We must continue to enforce Traffic Laws through an innovative andcontemporaryapproach. This approach would involve educating the public on the importance of following traffic laws through public awareness campaigns and utilising technology such as speed cameras to enforce them. Commissioner Hicken said this would help reduce the riskofinjuryduetoaccidents causedbymotoristsspeeding or breaking other traffic laws.”
Inclosing,Commissioner Hicken emphasized the c o n t i n u e d n e e d f o r collaboration across all sectors. “We must adopt a multi-sectoral collaboration to have a coordinated approach to maximize the impact of road safety efforts,”heposited.
For his part, Minister of Home Affairs, Robeson Benn, welcomed the initiative while thanking the private stakeholders supportingthecampaign.
“I want to particularly welcome this initiative here today...and I want to thank the private sector for partnering with us and all others who would have supported this activity,” he posited.

Omai sees Guyana US$190 million Mabura Road as a big boost to their gold operations
Even as the fiscal terms of large-scale mining contracts in Guyana remain hidden from the public; Canadian gold mining company, Omai Gold Mines has listed the US$190 million Linden toMaburaRoadasabenefittotheir goldoperationshere.
Omai is no stranger to Guyana; the company holds a 100% interest intheOmaigoldprojectinGuyana which produced over 3.7 million ounces of gold between 1993 and 2005. About two years ago, Omai re-entered Guyana's mining industry, occupying the same property which host two gold deposits: the shear-hosted Wenot Deposit and the adjacent intrusivehostedGiltCreekDeposit.

ElaineEllingham,thePresident andChiefExecutiveOfficer(CEO) of Omai during an interview talking about the management of the company shared that one benefitoftheirminingprojectisthe roadthatisbeingpaved.

Ellingham said during the interview that within a year's time the road that comes within several kilometers of Omai property will bepaved.Tothissheaddedthatthe company also has an airstrip on property and an old tailings facility which they believe can be refurbishedtobeusedagain.
According to her slideshow presentation about the benefits of the project, it was listed that, “The widening and paving underway as part of Government-funded upgrade of road to Brazil (comes within12kmofOmaiproperty).”
The sod was turned for this project in May 2022, after a contract was awarded to Brazilian firm, Construtora Queiroz Galvao S.A. for the construction of the 121 kilometresroad.
In 2020, the Government of Guyana secured a loan for this project. The US$190 million road project comprises a US$112million loan from the Caribbean Development Bank (CDB), a grant of £50 million (US$66 million) from the Government of the United Kingdom via the CDBadministered United Kingdom Caribbean Infrastructure Fund, alongwithUS$12millionprovided byGovernment.

She added, “We have not seen any limitations to the Wenot deposit, and as such are confident that additional drilling can further expandthegoldresources.”
Thispublicationhadreportedin January 2022 that the company had struck the jackpot only in itsWenot Gold deposit. It had found the 1.6 million ounces gold some 400 metres south of the Fennell open pit-apitthathasproducedsome2.4 million ounces of gold for Omai in thepastanditwaslocatedatadepth suitable for open pit mining. Nine months later, Omai was able to increase its gold resource in the
WenotDepositfromthe1.6million ounces to 1.86 million ounces-a 16 percentincrease.

In the latest incident in Manchester on Sunday morning armed men held up a bar in Kingsland, a few miles north-west of Mandeville.
A senior police source said about 2:00 am men entered the bar and held up two women, including a bartender, at gunpoint. The gunmen robbed the bartender of cash and took $65,000 from the other woman. Three poker boxes were also stolen. The gunmen then reportedly held the women against their will and raped them. The men then made their escape.
The police source said the theft of poker boxes is fuelling crime. “The men are tar-
geting bars not just to rob money, but the poker boxes are of most value to them; one of those poker boxes value up to $750,000. In this incident they stole three of the boxes — and to make matters worse, raped the bartender and another woman,” the source said. “We are warning bar owners and operators to comply with the Spirit Licence Act which outlines the opening and closing hours of the establishments. It’s 7:00 am for opening, and for closing, midnight on weekends and 11:00 pm on weekdays,” added the sources.
In the neighbouring parish of St Elizabeth, which in recent weeks has been plagued by criminals targeting bars, police have stepped up their response.
The men managed to flee the scene. The police were alerted and shortly after intercepted a Toyota Corolla motor car operating as a ‘pilot’ motor vehicle in close proximity to where the shooting occurred.

He retired in 1998, with 39 wins, six losses and two draws. His record and status led him to be inducted into the International Boxing Hall of Fame in 2004.
Following an exciting Under-13 (U13) Intercounty tournament, the Guyana Cricket Board (GCB) on Sunday released its 15-man squad which commenced encampment.
With a number of top performers in their mix, the U13 Guyana Team will be led by Brandon Henry with Richard Ramdeholl as his deputy.
The duo, alongside the likes of Khush Seegobin, Lamar Seecharan, Justin Dowlin, Bhomesh Lall and others, have been in top form and as a result will be looked upon to continue in the same vein ahead of the bilateral series.
