If deals not made public, ask Govt. why? – Int'l Group warns
Fo r c o u n t r i e s blessed with significant natural gas reserves, capturing those resources for use via gas-toenergy projects are often times, an obvious option for consideration But the manner in which contracts governing these projects are framed can have dire economicconsequences.
D r a w i n g o n t h e experiences of other nations, the Natural Resource Governance Institute (NRGI) has produced a framework to help nations and their citizens ask critical questions that would lead to the right decisions for these multi-billiondollarventures.
NRGI has been regarded f o r d e c a d e s a s a n independent, non-profit organization that supports informed, inclusive decision-making about natural resources and the energy transition It has provided advice to Guyana on several occasions on how itoughttoprudentlydevelop its oil and gas resources in theStabroekBlock.
NRGI's framework, published in September 2022, cautions that betting big on gas comes with serious risks and tradeoffs, especially as the world moves away from fossil fuels. It said, “Hasty, illinformed decisions today could carry hidden costs f o r a c o u n t r y ' s development prospects, energy costs and security, and climate, especially if it
ends up locked into a dirty, outdated and high-priced domesticenergysystem.”
NRGI noted that often times, fuel supply and transport deals for gas projects are subject to very little public scrutiny; terms frequently are not publicly available.
It said, “Governments may not have the bargaining power or favorable investment environments needed to avoid all contract terms that risk lock-in. But interested stakeholders should ask whether the public utilities, ministries or other bodies handling the negotiations are doing all they can to minimize the risks.”
In light of this, it said citizens must ask if contracts for gas projects are armed with a renegotiation clause for the transportation of gas. NRGI reasoned that this ensures the government has enough leverage to adjust deals when necessary and avoid being trapped into taking or paying for gas, no matter the circumstance This word of advice is premised on the case of Ghana.

Given these risks, NRGI said nations with gas ambitions must structure arrangements that balance risks fairly In terms of contract language, it said the

CJIA records 32% increase in passenger arrivals
The Cheddi Jagan International Airport Corporation (CJIAC) has recorded a 32% increase in passenger arrivals for January 2023comparedtothepreviousyear
During the month of January, the airport processed 25,005 arriving passengers compared to 18,874 in 2022, CJIA said in a release. The country's main port of entry continues to experience significant increases in passenger arrivals since the CricketCarnivalinSeptember2022.
Meanwhile, there was a 45% increase in cargo processed during January 2023 compared to 2022. The 738 tonnes of cargo processed in January 2023 comprised mostly agricultural products, perishable goods, industrialsuppliesandpersonaleffects.
Minister of Public Works, Juan Edghill, said these increases reflect the
transformational work being undertaken by the PPPC Government under the visionary leadership of President Irfaan Ali. The influx of visitors and investors coming to Guyana is attributed to the massive growth in housing, tourism, transportation and agriculturalsectors.
The Minister further noted that Guyana is well on its way to achieving one million arrivals by 2025, as predicted by President IrfaanAli.
In anticipation of continued growth, the Government is looking to expand and further increase the capacity at the Cheddi Jagan InternationalAirport. Vice President, Bharrat Jagdeo recently announced Government's plan to modernise and strengthen security measures at airports by introducing a new electronicpassportsystem.

12. Could the project endupflaringgas?NOTE: If the government gets the project's supply and demand estimates wrong, or the project starts producing gas before customers are ready to use it, its operators might have to flare gas while they are waiting.
GUYANA'S GAS AMBITION
Guyanese authorities have said the nation's first gas-to-energy project is scheduledtocomeonstream by2024.
It will transport natural gas from the Liza field in the Stabroek Block to the Wales Development Zone, where two main onshore plants are tobebuilt.

CH4/Lindsayca won the contract to construct the 300 megawatts (MW) combined cycle power plant and natural gas liquids (NGL) facility Itisdoingsoatacost ofUS$898million.
As for the construction of the pipeline for which ExxonMobil is responsible, this is expected to cost upward of US$1.3 billion. The current estimate for the projectismorethanUS$2B.
Engineers India Limited w i l l s u p e r v i s e t h e Engineering, Procurement and Construction (EPC) of the onshore plant facility. It is expected to hire another formtooperatetheproject.

A FOUR-YEAR AUDIT
It is four years later and Guyana is unable to get an audit fully done for US$460M. Using this as a benchmark, it should not surprise that the huge US$7.3B audit of ExxonMobil’s expenses has repeatedly goneoverpromiseddeliverytimes.Ifwecannotcompletea relativelymuchsmallerauditdoneinsuchalongtime,then thereissometroublefiguringoutwhatisitthatGuyanesecan expectfromanauditthatis15timeslarger,giventhebillions ofexpensedollarsatstake.
In 2019, an audit of US$460M in pre-contract costs incurred by ExxonMobil was started by UK-based IHS Markit. Four years later, the Hon. Minister of Natural Resources,Mr VickramBharrat,saidthattherewasbackand forth between Guyana and ExxonMobil, which held things up.Itisanormaloccurrenceinaudits,onewhereallparties want to have questions answered, and issues cleared, in a reciprocally satisfactory manner The latest from the Government is that “a final report has now been submitted and is being reviewed by all the relevant agencies (and) stakeholders” and “once that is over, we will conclude the first audit hopefully very soon” (“Exxon US$460M precontractauditstillongoing-MinisterBharrat”,KNFebruary 6).
We appreciate Minister Bharrat’s clearing the air, and learning that the actual audit work is, in fact, finished. But four years to audit US$460Mof costs (or anything) is too long, even with allowance made for Guyana’s own review process of the completed audit. Commonsense questions arise. Whatcouldbethecauseofsuchlengthybottlenecks, wherethisauditseemstohavejustfrozentodeath? Second, whatisresponsible(likelyhuge)forthedelaysinresponding byExxonMobil? Third,whyisExxonMobil,amajorparty, tothis‘smaller’auditdraggingitsfeet,stonewalling,andin one way or another holding up the process and finished product? Thisisnothelpful,notcomforting. Still,Minister Bharratsaidthatourreviewofthecompletedauditshouldbe “hopefullyverysoon.”
WithrespecttoMinisterBharrat,“hopefully”soundslike anexerciseinwishfulthinking,anddoesnotinstillthekindof confidence that should be after this four year wait. Also, “verysoon”againcomesacrossasgropinginthedark,where thisauditisconcerned,andputtingabrightsmileonmatters. OurownAuditOfficehasbeenabletocommence,complete, and compile audit reports within a much shorter period of timeforexpensesinvolvingbillionsofdollars. Admittedly, thoseareusuallyinGuyanadollars,andinthescrutinizingof itemsthataremorefamiliartolocals,dealtwithonanalmost repeating basis. On the other hand, the US$460M precontract costs of ExxonMobil and its partners possibly included many components that may be unknown to our reviewers (the GRA, among others), requiring more time to wrapourarmsaroundtheworkdonebyIHSMarkit.
Of note, however, is the statement by Opposition MP, DavidPatterson,thattheIHSMarkitauditreportwassentby theGuyanaGovernmenttoExxonMobilsincelastyearforits comments,andthecompanyhasnotrespondedsince. Whyis thisso,allowedtostand? WhatisitthatGuyanahasflagged for inclusion in the audit report, but which professional standards dictate must be shared with ExxonMobil for its comments?
For ExxonMobil to hold this up like this should not be pleasing to the PPPC Government. It certainly is looked upon most unfavorably by us, and should be, too, by all Guyanese.Wemustallwantthebestvalueforourhundreds of millions that ExxonMobil said it spent, and the company should not want anything but that, plus clearance to be paid fromouroilrevenues.
This is becoming to look like a trend with ExxonMobil doingasitpleases,seekingtorundisdainfullyalloverthisillequipped,weak,unreadynation. Wewantatrustedpartner, onethatisresponsivetoauditreportsthatmayhaveelements that sharply question ExxonMobil’s spending, pushes back onitsmult-imilliondollarpre-contractcosts.
Weareasovereignnation,andExxonMobileitherworks with us to its advantage, or plays these delaying games that exposesthecompanyforwhatitis.
PPP bent on dominating and controlling GECOM

Over one week ago, CommissionerRoheesought to respond to my letter of January 22, 2023. In that letter, I exposed the contrived acts that that PPP andtheircohortsatGECOM have being perpetrating in theirconcertedefforttotake control of GECOM in the manner in which they have gone about trying to dominate and control every aspectoflifeinGuyana.
Rohee in his response claimed my repudiation of his attempt to hoodwink the public about the legitimacy ofthecreationandfillingofa position at GECOM is “not only misinformed, but woefully misplaced”. The
Chairperson has since decided to rescind both the c r e a t i o n a n d t h e appointment.
Of course, in typical Roheestylenoevidencewas provided, and for that I commend him since no evidence is available and he seemed not to wish to descend to the tactics of backbencher Kumar, who in arecentletterunsuccessfully resorted to the art of fiction inhisattempttodiscreditme. He attempted to conjure metaphors as the basis of discrediting me with the hope of distracting the public`s attention from my cogent exposure of the schemethatisbeingpursued by him and his ilk at
GECOM This delayed response is as a result of the timeandeffortthatittookme trying to make sense out of whateventuallyIcouldonly describe as a nonsensical response Here are the reasonsforthatconclusion.
1. I concede that nine yearsago,Ididnotobjectto the shortlisting of Mr PersaudforthejobofDCEO. For Rohee‘s information, shortlisting is prima facie Aninterviewisinterrogative and may unearth that which was not evident on the surface.
Inthatstandardapproach totherecruitmentprocess,in theinterview(interrogation), my attention was drawn to information that informed
the conclusion that Mr Persaud did not meet the academic requirement for the job. He was not certified at the level of a first degree. May I repeat for the public, sinceRoheeandhisilkhave buriedtheirheadinthesand on this matter, the basis on which I objected to Mr Persaud‘s appointment was notamatterbeforethecourt. IhavesaidbeforethatInever accused Mr Persaud of contriving, but I maintained that the appointment was contrived. Since the Guyana Police Force seem incapable of efficiently and effectively managing this untenable traffic situation, I will suggest a possible solution thattheycanimplement.

Our concern is respect for our right as indigenous peoples to free, prior, and informedconsent.Thisisnot to say that no indigenous community in Guyana wouldeverdecidetogiveits consent to carbon credit sales,onlythatwemusthave the opportunity and the information required to take thisdecisionforourselves,in ourownwayandinourown time,notbyastrokeofapen bytheNTCinGeorgetown.
PradeepaBholanath at the Ministry of Natural Resources also made a puzzling comment, after questioning my credibility, that “in democracies, there will always be varying commentary around ambitious climate action –and sometimes these will be forpartisanpoliticalreasons ratherthanbasedonfacts.”
Thedeceptivenessofthis comment is frustrating. As stated above, our communities’concerns over
the carbon credit approval andsaleareaboutrespectfor our rights, not opposition to climateaction.
Thecommentshowsjust how disconnected our government is from our indigenous communities Ask any indigenous person how climate change has affected their life, and they will give you a list. Shifting weatherpatternsattributable to climate change affect everything,fromthecassava weeattotheleavesweuseto makeourroofs.
Ms.Bholanathalsonoted that I had been part of the LCDS consultation process led by the government. Of course, I was; I care about my communities and have long worked to advocate for meaningful consultations and respect for the rights of Amerindians. But the fact remains that consultation is n o t c o n s e n t , and a consultation process that does not lead to an opportunity for our communities to give or withhold consent through our own processes cannot constitute meaningful participation.Iwasalsopart of a meeting where Ms. Bholanath said that they would take seriously important lessons learnt from the previous LCDS. These recent actions show that those lessons have been ignored, and we see a dangerous trend in ignoring rightsandproperprocess.
For the government, this carbon credit scheme is aboutmoney.

The concerns I have expressed, which are shared by many m e m b e r s o f o u r communities, are about safeguardingourculture,our identity,andourwayoflife.I callontheARTSecretariatto reevaluatetheroleplayedby the NTC in carbon credit approval for all future batches of credits, and I call on the Government of Guyana to stop using the NTC as a substitute for genuine free, prior, and informedconsent.
Climate change is a real threat to humanity with indigenous people being the most vulnerable While Guyana may be able to cash in on our mitigating measures, it should not be doneattheexpenseofstrong processes that respect and protect rights. Ignoring our rights will threaten the very existence of Guyana’s first peoples. We are still in the initial stages of the carbon credit scheme, and there have been fundamental missteps that can be corrected We need mechanisms that reflect full a n d m e a n i n g f u l participation, true representation, and respect for our rights as indigenous peoples.
We can use this opportunity to realise the ‘One Guyana’ policy and trulyleadtheglobaleffortin fighting climate change, without sidestepping the legitimate concerns of our communities.

W h i l e e x p e n d i n g approximately $186 million to modernize the front of the Cliff Anderson Sports Hall and to install the heating, v e n t i l a t i o n a n d a i r conditioning (HVAC) systems, the Ministry of Culture, Youth and Sport would also be spending another $31 million to execute the electrical works onthefacility
Accordingtoinformation released on the National Procurement and Tender Administration Board (NPTAB) website, is that following the national competitive bidding procedures a contract has been awarded to contractor, A.Orgasein and Sons to do the electrical works at the facility to the tune of $31,409,000.
As previously reported, the Ministry commenced a rehabilitation project last year to have the sporting facility be enhanced and modernized.
Kaieteur News had reported that in November last year, contractor, ECS Construction had won a $97M contract to have the front of the building redesigned While in
December, that same contractor was awarded another contract worth $89 million to install the HVAC systems. This means that ECS Construction has been awarded a total of $186M for thetwoprojects.
DuringavisittotheSport Hall back in November, Minister of Youth, Sport and Culture Charles Ramson had told this publication that the $97M covers only the first phase of the rehabilitation project The Minister explained then that the work at the Sports Hall will be done in phases that will run concurrently Speaking of the first phase, the Minister had said, “thisoneisfortheredesignof the front section; the entire front section is going to be pulled down and be modernized.” This specific phase is expected to be completed in eight months. The other phases will see the e n t i r e f a c i l i t y a i r conditioned, and the installation of bucket seats. The Minister disclosed that theSportsHall'sflooringwill be enhanced as well, while the bottom sides of the building are to extended “to give us a little bit more
room.”
Ramson said that the Sports Hall is old and rehabilitation is aimed at modernizing the facility
“You know we are in a modern country We need to have a modern facility especially a modern indoor facility, it would be the only airconditionedfacilitythatis indoor in the country and that's important not only for the sports that we play there currently, let's say we wanna hostinternationalboxingthis would be a good facility for that,”heexplained.
Following the tender to rehabilitate the facility, the Ministry had also invited bidsfortherepairofthemain roof which is estimated to cost $12 5M, electrical installation works which was estimatedtocost$37.9Mand the heating, ventilation and, air conditioning (HVAC) installation works, which was estimated to cost $74.2M.
T h i s y e a r , t h e government has allocated a total of $4.3 billion for the overall development of sports in the country. This allocation will also cover the completion of the Cliff AndersonSportsHall.
ExxonMobil submits draft agreement for oil spill coverage

H e a d o f t h e Environmental Protection Agency (EPA), Kemraj Parsram has confirmed that the regulatory body is in receipt of a draft parent guarantee for oil spill coverage from ExxonMobil Corpo ation This is to
complement the insurance policy in place by Exxon's subsidiary and operator of the Stabroek Block, Esso Exploration and Production GuyanaLimited(EEPGL).
Parsram said the EPA is also in receipt of an assessment regarding the realisticcostforanoilspillin a worst case scenario. This was an independent study he said, adding that it is in keeping with the provisions contained in the permit governing EEPGL's fourth project development at the Yellowtail field in the StabroekBlock.
He said this assessment will inform the size of the guarantee to be requested fromExxon.
According to the Yellowtail Permit, EEPGL has to submit to the Environmental Protection Agency, as soon as reasonably practicable, and upon its request, a series of documents and evidence to ensure the State is well protectedfrombeingsaddled with oil spill costs. These include Environmental Liability Insurance policies in both a printed and

electronic copy, a summary of the Environmental Liability Insurance policies detailingtheinsurer,thetype of insurance, the amount of coverage provided by each policy, key terms of the insurance policies, what types of environmental damage the policies cover, what types of environmental damage the policies do not cover, and the duration of eachpolicy,evidencethatthe insurer is authorised to provide the insurance in Guyana, evidence of authorisation of the institution or parent (insurers) to provide insurance, and evidence of the insurer's financial strengthandmarketgrades.
EEPGL must also, as soon as is reasonably practicable,providefromthe
parent company or affiliate companies of permit holder and its co-venturers, one or more legally binding agreements to the agency, in whichtheparentcompanyor affiliate companies of the permit holder and its coventurers, undertake to provide adequate financial resources to pay or satisfy t h e i r r e s p e c t i v e environmental obligations regarding the Stabroek Block.
K a i e t e u r N e w s previously reported that Exxon and government were in talks about a US$2B parent guarantee for oil spill coverage. This would be in addition to the EEPGL's provision of a policy totalling US$600M per occurrenceofanoilspill.
The EPA had said it would not sign off on the US$2B until justification was provided. Parsram had said in 2022 that Exxon was asked to explain how it arrivedattheproposedsum.
He had said, “…We, as the regulator, are working with them and questioning what makes sense and what doesn't and laying out what we expect…I am not saying the US$2B would not be accepted but you cannot come up with a figure out of the air, you have to show me how you arrived at that figure…”

Forty-four-year-old Lurick Fiffee, of 1109 Westminster, West Bank D e m e r a r a , w a s o n Wednesdayfreedofacharge which alleged that he murdered his ex-girlfriend, Rosemary Rudder back in 2018.

Parliamentarian and Attorney Roysdale Forde, who is representing the petitioners, had submitted that the Chief Justice acted unlawfully and misdirected herself when she failed to considertheobjectiveofthe petition in making her decision.

“This election petition is quite narrow and has raised really one issue and we are of the firm view that legal issue has not been meted out by the appellants. We asked respectfully that theappealbedismissedwith an appropriate order in respect of costs,” Nandlall said. Last December, Court of Appeal, took a majority decision, to hear the appeal challenging the decision of the Chief to throw out the petition.

Fishermen swam 20 miles to safety after boat mishap in Atlantic Ocean
Six fishermen were last Sunday rescued by members of the Guyana Defence Force (GDF) Coast Guard, in the vicinity of Iron Punt Foreshore, Pomeroon River
The men reportedly survived the ordeal, by helping each other to swim some 20 miles tosafety,aftertheirboatsanklastThursdayin theAtlanticOcean.
GDFinareleasestatedthatithadlearntof the fishermen's plight on Saturday after receivingadistressreportthatafishingvessel hadlostpropulsionintheAtlanticOcean.
A search and rescue operation was initiated around noon that same day to locate thevesselindistress.

Abandoned crew onboard Surinamese vessel sent home without pay
The employers who allegedly disappeared and left a crew of six men stranded onboard a Surinamese vessel anchored in the Essequibo River have returned but are now being accused of sending home the menwithoutpay.
According to one of the
crew members, Orin Riddle, a Guyanese, the owners of the vessel returned after Kaieteur News reported that they were abandoned without food and cash.
Riddle said that his employers were not too pleased with them relating their situation to the media
and had allegedly threatened them and eventually sent them home without any pay or passage. “Only one boy that remained behind, they give him $50,000”, Riddle alleged.

denied threatening the crew
The employer, however, did admit that he still owes the crew their salaries but refutedclaimsthattheywere sent home without any money. “We give them hundred thousand each fuh themgohome”,themansaid while adding that he owes a balanceofUS$11,500.
He acknowledged that the men “are family men” andpromisedtopaythemoff by next week Monday The employer related that he was unable pay the crew on time because his client had not paid him for towing a vessel from Skeldon, Berbice to Trinidad. “I know that it is

Despite being scheduled for cross examination on Wednesday, Chairperson of the Guyana Elections
Commission (GECOM), Justice (Ret'd) Claudette Singh, was a no-show at the Commission of Inquiry
(COI) into the March 2020 Regional and General Elections.
Justice Singh was listed
among witnesses who were set to face a series of questions from Nigel Hughes, the lawyer for
Elections Officer, Roxanne Myers, in relation to their testimonies implicating
Myers in the elections mayhem before the elections COIcommittee.
However, when the hearing was ready to commence, Justice Singh was absent and Chairman of the Commission of Inquiry (COI) explained to Mr Hughes that the GECOM Chair did not implicate Myersinhertestimony
Hughes was told that his questioning of witnesses should be limited to those whoimplicatedhisclient.
The lawyer, however, explained that Justice (Ret'd) Singh, in her testimony, indicatedthatMr Gunrajhad accused Ms Myers of blocking him from entering sections of the Command Centre. But the Commission said it is for Mr Gunraj to respond to those allegations andnottheGECOMChair GECOM Commissioner Gunraj is now expected to reappear before the Elections COItodayat10:00hrs.
In the meantime, Hughes was given the opportunity to cross examine GECOM's IT Manager,AnealGiddings.
While under crossexamination, he admitted that he removed the Secretariat's server from the R e g i o n 4 R e g i o n a l Command Centre on March 5, 2020, and placed it into his personal car despite the fact that there were several vehicles belonging to the C o m m i s s i o n i n t h e compoundatthetime.
Hughes asked whether his actions were in keeping with the Standard Operating Procedure (SOP), Mr Giddings said” the SOP does not clearly state where the server or data should be placed.”
H o w e v e r r e t i r e d Chancellor of the Judiciary, CarlSingh,soughttostopthe line of questioning by enquiring whether, Mr Giddings was on trial. The former Chancellor is among the three Commissioners presidingovertheCOI.
“The issue remains the same, has Mr Giddings said anything implicatory of Ms Myers.Ifhedid,putittohim, let's hear what he has to say,” CommissionerSinghsaid.

Schlumberger willing to relocate radioactive waste facility

I f t h e r e g u l a t o r determines that the study is required, SGI will have to conduct the assessment through an independent consultant, approved by the EPA. That study will then be
used by the agency to make a decision in granting the approvalfortheproject.
On the other hand, the EPAcandecidethatanEIAis not required and instead order an Environmental Management Plan (EMP) and/or other forms of assessment to inform its final decisionforthefacility
The public must be notifiedoftheEPA'sdecision according to the law, which must be supported with reasons for their conclusion. The public will also have an opportunity to offer comments on the decision madebytheEPA.
