My attention has been drawn to Bharrat Jagdeo’s mostrecentpressconference and to his usual rantings aboutmyselfandothers,and in particular, about the Exxoncontract.
Ihavegrownaccustomed t o t h e s e t o t a l l y unsubstantiated statements and accusations, and understand where they are coming from. I am told by persons close to him that he has neither forgotten or forgiven me for our last encounter in Parliament someyearsago.
As such, I know that I walkaroundwithabigtarget on my back, and in his own words, he’s “vindictive”. It seems that no press conference can be held by him without my name being featured.Jagdeoisobviously unabletoreleasemefromhis mind.That’sunderstandable. Thehauntingwillcontinue. However, what is more
immediate, and of critical importance, is the statement that I, unknown to anyone else in the Cabinet, went off on my own, in the dark, conspired with Exxon, and committed an act of criminality in signing the agreement in June of 2016. Toquotehim:“Trotman...he is the biggest villian, the biggest criminal in signing theagreement.”
Thankfully, I have addressedmuchofthisdrivel in my book, and have the documents to dismiss it as ridiculous.
For now, putting aside the very slanderous aspects of the statement, from a purely legal and objective point of view, it occurred to me that Jagdeo has just delivered, wittingly or unwittingly, the pièce de résistance-theverybasison which his government can set aside, if it sincerely wishes to, the 2016 agreement that he endlessly
gripesabout.
Every student of the law knows, and I am sure he has access to first-rate legal advice to confirm, the fundamental principle that fraud and illegality vitiate andvoidanycontract.
All Guyanese should be happy at this latest pronouncement, or mispronouncement. In essence,itmeansthatthereis no need to “renegotiate” anything.JustinformExxon and its partners, Hess and CNOOC that because of the allegecriminalityassociated with the signing, there is no valid contract and call on them to come to the table to hammeroutanewone.
G i v e n J a g d e o ’s statement, ‘Sanctity of Contract’ cannot be applied in this instance by either Guyana or the other parties. Becauseofthe“criminality” there was no contract from thebeginning.
In the circumstances
adumbratedbyhim,itwould bevoidabinitio.I’mnotsure ifExxonanditsshareholders will be pleased to hear him say that the contract was predicated by criminality, as they would obviously be considered co-conspirators and accessories, but that’s notanyofourconcern.Now, the genie is out of the bottle and these words will go far and wide, and can’t be recalled. The Vice President of the Cooperative Republic ofGuyanahasspokenonthe “criminality” attending the agreement between the Government of Guyana and Exxon, Hess and CNOOC, and his words cannot be ignored. He thereforehas an obligation to do something aboutit.
The ball is now in his court,andallGuyanaawaits his action to do something about this so-called “criminality”.

some two million girmityas being engaged in forced, exploitative labor in Africa, Pacific, Caribbean, and IndianOceanterritories.The Gladstone family-owned ships that were used to transport indentured labourers from British India to the Caribbean. The disaggregation of data was meant to track whether all students are making progress, and whether schools are i m p r o v i n g t h e i r performance every year In theolddays,noonebattedan eyelid whether students in a school were passing or failing, but NCLB changed allofthat.
No longer could any staff be sitting on the payroll waiting for
retirement Everyone was now accountable for results.

Efforts are underway by the Guyana Agricultural and General Workers Union (GAWU) to inform local oilfieldworkersoftheirright to be represented by a labour union This comes as employees within the sector continue to face threats not jointheunions.
GAWU's President, SeepaulNarinetoldKaieteur news on the sidelines of the nd Union's 22 Delegate's Congress held at the Arthur Chung Conference Centre (ACCC) on Wednesday that many of the Guyanese workers within the oil sector a r e s t i l l a f r a i d o f unionization.
His statement comes more than a year after GAWU signed an agreement with the Trinidad-based Oilfield Workers' Trade Union (OWTU) to offer support to locals employed withinthesector
Narine noted that while one of the main purposes of the agreement is for the two unions to merge knowledge, information and provide
technical support to provide better representation to the workers, many local employeesarenotawarethat they have a legal right to be unionized He said, “Workers in that sector need to know their rights and who they can turn to in terms of representation.”

In July 2022, GAWU
signed a Memorandum of Cooperation with the Oilfield Workers Union (OWTU) of Trinidad and Tobago.
Following the signing of the agreement, the GAWU President had noted that the Guyanese union hopes to leverage the OWTU's vast experience in the oil and gas sector amid efforts to officially represent oil workersinGuyana.
He said the agreement is necessary, because oil workers in Guyana already face issues that include employers' unwillingness to pay overtime and to provide appropriate Personal and Protective Equipment (PPEs).
In resolving issues of workers, Narine said one cannot only depend on the Ministry of Labour whether thegovernmentisfriendlyto thecontractorornot.
“…Itisonlyunionisation that will be able to take workers out of their difficulties,”hesaid. Another challenge in representing workers is that different hiring companies source workers on behalf of the contractors. As such, Narine said that it becomes complicatedrepresentingthe workers.
Notwithstanding, the M e m o r a n d u m o f Cooperation will allow GAWU to benefit from OWTU's knowledge and skills in representing workers.

A snippet of less than a minute from Dr J's press conference held last Thursdaywasplayedforme, and I was pressed for my thoughts on the fact that brother Jagdeo mentioned the word “morals.” Though I listen to this leader only when pushed, I jumped out ofmyskin,soincrediblethis was. Let's face this simple fact: morals and the man are a stretch, a long, curvy one. What is the world coming to these days, where are we all heading, when there is the utterance of the word “morals” from Dr Jagdeo, and all that it means? Obviously, the world is coming to an end. For there isthehardconclusionthathe mixed up “morals” with
morale. Meaning, that he was working furiously to give his flagging troops a boost; that he was engaging in one of his now patented pompom and gyrating cheerleading exercises, with a view to denying reality, whichisbecausehistalesare of the fairyland variety. When brother Jagdeo speaks of “morals” it is the equivalent of him showering fairy dust on his audiences, and blinding them to truth, justice, ethics, principles, honor, and the honorable, all sacred attributes; and all interwoven with the imperativesof“morals.”. To me. Istillponderabouthim, especially with this latest marvelfromhim.
For the learned Dr. Jagdeo enlightenment “morals” is more than the sexual; it envelops and encapsulates, then expands a n d e x t o l s , t h e transformational in leaders, the constant quest for the high ground by men and women, and seeing the same

ExxonMobil's subsidiary, Esso Exploration and Production Guyana Limited (EEPGL), recently published a Request for Information (RFI)seekingcompaniesthat can provide Blow Out Preventer (BOP) testing equipment to support drilling activities within the Georgetownarea.
A BOP is a large specialised unit weighing up to 400 tonnes that is used to prevent an oil spill from occurring. It works like a valve to close an oil well, similartoaplumberclosinga valve in a pipe, and are proven to be highly effective in ensuring well safety The BOP testing equipment is used to ensure that BOPs were well functioning and capable of oil spill prevention.
The company which is the operator of the Stabroek Block offshore Guyana, uses the above mentioned equipment for all of its projects. In its RFI, EEPGL notedthatcompaniesbidding tosupplytheequipmentmust meet the precise parameters
set. This includes offering a universal 3-1/2” x 5-7/8” test joint designed specifically for testing Subsea Blow Out Preventers. The test joint must meet stringent pressure requirements of 15,000psi, with the seals utilized on the test joint capable of handling pressureratingsof30,000psi. Additionally, the test joint shouldadheretoDS1Cat3-5 inspectionrequirements.
EEPGL is also seeking the provision of a 4-way manifold test stand, engineered to accommodate various connection sizes, and
boasting a pressure rating of 15,000psi. Furthermore, the supply of a Blind Shear ram test tool and an emergency retrievaltoolisalsorequired.

Oriamna Naomi Silva Figuera, the Venezuelan national, who was arrested and had reportedly confessed to the fatal stabbing of John Fitzpatrick called 'Sunny' which occurred at Kumung Kumung Backdam, Region Seven, was on Tuesday charged for thecrime.

Following her arrest, Guyana Police Force (GPF) revealed that Figueira told detectives at the Bartica Police Station that she stabbed the miner with a retractable knife that she had in herpossession.
The police stated that Figueira was cautioned and told of the allegation of the murder of Sunny, to which she admitted, stating that the deceased had attacked her when she refused to dance with him at a shop inKumungKumung.
The woman told the police that she later went to the victim's camp later that night, where she saw him lying in a hammock. She then took a retractable knife and dealt him threestabsabouthisbody

On August 18, at about 06:00hrs, it was reported that the Venezuelan woman who Fitzpatrick had the argument with, was seen running away from his camp. He was later discovered covered in blood, lying motionless in his hammock.
Police said, upon arrival at the camp, observed Fitzpatrick's body and it was examined with one stab wound seen to his upper left side chest, two stab wounds were also seen below his left armpit, and one to his upper left side back Subsequently, an investigation was launched into the fatal incident.

Trade Unions in Guyana mustfocustheirattentionon adjusting to the everevolving world by adapting to technological advances, President Irfaan Ali said at the opening of the Guyana Agricultural and General Workers' Union's (GAWU) nd22 Delegates' Congress held at the Arthur Chung Conference Center, Lilendaal.
He said failure to do so would see unions such as GAWUexperiencingunique challenges The Head of State emphasised the need for the Unions to devise creative ways to remain relevant in an ever-evolving andcompetitiveworld.
President Ali challenged trade union bodies in Guyana and the wider Caribbean to invest in addressing the changes while pointing specifically to the role of Artificial Intelligence(AI)andtheuse ofrobotics.
“How can we remain competitive without adjustingorevenrelevantin thisnewworld?
AI, the digital economy androbotics,areuponusand we are seeing what this new reality can do and how it is rapidlychangingthings,”the headofstatesaid.
GAWU's two-day conference is themed, “Advancing Workers' Rights, Economic Progress andSocialJustice.”
The President noted too that this change will require collective effort and hard work.
He asserted that: “It requires changing mindsets. It requires building our competitive ability It requires building the capacity and capability of ourworkforce.Itrequiresthe diversification of skills within the workforce It requiresthecoming-together of our people under the umbrella of a common vision that will drive and upliftthiscountry.”

Another homeowner said, “Builders Hardware is the contractor of my home in the young professionals’ scheme in Prospect.
They are currently building my house and it’s a nightmare at best.
I’ve been paying my mortgage since October of last year. It’s been over one year since I signed an agreement with them which states that the house will be completed in six months, it’s very unreasonable.”
“My front and back doors have large spaces in between, water also seeps through the back door when it rains, my step is incomplete, the gutter over the porch is leaking, most of my windows are not opening, no plumbing in the laundry room…” she said.
The resident said they
were not given the houses free and even if that were the case, they ought to receive quality houses.
Their expectations have been shattered, since they are not receiving that which they have been promised.
The residents disclosed that that several times they have tried contacting the contractor to get him to rectify the defects on the houses to no avail.
“I got onto him once and he promised to look into it and he never did, when I tried calling him again, I never got back onto him,” one of the residents said. All of the residents who spoke with Kaieteur News said that making contact with the contractor is “one of the hardest things.”
A resident said, “Most of all there is a complete breakdown in communication, that is, Builders do not answer the phone, which I tried multiple times, even in the presence of a CH&PA engineer.”
Housing Minister’s response On Wednesday, this publication made contact with Minister Croal.
The minister was asked if his ministry inspects the quality of the homes before it is handed over to the residents and he stated that they are designated persons in his
ministry and CH&PA who are tasked with inspections before the k eys are handed over.
However, the residents showed that they have received the keys to their homes that are not built to standard.
The Minister said that he met with the contractors to address the issues reported by the homeowners.
Further, the Minister told Kaieteur News that the CH&PA contacted some of the residents who made complaints.
However, the residents who spoke to Kaieteur News said they were not contacted by the representatives of the Ministry of Housing much less the subject minister.
Minister Croal assured Kaieteur News that the issues are being addressed while adding that the residents need to contact CH&PA to have their problems rectified.
Additionally, the minister disclosed that two contractors have since been terminated for the substandard work done on the young professional homes.
An update will be forthcoming on the actions taken by the Ministry of Housing and Water, CH&PA and Builders Hardware to rectify the defects of the houses.
