Disciplinary actions relate to an employee’s capacity or conduct which may breach the obligations in the employment relationship i.e., to render faithful and honest service. Disciplinary matters should be promptly addressed by the management in the public service and should be separate and apart from any criminal investigation and consequent action therefrom. Revisiting and Revising the Public Service Disciplinary Process and Procedures on the outcome of any court case.The following process and procedures are proffered for consideration and debate. When it appears to senior staff, heads of departments or permanent secretaries that there is reasonable cause to believe that a staff member may have committed gross misconduct, or dereliction of duty, or is unable to perform the functions of his/her position as might warrant disciplinary action, the concerned head of department and permanent secretary, on their own initiative or upon receipt of a complaint from any source, in consultation with the head of personnel of the Ministry of the Public Service, should conduct a full investigation and hearing into the alleged misconduct or inability to function. A committee comprising the relevant head of department, head of the ministry’s personnel department, and the permanent secretary of the relevant ministry, should investigate the complaint within fourteen working days of the receipt of the complaint or from the date of initiation of disciplinary action, with due regard to natural justice principles. During the investigation and hearing, if it is considered expedient, the concerned staff member should be suspended from duty on half pay for fourteen working days and should be paid the amount withheld, only if exonerated. The staff member to whom the investigation relates should be free to represent himself/ herself and to be allowed representation by any person at the investigation and hearing. The investigating Committee should recommend to the Permanent Secretary of the Ministry of the Public Service, such fair and appropriate disciplinary action, by the end of the fourteen working days. The Permanent Secretary of the Ministry of the Public Service shall, within 14 working days, consider the matter and make the appropriate recommendations to the Public Service Commission (PSC). The Public Service Commission should consider the recommendations of the Permanent Secretary of the Ministry of the Public Service and shall institute appropriate disciplinary action including suspension without pay for up to two months, or immediate dismissal for good and sufficient cause, or termination of the employment contract. The affected staff member may appeal any decision of the Public Service Commission to the Public Service Appellate Tribunal which shall review the decision of the Public Service Commission in keeping with the principles of fairness and natural justice. The Tribunal should consider and render its decision within 28 working days from the date of appeal. The decision of the Appeals Tribunal shall be final and binding on all parties.

Unavoidable questions remain, however, like why should Guyana be paying ExxonMobil’s income tax to GRA out of Guyana’s share of the profits whilst also paying ExxonMobil’s insurance premiums and the interest on loans that company took on to finance its operations?Theshortexplanation of the unique tax deal is that ExxonMobil is making a no sense of the purpose of any double taxation treaty. A Guyana tax waiver means that the company would still be liable to pay US taxes – so to avoid this, inevitability ExxonMobil gets GRA to certify for presentation to IRS, the fiction that ExxonMobil did not simply benefit from (Continued
We are baffled by how leaders in the PPP/C Government bend over backwards, twist themselves into knots, and try every trick in the book to hide from renegotiation of the odious oil contract that Guyana has with ExxonMobil. One of the latest acrobatics from the PPP/C Government with this oil contract was presented by us recently: “VP Jagdeo, President Ali at odds over renegotiation of Exxon contract” (KN August 18). President Ali swiftly distanced himself from any talk involving renegotiation, which is strange coming from a national leader. President Ali said, “I don’t think you are quoting the Vice President correctly because the Vice President would have said that future (Production Sharing Agreements) PSAs would be different from this.” He also noted that this is “completely different” from what the Vice President would have said, and claims that renegotiation is on the agenda of the PPP/C Government are just not so. This gets more curious by the moment, which we will revisit later, but first here is an extract from Vice President Bharrat Jagdeo’s own words at a gathering in Patentia, West Bank Demerara: “on the one hand, you see Rystad Energy and Exxon trying to prove that they are the best thing for Guyana, which is not so. The contract was bad, we have to change it in the future but we are not going to renegotiate now.” We at this publication are mystified, and troubled, that the two most senior national leaders would go into these verbal contortions so as not to touch this most feared word in Guyana, which is RENEGOTIATION. “Would be different from this” (what currently exists) and “we have to change it in the future” both sound like renegotiation under different covers. These are exercises in semantics, and raise a bundle of probing questions, to which only President Ali and Vice President Jagdeo can provide satisfactory answers. The ongoing problem is that we are almost certain that both of them will not be forthcoming with any answers, since their first priority is to keep up this sham of being for the Guyanese people, while the real story is to conceal how much they are in cahoots with ExxonMobil in the gouging of Guyana. Why is it that renegotiation of the oil contract creates such shivers running up and down the spines of President Ali and Vice President Jagdeo? What is it that both of them find so fearful about the mere mention of the word ‘renegotiation’? What devilish bargains have they worked out with ExxonMobil that necessitate, indeed command, their frights and frailties where renegotiation is concerned? In what ways have they possibly compromised themselves that they now find themselves beholden to the American oil giant and, therefore, enslaved from having anything to do with renegotiation of the abominable contract, and renegotiate it now? Why, when the opportunities were available with the Payara and Yellowtail Projects were those allowed to go abegging without so much as one new development of substance for the benefit of Guyana? Many questions, but nobody is daring to answer. Moreover, we find it strange that the President is shying away so much from the word renegotiation. He has been known to be harsh and wrathful and oppressive, when any little citizen gets in his way, or interferes with his manufactured stories of how Guyanese have it with this oil, through its downstream developments. On those occasions, President Ali is a full head of steam, and the anger flares through his nostrils, as he unloads on some hapless Guyanese raising innocent inquiry about their future and the role of this oil contract. What hostile spirit takes over him that he vents blasts of fury at locals? Similarly, what formidable spirit overtakes him that he whimpers pitifully, and scampers away quickly, when the word ‘renegotiation’ is put in the centre of the national discussion table? We hope that he is not afraid of the foreign masters who come here to rule over us again, and dictate to him, as to what he must say, how it must be said, and when to say it, where renegotiation is concerned. Though this could explain much of the mystery, we just hope that it is not so.

DEAR EDITOR, Appalling it is to read, ‘Resisting the emerging apartheid state.’ So, I am elated that Floyd Haynes has distanced himself from the ‘Cuffy 250’ forum, that has chosen such a topic, ludicrous and vexatious at its best. Haynes was candid and firm, declaring that he wrote the Chairman of the Committee, Norman Ng-A-Qui, “… protesting his inclusion in the line-up of speakers at the forum scheduled for August 21, and calling for the immediate removal of his name.” He also noted that he had not been asked, formally or informally, to be a part of the programme. In fact, so upset and uncompromising the man is that he “… expressed consternation that his name was included on a list of speakers at this “Resisting the emerging apartheid state” forum, organised by the ‘Cuffy 250’ committee.
Now outside of lending my support to Haynes for his bold stand, I feel compelled to hit at this ‘Cuffy 250’ group. They are a mere agent provocateur, and the actual topic is not just a blatant denial of reality, it is very inciting and can only be for the purpose of resurrecting fading angst, that was in the first place unjustified. First, let me inform the perpetrators of this fallacy, that Apartheid, as we know it, was rampant during 1948 to the early 1990s and only in South Africa. Guyana, at no time supported this kind of evil, and for sure, never came close to practising it. As regard the ‘now’ and what this quack forum is seeking to do, it will not succeed, as it is clear that the PPP/C is most nondiscriminatory.Forexample, in the Apartheid system, Black South Africans could not own property. I ask now, “What is Guyana’s current drive? Is anyone being left out? I remind all that very soon, residents of Golden Grove, East Coast Demerara, will have legal right to lands they occupy in the backlands. This commitment came from Attorney General and Legal Affairs Minister, Anil Nandlall, SC, and Commissioner of the Lands and Survey Commission, Enrique Monize, just recently. In fact, it has already been agreed that residents will work along with the Government to get leases for the lands they occupy, a process that the Government enacted sometime ago, but which was not continued by the APNU/AFC leaders during 2015-2017. As a matter of fact, pre-1992 PNC Governments never even gave something like this a modicum of consideration. So, what will happen now (Continued page

My reaction was ‘WOW, are these people for real!’It was very clear that the Press Conference was held to discredit detective Sergeant Dion Bascom and to “debunk” the allegations that there is a cover-up by the police into the murder investigation of Ricardo Fagundes aka “Paper Shorts” and the payment of a large bribe to a named senior officer who headed that investigation.Havinglistened to the presentation by the Crime Chief, Assistant Commissioner Wendell Blanhum, and the responses by him and the Acting Commissioner of Police, Clifton Hicken to the few questions, which were allowed, I cannot help thinking that they did more harm than good in their effort to discreditSomeoneBascom.once said “I think if there were some mystery or unsolved problem, and somebody gave some “unsatisfactory” explanation, then we could claim “this [just] creates more questions than answers”, implying that the explanation is not sufficient or not complete. We might be better off without thisDuringexplanation”.hissocial media disclosures, Bascom made several damning allegations and provided evidence to support some of them. The Crime Chief and the Acting Commissioner failed to address several of the “Better to remain silent and be thought a fool than to speak out and remove all doubt” allegations; instead the Crime Chief was very selective of the ones he flippantly addressed. His demeanour and tone prompted a journalist to ask him why he appeared to be so dismissive of the allegations. I find it astonishing that the Crime Chief in response to the question relating to Bascom’s claim that he was instructed by the Head of the Major Crime Unit, Superintendent Mitchell Caesar, to make a report at the Brickdam Police Station about threats made to him (Bascom) by one of the main suspects in the above mentioned murder, would nonchalantly state that he was aware of the report made but that was not a matter for the theandherespondedGuyanastillheCommissionerForceandmoraletheabsolutelyandreportmurdermainthreatenedallegesexecutioninvestigationwasunderhaveUnbelievable!theDepartment,InvestigationsCriminalofwhichheishead,todealwith.Hereyouacasewherearankhiscommand,whoinvolvedintheofanstylemurder,thathewasbyoneofthesuspectsinthesaidcase,makesapoliceaboutthatthreat,theCrimeChiefshowsnointerestinmatter.NowondertheofranksoftheCIDtheGuyanaPoliceisatitslowest.TheActingwasaskedifthinksthatBascomisfittoserveinthePoliceForce.HebysayingthatdoesnotprejudgeissuesthatthereisaprocessinGuyanaPoliceForceand that process must be followed before any rank can be dismissed for the Force. It lost those elections to the PPP/C but tried to benefit from attempts at rigging the results. This was a major misstep of the APNU because the world had changed. The western countries which had turned a blind eye to Burnham’s and Hoyte’s rigging could not do so any longer. The new world postCold War world order which was being constructed was being built on respect for free and fair elections and the western nations could not and did not turn a blind eye to the attempt to foist a rigged election on the nation. For the first time ever, travel sanctions were imposed on individuals for their alleged involvement in the attempt to rig the elections. The APNU+AFC did not need to do what it did. Had it gone into the elections as a more united front and had its economic policies not imposed hardships on the people, it could have won reelection.Theethnic arithmetic of the country is not the same as it was in the past when the PPP was assured of a victory once there was ethnic voting. The situation at present is that no ethnic group by itself can deliver a victory to either of the two main political parties.But the PNC/R shot itself in the foot and is now imploding. Local government elections are going to be held later this year whether the PNC/R likes it or not. The PNC/R continues to make demands for a new voters’ list. It has made these demands because it is part of the discredited narrative as to why the Coalition lost the elections.ThePNC/R is boxing itself into a corner from which it will not be able to contest the elections. The Georgetown municipality has long been a bastion of the now Opposition PNC/R. The PPP/C will never win Georgetown. But what will happen is that smaller parties and groups are going to take advantage of the PNC/R’s likely absence from this year’s local government elections to seize control of the municipality, and that will be the end of PNC/R’s domination of city politics. Vice President Bharrat Jagdeo responds to a question during Friday's press conference filed that study with the Environmental Protection Agency (EPA) without addressing this risk. As such, former EPA Head, Dr. Vincent Adams had questioned, “How does it make sense that the highest hazardous risk is a leaking pipeline but it is not addressed in the EIA?” He was keen to note that this GLMP must also consider natural disasters which can potentially cause damage to the pipeline. “Are you looking at earthquakes below the ocean? Volcanoes, are you looking at mudslides below the ocean in terms of damaging the pipeline? You have to look at that and then you got to cater for that to say the pipeline may rupture so how are you going to address that? You have to say if you are going to monitor that remotely, so you have to address that in the EIA.” VP Jagdeo is however adamant that securing insurance for this project up front just does not fit into the sequence in which the steps should be taken. In fact, he told this newspaper: “It seems as though you just want a plan” and “you just have to find stories to write because it doesn't sound logical to me” since “if you don't build the house as yet how you gonna get insurance?”
He also pointed out that the objective is for Guyana to own the pipeline eventually and that the contractor's cost to put in the structure will be repaid by the citizens of Guyana through their monthly electricity bill. Given that the estimated US$1.3 billion expense will ultimately be on the backs of Guyanese, citizens have been questioning whether this investment will be safeguarded with a sound insurance policy. It must be noted too that seven years after oil was first discovered in Guyana, the country is yet to secure full liability coverage from the parent company, ExxonMobil, which is only ready to offer a US$2 billion guarantee if its subsidiary, Esso Exploration and Production Guyana Limited (EEPGL) fails to cover the costs associated with a spill. Gas leak impacts Though gas leaks, and worse yet, explosions or fires are all listed as likely 'unplanned events' that can take place, as a result of the pipeline, the oil company has completely glossed over how it would respond to such a disaster in its EIA. In an earlier article, this newspaper reported that gas releases from the planned GTE project can result in explosions which can pose grave risk to human and environmental health. In the EIA document, the developer explained that a loss of integrity of the offshore pipeline, resulting in a natural gas release can be caused due to corrosion, objects striking the pipeline, and a buildup of stress in the pipe wall, causing buckling. The EIA goes on to say that if an unplanned release of gas from damaged subsea pipelines occurs, the released gas will generate a gas plume that rises from the seafloor to the sea surface. Therefore, “Fire or explosion accidents can occur when the released gas disperses into the atmosphere and encounters ignition sources, which could have an adverse impact on human life and environment in the immediate vicinity of the fire.” Exxon's Consultant added that the consequences of a release would likely be less severe offshore as it “is extremely unlikely that there will be an ignition source to cause a fire, and the gas will passively disperse without affecting any resources” rather than an onshore occurrence. However, a release close to the Floating, Production, Sharing and Offloading (FPSO) vessel could result in a fire onboard the FPSO. Exxon said that to reduce the likelihood of a gas release, the offshore pipeline design and installation will vary depending on the pipeline depth.

The officer was later taken off the case and transferred to another location but the Crime Chief, Blanhum, had told Kaieteur News that it had nothing do with the media report.He had claimed that the rank was promoted and because of his ascension in the Force, he was transferred. Bascom, months later, in a Facebook live accused his bosses at CID of taking a bribe to cover-up 'Paper Shorts' murder. He'd identified himself as the officer who was threatened by the suspect and laterHetransferred.alsorevealed that when the Kaieteur News report surfaced, the Force had accused him of leaking information to the media which he denied and still continues to deny.However, it is the details that Bascom gave about the Fagundes' murder investigation to support his claims of an alleged cover-up that raisedBascomeyebrows.alleged that with the use of technology, investigators were able to place one of the suspects, Mark Richmond at the crime scene. Phone records, he had further alleged, show that the suspect was in contact with Mohamed during and after the time of the murder. When this information was handed over to his superiors, Bascom further claimed, they did not act on it. Blanhum has since confirmed that Richmond was listed as a suspect in the murder and that the senior ranks at CID were aware that he had allegedly threatened Bascom. Blanhum, had, however, denied that the Force was given or in possession of evidence implicating Mohamed or the suspect in the crime. He even denied that police have in their possession an equipment to provide that kind of Bascom,evidence.during the press conference on Friday, maintained what he had said and confidently related to the press that he has evidence to back up his allegations. More allegations were also brought to Kaieteur News' attention that detectives were tipped off by an informant about a suspected get-away driver in the hit but police never made any attempts to arrest the individual. Fagundes’ relatives stage protest at CID Headquarters - Called for police to arrest suspects
On Friday, relatives of Ricardo Fagundes better known as “Paper Shorts” protested in front of the Criminal Investigation Department (CID), calling for justice.Fagundes was gunned down on March 21, 2021 moments after stepping out of a popular bar on Main Street. Among those who prostested was Fagundes’ mother; she told reporters that she believes the recent claims made by Police Sergeant, Detective Dion Bascom about the suspects involved and wants police to arrest them. The protestors also protested against the alleged police corruption to cover up key evidence pertaining to the murder. claiming the de facto boundary did not exist, fired missiles over Taiwan itself, and challenged established norms by firing missiles into Japan’s exclusive economic zone. “I think we are in for a risky period of testing boundaries and finding out who can achieve escalatory dominance across the diplomatic, military and economic domains,” said David Chen, an analyst with CENTRA Technology, a U.S.based consulting firm. BACKGROUND
The legislation also preserves the right of Guyanese companies to bid clarifications. The law states that in all cases, responses to queries/feedback, updates and clarifications shall be communicated to all bidders in a bulletin at the same time.
