Withacurrentmanpower shortage at the Guyana Revenue Authority (GRA) hampering the audit of expenses by oil companies, the Shadow Minister of Natural Resources, David Patterson believes the Government of Guyana (GoG) is only adding more woodtothefirebyfailingto first plug the gap before increasingtheburdensofthe agency
Presently, Guyana is yet to complete the audit of oil major ExxonMobil’s expenses that were incurred during the period 1999 and 2017. Those bills amount to US$1 6 billion, which Guyana is expected to pay
Meanwhile, another review of the company’s expenses amountingtoUS$7.3billion isyettobecompleted. Those costs, according to Exxon, were incurred during the period 2018 and 2020
Notably, thetwoauditsmean that Guyana is yet to verify US$8 9 billion being claimedbythecompany
Inanexclusiveinterview withPattersonyesterday, the former Minister of Public Infrastructure noted that the revelationbytheGRAboss, Godfrey Statia is very “stressing” He explained that since the establishment of the Natural Resources
F u n d ( N R F ) t h e administrationindicatedthat
the GRA along with the Audit Office of Guyana would be scrutinizing the expenses of the oil companies, however both institutionslacktherequired staff to complete this fundamentaltask.
Noting the complaint that trained specialists are being snatched by the petroleum companies, Patterson underscored that the country remains grossly underprepared for the management and oversight of the new US-billion dollar sector In addition to the revenue agency being unprepared, the Opposition member flagged that the Environmental Protection
Agency(EPA)alsolacksthe technical staff it requires to regulatetheindustry, evenas the country presses ahead with the auction of 14 new oilblocks.
Patterson explained, “The Natural Resources Minister reported to the N a t u r a l R e s o u r c e Committeeabouttwoweeks ago, that the first audit is back with GRA for them to go through it. Now they are understaffed, theycan’teven get to that and every single day, every single second Exxon is racking up more expenses which they will claimiscostrecoverable.”

solution to the issue, the formerMinistersaidGuyana should now move to import the skills needed. He urged, “We can’t wait any longer for the agency to get up to speed. Things are moving too quickly, the country is losing too much money and Exxon is milking our unpreparedness.”
Further to that, he urged that government must continuouslytrainGuyanese sothatthecountrywouldbe able to effectively audit the oil companies operating offshore.
Hereasoned,“Ithinkwe haveatleast3,000graduates out of University every year in all disciplines. We should be selecting at least 10 of them and send them to do a Masters or some form of specialized training You c o u l d h a v e d o n e accountancy at U.G, you could have done any related subject and then you do the specialized training so this question of us not being prepared is a no longer a majorissue.”
Patterson pointed out that he moved an amendment to the Petroleum Act in the National Assembly to increase the funding for capacity building since he believes Guyana has the requisiterawmaterialstoget the job done This was ultimately defeated in Parliament, along with several other proposed changestothelegislation.

Patterson told Kaieteur Newsthatthecountryshould not move to entertain more oil companies through the auctionof14newoilblocks offshore until the human resourcegapisplugged.
According to him, “We should not even be heading to an auction in the absence of the required manpower we need to conduct these critical audits. We are so far behind in every area, we can’tgetExxonauditedafter they have been here since 1999 when they got their first license, and they can’t be audited now in 2023. For five years now we are producing oil and can’t get thecompanyaudited.”
Patterson argued that ExxonMobil is currently producing oil from two of the projects in the Stabroek Block, with a third likely to commence production before the end of the year Moreover, anapplicationfor Continuedonpage6

According toAttorney General,Anil Nandlall, the PPPC Government would love to bring about changes in the ExxonMobil contract, but it is handcuffed and severely limited from doing so. The argument of the government is that the stability clause stands as an impassable barrier against any changes to the 2016 contract that causes economic loss in any form to the company Therefore, no matter how much the PPPC Government is committed to doing better and getting more for Guyana, it just cannot, due tothepresenceofthisironcladstabilityclauseinthecontract.
This is breathtaking coming from a legal professional with the depth of the attorney general, Mr Nandlall. It is astonishing that this defeatist and resigned position is taken by the PPPC Government. We assert so because, more than most, he should know that skilled legal practitioners are always searching and probing for ways to get around and overcome provisions that seem unchallengeable, and conditions that look like they are insurmountable. What the learned attorney general would want Guyanese to believe todayisthatwhenthePPPCwasintheopposition, thegroup and its leaders (and lawyers) were all in the dark about this same stability clause. This was while the top people in the PPPhadpromisedtorenegotiatethecontract.Iftherearetwo things that separate resourceful and successful politicians and lawyers from the pack, it is that they figure out ways to conquer what stands in their way And second, this is when theoddsofdoingsolookmostunlikely
WhathasbecomecleareristhatthePPPCGovernmentis now full of excuses, and there is always the readymade pariah in theAPNU+AFC Coalition and the oil contract that wassignedduringitsterms. Indeed, thatisso, andweatthis publicationhavebeenneitherhesitantnorsympathetictothe previous government for its compete loss of judgment, and terrible failure, with that repulsive contract. The problem is thatconstantlylookingbackathowthethengovernmentsold out this country, and forever singing a ‘woe is Guyana’tune does not do anything that either confronts the contract fullon, or gives any indication of working around it in skillful ways to achieve better That is, introducing the kinds of approaches and practices that help ExxonMobil to see the light, andyieldsomeground.
When the PPPC Government, using Attorney General Nandlall as its warhorse, continues with its full-throated attacks on the crippling handiwork of the APNU+AFC Coalition, there is no benefit for Guyana, other than the scoring of cheap political points. The licking is deserving, butGuyanesestillremaintrappedundertheyokeofthe2016 contract. None is served, nothing is gained. Further, when attorneygeneralNandlallspeaksof“bornagainchampions” fortransparencyandaccountability, thenitisobviousthathis government is comfortable with the same secrecies that bedeviledtheformergovernmentwiththesigningbonusand concealingofthecontract. Bytheeruditeattorneygeneral’s reasoning, it would appear thatAPNU+AFC secrecies in the early stages of the contract’s existence, now justifies secreciesthatproliferateunderthePPPCGovernment.
When the government and its leading spokespeople find it more advantageous to degrade Guyanese messengers pushing for better in an amended contract, then only ExxonMobil and its partners continue to benefit. One would think that the PPPC Government would lead the way out of this longstanding crab barrel mentality of pulling down locals, while foreigners tear the flesh from their backs. The PPPC as a political group, and as a government, has never been lacking in resilience and adaptability. But here it is today pretending to be paralyzingly harnessed to the 2016 contract, thankstotheAPNU+AFC.
When the PPPC Government has had opportunities to proceed with ‘all deliberate speed’with its approval of new projects, it has raced forward like a reckless, drugged-up teenager by doing the opposite. When government had openings to use the bureaucracy and manifest savvy

Attorney General, Anil Nandlall, SC in an applicationtotheHighCourt described the citizens c h a l l e n g i n g t h e Environmental Permit, granted to Esso Exploration and Production Guyana Limited (EEPGL), as obstructionists.
The matter was filed by ElizabethHughesandVanda Radzik on March 27, 2023 through their Lawyers, Melinda Janki, Abiola Wong-Inniss,andJoelRoss.
RadzikandHughesinan Affidavit to the Court dated July28,2023,urgedthatthe statement be struck out by theAG.Furthertothat, they said he should apologize, since as citizens of Guyana, they were acting in the publicinterest.
The citizens said, “The Deponent’s description of me and my co-applicant as ‘obstructionists’ is u n a c c e p t a b l e I t demonstrates that the Deponent believes that he candowhateverhelikesand thatheisafrolicofhisown, unrestrainedbycompetence, or by any understanding of his professional duties as a publicservant.”
In the AG’s application filed in the High Court on July 14, 2023, Head of the GTE project, Winston Brassington gave a sworn statement indicating that the oil company was granted permission by the Government of Guyana to undertake works associated with the project, geared at lowering the cost of
electricity
Brassington told the HighCourtthattodate, there has been no complaint by any of the land owners that their lands were entered upon without proof of ownership, lease or other agreement between them and EEPGL- ExxonMobil Guyana-oranyotherperson and/orentityassociatedwith theproject.
Tothisend, hesaid,“Iam advised by my Attorneys-atLaw and verily believe that the Applicants are not land owners or occupiers or possessors of any legal or equitableinterestwhatsoever inrespectofanyofthelands

The citizens also refuted this claim, that no land owner has complained regarding entry on their private lands, and drew the Court’s attention to an ongoing dispute between Stuart Hughes (land owner) and the Attorney General. That matter was filed since February6,2023.
The applicant in that matter is seeking among other things, for the Order made under the Acquisition ofLandsforPublicPurposes Act to be declared null and voidandofnolegaleffectas itrelatestohisproperty
To this end, Radzik and
Hughes told the Court that the statement submitted by theAGwas“disingenuous”.
They reasoned, “They deponentknows, oroughtto know, if he is indeed properly coordinating, overseeing and managing the Gas to Energy Project andalsorepresentingtheAG that the acquisition of land by the Government is the subject of ongoing litigation.”
The citizens believe that theAGbreachedhis‘dutyof candour’ to the Court by failing to disclose the ongoing legal dispute over theacquisitionoflands.
HughesandRadzikhave approached the Court seekinganordertoquashthe Permit granted for the pipeline component of the project.Theyarguedthatthe Environmental Protection Agency (EPA) approved the

The National Assembly last week approved $2.1 Billion to construct the Wismar Bridge- a projectthegovernmenthadtakena US$35M Saudi Arabia loan under the same project title. The project falls under the Ministry of Public Works.
During last week’s debate, before the $61 Billion supplementary budget was approvedbytheHouse, theWismar project faced scrutiny from OppositionMemberofParliament, Annette Ferguson, as she correctly recalledaloanwassignedunderthe saidprojectname.
The project was presented to the House by Minister of Public Works, Juan Edghill, under the name, “Provision of additional resources to facilitate the constructionoftheWismarBridge” forthesumof$2,104,546,800.
This prompted the Opposition MP to question the reason behind the Government seeking supplementary funds for a project thataloanwassignedfor

The minister’s response raised

President of the Co-operative RepublicofGuyana,Dr Mohamed IrfanAli, Senior Finance Minister, Dr Ashni K. “Earlier when we were considering the supplemental for theMinistryofPublicWorks, under the Wismar Bridge, the question I asked was whether there was fundingfromanyforeigncompany and the Minister was unsure, so I have the information before me here…My question is to clarify whethertheWismarBridgewillbe funded by the Saudi Loan, what

In response, Minister of Finance,Dr AshniSinghexplained that at the time the MP made the querym he was attending to state matters.
He continued, “There is no great mystery surrounding this matter The honorable member correctly recalled loan agreements totalling US$150M with Saudi Fund was signed and the agreements were tabled, and the language in and surrounding the financing agreement did make mention to both housing developments and the Wismar bridge, allofitisfactuallycorrect. Spearheaded by Aliyah Abel, ‘Safe Haven’ will act as a digital directory for persons in search of reliable caregivers for their elderly or young loved ones.
Abel said that the online platform is set to revolutionize the dynamics of care giving in Guyana.
She noted that ‘Safe Haven’ was inspired by a personal journey of navigating challenges while caring for her father who was battling cancer. Witnessing the shared struggles of others, the founder envisioned a platform that extends support to families in similar situations.
As such, she said ‘Safe Haven’s’ mission is clear: it is to curate a nurturing community of trust, centered on caregivers who are not just professionals, but empathic. At present, the website boasts a roster of professionally trained caregivers who possess certifications set by leading industry standards, reflective of their uncompromising commitment to excellence.
Abel noted that beyond skills, ‘Safe Haven’ caregivers are chosen for their genuine passion to make a positive impact on the lives they touch. Navigating the user-friendly website and app allows families to access caregivers tailored to their unique needs.
She said “Transparent caregiver profiles, showcasing qualifications and experiences, empower families to make informed choices. Reviews from past clients stand as endorsements of the exceptional care giving experience provided by ‘Safe Haven’.”
According to Abel, security is also paramount.
“So at ‘Safe Haven’, stringent background checks,
interviews, and references are conducted. Transparent communication channels create a seamless rapport between caregivers and families, fostering a safe and nurturing environment,” She said.
‘Safe Haven’ extends beyond a mere transactional platform. Its vision encompasses community and belonging among caregivers and families. Online forums, support groups, and local events forge a realm where care giving is a heartfelt commitment, transforming care into a shared experience. According to the founder, the launch of ‘Safe Haven’ marks a significant milestone in care giving in Guyana.
“It is a testament of the important of empathy, compassion, and innovation, in addressing society’s critical needs. Whether for elderly family members facing health challenges or children in need of safe and reliable care, Safe Haven invites everyone to benefit from our services as we create a world where no one has to navigate the challenges of care giving alone,” she said.
For further details, contact 609-3289, visit safehavengy.com, or download the ‘Safe Haven’ app from your preferred app store.

Significantly, restorative justice allows for community leaders, religious leaders, and teachers, to play a central role in resolving issues.

He also clarified that the restorative justice concept is not open to all criminal offences but a few minor, petty offences which can be dealt with at a community level and allow for direct rehabilitative intervention. In this regard, offences such as murder, manslaughter, rape, robbery, sexual offences, offences involving minors, and other violent offences are exempted the restorative justice. Nandlall stressed that the concept of restorative justice allows for justice to be served in a way that promotes healing and accountability, while also reducing recidivism and keeping individuals out of prison who may not need to be there. He stressed that the approach can only work through support from members of the community and solicited their assistance to see the success of the programme.
The Attorney General promised the residents of Region Five that this is only the first of many engagements and that the Director of Restorative Justice, Seelall Persaud will return with a training programme to train suitable
Meanwhile, Director of Restorative Justice and former Commissioner of Police, Persaud, explained that currently he is executing a pilot project involving several communities on the East Coast of Demerara.
He said once that pilot is successfully completed the system will be replicated across the administrative regions of the country.
With the enactment of the Restorative Justice Act in November, 2022 a Restorative Justice Centre was established in April, 2023 which is staffed by trained professionals who will work with victims, offenders, and their communities to develop individualized plans that focus on repairing the harm caused by criminal behaviour and preventing further offences.
According to the AG, teachers, community leaders, Toshaos and religious leaders have already benefited from this training. The training exercise will continue across Guyana. A similar outreach exercise is scheduled to be held in Region Six (East BerbiceCorentyne) before the end of August.
