Creating competitiveness will - Business not be an overnight affair Minister By: Kiana Wilburg This time around, the concerns of those in the local manufacturing sector will not fall by the wayside.

This assurance was recently given by the M inis ter of Bus ines s , Dominic Gaskin.

In an interview with this newspaper, Gaskin shared his thoughts on Government’s policy and plans for the sector as well as his take on the current state of affairs of

the manufacturing in Guyana.

The Business Minister admitted that while Government has not formulated a comprehensive plan, there are a number of initiatives in the pipeline that will ultimately improve the ease of doing business in Guyana, as well as support the development of the local manufacturing sector.

The politician sought to emphasize, however, that it is the former administration which failed miserably to

s t i m u l a t e G u y a n a ’s manufacturing sector. With this in mind, he stressed that creating a competitive manufacturing sector would not be an overnight affair.

To make Guyana more b u s i n e s s - f r i e n d l y, t h e Ministry of Business is currently engaging various State agencies with a view to reducing bureaucratic red tape and making official procedures easier to navigate.

It is currently seeking financing to implement the

Single Window Automated Processing System ( S WA P S ) . W h e n established, the SWAPS will link licencing bodies along with the Customs and Trade Administration to facilitate the sharing of information and to enhance the efficiency with which trade transactions are carried out.

These improved procedures will not only reduce the amount of time that private businesses spend mired in paperwork, but also

increase government a c c o u n t a b i l i t y, r e d u c e corruption, and make data and information more accessible.

The Ministry of Business has already established a Help Desk for businesses, which acts as a single point of contact for information and advice for businesses, traders, and the Government.

Furthermore, while consumers and large businesses can access loans, Gaskin said that the Government is very much aware that small businesses commonly face a financing gap. He emphasized that this is being addressed by the Government through the implementation of the Micro and Small Enterprise Development (MSED) initiative which will be implemented by the Small Business Bureau of the Ministry of Business.

To build both generic and sector specific skills, the Business Minister said that training opportunities for small businesses will be expanded to cover all 10 administrative regions. The politician said that this year, 400 individuals are targeted to benefit from training.

He noted, too, that a newly appointed Small Business Council chaired by Commonwealth Woman Entrepreneur of the Year (2015) awardee, Ms. Valrie Grant, is now in place and tasked with significantly improving the work and expanding the reach of the Small Business Bureau over the next few years.

As such, it is expected that GO-Invest would work towards improving agency websites and develop partnerships with other investment promotion agencies worldwide.

Gaskin said that GOInvest is now overseen by a competent Board of Directors and headed by a competent and energetic new Chief Executive Officer. He said that the Ministry of Business’ Strategic Plan calls for the development of a national export strategy and the design of a sustainable national investment strategy.

The Business Minister said, too, that GO-Invest will play a key role in the implementation of these initiatives. He explained that the national export strategy will also be supported by enhanced quality infrastructure made possible by the upgrading of the national laboratory network to allow for testing and (Continued on page 3)

Magistrate adjourns matter without allowing witness to sign deposition

elatives of m u r d e r e d businessman, Shameer Ali Mursalin are raising concerns about the conduct of a Magistrate presiding over a matter, for which three men are charged for his murder.

Mursalin, called ‘Kazac,’ a trader, of Grant 1805 Weld Tank D am, Crabw ood Creek, Berbice Corentyne, in Region Six (East BerbiceCorentyne), was fatally shot to the head following a longstanding dispute with a fellow businessman, on October 24, 2015.

According to reports, police were investigating a report of threatening language and damage to property at Mursalin’s house. After calling out for him for some time without any response, the police officers ventured into the yard and found the victim’s body lying in a pool of blood at the residence.

Berbice businessman Dennis Veerasammy and two of his employees, Basheer Harrinauth and Delroy Fraser, were later arrested and charged with the murder.

The three men are facing a Preliminary trial before Magistrate Rabindranauth Singh at the Springlands Magistrates’ Court in Berbice.

However, relatives of the dead businessman believe that there is a deliberate ploy, by parties involved, to sabotage the case.

According to the relatives, the Preliminary Inquiry (PI) into the matter had been postponed on

several occasions, despite the availability of several witnesses.

In addition to questionable adjournments, the Mursalin family said that at the last hearing, the Magistrate did something that is even more baffling; he adjourned the matter without re-reading the evidence and allowing the main witness of the trial to review and sign his deposition.

“I am really concerned.

First, he write down the evidence on four pieces of paper that look like scrap and then he ain’t give the man it to sign. All he (the magistrate) said is that he adjourn the matter because he hungry,” a female relative explained.

“He ain’t care. He just come off the chair just so in front the police and the other court staff. I ain’t really know that that could happen.

I never see any Magistrate adjourn a case without allowing the witness to see or sign what dem said (the deposition)…And this is the man that actually witnessed the shooting,” she added.

She stressed that the matter has suffered the several postponements without any proper explanation. “The prosecutor would come to court and call the witnesses but the matter would get put down just so, “the woman claimed.

All we need is justice for our family. The family is hoping the relevant authorities will take notice and intervene on their behalf.

A senior court official told Kaieteur News this is not the first time that the Magistrate has not allowed witnesses to sign their depositions.

“It is the proper legal procedure for witnesses to certify their testimonies. A breach of this procedure can definitely have a negative impact on the case.”

In addition, a number of legal practitioners and retired judicial officers said that the Magistrate’s actions are indeed questionable and should be brought to the attention of the Judicial Service Commission (JSC).

The JSC, headed by Chancellor of the Judiciary, Justice Carl Singh, is responsible for appointment of Judges and Magistrates.

The Chancellor could not be reached for a comment on this matter.

In his most recent comment on the conduct of judicial officers, Justice Singh noted that allowing Magistrates who conduct themselves inappropriately to remain on the bench will be a serious indictment on the part of the judicial administration. He added that this act would mean that the judiciary has abandoned the people and public’s i n t e r e s t . “ We h a v e a responsibility to produce an environment which is

conducive for hard work.

Magistrates in Guyana are servants of the people. It is important that Magistrates and Judges give of their best, so when we find that Magistrates are involved in grave wrongdoing, then we will have to protect the public’s interest,” the Chancellor said.

Adumbration on the three branches of government A FAILED SYSTEM EDITORIAL

The Commission of Inquiry into the fire that took the lives of Joshua and Anthony George on July 6, last, at the Drop-In Centre on Hadfield Street has spoken and the Ministry of Social Protection has duly acknowledged full responsibility for the tragedy. The COI found that there were systemic failures at all levels and that it was an accident waiting to happen because the system that was in place to protect the children was inadequate and poorly managed.

The report highlighted the overcrowding at the Centre, inadequate and poorly trained staff, outdated fire prevention systems, and the lack of adherence to fire regulations.

The report stated that the remaining 29 children and the two staff at the Centre did not sustain any physical injuries, but some of the older girls are still traumatized as a result of the tragedy. It said that they blamed themselves for the deaths of the two boys and are often having flashbacks and are not sleeping well at nights.

However, using the children/staffer ratio, the COI affirmed that a minimum of six social service assistants should have been on duty that night, and not two, to adequately meet the needs of the 31 children.

It found that while there were adequate written guidelines for the management of crisis situations including fire, the two staffers on duty were not familiar with them.

It revealed that the staff was unqualified, untrained and inexperienced for the responsibility given to them.

Simply put, the Drop-in Centre was not safe; it had a series of problems. It was dirty and was inundated with roaches, which means that the children who ranged from 17 years to one and a half years were in so many ways in danger.

The tragedy should serve as a reminder to the Ministry, particularly the Child Care and Protection Agency (CCPA), that its efforts to protect children must be paralleled by a mature sense of caring for them.

As the parents continue to mourn the loss of their two sons, it is disturbing that there has been no apology from the authorities.

In light of the COI report which points to complete failures at all levels, the President should demand resignations from those at whom the buck stops. If he does not, the people will once again blast the government for its shortcomings.

They are worried that the President is once again being forced to defend the indefensible.

As a people, we must protect children because those in authority seem incapable to care for them. The Ministry of Social Protection had enough time to improve this and other Drop-in Centres that house vulnerable children, but nothing was done.

It is true that the two young boys and their siblings were suffering from neglect, and while it is an obvious case of indigent parenting, the Ministry has dropped the ball and is ultimately culpable for their demise.

The government must accept the recommendations of the COI and create a system to ensure that children who are the most vulnerable in society are not abused, and that they must have access to the basic necessities including food, shelter and proper healthcare. And crucially, they must also have equal access to education, irrespective of their status.

There is a lot of talk by those in authority about children being our future, but there is a lack of action to make it real.

The time has come for them to put aside their egos, humble themselves, and seek advice from experts in order to provide the best care for children.

It took the lives of Antonio and Joshua George for the authorities to come to their senses, but their deaths must not be in vain.

Dear Editor; I am responding to the following articles “Presidential powers granted to Lands Commissioner ridiculous – Opposition” and the article entitled “AG wants powers reduced after Deputy Registrar appointment” which were published in the Kaieteur Newspaper dated Tuesday, the 16th day of August, 2016. I penned this letter for the edification of the writers and the public in general on the following topics: (1) Delegation of powers from the Executive Arm of Government (the Cabinet) to administrative bodies or authorities and (2) Politics, the Law and Separation of the powers of the Judiciary and Executive Arm of government.

(1) Delegation of powers from the Executive Arm of Government (the

Cabinet) to administrative bodies and/or authorities. It is generally in accord with common sense and in the interest of the proper functioning of governmental bodies that in a democratic society government may choose to delegate certain functions to governmental bodies and/or authorities.

Article 65 of the Constitution of Guyana provides that “parliament may make laws for the peace, order and good government of Guyana.” Therefore, by virtue of this constitutional power the Legislature is empowered to make laws for the proper governance of the country. As a point of possible contention or by a stretch of imagination even in the absence of a written Article 65, the common law based on its appeals to such principles as are just and reasonable, common

sense and justice would have demanded the Legislative arm of government make laws which are necessary for good governance of the country. Political Science and Constitutional Law embraces the unfettered rule of governmental science that there are generally three arms of government; namely the Executive, Legislative and Judiciary. In a democratic society which adheres to the rule of law clear separation of the powers and functions of three different arms of government must be manifestly practiced and evident in the performance of the different governmental arms’ functions.

In a truly democratic society there must be a clear demarcation of the powers generally vested in the different arms of government and no arm of government (Continued on page 6)

Govt. assisting law students going to Trinidad Dear Editor, As a working class law student who has just completed my three years at the University of Guyana, Law Department, I cannot allow the recent achievement of Minister of Legal Affairs/ Attorney General Hon. Basil Williams to go unheralded.

I refer to his recent successful parliamentary motion which resulted in the allocation of $17.9M (approx.) to assist us who are proceeding to the Hugh

Wooding Law School, St. Augustine Campus, U.W.I. It is a tremendously challenging prospect for more “ordinary’ working –class students who must pay the full cost of tuition at Hugh Wooding in Trinidad and Tobago, for apart from the steep fees per year there are also the costs associated with boarding and lodging and other associated expenses.

A p a s t administration had ceased assisting Guyanese law students bound for Trinidad with any portion of their overall economic costs. So

kudos to our AttorneyGeneral and the Granger administration for their kind gesture of resumed assistance. Perhaps it is not merely resumed ‘’kindness” but an acute appreciation that the national development about to unfold in Guyana will attract the services of varied legal practitioners who will be necessary to give guidance over a wide array of disciplines.

The assistance is therefore an investment in the future, in terms of the legal expertise to be necessary within the context and framework of our

national socio-economic thrust.

So, even as I, at my own personal level, have to pursue even additional support, I thank on my own behalf and I daresay all my colleagues-students will concur – Attorney General Basil Williams for his thoughtful, constructive initiative.

As one of the twenty-five students about to proceed to Hugh Wooding within weeks, I cannot afford to let him and Guyana down.

I cannot give the Town Clerk a pass grade in any area DEAR EDITOR, I f I w e r e a teacher marking the performance of t h e To w n C l e r k o f Georgetown over the last year since he was appointed I would have to give him a big fat ‘F’ for Failure.

N o w l e t u s look at his report card: First off, let us look at his pattern of payments to contractors, how could the city seriously rack up a debt of $250 million dollars to garbage contractors and then only pay them 1.2 million each?

This is his first F. Wi t h r e g a r d to the Occupational Health and Safety record that his workers are subjected to, it is

a miserable failure. If we look at the Solid Waste Department and the findings by the Ministry of Labour, the abattoir and the method of slaughtering and the conditions that their storekeeper have to work under - an F. With regard to complete lack of democracy within the Council; the prevention of a Councillor from submitting a motion demanding a forensic audit, and his refusal to let all Councillors have a copy of the crooked parking meter contract - an F. W i t h r e g a r d to a promise he made to provide special housing projects to the various categories of

workers and which he failed to do - an F. A s i t r e l a tes to getting the Stabroek Market clock working again, especially for the Jubilee month of May when most of the visitors were here- an F. As it relates to his treatment of the small business persons in the City known as vendors, who are without a permanent place to ply their trade- an F. A s i t r e l a t es to his brutish demolition of the ‘Dread Shop’ with no compensation or remorse, he deserves an F. His constant late payment of municipal workers is sickening and certainly deserves an F. H i s l a c k o f attention to the continued deterioration of the City Hall building, where his office is

located and where the Councillors meet and debate, is just reckless and deserves an F. T h e b l o a t i n g of the Council’s payroll with friends and family of senior officers and some Councillors under his watch, an extreme act of nepotism also merits an F .

H i s f a i l u r e to present the 2016 City budget to the citizenry even though we are already eight months into the year is financial malfeasance and warrants an F. And those are just a few of his colossal failures since he was handpicked and catapulted into office and which proves Peter’s principle of one being promoted beyond one’s competence.

These out of court settlements by Govt. must be questioned Dear Editor; There is no other Govt. in the Commonwealth that has settled more cases and paid out more public funds, as a consequence thereof, over a sixteen month period than the coalition Government. In this regard, the Administration has demonstrated such an incomparable proclivity and haste to dole out public funds and write off debts owed to the State, that it puts a strain on the rational mind not to conclude that either incompetence overwhelms or,

that there is a corrupt motive, or both. In this piece, I will examine three (3) of such cases to demonstrate my point.

1. The Demerara Distillers Limited (DDL) case.

This case involved a legal challenge launched in the High Court by DDL in 2002, to the Commissioner General’s of the Guyana Revenue Authority, assessment of consumption taxes owed by that company in a sum exceeding $1 billion, for the period January 2001-

September 2002. This assessment by the Commissioner-General was eventually quashed by the High Court on the 1st of February, 2005. GRA appealed that decision to the Court of Appeal.

On the 31st of July, 2008, the Court of Appeal dismissed this appeal on the ground that the Commissioner-General had used a wrong formula for the calculation of the consumption taxes. The Court prescribed a formula to be used. In 2009, the Commissioner-General,

Guyanese need to support the SARA Bill Dear Editor; This is the conclusion of a letter we carried in yesterday’s edition.

In addressing the GHRA’s concern about the SARA, Bill being too narrow, SARU’s current Mission “is to aggressively and legally pursue corruption; the theft of State Assets and to ensure future transparency in the use of Government and Public assets” SARU’s goals as such, are to (1) recover stolen assets within and outside of Guyana; (2) the Prevention of corruption and the misuse of Public assets; and (3) to work for strengthened Regulatory Frameworks at all levels to further increase the Transparency and Accountability of Financial Institutions, the Corporate Sector, and Public Administrations”. Hence, the SARA Bill is part of a broader Government architecture to prevent corruption and to recover stolen assets which no Guyanese has a constitutional right to own.

The question of “narrowness” has to be viewed in the above context and one in which Civil Society including the GRHA has a role to play as stated in Article 13 of UNCAC as referenced by GHRA in its Press Release.

This position is recognized in clauses 6(1)(g) and 11(2) of the Bill which respectively provides for the Director to “raise public awareness on the dangers of corruption and

enlist public support in combating corruption” … and to engage in “appropriate consultations with any local or national civil society organisations.”

The GHRA also knows this SARA Bill has had wide international scrutiny, analysis and approval in its development. This is why the civil recovery route has been taken as an alternative but complementary to criminal recovery. The second major point raised by the GHRA was defined by their statement “the sweeping powers available to the Director of the Agency and the manner of his/her appointment.”

With respect to the powers, the following private and state institutions are only a selection of those which must comply with any request from the Director of SARA for information they hold: the Commissioner of Police, the DPP, Head of CANU, the Bank of Guyana, private banks, and the Chairperson of the Gold Board. Rather than the established procedure whereby other agencies provide the Guyana Revenue Authority with information on which it can act, the new Bill requires the opposite: the GRA must provide information on which the SARA will act”.

GHRA is worried about these powers even though GHRA would acknowledge, given their own knowledge of corruption (gold smuggling, stolen government vehicles and properties; land giveaways (Pradoville 2); state contracts; the G$18b

recently found in accounts of a Permanent Secretary) that lawfully obtained information is needed to recover stolen state assets.

Of course, the GHRA has not written a Press Release on the powers of the DPP. Nor has it suggested the DPP should be governed by a Board as is their wish for SARA. Over the years, the Guyana press has carried articles suggesting Guyana loses G$330 B per year in stolen state assets. SARU’s current analysis indicates the amount may be more than that.

In closing, Guyanese need to support this Bill because it creates an Agency with the objective of getting back from any person, state property which he or she unlawfully obtained and to which he or she has no legal right. To suggest that it is a Bill for political partisan or ethnic fights is not only wrong but reckless.

I hope the GHRA will create a press release calling on the DPP to recuse herself from the Pradoville 2 affair and to urge criminal charges be preferred against those who allegedly stole state assets for their benefit, as was the case in Belize where criminal charges were approved by the Caribbean Court of Justice.

utilizing the Court recommended formula, assessed DDL’s consumption tax liabilities for the period 2001-2007 (since after 2007 Consumption Tax was abolished with the introduction of VAT). The newly assessed liability of DDL for that period was in excess of five billion dollars.

Again, DDL filed legal proceedings challenging this assessment. GRA retained external Senior Counsel and was steadfastly defending this challenge when this Govt. took office. Instead of continuing to defend GRA’s assessment done in accordance with the Court of Appeal’s formula, this Administration settled these proceedings, for the paltry sum $1.5 billion and gave DDL more than a year to pay.

So, after fifteen (15) years of

litigation, with DDL having the use of several billion dollars of State funds, interest free, this Govt. settles for $1.5b. The Opposition Leader, an expert in the financial field, pegged the loss to the treasury by this settlement, at approximately $20 billion. The reasons publicly proffered by the Minister of Finance for this settlement are equally preposterous. Among the reasons he advanced, is that the company’s tax liability to the State declined with the passage of time! Up until that time, like me, most people thought that debts increase with the accrual of interest, with the passage of time.

A significant consequence of this settlement is that Banks DIH Ltd, who in like circumstances, paid billions of dollars in consumption

taxes, assessed by the Commissioner-General, utilizing the same method used to calculate DDL’s Consumption Tax liabilities, has signaled an intention to claim a refund of consumption taxes paid. Banks paid far more consumption tax than DDL as their production line is larger. Therefore, the refund that will be sought will be several times the $5 billion for which DDL was assessed. To sum it all up, the settlement of this one case is likely to cost the taxpayers over $50 billion.

2. Haags Bosch/BK International settlement A ten year contract in excess of US$10m signed between BK International and Puran Brothers (a joint venture), with the Govt. of Guyana in 2009, for the (Continued on page 6)

GuySuCo Wants GAWU to Become More Serious Dear Editor; The Guyana Sugar Corporation Inc. (GuySuCo) wishes to respond to a letter that was published in the Stabroek News on 19 August, 2016 under the caption “GAWU sent more than 12 letters to GuySuCo for which no acknowledgement has been received”.

Editor, GuySuCo has over 17,000 employees on its payroll and approximately 80,000 Guyanese who are depending on the Corporation to be productive.

During the out –of-crop season our staff on the Estates would tell you, that the residents and business people in communities around the Estates were all enquiring when the second crop will start. When smoke is coming through the chimneys of the estates, those communities are vibrant and boisterous, they are blooming.

About two weeks ago the

second crop started and GuySuCo is prepared to manage a responsible business to the benefit of all its stakeholders and therefore finds it unproductive to continue to play the games which the Guyana Agriculture and General Workers Union (GAWU) has become so accustomed to playing. If GuySuCo is not productive and cannot pay the same employees that GAWU is encouraging to strike left, right and center, the Union will confront the Corporation with another issue which will be nonpayment of employees.

With reference to the letter

by Mr. Narine, the Corporation categorically states that it is in receipt of only two letters from GAWU in regards to the ongoing strike at East Demerara Estate (EDE) and not twelve as published, therefore GAWU is blatantly giving information that is not true. The letters

from GAWU are dated August 15 and 17, 2016 and the Corporation’s responses are dated August 16 and 17, 2016 (please see letters attached). In the Union’s first letter which stated that a meeting was held on 4 August, 2016 in our response we clarified that “no meeting was held on August 4, 2016 at the Corporation’s Ogle Office” as was being claimed.

In the letter to the Union dated 16 August, 2016, the Corporation stated “contrary to your Union’s statement to the media, this was the only correspondence received by the Corporation since the commencement of the strike at EDE”. Further, in the said letter the Corporation implored upon the Union to advise its member to resume duty since this will pave the way for further discussions between GuySuCo and GAWU in keeping with industrial relations (Continued on page 6)

Serious complaints against the National Insurance Scheme Dear Editor; Please allow me the opportunity to publicly pronounce on the substandard service offered by the National Insurance Scheme, the most dysfunctional state entity in Guyana. Over the years the NIS has been short changing or disenfranchising contributors with respect to their pension, due primarily to

the Scheme’s own internal inefficiency and dereliction of responsibility. It is public knowledge that the Inspectorate Department at the head office is acutely slothful, lethargic and comatose.

The Scheme has abandoned its responsibility to monitor employers to ensure that employees’ deductions are remitted for

timely updating of the employee’s records. This failure causes some employees/contri b u t o r s having to shuttle between their employers and the National Insurance Scheme to verify information about remittance of deductions/ contributions.

Some employers/firms have “come” and “gone” without remitting their employees’

The very constitution which gives the Executive power to make laws for good government and which he undeniably did by passing the Order giving the Lands Commissioner power ‘to exercise on behalf of the President the functions relating to the sanctioning of renting and granting of leases, licences and permission of occupancy of all Public Lands….’ provides for the Separation of powers doctrine and would sanction against any attempt of unconstitutional law making by the Legislature/Political Officials.

Further, it is undoubtedly clear that the President is constitutionally authorised to grant such powers as he did when he made the Order.

Therefore, it is reasonable, just and in accord with common sense to conclude that it is not unconstitutional, null and void and of no effect to grant to the Lands Commissioner the functions which

were usually perform by cabinet.

This is for the very fact that it does not negate the Separation of Powers of doctrine. By vesting the powers in the Land Commissioner who is undeniably neither a member of the judiciary nor the legislature the separation of powers doctrine remains unaffected by the Order of the Legislature/Legislative arm of government. The functions being performed by a ministerial/governmental official still remain an executive/cabinet function and will continue to be performed by the Executive arm of government. Furthermore, the Order must have been made by the President and Cabinet adopting the correct process and its legislative functions (Articles 164,165 and 170 of the Constitution of Guyana). In the absence of so doing this might be a possible and reasonable ground for contention. In conclusion, I would like to think that the constitution brilliantly recognised since time immemorial that the Ex-

ecutive arm of government or the cabinet will have much more pressing issues to attend to and would need to clear its schedule of functions which can be reasonably, just and based on common sense be performed by other governmental bodies or authorities.

(2) Politics, the Law and Separation of the powers of the Judiciary and Executive Arm of Government.

It has been indicated in the numbered one topic above the law of Politics and Constitutional Law recognize and follows the unfettered doctrine of governmental science, that there are three main arms of government and these are the Executive, Legislative and Judiciary. The Separation of Powers doctrine requires that there be no usurpation of the functions performs by the different arms of government. This is necessary to ensure that there is a clear system of check and balances between and/or among the different arms and to ensure that citizens enjoy the benefit of the rule of law and to protect the rights, fundamental human rights and other rights of individuals. It is fundamental to the moral fabric of any society that there is an independent Judiciary. Judicial Powers should not be performed by any other arm of government. In the Kaieteur News article it is indicated that the AG is of the opinion that the Deeds Registry and Commercial Registry falls under the Executive arm of government.

Unfortunately some have died without realizing the conclusion or determination of their appeals. The records can prove me correct. Why such callousness and sloppiness?

Several contributors have been fleeced of sums of money collected by a senior security personnel to update their contribution records. What action has the NIS taken in those matters? What is the status of those people’s claims? All is not well in the NIS. It is time for a shakeup, re-organisation and refocus of mission/vision.

The public relations gimmick on television. “ NIS and You” should be urgently reviewed. The program should be taken to communities countrywide as face to face outreach.

The problems faced by contributors to the Scheme will be better appreciated in terms of magnitude. There is a pressing need for an urgent enquiry into the operations and performance of the NIS. It is not serving the best interest of contributors, especially the poor and powerless.

From page 5 construction and management of a garbage disposal site at Haags Bosch. From on or about 2013, the Gov’t began to complain to the contractor about sub-standard works being done under the contract. Notices and letters were sent identifying these defects and calling for their rectification. Several meetings were held, chaired by the President, to persuade the contractor to correct the breaches. All efforts proved futile. In 2015, the international funding agency of the project gave the Govt. an ultimatum to terminate the contract. As a result of several fundamental breaches of the contract, the PPPC Administration made a decision to terminate the contract, remove the contractor from the site and to sue for compensation for breach.

A termination notice was issued in February 2015, terminating the contract. In March 2015, BK launched legal proceedings in which a number of prerogative writs were sought, quashing the termination notice and

prohibiting the Govt. from removing the contractor from the site.

Upon the change of Government, the coalition Government made great hue and cry in the press about the state of the dump site.

Ministers Patterson and Bulkan led teams of public officials on site visits. For days, they publicly lambaste the sloppy and substandard works done at the site. They publicly criticized the contractor for negligent works.

Minister Bulkan and Mr. Brian Tiwarie had exchanges in the press. In November 2015, the Court quashed the termination notice and restrained the Govt. from ejecting the contractor from the site. The Attorney-General appealed. One must assume that he had good grounds to do so. In my view, he did. The Court erred in using public law principles to determine a private law contractual dispute.

Boyfriend gets life sentence for killing teen Twenty-four year-old Shieldstown, West Bank Berbice resident Shazam Khalil, the man who was on trial for the January 2015 murder of his girlfriend, has been sentenced to life imprisonment.

Khalil stood before Justice Jo Ann Barlow and a Mixed Jury in the Berbice High Court. He was found guilty of murdering Shazina Mohamed, 19, of Edinburgh Housing Scheme East Bank Berbice.

The woman was brutally stabbed about her body around 19:00 hrs on Saturday January 17, 2015 outside the Yang Yi Chinese Restaurant in Rosignol, West Bank Berbice.

Khalil was given the sentence following a probation report which was read by Probation and Social Service Officer Adessia Semple.

Attorney at law Stacy Goodings had told the court that the woman was ambushed and stabbed by the accused who then fled the scene.

Mohamed was picked up and rushed to the Fort Wellington Hospital from where she was subsequently transferred to the New Amsterdam Hospital where she succumbed.

The attorney had related that Mohamed was at the restaurant with two friends when the incident occurred.

She had journeyed to Rosignol to collect a phone and decided to go to the Restaurant with her friends to eat some food when she was attacked by the suspect.

During the trial, the prosecution had called a number of witnesses, including their two main witnesses who were on the scene when the incident occurred.

Vishwa Sukhdeo had stated that he and the now dead woman had shared a casual relationship. He had

bought food for his sister who was in the restaurant eating, while he and Mohamed were outside talking. He had just left Mohamed and gone to his sister when he heard Mohamed scream. Upon looking around he saw Khalil hugging Mohamed and apparently cuffing her. He shouted at the man who looked at him before releasing Mohamed and darting from the scene.

The young woman was bleeding profusely. She subsequently collapsed.

Sukhdeo assisted in taking her to both hospitals.

Latchmi Sukhdeo had testified that on the day in question she accompanied her brother to the Ritz Mall at Rosignol to unlock a cell phone.

They subsequently met Shazina Mohamed and after a while they walked to the Restaurant where her brother bought some food.

Subsequently Shazina was attacked by the accused.

State Prosecutor Attorney at Law Stacy Goodings had urged the jury to believe the state’s case which had two eyewitness and the doctor’s testimony.

Defence attorney Tajenarine Ramroop in his presentation pointed to some inconsistencies in the prosecution’s case and urged the jury to believe the defence’s case of self-defence and accident.

Justice Barlow had subsequently summed up the evidence to the jury and directed the panel on the law.

A probation reported was then asked for.

The judge had then granted the request. Attorney Ramroop had told the court that his client was just 24 years old, he is not married, has no children and lives with his parents. It was the first time he was charged for any offence of any sort.

outlined that Khalil was the product of poor upbringing.

He was the second of 10 children. He left school at the age of nine to seek

employment. The home environment was rundown and was described as a oneflat dilapidated building with a makeshift kitchen. The toilet

facilities were situated outside.

The house lacked the basic amenities and the home environment seemed to be overcrowded, with no privacy. There was no electricity. They used gas lamps and candles to light the house.

The relationship with Shazina Mohamed was his third. His first companion took her own life while the relationship with the second ended after her parents disapproved of it.

Justice Barlow before passing sentence told the accused she had listened to the contents of the report and the mitigation of his attorney, but she would disregard the report.

“Poverty is no excuse to kill,” the Judge stated.

She mentioned the fact that he had spent one year in jail, then sentenced him to life in prison with no parole before 24 years are served.

The accused had given an unsworn statement from the

dock.

During the trial the prosecution called a number of witnesses including Dr. Vivekanand Brijmohan who gave the cause of death as shock and hemorrhage due to multiple stab wounds.

The court also applied Section 95 of the Evidence Act to have the deposition of the deceased woman’s father Shafique Mohamed admitted in evidence.

The state called a number of witnesses to support its application including Police Sergeant Alexis Adams of the Central Immigration and Passport Office, Fazia Mohamed, daughter of Shafique and sister of Shazina, and Legal Clerk attached to the Fort Wellington Magistrate’s Court Ophelia Marques.

Shazam Khalil and Shazina Mohamed had reportedly met by accident. She had mistakenly dialed a wrong number which happened to be Khalil’s. After that they started to communicate.

Implementation of Rule of Law problematic in Guyana - USAID The United States Agency for International Development has published its 2016 final report on Democracy, Human Rights, and Governance Assessment of Guyana.

The report which was prepared by Tetra Tech ARD concluded that Guyana’s legal framework provides for the rule of law and protection of human rights, but its implementation is problematic.

It was noted that the administration of justice is slow, with uncertain access to fair and equitable justice.

Moreover, the report recognized that there isn’t a National Human Rights

institution established.

To facilitate the completion of the report, the body conducted several interviews with legal professionals who admitted that there is need for the nation’s laws addressing human rights to be updated.

According to the report, based on the Millennium Challenge Corporation index, Guyana received belowaverage rankings for the rule of law at 41% and control of

corruption at 30%. The document read, “Its (Guyana’s) justice system is out-dated, under-resourced and understaffed and cannot keep pace with the needs.”

The report highlighted the appalling state of Guyana’s justice system by referencing to the Guyana Justice Sector Reform Strategy (2006–2010) which estimated that 90% of prosecutions are unsuccessful and that half of the 25,400 cases pending at the High Court would never go to trial. This is so because the cases were either settled in the meantime or abandoned because the persons on bail disappeared, or the witnesses were no longer available.

Govt. intent on protecting press freedom - PM

By Kiana Wilburg Prime Minister Moses Nagamootoo is of the firm opinion that for too long, Guyana’s libel laws have been used as a weapon to muzzle various sections of the press.

He insists that such acts should be placed in the past.

And to facilitate this, the Minister with responsibility for Governance says that he will ensure that the administration keeps its focus on the need to review laws which deal with the right to freedom of expression.

Nagamootoo made these comments in light of remarks which were expressed by former US Deputy Chief of Mission Bryan Hunt.

In an interview with this newspaper, the US diplomat had said that if the Government wants to demonstrate that it is committed to protecting freedom of the press, then it needs to do a few crucial things, one of which is the review of Guyana’s libel laws.

It’s not something that is good for freedom of the

press when journalists can be charged for doing their job or for expression of their opinion. Libel laws have to be very, very, very, narrow in their application. And there has to be a review of the ones in Guyana and how they are applied”.

The US diplomat had said that he is not by any means stating that media houses should be allowed to print or say whatever they want. He said that based on the cases he has observed thus far, he does not believe that the libel laws in

Moreover, the report said that despite efforts to reduce the court backlog at that time, a significant backlog still remains today.

An evaluation of the geographic location of administration of justice machinery was also done.

“Areas outside of Georgetown in particular lack adequate security and justice sector personnel, resources and infrastructure. One

Magistrate covers all the hinterland regions, visiting each region only once every three months.”

A further evaluation revealed that there is also limited availability of legal advice and representation, especially for those without means or connections.

Despite the slothfulness of the judicial system, the report stated that persons use this delay of justice to their advantage in order to derail justice in some cases, as it would prolong the time to resolve an issue. During this period witnesses as well as evidence disappear.

All of these instances caused a reduction in public

trust in the judicial institutions.

The report noted that this level of trust had plummeted since 2012.

“Trust that courts could guarantee a fair trial dropped from more than 60% to below 45% in 2014 and confidence that the justice system would punish the guilty party also fell from more than 60% to close to 40%.”

These are just some of the findings contained in this 2016 edition of the report.

Other issues were highlighted in areas such as inclusion, competition and political accountability and Government responsiveness and effectiveness.

Guyana have been invoked in an equitable manner.

In this regard, the Prime Minister said that he could not agree more. He stressed that the coalition administration is open to all suggestions and recommendations that would lead to the freedom of expression in Guyana being improved.

Nagamootoo noted that there have been recommendations to delete a section of the Defamation Act which makes it criminal in a sense, when certain allegations are made in the stories produced by journalists on particular matters.

“To me, that section has no place in our law and no journalist should be jailed for exercising the right to expression and freedom of the press. While that is a pending proposal, among others, for the amendment of the Act, I would not exclude it from Government’s considerations because I support the view that all of the laws dealing with free speech should be reviewed,” expressed the Prime Minister.

He added, “There are current cases before the court which represent attempts to gag columnists. We need to put that behind us, we need to put behind any practice

that will see defamation laws being used to fight freedom of expression, and I will continue to support the need to review of our laws.”

Nagamootoo reminded that during the 2015 election campaign, there were calls for the establishment of a permanent Law Review Commission.

As leader of Government’s business in the National Assembly, Nagamootoo said that he will ensure that focus is maintained on acquiring such, so as to assist in the removal of odious provisions within the nation’s laws, particularly the Defamation Act. In a brief interview with this newspaper, British High Commissioner, Greg Quinn made it pellucid that the United Kingdom strongly supports the freedom of the press. The envoy said that a free and honest press must be allowed to play its role in shining a light on not just government, but all aspects of society.

Any restrictions on the media must therefore be limited, proportionate and justified, Quinn said. He noted however that journalists do of course, have a responsibility to report the news truthfully. The high commissioner said that the legal system must ensure this is possible.

Brazilian fined $7M for mining in Kaieteur Falls area A mining outfit which was caught in April operating in the Kaieteur National Park area has been fined $7M. According to the Ministry of Natural Resources, this latest measure would show clearly that the administration, through its regulator, the Guyana

Geology and Mines Commission (GGMC), continues to demonstrate its seriousness about meting out the measure of the law to those bent on breaking it.

The ministry revealed the miner’s name as Ceso Alves De Alcantara, a national of Brazil. He was fined after a raid

by the Ministry of Natural Resources and the GGMC in the Kaieteur National Park Buffer area found equipment, including a dredge - No. 9827and a Doosan excavator engine. The equipment was in operation, it was disclosed.

“The equipment was detained and charges were prepared against Mr Alcantara.”

According to the ministry, in discussions on August 4 and 5, the Brazilians indicated that he fully regretted the situation and that he was almost “ruined and has become ill” with worry since the situation unfolded. “Mr Alcantara’s equipment is to be removed from the buffer area to Grass Falls with the understanding that there should be no future issue arising from his operation working near prohibited areas or without permission.”

The Ministry and the GGMC said that they believe that this action sends a strong signal that there is a zero tolerance approach towards mining in protected areas and outside of the law and that stern action can and will be taken against those found doing so.

President must deal firmly with serious issues involving Govt. officials – Chris Ram Many who have had high expectations of greater levels of transparency and accountability, coupled with reduced corruption under the new government, have been left disappointed.

For one, anti-corruption advocate Christopher Ram says that he is not satisfied with the level of accountability under this new government.

“I am not satisfied at all; some of the recent cases under his new government are cause for concern,” said Ram. The attorney-at-law said that while President David Granger has not been fingered in any shady act or questionable deal, he is failing in one of his main responsibilities as Head of State. That, according to Ram, would be Granger’s responsibility to keep his officials in line.

“Granger has to step in and deal sternly with serious issues that have been raised in the public domain or his entire administration will become tainted by these accusations and possible misconceptions,” said Ram. He added that a wrong message will be sent if the public begins to feel as if government officials are getting off with less than a slap on the wrist.

Ram said that it is imperative that Granger remembers that the nation has put faith in him and expects him to do what is right. “They all (Guyanese) expect him to take his

Ram noted that Granger as President appointed Ministers, so he has a responsibility to make sure that they are acting in the best interest of the nation.

The auditor and anticorruption advocate pointed to some of the events that may have left the nation disappointed.

He made reference to the widely reported scandal involving Minister of State, Joseph Harmon.

After all of this, President Granger announced that he still has full confidence in Harmon. Ram said that on to now he is not satisfied with the way the Harmon issue was handled.

Ram then pointed to the recent bond fiasco involving Minister of Health, Dr. George Norton.

Dr. Norton has found himself in one of the worst image-wrecking scandals under the coalition government. The Minister rented a bond for the storage of drugs and medical supplies at $12.5M per month. A $25M “security deposit” was paid to the bond owner, despite the (Continued on page 11)

Will Granger commit ideological betrayal today?

There is no such thing as a head of state that is divorced from political ideologies and historical beliefs. If President Granger believes there is such an approach to governing a country, he is wrong. There is no need to define i d e o l o g y.

It comprises a belief system and core principles. Two powerful philosophers who have different historical perspectives agreed on one thing – ideology is essentially negative.

Karl Marx in “The

German Ideology,” referred to ideology as false consciousness. When you examine what Marx meant, then his definition has multiple elements of validity. It is outside the scope of a newspaper column to explain what Marx meant. He was essentially saying that one’s thought process is shaped by class position, therefore, you can embrace values that have no objective basis in life. This is a phenomenal adumbration that no anti-

Marxist philosopher can devastate.

Karl Popper, who wrote a devastating two volume critique of certain philosophers, including Marx (see “The Open Society and Its Enemies”) found ideology to be negative and dangerous, because it discovers what is undiscoverable – philosophical truths. It was a biting irony that Popper accused Marx of ideological truths when Marx said that ideology is a fiction in one’s mind that appears as fact. Both Marx and Popper were right and wrong. It depends how you define ideology and how historically grounded its philosophical contents are.

The brilliant 20th century Italian p h i l o s o p h e r, Antonio Gramsci (who has to be one of the favourite philosophers of every scholar or thinker who accepts Marxism) tried to meet Popper and Marx halfway (Gramsci was executed by Mussolini before Popper’s book was published). Gramsci argued that each ideology of each class contains elements of objective reality. This is

where ideology achieves acceptability in the study of politics. Ideology then can be said to be a system of thoughts and ideas, some of which can be proven wrong, some of which are historically valid and some of which, if accepted remain a guiding post. Here is where President Granger comes in.

Mr. Granger did a first degree in history and has edited a book titled, “Themes in African Guyanese History.” Mr. Granger would have a pattern of thoughts and ideas about his country’s historical evolution. He wrote about his country’s history. One fundamental thread of Guyana’s history is slavery. In 1823, there occurred the largest slave rebellion in the Caribbean.

The arrested revolutionaries were tortured, brutalized and killed at what is now Parade Ground.

President Jagdeo agreed for the erection of a monument at that site named the 1823 Slave Rebellion Monument. The sod was turned at the site.

Circumstances intervened and the Jagdeo Government found other uses for the Parade Ground.

The Ramotar Government came to power and switched the site to the

seawall. As a reaction to this, several African rights groups, including the multi-racial, Rodneyite formation, P e o p l e ’s Parliament, formed an organization named, Coalition for the 1823 Monument For Parade Ground. It found sympathy from many established organizations including the PNC under the leadership of Mr. Granger, the AFC, ACDA and the Georgetown City Council.

This columnist led off the negotiations with Mayor Green for the City Council’s permit to erect the monument there. He agreed and the necessary legal papers were drawn up. The protesting group got African Guyanese to boycott the official opening of the monument at the seawall road opposite Camp Ayanganna.

This year marks the 193rd anniversary of the uprising and President Granger will go to the monument today to preside over the ceremony. In the context of i d e o l o g y, President Granger is committing a grave political mistake.

In the context of ideology, the place for the monument is Parade Ground. Granger as an historian and political leader accepted that historical justification.

How can he then go to the

It must be remembered that the PPP did not move the site for ideological reasons. If Granger goes to the seawall, he will be guilty of ideological betrayal.

Fuel licences to GWI boss, others…

Company has no storage facilities - GEA As questions continue over the granting of fuel import and storage licences last year to a company owned by a senior Government executive and his three business partners, the Guyana Energy Agency (GEA) has revealed that the company involved had indicated use of other authorized storage facilities in its application.

The Importing/Wholesale Licence and Storage Licence were granted to Atlantic Fuels Inc., a company that has close links to Chief Executive of Guyana Water Incorporated (GWI), Dr. Richard Van-West Charles and Manager of the Debt Recovery Unit, Lear Goring.

The GWI boss and Goring became directors in

Atlantic Fuels in June, weeks after the May 11th elections last year which saw the Coalition Government taking power.

In late September, Atlantic Fuels applied for the licences, and was granted them on November 5.

Van West Charles started his duties as GWI’s head in October.

The granting of the licences has been raising eyebrows, with questions being raised whether VanWest Charles was given special considerations because of his closeness to the current administration.

He is the son-in-law of former President and Leader of the People’s National Congress (PNC), Forbes Burnham and served as a

Minister prior to 1992.

The GWI head denied this week that the licences had anything to do with GWI and said that nothing bars him as a private citizen from doing business. He also said that, contrary to what GEA has stated, the application was made since February last year.

Van-West Charles only became a director in June 2015 with his business partner, Goring, who he later coincidentally hired at GWI. The duo would have joined two other directors, Andron and Ronaldo Alphonso, said to be close relatives to prominent businessman and miner, Alfro Alphonso.

Dr. Norton was caught lying to the National Assembly. He told the House that the government was paying $19.2M a month to new GPC for the storage of drugs. Subsequently, New GPC made it clear that Norton was lying. The company said it offered its warehouse free of charge for the past decade.

When speaking about the fiasco, Ram noted the recommendation for the Minister to issue an apology.

He questioned, “Is that enough? Would an apology

have been acceptable if a PPP Minister had acted in that manner?”

“I can also remember what Volda Lawrence did,” said Ram. Reports in local media had quoted Minister Lawrence saying “this is a family issue that has been going on and on and on and on for whatever reason, I can’t tell you, because if I had a brother, even if there was an accusation, this is not how I would go about helping him.”

The Minister was at the time referring to allegations of sexual assault leveled against Winston Harding, who the coalition had offered as a candidate at the Local

Government Elections.

Lawrence’s position was that the man was never charged, so she did not see need to be wary of him. Many thought this was enough to cost Lawrence her position as Minister of Social Protection.

Ram said that some of what has plagued the new government during its short time in office may seem frivolous in isolation, “but when you view these things collectively you see that there is cause for concern.”

He said that when all is considered there is a clear need for President Granger to step up and prove to the public that he has things under control.

Damaged Konawaruk Bridge to become operational Monday

Repairs being done to the Konawaruk Bridge in Region Eight.

key bridge in Konawaruk, Region Eight which had become impassable will be operational from Monday, Government has assured.

Yesterday, Minister within the Ministry of Natural Resources, Simona Broomes, explained that bridge serves as an important cog to mining operations in that region, but it was recently swept away during rains.

The Ministry of Natural Resources has been engaging the Ministry of Public Infrastructure with a view to ensuring the early restoration of the bridge, a release from the former said.

Restoration work is being undertaken by MMC Inc., with the company yesterday assuring that work will be completed within a timeframe that will allow for normal use by vehicles as of Monday.

MMC Inc. has further assured the

Minister that the bridge will now be reinforced to ensure that it can withstand the ravages of inclement weather in the future.

Minister Broomes has said that those miners with whom she spoke earlier in the day, expressed relief at the news of the imminent restoration of the bridge and indicated their satisfaction over the on-theground attention.

She disclosed that Government is also paying attention to weather-related difficulties affecting smaller bridges in other parts of Konawaruk, including the Tiger Creek area, which is having a negative effect on mining operations throughout the region. “Arising out of this, the Ministry of Natural Resources is engaging the Ministry of Public Infrastructure on the matter of the early repairs/restoration of the affected bridges.�

Education Ministry in search of CEO The position of Chief Education Officer (CEO) is expected to be advertised shortly with the hope of finding a suitably qualified candidate by the end of September 2016.

This is according to a statement issued by the Ministry of Education which confirmed that CEO, Mr. Olato Sam, with immediate effect, will no longer be functioning in the said capacity as his contract with the Ministry has ended.

According to the Ministry’s statement, Mr. Sam has served in the sector

...as Olato Sam’s contract ends with distinction and zeal for the past eight years, five of which he served as CEO. “The Ministry wishes to thank Mr. Sam for his contributions to the Education Sector in Guyana and extends best wishes to him for all future endeavours,” the statement added.

Sam, a former student of Queen’s College, attended Swarthmore College in Pennsylvania and graduated

with a Bachelor’s Degree in a special major Sociology, Anthropology and Education and with a Pennsylvania Teachers Certificate in the area of Social Studies.

He taught Social Studies and English Literature at Walton High School and then became the Coordinator of the Alternative Education Programme for the education district at MS 144.

Sam, according to

information detailed on the M i n i s t r y ’s w e b s i t e , continued his studies at New York University and earned a Masters Degree in International Education with a concentration on Latin America and the Caribbean.

He subsequently returned to Guyana as the Director of the New Millennium Institute and introduced the phoneticbased literacy instructional programme through the

Chief Education Officer, Olato Sam Reading for All Learners Programme (RALP), currently being used in the school system nationwide.

Sam later became a

lecturer in the School of Education and Humanities, the Departments of Foundations and Education Management and Curriculum and Instruction.

In June 2006, he became the Head of the Department of Curriculum and Instruction and served in that capacity for one year, and in 2007 he moved to the Ministry of Education as the Technical Adviser to the then Minister of Education, Shaik Baksh.

During that period he also served as Chairman of the Board of Governors of the Cyril Potter College of Education (CPCE) and was instrumental in introducing a number of education initiatives including designing and structuring t h e G u y a n a Te a c h e r Education Improvement Project being funded by the World Bank.

In January 2011, Mr. Olato Sam was appointed the Chief Education Officer.

Two remanded for murder of boy, 13 Two men were yesterday remanded to prison for the murder of 13-year-old Daveand Sanchar, whose body was found with a chop wound to the head on Sunday last, at Plantain Walk, Triumph, East Coast Demerara.

Kevin Sahoy, 20, of 64 Agriculture Road, Mon Repos, East Coast Demerara, and Raymond Wo n g , 2 7 , o f 11 0 Agriculture Road, Triumph, East Coast Demerara, were not required to plead to the indictable charge of murder read to them by Magistrate Zamilla Ally-Seepaul.

Police Prosecutor David Goodridge told the court that on the day in question, the 13-year-old and the two accused were at a wedding house in the area. He said Sanchar became annoyed at Sahoy dancing with his aunt and subsequently left the wedding house for home.

According to Goodridge, Sanchar returned with a cutlass and an argument ensued between him and the accused, which resulted in Sahoy lashing him to the head with a piece of wood.

Goodridge added that Wong was the one who chopped the teenager to his head with

a cutlass.

Goodridge stated that Sanchar was picked up and transported to the Georgetown Public Hospital where he was pronounced dead on arrival.

Attorneys for the accused told the Magistrate that their clients have no pending or previous matter before the courts.

Prosecutor Goodridge indicated that investigations into the matter have been completed, and also, advice was sought from the Director of Public Prosecutions.

Sahoy, a mason, and Wong, an electrician, were instructed to return to the Sparendaam Magistrate’s Court on September 13, for disclosure of statements.

According to reports, Sanchar was at a function in the village and was involved in an altercation with some men over a female. It was reported that Sanchar left the celebrations and returned with a cutlass. A further argument ensued and it was alleged that one of the men took away the cutlass from the teen and dealt him a chop to the head, while another man gave him a severe beating with a stick.

Zika Virus spreads to outlying areas - CMO confirms Although the Ministry of Health has confirmed just over 40 cases of the Zika Virus, Chief Medical Officer ( C M O ) , D r. S h a m d e o Persaud, has revealed that the virus is spreading.

According to the CMO, cases have even been detected in Region One – a hinterland location.

“At least two positive cases have been confirmed in Region One. We continue

to monitor and test in some of the outlying areas,” said Dr. Persaud, as he informed that the spread of the virus might be linked to the fact that “people are moving a lot.”

Moreover, he noted, there continue to be cases confirmed along the coastal Regions.

As such Dr. Persaud said that the Public Health Ministry has started and will keep on closely

monitoring other outlying Regions such as Seven, Eight and Nine.

“It is not only East Bank and Georgetown that cases have been reported but it has spread a little bit beyond that...positive confirmation is about 42 cases but there might be a few more that are pending final results,” the CMO added.

He, however, noted that there might be a number of

cases that the Ministry may not even be aware of. This is simply because if blood samples are not tested in the early stages of the infection and persons receive symptomatic treatment, the virus will not be detected at a later stage.

“There is a small window when the sample has to be collected and tested, and of course we only sample and test a proportion of persons,” Dr. Persaud admitted.

Currently Guyana relies on the Caribbean Public Health Agency in Trinidad for testing support, but according to Dr. Persaud, “we are hoping that we could initiate the testing shortly.”

“Everything is in place; however we are still awaiting those vital kits to c o m m e n c e t h e Chikungunya, Dengue and Zika testing. It is a triple kit; we have all the machines, trained personnel but we are awaiting the kits to be delivered,” the CMO said.

The kits have been procured by the Ministry, Dr. Persaud said, as he noted that “we hope all of that goes well and we get them very soon and then we can start our local testing.”

But prevention is still an important aspect of tackling the Zika Virus, Dr. Persaud underscored. He explained that personal action is still crucial, including preventing mosquito bites and removing the breeding sites around the

home.

Added to this, Dr. Persaud said that the Ministry is still continuing fogging exercises.

“The (fogging) cycle has once again started on the East Bank and they are moving into south Georgetown and throughout the area...it will be like sixweek cycles and we will continue to do that,” the CMO shared. Some of the outlying Regions, including Mabaruma, have also been conducting fogging exercises, he mentioned.

“Wherever we have cases we have initiated the fogging exercises,” said Dr. Persaud as he revealed that the Ministry has a plan in place whereby all of the positive cases are followedup. He, however, divulged that “we have had some difficulty tracking a few of them. We are following up with them to ensure that first of all if they are women, they are not pregnant, and secondly screen all the contacts of that infected person.”

Conditions that have been linked to the Zika Virus are the Guillain-Barré syndrome which affects the nervous system, and microcephaly, which could cause a pregnant woman to deliver a baby with an unusually small head.

Thus far Guyana has diagnosed four pregnant women. One of the women,

Chief Medical Officer, Dr. Shamdeo Persaud this publication understands, has since had a miscarriage and at least one has given birth to a normal baby, but continued efforts are being made to monitor both mother and child. Reports suggest that a third woman has since failed to avail herself for monitoring while the fourth pregnancy continues to be closely monitored.

But according to Dr. Persaud, while there are a number of troubling conditions linked to the virus it is more often than not a relatively mild disease. This, he noted, is because many people can become infected and manifes t mild to absolutely no sign or symptom.

The virus is transmitted

by Aedes-type mosquitoes which also transmit Chikungunya and dengue.

There is no cure for the virus, but treatment is made available for the symptoms manifested. Symptoms can include fever, rash, joint and/or muscle pains, headache and conjunctivitis (pink eye).

CSEC/CAPE candidates have time to - final results to be review grades - Exam Supt. known by October Candidates of the 2016 Caribbean Secondary Certificate Education (CSEC) examination and the Caribbean Advanced Proficiency Examination (CAPE) are currently eligible to have their results reviewed. This assertion was made by Superintendent of Examination and local Registrar of Exams, Ms Sauda Kadir.

Kadir’s disclosure was forthcoming at a forum earlier this week to announce the results of the two Caribbean Examinations Council (CXC)administered examinations.

According to Kadir, “we are in the preliminary results stage and the students have an opportunity to do reviews or queries with the Caribbean Examinations Council.”

T h e E x a m s Superintendent explained that while the preliminary results essentially serve to present the highest number of grade ones secured by candidates, there are still criteria used to identify the

top performers and that will not be known until October.

Based on the preliminary results the national top performer this year is 16year-old Fatima Karim of St. Rose’s High School who was followed closely by Kayshav Tewari of Queen’s College. Karim secured 19 grade ones and 1 grade two passes while Tewari secured 19 grade ones.

The previous year Victoria Najab of the Sarawati Vidya Niketan Hindu school was the top performer with 20 grade ones passes, the year before that it was Elisa Hamilton of the Queen’s College who had performed a similar feat as Karim.

One year earlier it was Zimeena Rasheed of the Anna Regina Secondary School, with 18 grade one passes and two grade twos, who was declared the top national CSEC performer.

However, following CXC’s analysis it was Rasheed’s classmate, Yogeeta Persaud, with 18 grade one passes who was named the

Rasheed on the other hand was named the best performing candidate in Techinical Vocation.

Former CXC Registrar, Dr. Didacus Jules, in an interview with this publication had revealed that while he is aware of calls being made to limit the number of subjects candidates write at the CSEC, the matter at that time had not come up for

deliberation at the level of CXC. ”We don’t consider it to be a matter under CXC’s purview; this is a matter for parents, the schools and ultimately the Ministry,” said Dr. Jules.

However, he said, “Our view on it is that you should not put a limit on people’s capacity; whatever subject you feel you can do you ought to be allowed to do.”

The CXC Registrar underscored though, that one

factor that must remain clear is that the number of subjects that are undertaken does not determine whether a candidate is able to secure the status of top regional performer.

Meanwhile, Kadir disclosed that the two top national performers of both CSEC and CAPE are still expected to be eligible for scholarships. According to Kadir, “based on our understanding the

presidential scholarship is still available.”

The presidential scholarships were first introduced under the P e o p l e ’s P r o g r e s s i v e Party/Civic Government, whereby students were eligible to apply to universities of their choice.

thief was captured hiding in a woman’s bedroom yesterday, minutes after he grabbed a chain from a man in Bourda market, Georgetown.

This occurred around 14:15 hrs yesterday.

The suspect has given his name as Gonsalves also known as “White boy.”

According to information received, the suspect grabbed a man’s chain in Bourda market and ran through an alleyway and managed to sneak into a woman’s bedroom through an open window at a house at Robb and Light Streets, Georgetown.

This newspaper was told that when the victim lost his chain, public-spirited persons

gave chase. A resident on Robb Street informed the group of men that she noticed a young man jumping through a window in the apartment beneath her. ”When we went in, the two women who live there said that no one was there, but as we were leaving one of them started screaming, and we run back and see the man in the bedroom,” a source said, while adding that the suspect was beaten by the angry mob.

Kaieteur News was told that when the suspect spotted the cops, he started screaming for them to rescue him from the group of men.

He was eventually taken to the hospital where he remains a patient.

Mining company owner Shelly Singh was left traumatized after gunmen shot a security guard and wounded one of her employees after cornering the victims in Mrs. Singh’s pickup outside her Eccles, East Bank Demerara residence at around 15.00 hrs yesterday.

But the two gunmen and their driver were forced to flee empty-handed after the wounded guard discharged several rounds at the attackers. According to a source, the guard believes that he may have wounded at least one of the gunmen, since the shootout occurred at relatively close range.

A relative of Mrs. Singh said that a bullet grazed the

back of the head of one of Mrs. Singh’s employees. He was treated but was not admitted.

Kaieteur News understands that Crime Scene ranks found two warheads lodged in one of the door panels of Mrs. Singh’s pickup. At least eight spent shells were found close to the driveway.

Relatives believe that the gunmen trailed Mrs. Singh from a city commercial bank.

Kaieteur News was told that Shelly Singh, accompanied by an employee and a guard, had conducted a transaction at Demerara Bank Limited on Camp Street. They then headed to Singh’s home in

Eccles. But just as they entered the driveway, a grey car stopped nearby and two men exited. Both reportedly had handguns.

There was a brief exchange of gunfire between the bandits and the security guard, who had armed himself with Mrs. Singh’s handgun.

The gunmen eventually retreated, while the injured were taken to a hospital.

Singh’s relative who spoke to Kaieteur News said he was upset that investigators had asked the mining company owner to hand over her firearm.

However, a police source said that this was a routine aspect of such an investigation.

He said, too, that Cabinet has also given guidance to Minister of Education that in looking at the condition for the award of scholarships, “the Minister and the Ministry consider scholarships at UG for people in Guyana.”

This essentially meant, according to Harmon, that the scholarship programme will be expanded, whereby the scholarships will no longer be limited to the top performing students pursuing studies abroad, but will include “deserving students in Guyana who can pursue degrees at UG.”

Reuters - The FBI and U.S. Justice Department are investigating possible U.S. ties to alleged corruption involving the former president of Ukraine, including the work of firms headed by political operatives Paul Manafort and Tony Podesta, CNN reported yesterday, citing multiple U.S. law enforcement officials.

The broad-based investigation was looking into whether U.S. companies and the financial system were used to enable corruption by the party of former pro-Russian Ukrainian president Viktor Yanukovych, CNN said.

A person who answered a telephone number for Manafort said Manafort was not available for comment.

The person, who said he was an associate of Manafort and who gave his name only as David, referred queries to a lawyer in Washington, who did not immediately respond to a phone call and an email.

Manafort, who resigned as chairman of Republican presidential nominee Donald Trump’s campaign yesterday, had not been the focus of the probe, CNN said, citing the officials.

The probe was looking at

the work of other firms linked to the former Ukrainian government, including the Podesta Group, a lobbying and public relations company headed by Tony Podesta, whose brother John Podesta is chairman of the campaign to elect Democratic Party presidential nominee Hillary Clinton.

Manafort’s attorney Richard Hibey did not immediately respond to a request for comment. The FBI declined to comment, CNN reported.

The Podesta Group has hired an independent legal firm to investigate whether it had been misled by the Centre for a Modern Ukraine, a not-for-profit group linked to the ousted Ukrainian government, a spokeswoman for the group said in a statement.

The Justice Department, asked to comment on the report, said it remained “committed to helping recover stolen assets on behalf of the people of Ukraine.”

Investigators in Ukraine have said Yanukovych and his party engaged in widespread corruption. He fled to Russia following a popular uprising in 2014.

Traffic cops to campaign against minibuses with illegal markings The traffic department of the Guyana Police Force (GPF) has intensified its campaign to ensure that minibus operators comply with their road service licence.

“We recognise that there are a lot of public transportation, especially minibuses, that have writings, drawings and other things on their minibuses,” Traffic Chief, Dion Moore told the Government Information Agency (GINA).

The road service licence for public transportation

stipulates, among other things, that “there should be no marking, writings, etc.” on vehicles.

Minibuses often times are decorated with advertisements, slogans, artwork and pictures that can be considered lewd and/or offensive.

“We monitor the CCTV breaches, and then we’ll have patrol ranks almost simultaneously working in the field to nab those errant drivers who breach the traffic light control signals,” Moore explained.

This is another measure being utilised by the GPF to curb irresponsible use of the roadways.

Govt. moving to introduce polygraph testing across public service ST. JOHN’S, Antigua CMC – The Antigua and Barbuda government says it will seek parliamentary approval to introduce polygraph test for various categories of public sector workers.

Immigration Minister Charles “Max” Fernandez told reporters that five Immigration Department employees, who failed a similar test would not be re-employed.

The workers are claiming wrongful dismissal.

“Polygraph testing will continue because that it something that needs to be done. We have agreed there have to be something put in place leally and as a result of that we will be going to Parliament very shortly, I know the AG’s office is looking at polygraph testing because it will not be related to the Immigration Department.

He said the police, Customs, army “and other divisions of the government that polygraph test will be…required”.

He said the trade unions which represent public sector workers have been informed of the Gaston Browne administration’s moves, including the union represent-

“We have said to them that we are going to be looking to take this to Parliament.

I hope to have some more dialogue once we have the draft of the legislation with the union going forward and I am sure the same thing will happen for the other departments.”The five workers had been dismissed after they were found to have been involved with the use of illicit drugs, after a polygraph test.

“The Cabinet has agreed that anyone that is involved

in anything related to drugs – whether it be taking drugs or being associated with drugs – would not be allowed to remain in the Immigration Department,” Fernandez said.

But their bargaining agent, the Antigua Trades & Labour Union (AT&LU) is challenging their dismissal on the grounds that the process the Immigration Department took to remove them was inconsistent with the law.

According to the union, the recruits were called before the Chief Immigration Officer Annette Mark on July 23, informed of their termination, then received official letters to that effect days after.

“We are under a lot of scrutiny internationally from the US, the Canadians, the British in particular and in general most of the countries that send representatives, one of the first, most important issues to them (is) border security.

“So that is something we had put in place from the beginning (with) regards to persons involved in drugs and drugs related matters there is no room for them in the Immigration Department,” Fernandez added.

Trinidad Express - The Integrity Commission intends going to the High Court seeking an order directing public officials to file their Declarations of Income, Assets and Liabilities and Statements of Registrable Interests for the period 2003-2014.

The Integrity Commission, in a statement yesterday, said it had published the

names of those Persons in Public Life who failed to file their Declarations , in the newspapers in May this year, and quoted the law which states that : “The Commission may, at any time after the publication referred to in section (6), make an ex parte application to the High Court for an order directing such person to comply with the Act and the Court may in addition to

making such an order, impose such conditions as it thinks fit.”

According the the law: “A person who fails to comply with the directions of the Court, commits an offence and is liable on conviction to a fine of $150,000.”

The Commission said the people who had failed to declare should do so without further delay.

Judge rules on UNC election petitions…

EBC wrong but election result stays

Trinidad Guardian - High Court judge Mira Dean-Armorer has dismissed five election petitions filed last year by the United National Congress (UNC) challenging the results of the 2015 general elections in five marginal constituencies.

The UNC challenged the Elections and Boundaries Commission’s (EBC) decision to extend the voting time by one hour to facilitate voters in Trinidad due to inclement weather.

The original petitions challenged the results of six marginal constituencies, La Horquetta/Talparo, Toco/

Sangre Grande, Tunapuna, St Joseph, San fernando West and Moruga/Tableland after the UNC’s 23 to 18 defeat.

One of the petitions, for La Horquetta/Talparo constituency, was struck out because it was served too late.

Dean-Armorer ruled that the EBC did overstep their statutory remit by extending the hours, however, she felt they acted genuinely and in the interest of the voting population.

The judge said she could not invalidate the polls based on EBC overstepping its boundaries as the result of

the elections was not materially affected by the decision to extend the hours.

Doing basic math, DeanArmorer, subtracted the number of voters who voted between six and seven pm from the Peopl e ’s N a t i o n a l Movement candidates in the five constituencies represented in the petition and the result showed that the People’s National Movement (PNM) party would have still won.

The UNC is likely to challenge the judge’s decision before the Appeal Court, which has final jurisdiction on election petitions.

Clinton leads Trump by 8 points - Reuters/Ipsos poll Reuters - Democratic presidential candidate Hillary Clinton leads Republican rival Donald Trump by 8 percentage points among likely voters, according to a Reuters/Ipsos opinion poll released yesterday.

The Aug. 14-18 survey showed 42 percent of Americans supported Clinton ahead of the Nov. 8 general election. That compares with 34 percent support for Trump.

Another 23 percent of likely voters would not pick either candidate.

Clinton has led Trump in the poll throughout most of the 2016 campaign, and has maintained her advantage following last month’s Republican and Democratic conventions.

Since late July, support for the former secretary of state has ranged between 41 percent and 44 percent of likely voters, while Trump’s support has varied between 33 percent and 39 percent.

The race was tighter at this point in the 2012 election, with Democratic President Barack Obama ahead of Re-

Hillary Clinton publican nominee Mitt Romney by less than 2 percentage points.

Clinton also led a separate Reuters/Ipsos poll that asked people to choose between Clinton, Trump, Libertarian candidate Gary Johnson and Jill Stein of the Green Party.

Some 41 percent supported Clinton and 34 percent supported Trump. Among alternative-party candidates, Johnson came in third with 7 percent and about 2 percent supported Stein.

Clinton and Trump have

both struggled to inspire American voters this year. According to the poll, neither candidate is regarded favourably by most Americans, and two-thirds of U.S. adults believe the country is on the wrong track.

Victims of clashes overwhelm hospital in Indian Kashmir Reuters - More than 40 days of clashes between protesters and security forces have overwhelmed the main hospital in Indian-administered Kashmir, where some patients with severe injuries said they had been beaten in their homes by troops.

The activity which was held as part of the 177th anniversary celebrations on Guyana Police Force was held under the patronage of B Divisional Commander, Assistant Commissioner Ian Amsterdam.

The Guyanese strongman also set a new mark of 212.5kg also with his third and final attempt in the bench press to topple another of Ramos’ records, also achieved in St. Croix on July 10th, 2014. The old mark stood at 210.0kg (462.75lb).

Mars also achieved a Personal Best with his third and final deadlift of 312.5kg (688.9lb). Commenting on his achievements, Mars first gave God thanks for allowing him to be injury free to compete and bring glory for himself and country.

He said preparation was intense for the competition whilst noting that the record achievement was done with ease. ”In relation to the

records, this was done with ease and with more to spare.

My biggest achievement however, was winning the C o m m o n w e a l t h powerlifting championships in Canada last year.”

Speaking candidly, Mars said more athlete investment is needed: “My hope is for our sport to be supported by the Ministry of Sport.”

The Americans had nearly missed out on a place in the final, after Felix dropped the baton when handing over to Gardner in their heat on Friday morning.

Usain Bolt caps Olympic Persaud qualifies for Governor career with perfect General Final for 3rd year in a row ninth gold medal Guyana National Rifle Association (GuyanaNRA) Captain Mahendra Persaud has qualified for the Governor General Final at the 134th Canadian Fullbore Rifle Championships, reward for being one of the top 50 marksmen of the close to 200, competing at the Connaught Ranges, Ottawa.

Persaud, one of 9caribbean shooters competing including three Guyanese, has been the leading rifleman of the lot and will have the opportunity to shoot against the best in the world including the top 5 from the UK which includes David Calvert and Jon Underwood.

At the conclusion of shooting on Thursday, Persaud was 43rd overall with a Grand Aggregate total of 738v73 out of 184 competitors.

Leading was UK’s David Calvert on 752v98.

The next best Caribbean shooter was Trinidad and Tobago’s Norris Gomez at 109 on 717v53 just ahead of Lennox Braithwaite was one position down on Vs, 717v48.

( Ya h o o ) R I O D E JANEIRO — It ended like it was supposed to, with another gold medal, another breathtaking run, another reminder that Usain Bolt isn’t just the fastest man ever but one capable of s u m m o n i n g h i s otherworldly skill at the most appropriate time.

There are great athletes, and there are great competitors, and there are the rarest breeds, of which Bolt is one, who manages to marry the two.

They’re the ones that make history.

And so it went Friday night at the Rio Games, where Bolt left his final imprint on the Olympics in typical fashion.

The 4×100-meter relay went off at 10:43 p.m. local time, and 37.27 seconds later, he crossed the finish line to propel Jamaica to its third consecutive gold in the race.

Bolt anchored all three, and with his gold medals in

the 100- and 200-meter dashes this week, he hit his beloved triple-triple: three golds in three consecutive Olympics.

Nine gold medals. It is staggering for a sprinter, but then Bolt isn’t just a sprinter.

He’s a force of nature, a rg u a b l y t h e g r e a t e s t Olympian of all time, and with Asafa Powell, Yohan Blake and Nickel Ashmeade, he locked down his nine-for-nine r u n a h e a d o f silver medalist Japan, which ran a 37.60.

According to former national player and younger brother of Osmond Cummings, Nigel ‘Mice’ Cummings, the tournament will go to a next level next year. “Next Year I want the tournament to be played in a league with two groups so

that all the clubs in Linden will get an opportunity to play.”

He noted that he would like to collaborate with the UDFA and the GFF and start the league in March so the finals will be played in August. “I think the games will be more exciting and the players will benefit more.”

Cummings also gave back to the children of the community at the same venue by giving them haversacks, books and other school supplies.

Kholi’s men disappointed with no play on day two

But despite hot sun during the first two sessions of day two of the fourth and final Test, the day’s play was officially called off at 14:30hrs due to wet areas in

the outfield without a ball being bowled.

According to the ground staff poor drainage was the primary cause for no play being possible yesterday.

To make matters worse the first shower for the day came about 10 minutes (it was a short one) after play was abandon for the day making it very unlikely for an early start today as India desperately needs enough time to force a win to become the World’s number one Test team.

The entire day was lost due to rain in the third Test in St Lucia and India still managed to win by 237 runs but the possibility of a result here is now looking very unlikely even with the West Indies batting line-up prone to dramatic collapses like the last one in St Lucia when the last seven West Indian wickets tumbled for 31 runs.

The top club prize was increased to a whopping $1 million and the international races to eight, pushing the total prize money over $3M, a massive increase from the six previous years. As a result, the Coordinators of the meet have been redoubling their efforts to continue to raise the necessary funds to host the meet.

The prize money will continue all the way to fourth place, with the second place finisher taking home $500, 000. Third place is set to receive $300, 000, while fourth place will walk away with $200, 000 for a total of $2M for the club prizes.

Digicel supports DCC coaching camp

By Zaheer Mohamed As part of its corporate responsibility, Digicel has thrown its support behind the Demerara Cricket Club in aid of its ongoing cricket clinic. The entity presented a cheque to the club at a simple ceremony held at its Queenstown location yesterday.

President of the club Alfred Mentore, who received the cheque from Digicel Public Relations Officer Vidya Sanichara, expressed gratitude to the company for their input.

“This is not the first time Digicel has come on board with the club, we have seen Clive Lloyd and Lance Gibbs being recognised for their contribution towards West Indies cricket and the company contributed towards our mash camp as well, so we are thankful for their support,” he said.

The camp mainly caters for junior cricketers and Mentore explained that this is the grassroots of West Indies cricket. “We at DCC are extremely happy that Digicel has made a

definitely played our part in the success of the Guyana junior teams over the years.

Currently three of our players are in England with the West Indies U16 team; Ashmead Nedd, Sachin

Singh and Qumar Torrington, and that speaks volumes,” Mentore related.

Sanichara explained that Digicel is happy to be part of the clinic and will continue to support it. She lauded that

club for their efforts and urged the youths to remain committed towards the sport and their Education for they both go hand in hand.
