xxon Mobil's subsidiary Esso Exploration and Production Guyana Limited (EEPGL) has filed a response in the Court essentially contending that Kaieteur News Publisher, Glenn Lall has overstepped his boundaries “as a private citizen,” in his effort to legally challenge the Government to ensure that the oil companies pay their fair share of taxes.

The oil company has instead charged the AttorneyGeneral (AG) with the responsibility for filing a civil action in the interest of the public.

In the affidavit in defence signed by President of ExxonMobil Guyana, Alistair Routledge, the company which was recently added as a respondent in the case between Lall and the government outlines what it termed “as reasons,” why the newspaper publisher is

Lall is challenging the government over the discriminatory tax provisions granted in the Stabroek Block Production Sharing Agreement (PSA) for the oil

companies.

The PSA between the oil giant, its partners and the Government of Guyana essentially states, “…no tax, value-added tax, excise tax, duty, fee, charge or other impost shall be levied on the Contractor or Affiliated Companies, in respect of income derived from Petroleum Operations with the Stabroek Block.”

The Stabroek Block is currently being drilled by Exxon's subsidiary EEPGL, Hess Corporation and CNOOC Petroleum Guyana Limited.

I n J a n u a r y, K N ' s publisher, through his attorney, Mohamed R. Ali, filed an action in the High Court which outlined that the tax reliefs listed under Article 15.1 of the Petroleum Agreement, dated June 27, 2016, between the Guyana Government and the oil companies, violate the Petroleum Exploration and

Production Act, the Financial Administration (and Audit) Act, the Prevention of Discrimination Act, and the Constitution.

In that court case, Lall is seeking declarations to have the provisions nullified and reversed.

But EEPGL, the Exxon operator is strongly opposing the application.

In the document filed to oppose case, the company claimed it has no knowledge of the allegations contained in Lall's application.

Instead, EEPGL said that the fact that Lall is a citizen of Guyana and the publisher of the National Media and Publishing Company Limited (Kaieteur News), does not entitle him to bring the present proceeding in his own name, in his private capacity for declaratory relief alleging breach of public rights. “…Nor has the applicant (Lall) shown any special loss or damage he would suffer over and above the public so as to entitle him to seek the reliefs that he does,” EEPGL added in the affidavit.

The oil company explained that based on the advice of its attorneys, Lall as

The Exxon subsidiary argues further that it is a fundamental principle of Guyana law that public rights could only be asserted in a civil action by the AttorneyGeneral of Guyana

representing the public.

It explained that “Except where a statute otherwise provides, a private person could only bring a proceeding to challenge a breach of the law if his claim was based on an allegation that the breach constituted an infringement of his private rights or would inflict special damage on him. A private person was not entitled to bring an action in his own name for the purpose of preventing public wrongs. “ “Consequently,” the company continues, “the court has no jurisdiction to grant relief in such a proceeding as the present one and the proceeding brought by the applicant ought to be struck out forthwith.”

A d d i t i o n a l l y, t h e company claimed that the Petroleum Agreement (PA) that it has with the Government does not violate provisions of the Petroleum Act (PA), the Financial Administration and Audit Act, Prevention of Discrimination Act or the Constitution of Guyana.

The added respondent (EEPGL) specifically denies that PA does not extend or purport to extend concessions to persons in a manner that is inconsistent with sections 10 and 51 of the Petroleum Act, either as the applicant alleges or at all. “ T h e PA d o e s n o t separately or cumulatively alter certain tax laws to grant remissions, concessions and waivers contrary to section 6 of the FAA Act…” F u r t h e r, t h e a d d e d respondent is of the view that the provisions of the PA do not and cannot alter a law.

“Only Parliament may do so by way of legislative device, which is recognised and given effect to by Article 15.14 of the PA…”

Criminal governance at its best Leaders in the PPP/C Government may think they are so sophisticated that what they are doing goes over the heads of Guyanese. Perhaps, if the governments practices were some occasional event there might have been some truth to what government leaders comfort themselves in thinking. Also, if what they are doing and plan to do involved matters of tiny importance, they could have gotten away with those situations. Since none of the above applies when PPP/C Government practices are studied, then they have fooled few, thus narrowing prospects of success in their culture of larceny.

Because unthinking arrogance now controls Government leaders, they are their own worst enemies.

They are too predictable, too detectable, and have degraded into what is the unbelievable. Said differently, they have not only shot off their mouths, but have also shot themselves in the foot. It is why they are always on the defensive and running for cover when the bigger things in Guyanese life form the centre of attention.

First, what the PPP/C Government has done is to have visited the same wells once too often. A smart set of leaders would have some restraining hand and voice on the inside to say let us not go down this road again, or so quickly. It is why so many have come to discern a certain pattern of leadership behaviour that can only be described as purely criminal. Such things can only be stuffed down the throats of utter idiots, and in a watchful and critical and untrusting society, there are only a few imbeciles. Second, once money is involved, government are bound to be present, and the bigger the sum involved, the more of them and bigger ones among them gather under the money tree. This is now as good as a guarantee, with one project after another furnishing a long chain of evidence. The biggest money mass in Guyana today (though relatively small, it is growing) is in the natural resource magic coming out of the ground called oil. Government leaders gather there.

Oil causes drooling, makes them not know what to do with themselves. In the rush and free for all, they are so compulsively greedy; they are elbowing even their own out of the way, or tripping them up with tricks, so as not to lessen their share of the thievery. This is how pathetic they come across, what the sum of their self-enriching antics provides inarguable confirmation. Incidentally, what they are engaging in with the wholesale setting up of themselves and their circle of cronies so that they can steal at will is not antics, but criminality of a kind rarely seen, even by rapacious Third World leadership standards.

Third, the avarice is not limited to oil alone, but stretches sucking tentacles into gold and school money and flood relief money and COVID-19 relief money. Nothing is beyond the covetousness and ugliness of these thieving men and women elected to lead a poor nation forward.

Prime lands and prized real estate properties catch their eye, they even help themselves from sugar money (robbing their own), such is the intensity of their addiction to money.

Perhaps, if they were contented with stealing on a below the radar level, they may have flourished, but they cant help themselves, so it must be everything and the bigger the better. Similarly, anything related to quality in this society is of no interest to these rogues. Quality would mean spending for others to benefit, hence less for them.

Quantity is king, and the larger the amount from a sector or a project, the bigger the take for these lowlifes feeding on the taxpayers. Last, anything associated with consolidating their power brings a huge rush. For such means that they become more entrenched, and longer at the national trough, while the people starve and eat each other. There is no genuine talk today of a truly inclusionary democracy, for that translates to restraints and having to spread the nations wealth. They delay watchdog bodies, but rush through so-called electoral reform. They scorn national unity, since that leads to more bodies at the banquet. In the annals of leadership banditry, the PPP/C Government makes Al Capone look like John the Baptist.

Dharamlall should go: Enough is enough!

DEAR EDITOR, My missive to you today is the result of the severe depression regarding the situation surrounding the sitting Minister of Local Government and the implications it has. The Minister is accused of predatory behaviour, has committed sexual harassment during a contribution of his in the National Assembly and has publicly derided the professional work of female judges thereby committing an act of intimidation against the Judiciary by the Executive.

I would need to preface the rest of my letter by stating that I understand that persons have private lives and may have engagements with adult individuals, however, the expectation is much higher for a person of prominence in public life. When one agrees to serve our country, they agree to represent us as best as humanly possible in both their public and private lives, recognising that certain positions carry influence in both worlds. It is accepted that the distinction between the two spheres will become

blurred, that there will be expectations in both, and that your private life will not always be your own. While the Minister’s actions do not seem to bear legal or criminal consequences, they speak volumes as to who we are as a nation and not a good place to start if we are to realise His Excellency’s vision of “One Guyana”. The fact that the Minister has not resigned of his own volition and that the Government has not imposed any penalty on him, signals to the world that misogyny is rife in Guyana and sexual and wider misconduct is acceptable behaviour. It is made worse by virtue of the fact that Ministers are leaders persons of political, economic, social and cultural influence. The lesson that is being set for our younger generation is appalling and will only serve to crumble the moral fabric of society.

Furthermore, the Minister’s behaviour is in direct contravention of the Order made under the Integrity Commissions Act, which requires the observance of a

Code of Conduct for persons in public life. The Minister’s actions are against the Principle of Honour which states that Members of Parliament have “a moral obligation to preserve the reputation of their office” and Article 8 which requires that no person in public life “pursue a course of conduct which amounts to offensive sexual comments, gestures or physical contact...”. The statement of the President reported by the media when he states that persons should “complain to the police” is of grave concern as whoever is advising His Excellency surely knows that it is not a purely legal matter but largely an issue of ethics, cultural deficiencies and gender rights. It is a matter that requires the Government to show where their values and principles lay. The allowance of the Minister to continue in his public role sends the message that the protection of the “boys’ club” is more important than our future as a country and our legacy. I know the President wishes only the best for our

country and I urge him to act in a manner that shows us and the world where we stand. The ABCE and other nations are watching. I am sure they understand the gravity of the current situation and that their relationships with Guyana may need to change depending on how the story unfolds. This Government championed themselves as defenders of democracy; if appropriate action is not taken, it would cause our partners to wonder if we are only defenders of democracy when it is convenient to us. If we are a democratic country then we are bound to listen to our constituents, especially regarding an issue such as this where a clear pattern of behaviour is discernible. It is my fervent hope that the Minister proves himself as deserving of the prefix “Honourable” and saves his Government, our President, and our country from further shame by voluntarily resigning.

The Health Sector – The Value of Nurses DEAR EDITOR, Interested parties must have been paying attention to the more recent pontifications about ‘Human Development’, among which have been those concerning the impact on the population’s health by the current pandemic and its indeterminable future. It is in this connection that one noted the Minister of Health recently bemoaning the rate of migration of ‘nurses’ from the Public Health Sector. There was no specific indication of how this critical human resources deficit would be addressed. It is in this context that it is worth examining the ‘Nursing’ capacity reflected in the Budget 2022. The following shows the Categories and Grades of Nursing Staff within the Public Service 14 Grade Job Hierarchy – Georgetown Public Hospital Corporation: Administrative – Matron – Grade 11 Senior Technical – Department Sister; Ward Sister; Nurse/Midwife – Grades 10-7 Other Technical & Craft Skilled – Staff Nurse; Midwife – Grades 6-5 Semi-skilled Operatives & Unskilled – Nursing Assistant; Nurse Aide – Grades 4-2

It is against the aforementioned that one ponders on: a) Health Minister’s recent reference to the perceptible migration of ‘Nurses’.

There has to be some specific count and an identified period over which the loss occurred.

b) The projected number of hospitals to be established across Regions; and c) The optimism in the most recent announcement of the introduction of the following: - Community Health Training Course - Pharmacy Aid(e) Course/ s - Laboratory Aid(e) Course/s - Bio-medical Technician Course, and - Nursing Courses’ – a somewhat vague terminology which offers little indication of the level of competencies to be provided that could fill the deficit in skills of migrant ‘Nurses’; along with the reported human resources needs of the hinterland Regions. Hopefully, the peri-

odicity and the levels of graduated capacity would be announced very early, so that prospective trainees can understand: a) the level of job for which they will qualify; b) the applicable remuneration and other conditions of employment; in order to make decisions about careers – in the fundamental context of their personal development. In other words, would the employer institution be so

organised that they can grow (and in the process) set positive examples for their progeny. The above apart, it is not enough to speak of ‘training’ almost in a vacuum.

It is necessary for the decision-makers to require their professional resources to conduct the most comprehensive analysis of skill needs across the health sector, in order to inform the construction of at least a five year human resources development strategy, aimed, amongst other things, at ensuring a healthy rate of retention – to save lives. Hopefully by now, the case would have been made for the review of the respective values of jobs in the Health Sector, as distinctly technical from the rest of the Public Service. In the process, opportunity must be taken to at least reduce the disproportionate number of ‘semi-skilled and unskilled operatives’ who are too loosely included as ‘Nurses’ if only for public consumption.

Show us the evidence that Dookhoo is a Government man DEAR EDITOR, Reference is made to one, Ganga Ramdars missive in your March 29, 2022 letter section whereby Mr. Ramdar opined that “The Government and the PSC are One” and

100-200 persons in Guyana are the anointed (my words) ones and Mr. Ramesh Dookhoo falls smack dab in that mix since Mr. Dookhoo was nominated by Guyanas Private Sector Commission to

be National Resource Fund Board. Hmnnn…I know not if Mr. Ramdar is being disingenuous or if it is a Freudian slip as I read that Mr. Dookhoo was/is the Private Sector Commissions (PSC)

nominee to be on the NRF Board, as I am unaware if a National Resource Fund organization currently exists in Guyana. Mr. Ramdar should ensure that readers are (Continued on page 5)

Speedboat life jackets often ‘stink and dutty’ DEAR EDITOR, Permit me just a small space to make an observation Mr. Editor, which I noticed with the regular Vreed-en Hoop - G/town route with these passengers boats. First of all, I am not sure if the authority of Transport & Harbours Department in Georgetown look into the safety of daily passengers that traverse the river, but on a normal working day, most of the boats have defected life jackets that is…the life span for the jackets has expired; therefore, making the jacket incompetent for river use.

These jackets are soft most times and dirty. For example, just the 31st March, I saw a young lady with a white shirt sit next to me, after she wore a jacket and exited the boat, I know that she wasn’t aware of how dirty her shirt collar was until I informed her about it. Mr. Editor, this is totally unacceptable. The owners for these boats can do better for the comfort of

passengers. Finally, I was travelling on Saturday night (26th March 2022), it was the last boat loading from Vreeden Hoop side heading to Georgetown, as I approached to board the boat, the bowman (I didn’t get his name) told me $200 is the fare. The boat had like exactly 10 persons. Everyone almost agreed, to pay that fare he called when he came in the boat and said, “Umm yall have to pay $500 a man because nobody aint coming and I have to mek target.” Now, everyone in the boat starts quarrelling that they can’t pay that. He (the bowman) was annoyed; he chased us out the boat, yes chased us…”Come out meh boat” (this can be verified if an investigation is launched).

Therefore, we all leave the boat and take a bus to Georgetown. As I looked back, I heard him using a series of indecent language.

Do banks, other businesses have the authority to mandate masks wearing?

DEAR EDITOR, Once again, I have cause to write highlighting the lack of education and comprehension of Guyanese. In this instance, the commercial banks in Guyana took it upon themselves to implement their own COVID-19 guidelines, which is admirable. However, those guidelines are in stark contrast to that of the Public Health Ordinance gazetted on the 14th day of March 2022.

In Section 4 (c), it clearly states that “…all employees, customers and visitors are encouraged to wear face masks.” Note the language is very careful and it never mandates, nor does it give the banks the authority to mandate wearing masks. In fact,

Section 6 of the said Order clearly states that wearing a mask is NOT mandatory.

There have been a lot of conflicting information circulating, claiming that businesses have the right to make their own rules.

However, this is not reflected in the gazetted Order.

Therefore, where is this misinformation stemming from?

I, therefore, call upon the Minister of Health and the Government of Guyana to set the record straight, do the banks and other businesses have the authority to mandate masks or is it not mandatory as is gazetted?

David Granger should be removed as representative of the APNU+AFC list DEAR EDITOR, At this point, David Granger is sabotaging his party, the PNCR as well as the APNU-AFC coalition. Mr. Granger doesn’t need a letter from the Speaker to extract the two names from the coalition’s list of candidates to fill the two vacancies in the National Assembly.

He is aware of the resignation, and the APNU has written to him directing him to extract the name of PNCR leader Aubrey Norton.

One vacancy was created with effect from March 15, with the resignation of Attorney-at-Law Joseph Harmon. The second vacancy was created by the resignation of Dr. Nicolette Henry, effective March 31. Dr. Henry gave notice of her resignation in February.

There is no law restricting the Representative of the APNU-AFC coalition list from extracting the names to fill these vacancies before the effective dates or before he gets official notice from the Speaker or the Elections Com-

mission.

It is disgraceful that the PNCR and the APNU couldn’t put aside t h e i r i n t e r n a l wrangling and act in the national interest and that of their constituents and coordinate these departures from Parliament by extracting names to fill the consequent vacancies in a seamless manner that was not injurious to the national interest.

Furthermore, it is reckless and irresponsible for Mr. Granger to fail to effect the direction given to him by his party, in his capacity of Representative of the List.

It is an unpardonable abomination to have left the constitutional office of opposition leader vacant, given the importance of constitutional office, which he once held.

Already, the consequence is devastating.

lieve that Mr. Ramdar, perhaps, has a personal axe to grind, singularly, against Mr. Dookhoo or collectively, against this current administration.

Mr. Ramdars profligacy of thought should be better cohered.

It is clear that the strategy to move the PNCR leader into that position has been hampered by an abysmal lack of strategic thinking!

We, the coalition supporters, and Guyanese, don’t care who doesn’t like who and who thinks what of another leader.

The only thing we care about is your fidelity to the people who elected you to represent them, and to the l a w s o f G u y a n a . M r.

Granger found the time to write a letter to the Speaker advising that he is overseas receiving medical treatment.

We empathize with him and wish his well and speedy recovery.

But what utter nonsense? That said letter could have been a one line letter directing the Chief Elections Officer to extract the name of the individual to replace Joseph Harmon or Dr. Nicolette Henry. Mr. Granger should desist from his childish obstructionism and act in

the interest of his party!

Just as he was a complete failure during the last election saga, David Granger has again failed the people.

I believe he should resign or be removed as Representative of the List, if the law allows for such a removal. The APNU-AFC coalition as a political opposition has been a disaster.

They are failing in their responsibility to provide adequate representation for their constituents This needs to end now.

Trade union promises intensified 4 patients still in protest action over cost of living woes The Guyana Workers’ Union (GWU) is gearing up for intensified protest action if the government does not show compassion to its citizens, and render them much needed assistance to resist hardships associated with heightening cost of living.

The Union, in a show of dissatisfaction, held another protest outside Parliament Building yesterday, and has further increased calls for assistance to the public. GWU’s President Norris Witter told Kaieteur News that, given the ever increasing cost of living and the excruciating pain that is being felt by the elderly, in addition to demands made during their last protest, the Union is now, “…demanding a review of the old age pension, and the National Insurance Scheme (NIS) pension.”

In addition to that, Witter said that the Union is also calling for the review of public assistance.

He said that having commenced their picketing exercise last week, the Union felt that it had given adequate time for the State to show some type of sympathetic response toward citizens.

Having not done so, Witter said that the Union is now prepared to assess activities that have occurred so far, and if need be, will intensify the struggle for assistance regarding rising living costs.

plained too that emanating from the rising cost of living is a growing concern not just among its members, is the possible increase in crime.

He said that, “because of the escalating cost of living, the increase in crime; people feel that their personal security is also being compromised.”

The Union leader stated however, that, “In reality, what this is all about, is a poor people’s protest that may very well morph into a poor people’s campaign.”

He emphasized that if the State needs to be nudged in order to address the plight of the poor and ordinary people, “then we are prepared to do so.” He highlighted that the Union is also putting on record its intension to not yield, “until demands that are on the table are considered and positively responded to.”

He said that while the Union has been making its case under the shadow of the Hubert Nathaniel Critchlow statue, the father of trade unionism which sits in Parliament’s courtyard, the organization is ready to take its protests to other locations simultaneously, and with the support of other workers’ unions and civil society groups fighting the same cause.

Financial mechanism Yellowtail approval for small farming communities, predictable- Transparency Group Indigenous people need to be FAO 37th session…

- Govt. appears to dance to the tune of any interests but the people's The Environmental Protection Agency's (EPA) approval of the Yellowtail Development project which is being undertaken by Exxon Mobil's subsidiary Esso Exploration and Production Guyana Limited (EEPGL) has come as no surprise President for Transparency Institute of Guyana Inc., Fredrick Collins has stated.

The head of the civil society body in a preliminary r e a c t i o n t o E PA ' s announcement yesterday has described the move as coinciding with government's actions of belittling the law and not allowing state agencies to act independently.

“It was predictable,” Collins told the Kaieteur News. He said that, “It is in conformity with the general posture of the EPA that appears to dance to the tune of any interests but those of the ordinary people of this country.” He said the approval, “shows why the politicians insist on not allowing any of our regulatory bodies to display independence and is yet another attempt at the trivialization of our laws which will stand unless ordinary people put themselves to great expense to challenge it.”

Collins charged that the approval of the Yellowtail is what happens when the

people who are paid to work in citizen's interests, perversely use those very human and technical resources against the interests of the people.

Collins made his statements based on inconsistencies that occurred with existing oil wells; Liza 1, 2 and Payara. As it stands, Guyana has been unable to achieve assurances for full liability insurance coverage for the three existing wells in the unfortunate case of an oil spill or other environmental disaster. While commenting on the FAO's new strategy on climate change, Minister Mustapha indicated that these mechanisms should be able to make resources readily and equally available for smart, small adaptive and uninformed research given the effects climate change continues to have, especially on those groups mentioned above.

“We would like to see a reference of a financial mechanism that makes resources readily and equally available for smart, small adaptive and uniformed research targeting small farming communities and Indigenous people. And today, when the world is being faced with the serious problem of climate change, we have seen the devastation in some countries. I think we have come to a point where we have to make a decision on what is necessary for us to move forward,” Minister

Minister Mustapha's remarks were in support of comments made by St. Vincent and the Grenadines' Minister of Agriculture, Forestry, Fisheries, Rural Transformation, Industry & Labour, Saboto Caesar who maintained that more time, money, and efforts must be allocated toward developing a climate change strategy for the small island developing states in the region particularly the importance of the blue and green economy.

Minister Caesar noted too that some of the fundamental principles and precepts of the Samoa pathway should be reintegrated. As such, he called on the FAO to promote more nature-based solutions when addressing the issue of food and agriculture.

Moreover, Minister Mustapha added stated that climate change continues to be a serious problem for small island developing states in the Caribbean and called on the FAO to take a stand on the issue.

In fact, he said, “My colleague from St. Vincent and the Grenadines suggested that a marine resources survey be conducted. Such a survey is very important for us in the region because the blue and green economy in these parts

of the world contributes significantly to poverty reduction.”

He further disclosed that currently climate change is causing serious problems within countries in the small island developing states, especially in the Caribbean.

To this end he said, “We are so vulnerable to climate change that now, as we are working to improve our agriculture capacity, it seems as though we are taking risks because of climate change. We cannot allow one or two countries to dictate the pace of our way forward. We are living in these times and we are living in these vulnerable places.

We know what we are experiencing and we are now appealing that the FAO must take strong measures and take a stand on this issue.”

In sharing further sentiments, the Minister explained that in Guyana, the government has been working to combat climate change through low-carbon development by developing high potential low carbon subsectors and industries, drought and flood management, and by practicing climate-resilient agriculture with special focus on Mangrove and Coastal Ecosystem Restoration, Integrated Pest Management (IPM), and (Continued on page 9)

The Auditors are coming!

In the past, whenever civil servants heard that the auditors would soon be arriving, there would usually be a spurt of activity to ensure that all the accounts and records were in order. Everyone dreaded to receive a negative audit report. Auditors then were feared and respected.

Later, the practice became common for auditors, from the Auditor General’s Office to be stationed at various government offices to monitor and to audit transactions. Being on site, it was felt, was much better in intercepting fraud and deviations from the financial regulations. The latter system has not proven effective. Having the Auditor General auditors stationed at government offices, permanently have not had the desired results.

And for the simple reason that the Auditor General is not the internal auditor of government departments. The Audit Office is the external auditor and its principal function is to ensure that the fi-

nancial statements of government entities have been properly prepared, in accordance with applicable law, and properly present the operations and affairs of the entity concerned.

During the course of an audit, fraud and other financial irregularities may be unearthed but the types of audits, which the Auditor General is mandated to perform, does not guarantee that financial malpractice will be uncovered or intercepted.

It is for this reason that it is much better for the government to have in place strong internal audit departments which, in the case of government Ministries and departments, report directly to the Accountant General. In the case of government corporations which receive public subventions, there is need for stronger internal audit departments which undertake real time audits of transactions and report directly to the respective boards of directors.

In his 2014 Budget

Speech, the then Minister of Finance had indicated that efforts were being made to strengthen the country’s internal audit capability through the operations of a high level oversight committee. It is not clear whether this high level committee ever functioned, who were its members and just what it achieved.

The then Minister of Finance also had hinted that a centralised internal audit staff would have reviewed findings in the Audit Office’s annual report and follow-up with government agencies to ensure compliance with the relevant laws and regulations.

An Internal Audit Division was said to have been established. The success of these measures could best be judged by the litany of financial woes and irregularities unearthed each year by the Auditor General’s Office. In effect, the perception remains that the government’s efforts to strengthen its internal auditing capabilities has not led

Truck driver strangled at worksite then dumped in river Police are now probing a case where a 69-year-old truck driver was attacked and strangled at his worksite, BK Quarries, located along the Mazaruni River in the Region Seven district. Police believe that he was killed after 18:00hrs that evening and then dumped into the river.

The dead man was identified as Pitamber Sharma of Independence Street, La Grange West Bank Demerara (WBD). According to police, Sharma was employed as a truck driver at BK Quarries.

that Sharma probably fell over board and had drowned but an autopsy conducted on his remains proved otherwise. It is believed that Sharma was murdered.

The autopsy revealed that he was manually strangled. This means that whoever might have strangled him then decided to get rid of his remains by dumping his body into the river.

Region Seven investigators are now seeking leads in identifying a suspect in the truck driver’s murder.

to any appreciable improvement in financial accountability or helped much to root out corruption. The plans to strengthen the internal audit capabilities of government were doomed to fail. They were aimed primarily at responding to the issues identified in the Report of the Auditor General.

There was a change in government in 2015. The new government also came with a bagful of promises, including one to have the country’s Finance Secretary spearhead a project to review the needs and capacity of each Budget agency in order to implement a proper system of internal audit. The Coalition government conceded that “few budget agencies, if any at all, can boast a proper system of internal audit that meets the

test of competency, independence and professionalism required for the oversight of the spending of hundreds of millions of dollars.” Later, the Coalition government would indicate that its forensic audits pointed to the weakness and, in some instances, the absence of internal audit systems and departments.

Nothing much has changed. It can hardly be said that there is effective oversight of the spending of billions of dollars in public funds by government agencies. In many instances, it is believed that the internal audit departments of government agencies are weak and anaemic. Special attention should be paid to certain government agencies and corporations, which receive large government subventions.

There is a need to strengthen internal audit systems in these entities. Internal auditing should be decentralised, rather than centralised. Every government Ministry, agency or department should by now have had a full-time and adequately staffed internal audit team, which reports to the Accountant General.

This is one area where professional and permanent staffing should be increased.

And there would be no need for as many as 8,000 new jobs.

Sanjeev Datadin's points are also powerfully theoretical

T

his newspaper carried yesterday, an enunciation by attorney, Sanjeev Datadin, a Member of Parliament on how elected governments use power. I am sorry I missed his presentation. I didn't know about it. But on reading his articulation, it reminds me of the first-year class in politics when you are a freshman at university.

Let's first describe Mr. Datadin's two main points then offer a discussion. First, he argued that a group just cannot make claims on a government for documents.

He said that such documents are confidential and the role of government is to preserve such activities of the state.

He used the word, “nonsensical” to describe the surreal situation in which an elected government must get

the approval of this and that group for the projects the government undertakes. The second elaboration of the MP is that they are outlets that society provides for citizens to influence the direction of a country. He cites elections.

Mr. Datadin used the words, “not practical” in his rejection of organisations and groups and other entities that demand governments talk to them about sensitive projects. I will not dignify the argument by anyone that groups of concerned citizens must be accommodated by elected administrations when they want to see state documents and be consulted on the projects of government. No government from modern time right up to the present moment embraces such an approach to the use of power. Not only

is it not practical, it is fraught with danger, which I will analyse below.

I believe the two points of Mr. Datadin are strongly theoretical and all politics textbooks, without exception, carry an elaboration on how governments must function and those texts are generally supportive of the articulations of Mr. Datadin.

It was the first philosophy book on power in western civilisation that delineated how governments must administer the society – The Republic by Plato. He outlined how government must function and the role of representation. Plato was saddened at how his teacher, Socrates, was arrested and sentenced and sought to correct some of the pitfalls of Socrates' theory.

What we have in the 21st century is the continuation of the mistake Socrates made thousands of years ago.

Dismissive of mediocre government in Athens, Socrates took it upon himself to demand changes. He was seen as a one-man army that the Athenian government felt had no moral obligation to listen to.

But even Plato in strengthening Socrates had holes in his theoretical formulation. It was left to the teacher of Plato, Aristotle, to strengthen Plato's perspective by introducing legal representation in the use of power. The Roman Empire was respectful of Aristotle's contribution and made representative government a permanent fixture in politics, which today is found in the constitution of all countries.

Modern civilisation owes a permanent debt to Aristotle.

Mr. Datadin did not need to lecture his fellow panelists on how governments operate. The countless textbooks of the distant past and from modern times are there to guide anyone interested in politics. In representative government, elected politicians are

entitled to make demands on the government not any and every group.

ExxonMobil gets green light

for 4th project T

he Environmental Protection Agency (EPA) announced yesterday that it approved the Environmental Authorization for the U S $ 1 0 B Ye l l o w t a i l Development Project. The Environmental Permit was granted for a period of five years to ExxonMobil subsidiary and operator of the Stabroek Block, Esso Exploration and Production Guyana Limited (EEPGL) to undertake the requisite construction and operation of production facilities.

The approval comes after the EPA considered public inputs during all statutory periods for public consultations and review.

The EPA was keen to note that it took into consideration, the technical review and recommendations from a team of Independent International Experts, and the Environmental Assessment Board (EAB).

The permit contains several key provisions which speak to flaring, oil spill response and financial assurance and monitoring. It also includes a new provision on receipt of grievances.

On the matter of flaring, the Permit strictly prohibits routine flaring and venting, and specifies that it is only permissible during commissioning, start-up and special circumstances. The Permit also goes further to maintain payments in instances where flaring is

conducted beyond permitted durations. Kaieteur News previously reported that EEPGL would have to pay US$45 per tonne of carbon dioxide equivalent, which it is permitted to flare.

Among its other notable conditions, the permit requires EEPGL to procure a Capping Stack to be maintained, tested, and stored in Guyana.

A capping stack is a large well closure device that connects to the top of the blowout preventer (BOP) and is capable of sealing off a well. It is a form of modern technology (available post the Gulf of Mexico, Macando incident) to cap a well in event of a loss of well control, and failure of the blowout preventer (BOP).

Additionally, EEPGL must maintain access to at least one (1) overseas subscription service, to allow mobilization of a Capping Stack to the project location.

This serves to fortify safety and emergency response efforts since wells would be swiftly capped in the event of a well blow-out.

Importantly, the Permit also ensures that EEPGL is held liable for all costs associated with clean up, restoration and compensation for any pollution damage, which may occur as a consequence of the project.

EEPGL is also required to have financial assurance which includes a

combination of Insurance which must “cover well control, and/or clean up and third-party liability on terms that are market standard for the type of coverage.”

It also requires a Parent Company/Affiliate Guarantee Agreement which indemnifies and keeps indemnified the EPA and the Government of Guyana in the event EEPGL and its CoVenturers fail to meet their environmental obligations under the Permit.

Further, the Permit states that the financial assurance provided “must be guided by an estimate of the sum of the reasonably credible costs, expenses, and liabilities that may arise from any breaches of this permit.

“Liabilities are considered to include costs associated with responding to an incident, clean-up and remediation and monitoring.

In seeking to ensure EEPGL meets its obligations to prevent and mitigate environmental harm, the P e r m i t i m p o s e s comprehensive requirements for monitoring and management of any impacts affecting biological, physical, and socioeconomic resources within the Area of Influence of the project, including targeted and updated environmental baseline studies.

The permit also requires EEPGL to submit safety case information, including a risk assessment prior to drilling

Further, EEPGL is also enjoined to establish and maintain a Grievance Mechanism in keeping with the World Bank's Approach to Grievance Redress in

projects, to ensure that complaints from individuals and communities who may be affected by the project are received and addressed.

Flour to see another steep increase in prices With the cost of wheat increasing, the Caribbean Millers' Association (CMA) has pointed to the increases in prices for flour across the region. It said drought in the US and Canada and the impacts from the RussiaUkraine war have seen prices climb more steeply.

The CMA has explained that, “With Russian and Ukrainian wheat accounting for close to 30 percent of the worlds exported wheat, this has affected not only the price of the commodity but also the logistics and transportation. These factors mentioned above have led to imminent or actual price increases in the cost of producing flour due to increases greater than 40 percent in the cost of raw

(NAMILCO) which was forced to announce a 15 percent increase in its products last month, is gearing up to raise the price again. The price hike caused the price of the

commodity increase to jump from $280 per pack of selfrising flouring to as much as $400 and $460 The company in the daily newspapers said, “Manufacturing companies worldwide are experiencing unprecedented increases in the costs of raw materials, freight, packaging materials, e n e rg y, a n d o t h e r inputs…the price of wheat today is 40 percent higher than it was on February 15, 2022 just three weeks ago.

During this period, we have also seen increases in the cost of packaging, additives, and just recently, fuel.”

As a consequence, NAMILCO said it can no longer sustain its operations at the current price for flour.

In this regard, the milling

company said it must increase its prices by 15 percent with immediate e ff e c t , t o e n s u r e t h e continued supply of the important commodities. “ We w i l l w o r k a t leveraging economies of scale available to us (through wheat vessel ownership) to mitigate some of the adverse impacts of freight logistics, market access and raw material supply,” the company assured.

It said too that last year when Guyana was impacted by rising costs, NAMILCO absorbed these escalations and avoided passing the costs to its customers, however no other option is left in this specific circumstance.

Natural Resources Minister says...

Yellowtail Project to cost US$10B N a t u r a l Resources Minister, Vickram Bharrat disclosed yesterday that the Government of Guyana and Esso Exploration and Production Guyana Limited (EEPGL) signed the Petroleum Production License (PPL) for ExxonMobil's fourth project called Yellowtail which will cost US$10B. It is important to note that this cost is recoverable by EEPGL, ExxonMobil's subsidiary.

Bharrat said the project in the Stabroek Block is expected to produce up to 250,000 barrels of oil per day after startup in late 2025, using the 'One Guyana' floating production, storage and offloading (FPSO) vessel. He said the US$10 billion development project will target an estimated resource base of about 900 million oil-equivalent barrels while adding that this is now the largest single investment in the history of Guyana.

Prior to the approval, he reminded that the Government of Guyana contracted Bayphase Oil and Gas Consultants. He also revealed that the

Most importantly, he said the team of technical experts assessed the project to ensure that all relevant regulations are complied with and that they can be enforced. Minister Bharrat said this included environmental standards and reservoir management

for the sustainable and responsible operation of the project, in conformity with the best international s t a n d a r d s a n d environmental safeguards associated with a project of such magnitude.

Minister Bharrat was keen to note that the government and its regulatory agencies are satisfied with all the reviews and long hours invested by both local and international experts to finally have a licensing agreement for the Yellowtail Project, which will benefit all Guyanese, thereby realizing the 'One Guyana' vision.

Additionally, he said this project will build on the recently sanctioned local content legislation for each stage of the project as it relates to workforce development, supplier development, and overall strategic investment.

The Government of Guyana he reminded, remains committed to managing and extracting Guyana's oil and gas resources sustainably in keeping with internationally recognized acceptable environmental standards and transparency.

Construction of US$600M Vreed-en-Hoop Port to commence this year The construction of the US$600 million Vreed-enHoop Port, which will sit on 400 hectares of coastal land, is slated to commence this year.

NRG Holdings Incorporated, a 100-percent Guyanese-owned consortium along with Hadi's World Incorporated, National Hardware Limited and ZRN Investments Incorporated are the Guyanese investors involved in the project.

They have partnered with Jan de Nul Group, a Belgian engineering and construction firm which offers marine services, offshore service, civil engineering, environmental management activities and project development.

With plans to bring their multi-million dollar project on stream within three years, the company reported that the construction of the port will commence in 2022.

He said the port will allow for those services to be provided from Guyana.

He explained that the first phase of the project is an oil and gas shore base, followed by a commercial port. Notably, he shared that along some of the benefits expected are the reduction of shipping costs by up to 15 percent and incomegenerating opportunities.

“When we conceptualised this, we did not put services that you in the community can sell to us, food, housing, groceries…,” he said, adding that 220 persons will be needed during the construction phase.

Man volunteers to take rap for five suspects

man yesterday showed up at Georgetown Magistrates' Court in company of a lawyer to take the rap for five suspects who were busted on Tuesday last with more than $12.5M worth in cocaine and ecstasy at a house located in Prashad Nagar, Georgetown.

Unfortunately, his attempt to convince the magistrate presiding over the matter, Sherdel IsaacsMarcus, that he owned the drugs proved futile after his claims were rejected in court.

Instead his lawyer was advised to take him to the Customs AntiNarcotics Unit (CANU and turn

him in there.

The magistrate then went ahead and charged the five defendants, Lena Narine aka 'Aunty Lena', 62; James Herbert aka Uncle James, 60; Kay Jennifer Butcher, 71; Jamal Narine aka 'Tunks', 27; and Gregory Faria, 47, a Surinamese, with the possession of the illegal

substances for the purpose of trafficking.

They all pled not guilty to the charges and were granted $500,000 bail each.

The Ambassador furthermore commended GMSA in the part it plays in the development and economic diversification of Guyana.

Small Island Developing States must take lead on guiding necessary steps on climate change With many countries in this part of the region being the most affected by the devastating impacts of climate change, Agriculture Minister Zulfikar Mustapha thought it prudent to urge other Small Island Developing States (SIDS) to voice their thoughts and opinions on matters relating to the global climate change mitigating efforts.

Minister Mustapha was at the time addressing the 37th session of the United Nations Food and Agriculture Organization ( FA O ) R e g i o n a l Conference for Latin America and the Caribbean in Quito, Ecuador.

While speaking during Friday's ministerial session, Minister Mustapha said developing countries and SIDS have very low Carbon Dioxide (CO2) emission levels when compared to developed countries with large established

Given the fact that developing states are most affected, the Minister noted that it was time for developing countries to take the lead in making and guiding the necessary steps to curb climate change.

In highlighting Guyana's efforts in this regard, he explained that for years, Guyana has been recognized for its global leadership in climate and forest conservation efforts and interventions through its Low Carbon Development Strategy (LCDS).

“Guyana's Low Carbon Development Strategy is a framework intended to map the pathway of a new growth trajectory in a nonpolluting way. Recognizing that the first objective of the LCDS requires international action, Guyana had sought a partner who shared the country's vision, and, in 2009, Guyana and Norway agreed to work

together to create a model to advance these efforts. At that time our then President Dr. Bharrat Jagdeo and the Government of Norway signed an agreement that would see Norway providing Guyana with results-based payments for forest climate services alongside cooperation between the countries in the fight against climate change, the protection of biodiversity, and the enhancement of sustainable development,” explained the Minister.

He added, “For the period 2009 to 2015, Guyana earned US$212.5 million which was then invested in our LCDS. This has created low carbon jobs enabling indigenous villages to receive legal titles for communion lands, funded critical rehabilitation of canals to protect against flooding as well as the initial procurement of materials to equip indigenous and hinterland communities with renewable energies, digital

While five contractors have placed bids ranging from $639 million to $896 million, it was Platinum Investments Inc. that bid the lowest at $599 million to execute the construction of the pump station.

It should be noted that this project forms part of the $13 billion that was allotted in the budget this year to upgrade drainage and irrigation systems across the country.

Senior Minister with responsibility for Finance, Dr. Ashni Singh who presented the national budget back in January, had said that in strengthening the drainage and irrigation network across all regions his government has allocated over $1 billion to procure 37 new mobile pumps to be installed along the coast, in Regions Two, Three, Four, Five and Six, in areas identified to be vulnerable to flooding.

“Further, 100 tractordriven pumps will be purchased to be utilised in all coastal Regions. This will be complemented by the construction and rehabilitation of pump stations at Canal No. 1, A-Line sluice WBD, Charity and Cozier, which will benefit over 9,500 acres of coastal farmlands,” he explained.

Following the opening of that project, bids were also received for the provision of consultancy services for the design review and supervision for the construction of the Canal Number 1 pump station.

T&T to host remaining WI Championship matches - Guyana resumes campaign against defending champs When the 2022 West Indies Four-Day Champion resumes on May 18, the next three rounds that are scheduled to unfold, happens in the Twin Island Republic at three venues identified by Cricket West Indies (CWI).

The Diego Martin Sports Complex will be added to the list of Trinidad and Tobago’s 13 First Class venues at the tournament’s resumption.

The Queen’s Park Oval and Brian Lara Cricket Academy are the other two venues pit-

ted for the upcoming rounds.

Rounds one and two of the Championship took place in February (in both Trinidad and Barbados) ahead of the WI-England Test series. And the final round of matches will take place ahead of the pro-

Pugilists sign on the dotted line Just three weeks remain before the return of professional boxing to Guyana as pugilists prepare for Guyana Boxing Board of Control’s (GBBC) Guyana Fight Night Road to Redemption card, which is scheduled for the Guyana National Stadium, Providence.

Yesterday, the fighters inked their contracts for their potential fights at Abdool and Abdool Inc.’s head office in the presence of President of the GBBC, Peter Abdool, Director of Sport Steve Ninvalle and Promoter, Aleem Hussain.

The Director of Sport disclosed that the initiative of bringing professional boxing back to the fore was something the government lunged at without hesitation. Ninvalle further reassured the GBBC of the government’s commitment who will be supporting every step of the way.

The Promoter stated that his team has kicked the marketing aspect into high gear ahead of the event. He believes he has set the largest stage for Boxing in Guyana and it is now up to the fighters to display their skills to the fullest.

In the feature bout of the evening, 36-year old Guyanese Elton Dharry faces the undefeated 28-year old Orlando Penalba of Panama for the WBC International Super Flyweight Title on April 23.

The headlining bout will be experience versus youth since the Guyanese boasts an 18-year career that has 25 wins, six losses and a draw in comparison to the young Penalba who has 11 wins and a draw.

At the signing, the fighters for the main event were not present, neither was Dexter Marques’ opponent.

Meanwhile, in the co-main event, Guyanese Dexter ‘The Kid’ Marques challenges flyweight Gilberto Pedroza, also from Panama.

The 36-year-old Marques enters as the favourite with a record of 19 wins and two losses, while the 29-year old Pedroza also has 19 wins, but nine losses and two draws to accompany that.

Guyana’s track and field stars will have a wonderful warm up for the 49th Caribbean Free Trade Association’s (Carifta) games which is scheduled to be hosted in Jamaica this Easter weekend, as Athletics Guyana (AG) has revealed that tomorrow they will host the ‘Super Champs’ track

meet.

The Super Champs track meet will be held at the National Track & Field Center (NTFC), Leonora from 10:00hrs and it will peg the junior athletes; including those that have qualified for this year’s Carifta Games, against the senior athletes in the country.

A total of nine athletes have qualified for the championships and President of Athletic Guyana; Aubrey Hutson, has hinted that Guyana may have at least two relay teams heading to the championships.

Softball fraternity in shock at sudden passing of Lakeram ‘Mike’ Singh The softball fraternity was left in a state of shock as Wellman Masters, Legends and Wellwoman owner Lakeram ‘Mike’ Singh passed away on Thursday in Florida.

Singh was at the time playing for Wellman Legends of Georgetown in the over-50 category in the Florida Cup in the USA. A source told Kaieteur Sport that he collapsed on the field after bowling a spell, and was rushed to a nearby hospital where he succumbed.

Singh who was the Proprietor of Mike’s Pharmacy, also played for Floodlights and was an executive member on that organisation. He also sponsored and organised an inter-county softball competition, sponsored U19 tournaments in Wakenaam and supported cricketers in Guyana.

He also did charitable works.

Wellman, Regal Legends and Regal Masters are the Guyanese teams participating in the tournament.

Many organisations expressed their shock at his demise. GSCL Inc noted -The executives and members of the Georgetown Softball Cricket League Inc (GSCL) is saddened by the untimely passing of Lakeram Singh of Mike’s Wellman Softball Cricket Team. GSCL wishes to extend sympathies to the immediate family of Singh, the staff of Mike’s Pharmacy, his former teammates and by extension the entire cricket fraternity on the passing of the softball cricket stalwart. The news of ‘Mike’, as he is called, has placed a damper on the ongoing Florida Cup in Fort Lauderdale but as a league we

will dedicate the rest of the tournament to our beloved friend who was on his maiden tour with Mike’s Wellman.

Our prayers are with this wife, children, other relatives and many friends at this difficult time. At the time of his death, Singh, who was fondly called Shane Warne because of the huge turning leg breaks, was leading his side in their second preliminary round match of the Florida Cup 2022 when he collapsed on the field after bowling his spell. We have lost a true gentleman who was a fierce competitor on the field. Mikey died while doing what he loved. Rest in peace Mikey. Until we meet again.
