Partnering with Grow Limited We are really pleased to have partnered with Grow Limited, a Guernsey based charity that provide a career in horticulture or related craft industries for people with learning and other disabilities. They aim to provide a safe and secure working environment allowing employees to build up their self respect and confidence levels by being able to work and interact within our community. Grow are helping us provide environmentally sustainable gifts to our clients which are plastic free and great for pollinators, indoor or outdoor depending on the property that is sold or let. Emma Le Cloarec from our marketing and admin team said: “We have been pushing to provide a service that has a better impact on the environment, and supporting a charity like Grow that can produce sustainable gifts for our clients is a fantastic way to do so!” In addition, providing a gift from Grow to new people that have moved to the island will also help build awareness of the charity. They will be able to see the quality of arrangements that are produced by people with learning difficulties and hopefully lead to more people supporting them.

The sky’s the limit for Ross Yeates “I have always had an interest in photography dating back to my A levels (many years ago now!!). Drone footage/photography has been around for some time now and I had always been keen to try it. I bought my first drone at the start of the year and fell in love with the incredible perspectives they can give you, in particular of our island. I began to take photos and a lot of footage of the surf and surfers, which is one of my other passions. This led further to various shots of our island, bays and beaches. Having previously read the guidelines for use of a Drone on island, there are certain qualifications you require in order to operate commercially. I undertook these earlier this year and now hold a permit to undertake aerial photography for Cooper Brouard. I love that I can use one of my interests for my day to day job, not only that, but it is another additional service which we can offer in house to our clients.”

More records predicted to tumble this Autumn After another eventful year that created its full share of challenges, the durable Guernsey Property Market cast off many of the concerns and enjoyed a strong bounce back with significant confidence, particularly across the residential sectors. The extreme demand for Lettings, exasperated by encouraging occupiers of former Part D Lodging Houses (now known as Houses of Multiple Occupancy) into Local Market housing, created a cascade effect that quickly increased the demand for Local Market sales from discerning landlords as well as traditional homeowners. The confidence very quickly spread to our Open Market that was ready

for awaited growth in value and subsequently outstripped expectations for the year. Historically, the Open Market has commanded a greater premium over Local Market than we have seen in recent years. This years events may well suggest that there remains more headroom for that difference to build again as the UK faces up to new challenges such as the acute shortage of labour and the mounting burden of debt with rising interest rates. Whilst we are not immune from similar difficulties, we have an administration that is working with business and commerce effectively. Locate Guernsey demonstrates the commitment, to offer

a range of ancillary help and guidance, enjoying an active and successful third quarter. Given the continuing level of enquires and agreed sales, all the indications suggest that various records may well be broken before the year comes to a close. Working from Guernsey Over the last 18 months or so, as the world struggled with the Covid pandemic, Guernsey has seen an influx of new permanent residents. There has also been many who have come to the Island to stay with family or friends. This is great for Guernsey both culturally in terms of new residents; and financially due to the income generated by them. The question posed is whether those here for the shorter term are fully aware of the potential tax and social security reporting and associated liabilities that may have been triggered, both individually and for their employer. Tax in Guernsey for an individual is usually determined by residence. Residence in turn is a matter of day counting, once you reach 91 days or more on the Island in a calendar year, you are tax resident. If you are in Guernsey “working from home” but undertaking duties of employment for a UK employer, then hopefully you have already considered the tax and social security implications for both you and your employer. It may also be that the Guernsey/UK double tax treaty might be applicable to ease tax exposure. The double tax treaty applies, very simply, so long as you have not been in Guernsey for more than 183 days in any 12-month period that starts or ends in the relevant tax year. If you breach that requirement (there are other elements of the treaty to consider) there is a good chance that you may have a liability to Guernsey taxation upon your employment income. This may mean that a UK employer needs to consider its UK PAYE arrangements and whether it has any Guernsey ETI contribution requirements. Not only that, the question of UK national insurance and Guernsey

social security contribution also needs consideration. As a rule of thumb, social security contributions are required in the jurisdiction where you are working. The UK/Guernsey social security reciprocal agreement may, in some instances, help alleviate this issue. It is also possible, depending upon the work undertaken in Guernsey, that the individual might have inadvertently triggered a Guernsey corporate tax exposure for their UK employer through what is known as a “permanent establishment”. The Guernsey company standard rate of tax is 0%, so, even though it likely no company tax may be involved, the tax reporting requirement is likely significant.
