DEVELOPMENT SERVICES We act for and on behalf of private individuals, landowners, farmers and estates, local authorities and private & public institutions, housebuilders/developers and registered providers/housing associations as well as building contractors.

Our team deals with single building plots, barns for conversion, Class Q and other prior approval conversions, buildings for conversion and multi plot sites from 2no. upwards, including urban extensions and new settlements.

We cover the South West, including Cornwall, Devon, Somerset and Dorset.

AGENCY SERVICES

STRATEGIC LAND SERVICES

We provide bespoke, site specific development agency advice. This includes appraising the value of sites using our knowledge and experience, comparable evidence and Argus Developer software; identifying any legal, planning, tax or technical issues following our due diligence; setting out our marketing strategies and initiatives in marketing reports, including methods of sale, conditionality of the sale (unconditional or conditional on grant of planning permission), rights and reservations (to retained land or ransom strips); with/without overages (based upon a change of use, an enhanced planning permission, an increased Gross Development Value or a reduced affordable housing provision or financial contributions) and any other site specific advice.

We provide bespoke, site specific strategic land advice. This includes speculative site identification through desktop appraisals; planning and technical due diligence*; making representations to the Call for Sites (SHLAA/HELAA) and Development Plans*; site assembly; advising on Landowners’ Agreements where there are multiple owners (including the principles of equalisation) and on Promotion, Hybrid and Option Agreements with land promoters and housebuilders; setting out our marketing strategies and initiatives in our marketing reports; marketing the land; carrying out our due diligence on offers received; and negotiate detailed Heads of Terms and following agreement issue these. We liaise with all parties through the legal process to exchange/completion of the Agreement.

Our team will market sites using our database of housebuilders/developers, registered providers/housing associations, building contractors and enquiries from those prospective buyers that reply to one of our marketing strategies and initiatives. We openly and fully market sites (unlesss specifically asked to do otherwise); carry out our due diligence on offers received; and negotiate detailed Heads of Terms and following agreement issue these. We liaise with all parties through the legal process to exchange of contracts and completion of the sale of the site.

GTH worked very effectively on the sale of our brownfield site. They advised on planning and listed building consents as well as giving key contractual advice both initially and during the sale process.

WHAT IS STRATEGIC LAND? Strategic land is outside of the development boundary/built-up area of a settlement, but has potential for development. The potential is for it to be allocated within the Development Plan (Local Plan and Neighbourhood Plan) and, following allocation, the preparation and submission of a planning application.

Alternatively, if the local planning authority does not have a 5-year housing land supply of deliverable sites within the authority’s area, a planning application can be prepared and submitted based upon the presumption in favour of sustainable development.

CONSULTANCY SERVICES

VALUATION SERVICES

We provide bespoke consultancy advice specific to each site and matter. This includes advising on development feasibility on both greenfield and brownfield sites*, including housing tenure, mix and sizes; the preparation and submission of Independent Financial Viability Assessments to local planning authorities to support planning applications and the negotiation and reduction of the affordable housing provision, where there is a viability issue; advising on the renegotiation of existing overage provisions and restrictive covenants to vary them to enable development of sites; and advising on price negotiations when price notices are served, following grant of planning permission, in accordance with the terms of an Option Agreement.

Our team of RICS Registered Valuers, with specialist knowledge and expertise in valuing development land and sites, provide RICS Red Book valuations for all purposes.

These include valuations for bank/building society lending, Capital Gains and Inheritance Tax, accounting, receivership, administration & liquidations, charitable and matrimonial/ divorce purposes. These valuations include appraising the value of sites using our knowledge and experience, comparable evidence and Argus Developer software.

Ours was a complex negotiation with multiple parties on a part brownfield, part greenfield site. The hybrid planning permission that was granted enabled a substantial commercial development and circa. 200no. dwellings. GTH showed great tenacity in arranging a deal that ensured our return was maximised.
