


Welcome to the February edition of the Development Sites List. One-twelfth of the year has already come and gone and we have had the Government issue a revised National Planning Policy Framework (December) and the RICS issue a revised Global Standards and International Valuation Standards (January). What other changes are afoot for 2025? Another unitary authority: this time in Devon?
Hopefully the Local Planning Authorities (LPA) within the South West of England, will be progressing their local plans in a timely manner (but not as trigger happy as East Devon) and taking note of their shortfalls in land supply by granting permission for sites in suitable locations. Also such Authorities control their Planning Committees and stop the waste of local communities’ taxes on defending appeals of applications which should have not have been refused in the first place.

One of the Government’s main priories is to help grow the economy, and one of the mechanisms available to achieve this is to increase infrastructure spending. This will more than likely lead to further compulsory purchase schemes, such as new roads, electricity lines, water pipes or railway connections which will affect private landowners and occupiers.
We at Greenslade Taylor Hunt have many years of experience in dealing with compulsory purchase schemes ranging from the new National Grid t-pylon line, right the way through to the laying of underground water and gas pipes, the sale of land to utility companies, Environment Agency river or drainage works, telecom communication masts, and new road schemes, most recently being the widening of the A303 and the Banwell Bypass.
Compulsory Purchase and the associated compensation are complicated subjects with numerous layers of legislation and case law dating back to the 1800’s when it first began. This legalisation continues to evolve, and we note there are two current consultations on Compulsory Purchase Reform in England and Wales being:-
1. Changes to the power to limit compensation payable for the prospects of planning permission (“hope value”); and.
2. Technical changes to the Compulsory Purchase Order (CPO) process and compensation rules.
We as a firm are continually keeping abreast of these changes in order to provide our clients with the most up-to-date advice if you are affected by a CPO scheme. If you are aware of one of these potential schemes affecting your land or property, we always advise to make early engagement with the Acquiring Authority and do not ignore their communications. We would also advise early engagement with an independent Agent who can advise you of your rights accordingly. The Agent’s fees ultimately form part of the final compensation if you are affected; the only exception to this being the fees in fighting the initial CPO order.
