K’chi Noodin Kaamdaaking Progresses

Construction on the “Windy Hills” GTB Herkner Property has been making great progress. One building now stands with siding, while another awaits for installation. This years mild winter months, and a particularly warm March, has allowed for significant headway to be made with the new GTB Property construction. A foundation for a third structure is also already in place. Be sure to look for further updates from GTB News on the Herkner Rd. project in the coming months.

THURSDAYS 4-7P OPEN GYM/DROP-IN CENTER. Op

March 2018 When the weather is cold and uninviting, its always nice to be able to run around the gym and burn off the winter blues. At the Charlevoix site this month, the youth were running around looking for leprechauns and gold, swimming, as well as learned about science by making slime. Our open gym/drop in center is gaining momentum.

Also, the Charlevoix Education Staff would like to give CHI-MIIGWECH to the East Jordan Title VI program for inviting our youth to sit in on their Drum Naming/Welcoming Ceremony. So, we thank Rebecca Gotts, and the East Jordan Elementary for continuing to support our community with cultural exposure to the student body.

I am committed to doing what is best for our Tribe and our membership, with that I would like to continue to advocate for MEMBERSHIP, that we need management to develop plans, with timelines, to eradicate the losses and break even at best, in our losing businesses. We must follow the Revenue Allocation Ordinance, and not in a manner that merely suits a few elected officials political will.

Actually the Revenue Allocation Ordinance was written very well and if followed properly we would be sitting even better than we are now.

If you look at the February report from the EDC CEO, overall revenues are down and losses continue in all other businesses. Undoubtedly we need expert plans to turn these losses around and increase revenues, and not rely on Turtle Creek to cover these losses.

the EDC Board on 3.19.18 to approve a $54 million budget for the newly proposed Leelanau Sands Casino and Hotel. They also voted to approve requesting $20 million of our Government Ops fund (savings) to pay for construction of the casino portion (as a gift towards the LSC—meaning no intention of replenishing the $20 million), and financing $34 million separately for the hotel. The existing LSC and the hotel have been consistently losing money year-after-year, and there are no projections to show new customers that will come to a new LSC to increase revenues! There is nothing to show that LSC or the hotel could sustain ANY NEW DEBT! All we are doing is taking the customers of the old casino and putting them in a new building by the bay. With the new Turtle Creek, nothing changed with revenue at Turtle Creek with the new building, and we just put the customers in a new $120 million building, revenue did not increase.

We have heard from the Elders, and many families that are questioning why are we allowing businesses to be mismanaged, why are we allowing Turtle Creek revenue to fund all of the mismanagement? Meanwhile we are seeing membership issues such as housing and healthcare going unaddressed for months, while we ‘find’ money to fund programs. This is WRONG! What is the best use of our investment funds? As one of Tribal Elders, Ernie Gablow continues to say—“give us the money and we will make sure it is put to good use on behalf of our elders”. We must hold EDC accountable to ensure we have percap, programs/services, and money to invest!

We must invest per the RAO, in businesses that will yield a RETURN ON THE INVESTMENT. Our Tribe must be financially responsible and smart with our businesses, investments, and economic goals for our present and future. My assistant created a visual of our financial situation you can see below.

Also approved by the EDC Board was a budget of $2.5 million dollars for Season’s buffet redesign. That appears to be a high dollar amount for a redesign and I have not seen any presentation to show that it will have a return on the investment. So who will benefit from this redesign? Who benefitted from the Poker Room redesigns, and Level 3 redesign, Bourbon’s 72 redesign…(over a seven-year period we must also include the depreciation costs for the redesigns, still coming out of net revenues). We have seen no return on these multi-million dollar investments, in fact the restaurants within the casinos continue to lose money.

Who is paying for all of this? We are paying through Turtle Creek revenues! Just for sake of comparison, the average Taco Bell franchise is $750,000.00 with an average return on investment of 17%!

A tribal elder, Sandy Bennett, mentioned to me that decisions to spend and invest millions of tribal dollars should require a unanimous vote of the Tribal Council. The LSC/hotel budget of $54 million MUST have support from ALL of Council. We can’t have Council members making decisions in an attempt to get votes rather than doing what is best for the GTB! I have not lost vision or optimism for our Tribe and our future regardless of obstacles. We have many opportunities and potential to grow and manage our Tribe for success of all members. Are we a representative government or a dictatorship? We need the input of the Tribal members. Where are the voices of the members who don’t live in the six-county area? Where is their voice in developments for their county and the at-large members? I hope to have a CONSTITUTIONAL COMMITTEE reinstated very soon to help address these issues.

Effective January 22, 2018, please be advised that Michigan travelers may need to provide additional acceptable government identification when going through security before boarding a plane. Be pro-active and be ready.

PER CAPITA DIRECT DEPOSIT • If you have not already signed up for direct deposit of your per capita checks, Friday, May 4th is the deadline to sign up for a direct deposit of your JUNE 2018 per capita and all future per capita checks. The form must be received in our office by May 4th.

• This deadline (May 4th) also applies to those that are currently signed up for direct deposit and wish to change the bank information.

• Please Note: If you do not have a valid address on file with the membership office, your per capita direct deposit will be suspended until a valid address is received in the Membership Office.

• If you need to change the information for your direct deposit, please submit a new Direct Deposit Agreement form. To request one, you may contact Christina Loucks at (231)534-7131. This form is also available on www.gtbindians.org.

• Once completed, the Direct Deposit Agreement form must be mailed in or dropped off at the Government Accounting building.

Nate Campbell and other GTB NRD personnel have been making traditional Maple Syrup throughout the month of March. The last unusual warm month has allowed a steady stream of sap to be collected from tapped trees. The crew boils the sap twice, once outside and again via conventional stove top. They then strain the sap to remove any unwanted particulates. The Syrup will be used for future traditional feasts at GTB events. For more information on the syrup making process please contact the Natural Resources Department.

“When we come together in a talking circle to talk about sexual violence, it matters how we talk about it and what we think about it. Together we can change how we think and talk about the issue and we can create respect and equality and safety”. We will smudge and have cedar tea available.

GTB Tribal Police Department has developed a Neighborhood Watch Program at four Tribal Sites: Benzie, Charlevoix, Traverse City and Peshawbestown.

APRIL MEETING DISCUSSION TOPIC: Opioid Abuse: Video- Chasing the Dragon: The Life of an Opiate Addict (Approx. 50mins) The opioid and prescription drug abuse epidemic that is sweeping the country is a problem unlike anything we have seen before. This documentary was created to help teens develop a greater understanding of this crisis and the dangers of opioid addiction.

Child Car Seat inspections can be performed at any community meeting upon request.

Community members are invited to meet with the Tribal Police Department Officers and learn about the Neighborhood Watch Program with the focus of prevention and community safety. Community members of all ages are encouraged to attend. Come as a family and learn together, have fun.

The meetings have a short educational component, and an open discussion. The meetings are designed to meet the needs of each community. Please join us!

Notice of Tribal Appellate Court Judge Vacancy

Notice to Grand Traverse Band Tribal Members Appointment of Appellate Judges

The Grand Traverse Band of Ottawa and Chippewa Indians (Tribe(al)) serves notice to the Tribal Membership and licensed attorneys about a judicial vacancy on the Tribal Appellate Court.

The judicial vacancy on the Tribal Appellate Court may be filled by a Tribal Member or a licensed attorney for the balance of the unexpired six (6) term, due to end on September 30, 2020.

This notice serves to inform the membership of the Grand Traverse Band of Ottawa and Chippewa Indians of a Tribal Appellate Court vacancy.

The Tribal Constitution at Article V establishes the Tribal Judiciary and Section 1 states: “The judicial power of the Grand Traverse Band shall be vested in a tribal court system. The tribal court system shall be composed of a court of general jurisdiction, an appellate court, and such lower courts as the Tribal Appellate Court may establish.”

Article V, Section (3)(b) addresses the composition of the Tribal Appellate Court and states: “The Tribal Appellate Court shall consist of three (3) judges. At least one (1) of the three (3) judges shall be an attorney licensed to practice before the courts of a state in the United States.”

Article V, Section (4)(b) sets all Appellate Court appointments at a term of six (6) years. Article V, Section 9 sets forth the process for filling a vacancy and states: “Any vacancy in the Tribal Judiciary shall be filled by the Tribal Council in the same manner as the original appointment for the balance of the expired term.”

The Tribal Constitution also establishes the eligibility and qualifications for the Appellate judges. Article V Section 5 states:

Any person shall be eligible to serve as a tribal court judge only if he/she: (a) Is a member of the Grand Traverse Band who has attained the age of eighteen (18) and/or is an attorney licensed to practice before the courts of a state in the United States; (b) Is not presently a Tribal Council member or running to become a Tribal Council member; and (c) Has not been convicted, within ten (10) years of such appointment, of any felony by a court of competent jurisdiction.”

Any person shall be eligible to serve as a tribal court judge only if he/she: (a) is a member of the Grand Traverse Band who has attained the age of eighteen (18) and/or is an attorney licensed to practice before the courts of a state in the United States. (b) Is not presently a Tribal Council member or running to become a Tribal Council member; and (c) Has not been convicted, within ten (10) years of such appointment, of any felony by a court of competent jurisdiction.”

Interested and eligible individuals are required to submit a cover letter and resume to Human Resources stating their desire to be appointed to the Appellate Court; if licensed, proof of licensure and good standing are also required. The deadline for submission is 5:00 P.M. on April 12, 2018. The Tribal Council may conduct or forgo interviews with the selected candidate appointed at a duly convened Tribal Council session.

1. Are the provisions of SORNA retroactive?

SORNA applies to all sex offenders, including those convicted of their registration offenses prior to the enactment of SORNA or prior to particular jurisdictions’ incorporation of the SORNA requirements into their programs. Jurisdictions are specifically required to register such sex offenders if they remain in the system as prisoners, supervisees, or registrants, or if they alter reenter the system because of conviction for some other crime, whether the new crime is a sex offense.

2. How are juveniles treated under SORNA? Section 34 U.S.C. §20911 provides that delinquency adjudications count as convictions “only if the offender is 14 years of age or older at the time of the offense and the offenses are adjudicated was comparable to or more severe than aggravated sexual abuse or was an attempt or conspiracy to commit such an offense.” (section 2241 of title 18, United States Code).

Additionally, under the Tribal Constitution, Article V which establishes the Tribal Judiciary, Section 1 states: “The judicial power of the Grand Traverse Band shall be vested in a tribal court system. The tribal court system shall be composed of a court of general jurisdiction, an appellate court, and such lower courts as the Tribal Appellate Court may establish.”

These items are to be submitted to the General Counsel, John Petoskey, as soon as possible. Tribal Council appointments will take place at the Regular Session of the Tribal Council on April 18, 2018.

Hence, SORNA does not require registration for juveniles adjudicated delinquent for all sex offense for which an adult sex offender would be required to register.

3. How are foreign convictions and tribal convictions treated under SORNA? Foreign convictions require sex offenders to register under SORNA unless the foreign conviction “was not obtained with sufficient safeguards for fundamental fairness and due process for the accused.” The Final Guidelines establish rules for determining if legal process in foreign countries meet the required standards under SORNA. 4. Do Jurisdictions have to make statutory charges to substantially implement SORNA? While SORNA sets minimum standards for jurisdictions and notification programs, it does not require that these standards be implemented by statute. Hence, in assessing compliance with SORNA, the totality of a jurisdiction’s rules governing the operation of it registration and notification program will be considered, including administrative policies and procedures as well as statutes.

Bipolar disorder: Bipolar disorder is an illness that makes a person’s mood change between mania (highs) and depression (lows) that can last for hours, days, weeks, or months. Having bipolar disorder DOES NOT mean that the person is flawed as it can be treated. If you are someone who suffers from bipolar disorder, you are not alone. More than 5.7 million adults are affected by this illness. It is important to consult a psychiatrist or a general practitioner for assistance to begin your journey to wellness.

Symptoms of mania: • Increased physical and mental activity and energy • Heighted mood, exaggerated optimism and self-confidence • Decreased need for sleep without experiencing fatigue • Racing speech, thoughts, and flight of ideas • Increased sexual drive • Reckless Behavior Symptoms of depression: • Prolonged sadness or unexplained crying spells, profound hopelessness • Significant changes in appetite and sleep patterns • Irritability, anger, worry, agitation, and anxiety • Pessimism, loss of energy, persistent lethargy • Feelings of guilt and worthlessness • Inability to concentrate, indecisiveness • Recurring thoughts of death and suicide

There are three different types of bipolar disorder: 1.) Bipolar I Disorder is characterized by one or more manic (high) episodes that last at least a week or require hospitalization. Episodes of depression and hypomania may also occur. Some mood episodes may have mixed features (symptoms of both depression and mania/hypomania).

2.) Bipolar II Disorder is characterized by one or more depressive episodes accompanied by at least one hypomanic episode. Hypomanic episodes have symptoms similar to manic episodes but are less extreme and don’t last as long.

3.) Cyclothymic Disorder is characterized by chronic mood fluctuations that do not reach the level of full manic or depressive episode.

Caregiver Program WHO IS ELIGIBLE FOR FAMILY CARE GIVER SUPPORT SERVICES? • Informal, unpaid family Caregivers of older adults. An older adult is the age used on your Title VI Part A application that was determined by the tribe to be an elder. .

• Grandparents and relative caregivers, age 55 and older, who are the primary caregivers of a child not more than 18 years old because the biological or adaptive parents are unable or unwilling to serve as the primary caregiver of the child. They must be related to the child by blood, marriage, or adoption and live with the child.

The OAA requires that the Family Caregiver Support Program give priority to: • Caregivers who are older individuals with the greatest social need.

• Older individuals with the greatest economic need, particularly low income individuals.

• Older individuals providing care to individuals with severe disabilities, including children with severe disabilities.

Grand Traverse Band of Ottawa and Chippewa Indians Elders Program – Elders Emergency Services Aanii GTB Tribal Elders: Tribal Council has approved another fiscal year of funding for the “Elders Emergency Service Component” for FY 18. This program is for all elders living within the six-county service area and there are no income requirement.

The guidelines for this service is categorized on your age ranging from $300 to $500.

The Elders Emergency Service program is to assist elder’s that may have an emergency, but is not limited to any situation.

Examples: Food, Heating, cooling, snow removal @ $25/per trip and lawn care up to $25 per cut, appliance purchase, clothing, reimbursement or another emergency.

This program can be used in conjunction with LIHEAP and/or HUMAN SERVICES. Each Elder is required to complete an application. In order for the application to be processed in a timely manner, it is important that the directions for this program be followed and completed properly.

Procedures for program are as follows: • • • • • •

Application must be filled out completely, signed and dated by the applicant.

Supporting documentation must be submitted with application Assistance request must be for primary residence.

NEWS FROM THE PROSECUTING ATTORNEY’S OFFICE (April 2018)

The Prosecuting Attorney’s Office had an open house on Friday, February 23, 2018, where we awarded the prizes for our art contest winners. Local students ages 6-14 submitted various paintings, drawings and other forms of artwork to be permanently displayed on our walls. Everyone did an exceptional job and we truly appreciate all the effort put into the entries.

Over one hundred Government staff and Tribal members were able to come see the artwork and our remodeled offices. The artwork makes a huge difference in the look and feel of our office and we have received so many positive comments on the string art, paintings, drawings, and the remodeled offices–so chi miigwetch to all of those who entered our contest and to the Maintenance Department for the incredible job they did remodeling. Our work areas are unrecognizable from what they were in the past and we are excited to have updated and professional offices from which to serve the community.

The Fire Department is still looking for volunteers. While the word volunteer is used, it is actually a paid-on call. We provide service such as medical, firefighting, wildland firefighting and Public education. If this sounds interesting to you or you would like more information, please stop down to the Fire Station and talk to the Chief. He will be happy to answer any questions you may have. The fire station is located on Putnam Rd. With spring right around the corner, you are reminded to have a burn permit if you intend on burning leaves and branches. You may obtain one from the fire dept. Failure to get a burn permit could result in a fine being levied against you.

Your Tribal Fire Department received 13 calls for service in the month of February.

One of our firefighters, Mr. Sunny Nair is finishing up his Fire Inspectors school. He should complete this training by the end of March. This will enable him to conduct building inspections to make our facilities safer for all of us.

The Fire Chief is conducting a survey. We are wondering if there is a interest in having a Jr. Firefighter Program here. It would be open to all kids from 8-17. If your child would be interested in this,

Grilling season will soon be upon us. For some it never left. Some safety tips for all to remember. First make sure your grill is clean and free of grease. You can still have a grease fire on a grill that can ruin your grill and result in a house fire depending on where it is placed. Second , do not grill in your house or basement. Lastly, make sure your grill is away from your house so if something does happen you do not catch the house on fire. Accidents do happen, we just don’t want them to happen to you!

Stove fires can happen to anyone. A simple trick to avoiding one is a simple cleaning. If something gets spilled in the oven, clean it out before its next use. This will avoid your house filling up with smoke and setting off your smoke detectors. This could also cause a oven fire depending on what has spilled.

Thank you all for being fire safety conscious this winter. We have not had a house fire this winter due to improper use of heating appliances. You all deserve a Giant THANK YOU from us here at your Fire Department!!

Consider buying a NOAA Weather Radio (NWR) All Hazards receiver, which receives broadcast alerts directly from NWS. You can purchase these at many retail stores.

Prepare for Spring Tornadoes Tornadoes can strike in any season but occur most often in the spring and summer months.

Every state has some risk of this hazard. Learn how to prepare ahead of spring with the How to Prepare for a Tornado Guide. It explains how to protect yourself and details the steps to take now so that you can act quickly. Tornadoes may develop quickly with little, or no warning.

Follow these tips from Ready.gov to prepare: 1. Sign up for local emergency alerts and warnings. In any emergency, always listen to the instructions given by local emergency management officials.

2. Look for danger signs including: dark, often greenish sky; large hail; a large, dark, low-lying cloud (particularly if rotating); and, loud roar, similar to a freight train. If you see approaching storms or any of the danger signs, be prepared to take shelter immediately.

Flooding is the most common natural disaster in the United States. Deadly flooding can happen anywhere and faster than you might expect.

It is important to be prepared for flooding if you live in a low-lying area near a body of water, such as a river, stream, or culvert. You should also be wary if you live along a coastline or downstream from a dam, levee, or area that has been burned by wildfire.

Protect yourself during a flood with these Ready.gov tips: Turn Around, Don’t Drown! Avoid walking or driving through floodwaters. Just six (6) inches of moving water can knock you down. Just one (1) foot of water can sweep your vehicle off the roadway.

• If there is a chance of flash flooding, move immediately to higher ground. Flash floods are the #1 cause of weather-related deaths in the U.S. • If floodwaters rise around your car but the water is not moving, abandon the car and move to higher ground. Do not leave the car and enter moving water. If water is rising inside the car, then seek refuge on the roof.

• Avoid camping or parking along streams, rivers, and creeks during heavy rainfall. These areas can flood quickly with little warning.
