LEADERSHIP CORNER
There's No 'I' In REaltor® Back in 2015, I was hosting a broker’s open house at a listing not too far from here. I had a really impressive tray of sandwiches and cookies I was going to have to enjoy all by myself until Sue Pearson, the 2015 President of the East Pasco Association of REALTORS® stopped in to check out my listing. Little did I know she was about to set my career and life on a totally different trajectory. She asked me if I had ever attended any association events or been involved. I replied that I had not. She replied, “Well now you are.” And here we are… I began serving first on the grievance committee, then on the MLS committee, then finally on the Board of Directors. It was my privilege to serve as the President of EPAR in 2018 when the members of EPAR and GTR agreed to merge and make Greater Tampa even greater. As part of our merger agreement, the EPAR board elected me as our board representative on the GTR board, and then in 2020 I was elected by the GTR membership as a regular seat GTR Board member, and in 2022 I was elected as the Vice President of the Board by the GTR Board of Directors and was blessed to again be voted in as the president elect for 2023. It has been an amazing journey to this point, and I can’t wait to see what’s ahead. I started off the new year laughing and celebrating with some incredible friends and family with a champagne toast at midnight. I then spent a lot of the day texting and calling friends, family, and colleagues to wish them a happy new year and give some words of encouragement. Unfortunately, I did still receive those texts from insurance agents with special deals for NAR members, so I guess that’s going to continue… I spent some time negotiating a contract for one of my listings…sweet! I spent time relaxing with my wife and kids on our back porch, and I enjoyed a great cigar.
I gave an in-person interview with the news media about the 2024 real estate market. Then I was able to serve my church at the Celebrate Recovery meeting I help lead. One thing is for sure, with every challenge comes an opportunity. 2024 is going to be full of opportunities! I don’t know all the answers, heck, I don’t even know all the questions! But I do know that I get to serve this association with an incredible group of servant leaders who are dedicated to making the best of the opportunities in front of us! I believe in learning from history – both for reasons TO DO things and reasons NOT TO do things. “Those who cannot remember the past are condemned to repeat it.” – George Santayana in 1905 It’s incredibly important to seek out the why and how when seeking to make a change. How did we get here? Why do we want to move from here? As the 112th President of Greater Tampa REALTORS®, I am proud to rely on the guidance of the many who have come before me, while investigating the changes, growth, and trends that affect today’s association world and the real estate industry.

The program matches real estate agents who work on small-scale charitable efforts with mentors who can help them improve and expand their impact. Daphne founded Unbroken Dreams in 2021 to address homelessness and help people rebuild their lives. She has connected hundreds of people with housing resources; runs a cold-weather shelter; provides necessities like food, warm clothing and blankets; and sometimes buys bus tickets to help reunite people with their families.
Congratulations to Cristinia Gregorio on being promoted from Member Services Coordinator to the role of Partnerships Coordinator within our organization after two years of dedicated service and exemplary contributions to our membership team. CODE OF ETHICS Responsibility for Sales Associate’s Error Case #2-2
R
EALTOR® A, a REALTOR® principal, was asked to list a neglected house that obviously needed a wide range of repairs. He strongly advised the owner that it would be to his advantage to put the house in good repair before offering it for sale, but the owner wanted it sold at once on an “as is” basis. REALTOR® A wrote a novel advertisement offering a “clunker” in poor condition as a challenge to an ambitious do-ityourself hobbyist. A few days later, Sales Associate B, who was not a Board member, from REALTOR® A’s office showed the house to a retired couple who liked the location and general features, and who had been attracted by the ad because the husband was looking forward to applying his “fix-up” hobby to improving a home. The sale was made. Shortly thereafter, REALTOR® A was charged by the buyer with having misrepresented the condition of the property. REALTOR® A accompanied Sales Associate B to the hearing, armed with a copy of his candid advertisement. The hearing established that the buyer fully understood that the house was represented to be generally in poor condition, but that while inspecting the house with a view to needed repairs, Sales Associate B had commented that since the house was of concrete block and stucco construction, there would be no termite worries since termites could not enter that type of construction. Sales Associate B confirmed this
and his belief that the statement was correct. However, after the sale was made, the buyer ripped out a sill to replace it and found it swarming with termites, with termite damage to floors in evidence. Further questioning established that there had been no evidence of termite infestation prior to the sale, and that the Sales Associate had volunteered an assurance that he thought was well grounded. REALTOR® A, prior to the conclusion of the hearing, offered to pay the cost of exterminating the building and the cost of lumber to repair termite damage in view of Sales Associate B’s failure to recommend a termite inspection, which was the usual and customary practice in this area. The complainant stated that this would satisfy him completely. It was the Hearing Panel’s view that while REALTOR® A’s actions were commendable, and would be taken into account by the Hearing Panel, REALTOR® A was still responsible for the errors and misstatements of the sales associates affiliated with him. The Hearing Panel concluded that REALTOR® A was in violation of Article 2.

Q: I’d like to keep my Florida real estate license and become voluntarily inactive. How long may I remain voluntarily inactive without losing my real estate license? A: There’s no limit to the time a sales associate may remain voluntarily inactive, provided the sales associate renews as inactive every two years and satisfies the continuing education requirements prescribed by the Florida Real Estate Commission (FREC).
Q:Did something change with the Florida Realtors/Florida Bar contract? I distinctly remember someone telling me a few years ago that a text message could potentially be a valid way to send written notice under a Florida Realtors/Florida Bar form contract A: Yes. Until late 2021, a notice would be effective if given by “...electronic (including ‘PDF’) media.” The contract drafters removed that option, leaving us with the most recent version discussed above, which only considers mail, fax, personal delivery or email as valid options to deliver written notice. tamparealtors.org

YPN Committee is BACK!
What a wonderful time to be in real estate. Interest rates are coming down, more homes are going under contract, and the Young Professionals Network (YPN) Committee is BACK! As your YPN Chair, I want to introduce myself a little. As a Tampa native, I take pride in seeing our thriving community grow. With a bachelor’s in criminology from USF, I graduated with honors via Phi Sigma Theta. I’m very family-oriented as a mother of two amazing children (15 and 3) and wife to the best husband I could ask for. I’ve been a consistent Top Producer with my brokerage since first joining in 2021. Then in 2022, I earned GTR’s Newcomer of the Year award recognizing my efforts in building my business. Although I only started practicing real estate in 2021, I’ve been in the real estate realm since 2013. For the first eight years, I operated on the admin side of a brokerage where I wore the hat of office manager, recruiter, trainer and mentor to hundreds of agents at any given time. Eventually, it was time to take a leap of faith and start practicing myself. And I’m so grateful that I did! I’ve always been involved in my community and groups wherever I’m needed. So, when I accepted to serve as one of GTR’s two YPN Ambassadors for 2023, I stepped up to the plate. Imagine my excitement when the GTR Board of Directors voted to bring back the YPN Committee in 2024, among others. This year is sure to be a memorable one for all Greater Tampa REALTORS® members, but I am especially excited about what we have in store for those who want to get involved in YPN. As well as serving as your YPN Chair, I also serve as one of GTR’s Florida REALTORS® Board of Director members. Serving to no end! For YPN, I envision this year as an opportunity to be the voice for all newer licensees and affiliates in which we

can help propel their business forward and provide tools and resources to help them be as successful as they want! As a committee, we plan to put in motion ways to keep members engaged with each other via social media as well as offer spotlights on key topics which members can benefit from. We will also be focusing intently on community engagement to get more directly involved with those around us. Along with fundraising for select organizations at each of our events, we plan to have boots on the ground helping those in need. We are currently researching potential avenues for this and will be sure to announce upcoming opportunities to the members. As in the past, we will continue to host mixers for members to connect with their colleagues and affiliates. We are actively coordinating these events to promote them to the members. Of course, we can’t forget about the fantastic RealTours throughout the year as well. These continue to be an opportunity for YPNers to engage with the staples of the Tampa Bay area, earning them the opportunity to better understand the draws that our area has to offer to buyers and sellers. In the past, we’ve explored locations such as Tampa International Airport, Raymond James Stadium and Straz Center for the Performing Arts. Keep an eye out for what’s to come this year! All in all, I hope we can have a positive and impactful effect on everyone we interact with. Housing Market Predictions
T
he new year is a great time to provide potential, unsure clients with knowledge on what the housing market might look like in 2024. As we gear up for this year, here are some of our 2024 housing market predictions. Mortgage rates will fall In 2023, the U.S. economy proved to be more resilient than expected and because of this, the Fed raised interest rates. The housing market saw a peak in mortgage rates this year. In 2024, we hope to see mortgage rates cool off. Nationally, the 30-year mortgage rate is anticipated to drop below 7% in the first quarter of 2024. Then the rates will fluctuate between 6-6.5% in the second and third quarters and are hoping to fall to 6.2% by the end of 2024. Rates are not expected to fall below 6% but this is still better than some of the rates we saw last year. More listing activity We hope to see an increase in the number of listings in 2024. Those who have been holding off on listing their home because of high mortgage rates might be more likely to sell their homes at the lower rates we are expecting in 2024. The National Association of REALTORS® (NAR) predicts 4.71 million existing-home sales in 2024, up 13.5% from 4.1 million anticipated in 2023.

Home sales will increase The national housing market saw a decrease in home sales in 2023 due to high mortgage rates, less buyer demand, and limited inventory. In 2024, lower rates and more available inventory will drive the influx of home sales and allow fewer barriers to entry for younger households who have been deterred from buying last year. Prices will remain moderate The housing market will likely see stable home prices in 2024, and a possible 1.5% increase in the median home price compared to the U.S. Increased inventory and more buyers, will drive the subtle growth of home prices. NAR Chief Economist Lawrence Yun predicts the median home price will reach $389,500 this year. In Tampa, home prices are expected to recover from a surge in prices in 2023.

Blue color schemes are gaining popularity in 2024. Several paint companies have chosen shades of blue as their 2024 Color of the Year, from Benjamin Moore to Sherwin-Williams. Adding blue to homes in decorative materials and housewares will make everything pop.
Cozy, warm neutrals The days of cool grays and stark whites are behind us. Say hello to warn neutrals, such as beiges, creamy offwhites and rich browns. Expect softer neutrals to enter every living space of a home, from the kitchen to the family rooms. Designers recommend adding a variety of textures and patterns, to create a layered look.
Mud-laundry rooms Combining a mud room and laundry room allows for optimal functionalism. One room that can do it all, quickly and easily. Some must haves a homeowner is looking for in a mud-laundry room is a utility sink for dirty clothes or shoes, plenty of cabinets, hooks and cubbies and a bench for taking on and off shoes, coats

Real estate disputes can include earnest money deposits, home inspections, misrepresentations about the condition of the property, plumbing or electrical problems, roof leaks, moving dates, breach of real estate contracts, appliances or fixtures disputes, breach of fiduciary duties, fraud, personal property, property encroachments, cost for unexpected repairs, and the list goes on. There is no limit to the type of disputes that can arise in real estate.
Also, many home builders have a similar paragraph in their Purchase agreements to help settle disputes. The paragraph may read as follows: “The parties to this Agreement specifically agree that any Dispute shall first be submitted to Mediation.”
So, what can a REALTOR(r) do to help alleviate a lengthy, costly, stressful litigation leading to a courtroom trial decision? Section 16(b) of the “As Is” Residential Contract for Sale and Purchase states: “Buyer and Seller shall

Disputing parties seldom have the chance to speak informally. Often emotions are high, and they want their day in court. Both parties feel they have a strong case, and the judge or jury will rule in their favor. The courtroom is very adversarial, and you have a winner and a loser. No case, no matter how strong, has a guarantee of success in your favor. You could lose all self-determination, and the case is put on record and available to the public. You may also lose any chance of preserving a business and/or personal relationship.
Mediation can be the first step to resolve a real estate dispute and can be initiated at any time by agreement between the disputing parties. Your attendance at the mediation does not imply any admission of guilt or wrongdoing. Mediation is a voluntary, confidential, nonadversarial way for people to come together and discuss their issues and concerns with a neutral and impartial Mediator who helps the parties reach a mutually agreeable resolution. All parties will have the opportunity to speak and give their facts and key arguments, so everyone understands the strengths and weaknesses of the dispute. The parties may never convince the other side that they are wrong, but this understanding could possibly help convince both sides that a compromise is necessary.

1. What is a judgment? A judgment is a court's final determination of the rights and obligations of the parties in a case. This can be in the form of a money judgment or for performance. 2. How do you resolve a judgment on a homestead property? Judgments on homestead property can be avoided if they meet certain criteria. Such as amount of judgment, length of time recorded, whether the creditor has initiated any foreclosure. 3. How do you resolve a judgment on non-homestead property? If the judgment is perfected, it would need to be paid. However, in certain circumstances, payoffs can be negotiated. 4. How long does a judgment remain attached to a property? Once they are perfected, they can remain attached for up to 20 years. However, they must be re-perfected after the first 10 years. 5. How do you perfect a judgment? Once the judgment is recorded, a certified copy must be recorded. Then it is perfected.

A little about me; I am a mother, wife, attorney and business owner with over 25 years of experience and knowledge in litigation, probate and real estate planning with a background in real estate, residential and commercial transactions and title closings. With a passion for real estate law, I serve as the 2024 President of the Bay Area Real Estate Council, a group of over 100 real estate attorneys in the surrounding Tampa Bay area.
