2022 Year-End Presidential Insight

The quote “time flies when you are having fun” by Albert Einstein sums up my rewarding, insightful and unforgettable year as the 2022 President of Greater Tampa REALTORS®.

I have fond memories of mingling, listening and learning from members during the many GTR Mixers conducted throughout the Tampa Bay Area as a convenience to members. Mixers were held in Brandon, Wesley Chapel and Citrus Park. Other in-person events held to allow members to mingle and renew connections include: Meet The Candidates at The Pub, our 2022 General Membership Meeting, Affiliate Tradeshow at Armature Works and GTR Global Mixer at Brio Italian Grille. All were planned and well executed by our dedicated staff.

GTR’s Young Professionals Network returned with a vengeance in 2022. A wildly successful 2022 YPN Kickoff Event in June featured a Pirate Water Taxi Tour followed by a Mixer at Jackson’s Bistro. Fun was had by all at the 3rd Annual Blue Party in September at the fabulous Westin Tampa Bay and The Tacky Sweater Party in December at Zydeco Brew Works in historic Ybor City.

We held the first Awards luncheon to celebrate and honor fellow members for their exemplary professionalism, commitment and selfless attitude. I had the distinct honor to present 2022 Presidential Awards to four professionals for their untiring efforts, advice and unwavering assistance helping me achieve my theme of Moving Forward in 2022!

GTR was also a sponsor for the National Association of Real Estate Brokers (NAREB) Annual Conference and Celebration of the 75th Founding Anniversary in Tampa.

Your amazing Board of Directors exercised remarkable due diligence during a year full of challenges such as the ongoing COVID-19 pandemic, shortage of inventory, lawsuits and huge venture capital investments. Let’s not forget skyrocketing home and rental prices, rising interest rates and rampant inflation. I’m especially proud of their sound decisions and commitment to move forward with the search for a new CEO and contracting for an Interim CEO. The Board is laser focused on providing programs, products and series to help members thrive and succeed in an ever-changing marketplace.

Advocacy efforts were a resounding success starting with Great American REALTORS® Days (GARD) in Tallahassee. A group of new and experienced members headed to Tallahassee in February to meet with legislators on pending legislation and to discuss important issues impacting Florida’s real estate industry. Casino Night and Auction at Westin Tampa Bay was a successful fundraising event for RPAC as well as a networking opportunity with casino games, a cigar roller and food and drinks.

Significant acknowledgements and awards include a proclamation from Hillsborough County Board of County Commissioners in recognition of our efforts during Fair Housing Month in April. The proclamation was presented by Commissioner Kimberly Overman. A Focus on Fair Housing was presented by REFAA (Real Estate for All Alliance) on April 21, 2022, with an outstanding line up of speakers. GTR earned the prestigious Platinum Global Achievement Award presented by NAR (National Association of REALTORS®) for the fifth consecutive year.

As this unprecedented year comes to a close, I want to thank each of you for the honor to serve as your 2022 President. I’m thankful for the opportunity to work with an exceptional Board of Directors, resourceful Affiliates, competent and efficient staff and amazing volunteers. All the best to Incoming President Jay Quigley and the 2023 Board of Directors. Wishing everyone a safe and joyous holiday season.

GTR retains Platinum designation for global business leadership

Greater Tampa REALTORS® has earned the Platinum Global Achievement Award presented by the National Association of REALTORS® (NAR) for the fourth consecutive year.

The Global Achievement Program is designed to recognize and reward the most active associations in global business. Each applicant is reviewed by a 10+ person NAR staff review team.

GTR’s Global Business Council “set the bar” among 130 global business councils nationwide, according to Lisa Calarco, Manager, Global Programs and Outreach/Engagement for NAR.

The Tampa Bay Global Business Council is committed to providing members with the necessary education and tools to conduct real estate transactions with foreign buyers and sellers. As part of the Council, GTR members have opportunities to broaden their knowledge of international tax and immigration laws, discover the latest international trends and opportunities for business and expand their referral base through networking with local and state and national entities.

Knowing or Reckless False Statements About Competitors

Case #15-1

REALTOR® A operated a residential brokerage firm in a highly competitive market area. He frequently used information from the MLS as the basis for comparative ads and to keep close track of his listing and sales activity as well as his competition.

One day, while reviewing MLS data and comparing it to a competitor’s ad, REALTOR® A noticed that REALTOR® Z had used a diagram to demonstrate his market share, contrasting it with those of several other firms. The ad showed that REALTOR® A had listed 10% of the properties in the MLS over the past three months.

REALTOR® A thought this was low. His analysis of MLS data showed his market share was 11%. REALTOR® A filed an ethics complaint against REALTOR® Z citing Article 15 of the Code of Ethics in that REALTOR® Z’s “obviously understated market share claim” was a “misleading statement about other real estate professionals.”

REALTOR® A’s complaint was considered by the Grievance Committee which determined that an ethics hearing should be held.

At the hearing, REALTOR® Z testified he had always been truthful in his advertising and that all claims were based in fact. He produced an affidavit from the MLS administrator which indicated that a programming error had resulted in miscalculations and, after careful recomputation, REALTOR® A’s market share over the past three months had been 10.9%.

The administrator’s statement noted that this was the first time that information related to REALTOR® A’s listings or sales had been misstated on the system. “I relied on information from the MLS. It’s always been accurate and I had no reason to even suspect it was wrong last month,” said REALTOR® Z in his defense.

The Hearing Panel agreed with REALTOR® Z’s logic, noting that a REALTOR® should be able to rely on generally accurate information from reliable sources. They reasoned that if, on the other hand, the MLS had shown REALTOR® A having, for example, 1% of the market, then REALTOR® Z’s reliance on the information would have been “reckless” because REALTOR® A had generally had a 10 –15% market share and a reasonable conclusion would have been that the information from the MLS was seriously flawed.

The Hearing Panel concluded that REALTOR® Z’s comparison with other real estate professionals, while slightly inaccurate, was based on usually accurate and reliable information and had been made in good faith and while technically “misleading,” had not been “knowing” or “reckless”. REALTOR® Z was found not to have violated Article 15.

Q: What happens if a residential rental premises was damaged or destroyed by Hurricane Ian?

A: Section 83.63 Florida Statutes entitled casualty damage addresses this. It provides if premises are damaged or destroyed by a casualty (not by the wrongful or negligent acts of the tenant) AND the enjoyment of the premises is substantially impaired, the tenant may terminate the lease and immediately vacate the premises. In the event the tenant terminates the lease and vacates the premises, the landlord must comply with section 83.49 Florida Statutes regarding handling the tenant’s advance rents and deposit. Section 83.63 does not provide the landlord the right to terminate the lease.

Q: What Florida law governs landlord tenant relationships?

A: In general, Part II of Chapter 83 Florida Statutes, known as the Florida Residential Landlord and Tenant Act is the state law that sets forth landlord and tenant statutory obligations and rights. The answers to questions below refer to this chapter, and NOT to local ordinances which may also govern landlord and tenant responsibilities.

Wow - time flies and another year is in the books!

What a crazy and busy real estate year it has been. It was also a busy year for bringing back our YPN events and they were such a huge success with record attendance! We kicked off the year with our Pirate Water Taxi tour and networking event at Jackson’s, volunteered to clean up Florida waters, had an amazing Blue Party event attended by YPNers from across the state, and are wrapping the year up with our annual holiday ugly sweater party. Not only did we network, but we raised funds for charities in our community. As we look forward to next year, we will continue to partner with local organizations for volunteer events.

YPN has brought so many important relationships into my life. It has also created business opportunities that I would not have otherwise. There were so many new faces that attended our events this year. The connections you make and the experiences you can create are invaluable. Members Doing Good in the Tampa Bay Area Community

Greater Tampa REALTORS® member, Sarah Hart, believes that a job well done starts with fun. She’s known for her ability to bring laughter and joy to the build site with a little friendly competition, like challenging a fellow volunteer to see who can lay sod the fastest. “You’re dirty, you’re hot, you’re throwing sod. So make fun, right?” says Sarah, a 42-year-old U.S. Air Force veteran who volunteers with Habitat for Humanity of Hillsborough County.

Nearly 20 years ago, Sarah began volunteering with Habitat ® while still serving in the military. Her longstanding commitment to safe and affordable housing has inspired others to get involved, and she always brings along a crowd of enthusiastic volunteers whenever she shows up to a build. “I have a lot of pride in what I do,” she says. “And then it makes me feel really good to be able to give back to somebody for a very good cause and be able to see something come of it.”

Sarah has invited colleagues from her real estate company to volunteer, coordinated a youth build where her 17-yearold son participated and brought together her friends from the military to help build homes. “It was just really fun to be able to do a build with my military friends, even after I’m retired,” Sarah says. “I still keep in contact with all of my buds, and so it is fun being with them in a different setting, not with our uniforms on, but building a house together.”

A few years ago, Sarah started an online group for newcomers where she regularly shares volunteer opportunities. “I have, I think, right now 5,600 people who are on that,” says Sarah, who encourages members to sign up for Habitat ® builds to get involved in their new community and meet new friends.

“Sarah is a vivacious volunteer who inspires all around her, and she shows her dedication to this affiliate not only by swinging a hammer and building houses, but also by taking on a key responsibility to spread the word of her passion to those from all walks of her life,” says Callie Lupica, Habitat Hillsborough County’s volunteer services director. “From posting on social media to actively planning and recruiting volunteers, she stands tall as a local leader with a huge smile on her face at all times.”

Air Force veteran who was the sole caregiver for his brother living with a rare form of cancer. “That was very moving. Obviously, him being military and me being military, and just seeing that he was doing it all in the name of his brother. That was amazing to me,” she says.

I can’t believe my year as your Affiliate Director is coming to an end. I have enjoyed my time on the GTR Board of Directors and have learned a lot. Home inspectors and other real estate-related industries are dependent on REALTORS® and my year on the board has helped to teach me of the many challenges and needs real estate has and ways that Affiliates can help. Hopefully, as we move further away from pandemic restrictions, our next affiliate director can do even more to get our affiliate members together and involved. I would like to take this time to introduce you to your next Affiliate Director, Jennie Restrepo. Jennie is the Director of Marketing for Insured Title Agency and will bring great energy to the Board next year. Enjoy reading her answers to the questions I asked her in our interview.

What brought you to Tampa and how long have you been here?

I came to Tampa for college at USF and stayed here since then. I've been in Tampa for 20 years. I live in Seminole Heights, which I love.

What got you into the title business?

I started working with Insured Title Agency supporting the Become A Better Agent seminars. I enjoy sharing knowledge with others. Many aspects of title can be misunderstood and we have a commitment to education.

What is your greatest asset to real estate agents? We go above and beyond with each transaction because

we know buying and selling real estate is a big decision for our clients.

Why did you become an Affiliate member of GTR?

I became an Affiliate member to support the partner and agent community. As an Affiliate member, we can continue our commitment to education and helping our community grow.

What made you decide to run for the Affiliate Seat on the Board of Directors?

I ran for the Board of Directors to better serve and support the Tampa Bay REALTOR® community.

What changes would you like to make during your time as a director?

I would like to support more opportunities for partners and agents to connect.

What do you want people to know about you?

I am a mom and consider myself a local tourist. I don't just live here, I love this city and enjoy sharing what's great about it with others.
