Dream Big, Sparkle More, Shine Brighter!

H

appy new year to my Greater Tampa REALTORS® family! I’m excited for the opportunity to serve as your 2018 president. I look forward to working with you to better our association and to provide more value and support to all of our members. This year, I would love to see more members engaged, connected and taking advantage of the many benefits your association membership offers. I know it’s not always easy to get involved if you haven’t already been. That’s why I want to share my personal GTR story with you.

As I look back to August of 2011, I asked my women’s Bible study group for prayers, as I needed personal direction. Little did I know that Shannon Damschen, who I had done a deal with, would call and ask me to attend a committee meeting at Greater Tampa REALTORS®. I had joined GTR in January of 1999 but only went there as needed and never had the desire to be involved. I said “no” a couple of times but Shannon was persistent. When I finally agreed, I attended my first committee meeting,

which was Governmental Affairs, in November of 2011. I remember saying to Shannon that those were the smartest people I had ever been around AND that I had no intent on doing that again! After the meeting was over, she immediately signed me up for the Governmental Affairs and RPAC Committees for that following year.

I went on to serve as a director for the 2013 – 2014 term, chair of RPAC for 2014, secretary, vice president and president-elect. Today, I am humbled to serve as 2018 president. My life has change both personally and professionally since getting involved with GTR. I’ve made friends, grown as a professional and have had amazing opportunities to network with colleagues from across the country. I thank God for answered prayers.

Enthusiasm breeds energy and if you are energetic, nothing is impossible.

When you sparkle, you inspire others around you. Sparkle more!

There may be times when it’s hard to believe in the future. When this happens, concentrate on the present.

Cultivate your happiness until courage returns. Look forward to the stars shining brightly at night and the beauty of the day’s sunshine. Shine brighter!

This year, I want to encourage you to get involved, if you haven’t already, and dream, sparkle, shine! There may always be dreams larger than your own, but there will never be a dream exactly like your own. You are more marvelous than you know. Dream big!

Laura Izzo, CPA, MBA, RCE, GRI, ABR - Chief Financial Officer GTR congratulates Chief Financial Officer Laura Izzo who recently earned the REALTOR® Association Certified Executive (RCE) designation, the only professional designation specific to the industry of REALTOR® association management. The designation demonstrates expertise and a commitment to professional growth.

Laura has been the CFO at Greater Tampa REALTORS® since 2012. She started her career in public accounting but has since worked in the corporate real estate divisions of American Express and MetLife and as

a consultant in the real estate division of PricewaterhouseCoopers. In 2002, she became a real estate broker for Prudential and was among the top 5 percent producers of sales each year she was with the company.

Laura’s interests and experiences are eventually what led her to GTR. “I have had a fulfilling career blending the two passions I love most — real estate and numbers,” she said. “Numbers will always tell a story about a company and real estate is exciting; so every day, I get to tell an exciting story!”

early 200 people gathered at the Sheraton Tampa Riverwalk hotel on December 7, 2017 for the Greater Tampa REALTORS® 106th annual installation and awards banquet. The ballroom, overlooking the Hillsborough River, was decorated with silver and blue accents to match the theme: “Dream, Sparkle, Shine!” Attendees were serenaded by tunes from Blake High School students during the cocktail hour and banquet.

CODE OF ETHICS Obligations Under Exclusive Listing

A

t the time Client A signed an exclusive listing agreement with REALTOR® B, they discussed market conditions and prevailing prices, and agreed on listing at $156,900. After six weeks with no apparent interest in the house, Client A called REALTOR® B to learn why his property was receiving scant attention from prospective buyers. REALTOR® B said, “It’s not hard to diagnose the trouble. Your property is overpriced.

That was clear to me by the time we had it listed for ten days. In this market, it would take a really interested buyer to go as high as $149,000 for it. That’s why it hasn’t been possible for us to push it.” “When you reached that conclusion, why didn’t you tell me?” asked Client A. “Because,” said REALTOR® B, “it wouldn’t have done any good. I know from experience that sellers can’t be convinced that they are overpricing their property until they get tired of waiting for an offer that will never come. Now that the market has taught you something that you would not take as advice, let’s reduce the price to $148,900 and push it.”

Client A complained about REALTOR® B to the Board of REALTORS®, detailing these circumstances, strongly insisting that REALTOR® B had fully agreed with him on the price at which the property was originally listed.

Client A reiterated this point strongly at the hearing of his complaint which was held before a hearing panel of the Board’s Professional Standards Committee. REALTOR® B did not

contest this, taking the position that at the time of the listing it was his judgment that a price of $156,900 was fair and obtainable in the market.

He stated that a strong immediate sales effort had convinced him that the listed price was excessive, and he defended his action of reducing his sales effort as he had done in his discussion with the client. He said that many years of experience as a broker had convinced him that once a seller decides on a definite price for his property, no argument or analysis will shake his insistence on getting that price; that only inaction in the market is convincing to the sellers.

The hearing panel concluded that REALTOR® B’s conduct had violated Article 1 of the Code of Ethics, which requires REALTORS® to protect and promote their clients’ interests. The panel also found that since REALTOR® B honestly felt the original listing price of $156,900 was the fair market value at the time he listed it, REALTOR® B had not violated the Code of Ethics by suggesting that the price be lowered. However, since REALTOR® B later concluded the property was overpriced, he should have immediately notified Client A of his conclusion and not waited for Client A to call him six weeks later.

Q: Do referral fees have to flow through a brokerage company, or can they be paid directly to an associate?

A: Referral fees should flow through the brokerage company to the associate, in accordance with Section 475.42(1)(d),Florida Statutes.

Although FREC says that an associate may be paid directly at closing if a broker instructs the closing agent (in a specific writing) to authorize direct payment, FREC has not expanded this to include other situations.

Q: The Florida Real Estate Commission disciplined me several years ago. Is there a way to expunge my record?

A: It depends. Although Florida law does not refer to the process as expungement, Section 455.2255(1), Florida Statutes, states, in part, that a “licensee may petition the department to review a disciplinary incident to determine whether the specific violation meets the standard of a minor violation as set forth in Section 455.225(3).

gard My First Experience at Great American REALTOR® Days By: Marie Gregorio

H

ave you ever received one of those **ACTION NEEDED** emails? You know, the ones with SHOUTY CAPITALS and red letters stressing the urgency for an immediate reply because SPACE IS LIMITED? Well, back in December I received one of those emails from Meredith Bellanca, GTR programs director, with the words “Great American REALTOR® Days” in the subject line.

I am in my fourth year of real estate since moving to Tampa, and I’ve seen many of my fellow REALTORS® attend Great American REALTOR® Days, or what would come to be known to the regulars as GARD, in Tallahassee the last few years and I’ve been meaning to “look into it.”

It’s been on my to do list for at least the last couple of years. Well, somehow, this year the email gets sent directly to me. Yes, me! I later realized that since I am the current president of Women’s Council of REALTORS® Tampa, serving as an ex-officio director for GTR, I will be getting lots of emails from Meredith and others, but this was the first… and this was the most exciting!

2018 is going to be a year of many firsts but I am excited to share with you a little about my first GARD trip. I was provided a proposed itinerary in that first email.

We take a bus, yes, a bus, from GTR to Tallahassee. Are you kidding me? Are we back in school? So, I start asking questions… lots of questions. Who rides the bus? What do we do on the bus? Are there assigned seats? Tallahassee, is that even in Florida? OK, so I knew the answer to that last question but I was promised a fun and adventurous bus ride and boy, did they deliver. I had down time to check in back at the office but there were plenty of lively, fun and engaging conversations along with a GTR GARD gift card auction with contributions going to the Florida REALTORS® Political Action Committee (RPAC) and we hadn’t even made it to Tallahassee yet.

Once we arrived in Tallahassee, we dropped off a group that had to run straight into committee meetings.

The rest of us were dropped off at our hotel and had a few minutes to freshen up before heading out to the Florida REALTORS® open house. This is when it

ADVOCACY all started to come together for me. I realized that there is a bigger picture to what we do locally, how it extends to the state level and what exactly RPAC is. I started to see how the pieces fit together.

Prior to arriving in Tallahassee I was provided Hill visit protocol, a schedule for legislative Hill visits and the 2018 Florida REALTORS® Legislative Priorities talking points. I was instructed, along with all attendees, to read up on these talking points to familiarize myself with the issues. I would be meeting with lawmakers and learning more about the political process. I would be performing a service to my association and the real estate industry. I would be representing my profession. I would be acting as an effective grassroots lobbyist. A lobbyist? Wait, me? I will have to come back to this.

Hill visits would be on Wednesday afternoon and Thursday morning but first, a legislative issues briefing at the Civic Center with lunch. If you are like me, you saw that and read, “classroom meeting, PowerPoint and cafeteria lunch.” BORING! But this is Florida REALTORS® and what was about to happen was anything but boring.

When the doors opened to the Civic Center, I saw all the tables set with white linen and glassware. There were servers, a stage, big screens and a podium, and that huge REALTORS® ROCK sign. I was so thankful that Jo Easton likes to sit in the front of the room because she found what I am sure were the best seats in the place (second table dead center only behind the Florida REALTORS® officers. Told you it was the best). This would prove to be advantageous once the program began. I got excited that it was my first time attending. So much so, that when our guest speaker, Staff Sgt. Sal Giunta took the stage, he called me and my

enthusiasm, out again! Giunta gave the keynote address titled, “Uncommon Value: The Importance of Teamwork, Sacrifice, and Leadership.” I laughed, cried and laughed again, but most importantly, I remembered what he said, the sacrifice he made, and took to heart a story of how this man came to be awarded the Medal of Honor—the first awarded to a living recipient since the Vietnam War.

I particularly noticed that the legislators were more engaged when they could see how we were personally affected by these issues.

MARKET PREDICTIONS

Predictions on the 2018 Tampa Real Estate Market By: Sunny Alexander Predictions are an age-old new year’s tradition. For real estate agents, it is more than a quaint custom. In our industry, successful sales strategies are built on anticipating trends in the marketplace. Is there a crystal ball that predicts what customers will do, what they want and where they are going to buy?

There are a ton of services and resources to feed your client database, but how do you make order out of all that data to find the opportunities in the market? Where do you start? To make sense of all the noise, a lot of organizations are turning to predictive analytics.

Those organizations buy in to the idea that “predictive analytics is an ideal way for sales and marketing professionals to make sense of their big data.” According to Eric Siegel, Ph.D., predictive modeling methods work by crunching historical data, thus learning from past performance to inform the best next move. He believes that predictive analytics optimize your marketing campaign by providing you with a predictor, or single value that ranks your customers or prospective customers.

Predictive scores for each prospective customer are the “golden eggs” you use to inform the best action to take with that customer. But, does it really work or is it just a bunch of voodoo?

Digging into that question led me to a lecture by acclaimed author and mathematician David Orrell. In his lecture, he pointed out glaring blind spots in our predictive efforts including climate change and our failure to predict the 2008 financial crisis. According to Orrell, the problem with today’s predictive models is that they are traced back to the ancient Greeks’ belief in world “mathematical harmony” and the Neoclassical Theory inspired by Isaac Newtown’s “rational mechanics” theory that humans will behave independently and rationally to maximize happiness. Orrell questions the old model and argues that we should acknowledge the uncertainty of people and living systems. “Can we predict the exact timing of the next business, health or climate crisis or opportunity?”

Orrell asked. “No, but can we use available tools to better prepare ourselves and make our businesses and institutions more flexible and robust? Yes. I think we can.”

TIGE LINTS PINEYWOODS REALTY So, what do seasoned and successful real estate agents predict for the Tampa market when they look in their crystal ball? Tige Lints with Pineywoods Realty was generous enough take some time to offer some insight. Tige focused on construction trends and buyer behavior in our market. He pointed out that new construction will continue to be an obstacle for sellers of existing homes. Sellers may have to make needed updates in order to stay competitive with the new homes. On the other hand, new construction may see an increase in building material costs due to the fires and hurricanes in 2017. Builders will need to be creative to keep the homes affordable and competitive with the changing climate of resale.

In terms of buyer behavior, he sees a trend with more people moving to the suburbs to get more home for the money and a continued influx of Millennials buying over renting. However, the threat of interest rates rising two to three times in 2018 may make potential buyers more tentative.

Tige is optimistic and predicts a continued seller’s market because of low inventory in 2018.

JASON SOMERS LANDCASTLE TITLE GROUP Another industry leader, Jason Somers (president of LandCastle Title Group) helped translate the significance of raw numbers for 2018 based on past projections and Mortgage Banker Association (MBA), Fanny Mae and LandCastle Title Group, a division of Fidelity National Financial. Jason pointed out during the peak of the market in 2005, MBA reported roughly 3 trillion originations, 2006 saw roughly 1.8 trillion, and 2008 brought roughly 1.5 trillion.

For 2018, the MBA is predicting a 1.588 trillion origination market, with LandCastle/Fidelity predicting similar numbers with 1.178 trillion in purchase originations and 410 billion in refinance originations. LandCastle/Fidelity predicts a slight 3 to 4 percent increase in purchase activity over 2017, with commercial transitions remaining flat and a 7 percent decrease in refinance activity when comparing to 2017 originations.

percent increase in sales of existing homes and a 10 percent and 8 percent increase in new construction, respectively. Florida is one of the best economies in the country. We are creating new jobs monthly and enjoy very low unemployment. In fact, Florida’s unemployment is predicted to drop to 3.9 percent in 2018–2019. Compared to the nation, Florida historically outperforms in many of the key economic areas. As Jason sees it, “Florida is a little more insulated because we have everything everyone wants—sun, sand and positive growth.”

DAWN DOMINICI TOMLIN ST CYR The excitement was palpable when I spoke with Dawn Dominici from Tomlin St Cyr about her 2018 predictions. Dawn has been entrenched in the Tampa community for over 20 years and she has proven to be a demonstrated leader in our city and real estate market.

Dawn focused on downtown and Waterstreet, and she believes the birth of Waterstreet will further solidify Tampa’s downtown as the epicenter of our community. When Dawn reads the tea leaves in the market, she thinks residents will want to live in close proximity to downtown to catch a dinner at Ulele, attend a Lightning game or enjoy the Riverwalk. Currently, South Tampa housing inventory is scarce and cost per square foot is higher than other areas of Tampa. Dawn predicts West Tampa, West Riverside Heights and Ybor Heights are all going to mimic the growth of Seminole Heights. These areas can offer buyers a more affordable price point and close proximity to downtown and all the entertainment and restaurants.

Let’s talk about the elephant in the room: the new tax reform. This topic kept cropping up when I asked agents for their 2018 predictions. Specifically, the decrease on

MARKET PREDICTIONS mortgage interest deductions for primary and secondary residences from $1 million to $750,000 and SALT (state and local taxes) went from no cap to a $10,000 cap.

Two local legends and proven prognosticators of the Tampa real estate market, Jane Spector (Keller Williams) and James Pinchbeck (Coldwell Banker) were both kind enough to offer their thoughts on the tax bill. Both Jane and James have been studying the new bill to stay abreast of the situation to better advise their clients.

JANE SPECTOR KELLER WILLIAMS TAMPA CENTRAL As usual, Jane did not disappoint.

She made it clear that with any change, such as the tax reform, comes a learning curve. Specifically, she addressed the changes in a home equity line of credit loan (HELOC) and SALT. Homeowners can still utilize the opportunities a HELOC provides, but the new bill has implemented new guidelines that will impact deductions if the homeowner has borrowed over $750,000 on their property. In regards to the SALT deduction change, Jane anticipates buyers are also going to be more cognizant about future property taxes and mortgage deductions. Before the bill, there was no cap on the SALT whereas the new bill brings a $10,000 cap. So, as property taxes raise, homeowners will pay more taxes without the benefit of uncapped tax deductions. Jane ends with the thought that buyers may be more mindful to buy at their max amount since prices are currently leveling out and the tax reform may further impact the leveling of prices. Jane’s 29 years of experience has honed her intuitive ability to predict the market and she is optimistic about 2018. Jane went on to say there are many benefits and opportunities for homeowners in our community and having a real estate agent who understands the value structure of our market and how the new bill may impact homeowners is now more vital than ever.

New York and New Jersey both have state income taxes which may encourage residents of states like these to move to Florida. Additionally, with the final bill including mortgages on second homes, this is also a positive for Florida since our market is buoyed

by second home buyers. James says that change is on the horizon and he thinks it is going to be a dynamic environment as everything shakes out. This dynamic and changing environment may lead to people hunkering down for a bit. Like Jane, James is optimistic about our market and he is hoping for similar sales volumes next year with no big shifts.

While predictive analysis tools can inform your strategy, making accurate predictions require more than math.

Like most aspects of the profession, market predictions are both a science and art. There is no shortage of services and resources to feed your client database.

Tech 2.0: New Technologies are Changing the Real Estate Landscape

Patricia Riesenkampff, CIPS (CENTURY 21 Beggins Enterprises) recently interviewed fellow REALTOR® and tech guru, Krishna Malyala to learn more about his True Lifestyle Cost™ engine

(currently used by MFRMLS) and to get his take on how REALTORS® must adapt to emerging technologies to remain competitive.

Patricia Riesenkampff (PR): Krishna, please tell us what inspired you to create your True Lifestyle Cost™ (TLC) engine which was used by Florida’s largest multiple listing service, My Florida Regional MLS (MFRMLS), to launch State27Homes.com— their pioneering, public-facing Florida home search website. This fabulous new REALTOR®/consumer tool won them the Inman Innovator Award in August 2017, selected from 700 other MLS boards.

Krishna Malyala (KM): Though I have always been very interested in staying at the forefront of technology, it was my own home search experience which had me confronting the kinds of questions and problems that I know other consumers are facing in our realm of real estate today. I wanted to find the solution to these questions and TLC was born.

Buying a home is a big deal and the consumer deserves some TLC. Of course, by TLC we

mean an extraordinary search that pays special attention to all the factors that weigh in to the actual cost of home ownership. The TLCengine is a comparative tool. Your actual costs of owning a particular home will vary depending on your personal circumstances.

Factors to consider include the cost of your mortgage, which is pegged to your FICO score and financing choices, the age of the home, property taxes, utilities and your commute.

TLC stands for True Lifestyle Cost and is the only way to search if you want to fully understand all the real and the hidden costs of your new home, including commute, taxes, insurance rates, local gas prices and more than 30 lifestyle cost factors!

The search application also allows you to save searches, share and collaborate with your local agent on the ground. Conventional searches don’t let you do that.

EXPERT TIPS PR: Do other MLSs have it and can you eventually market it globally?

KM: So far, there are 127,000 agents who have access to this platform in Florida and 250,000 agents nationwide. And yes, the vision is to continually improve it so it can also be used in other international markets. The challenge is that other countries have very different MLS configurations and this issue would have to be addressed first.

PR: The newest app you were telling me about called “True by TLC” should facilitate both the buying consumer and the REALTOR® in the pre-qualifying process. How does that work?

KM: True by TLCengine utilizes an exclusive set of lifestyle tools including utility costs, commute times, average gas pricing and average entertainment costs, to give buyer agents and their buyers the True Lifestyle Cost of purchasing a specific home based on the individual buyer’s information.

As an exclusive platform aimed at keeping buyer agents in the middle of the search process, buyers will not gain access to True by TLCengine until they are either invited or approved by an agent for system use, keeping all the MFRMLS data and big data from TLC locked down, except to those people who are expressly given permission to use it.

The True platform functions similar to many search engines which currently face the public, however, with the exclusive big data TLCengine processes daily, we are able to provide consumers with a new way to search for properties including taking their entire monthly budget, commute costs and over 100 other factors into account. Additionally, as an industry first, buyers and agents can now search for the photos that matter to them most. If a buyer is interested in kitchens or bathrooms, they can have those photos show

EXPERT TIPS up as the main property photo instead of the typical frontfacing photo, saving the buyer and agent time when looking for specific criteria for clients.

PR: In your opinion, what kind of apps do you consider the most important for REALTORS® to facilitate the business process?

KM: Well, it’s all about increasing productivity and quickly offering value. True by TLC is a good example of enabling consumers to live their lifestyle. It answers the question, “Can the consumer afford a particular property and what will the full monthly costs be?”

Apps that help consumers and agents are those which empower both groups during the on-boarding process.

The agent can save all of these apps under one group icon on their phone from map search, property search, cost estimators, CMA tools, Showing Time, schedules, form providers, scanning and e-signing apps, CRM and databases, making them most readily available.

Then there are the self-tracking apps such as those like QuickBooks which allow the agent to realize their personal productivity numbers relating to their own lifestyle and how to best maintain it. Tracking their own business productivity, transaction management, mileage, times of commutes, expenses, taxes, car-related info, social media and camera/ video apps to enhance the images made, to mention a few.

PR: Krishna, what is your prognosis for our industry regarding offering the client/customer the best service possible? What should be considered and invested in regarding the tech tools of today and those you assume are yet to come?

KM: The REALTOR®’s role is becoming more of the trusted advisor; the one who has the answers at the center of knowledge and cutting-edge technology tools. This real estate professional is the expert in their market area and able to quickly answer questions offering value via information and reports delivered personally or via email, text, calls and video images.

REALTORS® need to be very keen on furthering their education to become most knowledgeable about their markets and the industry’s new tools. Millennials are a large group of the buying public and they are asking different questions than those generic ones regarding the number of bedrooms and baths of the past. They also use the tools of technology more readily than consumers of the past. Purchasing real estate remains one of the largest

investments for the consumer so we need to enable them from where they are. Customizing their individual needs in a more time efficient manner is key. For instance, if a consumer is most interested in how the home’s kitchen looks, we can use the artificial intelligence of image tracking to send only kitchen photos to this consumer. Using IMOVA floor plans can enable the consumer to see a 360 degree view of the home’s layout. There will be new voice search tools that REALTORS® can use during open houses to immediately get answers and market stats for quickly answering the potential buyer’s questions.

The future of Uber and production of self-driving cars can make car ownership in the not too distant future become less and less attractive. Facebook campaigns can target specific buyer or seller audiences, allowing the agent to incubate these leads more effectively. New transaction and record management tools and the use of fully traceable technology of “Block Chains” may very well be changing how even title companies are doing their business regarding the wiring of funds. These changes would eventually bring the costs of title companies down for the consumer. And, regarding the prevailing belief in the present shared value of gold currencies, or of the new trend with BitCoin, comparative results have yet to be seen. There will be a convergence of many platforms and virtual reality will lead the way to the future. Agents using 360 degree views of favorite places within their market areas and sharing them with clients and consumers over social media will enhance the usage of Gear headsets and the Occulus tools. The real estate experience will therefore offer new perspectives of perception and become even more “feeling oriented” than in the past.
