2023 Year-End Presidential Insight Sitting down to write this final message as your 2023 President, I realized there is so much to write about. First, I want to thank you, the member, for the honor of serving as your 2023 President. I also want to thank Jason, his wonderful staff, and my Board of Directors for their hard work and unwavering support. I am humbled and grateful for the experience, talent and zeal that each of you brought to the Board table. As I reflected on this past year, it was with immense pride and gratitude the many great accomplishments Greater Tampa REALTORS® has accomplished. These accomplishments are a testament to the hard work, dedication and passion of our volunteer leaders, our staff, as well as our members. One of the single most important decisions rendered by your Board of Directors was the hiring of our new CEO, Jason Outman. The extensive leadership skills that won him the job are already on full display. Collaborating with our leadership team, Jason is clearly focused on the future of our Association, creating ways to improve member experience and exploring new opportunities. Through the hard work of our Pathways to Leadership task force, we saw the return of the Global and Young Professionals Network Committees as well as the creation of the Diversity & Outreach Committee. In addition, the task force also created several Forums that will offer our members a diverse range of enriching experiences, including networking opportunities, professional development sessions and educational programs. Initially, we will implement Forums for Affiliates, Broker Engagement, Technology & Innovation, and Top Producers. As we experiment, other forums may be introduced to meet the evolving needs of our members. Our Global Council and Commercial Services both received Diamond-Level recognition from NAR.

As REALTORS®, we believe in giving back to the community, and our Association continued our partnership with Habitat for Humanity. Earlier this year, a group of our members swung hammers and helped with new home builds for two very deserving families. Witnessing the joy expressed by the recipients when they are presented with the keys to their new home is nothing short of amazing! I’m excited that in 2024, GTR is sponsoring one build in Hillsborough County and one build in Pasco County. As you know, the recent Sitzer/Burnett trial resulted in a verdict against NAR and the two co-defendants. We do not know how this will play out, but we do know there will be changes in our industry. GTR remains committed to you and the communities you serve, offering the benefits and value to ensure your success. 2023 QUARTER 3 BOARD OF DIRECTORS ACTION ITEMS The following items were acted upon at the July Meeting:

✓ Motion to approve the three recommendations [Committee and Forum Process Policy, Adoption of the Leadership Symposium, & The GTR Committees and Forums], from the Pathway to Leadership Taskforce was adopted. ✓ Motion to rescind the June 22 motion to engage Marilyn Wilson from the WAV Group for the 2024 strategic planning session with the BOD. ✓ Motion to engage staff and leadership to facilitate and update the strategic plan for 2024-2026.

The following items were acted upon at the August Meeting:

✓ Motion to increase the budget and lock in the time and space for the 2024 FR Convention Hospitality Event was adopted by general consent. ✓ Motion to implement a process that allows GTR to mobilize quickly when considering taking a public position on an issue that affects homeownership and property rights was adopted by general consent. ✓ Motion to have GTR take a formal position to oppose the City of Tampa millage increase of $1.0MM, an increase from $6.2076 to $7.2076 was adopted by general consent. ✓ Motion to amend the BOD approved committee structure to change the RPAC Qualifications for members from being “required to be an RPAC contributor” to “strongly recommended to be an RPAC contributor” was approved by general consent. ✓ Motion to add the Governmental Affairs Committee to the list of exempted committees [in the new BOD approved Committee Structures that came from the Pathway to Leadership] and to delete the paragraph titled Governmental Affairs Committee was adopted by general consent. ✓ Motion to refer the remainder of the motion [referencing two committees limitation and additional proposed changes] back to the Bylaws & Policy Taskforce for further review, clarifications, with a report provided within 30 days was adopted by general consent. ✓ Motion to move the December 28 BOD meeting to December 20 was approved.

CODE OF ETHICS Dealings Initiated by Another Broker’s Client Case #16-13

EALTOR® X, a residential broker, had recently listed a home. REALTOR® X’s marketing campaign included open houses on several consecutive weekends. One Sunday afternoon Buyer B came to the open house. REALTOR® X introduced herself to Buyer B and asked whether Buyer B was working with another broker. Buyer B responded that he was, in fact, exclusively represented but went on to add that he was quite familiar with the property as it had been previously owned by a close personal friend. REALTOR® X told Buyer B that she would be happy to show Buyer B through the home and answer any questions he might have, but added that she represented the seller and not Buyer B. After viewing the home, Buyer B indicated that he was seriously interested in the property and intended to discuss a possible purchase offer with his buyer representative. REALTOR® X responded that there were several other buyers interested in the property and that it would likely sell quickly. “I can’t tell you what to do, but if it were me, I would make an offer today,” REALTOR® X told Buyer B, “You can go back and discuss this with your broker if you like or I can help you write a purchase contract. It’s your choice.” With REALTOR® X’s words in mind, Buyer B decided to make an offer. REALTOR® X assisted Buyer B in filling out a standard form purchase contract which was

accepted by the seller later that day. REALTOR® X was subsequently charged with violating Article 16 for dealing and negotiating with a party who had an exclusive relationship with another REALTOR®. At the hearing, REALTOR® X defended her actions noting that she had told Buyer B that she was the seller’s exclusive agent and, as such, would not and could not represent Buyer B’s interests. She pointed out that Buyer B had asked for her help in writing a purchase offer and had not sought the counsel and assistance of his exclusive representative. She concluded her defense noting that Standard of Practice 16-13 authorizes dealings with the client of another broker when those dealings are initiated by the client. The Hearing Panel disagreed with REALTOR® X’s reasoning. They concluded that REALTOR® X’s inducement of Buyer B by emphasizing that the property might sell quickly (which might well have been true), coupled with her offer to prepare a purchase contract on Buyer B’s behalf, constituted an initiation of dealings on the property by REALTOR® X, not by Buyer B. As a result, REALTOR® X was found in violation of Article 16.

Q: I’m planning to send a mass mailing to all the homes in a subdivision near my office. Is there a legal requirement to include a disclaimer informing recipients who have their property exclusively listed with another brokerage firm to ignore the advertisement? A: No. There is no legal or ethical requirement to include a disclaimer like this in the advertisement. That said, there’s nothing wrong with including a disclaimer like this to ensure there’s no confusion by a recipient who is currently represented by another real estate company.

Q: I represent the buyer. The transaction failed, and the seller refuses to release the escrow deposit to my buyer. The seller put the property back on the market. Is the seller permitted to advertise and sell the property when there’s a pending escrow dispute? A: Yes. An escrow dispute does not prevent the seller from advertising the property or entering into a contract with a second buyer.

Noteworthy Moments of 2023 while catching a glimpse inside how the world of the performing arts works. We also partner up with our neighbors across the bay from time to time! This year, we were grateful enough to join efforts with Pinellas REALTORS® Organization’s YPN in a beach clean-up at Gandy Beach this summer. REALTORS® grabbed a bag, gloves and trash pickers to help beautify the beach and its surroundings. It was a successful event where we also collected donation items for the local non-profit, Clothes to the Kids.

2023 has been a year of excitement in the world of GTR’s Young Professionals Network. Members have shared some noteworthy moments at a variety of events so far! REALTORS® enjoyed mixers around Tampa Bay starting with our kick-off one at Tampa Bay Brewing Company in Centro Ybor. At the mixers, members got to know their colleagues and make new connections. It’s easy to get caught up in the day-to-day tasks of real estate, between checking the MLS, taking calls and showings. These mixers offer members the chance to let loose and enjoy themselves. Recently, members dressed in their favorite costume at our Halloween RealMix at Acropolis – Kennedy Blvd, where we also had a Pet Photo Costume Contest. As a perfect fit, this mixer benefited the Humane Society of Tampa Bay. YPNers also experienced RealTours throughout the year. Our RealTours invite members to get to know the Tampa Bay community staples more in-depth. This allows us as REALTORS® to share our first-hand knowledge of the area and its appeal with our clients, highlighting what draws the masses to our beautiful area! One of our visits this year was to the Tampa International Airport where we were given a behind-the-scenes tour filled with need-to-know info & the airport’s history. Members recently toured our very own Raymond James Stadium – home to the Tampa Bay Buccaneers, USF Bulls, and many other events and concerts! Next up, we’ll be going behind the curtains at the Straz Center for the Performing Arts. There, members will have a chance to step into the same dressing rooms and on the same stage as countless performers from around the globe,

In an inflated market like todays in which agents are working harder than ever to earn their commission, YPN offers an outlet to break away for an evening and mingle! Last month, we wrapped up our annual GTR YPN Blue Party at The Westin Tampa Bay where attendees wore all things REALTOR® Blue. Like most of our events, we raised funds for a non-profit organization – this year being Solita’s House. One of our last hurrahs for the year will be the Tacky Sweater Party on Thursday, December 7 at the Aloft Tampa. Attendees can expect to dance, sing karaoke-style, enjoy appetizers and drinks, all while donning their tackiest of holiday attire! We will also have a toy drive for Toys for Tots the night of the event. There’s so much that GTR YPN has to offer and much more to come in 2024! Your GTR Board of Directors has brought back the YPN Committee, starting January 2024. This committee will be charged with putting together even more enjoyable events filled with soughtafter activities for its members. As your current YPN Ambassadors and future Chair and Co-chair of the YPN Committee, we very much look forward to continuing to work with YOU in mind and growing the network all the more! GTR RECEIVES PRESTIGIOUS DIAMOND GLOBAL ACHIEVEMENT AWARD Greater Tampa REALTORS®'s Tampa Bay Global Business Council (TBGBC) is proud to announce that we have been honored with the highly prestigious Diamond Global Achievement Award by the National Association of REALTORS® (NAR) for outstanding contributions to the real estate industry for the past six years.

The Diamond Global Achievement Award is the highest award for global achievement provided by NAR, and it is awarded to organizations that have consistently performed at the highest level for six years. GTR’s TBGBC was honored with the Platinum Global Achievement Award for five consecutive years from 2018-2022. The Council will maintain Diamond status with NAR through biennial reviews of their programs and will continue to exceed the criteria to maintain the status. JOIN GTR FOR GREAT AMERICAN REALTOR® DAYS Make Your Voice Count at the State Capitol Excitement is in the air! The dates for the annual Tallahassee trip for Great American REALTOR® Days (GARD) have been announced. Each year, REALTORS® from across the state get the opportunity to meet with State legislators one-on-one and talk about pending real estate legislation. This event brings Key Contacts and Florida REALTORS® together and affords the opportunity to discuss current issues affecting real estate professionals as well as private property rights. The primary goal of our annual visit to the State’s Capitol is to maximize opportunities for key issues to be communicated. Everyone wants to be heard, and Great American REALTOR® Days is your chance for YOUR opinions to make a difference in the real estate business in Florida. It’s your chance to stand up for your profession and for homeowners across the state. How YOUR voice has made a difference In past years, REALTORS® who participated in GARD have been instrumental in legislation that: • Massively cuts the state sales tax on commercial leases • Provides important insurance reforms to help keep premiums affordable • Allocates significant funding for improved water quality throughout the state

Estate Planning and Property: Ensuring the Most Successful, Stress-Free and Smoothest Transfer Possible

By Barbara M. Brown, Esquire, with the assistance of law firm intern Sam Hijazi, Brown & Associates Law & Title P.A. As you get older in life, it becomes ever so important to manage your assets and make sure your preferred beneficiaries receive your property when you become incapacitated or when you pass. Without planning properly, the cost of probate can be very expensive and time-consuming for your loved ones. A popular estate planning tool is a trust, which is a legal instrument that gives another person (a trustee) legal title to the property at the request of the person who puts the property in a trust (the settlor), usually for the benefit of a third party (the beneficiaries). Fortunately, there are a lot of ways you can manage the transfer of property in preparation, and you should know these five. 1. What is the difference between a revocable vs an irrevocable trust? A revocable trust can be changed at any time while an irrevocable trust usually can’t be changed without the beneficiary’s direction. Having a revocable trust is useful when one might need to plan for medical assistance that is contrary to the financial provisions of a trust. While an irrevocable trust may seem unappealing at first, there are a few reasons one would choose this route. The main reason is the fact that property held in an irrevocable trust is protected from the beneficiaries’ creditors. 2. What is a land trust? A settler will create a land trust to grant a trustee authority over the property while the beneficiaries retain the ability to manage, direct, and draw money from the trust. A land trust will usually be created for the purpose of asset protection and privacy since using a land trust to buy property is not a public record. Property owned through a land trust does not have to go through probate, which will save you a lot of time and money in the future. 3. Florida Real Estate Power of Attorney. Having power of attorney for someone means you have the authority to make decisions on that person’s behalf while they are alive. Power of attorney comes in many different forms, such as durable power of attorney, a healthcare surrogate and many other forms. Florida has a power of attorney for real property, where someone (usually an individual, real estate agent or an attorney) has the authority to refinance, manage, sell or mortgage property in the name of the principal (the individual who granted authority). 4. Should I include my property in my Will if I have a trust set up? No! If you already have a trust set up for your property, then you don’t include it in the Will. However, it is extremely important to note that if this property is your homestead, neither the trust nor the Will dictate the distribution of ownership. With homestead property, the devisees depend on whether or not the home is owned by a married couple and if there are minor children involved. 5. What are the biggest mistakes made when drafting a will? The estate planning process has a high potential for mistakes, which is why it is almost always necessary to have an attorney assist you. People often omit things like their dependents such as pets. You don’t want them to end up being put in a pound or even euthanized, so consider the expenses associated with them. You should also make sure ALL property is addressed, including intangible property. Lastly, the biggest mistake people make is not getting their Will drafted soon enough. The future is uncertain, but you can protect yourself and the people you love regardless of what the future holds.

I am honored to have been selected as the Affiliate Director for the remainder of the year 2023 and for next year, 2024. We also have a new position at Greater Tampa REALTORS®, the Vice President of Strategic Partnerships. Quan Remmer has recently accepted the position, and we are very excited to have him on our team.
