MANUFACTURING INDUSTRY OUTSOURCING REFORM BEGINS IMPLEMENTATION ROUTE; THESE ARE THE DATES. In the last week of April, the deadlines to implement the outsourcing reform that regulates the outsourcing of specialized services and prohibits outsourcing schemes based on the supply of personnel began to run. The outsourcing of personnel, understood as the supply of workers from one company for the benefit of another is an activity considered illegal and with both administrative and criminal repercussions as of April 24. In that sense, no company may sign a new contract for this hiring scheme. The new regime for which eight legal ordinances were reformed established different transition terms, among them, for the regularization of companies that currently have a personnel supply scheme. These are the transition events and the deadlines to carry them out: May 2021 • The Ministry of Labor and Social Welfare (STPS) must put into operation the registry of specialized services subcontracting companies, with the general provisions for this procedure (deadline, May 24). June 2021 • The National Workers’ Housing Fund Institute (Infonavit) will issue the rules to be followed by subcontracting companies for the submission of four-monthly reports on the contracts performed and the salaries of their workers, among other data, these reports will be submitted in January, May, and September of each year (deadline, June 23).

MANUFACTURING INDUSTRY
July 2021 • Companies with labor outsourcing schemes, either through insourcing or personnel transfer mechanisms, must transfer to their payrolls the workers of the other company, without the condition of transferring assets, but recognizing the labor rights of the collaborators, such as seniority (deadline, July 23). • Companies subcontracting services and specialized works must begin to file with the Mexican Social Security Institute (IMSS) reports on their contracts and the conditions of their personnel, which must be shared quarterly in January, May, and September of each year (as of July 23). • Companies in the transition period must request the cancellation before the IMSS of the employer registrations by class and the assignment of a new one (deadline, July 23).
August 2021 • Deadline for service and specialized works companies to obtain registration with the STPS to operate under the new rules. Businesses have 90 calendar days to comply with the procedure from the date of publication of the guidelines by the agency (deadline, August 22). January 2022 • The federal government must incorporate subcontracted workers into its payroll within the authorized expenditure for the fiscal year (as of January 1). The new regulatory framework contemplates fines for non-compliance, the highest of which can be up to 4 million 481,000 pesos for those who benefit from outsourcing personnel (up to 50,000 UMAs) and up to three years in prison for the crime of tax fraud.

GOOD NEWS U.S. VACCINE ASSISTANCE ALONG THE BORDER IS IMPORTANT, MEXICAN OFFICIAL SAYS Mexico is ramping up requests for more COVID-19 vaccines from the United States, and in the coming days may ask for assistance vaccinating people along the countries’ shared border, the Mexican government official in charge of vaccine diplomacy said. Mexico has received 2.7 million doses of AstraZeneca’s (AZN.L) COVID-19 vaccine from the United States, but has not progressed on accessing larger U.S. stocks, deputy foreign minister for multilateral affairs Martha Delgado said in an interview last week. “We are once again taking up dialogue to insist on this need,” she said, ahead of an upcoming visit by Foreign Minister Marcelo Ebrard to the United States.
regulators after operations were halted at the U.S. plant that produced them due to contamination.
Mexico may also put forward a proposal to prioritize vaccination along its border with the United States, Delgado said, describing the issue as important and concern in Mexico.
Ebrard will also make trips to Russia, China, and India, as part of efforts to ensure supply agreements are honored.
The proximity and human ties between the densely populated cities along the border make it easy for the coronavirus to re-infect both countries.
Part of his agenda in the United States will be devoted to vaccines, including “scientific exchange,” Delgado said.
The U.S.-Mexico border region, which stretches 3,175 km (1,973 miles), is home to at least 14.6 million people, according to government data from 2018.
Mexico has so far received more than 21 million shots, primarily from Pfizer, AstraZeneca, China’s Sinovac and Cansino, and Russia’s Sputnik V.
The supply of vaccines has become a global diplomatic tussle.
But delivery delays and supply shortages have slowed the campaign to vaccinate its 126 million people.
Mexico government officials on Friday declared the doses of AstraZeneca’s vaccine shipped from the United States safe and approved by two health
Mexico was considering hosting Phase III trials for an additional Chinese vaccine, Delgado said. She declined to say which one.

RECOMMENDATIONS SAFER TRAVEL RECOMMENDATIONS TRANSPORTATION During car travel, making stops along the way for gas, food, or bathroom breaks can put you and your traveling companions in close contact with other people and frequently touched surfaces. If traveling in a Recreational vehicle (RV), you may have to stop less often for food or bathroom breaks, but you could still be in close contact with others while staying at parks overnight and while getting gas and supplies. Traveling on buses for any length of time can involve sitting or standing within 6 feet/2 meters of others, which may increase your risk of getting COVID-19. If you choose to travel by bus, learn what you can do to protect yourself on public transportation. Air travel requires spending time in security lines and airport terminals, bringing you in close contact with other people and frequently touched surfaces. Most viruses and other germs do not spread easily on flights because of how air circulates and is filtered on airplanes. However, keeping your distance is difficult on crowded flights, and sitting within 6 feet/2 meters of others, sometimes for hours, may make you more likely to get COVID-19. SAFER • Short road trips with members of your household or fully vaccinated people with few stops along the way • If you must fly, try to take flights with the fewest stops or layovers LESS SAFE • Longer trips by car or RV with many stops along the way • Trips by car or RV with people who are not vaccinated or not from your household • Flights with layovers AVOID • Long-distance train or bus trips • Traveling on a cruise ship or riverboat

NEW PROVISIONS FOR OUTSOURCING IN MEXICO Starting Saturday, April 24, 2021, new rules for outsourcing apply in Mexico. In the previous days, both chambers of the Mexican congress approved the presidential bill that bans outsourcing of personnel. The new law was published last Friday in the official gazette to enter into force the day after its publication. Major changes: • The new regulation prohibits outsourcing of direct workers and direct personnel. • Outsourcing of specialized services is allowed (as long as the services to be rendered are not part of the company’s main economic activity or corporate purpose as described in the company’s by laws). • New rules for profit-sharing have been added to the law. • Labor law now sets higher economic sanctions for companies not complying with the new outsourcing regulations. • In addition to the labor changes, there are also new fiscal implications.
