Crown Land (Reserves) (Great Ocean Road coast and parks) Interim Regulations 2023
Set Aside Determination – Regulation 18
I, Leia Howes, Acting Director Environment and Coastal Operations, as an authorised representative of the Great Ocean Road Coasts and Park Authority, make the following determination under regulation 18 of the Crown Land (Reserves) (Great Ocean Road coast and parks) Interim Regulations 2023.
(1) The area(s) of the reserve described in the Schedule to this determination is an area to which access is prohibited for one or more of the following purposes:
a. the care, protection and management of a reserve, under regulation 18(2)(a).
(2) This determination
(a) applies to all dune and cliff systems and fenced conservation areas (except within a defined access point);
(b) applies at all times;
(c) applies to all persons, domestic animals and vehicles; and
(d) is executed in line with Surf Coast Shire Community Amenity Local Law (2021), 4.12 Sand Dune Area: A person must not enter a sand dune area at any beach apart from defined walking tracks and beach access tracks.
Note - The prohibited area applies to the fenced sand dunes, or in the case of no fencing, applies from the toe of the primary sand dune; and
(e) Is executed in line with Colac Otway Shire Council Local Law No.1, General Local Law (2023), 2.5 Activities Prohibited in a Reserve: (a) In a reserve, a person must not: (10) enter a reserve, or part of a reserve, contrary to signage prohibiting access to the reserve or part of the reserve, (12) walk on any plot, bed, border or any other area set aside for vegetation; and
(f) commences on the date of execution and remains in force until 8 November 2025.
Schedule – Reserve(s) subject to this determination
All dune, cliff and fenced conservation reserve areas (excluding defined access points) managed by the Great Ocean Road Coast and Parks Authority outlined in Appendix A.

Notes
A person, other than a person to whom a permit has been issued under regulation 18(6), must not enter or remain in a reserve or a specified area of a reserve set aside under regulation 18(1)(a).
Penalty: 10 penalty units
A person must not enter or remain in an area set aside under regulation 18(1)(b) unless that person does so in accordance with the determinationunder which thearea is set aside,or in accordance with apermit issued under regulation 18(6).
Penalty: 10 penalty units
A person, other than a member of the traditional owner group entity for which the set aside has been made, mustnotenterorremaininanarea setasideunderregulation 18(1)(b)forthepurposesofregulation 18(2)(d) unless that person has been issued in writing an invitation from the traditional owner group entity to attend their cultural activity.
Penalty: 10 penalty units
