GAMBLING TOWNS NOT EXACTLY THREE OF A KIND

Las Vegas, Atlantic City and Macau are separated by thousands of miles but linked by a common factor: Their economic identities are grounded in casino gambling. ¶ But while the cities are affected by some of the same trends, their casino industries differ significantly. ¶ Las Vegas long has been the pre-eminent gambling city in terms of name recognition and historical identity. Over the past decade, however, Macau has sprinted far ahead of Las Vegas in gambling revenue. Both Las Vegas and Atlantic City were hit hard by the economic downturn at the end of the 2000s. ¶ Las Vegas generally is recovering from that slump.

Atlantic City, meanwhile, has been left in the dust.

LAS VEGAS STRIP

The Strip accounts for the bulk of gaming revenue in Clark County and almost 60 percent of gaming revenue generated in Nevada.

But focusing only on gambling ignores the larger picture of what’s happening on the Strip. While other places — namely, Atlantic City — have struggled amid a proliferation of casinos nationally, the Strip has been reinventing itself to rely less on gambling and more on other ways of making money.

“The Strip has sort of matured or developed into a market where gaming isn’t the primary driving force for revenue,” Union Gaming Group analyst Chris Jones said.

“Right now, the most important thing for all operators is room revenue.”

Why? It’s an area of high growth and high profitability, Jones said.

Macau revenue isn’t available prior to 2002 because a monopoly controlled the market.

In fiscal year 1998, gaming accounted for roughly 50% of the Strip’s total revenue.

Macau has a long history of gambling, but it wasn’t until the early 2000s that its gaming economy really took off. That’s when the Chinese government broke up a monopoly that had controlled the market.

China allowed new operators to build casinos, and revenue skyrocketed from $2.8 billion in 2002 to $43.9 billion last year, about seven times the revenue on the Strip.

And unlike Las Vegas, Macau didn’t see a major dip during the global financial crisis.

But the market has sputtered recently, with its eighth consecutive month of yearover-year gaming revenue declines.

Why the sudden downturn? In a nutshell, China’s government has led a crackdown on corruption that’s keeping away some gamblers who otherwise would spend a lot of money in Macau.

“Macau has become collateral damage with respect to the broader anti-corruption crackdown,” said Grant Govertsen, a Union Gaming Research analyst in Macau.

Wynn Resorts, Las Vegas Sands and MGM Resorts International operate casinos in Macau and are building new resorts there.

Last year was a bad year for Atlantic City, and that’s putting it lightly.

Four of the city’s 12 casinos closed, taking with them about 7,600 jobs. A fifth casino, the Trump Taj Mahal, was in jeopardy but was saved by billionaire Carl Icahn.

Icahn since has grappled with the casino workers’ union over how best to keep the struggling property afloat. He says it is losing millions of dollars every month and remains open only because of his financial support.

Atlantic City has become a victim of tough regional challenges. Its customer base was cannibalized by casinos in nearby states. And, unlike Las Vegas, it failed to transform itself into an entertainment hub with nightclubs, shopping and fine dining.

The city has lost more than 47 percent of its gaming revenue since 2006.

There is a bright spot, however. In January, revenue for Atlantic City’s remaining casinos was up about 19 percent from the previous year.

MEASLES Is it really scary? What’s the big deal?

igns in hospital emergency rooms order people with fevers and coughs to cover up with face masks. Day care centers have limited outsiders’ contact with infants and sent home information packets about vaccinations, symptoms and precautions. Doctors have plastered waiting rooms with notices warning they won’t treat patients who aren’t immunized.

Measles is back in Nevada, and people are scared.

Six Clark County residents — three adults and three children — have been diagnosed with the virus, which spreads with coughs and sneezes and can linger in the air for two hours. Before January, Clark County had been free of measles since 2011.

Across the country, 141 people in 17 states have been infected, as of Feb. 13. Most are linked to an outbreak that began at Disneyland.

The Nevada cases show no direct tie to the California cluster.

Epidemiologists don’t know how the virus got here.

But scientists do know whom to blame for its spread: the antivaxxers, a vocal community of people who choose not to immunize their children. ◆ ◆ ◆

WHEN PARENTS CHALLENGE Dr. Blair Duddy about the ben-

efits of vaccines, the pediatrician delivers a well-honed speech outlining how immunizations protect children from diseases that could kill them. He shares statistics and cites studies. He hands out informational pamphlets.

Then he switches to dad mode. He points to a mouse pad stamped with a photo of his children.

“These are my kids,” Duddy says. “I vaccinate. I love my kids as much as you love yours. Please vaccinate your kids.”

If a parent still balks, Duddy, a pediatrician with HealthCare Partners Nevada, delivers the hammer: He recites his office’s 2-year-old policy to not accept unvaccinated children as pa tients.

Doctors like Duddy know what stops measles and other preventable diseases: vaccines. Once a common childhood inflic-

tion, measles was declared eliminated from the United States in 2000 because of a highly effective vaccination program.

Officials at the Centers for Disease Control and Prevention said the majority of people diagnosed with measles this year were unvaccinated.

“This outbreak is pretty eye-opening for all of us,” said Nicole Cavenagh, a pediatric neuropsychologist and director of the Touro University Nevada Center for Autism and Developmental Disabilities. “We are seeing this pop up as a result of parents not vaccinating.”

Why would parents choose not to immunize their children?

The anti-vax movement gained a foothold after British doctor Andrew Wakefield published a report in 1998 linking the measles, mumps and rubella (MMR) vaccine to autism. Parents looking for causes for their children’s autism, celebrities and bloggers latched on to the study and vigorously backed its findings. But concerns about its validity mounted, and the medical journal that published the report formally retracted it.

Scientists, researchers, doctors and public health organizations agree: Vaccines do not cause autism.

Still, some parents fear immunization. They continue to insist, despite the science, that vaccines cause autism. They say the shots contain mercury and heavy metals; cause the diseases they are trying to prevent; don’t work; are symptomatic of an overly obtrusive and controlling government; are pushed by pharmaceutical companies that pay doctors to promote them; or are unnecessary because people can build up natural immunities to diseases.

In fact, with the exception of a few flu vaccines, immunizations don’t contain mercury or heavy metals. They don’t infect people with the disease being prevented as hardly any childhood vaccines contain live virus, and it is impossible to get sick from a dead virus. Pharmaceutical companies don’t pay doctors to immunize children, and vaccines have been proven to be safe and effective, which is why doctors recommend them. ◆ ◆ ◆

MEASLES VIRUS 101 WHAT IS MEASLES?

Measles, also called rubeola, is a highly infectious respiratory disease caused by a virus. Before vaccines were developed, it was a common childhood disease.

WHAT ARE THE SYMPTOMS? Initial symptoms include fever, runny nose, cough and red eyes, which typically last two to three days. The fever can reach a high of 105 degrees.

The virus’ signature red rash doesn’t typically appear until 14 to 17 days after exposure. The flat red spots tend to start at the hairline, then move to the face and neck, then limbs. Small raised bumps may appear on top of the red spots. The rash can last five to six days. Measles’ incubation period, during which there are no symptoms, can last 10 to 14 days.

WHAT ARE COMPLICATIONS OF THE VIRUS? Measles tends to be more serious for children younger than 5 and adults older than 20.

About 3 in 10 people diagnosed with measles will come down with ear infections and/or diarrhea. Ear infections can result in permanent hearing loss.

More severe complications include pneumonia and encephalitis, which is swelling of the brain. One in 20 children with measles will get pneumonia, and about 1 in 1,000 will develop swelling of the brain, which can cause convulsions, deafness and/or mental retardation.

One or two of every 1,000 children diagnosed with measles will die.

HOW CAN YOU AVOID CATCHING MEASLES? Getting vaccinated is the best protection against measles.

The CDC recommends children get two doses of the MMR (measles, mumps and rubella) vaccine. The first dose should be administered when the child is 12 to 15 months old, the second dose between age 4 and 6.

Adults who aren’t vaccinated or never had measles as a child should get at least one dose of the MMR vaccine.

Two doses of the MMR vaccine are about 97 percent effective protecting against the virus.

As vaccine-preventable diseases such as measles make a comeback in the United States, health officials urge people to know their immunization status. People fall into one of four categories: Fully vaccinated Children and adults who have received all recommended immunizations, plus booster shots if needed.

Undervaccinated Children and adults who receive an initial dose of vaccine but not all the recommended doses. In these cases, the effectiveness of the vaccine will be low.

Unvaccinated by choice People who choose not to vaccinate themselves or their children based on religious or personal beliefs.

Unvaccinated by medical exemption People who cannot be vaccinated because of, for instance, a compromised immune system due to chemotherapy, disease or other conditions or a serious allergy to a component in the vaccine.

The impact of an outbreak In 2011, when there were 107 confirmed cases of measles in the United States, local and state public health agencies spent up to $5.3 million dealing with the outbreak, researchers found.

When a Valley High School student was diagnosed with measles this year, unvaccinated children at the school were told to stay home for 21 days, per Nevada law. If several students at one school get measles, unvaccinated children could be kept out of school for two to three months.

has confirmed six cases of measles in Southern Nevada, two more than seen in the dozen-year span from 2003 through 2014.

The people diagnosed include an infant, a young child who received a single dose of vaccine, a Valley High School student who was fully vaccinated, an unvaccinated adult, an undervaccinated adult and an adult whose immunization status is unclear.

Nevada health officials have hesitated to label the incidents an outbreak but acknowledge the situation marks an abrupt shift from the past decade.

Epidemiologists believe the Disneyland case originated with a tourist who brought measles to California from outside the country. In many nations, measles is abundant; it remains one of the leading causes of death among young children worldwide. Past U.S. epidemics have been linked to Americans traveling to England, France, Germany, India, the Philippines and Vietnam.

In a vaccinated population, a hitchhiking virus does little harm. If enough people are immunized, vaccines offer a community benefit known as herd immunity.

There’s little opportunity for an outbreak.

Even people who can’t be immunized — infants, pregnant women and people with compromised immune systems, for instance — get some protection because the spread of the disease is contained.

Unvaccinated people poke holes in that net of protection. The more gaps in immunity, the more chance for an outbreak.

“If (the anti-vaccination movement) grows, you could start to see problems like this all the time,” said Brian Labus, senior epidemiologist for the Southern Nevada Health District. ◆ ◆ ◆

of Immunize Nevada, a state coalition that advocates for vaccinations, said the measles cases should be considered a call to action.

“The majority of parents do believe in vaccination,” Parker said. But “there’s that small (percentage) that’s not vaccinating, and we want them to understand the facts.”

Nevada’s immunization rate has long lagged below the national average. It has been increasing but not as fast as the rest of the nation.

In 2013, two-thirds of Nevada children ages 19 through 35 months were up to date on all of their various recommended vaccinations, the CDC found. That was up 1 percent from 2012 but far below the national average of 73 percent.

Nevada’s vaccination rate for measles specifically was much higher. Nevada’s MMR immunization rate for children

ages 19 through 35 months was 90.4 percent in 2013, just shy of the national average of 91.9 percent. California’s MMR vaccination rate was about the same, 90.7 percent.

Health officials said Nevada’s lower immunization rate isn’t necessarily indicative of a strong anti-vaccination movement, as it is in, say, California.

Rather, “I think a lot of our barriers to vaccination are access issues and insurance,” said Richard Cichy, community health nurse manager for the Southern Nevada Health District.

Cichy pointed to Nevada’s doctor shortage as one barrier. A study by University of Nevada School of Medicine researchers found Nevada has the 46th-lowest rate of pediatricians and family practice doctors in the country.

emptions for school-age children. Unlike California, Nevada doesn’t have a personal belief exemption, but health officials admit the rules are fuzzy because parents can easily claim religious exemption instead. They just need to submit a written statement to school officials.

Clark County School District officials said 1.1 percent of students haven’t been fully vaccinated against measles. Of those students, 0.4 percent have religious exemptions, and the remaining 0.7 percent are noncompliant, meaning they haven’t received the full MMR immunization series or their paperwork hasn’t been processed, schools spokeswoman Melinda Malone said.

of uninsured residents. County health officials hope the Affordable Care Act helps boost Nevada’s immunization rate as more people become insured.

To address the lackluster vaccination rate, the Clark County health district started auditing immunization rates at preschools and day cares to see if children were falling through the cracks, either by not being vaccinated or by not being up to date on recommended shots. Seventyfour percent of children ages 19 months to 5 years old were current with vaccinations in 2013. When a re-audit was done several months later, the immunization rate had jumped to 92 percent. Outreach efforts had worked. ◆◆◆

PARENTS WHOSE CHILDREN are being put at risk by anti-vaxxers are mad at what they see as parental — and societal — irresponsibility. And they aren’t keeping quiet.

Jennifer Hibben-White and her 15-day-old son were exposed to measles in a Toronto doctor’s office while waiting

for a weigh-in appointment for the newborn. Baby Griffin was too young to be vaccinated. Hibben-White had already lost one daughter unexpectedly, to a blood infection.

“I’m angry. Angry as hell,” HibbenWhite wrote in a Feb. 10 Facebook post that received international attention. “I won’t get angry at or blame the person in the waiting room. I would have likely done the same thing ... you get sick, you go to the doctor. I have no idea what their story is and I will never know. But I do know one thing: If you have chosen to not vaccinate yourself or your child, I blame you. ... I watch these arguments trotted out on Facebook and Twitter citing false science and long discredited ‘studies’ that just won’t stop and Jenny McCarthy quotes and ‘it’s MY choice’ to not vaccinate ... and I think ... what would you have done if your child lay dying? Would you give them a scientifically proven, safe and effective vaccine and risk the minuscule likelihood of a side effect? Or would you let them go, knowing that at least they won’t develop autism (which they wouldn’t even develop anyway because SCIENCE)?”

Dr. Timothy Jacks, an Arizona pediatrician, testified before Congress about the importance of vaccines the same day, after an open letter he wrote to the parents of an unvaccinated child who exposed his family to measles went viral.

Jacks’ 10-month-old son Eli is too young to be vaccinated and his 2-year-old daughter Maggie has leukemia and can’t be immunized because she is immunocompromised. The family was exposed at a clinic while waiting for a lab draw after a round of Maggie’s chemotherapy.

“Unvaccinating parent, thanks for screwing up our three-week ‘vacation’ from chemotherapy,” Jacks wrote. “Instead of a break, we get to watch for measles symptoms and pray for no fevers (or back to the hospital we go).

Thanks for making us cancel our trip to the snow this year. Maggie really wanted to see snow, but we will not risk exposing anyone else. On that note, thanks for exposing 195 children to an illness considered ‘eliminated’ from the U.S. Your poor choices don’t just affect your child.

They affect my family and many more like us. Please forgive my sarcasm. I am upset and just a little bit scared.”

A national survey this month by the Pew Research Center found the majority of Americans — 83 percent — believe the MMR vaccine is safe. Seven percent said they were unsure, and 9 percent said the vaccine is dangerous.

The latter group irks Duddy to no end.

“People who don’t vaccinate — I feel like I should confiscate their keys and issue them a horse,” Duddy said. “It’s very, very frustrating.”

McCue worked her way up the ranks of Reid’s staff to become the senator’s top aide from 1999 to 2007. She strategized for the then-minority leader during his near-constant battles with thenPresident George W. Bush. McCue left Capitol Hill after 16 years to run the anti-poverty One Campaign; she counts its founder, Bono, as a personal friend. She now runs her own Washington public affairs firm, Message Global, and is considered one of the most well-connected people in the city.

After Reid’s 2010 re-election, McCue co-founded the Senate Majority PAC, aimed at helping Democrats win back the keys to the Senate in 2016 and helping Reid win his sixth re-election.

The PAC spent $46 million during the 2014 midterms, compared with $21 million from the comparable Republican organization American Crossroads, according to OpenSecrets.org. Even though Republicans took the Senate, McCue’s aggressive fundraising strategy marked a shift in how Democrats play the big-money game.

Anderson worked for Reid for six years, eventually becoming his deputy chief of staff. During that time, he helped Reid preserve Nevada wilderness, water resources and Native American lands. Anderson went on to become co-chair of the Washington lobbying firm Cassidy & Associates, where he helps clients from Nevada to New York secure congressional support for development and conservation projects on public lands.

Anderson believes development and conservation aren’t mutually exclusive. He has helped protect 538,000 acres of wilderness, much in Nevada, while advancing major infrastructure projects. He also is working to develop transmission lines that can help Nevada export its geothermal, solar and wind energy to other states.

The native Westerner specializes in understanding the minutia of law, a valuable skill set in Washington. He founded his firm in 1981.

Faust prefers to remain behind the scenes, but his fingerprints are on landmark legislation that created the Southern Nevada Public Lands Management Act, a national monument at Tule Springs and a payments-in-lieu of taxes program for rural Nevada counties with federal land.

His customers are satisfied: A recent study on lobbyists put Faust at the top of the list for most retained clients in Washington.

The former Boulder City mayor was elected in 2002 to represent Nevada’s newly created 3rd Congressional District, which spanned the Las Vegas suburbs. Porter lost re-election in 2008 to Rep. Dina Titus.

Working just blocks from the Capitol, Porter and his lobbying team are frequent guests in lawmakers’ offices. They are leaders in the debate on how to protect online gaming from casino magnate Sheldon Adelson’s efforts to ban it. They also work to bring more business to Nevada, particularly in the tourism and drone sectors.

Porter represents the Las Vegas Metro Chamber, city of North Las Vegas and Reno Tahoe National Airport.

McGinness, a fifth-generation Nevadan and son of Republican state Sen. Mike McGinness, worked as an aide for former Sen. John Ensign before becoming a lobbyist. He took over as director of Nevada’s two-person D.C. office in 2006.

McGinness works with Congress and federal agencies to champion all legislation benefitting Nevada. He’s currently focused on getting federal funding to build Interstate 11 through Las Vegas and trying to keep the sage grouse off the endangered species list, a designation that could close off large portions of Northern Nevada to development and recreation. His team also is trying to thwart renewed efforts to use Yucca Mountain as a nuclear waste dump.

In Congress, Laxalt gained a reputation as a powerful politician with a direct line to the White House. He and President Ronald Reagan met as governors and remained close friends in Washington. Laxalt also earned respect from Democrats, including Reid, who welcomed the senior Republican’s friendship.

After retiring from Capitol Hill, Laxalt tried to leverage his contacts for a short-lived presidential run in 1988. He settled into lobbying, and with his daughter, Michelle Laxalt, represented the American Gaming Association, Sirius Satellite Radio and Lockheed Martin.

The 92-year-old isn’t actively lobbying these days, but his name still reverberates in Nevada and Washington.

Fight against blight only intensifying Southern Nevada’s code-enforcement officials struggle to keep up

Out the back windows of the Creekside Hospice near Twain Avenue and Pecos Road, patients and visitors get a view of one of the valley’s worst eyesores.

When construction started in 2009, the building across the parking lot was supposed to be a medical office. Today, it sits empty, a half-finished monstrosity covered with graffiti.

A gaping hole where the front doors should be offers an unobstructed view through the concrete shell. The site has become a popular shelter for the area’s homeless. At night, the orange glow of bonfires flickers through holes meant for windows.

Continued attempts by the county to force the property’s owner, TRRAC LLC, to finish or secure the building have gone unheeded.

Soon, the county will take care of mat ters itself. Demolition is slated for later this year.

Fighting blight in Southern Nevada is a never-ending challenge for local governments. Although demolitions are rare, code enforcement officers are out almost every day mowing grass, boarding up bro ken windows and draining stagnant pools — costs that will be passed on to the owner.

Their task was made more difficult by the tidal wave of foreclosures that swept across the valley, leaving thousands of homes and buildings vacant. Money to pay for cleanups often is hard to come by, and code enforcement staff has been stretched thin by government cuts dur ing the recession.

Clark County plans to pay $64,000 to demolish the building on Twain Av enue. Money will come from the federal Neighborhood Stabilization Program.

Commissioners approved setting aside $250,000 in federal funding to pay for demolitions in a distressed area of Win chester bounded by Maryland Parkway and Boulder Highway, Sahara Avenue and Flamingo Road.

As with most abatements done by lo cal governments, a lien is placed on the property so when it is sold, demolition and cleanup costs can be recouped, and the stabilization fund can be replenished.

fective in North Las Vegas, the valley city hit hardest by the foreclosure crisis.

Officials there have used $400,000 in federal funds to demolish five homes since last summer. Another 30 homes, all at least 50 years old, are slated for demo lition unless owners, typically banks, take action, said Greg Blackburn, North Las Vegas’ director of community develop ment and compliance.

“We’re looking at homes that are not habitable,” Blackburn said. “These are homes that are abandoned. One house has caught on fire three times. It’s not worth banks putting in the money to get

rid of the home.”

In North Las Vegas, code-enforcement officers have repaired or demolished 1,177 homes and buildings over the past two years as part of a crackdown on blight.

The problem is less acute in Henderson and Las Vegas, but those cities also deal with chronic low-level blight and the occasional condemned building.

In Las Vegas, eight buildings in two of the city’s older wards were demolished, while 64 were landscaped, secured or fixed up. Henderson reported 88 abatements in 2014.

Beth Scow, whose district includes many older, distressed neighborhoods, said the situation seems to be improving as the economy rebounds but recommended continued action to stabilize communi ties and protect property values.

“It was at a peak when we had more empty homes and foreclosures, but it still exists — definitely,” Scow said. “Before, the most common complaints were empty homes that had squatters. Now, it seems to be more homes not being taken care of, cars in yards, things like broken windows or garbage collecting in empty lots.”

Pot spawning many businesses Growing marijuana is just the start of the economic impact legalization has had

It has been a busy weekend for lawyer Alicia Ashcraft.

For the past few days, the managing partner at Ashcraft & Barr, a local firm specializing in business regulation, has been unpacking boxes and putting the finishing touches on its newly expanded office. In December, Ashcraft & Barr partnered with Colorado-based marijuana law experts Vicente Sederberg to form a practice dedi cated to serving the needs of Nevada’s budding medical marijuana industry.

The lawyers can’t get ready fast enough.

“From regulation to taxation to business operations, there are (rules) specific to the marijuana industry that ... you need to have a little bit more specialization and expertise in,” Ashcraft said. “We’re helping businesses tread through the regulatory schemes in order to get open.”

The firm is one of several ancillary businesses cropping up in Las Vegas and throughout the state that are capitalizing on the growing demand for cannabis-related products and services. With the arrival of commercial producers and dispensaries comes a new set of market needs, from accessory vendors to greenhouse manufacturers and security officers to lawyers.

Just how much revenue such businesses will bring in is hard to predict, but experts estimate it to be in the hun-

dreds of millions of dollars nationally. And revenue is expected to grow as the industry expands.

Legal cannabis sales in the United States ballooned 74 percent in 2014, to $2.7 billion from $1.5 billion in 2013. The market in Nevada is expected to grow 341 percent in 2015, according to ArcView Group, a market research firm and investment network specializing in legal cannabis.

“A lot of businesses are looking to expand into Nevada and be able to offer their services because there’s going to be huge, huge growth in the market,” said Troy Dayton, founder and CEO of ArcView. “The cost of cannabis is a very small part of the overall budget. Every other line item on that budget is an opportunity for an ancillary business provider to meet an underserved need.”

Ancillary industries are rife with opportunity in part because their larger, more traditional counterparts remain hesitant to get into the pot business. Some estab lished businesses are deterred by the reputational risks that surround the industry and the fact that the federal government still classifies marijuana as an illegal drug.

Medical marijuana also largely is a cash-only enterprise, since most banks won’t work with vendors (although First Security Bank of Nevada has embraced medical marijuana as a new line of business).

But the industry can be a springboard for big opportunities. Among the most common ancillary services: waste management, real estate, consulting and information technology.

“There’s a reason people are calling Nevada the new Amsterdam of the West,” said Leslie Bocskor, a marijua-

na investor and founding chairman of the Nevada Cannabis Industry Association. “The opportunity in Nevada is huge.”

The industry is equally fertile for entrepreneurs with more unusual niche businesses. Medical marijuana modeling agencies, delivery services, interior design firms and social networks are cropping up in Las Vegas and beyond.

Smokin Hot Talent, for example, is a talent agency that launched last year to provide models, known as “smokesmodels,” for cannabis-related events and photoshoots.

Several appeared at Hempfest in October. The models are patients, advocates and supporters of the cannabis movement.

Nevada’s reciprocal card policy and tourism economy make it primed to draw visitors from other states where medical cannabis is legal, including California, which touts the largest cardholding population in the country.

That could give rise to ancillary services such as delivery services to marijuana-centered boutique hotels and smokers clubs that even states like Colorado have struggled to established.

The opportunities would increase if recreational use were approved in 2016.

“We’ve been conditioned as tourists to overspend in Las Vegas, and I think you’re going to see that happen with pot as well,” said Mike Nahass, director of Terra Tech, an agriculture technology firm that holds eight production licenses in Nevada. “I think tourism will be a big deal in time to come. When it goes recreational, certainly.

After 60 years, a Vegas classic crashes down

I

Why am I here, checking out this scene?

Because the Riviera is headed for demolition. The Las Vegas Visitors and Convention Authority verified what already had been known around the property and city: The tourism agency is buying the resort, demolishing it and building a new convention center as part of its $2.3 billion Las Vegas Global Village business district.

The Riviera hoped to celebrate its 60th birthday by making a statement that it was the one hotel on the Strip that still boasted a great, old-Vegas identity. Instead, like the timepiece hanging from Flavor Flav’s neck, the clock ticks down.

Funny, a few minutes ago a member of the hotel’s cleaning staff passed by, pushing a small dumpster on wheels through the registration area. He inadvertently slammed the container into a trash can, sending it crashing to the floor.

It felt like a mini-implosion, and a harbinger of what’s to come.

POTENTIAL SIDE EFFECTS Prenatal vitamins are unlikely to cause any serious side effects, but they can potentially be a source of discomfort. “For some women, iron can cause some constipation, nausea and an upset stomach,” Dr. David Kartzinel said. “Prenatal vitamins can also cause some women to feel generally unwell. Usually, I find it is easily remedied by switching the vitamin around, from different formulations and different brands, until a woman finds one she can tolerate.”

There are many illnesses that can cause complications during pregnancy, and measles is a top offender. “Measles can cause miscarriages, brain abnormalities and other serious problems for the baby,” Kartzinel said. “It’s critical that pregnant women stay away from people who are not immunized and anyone who might have measles.”

MORNING SICKNESS For women who experience moderate to severe morning sickness, prenatal vitamins are especially important to replace nutrients they’re losing from their diet.

A nutritious diet that is rich in fruits, vegetables and lean proteins is necessary during pregnancy. While prenatal vitamins cannot substitute a well-balanced diet, they can act as a fallback when women don’t eat as well as they should. “With the exception of folic acid and iron, many of the vitamins and minerals found in prenatal supplements are accounted for in a well-balanced diet, but many women don’t have the opportunity to eat nutritious meals all the time,” Kartzinel said. For women who do eat a healthy diet, most of the excess vitamins and minerals from the prenatal vitamins will be secreted, so there’s no harm in doing both.

Prenatal vitamins simply help guarantee there are no nutritional lapses.

EXERCISE It is important that women continue their fitness routine over the course of their pregnancy. Low-impact cardiovascular exercise is best for pregnant women, though some light weight training is fine, too. “I think swimming is the best exercise for pregnant women,” Kartzinel said. “It’s easy on their joints, it makes their back feel better, and it’s cardiovascular, so it helps with blood flow.” Other good low-impact options include walking, biking on a machine and yoga.

LAS VEGAS’ CASE FOR HOCKEY

Desert aside, we have a leg up on other possible expansion cities

With an arena under construction and an ownership group in place, Las Vegas appears to be ahead of the competition if the National Hockey League decides to add one or more teams in the coming years.

NHL Commissioner Gary Bettman emphasized the league hasn’t decided whether to expand, but it spoke volumes that he appeared Feb. 10 at the MGM Grand as an ownership group launched a drive to collect 10,000 season-ticket deposits. If multimillionaire Bill Foley and the Maloof family reach their goal — and they were halfway there after a day and a half — the league will have to seriously consider Las Vegas as a hockey town.

Other potential expansion cities have issues the valley doesn’t. Seattle has possible owners but an imperfect arena. Kansas City, Mo., and Portland, Ore., have NHLready arenas but no clear ownership groups. Quebec City already has lost an NHL team and faces cultural hurdles as a francophone city. Houston has ownership limitations because of its arena deal.

Las Vegas isn’t a perfect candidate. It would be the fourth-smallest NHL market in the country, ahead of Columbus, Ohio; Nashville, Tenn.; and Buffalo, N.Y. But market size doesn’t guarantee success, as Houston, the nation’s fifth-largest metropolitan area, has never had an NHL team, and two NHL teams have moved away from Atlanta.

Although adding teams could dilute talent across the league, it would make financial sense. Foley’s group would have to pay an expansion fee estimated to be about $450 million.

QUEBEC CITY Arena: New Quebec City Amphitheatre, a $400 million venue funded by the city and province of Quebec, is scheduled to open in September. It will seat 18,482 for hockey.

Ownership: Since the Quebec Nordiques moved to Denver in 1995 to become the Colorado Avalanche, many potential ownership groups have pursued a team.

Hockey history: The city has been home to two top-level teams: the Bulldogs from 1878 to 1920 and the Nordiques, who played in the World Hockey Association from 1972 to 1979 before joining the NHL. Potential obstacles: The market would be one of the smallest in major North American sports.

Also, Quebec City is almost entirely a francophone city with little English-language media.

That could make it difficult for a Quebec City team to attract players who don’t speak French.

720K Arena: FirstOntario Centre, which opened in 1985, seats 17,383 for hockey.

Ownership: BlackBerry founder Jim Balsillie has made three attempts to purchase a team and relocate it to Hamilton.

Instead, he could pursue an expansion team.

Hockey history: Hamilton had an NHL team in the early 1920s, but the team folded in 1925. The minor-league Bulldogs have been in Hamilton since 1996.

Potential obstacles: The Toronto Maple Leafs and Buffalo Sabres, both within 50 miles of FirstOntario Centre, oppose a team in Hamilton. A team could have trouble drawing fans from established fan bases nearby.

HOUSTON

Arena: MGM Resorts International and Anschutz Entertainment Group are building a 17,500-seat, $375 million arena on the Strip behind New York-New York, scheduled to be completed by April 2016.

Ownership: Bill Foley heads Hockey Vision Las Vegas, a partnership with the Maloof family. Foley is CEO of insurance and mortgage company Fidelity National Financial. The Maloofs have a minority stake in the Palms and used to own the NBA’s Sacramento Kings.

Hockey history: Las Vegas was home to the minor-league Thunder from 1993 to 1999 and Wranglers from 2003 to 2014.

Both teams folded because of arena problems.

Potential obstacles: Las Vegas is a nontraditional hockey market where many people work irregular hours, which could make it difficult to build a stable fan base. Nevada residents’ economic health ranks among the nation’s worst, so many people can’t afford season tickets.

Hockey history: The NHL’s Kansas City Scouts struggled with low attendance from 1974 to 1976 before the team moved to Denver. Minor-league teams in the area have included the Blades, who played in the International Hockey League from 1990 to 2001.

Potential obstacles: The lack of an ownership group, a poor history with the NHL and a small market combine to make Kansas City look like a long shot.

Arena: The Maple Leafs play in Air Canada Centre, but a second Toronto team could share the venue, the same way the NBA’s Lakers and Clippers share Staples Center in Los Angeles. New arenas also have been proposed in Toronto and the suburbs Vaughan and Markham.

Hockey history: The Leafs are one of the NHL’s Original Six teams and have won 13 championships. The city, which also has had minor-league and junior teams, has been home to the Hockey Hall of Fame since 1958.

Potential obstacles: The market appears to be large enough to support two teams, but the ownership and arena issues are significant.

Ownership: Microsoft co-founder Paul Allen owns the arena and its primary tenant, the NBA’s Trail Blazers. He came close to acquiring the Pittsburgh Penguins in the late 1990s.

Hockey history: The city has been home to the Western Hockey League’s Winterhawks, regularly one the league’s leaders in attendance, since 1976.

Potential obstacles: Who besides Allen could afford a team?

Although the MLS’ Timbers have been a hit in Portland, doubts remain about the city’s ability to fill an arena for professional hockey.

Arena: KeyArena, which opened in 1962 and was renovated in the mid-1990s, seats 15,177 for hockey.

Ownership: Minnesota Wild Vice Chairman Jac Sperling and New York investment banker Ray Bartoszek could lead the push to bring a team to the Seattle area.

Hockey history: The Seattle Metropolitans were the first U.S. team to win the Stanley Cup but folded in 1924. The area has two Western Hockey League major-junior teams: the Seattle Thunderbirds, who moved out of KeyArena in 2009, and the Everett Silvertips. The Thunderbirds now play in Kent.

Potential obstacles: KeyArena’s renovation made the venue less than ideal for hockey capacity and sightlines. An arena has been proposed for the city’s SoDo district but has hit snags.

Suburban cities such as Tukwila and Bellevue are possible sites for a new arena.

Treasurer’s budget calls into question his seriousness

S

tate Treasurer Dan Schwartz, who took office last month, recently introduced what he called an “alternative budget” to the one proposed by Gov. Brian Sandoval.

The plan promises cuts to government spending that Schwartz paints as excessive and dismisses the governor’s proposal to restructure the state’s broken tax system because it raises taxes.

Schwartz, a Republican, presented his suggestions to the state Senate Finance Committee this month, and he was fiercely opposed by senators from both parties. And for good reason.

Not only does his plan not add up, but it brings confusion to the process of how Nevada adopts its budget.

Schwartz now has given an opportunity to fringe lawmakers to cite his budget plan, which was poorly conceived and unworkable.

THE ISSUE Unlike the governor’s plan, which runs 3,361 pages, Schwartz offered a budget that was a three-page news re-

lease and had factual issues. It wasn’t an alternative budget so much as a political shot at Sandoval. Schwartz’s attack may seem odd considering he rode to office on Sandoval’s coattails, but that is the way state Republicans seem to operate these days.

In his news release, Schwartz said he and newly-elected state Controller Ron Knecht, “elected with fiscal and financial responsibilities, have reviewed the governor’s executive budget.”

THE PROBLEM However they reviewed it, it doesn’t appear either thoughtfully read it. Mike Willden, Sandoval’s well-respected chief of staff, has 40 years of government experience and said he was “appalled at the lack of research” in Schwartz’s plan.

Willden listed several examples of critical mistakes Schwartz made, such

as not knowing where money came from or what it could legally be used for.

For example, in his original plan, Schwartz proposed raising fees on airline passengers to help pay for the state budget. He had to go back to the drawing board when he learned that was illegal.

Schwartz came back with an idea to add a tax on hotel restaurant and bar revenue, though he couldn’t provide a full explanation of how that would work or how much money it would bring in.

THE POWER OF OFFICE Although senators rebuked Schwartz’s ideas, there is a larger issue of concern with Schwartz’s plan.

Now that Schwartz is state treasurer, his proposal carries weight because of his office. People actually may believe him, no matter how wrong he might be.

More so, there is a question about what authority Schwartz had to bring another budget proposal. Schwartz points to a state law as proof he can propose a budget, but state lawmakers didn’t buy what appeared to be a novel view of the law.

Senate Majority Leader Michael Roberson, R-Henderson, said Schwartz was “hijacking the process and bringing forward a three-page budget for political purposes.”

THE POLITICS There is no doubt Schwartz is being political. He is part of an anti-tax, antigovernment coalition of conservatives who are upset with the governor, even if they are in office largely due to Sandoval’s popularity.

Here’s a lingering — and troubling — question: If this is the work Schwartz did on the state budget, what is he doing in his own office?

Instead of trying to do the governor’s job, Schwartz should go back to the treasurer’s office and try to do the work he was elected to do.

FORECLOSURE FILINGS HEAT UP IN JANUARY Nevada’s notorious foreclosure woes had eased over the past few years, with fewer borrowers defaulting on mortgages and losing their homes to lenders. But 2015 started with a painful setback.

One in every 495 homes statewide received a foreclosure-related filing in January, up 38 percent from December and 8 percent from a year ago,

according to RealtyTrac. Nevada had the second-highest foreclosure rate in the country last month, behind Florida.

There were 1,009 filings statewide to start the foreclosure process, up nearly 11 percent from December and 255 percent from a year ago. Creditors also seized 698 homes in Nevada last month, up 125 percent from December and almost 29 percent from a year ago.

He has seen its people experience euphoric highs and struggle through depressing lows. He started Brooks Behavioral Health Center with the mission of providing care for those dealing with depression, anxiety, ADHD and a number of other difficulties that affect a person’s wellbeing and quality of life.

Why did you choose this field?

This field chose me. Growing up in West Las Vegas instilled the desire to give back to the community. The health care industry was an opportunity for me to help those in need while generating employment for others.

What’s your best advice for people struggling with substance abuse?

Addictions are tough. It’s not easy to deal with any kind of addiction, but I think the most common mistake is that people feel like they have to go through it by themselves. It is important for people to understand they aren’t the only ones suffering and that treatment will help.

Do you think it is harder to deal with substance abuse here than in other cities?

I do not. Las Vegas has several behavioral health centers. The hardest part of our job is educating abusers that help is available.

What advice do you have for other entrepreneurs?

What’s the most important part of your job?

I would hardly call it a job. It is a lifestyle, and a rewarding one. I love meeting our clients, talking to them about their concerns and seeing the smiles on their faces after they come out of a treatment.

What is the hardest part about doing business in Las Vegas?

Finding the right people and the honest people to do

the work — especially construction. Otherwise, I think if you have the right intentions and the right mindset, nothing can stand in your way.

What is the best part about doing business here?

The diversity is my favorite part. I see all kinds of people on a daily basis, with various cultural backgrounds and different interests in life. It is rewarding to see such diversity gather together under our roof, hang out in the Salt Cave and share experiences.

What obstacles has your business overcome?

We certainly had many obstacles building our Salt Cave, since it was something no one had built before. Salt is not very easy to work with, and it had to have a natural compound to go up on the walls with. We spent many sleepless nights working out details of design and construction, which took about six months.

What have you learned from the recession?

I started working for the banking industry during the recession, which gave me a lot of insight on consumers and small businesses. It was painful to see the immense increase of unemployment blue cards, which became a norm of daily transactions. It was equally painful to see so many small businesses shut down. I made it a point to educate smallbusiness owners how important cash flow is. You should always be prepared for the rainy day, legislation changes, shifts in laws and even consumer spending. Change is the only constant thing in life. If you can’t keep up with the pace of change, you cannot catch the wave of success.

Gaming industry plans to be heard in ’16 election

“It’s exciting knowing, and seeing firsthand, that more and more women are becoming leaders,” she said.

Gaming Votes is part of a larger effort by the gaming association to shape the casino industry’s public perception. Last year, the association launched its “Get to Know Gaming” campaign and ran ads in Massachusetts while voters were considering a ballot measure that would have banned casinos in the state.

The association also spread earlier reports from Oxford Economics showing the casino industry supports 1.7 million jobs nationwide.

App being developed to offer 24/7 help for gambling addicts

Gambling addicts may soon be able to get help anytime, anywhere, at the touch of their smartphone screen.

Researchers at UCLA are developing an app that would allow problem gamblers to continue their treatment virtually, between regular in-person therapy sessions. The app would also help therapists by providing information that could be used to improve their treatment regimens.

Here’s how it works: A patient struggling not to gamble could open the app and rate the strength of their gambling urges, view messages from their therapist, go through guided meditation or access other treatment options. They could also use the app to track their treatment’s progress, keep journal entries and provide information about their lifestyle.

“Think of it sort of like a first-aid kit for problem gambling,” said Ardeshir Rahman, program manager for the behavioral technologies lab at UCLA’s Gambling Studies Program, which is developing the app.

“The app has a lot of built-in tools and techniques that allow people to manage their behaviors in a controlled way.”

Rahman said developers were still in the early testing stages, but if all goes well, the app could be ready around this time next year.

He hopes the tool can improve treatment for problem gamblers by generating data on patients’ behavior in real time.

For example, the app contains a “triggers” section that patients can use when they feel the urge to gamble. The section asks them what kind of trigger they’re experiencing — do

they want to gamble because of certain internal feelings, or is it something like an external object? The app also prompts patients to rate the intensity of their gambling urge, and to choose from a series of descriptions that best fit their current mood.

Using such information, a therapist might be able to draw conclusions about the patient’s gambling compulsions much faster than usual.

Rahman said that, in his team’s clinical trial, a therapist was able to note a correlation between time of day, mood and the strength of a particular patient’s gambling urges after just one week of using the app.

“You can make a conclusion that this particular patient, around 2 a.m., was feeling very bored and then had very strong urges to gamble,” Rahman said. “That’s data we never had before.”

A therapist can use such information to help develop treatment strategies. In the case of the person being bored around 2 a.m., that meant improving the patient’s sleep habits.

The UCLA team is conducting a feasibility study, in which it’s testing the app on a small group of patients to see if it has a positive effect. The next step is to test it on a larger scale.

“Worst-case scenario, this becomes a way for us to track patients’ behaviors,” Rahman said. “Even that would be a huge improvement over what we do today.”

Carol O’Hare, executive director of the Nevada Council on Problem Gambling, said she was particularly excited that the innovation facilitates more communication between therapists and patients because “you can’t be sitting in your therapist’s office every day.”

Three buddies make their way to the front registers, their small shopping carts packed with vodka, wine, soda, chips, bags of ice and a whole lot of beer. Others stroll the aisles looking at the hundreds, maybe thousands, of shot glasses, flasks, ashtrays and shirts for sale, many with familiar Las Vegas themes — booze, gambling, sex and partying.

“Party Like A Rock Star” says a 64-ounce, or half-gallon, flask. “SIZE MATTERS” declares one that can hold 128 ounces — a full gallon — of alcohol.

The store is on the Strip, but it’s not your typical liquor depot or Vegas party shop. It’s a Walgreens pharmacy.

Las Vegas’ resort corridor is peppered with Walgreens and CVS Pharmacy stores, with more on the way.

The chains are drawn to the Strip for its heavy foot traffic and tourists’ universal need for water, snacks, medicine and the not-so-infrequent hotel-room party.

Landlords want them because national pharmacies are stable tenants that do big business, sign long-term leases and can easily afford the area’s eye-popping rents.

They pay about $300,000 a year in rent for a typical residential store but around $2 million a year for space on the Strip, said broker Ray Germain, a senior associate with Marcus & Millichap.

“Their sales at these locations are just phenomenal,” he said.

Walgreens has five stores on the Strip, all on the east side of the boulevard. The company plans to open another one in the area this spring, in a newly built retail plaza at the northeast corner of Sahara Avenue and Las Vegas Boulevard, across from SLS Las Vegas.

CVS has two stores on the Strip, both on the west side — one next to Monte Carlo just outside CityCenter, and the other at the base of Sky Las Vegas, a luxury condo tower across from the mothballed Fontainebleau.

The retailer plans to open another

store on the west side of the Strip at the end of March, in the new three-story mall at Treasure Island, CVS Health Corp. spokesman Mike DeAngelis confirmed.

There is one more CVS being planned for the Strip, and it could “potentially” open in 2016, DeAngelis said.

The resort corridor is a gold mine for such stores — there are about 38,600 hotel and motel rooms on and just north of the Strip, according to the Las Vegas Convention and Visitors Authority, and it’s the valley’s main concentration of jobs, with tens of thousands of workers cycling through each day.

Germain said one of his current listings — the Walgreens property at Convention Center Drive — at one point had the highest sales totals of any in the chain. That distinction now apparently belongs to the Walgreens between the Venetian and Palazzo, he said.

Walgreens has about 8,200 stores and booked $76.4 billion in sales in the year ending Aug. 31, according to a

regulatory filing.

Pharmacy properties also sell for big dollars on the Strip.

In separate deals in 2012, landlords sold the Walgreens property between the Venetian and Palazzo for $71 million and the Walgreens at Convention Center Drive for $28 million. Last spring, investors sold the CVS property in Sky Las Vegas for $30 million.

Current owners of the Walgreens property at Convention Center do not have a listing price, but Germain said his clients are aiming for more than $40 million.

Not all of the Walgreens and CVS locations on the resort corridor have or will have pharmacies, but they sell items you’d see in any neighborhood store — gum, juice, bottled water, cosmetics, shampoo.

And, this being the Strip, they also sell items fit for the epicenter of this tourist and party town — souvenirs, booze, whatnot.

“Alcohol would be one of our (top) sellers,” a store manager said.

Student-run drone company is getting off the ground

A year ago, Greg Friesmuth spent most of his time in the Cage, a cramped room in UNLV’s science and engineering building, where he tested homemade drones for a company he had just founded called Skyworks Aerial Systems.

Now he’s a graduate and spends most days in the Pit, a windowless room full of workbenches and computers inside Skyworks’ new office in Henderson, where the startup took up a lease last summer.

A lot has changed.

The QuaRK, which costs $9,000, has four rotors and a square foundation containing the flight software.

Skyworks designed the QuaRK to be easily customized by attaching different modules and sensors. Even the software can be tweaked.

A laser-scanning module can be attached to construct a 3D map of a certain area, for example. Another possibility is a radiation sensor that could measure the level of damage in a nuclear reactor after a disaster like Fukushima.

When you buy a QuaRK, Friesmuth says, you’re buying a toolbox. That means Skyworks can serve a wide variety of clients who can adapt the drone to serve their needs.

“It’s a new approach to quadrotors,” he said. “There haven’t really been any other drones out there that have this modular concept.”

Skyworks is courting more investors and working to get the QuaRK classified as an experimental aircraft, which would exempt it from some federal restrictions.

Around $200,000 has been invested into the company, mostly from private individuals. Skyworks is hoping to raise about $1 million.

Now that it has sold its first drones, the next step is using information gathered from customers to strengthen the company’s business model. After that, Friesmuth said the company could be ready for serious venture capital investment.

“Right now there’s a lot of money going into other companies, so we need similar financials to compete,” Friesmuth said. “Drones are going to be as big as phones and computers.”

Gravel auction another sign construction industry rebounding

Federal lands officials are selling raw construction materials to the highest bidders in Southern Nevada again, another sign the building industry is back from the dead.

The U.S. Bureau of Land Management next month plans to auction nearly 9.6 million tons of sand and gravel from government-owned pits off Lone Mountain Road, west of the 215 Beltway in northwest Las Vegas, the agency said.

The auction is March 3 at the BLM’s office at 4701 N. Torrey Pines Drive.

Prospective buyers must pay at least 94 cents per ton.

If everything sells, the auction will generate at least $9 million in proceeds.

Sand and gravel can be used in the construction of highways, highrise buildings, power plants, airport runways and bridges, among other things, the BLM said.

Agency officials used to auction the raw materials “all the time,” but

demand dried up, so they switched to direct, noncompetitive sales, said Kirsten Cannon, a BLM spokeswoman in Las Vegas.

Demand has now returned, she said, “so that’s why we’re moving back to auctions.”

Last summer, for instance, the agency auctioned off 30,000 tons of gravel stockpiles in Pahrump for $2.57 per ton — or $77,100 — to Wulfenstein Construction Co., Cannon said.

Southern Nevada’s construction

industry remains a shadow of what it was during the real estate bubble last decade, but it has grown the past few years after suffering huge job losses during the recession.

The Las Vegas area had 43,600 construction workers as of September, up 22 percent from two years earlier, according to the Associated General Contractors of America.

By comparison, even in spring 2008 as the market was heading south, the valley had 94,500 construction workers.

Investors buy 127 acres at Lake Las Vegas for new neighborhoods

Southern California investors have acquired a big swath of land at Lake Las Vegas, the upscale and long-struggling Henderson development.

R.Y. Properties and its partners recently bought 127 acres for $12.5 million at the south edge of the once-foreclosed and formerly bankrupt 3,600-acre community. It has plans for residential development, according to a news release.

The land, which has already been graded and prepared for homes, is just east of the shuttered Falls Golf Club, near the main entrance off Lake Mead Parkway.

The deal was announced this month by the brokerage firm Hoffman Co., which represented sellers with the Atalon Group.

The sale closed Dec. 22, property records show, and amounts to $98,425 an acre. That’s well below the $169,101 an acre that Southern Nevada land sells for on average, according to Colliers International data.

Brokers said Kimberly Yu, an executive with Alhambra, Calif.-based R.Y., indicated the group plans to develop three residential communities — Verona, with 127 lots; Providence, 112 lots; and Serrano, 105 lots.

This is R.Y.’s first land purchase at Lake Las Vegas, according to the sellers, who could not confirm whether the new owners plan to build homes themselves or sell the land in pieces to builders.

“The land business has similarities to the Buddhist philosophy of birth, death and rebirth, and there is no place where this is more clear than Lake Las Vegas,” Hoffman broker Aman Lal said in the news release.

Lake Las Vegas was designed as an el-

egant Mediterranean village with a 320acre, man-made lake but wound up one of the biggest real estate flops in one of the hardest-hit markets in the country.

Former developers lost the project to foreclosure after defaulting on $540 million in loans in 2007. Atalon acquired the project in early 2008 but pushed it into bankruptcy protection six months later.

The community emerged from bankruptcy court in summer 2010, reportedly under the control of Dallas investment firm Highland Capital Management and lenders led by Credit Suisse.

Along the way, golf courses and other businesses closed, tourism plunged and housing foreclosures soared.

The project later showed signs of im-

provement, with rising home prices and hotel occupancy inching higher. Also, Wall Street billionaire John Paulson acquired roughly 1,000 acres with plans to sell much of it to homebuilders. His company’s holdings include the Falls golf course and the Reflection Bay Golf Club, which closed in 2009 but reopened last fall.

If you’re going to blow the whistle, talk to a governing agency before you talk to your boss get dicey as you make the leap from employee to whistleblower. Soon, you could have a target on your back.

The National Conference of State Legislatures defines whistleblowers as people — usually employees or former employees — who report fraudulent or illegal activity by their employer, the government or an organization.

If a whistleblower reports a violation of federal law, there are provisions to protect them from retaliation. The Department of Labor lists the regulations on its website — dol.gov/compliance/laws/ comp-whistleblower.htm.

But Nevada is one of 15 states without a state statute guaranteeing protection for whistleblowers.

That means there’s risk to public- and private-sector employees who could face retaliation, including being fired, for calling attention to illegal or corrupt workplace conduct.

If the employee believes an action against him is in retribution for speaking up, he’d have to prove wrongful termination in court.

There are rules to be followed. Lawsuits in whistleblower wrongful-termination cases have been thrown out of court because employees failed to first report the information to an outside government authority, before reporting it to a workplace superior. For instance, if a casino employee witnesses a co-worker or boss doing something illegal, he is supposed to report it first to the Nevada Gaming Control Board, not his employer, to buttress his claim of wrongful termination if he is dismissed.

So what should you do if you want to blow the whistle on a workplace problem you think is illegal in Nevada?

Make your boss aware you have contacted a governing agency. n Talk to a lawyer. Seek consultation from an attorney who practices in the specified field. n Keep evidence. Save emails, texts and any other evidence you have that points toward the problem and/or action sought against you. n Document. Document everything in writing.

A CASE IN POINT: WILTSIE VS. MAXIM The need for whistleblowers to go to legal authorities before taking complaints to employers became especially clear in the 1989 case involving Jerry Wiltsie, a Las Vegas poker room manager at the Maxim.

He told higher-ups in the company that his supervisor was participating in illegal activities.

Wiltsie was fired, which he claimed was retaliation for calling out his boss. He sued the hotel’s owner, Baby Grand Corp., for wrongful termination.

But because Wiltsie did not report his suspicions to an outside regulatory authority — in this
