After the deaths of an unarmed teenager in Ferguson, Mo., and a man in Staten Island, N.Y., both at the hands of police, law enforcement officials across the country increasingly are looking at body cameras as a way to enhance officer transparency and accountability. ¶ Metro Police officials announced plans for a camera pilot program in 2013, well before the deaths of Michael Brown and Eric Garner. The department, which has faced accusations of racial bias after a series of officer-involved shootings in the 2000s, hopes body cameras will help improve community relations.

WHAT ARE BODY CAMERAS? Tiny video cameras mounted directly onto a person to capture footage from the wearer’s point of view, body cameras typically are worn by police but are marketed for athletes and adventure seekers who want to capture action shots, as well.

HOW THEY WORK ■ Metro’s cameras are no bigger than a marker and have a magnetic strip that allows officers to attach them to mounts placed on their shoulder, collar or head, or on a pair of glasses.

■ Most officers prefer the collar because it’s the most comfortable. The least popular option is the head because it slips and officers say it looks goofy. The cameras are sturdy and are designed to stay on an officer during a struggle or foot chase.

■ Cameras come with a battery pack about the size of a deck of cards.

The camera’s power switch is on the battery pack, connected by a thin wire.

■ Footage is stored on a chip inside the battery pack. A dock at the police station uploads the data to a computer.

Metro began buying cameras in March, and the yearlong pilot program began officially in November. Of Metro’s 2,555 officers, 197 volunteered to wear body cameras.

Another 190 officers not wearing cameras also will be studied.

DASH CAMS: Dashboard cameras record only what is directly in front of the vehicle.

BODY CAMS: In a situation like this one, an officer’s body camera could record a suspect drawing a weapon and what happens next.

WHAT ABOUT DASH CAMS? Henderson and Boulder City police, as well as the Nevada Highway Patrol, use dash cameras in vehicles. Metro does not.

The cameras are mounted inside officers’ vehicles and can record video while the officer is driving. They have been widely available since the 1980s.

Like body cameras, they can enhance officer safety and improve accountability, advocates say. The biggest concern users have had is the cameras’ poor sound quality. Police who frequently are on foot also don’t benefit much from the cameras since the devices capture only action directly in front of the vehicle.

■ All 150 Henderson Police patrol cars have been outfitted with dash cameras since June 2011. The cameras turn on automatically when an officer’s vehicle goes 80 mph or faster, when an officer manually activates one or when a patrol car’s sirens are turned on.

The cameras can’t be turned off manually. A $1.2 million grant from the U.S. Justice Department paid for the equipment.

■ Dash cameras in Boulder City cost about $3,500 each. Each of the department’s 28 patrol cars has one.

WHO CAN SEE THE FOOTAGE? ■ Police. Supervisors overseeing the pilot program can view footage. Officers can see only the footage they upload.

FOOTAGE WORKS BOTH WAYS ■ Camera footage helped quell unrest in Rialto, Calif., after police shot and wounded a man in 2011. The man claimed he was unarmed, but footage from a camera the officer was wearing on his uniform showed the suspect waving a handgun.

■ Lawyers. Prosecutors and defense attorneys can request footage, which is admissible in court. Experts say courts, arbitrators and civilian review boards increasingly expect police to use body cameras.

■ In 2012, after Rialto police equipped more officers with cameras, complaints of police abuse plummeted from 24 to three in the first year. Incidents of police use-of-force dropped by 66 percent.

■ Body camera footage typically isn’t available to the public while it’s part of an open investigation.

■ An officer in Phoenix was fired after footage from his body camera showed him repeatedly verbally abusing people, using profanity and making threats against the public.

■ Of the 40,000 recordings Metro Police have made so far, officials have retained fewer than half, they said. Officers delete footage from calls that don’t result in criminal charges. All other footage is kept for at least 45 days.

SCOPE ■ Metro is the only Southern Nevada law enforcement agency that uses body cameras. North Las Vegas, Henderson, Boulder City and Clark County School District police say they have considered using body cameras but are awaiting the results of Metro’s study.

■ About a quarter of police departments nationally use body cameras, according to a 2013 study by the U.S. Justice Department.

■ More than 1,200 law enforcement agencies have bought wearable cameras from Taser International, one of the devices’ primary distributors.

t was their first date. Zack Kalashian, then a VIP host for Las Vegas nightclubs, wanted to treat the woman well, so he brought the young cocktail waitress to N9NE Steakhouse at the Palms. ¶ She demanded they order a $2,000 bottle of champagne. Kalashian could hardly believe it. Sure, they were dining at a fancy restaurant and he made good money ushering tourists into clubs, but his practical, small-town Wisconsin sensibilities were screaming in his head. The request seemed frivolous. ¶ “I’m not going to throw $2,000 on a bottle of champagne,” Kalashian, now 35, recalls telling his date. “I barely know you.” ¶ That was it. The woman walked out. ¶ Kalashian stayed at the restaurant, invited friends to join him and never regretted the decision. ¶ Now living in Hawaii, Kalashian’s first reaction to the mention of dating in Las Vegas is, “It’s not easy.”

He said there was a common refrain among his friends who work on the Strip: “In order to find someone to marry, you’re going to have to leave Las Vegas.”

especially challenging environment. The city’s fantasylike atmosphere, where good looks carry heavy weight, can contribute to unrealistic expectations for a mate. That’s on top of many residents’ odd work schedules, neighborhood conveniences that can prevent people from crossing paths and the community’s overall transiency.

“There are so many good people out there, they’re just not meeting,” said Mickie Choi, a dealer at the Cosmopolitan who organizes the “Single & Fabulous in Las Vegas” Meetup group.

Those difficulties led Lauren Peña and a friend to start their own matchmaking service. A Las Vegas native and bankruptcy lawyer by day, Peña kept hearing friends complain about not meeting people to date. Her friend, Steven Peralta, encountered the same gripes in his circle, so they decided to set up a handful of friends.

It spiraled from there as more friends and acquaintances expressed interest. Called Project Duo, their company pairs eligible bachelors — many of whom are successful members of the community and pay thousands of dollars to join — with women seeking a relationship.

“A lot of women are really convinced it’s going to happen in the most organic, beautiful way,” Peña said. “Nowadays, it just doesn’t happen that way.”

Peña has several theories about why, particularly here.

First and foremost: locals’ impossibly high standards.

Women want men with six-pack abs. Men want beautiful women with perfect proportions. Sixty-year-olds want to date people half their age.

Such desires aren’t unique to Las Vegans, but Peña said people seem to be more honest about it here, perhaps because of the perceived accessibility to good-looking people.

It’s not hard to imagine why. After all, the Strip runs on hospitality, so it’s many workers’ job to make people feel important. Cocktail waitresses chat up middle-aged men sitting at slot machines, while VIP hosts in sharp suits sweet-talk women into clubs and lounges.

“Unrealistic expectations are the most giant hurdle for single people” in Las Vegas, Peña said. “If I could put that in neon lights, that would be it.”

Naturally, in a city flush with money, material expectations play a role, too. SeekingArrangement.com, which describes itself as a place “where beautiful, successful people fuel mutually beneficial relationships,” has 47,000 “Sugar Baby” and 9,000 “Sugar Daddy” members in Las Vegas.

That places the city in the top 10 nationally for both men and women seeking well-off partners on the site.

Marquel Martin, who last year appeared on ABC’s hit reality show “The Bachelorette,” used the word “fabricated” to describe the local dating scene. The former UNLV football player said wooing prospective girlfriends is challenging because his idea of a good time isn’t necessarily glitzy. It typically involves hiking, bowling or watching Netflix and hanging out with friends.

“I’m much more laid back,” said Martin, 27, who works in sponsorship sales at UFC. “I don’t like clubs at all.”

Martin said he struggles to find people who value education and ambition. He has a master’s degree from UNLV and is working on starting his own business, a dessert lounge called Social Cookie.

“It’s tough to find someone else who may be on the same level or mindset out here,” he said.

Dating someone who works swing or graveyard shifts at a casino wouldn’t mesh with his 9-to-5 workday or the hours he plans to spend at Starbucks dreaming up his future business plans. ❤ ❤ ❤ THIS IS A CITY OF 2 MILLION, filled with neighborhoods, schools and parks. work evenings, nights and weekends on the Strip and miss many social outings. The group quickly grew and now has nearly 3,000 members, including nurses, engineers and lawyers, who attend happy hours, club nights and other activities.

“It’s all about having fun and making friends,” Choi said.

The group is a prime example of what Peña said more singles should do — actively meet new people in the community. The city’s conveniences are a detriment to the dating scene, she said. Because grocery stores, restaurants, shopping centers and casinos exist in most neighborhoods, people never have to wander far to run errands or find entertainment, and thus have fewer serendipitous encounters with new people.

People “are just not intersecting,” Choi said. “The convenience works both ways.”

That’s why Jennifer Parsons, 30, turned to online dating several years ago. She wanted to expand her dating pool beyond the people she met through friends and work. Dating sites such as Match.com and PlentyOfFish seemed like her best hope. Match.com has more than 37,000 profiles for people living in the Las Vegas area, a spokeswoman said.

A relationship blossomed for Parsons but fizzled after a few years.

Now, Parsons is giving online dating another shot.

She updates her profile with flattering pictures and has a list of go-to spots for when she meets someone.

She prefers meeting for frozen yogurt because if she doesn’t like the guy, she isn’t trapped for hours like she would be at a three-course meal.

“Around here, the pickings are slim,” said Parsons, who works at a law firm. “You have to weed through a lot of weirdos to get to the nice ones.”

Online dating in Las Vegas is challenging because of the community’s transiency. Some people aren’t looking for a lasting relationship because they don’t intend to settle down here. Others don’t live here at all.

Peña, who is single, once did a seven-day trial of Tinder, the dating app that suggests matches based on a person’s Facebook profile and geographic location. Her suggested matches ranged from men down the street to tourists from as far away as Australia who were in town and looking for fun.

But if dating is the luck of the draw, it’s bound to work out every so often.

Janay Oakland, a model and company sales representative, joined Tinder on a whim and met her current boyfriend. He was here on a business trip in April.

Their first date, which started at Mix Lounge and ended at Tryst nightclub, lasted 10 hours and led to a longdistance relationship.

“We both swiped right,” she said.

Oakland, who’s in her 30s and never considered dating in Las Vegas very difficult, called their meeting a fluke. Previously, she met people through friends or social activities, such as tennis.

“I’ve never done online dating,” she said. “It’s kind of a numbers game anyway, so you might as well use all the tools available.”

The method worked for 29-year-old Julian Concepcion, too. Except, in his case, he began using dating apps to fill a gap he saw in Las Vegas’ gay community.

WalletHub, a personal finance website, looked at the percentage of singles, cost of meals and available attractions in 150 U.S. cities. Las Vegas ranked high in the “romance and fun” category but received a dismal ranking in the “economics of dating” category.

Contrary to the view many have of the city, Las Vegas isn’t full of cheaters, according to AshleyMadison.com, a website that facilitates affairs for the unfaithful. Las Vegas ranks No. 35 on AshleyMadison’s list of cheating cities, well below party hot spot Miami (No. 5) and Southwest neighbor Phoenix (No. 10).

AshleyMadison had 79,000 members living in Las Vegas as of September. Fifty-five percent were men; 45 percent women.

“If anything, the residents of Las Vegas are prudish,” founder and CEO Noel Biderman said. “There is nothing extraordinary about the infidelity rate in Las Vegas.”

That doesn’t mean affairs and one-night stands don’t take place in Las Vegas. They do; they’re just more likely to occur on the Strip than in the suburbs.

AshleyMadison’s “traveling man” and “traveling woman” section, which offers services for tourists, is most popular in Las Vegas, especially during the International Consumer Electronics Show, Biderman said.

Concepcion moved here two years ago from San Diego, which has the gay neighborhood Hillcrest — a dozen blocks filled with stores, coffee shops and bars. Although Las Vegas has clusters of gay bars in several areas, it lacks a distinct gay neighborhood where residents can live, shop and be entertained.

An employee at the Gay and Lesbian Community Center of Southern Nevada, Concepcion didn’t want to date anyone who worked or volunteered there. Nor was he into the bar scene.

“The gay community in this city is all spread out,” Concepcion said. “If you don’t have physical venues to go to, you have to go online.”

In September, he joined a handful of gay dating apps and met his boyfriend, who works in marketing on the Strip.

Without dating apps, Concepcion knows their paths might not have crossed.

friends camped out at a high-top table at Born And Raised, the southwest valley bar geared toward locals.

The Desert Oasis High School grads, all in their early 20s, defended Las Vegas’ dating odds as they sipped beers and waited for food. Two of them met in middle school and now are dating.

“It seems pretty normal,” said Cody Larson, 21. “It’s the same as any other place. It’s all about personality.”

His unscientific assessment might not be far off base. Las Vegas’ dating demographics are more average than unique.

Fifty-nine percent of Las Vegans aged 25 to 34 are unmarried, compared with 66 percent in Los Angeles and Miami, according to 2012 census data. Las Vegas’ percentage of singles is in line with cities such as Seattle (58 percent), Portland, Ore. (59 percent), and Austin, Texas (59 percent).

The Pew Research Center, analyzing Las Vegas’ “marriage market,” found there were 118 men for every 100 women in the valley, the same as in Phoenix.

“Statistically speaking, Las Vegas isn’t that different than a lot of other metro areas,” said Christie Batson, an associate professor of sociology at UNLV who studies urban demography. “It seems like we share a lot of the qualities of up-and-coming urban metro areas.”

The data solidify what Peña likes to preach to dating skeptics in the community.

“If you really wanted to be proactive, there are a ton of singles everywhere,” she said. “Everybody is looking for love. I still believe in that.”

As for Kalashian, the VIP host now working in Hawaii’s nightlife industry, he left Las Vegas as a single guy to move to Miami for a new job.

But there was a girl named Alice in Las Vegas. A former girlfriend, in fact. She shared his Armenian heritage, love of family and, in his words, was the nicest, sweetest girl he had ever met. She also was the one who got away.

Several years later, when she contacted him, he didn’t want to let her go again. So he moved back to Las Vegas and married her, proving himself wrong. He didn’t need to leave Las Vegas to find the one.

Beers is in it to limit it (government) Champion of libertarianism scrambled to try to stop public funding for stadium, sets sights on higher office

Bob Beers, protected by a blue canopy tent in the pouring rain, spots a pickup truck heading his direction in a Smith’s parking lot. Beers, a Las Vegas city councilman, fumbles with an umbrella, gives up and dashes toward the vehicle, sloshing through puddles.

“Don’t get out,” he yells. He’s thrusting a clipboard and pen toward the truck window. “Do you want to sign our petition?” he asks the couple inside. The issue: public funding for a $200 million downtown soccer stadium, something Beers and other opponents want to see put to voters in the June election.

Over the course of a 10-hour day, dozens of people skeptical of the stadium plan stop by Beers’ makeshift outpost, fashioned using the hatchback of his silver PT Cruiser and a small tent.

He put in 10 hours the day before, too, having meticulously chosen this particular Smith’s in Summerlin because it is near the densest residential area in Las Vegas. But he hadn’t anticipated the rain.

Returning from the truck with two more signatures in hand, Beers grins broadly. He was having fun.

“We’re making lemonade,” he says.

These days, Beers is energized by an unlikely second act in his political career after being ousted from a state Senate seat in 2008 after a brutal campaign and barrage of attack ads.

At the time, Beers said he was done with politics and poured himself into his day job as an accountant. But he got pulled back into politics in 2012 when a seat on the city council came open.

In many ways, the job is a perfect fit for Beers, who enjoys the day-to-day minutiae of government as much as he does the high-minded debates.

“For some bizarre reason, I enjoy it,” Beers said. “Somebody has a difficulty,

and I figure out how to help solve it.”

Beers found a new cause in the soccer stadium, an opportunity to use his intellect and savvy with numbers to poke holes in complicated and often opaque plans to use $56 million of public money for the $200 million project.

Beers’ opposition to using city funds to build the stadium isn’t a surprise to those who know him as a firebrand conservative from his days in the state Legislature. Beers led a group of Republican Assembly members, known as the Mean Fifteen, in opposing an $833 million tax increase in 2003 that took two special sessions to resolve. He later championed a version of the Taxpayer Bill of Rights, gathering 150,000 signatures to place an amendment on the ballot that would have restricted increases in government spending.

But Beers says his opposition to the stadium is more practical than partisan.

“Academic economists around the country are pretty much of one voice that these things do not build a city’s economy,” he said. “Those of us who’ve been here a long time understand this is a really tough sports market. ... That would lead a rational business mind to say, ‘If (stadium developers) want to make a go of that, God bless them, but they’d better be using their own money.’ ” nnn

Growing up, Beers was more interested in electronics and computers than politics. As a teenager, he tinkered with radios and taught himself how to write computer code.

After starting out in radio news in Reno and Las Vegas, Beers went back to UNLV to study management before launching a career as an accountant and computer software expert.

A friend recruited him to run for a vacant Assembly seat in 1998. He agreed,

he said, out of a sense of civic guilt.

Arriving at his first Legislative session in 1999, Beers thrived in the policy-driven, number-filled world of state government. But he also was startled by the inefficiencies he saw.

“I ended up with the philosophy that government doesn’t really do anything well or somebody else would already be doing it,” Beers said. “Government is a way to get stuff done that we all agree needs to be done but can’t figure out any other way to do it. Therefore government should be limited in the scope of what it does.”

That thought process carried Beers through the budget battles and tax showdowns that defined his decade in the Legislature, where he emerged as a prototypical libertarian in the pre-Tea Party days, equally revered and reviled.

“Bob was viewed in multiple ways: He could be a bomb thrower but was smart and witty with a dry sense of humor,” said Clark County Commissioner Chris Giunchigliani, a Democrat who squared off against Beers in the Legislature but now is an ally in his fight against the stadium. “He liked to be on the fringe and use anything that could dig at someone, but he always did his homework.”

Beers brought his research skills and trademark quips to the city council, but those around him say he’s more mellow now than during his legislative days.

Beers attributes that to the lack of partisan friction on the council, which deals more with problem-solving than polarizing debates about the size and scope of government. Outside of the occasional vote of dissent, Beers has been a team player on

what normally is a collegial board.

When the stadium issue picked up momentum a year ago, Beers couldn’t help but take up the mantle of the opposition. He has voted against using public dollars for the stadium every step of the way, penning several scathing, pointby-point takedowns of the stadium’s financing plan on a personal blog — a trick he picked up during the 2003 tax fight when he blogged at nevadabudget.com — much to the chagrin of some of his fellow council members.

“I did not think that was appropriate.

He should have first gone to staff and city managers,” said Mayor Carolyn Goodman, the stadium’s lead advocate, who otherwise speaks highly of Beers.

Despite Beers’ vocal criticism, public funding for the stadium was approved in

a 4-3 vote. Joining Beers in opposition were council members Stavros Anthony and Lois Tarkanian. The three launched a petition drive to put an initiative on the June ballot that would block using taxpayer dollars for the project.

Over three weeks, Beers spent hours and thousands of his own dollars pushing the initiative, even after the number of signatures needed to qualify quadrupled from 2,000 to 8,000 because of an error by the City Clerk’s Office.

But the group got only 6,911 signatures. The issue has landed in court, and it’s unclear whether the stadium will end up on the ballot.

So Beers is gearing up for an even bigger political challenge — taking on Senate Minority Leader Harry Reid in the 2016 election. Ever the maverick, Beers

threw his hat into the ring nearly three years before the election, well before other Republican challengers. So far, he is Reid’s only declared opponent.

“Somebody has to do it,” Beers said. “I don’t know if Washington can be saved between the misguided, continual borrowing and never paying back.”

For now, Beers is content working parking lots, talking to constituents and solving whatever problems happen to roll across his desk.

“The worst thing that can happen to me is in the process of losing (the U.S. Senate race), I get sullied and lied about so bad that my voters in Ward 2 don’t send me back to City Hall in 2017, because I love this job,” Beers said. “The second worst thing that can happen to me is I win.”

If you’ve got business you’d like to see taken up by the Legislature this session, it can pay to send in a professional.

Casinos, mining companies, utilities and other interests will fund an army of lobbyists in Carson City over the next four months to try to sway legislation in clients’ favor. Local governments in Clark County also will spend hundreds of thousands of dollars hiring outside lobbyists and sending staff up north to represent municipal interests.

Taxpayers fund the work. Some Nevadans bristle at the idea of spending public dollars to lobby another government, especially when tax increases are involved, but Southern Nevada officials say it’s critical for them to make sure they’re treated fairly by the state.

Often, the issues lobbyists become involved in deal with how tax dollars are distributed to local governments and how program costs are shared with the state. This year, there’s expected to be increased attention on “home rule” to give local governments more autonomy to make spending and policy decisions without having to run everything by the Legislature first.

Despite the costs — local government agencies in Nevada spent $3 million during the 2013 session — officials say it’s important to have a voice on issues that affect them.

Local governments get their messages across in various ways. Some hire outside lobbyists to do most of the work, others use in-house staff and some use a combination of the two.

North Las Vegas, for example, approved spending $120,000 to hire Samuel McMullen and George Ross of the Porter Gordon Silver law firm to represent them during the session.

“They’re both longtime lobbyists who really understand the law and the Legislature and how things work,” North Las Vegas Chief of Staff Ryann Juden said. “North Las Vegas has some very big, complex things that we’re working on, from Apex to some home rule issues that we think are important. It was important to make sure that we had some lobbyists that understand how to think outside the box.”

Las Vegas spends $115,200 a year for lobbying services from the Ferraro Group. Henderson spends $114,000 annually on a lobbying contract with the Perkins Co. Clark County stopped hiring outside lobbyists after the 2009 session, saving about $100,000 a year.

The county instead will send Chief Financial Officer Yolanda King to lead its lobbying efforts in Carson City, with a rotating cast of staff members for support.

The conventional wisdom used to be that hiring outside lobbyists gave governments access to connections and relationships the lobbyists formed with legislators over decades. But Clark County Chief Administrative Officer Sabra Smith Newby isn’t so sure.

Going from gamers to video gamers For casinos to attract the next generation of gamblers, luck may give ground to skill

Imagine a Las Vegas casino floor 10 years from now, where the games look less like traditional slot machines and more like the video games millennials grew up playing on Xboxes and PlayStations.

That vision may be on its way to becoming reality. A state Senate committee is considering a bill that would let gaming regulators allow more skill, as opposed to chance, on the casino floor. The bill suggests, among other things, that regulators outline requirements for games of skill and allow flexibility in payout percentages or a game’s outcome.

If the bill becomes law, it could pave the way for a flood of slot machines with games that play more like Super Mario than Wheel of Fortune.

Such a shift is underway. Game developers have created video game-like products.

Bally Technologies, for example, introduced a slot based on the arcade game Skee-Ball, while Gamblit Gaming debuted products that resemble popular games such as Angry Birds. Skilled players, though, aren’t necessarily rewarded with bigger payouts.

Changing the regulations would push the market even further. And casinos have a major incentive to of fer such games: They’d be a big draw for younger generations that increasingly shy away from slot and video poker machines. Many millennials aren’t enticed by

games that require only the push of one button repeatedly, despite the possibility of winning a jackpot.

“The younger demographic is just interested in a different type of gaming than the older demographic that was used to, and is still comfortable with, the traditional slot machine and video poker machine,” said Sen. Greg Brower, a Republican from Washoe County who chairs the Senate Judiciary Committee, which is considering the bill.

Brower said he didn’t anticipate problems getting the bill passed. Then it would be up to the state’s two regulatory bodies for the casino industry — the Gaming Control Board and the Gaming Commission.

Regulators seem equally receptive to introducing more skill on the casino floor. Control Board Chairman A.G. Burnett said the days of “grand casino openings with people rushing to play the slots” are gone.

“Now have come the days of huge, integrated resorts offering hundreds of entertainment options found nowhere else on earth, from the finest dining and entertainment anywhere to clubs that cater to a younger demographic,” he said. “So everyone recognizes that gaming must keep up, and to do that, the old style of slots simply needs to change. … This means adding skill and social elements to the slot mix.”

Gamblit showcased its products at last year’s Global Gaming Expo, the casino industry’s annual convention in Las Vegas. Since then, David Chang, Gamblit’s chief marketing officer, said the company has received a warm reception from casinos.

“The response has been overwhelmingly positive,” he said. “We’ve had people come in and say, ‘I’ll take

20 of those.’ ” Chris LaPorte, who owns the Insert Coin(s) arcade bar in downtown Las Vegas, also is waiting for the regulations to loosen. He created Quantum Gaming Concepts, which develops casino games LaPorte says are “definitely outside of what can currently be done.”

Quantum’s games have the look and feel of something you might play inside LaPorte’s bar, only skill is rewarded with cash instead of virtual currency, extra lives or a higher score.

A longtime video gamer and a Las Vegas resident for the past decade, LaPorte understands questions remain about how skill-based gambling can be financially successful for casinos. One question is whether games that cater too heavily to players’ skills would allow customers to get so good they’d prevent the house from winning.

LaPorte is confident he can answer that question, though he won’t publicly say how.

“Have them call me, and I’ll show them,” he said.

“There is definitely a way — my way — for the casino to be happy, just as much as the customer is happy with their experience.”

To illustrate, LaPorte compared the number of people who play basketball to the number of people who are professional players in the NBA. The latter group is comparable, proportionally speaking, to the number of people who would be highly skilled enough to regularly win at new casino games, he said.

If he’s right, and if enough other game developers follow suit, the casino industry might well be looking at its next game-changer.

mploding a building is a massive undertaking. It’s a real knockdown, drag-out experience.

But our city’s latest implosion isn’t the most massive undertaking on the to-do list of Lorenzo Doumani, owner of the Clarion resort and its surrounding property. In fact, the implosion, scheduled for Tuesday, isn’t even the biggest project for Doumani this month.

The announcement that Chinesethemed Resorts World would be built sparked the $2.3 billion convention center concept, which in turn will dictate how and when Doumani proceeds. The convention center is across the street from the Clarion property.

The best time frame for the new resort to open is the summer of 2018, Doumani said, but expect fluidity throughout the project’s development.

“I will have some idea of what we’re going to do later in the year,” Doumani said. “We need to wait for the convention center plans to come through. There is a synergy in the entire area. Everything needs to be complementary, and my feeling is the convention center is going to have an idea of its own timeline in the second quarter of next year. But all my preliminary plans are ready to go. I just don’t want to make any big announcement, then have to make big changes.”

In a city that has witnessed myriad renderings of projects that never broke ground, the Clarion’s implosion signifies only the start of a grand design. Keep an eye on Resorts World. That will be a good indicator of how these dominoes — and even the old Clarion — will tumble.

BATTLING THE NO. 1 KILLER OF WOMEN Heart disease is widely known as a killer of men, but it’s just as much a threat to women despite being underreported Heart disease often is perceived as a male epidemic, but it has killed more women than men each year since 1984, according to the American Heart Association. While the threat to men isn’t exaggerated, heart disease is the No. 1 killer of both men and women in the United States. One in 3 women will die of heart disease, but only 1 in 5 women believe heart disease is their greatest health risk, the American Heart Association found. ¶ The Centers for Disease Control and Prevention estimates at least 25 percent of deaths caused by heart disease are preventable. Knowledge truly is power when addressing heart disease, and while awareness about women’s heart health has progressed in recent years, we still have a long way to go. ¶ Dr. Navid Kazemi, MD, FACC at MountainView Hospital, explains why heart disease in women has been overshadowed and what women can do to keep their hearts healthy.

MENOPAUSE INCREASES RISK Everyone becomes more susceptible to heart disease and high blood pressure as they grow older, but menopause can further increase certain risk factors for women. “During menopause, the amount of estrogen and progesterone the body produces decreases, which causes metabolic changes,” Dr. Navid Kazemi said. “Blood pressure might start to go up and HDL (“good” protective cholesterol) might decrease, while LDL cholesterol (“bad” cholesterol) tends to increase, which can indirectly cause plaque buildup.” Though menopause doesn’t cause heart disease, it can increase the risk. “The era after menopause is when women should be the most cautious about developing heart disease,” Kazemi said. Post-menopause, women should continue to strive for a healthy lifestyle, including eating a nutritious diet, keeping a steady exercise routine, monitoring their blood pressure and prioritizing an annual checkup.

BE CUNNING AT THE CAFETERIA Faced with a dining room full of unhealthy food, you still can avoid consuming too many calories.

Take the smallest plate available to control portion size. Ask servers to hold the sauce. Fill half your plate with fruits and vegetables. Loading up at the salad bar is another good bet, as long as you add lean protein such as beans, tofu or poultry, and go easy on the dressing.

LEAVE TO EAT Sometimes we eat to relieve boredom. Mindlessly munching while answering emails or preparing a report can lead to overeating, so leave your desk to eat or snack, public health officials recommend.

If you go to a restaurant, try to find the menu online ahead of time to come up with an order that’s heavy on vegetables. At minimum, avoid fried foods.

“Just like doctors tell you, ‘Listen to your body,’ you should listen for unusual noises in your car,” Molla said.

“If you hear a chirp when you step on the brakes, some vehicles are designed with audible warnings, and that chirp might mean the brakes need work.”

Likewise, a sweet smell could mean coolant is leaking, and a musty smell could mean a filter needs changing.

Tire pressure monitoring systems are designed to trigger a dashboard warning light when pressure dips by five pounds, but even two pounds of difference from one tire to another can affect handling. Also, look for uneven wear, a sign of improper inflation or misalignment. Not sure what uneven wear looks like? AAA has a guide with examples.

■ Check under the hood. Dirt and grime on the battery case can drain the battery. Wipe the case with paper towels moistened with mild detergent. Cracking or bulging mean the battery needs testing or replacing.

■ Check, or have a mechanic check, your oil, windshield washer and brake fluid levels. Also, check the coolant, but make sure the vehicle is cold before you do so. Top off any fluids that have run low.

Things like belts and hoses are designed to last about 80,000 or 90,000 miles.”

The motor oil industry would like you to change your oil every 3,000 miles, but Molla said most drivers should get by with less frequent changes, unless they put a lot of miles on the car or drive often in dusty conditions. Synthetic oil can last up to 15,000 miles between changes; conventional oil, about 7,500 miles.

WHAT IS SEVENS RUGBY? IS IT ANYTHING LIKE FOOTBALL? Sevens rugby, in which each side plays with seven players instead of the 15 used in traditional rugby, favors teams with speed and athleticism. The game is played on a regulation rugby field that’s between 113 and 133 yards long and 74.3 yards wide, creating constant action and attacks. The openfield play resembles football with plenty of open-field tackles.

“It’s easy to watch,” said Rob Cornelius, vice president of business development at United World Sports. “It’s fast-paced with big hits and big runs. It’s pure hell on the players. They are absolutely gassed.”

HOW IS IT PLAYED? n Over three days, 16 national sevens teams play 44 games.

Games last 14 minutes with seven-minute halves, whereas 15-player rugby uses 40-minute halves.

n The most common way of scoring is a “try,” when a player places the ball on the ground in the goal area for five points.

n That earns a twopoint conversion kick from 24 yards out in line with the spot where the try occurred. That’s why players with a clear path to the goal typically run to the center — for a straight conversion kick.

The kick must travel through H-shaped goal posts, similar to football.

n Another way to earn points is with a drop kick on a penalty, which results in three points if successful.

Another group of fans wore Muppets costumes. ¶ There was loud music, supporters waving flags, patriotic songs and record alcohol sales. ¶ The USA Sevens Rugby tournament, which returns Feb. 13-15 to Sam Boyd Stadium, is more than a sporting event. It’s a three-day party.

“The rugby is great, but you can’t beat what’s going on in the crowd,” said Rob Cornelius, vice president of business development at United World Sports, which stages the tournament. “It’s one big, dress-up party.

It’s the type of atmosphere you want in a big-time event.”

Las Vegas is the fifth of nine stops in the HSBC Sevens World Series, where points are accumulated, similar to the NASCAR series, and a champion is crowned at the end of the season.

The event started in 2004 in Southern California and moved to Petco Park in San Diego before coming to Las Vegas in 2010.

Attendance has more than doubled since the event moved here, setting a record in 2014 with 68,608 fans over three days, including a single-day high of 31,644.

The sevens format — seven players rather than rugby’s typical 15 — allows for fast-paced action, with athletes creating plays in a strategy similar to football. Carlin Isles, who ran a 4.22-second 40 yard dash during a workout with the Detroit Lions, has emerged as one of the most exciting players for the U.S. team.

“In American football, if you are tackled or make a tackle, the game starts over,” Cornelius said. “In rugby, you have to be ready to make the tackle again. You hear the hits. It is a full-on collision.”

Matches will be shown on NBC and NBC Sports, available in 149 countries and 390 million homes, Cornelius said.

“It’s one big advertisement for our city,” he said.

LOCAL RUGBY SCENE THRIVING The Las Vegas Blackjacks, a club team, won the USA Rugby Premier Division in 2010 (placing second in 2009 and fourth in 2006). The team is part of the Southern California Rugby Football Union, which includes teams in Arizona, California and New Mexico.

The Blackjacks formed in 1976 and are considered Southern Nevada’s top team.

In 1998, when player numbers were high, Las Vegas Irish RFC formed to give locals

more opportunity to play rugby. Another club, Downtown Las Vegas Rugby, also plays at a high level.

Rugby has been called one of the fastestgrowing sports nationally. And that starts with children.

Without required resources, police can do only so much

D

runken driving arrests by Metro Police have dropped significantly over the past few years.

As reported in last week’s edition of The Sunday, Metro Police made more than 7,700 DUI arrests in 2012. A year later, the number fell to about 5,800, and in 2014, it was fewer than 4,750.

But that doesn’t mean fewer drinkers are getting behind the wheel. Sheriff Joe Lombardo attributed the drop to fewer officers patrolling the streets.

“DUI is still in the same position on the priority list that it’s always been,” Lombardo said. “It’s just that if you have fewer people addressing it, you’re going to have fewer arrests.”

That is a problem, given the damage and deaths drivers under the influence can do on the streets.

SOME GOOD NEWS Although it is the largest police agency in the state, Metro isn’t the only department patrolling our roadways.

THE BAD NEWS The net number of DUI arrests by Metro and NHP, however, still is down about 2,700 from 2012 through 2014.

Drunken drivers just aren’t being caught as frequently as in the past.

Yet, alcohol is available all the time in Sin City, as attorney James Martines, a former DUI prosecutor, noted.

“It’s just the nature of the city,” Martines said. “This is what we sell.”

And what we trade in as a party town, and consume in our homes, can be deadly. In 2011, there were 37 alcoholrelated fatalities in Clark County. Last year, there were 60.

WHAT’S AHEAD So what can be done?

This is a regional problem, not just a Metro issue. And although police departments work together for special patrols and checkpoints, that’s not enough.

Some critics have called for Metro and other agencies to be more efficient.

But while any organization can be more efficient, Metro can be efficient only with what it has. The fact is, Metro doesn’t have enough resources to deal with the problem.

Metro saw an authorized strength of 2,981 officers in 2009 drop to 2,555 officers last year. The police force went from about two officers for every 1,000 residents to 1.74 officers per 1,000 residents. When the number of tourists is factored in, the ratio drops further.

Other local agencies also have seen a drop in the number of sworn police of-

ficers and have responded by trimming nonessential services.

Metro stopped sending officers to fender-benders and routine car crashes to keep officers on the street, and in theory, to enable them to pay more attention to more serious problems, including drunken drivers. However, with the drop in the number of officers, police simply can’t do it all.

BOTTOM LINE It is clear that police agencies need more officers on the street, but politicians have failed to provide local law enforcement the money it needs to protect the public. For example, the County Commission last year balked at a plan that would have increased sales tax less than a quarter of a cent to pay for police officers.

Given that drunken driving remains a persistent problem, the County Commission should revisit that decision and arm police agencies with the money they need. The bottom line is this is a public-safety issue, and police need resources to combat it.

LAW QUARTERLY Q&A WITH ABBI SILVER

For new court, judge packs her robes and hits the road Through school graduations and judicial elections, Judge Abbi Silver’s career has kept her in Southern Nevada. ¶ That’s about to change. Silver, a lifelong Las Vegan, was appointed by Gov. Brian Sandoval in December to serve as one of three judges on the state’s newly formed appellate court. ¶ Now, the UNLV graduate and former Clark County District judge will preside statewide over Nevada’s 2.8 million residents. And she’ll be traveling a lot to do it. ¶ As she settled into the role, Silver spoke with VEGAS INC about the transition. She and fellow appellate court judges Jerome Tao and Michael Patrick Gibbons have been setting up their new offices at the Supreme Court building in Carson City and the Regional Justice Center in downtown Las Vegas.

How is the transition going so far?

This is a big change in my life, and it’s an exciting change. It has been a whirlwind.

We were called by the governor Dec. 17, and he advised us that we were appointed. Within an hour, we were called by the Supreme Court and given an itinerary.

As soon as we were sworn in, we started doing training and learning how to use the new case-management system. It’s a whole different process from what we have in District Court.

What is the biggest difference you anticipate compared with your old job?

Traveling. I’ll be traveling a lot throughout the state and meeting with attorneys from all over the state versus just Clark County. I’ll be going everywhere from Elko to Esmeralda to Washoe County. Now, I’m a judge for the entire state.

We’re having discussions about how we’ll have to manage our travel.

Before, I’d be gone only for judicial education programs one or two times a year, either in Las Vegas or Reno.

I’ve already been to Carson City four times in January alone.

What drew you to the job?

This bench is making history, and that opportunity may come once in a lifetime. Appellate work is something I have always aspired to do, and I’m grateful I was given the opportunity.

The creation of this court is a real victory for the citizens of Nevada.

We’ll be able to handle cases more effectively and efficiently.

What is the workload like so far? Are cases different or more complex at the appellate level?

We recently issued 45 decisions — 34 were criminal and 11 were civil. We’re trying to get at least 50 decisions out per month because we have a backlog of 800, so we have a

We think it will probably take three years or so to get the backlog taken care of.

They’re the same type of cases I was seeing in District Court, because they’re appeals from that court. We get all criminal cases except for those involving the death penalty.

There is one difference: I did not get family law cases before. Now, we have a contested divorce case that we’re reviewing in chambers. That is an area I don’t have a lot of experience

in, so I’ve been catching up by reading other cases.

But for the most part, they’re the exact same.

Is your access to legal records different?

We’re getting access to more internal documents and drafts that will be very useful for us.

For example, if we’re deciding on a burglary case, which are very common, we’re able to look at previous cases that are similar to see

how the Supreme Court may have ruled.

In addition to opinions, we get access to internal documents, as well as drafts and briefs. This is information that isn’t available to anyone but people within the Supreme Court and the Court of Appeals.

I’ve only been working here a little while, but the system so far seems very impressive.

Encourage better small-business loan opportunities, especially for veterans. There is a lot of talk out there but for smaller loans there was no market for my startup loan needs. Also, instituting a network or workshops for local veterans helping one another with startups, business plans, lessons learned, etc., may also be a positive step forward.

What’s on the horizon for construction industry

evada’s construction industry is a conglomeration of varied political interests. Commercial and industry project owners, designers, residential homeowners, general contractors, construction managers, subcontractors, materials and equipment suppliers, union benefit trust funds, lenders, surety and insurance companies and title insurers all are affected by changes to the state’s construction laws.

With the entire government now controlled by Republicans, such groups can expect substantial change in 2015. Some areas to watch closely:

State’s top gaming regulator shares perspective as a physician, is of two minds on marijuana issue

Nevada’s top gaming regulator hasn’t made his professional career in the casino industry or in the law, but he’s plenty experienced with both of those fields.

Dr. Tony Alamo is the first non-attorney to serve as chairman of the Nevada Gaming Commission, the body that has the final say over regulation of gambling in the state. Other parts of his background give him an understanding of gambling and regulatory affairs: His father was a longtime casino industry executive, and Alamo previously served on the state Athletic Commission.

Alamo joined the Gaming Commission as a member in 2008 and last summer was appointed by Gov. Brian Sandoval to replace Chairman Peter Bernhard. In the half-year since Alamo took over the chairmanship, he has led the commission’s meetings on several high-profile gaming developments, including the opening of SLS Las Vegas and concerns about the background of Sam Nazarian, the businessman who led the creation of SLS. Alamo spoke with VEGAS INC about his duties on the commission and some of the most pressing issues facing the state’s gaming industry.

If you had to pick the most significant moment or issue that has come up since you’ve been chairman, what would it be?

That’s a tough question, because I’ll be honest with you: We’ve had so many. Keep in mind, in my tenure as a commissioner and now as a chairman, Las Vegas has suffered the worst recession it’s ever had. We’re here dealing with near closures of casinos and enormous restructurings; we’ve had to deal with the largest fines ever given to a licensee for issues with one of the sports books; we’ve dealt with issues of drug use, extortion; we’ve dealt with issues with slot parlors — it just goes on and on. Every meeting comes with something I think is going to be very important and could have an effect on gaming if we don’t do our job.

What do you think your medical background adds to your perspective as chairman?

Keep in mind the support that I have as chairman: I have the Attorney General’s Office, so I have all the legal representation at my disposal. We also have board members who are attorneys. So the fact that I’m not an attorney is definitely not a negative because of the support I have around me. The fact that I am a physician, believe it or not, I think it’s helped me quite a bit. It’s helped me in the way I think, the way I study, the way I decide things, my work ethic. On top of that, there’s been a topic that’s completely medically related, which is medical marijuana and gaming. Coincidentally, I think it’s put me right at the forefront of being able to objectively be part of those discussions.

Let’s go into that a little bit. Why do medical marijuana and gaming need to be

totally separated?

I wear two hats; we all do. We’re people with experiences and we’re regulators. My hat as a person with experience is a physician who truly believes that medical marijuana should be available. Unfortunately, I think the way it’s been enacted and put into place in Nevada and other states has caused a misfire. I think the need for medical marijuana — which is there, but small — has gotten confused with the want, which is large. And therefore, the demand is huge.

But let me bookmark all that, because that’s me as a person. As a regulator, it’s very cut and dried and obvious: It’s against federal law. Period. It’s a Schedule I drug that the federal government has said has a high abuse potential and is against the law. We cannot allow our gaming licensees to participate in something against federal law.

So the only thing that could maybe change your mind would be some sort of loosening on the federal level?

If the federal government stopped making it against the law of the land, then that changes things.

But right now, it is against the law. And we can’t allow our licensees to participate in anything that’s against the law.

In a few years, what role do you see online gaming playing in the overall Nevada gaming market?

For online gaming to work, you need liquidity. Liquidity means volume, lots of people playing. We all got to the race, we were all ready to go — the problem is, the starter gun never went off. The federal government didn’t open it up. Our governor tried, and I commend him for trying. When the federal government slowed down its approach, he went on his own and started to make compacts with other

states. But it’s just not enough. We do not have the population base to do it just within our state, or one or two smaller states, to make it viable. The fact that Ultimate Gaming closed its doors — the writing’s on the wall that it’s very pessimistic right now. I don’t think there’s any appetite at the federal level to open it up and allow interstate online gaming. Until you do that, it’s not financially viable.

How concerned are you about illegal sports betting, given that the American Gaming Association is really looking at tackling that?

We know how to do sports betting. We know how to regulate it, we know how to take care of it; it’s our expertise, and we’re comfortable doing it. There is an appetite now at the organizational athletic level to embrace sports betting — legal sports betting.

The illegal is an enormous problem. Illegal betting is a platform for organized crime, money laundering and other nefarious acts. To continue the status quo, I think, is a mistake. The less illegal sports betting there is and the more legal sports betting there is, the better everyone is.

When you’re done with this, looking back, what would constitute a successful stint as chairman for you?

Of course, everybody always wants to leave a legacy in everything they do, and I just hope that when my time is up, that everybody around — from the regulators to the legislators to the industry — looks back and says: “Dr. Alamo was a true Nevadan and he helped the industry of gaming, which is the lifeblood of our state.” If I get people to remember me that way, I accomplished something. But every time I think my role as a regulator comes to an end, I end up doing something bigger and better. So I don’t know what my future will entail.

In 2014, Mayor John Lee delivered his first State of the City address as North Las Vegas teetered on the brink of financial disaster, faced with a long-term deficit of $152 million.

This year, Lee made his second State of the City speech with North Las Vegas facing a much different outlook.

As a result of deals struck with public unions last April, the city’s projected budget deficit over the next seven years has been slashed nearly in half, from $152 million to $78 million. Vacant space at City Hall has been leased and key executive positions have been filled.

“We have put together a strong plan to repair our city, and we’re executing on it,” Lee said during the nearly hourlong speech at Texas Station. “North Las Vegas

will be a story of optimism written with achievement and hard work.”

After guiding the city as it avoided financial insolvency, Lee is turning his attention to major projects that can help revitalize the city’s economy. Leading the way is a plan to create a tax-free zone on 700 acres at the Apex Industrial Park to lure a few major businesses to the site. By doing so, the city hopes to pull together funding to finish water and electricity hookups needed to open the remaining 6,000 acres of the park for development.

Still, he urged caution with the city’s recovery.

“North Las Vegas is not out of the hole. We’re continuing to work just as hard as we did last year,” he said. “We put a sevenyear forecast together. I’ll need all seven years to really make North Las Vegas stand on its own.”

Nevada casinos win $11 billion in 2014, a slight drop from 2013

Nevada’s gaming revenue declined slightly in 2014 after several years of consistent increases, the state reported.

The Gaming Control Board said casinos won a little more than $11 billion in 2014, a 1.1 percent drop from a year ago, when gaming revenue increased by 2.6 percent.

Revenue had been steadily going up for the past few years since the worst of the recession-induced slump.

The Strip’s gaming revenue dropped 2.1 percent to $6.37 billion for the year, while Clark County’s revenue went down 1.3 percent to $9.55 billion.

A lot of the reason behind the declines comes down to one word: baccarat. That game’s $1.5 billion statewide revenue was down 5.9 percent from 2013. Gaming Control Board senior research analyst Michael

Lawton said the year’s drop ended five consecutive years of increases for baccarat revenue.

Lawton saw positive developments in slot and sports wagering revenue for the year. Slot revenue in 2014 was “basically flat” compared with 2013, and sports wagering revenue rose 11.8 percent, he said.

Things were also a little better elsewhere in Clark County. Downtown Las Vegas revenue rose 2.1 percent to $511.4 million for 2014, while Laughlin and North Las Vegas saw increases of 1 percent and 1.9 percent, respectively.

The Boulder Strip, however, saw a 1.8 percent decline for the year.

The picture in December was worse for the state overall. Gaming revenue for the month was $950.7 million, down 8.06 percent compared with a year earlier. The Strip’s December gaming revenue was $555.2 million, a 16.41 percent decline from 2013.

Gaming regulators have added another name to Nevada’s famous “Black Book,” a list of people barred from entering any of the state’s casinos.

Late last month, the Nevada Gaming Commission unanimously approved adding Tasia Musa to the list. Commissioners were told Musa met multiple conditions that can warrant inclusion on the list, including convictions for gambling-related crimes.

Musa, who was not present, is the

33rd person on the list.

Under state law, the list “may include any person whose presence in the establishment is determined by the (Gaming Control Board) and the commission to pose a threat to the interests of this state or to licensed gaming, or both.”

Once added to the list, a person’s death is the only sure way to be removed from it.

Former Las Vegas mayor Oscar Goodman has frequently said he thinks the list is unconstitutional.

Attorney: Landowners must be ‘made whole’ domain law.

The Nevada Department of Transportation toes the line between being a steward of taxpayer dollars and offering a fair deal to property owners. But two of the biggest eminent domain attorneys in town argue the transportation agency is dragging out the process far too long, further harming landowners.

THE PROJECT Project Neon calls for several braided ramps, similar to ones along the U.S. 95 interchange at Rancho Drive, as well as a high-occupancy vehicle flyover ramp that will connect car-pool lanes from U.S. 95 to I-15’s express lanes. The changes require redesigns along Martin Luther King Jr. Boulevard and a complete reconstruction of the I-15 and Charleston Boulevard interchange.

To get it all done, the state must purchase dozens of parcels using eminent domain, a point of contention among owners. Eminent domain is a government’s right to appropriate private property for public use. Landowners have no recourse to stop the sale, but they get paid for their land — the appraised fair market value plus the cost of moving. Landowners can appeal if they think the price is too low.

Coming up with the right price isn’t easy.

“The state has a limited amount of money for acquisition,” state transportation board member Frank Martin said in August.

The goal is to have all price disputes resolved by 2016, when construction is set to begin. NDOT Director Rudy Malfabon thinks it can be done.

“We are confident the state will acquire the primary parcels that will allow construction to commence in early 2016, although land acquisition will occur throughout the course of the 3 1/3-year-long project,” Malfabon said.

Project Neon is expected to reduce travel time by 28 percent and create $110 million in annual savings through improved productivity, Malfabon said.

owners facing eminent domain.

Padgett recently argued a case for Ad America before the state Supreme Court. Ad America owns four parcels in the downtown area financed under one loan. Three of the four are set to be taken under eminent domain, and as a result have low vacancy rates — 30 to 40 percent, Padgett said. That jeopardizes the fourth parcel, which has high occupancy.

The landowner is on the verge of foreclosure and is waiting for a Supreme Court decision, which could take up to a year.

“It’s a situation where these landowners have a hard time filling apartments, offices and industrial buildings,” Padgett said. “As a result, they’re hanging on by their fingernails. The landowners have become involuntary custodians of their own properties.”

Malfabon called the acquisition of property through eminent domain “a very meticulous process” that requires in-house counsel, right-of-way expertise and outside experts including appraisers, engineers and consultants. Malfabon said the agency is

moving as quickly as it can.

“NDOT is managing the acquisition of parcels as best as possible with the resources available, and we respectfully request the patience of affected property owners as we diligently pursue the acquisition process in manageable stages,” he said.

VALUATION DIFFERENCES Waters said zoning issues play a huge role in price gaps between NDOT’s offers and what landowners have in mind. Sometimes an appraisal uses existing zoning, which may not be the highest and best use.

“If it’s a home next to a casino, then the highest and best use is not a home,” Waters said.

Malfabon said NDOT has kept an open mind during the process.

“Our goal is to reach an agreement with each owner,” he said. “When the owner makes a counteroffer that is supported by the market data, we will reconsider the original offer amount.

However, there is little the state can do when owners either refuse to participate in the process or make unrealistic demands that are not support-

ed by the market data.”

Waters and Padgett say landowners need to be “made whole.” They note that just compensation is defined as a “sum of money, necessary to place the property owner back in the same position monetarily, without any governmental offsets, as if the property had never been taken.” Compensation can include interest and attorneys’ fees.

Negotiations have yielded wildly different outcomes. In one recent settlement, Waters’ client received $3 million, more than triple NDOT’s initial $700,000 offer. Another received 37 times the amount initially offered.

“Unless you can get back to the same type of property, you’re not made whole. You’re just helping them finance that project for the government,” Waters said.

Early on, Waters went to trial with just about every case. Now, more are being settled before they go to court.

Malfabon said NDOT had done its best to be fair by using independent appraisers and allowing owners to accompany the appraiser when he or she visits the property. Landowners also are encouraged to bring forth relevant information concerning the value of the property. Owners are provided a copy of the appraisal when presented with an offer. They then have the opportunity to make a counteroffer, too.

FUTURE NDOT has approximately $250 million budgeted for land acquisitions related to Project Neon.

About $100 million comes from revenue-backed bonds and the rest from federal and state fuel tax revenue.

Malfabon estimated about 100 more parcels still need to be acquired. Offers have been made to 39 landowners. Twenty-one parcels are in the appraisal process. Agreements have been made with 18 property owners and negotiations are underway with 21, Malfabon said.

How the process is going depends on whom you ask. Malfabon has a much more upbeat take than many.

“We’re more than halfway through assembling the project parcels,” he said. “The acquisition process, generally speaking, has been smooth thus far.”
