he International Academy for Dental Facial Esthetics (IADFE) is an honourary service organization whose mission is to foster interdisciplinary relationships and cooperative education in the area of facial esthetics. The IADFE includes dentists, doctors and individuals of various associated professions, all of whom share a goal of building bridges and relationships whereby esthetic patient needs can be better and more knowledgeably served. The IADFE is truly an international group, as this year’s meeting clearly reaffirmed with new Members from the UK, Bahrain and across the United States. This year’s annual Fellowship Meeting took place on November 28th, in conjunction with the Greater New York Dental Meeting. Within the beautiful surroundings of the Harmonie Club, the Academy inducted a number of new Fellows as well as recognizing the dedication and service of the Academy’s regents. rust is unquestionably the cornerstone upon which a great dental practice is built. Patients trust in the knowledge and skill of the dentist(s), but also trust the practice with their highly sensitive personal financial and health information. Of course, Canadian patients don’t need to trust blindly in their dental providers, at least not as far as their personal information is concerned, because that information is protected by various regulations in this country. Canada has a comprehensive and evolving set of privacy laws built on the Canadian Standards Association’s Model Code for the Protection of Personal Information, including the Personal Information Protection and Electronic Documents Act (PIPEDA), the Personal Information Protection Acts (PIPAs) in Alberta and British Columbia, and the Ontario Personal Health Information Protection Act (PHIPA). Although many of these acts are new, most are being evaluated and are undergoing changes and revisions. Canada is not dissimilar from most other countries in this regard. Worldwide, privacy laws are being enacted and updated at an unprecedented rate. Almost every country has a comprehensive and evolving set of privacy laws. All of the global activity surrounding privacy regulations are a reflection of the importance that the public places on

personal privacy. Today’s dental patients understand that a privacy breach, especially one involving health information could have serious consequences, including identity theft, the release of traumatizing health information, damage to a victim’s reputation and employment status, or increased risk of physical harm or harassment. The damage that a privacy breach would bring upon a dental practice could be almost as serious. Damage to the practice’s reputation would be severe, and the resources required to manage a breach once it occurs could be significant. But with all of the concern over privacy, busy practices sometimes forget that. Even the most carefully written privacy policies and promises won’t provide much comfort to patients if inadequate computer security fails to secure their personal information. And just what happens if an unauthorized personal information access or ‘data breach’ occurs? In most cases, the first steps will involve contacting legal counsel and then notifying any impacted patients. In Ontario, notification is mandatory for any individual impacted by a health information breach, and in Alberta notification is mandatory in cases involving ANY personal information. Regardless of the official regulations, it is likely prudent to notify all involved individuals since failure to notify may result in

our responsibility There can be no assurance of privacy without first the assurance of security unwanted consequences. Notifying your Privacy Commissioner or Ombudsman is likely also either required or prudent. Recently introduced by the Canadian Government, Bill C-12 contains amendments to the Personal Information Protection and Electronic Documents Act (PIPEDA) which, if passed, will require disclosure of all privacy breaches to either the privacy commissioner, to individuals who may be affected, or both. After a breach notification occurs, the appropriate privacy body may begin an investigation and in some situations a fine or certain sanctions may result. Civil suits are also possible. There will most certainly be a loss of trust among the patient base. Even with the looming threat of severe consequences, data breaches involving the disclosure of personal information, and especially health information, are occurring routinely. This in turn causes individuals to become more and more concerned about these breaches and the ramifications to the organizations involved in these breaches is becoming more severe. As I write this, we are not quite at the midway point of November 2011. However, since the beginning of November the British Columbia Information and Privacy Commissioner Elizabeth Denham has initiated two new

investigations involving compromised medical records in that province. One involves the loss of an unencrypted laptop containing personal information of approximately 450 patients. The other involves the improper disposal of records containing health information. Also in November 2011, a multi-billion class action lawsuit was filed against a California based health provider after a single workstation containing patient health information was stolen from a locked office during a robbery

Should we just get rid of computers? Is it a good idea to avoid electronic records all together and therefore avoid all of this risk? It turns out that, no, this is not a valid option at all. In many cases data breaches involve regular paper documents. In fact, there is growing awareness that electronic records can be much better protected than can paper records. Digital records are now generally the preferred method for sensitive data storage as they are easier to protect. Ann Cavoukian, Ontario’s Privacy Commissioner, has stated in her Privacy by Design Trilogy that, “Technology itself is not inherently a threat to privacy. The key lies in how we use it. Let’s enlist the support of technology to protect privacy.” She has also backed that up with action. After her investigation into Cancer Care Ontario’s loss of personal information on more than 7,000 patients in 2011, she ordered the organization to stop collecting and sending paper records and instead required that they develop and migrate to an electronic document system. In her order she stated that, “Cancer Care Ontario should not have used a courier service to send paper-based records...when other viable, more secure and privacy protective options were available.” So, unplugging the computers and going back to pen and paper is not an option. What then can we do to limit our risk of data breaches and avoid violating patient privacy?

Awareness Privacy and Security management is all about risk management. There is likely no way to absolutely ensure complete security. Instead, we need to take appropriate measures to work toward an appropriate level of security. Dental offices are in the unenviable position of needing to record and store sensitive health information while also operating within the realities of a small business budget. The data security requirements are really no different than they are at a large hospital, but the legal and I/T resources of a large hospital don’t exist in a small dental practice. It is therefore critically important that dental practices develop their own privacy and security awareness and begin to look at ways to make appropriate improvements to their processes and systems. Contrary to popular belief, privacy and security breaches are not usually caused by third-party hackers or pirates. A Continued on page 29

Light activation of bleaching gels has long been debated. Some studies with other chairside whitening units have demonstrated minimal, if any, noticeable differences in whitening when comparing teeth treated with the same bleaching gel without a chairside light. The new, improved Philips Zoom WhiteSpeed is clinically proven to whiten teeth up to 8 shades in 45 minutes. Solving the Sensitivity Issue

Another drawback to chairside whitening is sensitivity as teeth rehydrate. Some patients demonstrate increased sensitivity after chairside whitening, especially those who have sensitivity before the procedure or have root exposure and enamel wear. CLINICAL TIPS Successful Chairside Whitening with Philips Zoom WhiteSpeed System

1. Isolation is critical because chairside whitening solutions typically use highly potent hydrogen peroxide bleaching gel, which can cause soft-tissue damage if it comes in contact with the gingiva or lips. Lip and tongue retractors, such as Philips Zoom’s IsoPrep Retractor and Liquidam light-curable dam, can completely isolate the soft tissue from contact with the bleaching gel and exposure to the chairside whitening light. 2. The whitening gel should be applied in a 1-mm to 2-mm thick layer over all tooth surfaces that will be whitened to ensure that adequate bleaching gel is present to whiten teeth when the light is applied. To avoid spreading the bleaching gel onto the soft tissue or under the isolation, remove the gel from the teeth using a surgical suction tip (now included in the redesigned Philips Zoom Chairside Light-Activated kit) after each 15-minute session. Avoid using the air/water syringe because this can dislodge the isolation and push bleaching gel onto the soft tissue. Any remaining gel can be removed with moist gauze. 3. Tooth sensitivity can be addressed by using the variable intensity settings of the light and by having the patient use a desensitizing agent. The Philips Zoom Chairside LightActivated procedure includes a unique Patient Post Care & Maintenance Kit complete with a syringe of Relief ACP. The Relief ACP gel can be administered in either a take-home tray or applied with a toothbrush daily for 10 to 30 minutes. 4. Application of vitamin E oil to the lips before beginning whitening will minimize irritation. 5. Patients also should be advised that consuming coffee, tea, or red wine or smoking during the first 2 hours after chairside whitening can lead to staining and darkening of the teeth. It will take about two hours for a pellicle to reform on the enamel surface. 6. To maintain and further enhance the chairside whitening results, it is advisable to make take-home trays to be worn by the patient for 30 minutes weekly. r. Paul Bhatti’s new practice, Parkview Oral and Maxillofacial Surgery, in Brampton, Ontario, is unique, vibrant, and inviting. His goal was to make patients feel immediately comfortable within a clean, professional environment. The soft color scheme, smart finishes, and effective lighting solutions, were carefully selected with that notion in mind, as was the incorporation of interesting ceiling design, wall detailing and artwork. Understanding procedures and what to expect post-op undoubtedly alleviates most anxiety and concerns, so both consultation rooms are suitably sized for patients and family members, and equipped with computer stations to facilitate communication. Six surgical rooms have been strategically designed to hide much of the large, intimidating equipment. With room for five team members, procedures are efficiently completed. Vital monitors have been located for easy visibility, allowing

the surgeon’s focus to remain on the surgery field. Recovery rooms with reclining chairs are open to a nurse’s station to ensure close monitoring of patients. The technology in this office is cuttingedge; 16 networked PCs permit Parkview OMS to be paperless and efficient. Off premises, through POM’s website, patients can remotely enter information, creating an electronic chart in the software, and eliminating the need to fill out forms at their visit. Relevant information is instantly available on all computers, and several techniques are used to safeguard confidentiality. Beyond reception, through tall glass doors to the clinical area, is an area of curved walls and 14-foot ceilings. Each operatory has been named with a spa-like motif. In the manner of true ‘frontdesklessness,’ all patient “check outs” are done in the spacious operatories. Spacious and clean, the office flows perfectly. WATERFRON with George Brown College T

he revitalization of Toronto’s waterfront has introduced many new developments along the city’s shoreline, possibly none more exciting than the new campus for George Brown College’s Centre for Health Sciences. The campus is scheduled to be completed by fall 2012 and will accommodate 3,500 new students in a variety of programs ranging from nursing to dental health. Located at the foot of Sherbourne Street facing Lake Ontario to the south and the new Sherbourne Common park to the east, the new location is being outfitted with state-of-the-art equipment that will enhance dental health education in the city. Given that 70 per cent of health care workers are educated in the college system, institutions like George Brown College have a critical role to play in preparing graduates who are ready to meet the current and future needs of Ontario’s healthcare system. George Brown’s School of Dental Health includes dental assisting, dental hygiene, dental technology and denturism

and is one of the only colleges to offer restorative dental hygiene. Moving from its current location at George Brown College’s Casa Loma campus to the Waterfront campus gives the school an opportunity to upgrade technology and facilities to provide the best learning environment for students. One of the main areas of the dental school to receive a make-over is the dispensary, where students receive, store, and sterilize equipment. Along with an increase in storage space, a state-of-the-art ventilation system will be installed to allow instruments to cool down without creating condensation as well as the installation of a medical-grade autoclave sterilizer. Currently the students use conventional ultrasonic water baths/cleaners, the Waterfront campus will be equipped with ultrasonic instrument washers. The school is also considering adopting an electronic health record system (EHR) which will allow students to send and document client information electronically.

While the school’s radiography clinic may ultimately change to a fully digital system, the program will continue teaching manual techniques so students are equipped and comfortable working in both environments. Going digital not only allows the students to keep up with technological advances in the industry but also conserves paper and increases efficiency. Sally Choi The dental clinic has a client base of about 2,500 and the Waterfront campus will allow them to serve more clients from the community. The hygiene clinic will increase the number of operatory chairs from 57 to 75. Currently the school is looking into equipping each operatory with a computer to enable students to watch demonstrations and work at their own pace, rather than being grouped into one operatory to observe a demonstration. At the moment, there are two dental surgical rooms at the Casa Loma campus and they hope to have more in the Waterfront campus, all of which will be accessible to people who use wheelchairs or mobility devices. One of the biggest improvements to the efficiency of the dental school is the amount of physical space that enables the school to accommodate client services and clinics on the same floor. Currently, traveling between floors is problematic for clients and students. One element of the program that will not change is the ability for students to work with different programs to devel-

op their interprofessional skills. The Waterfront campus is among the first in Canada purpose-built to deliver interprofessional healthcare education. Students from all four Health Sciences program areas — dental health, nursing, health services management, and health & wellness — will work in concert to serve clients under the supervision of expert faculty and staff. For instance, dental students work with nursing students to learn how to properly take blood pressure. Students will also continue to do placements at community centres, long-term health facilities, private practices and internationally. George Brown College takes pride in building good relationships with a variety of organizations to give students the opportunity to work with a diverse range of practices. The benefits of this new campus also extend to the community with the introduction of WAVE (Wellness, Applied research and Visionary Education), a clinic that will offer lower cost health care services to the general public. WAVE will be a unique cluster of simulated and real clinical service environments that will enable the health sciences students to develop competencies in their chosen programs in a professional setting. Some of the services offered at WAVE will include dental check-ups and assessments, X-rays, teeth cleaning, fabrication of complete or partial dentures, repairs and relining, teeth whitening, fillings, veneers, and bonding as well as hearing aid evaluation, consultation for assistive listening devices and hearing conservation, cardiovascular and fitness assessments, mobility and flexibility training. Along with WAVE, the Waterfront campus will provide amenities such as healthy food services and a bookstore. Student life will animate the up and coming East Bayfront neighbourhood, supporting local businesses and increasing the sense of community. For students, perhaps the greatest benefit will be learn-

ing in one of the most architecturally beautiful, sustainable and desirably-located educational environments in Ontario. The building’s glass and metal exterior has been designed to provide the most dynamic student experience with unobstructed views of Lake Ontario. One of the unique features of the building is a tall set of deep stairs that can be used as a touchdown area for students, while also facilitating group learning. In keeping with the theme of flexibility, the space can also substitute for larger groups and seminars. The campus will be comprised of two main blocks; the west block houses classrooms and uses heavier material for the programs’ lab, classrooms and simulated hospital area, while the eastern block consists of a public library and simulation centre and faces the park. The materials used in the construction of the campus are significant to the theme of the Waterfront campus itself. Strong materials with a long lifespan such as wood, concrete, basalt, and exposed concrete make up the building’s structure. The use of glass brings the outside in, allowing the building to spill out onto the promenade to promote interaction with the community. The building also incorporates materials that are stable and bacteria controlled from a healthcare perspective. Taking into account the digital sophistication of today’s students, every classroom in the building is considered a

learning lab for multi-media learning. The physical classrooms are flexible for interactive and group learning, while also taking into account that every student learns differently. Classrooms are embedded with tools for different learning purposes, including the furniture, huddle boards and the use of Smart technology. Designed by Stantec Architecture and Kuwabara Payne McKenna Blumberg Architects in joint venture the campus is being built with an environmentally sustainable focus. The goal of the Waterfront campus is to meet Leadership in Energy and Environmental Design (LEED) Gold certification, an internationally accepted benchmark for the design, construction and operation of high performance green buildings. The campus will have features such as advanced energy management, 43 per cent reduction in water use, 51 per cent reduction in energy consumption, use of recycled materials, focus on local materials for construction, bicycle spaces and alternative fuel stations, native/drought-resistant plants, and a 62 per cent green roof area. In locating its new campus in the heart of the city’s developing East Bayfront neighbourhood, George Brown College will be providing Toronto with a new centre of excellence for health sciences education and the community with new resources and clinics promoting health and wellness. privacy breach is often caused by human error or faulty practices and procedures. Look to implement simple fixes first. The Royal College of Dental Surgeons of Ontario (RCDSO) has published a Draft Guideline on Electronic Records Management. Although it has not been ratified by the college and may undergo further changes before final approval, it is still an excellent resource for any dental practice, whether in Ontario or elsewhere. In fact, it is currently the most comprehensive and rigorous set of standards published on the topic of data security by any similar organization in North America. If you have not carefully read through these guidelines, I suggest that you take the time to do so. A link to this document and other related information and tools can be found at the end of this article. One common misconception among dentists is that their computer hardware or I/T providers are responsible for their data security. While I/T providers may have the knowledge to assist with the implementation of security solutions, they are ultimately in the business of selling a service that their customers value and are willing to pay for. In many dental offices, it is very obvious that data security is not a big priority. The I/T provider is therefore not inclined to tailor their offering to include more expensive and more secure options. On the other hand, if the practice demonstrates an interest in security, a qualified I/T provider can offer to implement a variety of solutions.

Passwords Dental practices are notoriously poor at implementing appropriate password security. Many practices use either no password or the same password for all users, and generally choose one that is either obvious or nearly so. They do this to avoid the administrative burden that would be imposed by a need to assign passwords to individuals, and to maintain those passwords. To be fair, it is not a trivial task to keep up with demands for new account creation and deletion, and the inevitable forgotten passwords. However, the individual user account is the building block upon which almost every other component of computer security is built. Without the ability to validate an individual user on the system there is no way to provide appropriate levels of access (including no access), or to monitor or audit what individual users are doing. Implement a policy now whereby all individuals have their own user account with their own unique password. Ensure that account sharing is not tolerated, and put processes in place to ensure that all users must login with their own account prior to using any system. As an added step, and if your software allows it, try to setup whatever auditing is available, but the simple act of requiring unique account access for each user is a huge step forward for many practices.

Encryption One of the best ways to ensure that data does not fall into the wrong hands is to encrypt it. Data encryption is the process of transforming data to make it unreadable to any-

one except those possessing some type of special knowledge, or ‘the key’. Encryption is itself a risky undertaking because loss of ‘the key’ will result in loss of the data. There is no way to recover encrypted data without ‘the key’. However, encryption is necessary whenever data exists where the security of the physical media cannot be assured. Data stored in a bank safety deposit box is presumably safe enough and encryption is not required. Conversely, data stored on a portable device that might be lost or stolen on a bus or park bench, or data transmitted freely across the Internet must be encrypted. Most practices are also bound by some kind of legislation or order requiring them to encrypt data on mobile devices or while data is in transit. In Ontario for example, Order HO-004 and Order HO-007 from the Office of the Information and Privacy Commissioner (IPC) require that personal health information stored on any mobile devices (e.g. laptops, memory sticks, PDSs) be strongly encrypted. “Strong Encryption” was later described in the Fact Sheet: HealthCare Requirement for Strong Encryption to be either AES, or Triple-DES with 168 bit keys. In practical terms, this means that prior to backing up electronic data and moving it offsite (which all practices REALLY should be doing) the data must be first encrypted with the appropriate type of strong encryption. Likewise, any data stored on a device that might be considered ‘mobile,’ or at risk of loss or theft, must be encrypted as well. We highly recommend a free tool called True Crypt for many encryption purposes (www.trucrypt.org). It is a very robust piece of software which allows for the encryption of data on Windows, Mac and Linux platforms. With it the user can encrypt entire drives, volumes, or files. Other tools are available, and many cost little or nothing to implement. For more information and a list of tools to help you encrypt and decrypt data, please visit the link provided at the end of this document. Once some of the basic security precautions listed above have been implemented, there are a myriad of other ways that dental systems can be made more secure. Work with experts; learn a little more about security, and strive to take data security a little more seriously. As security improves, risk diminishes, for the practice and for the patients that trust it with their personal data. he Scientific Research and Experimental Development (SR&ED) program pays out over $4-billion annually to thousands of innovative companies annually and is the largest single source of federal government support for Canadian companies. The objective of the incentive program is to encourage Canadian businesses of all sizes and in all sectors (including incorporated dental practices) to conduct research and development in Canada. The program is not a grant but rather offers reimbursement for allowable SR&ED expenditures (including part of employees’ salaries) incurred and claimed in corporate income tax filings.

What work qualifies? SR&ED work must: • I nvolve a systematic investigation or search; • Be carried out in a field of science or technology; • I nvolve the advancement of scientific knowledge or technology; • Be conducted by means of experiment or analysis.

As the name implies, categories of SR&ED include various types of Scientific Research as well as Experimental Development which is work undertaken to achieve technological advancements for the purpose of creating new, or improving existing materials, devices, products, processes (new treatment techniques) or protocols. The majority of the work that is claimed is Experimental Development and dental clinical innovation most often fits in this category. An example of work that might qualify would be developing a new capability for an existing piece of dental equipment or new protocol settings for the equipment with the intent that the changes will lead to increased efficacy or patient comfort. Another example might be the development of a new bone grafting technique to improve dental implant success rates. With respect to the dental profession, costs incurred for routine treatments or implementation of wellknown established technology (i.e. digital radiography) would not qualify. In summary, there must be an attempt to achieve advancement through resolution of scientific or technological uncertainties and it must involve systematic investigation. The technological advancement for the purposes of SR&ED eligibility is defined as the development of a characteristic, capability or know-how not previously existing or available.

How to Apply Corporations may apply directly to the SR&ED program by completing the necessary forms which describe the work performed, summarize the expenditures, calculate the refund and provide supporting documentation. However, the expertise required and the opportunity cost of committing time and resources makes this approach impractical for most corporations, and even more so for dental practices. As a result, a whole consulting industry has evolved to respond on behalf of corporations who do not have the inclination, resources, and expertise to file claims on their own. Unfortunately, most of those consulting companies are unable to assist incorporated dental and physician practices due to lack of relevant scientific and clinical expertise.

How Qualified Consultants Help First of all, an experienced consultant can help you determine if you qualify for the program based on SR&ED guidelines for eligibility. In addition to the work required to prepare the application forms, a qualified consultant will have a staff of experienced clinical researchers to support you through all stages of your research activities. They will help you to properly document innovative treatment techniques you may have developed, guide you on data collection and scientific analysis, and assist with submission of scien-

tific abstracts to dental industry meetings that summarize your clinical results.

Common Questions and Concerns • I don’t have the time required to make a SRED claim since I’m running a busy dental practice If using a qualified consultant, depending on the size of your claim, the time required by the dentist is non-significant and represents a small percentage of the overall time required for claim preparation. An initial halfhour interview is all that is required to discuss the eligibility of your research projects and available project-related documentation. Tax returns and T4 slips for the relevant fiscal years are required. • A m I opening myself up to unnecessary professional scrutiny by reporting my clinical procedures and potential failures? The claim is not critiqued for clinical or scientific viability by any dental governing body but rather is evaluated strictly on meeting the program eligibility requirements by a SRED governing body of the CRA . The claim remains confidential just as submitted tax returns are. • What is the cost for a consultant to apply for a claim on my behalf and what amount of refund can I expect? Most SR&ED consultants do not charge fees upfront but rather will bill a percentage of a successful claim based on the amount reimbursed to the client. For a dental office, the amount of the claim for reimbursement is calculated by first allocating appropriate percentages of dental staff T4 slip wages (including the dentist but normally excluding hygiene) issued by the dental corporation that can be attributed as costs toward the time spent working on clinical innovation. A dental practice that is running qualified research projects can expect to receive tens of thousands of dollars annually from this program. • The program seems too good to be true. Why would the government give me funding for things I perform in my practice? The SRED program was developed to encourage innovation in response to other countries’ offering incentives to their industries in order to be more competitive in the global market place. It is also hoped that the resulting innovation will stimulate employment. There is no reason these goals may not also be applied to the dental profession that is a contributing to the tax base and therefore entitled to reimbursement for expenses incurred in innovation development. • Although I am interested, I am not sure I have done or am currently doing anything innovative that would qualify Continued on page 40

life insurance policy, which in turn lets you take advantage of tax-free or deferred growth and draw retirement income tax-free.

Investing excess earnings This strategy works particularly well for medical professionals who have excess retained earnings in their professional corporation. It works like this: You use your professional corporation to acquire a universal life insurance policy on yourself. Then, the corporation makes deposits to the universal policy in excess of what is required to support it. The extra funds in the contract then grow tax-free, yielding a significant sum of money. When you retire, you then access the cash via loans.

There are two common ways to structure a corporate IRP: • The professional corporation owns the life insurance policy and, using the policy as collateral, takes out against the policy’s cash value and pays a taxable dividend to the corporate shareholder. This is known as a “corporate IRP — pay a dividend.” • The professional corporation owns the life insurance policy, but the shareholder —

hat is arguably the most tax-efficient way for incorporated dentists to save for retirement and access those savings in their leisure years? Many would answer RRSPs. While RRSPs are certainly a smart way to reduce what the tax man takes, as contributions are deductible from income and they can grow on a tax-deferred basis, their usefulness for medical professionals earning high incomes is limited. Are we suggesting you don’t use RRSPs to save for retirement? Not at all. By all means, maximize your RRSP or individual pension plan contributions every year (if you have one). But consider expanding your strategy to include an investment vehicle that allows you to shelter 100% of your earnings growth, tax-free. It’s an option that could give you significant money after your retirement. This vehicle is called a corporate insured retirement program (corporate IRP). A corporate IRP allows for retained earnings from your practice to fund a

again using the policy as collateral — personally takes out a loan equal to its value. This is referred to as a “corporate IRP with shareholder borrowing.” It’s important to note there is no best way to structure a corporate IRP. Each model has its benefits and each has its drawbacks you need to consider, and you should consult with your tax adviser to determine which may be right for you. Assets such as vacation properties result in taxation upon death, so to offset these costs a person can buy a life insurance policy and deposit the maximum so these tax-free funds are available to pay the tax bill. Let’s run through an example to illustrate a corporate IRP with shareholder borrowing. “Dr. David Jackson” is a 50-year-old divorced father of three children who is a nonsmoker of average health. He incorporated his practice in 2006 and is annually maximizing his RRSP or an individual pension plan. Dr. Jackson has excess retained earnings in his corporation that he would like to use to supplement his retirement income. Meanwhile, realizing his vacation property and other assets will attract a fair amount of taxation when he dies, he would like to pool some money to cover these liabilities so no part of his estate will have to be sold to pay the tax bill.

With the strategy, Dr. Jackson’s corporation acquires a $1-million universal life insurance policy on him and deposits the maximum legally allowable premium into the plan annually for 15 years. The actual annual cost for the coverage is $10,937, but over the period his corporation has put in more than that — over $1 million from corporate retained earnings — on a tax-free basis. Upon retiring, Dr. Jackson obtains a bank line of credit and puts up the policy as collateral. Assuming a 6% return on the insurance policy and an 8% borrowing rate on the loan — and that he will live to 82 — Dr. Jackson can draw $109,421 per year from his credit line, tax-free, to supplement his other sources of income. Assuming he dies at 82, the outstanding loan balance would be $3,870,247. The balance would then be paid using the insurance policy’s total benefit of $6,160,336 with the remainder going to Dr. Jackson’s beneficiaries. The value added benefit of preparing an SR&ED claim is that in many cases it provides by default the core material for scientific abstracts for submission to dental industry meetings as well as materials for lecturing. Similarly, publishing clinical findings and creative treatment techniques can further establish you as a leader in the profession.

Conclusion

The SRED program is a great opportunity for dentists who qualify to be compensated for their hard work in advancing the profession. You may already be eligible for annual financial support for innovative use of a wide range of medical devices, materials and surgical procedures but it is best to consult with a SR&ED consultant with experience in healthcare submissions. Secondly, material derived from your SR&ED submission can help establish yourself as a key opinion leader in the chosen field of your expertise and further set you apart from the majority of your peers.
