This past year has been a wild ride. The Bills are sitting atop the AFC East and a global COVID-19 immunization effort is underway.

I

We’ve seen some interesting developments in the cannabis space since our last issue. First, was the proposed change in the regulation of hemp-based CBD products in the State. While we’re excited about improvements for consumer safety, we’re worried about our many friends in the hemp space that have worked hard to grow or source quality hemp flower. (As I type this, the legislation in its current form would prohibit the sale of Hemp CBD flower).

Governor Cuomo again promised to legalize (recreational) cannabis for adults this year. In the wake of the budget deficit caused by COVID-19, NY needs all the tax revenue it can get.

I fully support legalization and believe that a regulated market is safer for everyone.

However, tax revenue from cannabis will not go directly to those hurt by prohibition, instead, it will be sent to the State and they will decide what to do with it. A key aspect of the State’s legalization bill will be details regarding the reinvestment of that tax money into communities wronged by prohibition. Hopefully, NY can get this right.

Joe Biden won the election and I’m optimistic that positive change in cannabis and drug policy reform is on the horizon. The MORE Act and Medical Marijuana Research Act both passed in the House but will need to pass again in the house and senate next legislative session. Another largely symbolic win was the rescheduling of cannabis by the United Nations.

What is Delta-8-THC?

ave you heard of Delta-8 THC Yet? If you’re a medical patient, you may have heard of this compound from your local dispensary associate. For some, the concept of a legal THC product seems too good to be true. For others, Delta-8 THC seems to be the perfect remedy. Let’s learn more about this upcoming cannabinoid as we take a deeper dive.

What Is Delta-8 THC? There are many forms of THC that exist.

Delta-9 THC, being highly psychoactive, is commonly associated with cannabis and is used to classify whether a plant is hemp or cannabis depending if it has more or less than 0.3% D9 THC. Delta-8 THC is one of the numerous other naturally occurring THCs found in both hemp and cannabis varieties but has always been found in very low amounts.

D8 THC, molecularly, is very similar to D9 THC, but with enough differences to make D8 THC unique enough to stand out in the crowd. Seen as a viable option for those who aren’t necessarily seeking the level of high associated with medical cannabis products, D8 THC is earning a quick reputation for its unique effects.

Effects of Delta-8 THC When vaped, many people report D8 THC as being the opposite of D9 THC, but in positive ways. D8 THC is known to boost mood and promote calm feelings, while simultaneously giving energy and a motivational and functional “buzz”.

The slight molecular difference of D8 THC from D9 THC can make D8 THC a little harsh on the lungs as some users report. However, good to note there are other methods that don’t require having to inhale anything.

Ways to Consume Delta-8 THC Currently, the types of Delta-8 THC products range from distillate for vaporizing, tinctures for oral absorption, and edibles for ingesting.

D8 THC Distillate: The most common method you will have is a vape cartridge filled with D8 THC distillate, screwed onto a 510 threaded battery, and vaporized. Inhaling vaporized D8 THC can provide quick and intense relief as it is absorbed quickly into your bloodstream. Is Delta-8 THC Legal?

The magic behind this molecule revolves around the 2018 Agriculture Improvement Act of 2018 which made any isomer found in hemp legal, as long as its total D9 THC was below 0.3%. D9 THC becoming the only hemp-derived cannabinoid with a federally regulated limit meant that all other forms of hemp-derived THC were technically free to exist in any concentration.

Like federal law, New York state specifically legalized all deviates, cannabinoids, and isomers of hemp including all THCs as long as the D9 THC is below 0.3%.

This means that in New York State, for the time being, it is legal to purchase and possess D8 THC products.

Flower at NYS Dispensaries Gets Recalled Due to Noncompliance

BY JACK PORCARI t was 2:50 p.m. on September 2nd, and medical marijuana patient Alicia P. noticed something different about her trip to the dispensary; her medicine was no longer on the shelf. She has found particular relief from Curaleaf’s cannabis flower products. A recovering addict with over six years of sobriety, the patient said that it helped cut her Suboxone dose in half.

“I was seeing studies about the entourage effect … it was all seeming to go in the right direction and then this happened,” Alicia said. Verilife, a local Amherst dispensary, offered ground flower for a little over a month before it was recalled. This difference in product availability can mean a great deal for some patients.

“Flower is by far the most accessible dosage form, both in terms of patient familiarity and, most importantly, in terms of cost,” said Stacia Woodcock, Pharm D, Dispensary Manager for Curaleaf’s Forest Hills Dispensary.

Due to the fact that it requires minimal processing to adhere to regulations, ground flower will cost the patient less than other cannabis products that are expensive to produce. Vape cartridges, which are the closest comparable product to vaped flower, can cost up to twice as much as flower on a dollar per milligram basis.

Woodcock also noted that cannabis flower is essential in giving patients a versatile treatment option, allowing for homemade oral, topical, and sublingual medications. “When flower is not available through a legal, regulated market, it drives patients toward illicit sources, which creates great risk, especially in terms of potential contamination with mold or fungus, which could be life-threatening to immunocompromised patients,” Woodcock said.

Now more than ever, the Department of Health should be ensuring that all New Yorkers have access to high quality, affordable cannabis.

Medical cannabis flower was recalled from the 18 stores carrying Curaleaf

products in early September, leaving the shelves vacant for weeks. The DOH cited the measurable size of the cannabis nuggets as their reasoning behind the administrative hold.

After further investigation, it appears that this may not be the only reason why the DOH decided to pull a medicinal product from the shelf with such an ambiguous explanation.

Dispensaries were ordered to “immediately stop offering these products to patients until further notice,” according to a leaked document sent to all NYS registered organizations.

Patients and doctors were not aware that this administrative hold was imminent and were unable to plan accordingly. This decision to recall medicine and change the guidelines for the program was made promptly without the input of the community through a public hearing.

We spoke with an inside source (who wished to remain anonymous) from one of the dispensaries that stocked Curaleaf’s flower.

“We believe another registered organization filed a complaint to the DOH that Curaleaf didn’t have their flower ground down to an acceptable size. This year seems to have jaded a lot of people and it just seems like it brought out the worst in everybody when it shouldn’t have.

When higher-ups start these pissing matches, I don’t think they realize the impact that it has… In New York City there have been a couple of dispensaries that they’re actually so down and out that they’re only open Thursday through Saturday.”

This massive product recall shows that even in the midst of a pandemic, competing companies in the cannabis industry are willing to resort to blowing each other into their regulators.

These decisions, both by the Department of Health and the alleged registered organization that filed the complaint, echo the realities of the cutthroat business tactics in this industry. Over 15,000 wholesale units of flower were recalled by the Department of Health, according to Timothy Mitchell, a patient advocate. With a price tag of roughly $1.1 million, the ripples of this regulatory charade are felt by patients and workers alike. While some registered organizations feel the need to fight for a larger share of a market, patients and those working within the cannabis industry are wondering how such a useful product was able to disappear over a technicality. In the legislation, there is no section expressly stating the guidelines for the size of medical cannabis. In fact, 10 NYCRR § 1004.11 only mentions ground cannabis once: It is displayed on a list of approved forms of medical marijuana products.

With this level of inconsistency and transparency, many patients like Alicia feel that the program doesn’t work with them in mind.

Recently, the eight weeks ban on ground flower was lifted. “The Department has lifted the quarantine and approved Curaleaf to continue product manufacturing and sales,” a spokesman from the Department of Health said. Despite this, there are still many barriers to achieving access to affordable flower across the state. “Testing turnaround time under the best-case scenario can be three to four weeks. We are pretty sure that the Wadsworth Center is doing 100% of the testing,” said Timothy Mitchell, an advocate who is very familiar with the medical industry. Now with a backlog of thousands of units and only a single testing location, it could take a long time before all New Yorkers can see their medicine back on the shelf.

What this series of events shows us is that New York’s medical program can do much better for the patients it serves. Instead of trying to cut others out of the market and monopolize, dispensaries ought to work together, innovate, and create the most positive patient experience.

a more robust set of regulations that focuses on the actual application of the plant with the advice of patients, consumers, and industry professionals. “Patients can expect the same quality flower which will now be ground according to the Department of Health’s new guidelines. Our patient community has been incredibly patient with us and, to show our appreciation, Curaleaf’s ground flower will be sold at a lower price point once it returns to the market,” said Patrik Jonsson, Regional President, Northeast for Curaleaf. The ground flower is slowly being re-released in small batches at Curaleaf’s dispensing locations in the Hudson Valley, Plattsburgh, and Queens this week. From here, patients need to ask more questions and demand more of a program that truly has the potential to be successful.

If we ever expect to legalize and open up the adult-use sector, registered organizations need to focus more on the impact their decisions have on the community.

airways. After binding, the virus is able to enter our cells, hijack cellular machinery, and replicate. In a small percentage of individuals, this leads to a complex inflammatory cascade causing severe COVID-19 illness.

To conduct the study, the authors obtained 3D tissue models (made to mimic tissues in our airways) and pre-treated them with cytokines to induce inflammation. After that, they exposed the cells to numerous extracts from different strains.

They used RNA sequencing and Western Blotting to analyze the expression of ACE-2 and found that a number of their CBD dominant extracts reduced the expression of the ACE-2 receptor in their tissue models. In the discussion of their article, the authors mention that they applied the extracts directly to the tissue media to model medical delivery such as that obtained via a mouthwash, throat gargle, or inhaler/nebulizer.

The authors went on to state that the results should not be extrapolated to cannabis smoking because of the findings that tobacco smoking increases ACE-2 expression and is associated with worse outcomes in COVID-19 illness.

While these findings are certainly exciting and interesting they are only preliminary and were published online without peerreview. The research definitely supports further investigating the role that cannabis and CBD have in modifying ACE-2 expression and the implications this has on COVID-19.

Cannabis Wins Big with Voters on 2020 Ballot

Regulators Crack Down on CBD Since the last Cannabuff issue, developments in cannabis reform have come fast and furious. Cannabis legalization was approved by voters in every ballot where it appeared, Governor Cuomo just announced another push for adult-use legalization in New York, and even Congress made some symbolic progress. But if you are in the CBD space, beware recent enforcement efforts targeted at unverified health-based claims.

Cannabis on the Ballot The 2020 election was an across-the-board win for cannabis legalization advocates. Voters in four states (Arizona, Montana, New Jersey, and South Dakota) approved measures to legalize cannabis for adult use, Mississippi legalized medical cannabis, and Oregon became the first state to broadly decriminalize all drug possession and legalize therapeutic use of psilocybin mushrooms.

Moreover, Washington, D.C. approved a ballot measure which decriminalized psychedelics in the District.

Therefore, after the 2020 election dust has settled, recreational cannabis is legal in 15 states and the District of Columbia. 20 more states have legalized cannabis for medical use with a doctor’s recommendation.

And in fact, only two states currently prohibit non-hemp cannabis for any purpose.

The overwhelming popular support for cannabis will not go unnoticed by lawmakers at the state and federal level.

Any remaining holdouts may not become champions for change, but they will be much less likely to stand in opposition.

Who to Watch in 2021 Joe Biden is set to become president on January 20, 2021, and he will be joined in the Capitol by a democrat-controlled Congress.

With a united government, some are hopeful that we could see real change at the federal level. This writer remains both hopeful and skeptical.

Biden did not campaign on cannabis reform. He has supported decriminalization, but has not come out in support of the MORE Act passed by the House shortly after the election.

Biden’s priorities appear to be focused elsewhere, and he is unlikely to spend early political capital on a strong push for cannabis reform.

However, that push can still come from elsewhere.

Progressive democrats and even some republicans have gained support from the old guard—and Biden will probably not stand in their way.

Regardless of what happens at the federal level, we can expect the dominoes to continue to fall at the state level. On January 6, New York Governor Andrew Cuomo announced that he plans to make another run at adult-use legalization in New York. While details are sparse at the time of this writing, Cuomo’s announcement indicated that the 2021 proposal will be essentially the same as the one he proposed in 2020.

FTC is a powerful federal agency that, among other things, investigates and enforces federal laws governing deceptive and unfair business practices.

They recently set their sights on six different sellers of CBD-containing products for allegedly making unsupported claims about the ability of CBD to treat cancer, heart disease, high blood pressure, and other conditions. Several were ordered to pay monetary judgments in addition to ceasing their health-based claims.

Other states most likely to expand their programs to adult use are Connecticut, New Mexico, Rhode Island, and Virginia. In each of those states, senior lawmakers and governors expect formal consideration this year.
