FAIR HOUSING: REALTORS® CHAMPION INCLUSION IN THE CAPITAL REGION
As real estate professionals serving the Capital Region, we play a vital role in shaping our communities. Every day, we help people find homes, invest in neighborhoods, and build their futures. With that responsibility comes an important commitment, upholding the principles of fair housing. Fair housing is not simply a legal requirement; it is a cornerstone of ethical real estate practice and a reflection of the values that strengthen our profession.
The Fair Housing Act was established to ensure that all individuals have equal access to housing opportunities regardless of race, color, religion, sex, national origin, disability, or familial status. In New York State, additional protections extend to categories such as sexual orientation, gender identity, lawful source of income, and marital status. These protections are critical in creating an equitable housing market where individuals and families can pursue homeownership or housing opportunities without facing discrimination.
As REALTORS® in the Capital Region, we serve a diverse and growing population. From young professionals relocating to the Capital Region, to families seeking more space, to seniors downsizing after many years in their homes, our clients come from many different backgrounds and life experiences. Fair housing ensures that each of these individuals is treated with the same level of respect, professionalism, and opportunity when navigating the housing market. Our role extends beyond simply complying with the law. We are often the first point of contact for buyers and sellers entering the real estate market,
and our guidance can shape their entire experience. This means we must remain vigilant in avoiding practices that could unintentionally steer clients, limit their options, or reinforce historic patterns of segregation. By presenting all available housing opportunities objectively and allowing clients to make informed decisions, we help maintain a market that is open and fair to everyone.
Education and awareness are also key components of our responsibility. Fair housing laws and expectations evolve over time, and it is essential that we stay informed about both federal and New York State regulations. Continued training not only protects our clients but also safeguards our own businesses and reputations. More importantly, it reinforces public trust in the real estate profession.
The Capital Region neighborhoods are strengthened by diversity and opportunity. When we commit to fair housing principles, we help create vibrant communities where people from all backgrounds can live, work, and thrive. Each transaction we handle represents more than a sale; it represents someone’s home, their security, and their future.
As we continue serving the Capital Region, let us reaffirm our commitment to fairness, integrity, and equal opportunity in housing. By doing so, we uphold not only the law but the highest standards of our profession. Fair housing is not just a policy; it is the promise that everyone deserves a place to call home.

GCAR Members Warm Hearts and Hands
The GCAR Community Relations Committee extends heartfelt thanks to everyone who contributed coats, hats, gloves, mittens, and scarves to benefit the City Mission of Schenectady and the Veterans Miracle Center.
This effort came together quickly, yet the outpouring of support was truly inspiring, resulting in hundreds of items collected for those in need. Because of your generosity and willingness to act on short notice, many individuals and families will have something of their own to keep them warmer and more comfortable this winter.
Your compassion and community spirit make a real difference. We are deeply grateful for your care and commitment to our neighbors and veterans. Thank you for helping us make a meaningful impact!

Gov. Hochul and NYSERDA Warn Climate Law Mandates Will Cost New Yorkers
Governor Kathy Hochul suggested on Thursday that the cost of fully complying with the state’s 2019 climate law could cost average New Yorkers up to $3,500 annually. These remarks follow the release of a memo from the New York State Energy Research and Development Authority (NYSERDA) that analyzed the likely costs to New Yorkers of meeting the 2030 targets set by the CLCPA law. NYSERDA also stated that meeting these climate goals is “infeasible today.” While Governor Hochul has been open to making changes to the state’s 2019 climate law as part of this year’s budget negotiations, state lawmakers are resisting any rollbacks.
NYSAR-Supported First Home Savings Account Bill Passes State Senate Housing Committee
On February 10, the State Senate Housing Committee voted unanimously to advance NYSAR-supported legislation (S.1157/A.5098), which would create a New York State first-time homebuyer savings account program. The bill would provide a state income tax deduction for New Yorkers on deposits of up to $10,000 annually for joint filers and $5,000 annually for individuals when funds are used to purchase a first home in New York, including townhouses, condos, and co-ops. The bill has been reported to the Senate Finance Committee, where it will be considered for a vote.
Albany Mayor, Common Council Back Major Changes to Development Ordinance
A compromise worked out between affordable housing advocates, developers, and Albany city and state officials would change a controversial ordinance that has hindered the construction of market-rate apartments for the past two years.
The measure, backed by Mayor Dorcey Applyrs and sponsored by 11 of 15 members of the Common Council, would reduce affordable housing requirements in the inclusionary zoning ordinance and give developers the option of paying a fee to avoid complying with the set-asides for lower-income tenants. The draft legislation enables developers of residential and mixed-use projects to pay the city $50,000 per unit instead of complying with the affordable housing requirements.

Why It Matters
Real estate professionals with a strong understanding of fair housing laws are better equipped to serve clients ethically and avoid discrimination. Noncompliance can lead to civil liability, criminal penalties, and disciplinary action.
What Everyone Should Know About Equal Opportunity in Housing
The sale or purchase of a home is one of the most significant events in a person or a family’s life. It is more than a transaction. It shapes the hopes, dreams, aspirations, and economic destiny of those involved. Federal, state, and local laws, along with the REALTOR® Code of Ethics, protect people from discrimination when they are renting or buying a home, getting a mortgage, or engaging in other housing-related activities.
REALTOR® Commitment to Equal Opportunity
The term REALTOR® identifies a licensed real estate professional who is a member of the NATIONAL ASSOCIATION OF REALTORS®. REALTORS® conduct their business in accordance with a strict Code of Ethics. Article 10 of the Code provides that REALTORS® shall not deny equal professional services to anyone because of their race, color, religion, sex, handicap, familial status, national origin, sexual orientation, or gender identity. A request that a REALTOR® act in a discriminatory manner in the sale, lease, or rental of property cannot legally or ethically be fulfilled by a REALTOR®.
Fair Housing Rights & Responsibilities
The home seeker, the home seller, and the real estate professional have rights and responsibilities under the federal Fair Housing Act, as well as other federal, state and local laws.
For The Home Seeker
The Fair Housing Act protects people from discrimination when they are renting or buying a home, getting a mortgage, or engaging in other housing-related activities. You have the right to expect that housing will be available to you without discrimination or other
limitations based on race, color, religion, sex, handicap (disability), familial status (presence of children under 18 in the household), or national origin. Additionally, when working with a REALTOR®, you can expect that your housing search will be free from discrimination based on sexual orientation or gender identity. State and local laws may add further protections.
This includes the right to expect:
• Equal professional service from your real estate practitioner;
• The opportunity to consider a broad range of housing choices and neighborhoods;
• Fair and equal treatment in the terms and conditions for home sale and rental, including in the financing, appraising or insuring of housing;
• Reasonable accommodations in rules, practices and procedures for persons with disabilities; and
• To be free from harassment or intimidation for exercising your fair housing rights.
For The Home Seller
As a home seller or landlord, you are required by federal law to do business with prospective purchasers or renters without regard to their race, color, religion,
sex, handicap (disability), familial status (presence of children under 18 in the household), or national origin. State and local laws may prohibit discrimination based on additional characteristics, such as veteran status or sexual orientation. You may not instruct the licensed real estate broker or agent to put any limitations on the sale or rental of property based on these characteristics, because the real estate professional is also bound by law not to discriminate.
Under the Fair Housing Act, a seller or landlord may not treat prospective buyers or tenants differently because of their race, color, religion, sex, handicap, familial status, or national origin. A seller may not, based on these characteristics:
• Advertise a preference for certain buyers or tenants;
• Falsely represent that a property is unavailable for sale or rent; or
• Establish different terms or conditions in any aspect of the purchase or rental of housing.
For The Real Estate Professional Agents in a real estate transaction, whether they are REALTORS® or not, are prohibited by federal law from discriminating based on race, color, religion, sex, handicap, familial status, or national origin. In addition, the REALTOR® Code of Ethics prohibits REALTORS® from discriminating because of sexual orientation or gender identity. State and local laws may also prohibit discrimination based on additional characteristics.
REALTORS® may not, because of a client or prospective client’s race, color, religion, sex, handicap, familial status, national origin, sexual orientation or gender identity:
• Refuse to sell or rent housing;
• Set different terms or conditions in any aspect of the sale, rental, or financing;
• Represent that housing is unavailable for inspection, sale, or rental, when in fact it is;
• Steer a buyer or renter to a particular neighborhood; or
• Make a statement or publish an advertisement indicating a preference or limitation.
RESOURCES
