GENDER BASED VIOLENCE How does the LAW protect you?

I

was asked to do an article on this sensitive issue so that the community can see a simple version of quite a complex Act. It is definitely a very emotional issue as violence from a spouse or loved one is often the cause of the unpleasantness. In my career I attended more than enough of these incidents to know that they are very complicated and the Police are sometimes called upon to resolve an issue that has been brewing and smouldering for years. What then is a domestic relationship? Not easy to define. A domestic relationship doesn’t just mean spouses or courting couples, it could be parents and children, grand-children, even siblings. There is no statute of limitations regarding time limits of the relationship and the cessation of that relationship.

Technically, if a person you dated five years ago for two weeks swears at you or threatens you, it falls under the Domestic Violence Act. (See how easy it is to abuse?)

The easiest way to explain how the system works is to walk you through it as an exercise. There are going to be some jargon-like numbers thrown around, like SAP508, but each will be explained and referred to as such. Note, to report the incident you can have a vehicle come to your home or work or you can go to the SAPS station in the area in which the incident happened. If the “location” is cyber, like a threatening SMS or email, report the matter to the Station where you live. (Conveying threats via telephone or email opens the suspect up to a host of other charges on top of Domestic Violence.) At the first meeting of the complainant and Police, the official will conduct an interview, in private if necessary, to determine what type of assistance is necessary. The official will note injuries, severity of violence, if necessary make arrangements for medical assistance, shelter, place of safety, counselling (SafetyNet) and if a threat of firearm use is suspected or imminent.

t the age of 25 I fell in love with the idea of a man! I was somewhat swept of my feet! Now looking back at it all the red flags were there from the start, but they were very subtle.

It started with little insults “you’re so stupid, oh I was just joking” “you’re fat” and so on. I remember the first explosion like it was yesterday, it was a Saturday a beautiful summer’s day! I had to go to the OBGYN and I was out for longer than I expected and something cracked inside Adam and he went crazy, accused me of cheating on him, hundreds of missed calls from him.

He called my parents and went off on them! Now I had to give his car back so I had to see him and he kept screaming and shouting and that was the first time I was scared for my life.

A friend came and rescued me and I stayed with her.

This is when the cycle started because he was then very, very, very sorry and it would never happen again! And blindly I believed him and I went back. Not long after being back with Adam I had my first taste of physical abuse. He got really angry and hit me in the face with a cell phone. When it happened I was shocked as I didn’t think that this could happen to me. I was alone because I went back after my friends, family all told me not to go back!

At this point he had isolated me from my friends and family. And again, he was sorry he looked after me and so again I forgave him. But the nice honeymoon was shorter this time! Once again Adam was verbally abusive to me and because he was not working, he was taking all the money I was earning. His standpoint was he was my husband and therefore the wages I was bringing in was his.

I felt like I was constantly walking on eggshells.

I felt myself slowly drifting away and I was becoming a ghost. I tried to leave, and he talked me into staying yet again! And a week later he beat me up so badly and kept me locked in the house so that I could not leave!

He cracked my ribs, burnt me with a cigarette, punched me repeatedly while his mom and his sisters watched (it took them some time to help me as they were afraid of him).

He broke my new phone so that I could not call anybody to help me. I was hospitalised and as soon as I recovered I went to work one night and didn’t return!

TESTIMONIAL me out of the car. I lost the baby. But I fell pregnant again, the abuse did not stop. The verbal abuse - I think this is the worst- was at an all-time high and the physical abuse was not far behind-black eyes, strangling me and punching me in the head whilst the silent treatment and just making me feel like an outcast. By this time Adam had cut me off from my parents, my church, my work colleagues and my friends Let’s fast forward to when Mia was born. Now Adam didn’t want to know the sex of the baby. At a checkup, which I went to alone. I was told I was having a girl.

When she was born, he was mad that I kept the secret of her being a girl. When we got out of the hospital, he immediately told me that I needed to work out and lose weight because I was fat. I started walking a week after Mia was born. Not long after Mia was born the verbal abuse started getting worse and worse.

When Mia was 8 weeks old Adam was physically abusive! He punched me and even strangled me; he only stopped because I told him to get it over with. I was then called a variety of awful names and then told to sleep on the floor like the dog that I am!

Two weeks passed and the final blow out took place.

Adam beat me up and he threw me out of the house without my baby. At this point something in me broke!

No family and no place to go! I ended up at an abuse shelter.

The police and the shelter staff got my daughter back 30 hours and 36 minutes later! I stayed in the shelter for a month and a half-the maximum period I could stay there and I ended up going back to Adam because he had alienated all my friends and my family and I had nowhere to go. His sister Nikki made me feel like I was a

And he came back and again was sorry and he convinced me to marry him and because I believed that there was still good in him I did and it was okay for a month and then I got pregnant and he started to think I was cheating on him. home wrecker she also told me that Adam was in counseling and had changed I believed her. There was no honeymoon period this time. On the day I left the shelter the verbal abuse started and the manipulation.

Adam and I are divorcing. He is still unemployed and trying his tricks which will not succeed. I’m back to being my old self, I have reconciled with my parents, family and friends I’m older but very much wiser.

But little did he know, that in the month and a half I changed. I got smarter and I now I had skills to help me survive! So now I needed to put those skills to work as it did not take long for the physical abuse to start again, and it was always my fault.

Because my family meant so much to me he made threats against them. And one time he went for my daughter and that was when I knew that I had to get out for the safety of my daughter. So, I did I took Mia and left with the clothes on my back.

We are safe now we have our own flat,

The lesson that I have learned from this part of my life is listen to the voices that tell you something is wrong.

by Jan Wessels, which took place during a webinar on Maroela Media. As of 30 November 2020, AfriForum had verified and recorded 347 farm attacks and 49 farm murders for 2020. Of those, 41 attacks and 8 murders took place in KwaZulu-Natal. These represent AfriForum Community Safety’s positions on the matter: POSITION 1 Farmers should be encouraged to focus more on home and hearth protection as part of proactive measures • Great successes have already been achieved with the implementation of proactive home and hearth protection measures by farmers. However, with the handling and processing of reflections over the past few months, it has also become increasingly clear that there needs to be a renewed focus on the basic aspects that will make farmers and their communities less vulnerable.

• The fact that farm communities are dependent on their own once again clearly manifested, as there was little or

no support from statutory ranks during farm incidents.

• From various aftermath conversations, the occurrence of tragic loss of life and other losses has repeatedly begun to show a recognizable pattern.

The sometimes reluctance of farm communities to look after their own security measures can be distinguished as one of the fundamental contributing factors to vulnerability.

• AfriForum would like to help create a safe environment by refocusing on simple countermeasures that will prevent the possibility of attacks and murders on farms. We are aware that many farmers do make strong efforts to protect themselves, their workers and property. As already mentioned, however, it appears from some of the recent reflections that basic measures are sometimes overlooked and that an alternative approach to emphasizing the safety of farming communities is urgently needed.

• Cultivating a safety awareness will increasingly become a prerequisite for successful agricultural survival in the future.

AFRIFORUM WILL THEREFORE: • focus on the creation of contingency plans through greater empowerment of structures.

• establish more efficient proto-teams.

• make the farm assessment tool available on our website.

POSITION 2 By better equipping community safety structures, we can create the right awareness and attitude that can lead to improved security.

It is essential to realize that communities can and must protect themselves. This can be improved by the following: • Prominence granted to: • training in preventive security measures; • providing the necessary equipment and technological power multipliers (tactical capabilities) to existing and wellestablished local structures, and • membership of community safety structures such as AfriForum’s neighbourhood watches.

• Trauma support made possible by the AfriForum Trauma Unit, which will also have a volunteer structure in 2021 once the training has been completed.

• Legal support by a legal expert who can assist members should emergency action be taken. The legal expert also provides the necessary advice to members who have undertaken operational action - within the framework of the law - to protect the community.

• Farm communities need to be aware that they are capable of acting and defending themselves, especially in

the period immediately following an attack. The law provides for legitimate self-defence, and as a primary reactive measure, farming communities must organize themselves in such a way that mutual support can be provided should threats arise.

• The focus on strengthening self-security lies in the community strengthening its own power, which lies locked in cohesion within structures and with other role players. This cohesion confuses and disrupts the abilities of destabilizers and deprives them of their freedom of movement.

AFRIFORUM PLANS THE FOLLOWING: Continuation of the presentation of online training with our neighbourhood watches in the 17 modules of the curriculum in order to better prepare neighbourhood watches (for example training in legal aspects, radio handling and communication, first aid, crime scene handling, patrols, and so on).

• The scale of outreach ensures with all our neighbourhood watches.

• Establishment of a voluntary training corps (almost 100 volunteer trainers have already been trained in the northern and central regions. It will be the turn of the southern region in 2021).

• Establishment of a voluntary trauma counsellor corps (already more than 50 voluntary counsellors have been selected, who will be trained in all the regions early next year).

This implies that both the farmers and the AfriForum entities responsible for safety in communities must constantly act to support and protect communities.
