International Students Working For Safe Communities Together With The Auckland City District Police Thanks to all those who attended the last ISA meeting on Wednesday 27th May. This month we had Gary Gardner and Heeni Taane from New Zealand Immigration come and talk to a packed room about worker exploitation and temporary visas. We learned how easy it is to be exploited by employers, who try lots of different tricks to reduce the cost of hiring workers. Remember the minimum wage for everybody in New Zealand is $14.75 per hour. You, or your friends, may be scared to come forward and report that you are being exploited – perhaps because you believe you will be in trouble? But rest assured Immigration, and the Police, are interested in making sure you are safe and not exploited. So Immigration will be looking to make employers accountable and will do what they can to help you. More information and some prevention tips can be found below. We also got our Aunties and Uncles up at the end of the evening and introduced them – and we will be assigning several ISA’s to each one. We recommend you make the best use of this valuable resource as they are there to help you! Employer exploitation is a criminal act!! To help reduce crime and victimisation, if you have information about an crime or any illegal activities, you can report to the NZ Police by: · Calling 111 · Calling Crimestoppers - you don't have to reveal your identity when you call 0800 555 111 · Report online : www.crimestoppers-nz.org / www.police.govt.nz You can write in your own language and that will be translated and handed to the NZ Police. For more safety tips, please visit www.police.govt.nz Information is available in 12 languages. If you have any questions or wish to contribute to this newsletter, please contact:Jessica Phuang QSM—Asian Liaison Officer Phone : 09-302 6421 / Mobile : 021 192 0935 / jessica.phuang@police.govt.nz
IMMIGRATION & WORKER EXPLOITATION Migrant workers have the same rights as workers from New Zealand. You’re employer has to treat you fairly and it can be a crime for them to exploit workers who are migrants. The main industries that tend to exploit migrant workers include (but are not limited to): · Restaurants · Convenience Stores / superettes · Take-away restaurants (fast food) · Petrol stations · Seasonal fruit pickers Many students are afraid to report Exploitation. This can be because they may be working contrary to the conditions of their visa, or their visa may have expired. The first concern for Immigration and the New Zealand Police is to stop exploitation, and take action against employers who exploit Migrant workers. Don’t be afraid to come forward and expose it. Immigration will help you; you will not get in trouble if you report exploitation. Signs of exploitation: · Do you feel bullied, threatened or intimidated by your employer? · Is someone keeping your passport and or money without your consent? · Are there locks on your doors or windows to stop you from leaving? · Do you need to ask permission to eat, sleep or go to the bathroom? · Are you being paid too little money or none at all? The minimum wage for everybody in New Zealand is $14.75 per hour. The minimum wage is $14.75 per hour (before tax). · Are you being forced to work to pay off a debt to your employer? · Have you, or your family, been threatened with violence, jail or deportation, if you do not cooperate? That means for every 20 hours you work you should be paid $295.00 before tax. Your employer must pay the tax before you are paid, and must pay you on the day and the interval agreed in your Employment Agreement. Everyone is entitled to holidays!
Prevention Tips: 1. Do not have unrealistic expectations of work when you arrive in New Zealand. Prepare yourself properly and understand that people who promise you work cannot always deliver. 2. Undertake genuine courses – a course with recognised qualifications is much more likely to lead to work. 3. Avoid unusual dealings with an employer – if they have some complicated requests it’s probably because they are trying to circumvent the law. 4. If your employer asks you to do something you know is wrong (against the law) then don’t do it. As soon as you do it you have committed a crime, and the employer has a ‘hold’ over you. 5. Remember, no temporary visa holders can work in the sex industry. This industry is often linked to organised crime, highly likely to be exposed to exploitation, and, if you work in this industry you are very likely to be deported and lose your visa status. Remember: · Supplying false and misleading information to Immigration is a crime and you can be imprisoned for up to 7 years; or get a fine up to $100,000.00, or both! · Making false declarations to obtain residency (about your criminal history, or your identity) means when you are ‘found out’ you can still be deported. · If you are deported you will be prohibited from returning to New Zealand for two years or even permanently. There may be costs against you and New Zealand has partner countries that may refuse you a visa as well.
If in doubt be honest and ask for assistance from Immigration or NZ Police!!
