I

n addition to the disruption of their lives caused by deployment, post-traumatic stress disorders and other difficulties, many veterans in our communities face legal challenges that affect their ability to move forward. For example, a veteran who is behind on child support, but has little or no income, may have his or her driver’s license revoked, which in turn makes it difficult to work, and can lead to the loss of a job or even homelessness. Others may have criminal records that stand in the way of housing and other benefits. Additionally, many low-income or homeless veterans do not have the means to seek basic legal help, such as talking with a lawyer about an employment issue, drafting a will or a health care directive, or having a power of attorney prepared.

Partnering with the Minnesota Assistance Council for Veterans (MACV), Fredrikson & Byron has responded to these needs in two ways. The first has been to create a team of lawyers to attend a clinic at the VA Medical Center in Minneapolis every other month. Lawyers from our Oil and Gas Group meet with veterans at the VA to help with such tasks as preparing child-support modifications and criminal expungement forms. Lawyers responding to this need include: Jason Cassady, Michael Cummings, Tim Eschweiler, Ryan Heck, Jody McGinley, Jeff Serum and Marc Sugden. They are joined by lawyers Larry Berg, Clint Cutler, Sarah Gibbs, Doug Kassebaum, Ryan Murphy, Anne Radolinski, Rick Ross and Bob Whitlock, who provide employment, consumer, and real estate assistance.

7 Secondly, our Fargo office partnered with MACV, Legal Services of North Dakota, Legal Services of Northwest Minnesota and the Veterans Medical Center to hold the inaugural legal clinic for veterans in the Fargo/Moorhead area. During this event, volunteers assisted more than 40 veterans on a wide range of issues, including providing advice on employment, estate, and civil court issues. Our team prepared wills, health care directives, and power of attorney forms for nearly one third of the attendees. Volunteers included lawyers Kristy Albrecht, Jessica Foss, William Guy, Ben Hasbrouck, Amy Jenson and Katie Perleberg; paralegals MaKell Baumgartner, Christy Carrier, Andrea Jenson-Packer, Deborah Moeller, Kim Thompson and Joan Wrolstad; and administrative assistants Roz Buck, Lori Danielson and Melissa Setzer.

ENSURING JUSTICE Death is Different

10 Ed Cassidy and Jim Mayer, shareholders in Fredrikson & Byron’s Litigation Group, represent Michael Wearry, one of five young African-American men who were arrested and convicted of the kidnapping and murder of a white high school student in rural Louisiana. The arrest came two years after the murder and was based entirely on information obtained from a jailhouse informer. Our client was the only defendant given the death penalty. He was represented at trial by a public defender who performed little or no investigation, and who personally met and interviewed his client only once, for a few minutes just prior to the trial. Since beginning our post-conviction representation in 2009, we have uncovered significant evidence supporting our client’s claims of ineffective assistance of counsel. We also uncovered facts and other evidence that could have been used to support his claim of innocence at the time of his trial, but were withheld from his counsel. In July 2010, lawyers Cassidy and Mayer filed a nearly 400-page Petition for a new trial that set forth the newly discovered evidence supporting our client’s claims. In March 2012, the State District Court Judge granted our Motion for an Evidentiary Hearing on all issues raised in the Petition. The hearing started last August and for procedural reasons was continued until June 2013. Over the course of the two hearings, we called over 40 witnesses, 10 expert witnesses, and entered thousands of pages of documents. The record closed on June 20, 2013. We recently received an Order from the district court denying Michael’s request for a new trial. The case will now go on to the Louisiana Supreme Court and then on to Federal District court in Baton Rouge. Many at the firm have assisted on the case, in particular paralegal Leslie Anderson, and associates Cari Martell, Karla Reyerson and Chris Stafford. Also assisting with the case were: lawyer Steve Kaplan, paralegals Jane Ball, Becky Strand and Maureen Young; summer associates Tim Billion, Kyra Ayo Caros, Pari McGarraugh, Christopher Montana, Matthew Stortz and Sam Young; and librarians Sheri Brenden, Nancy Warren and Abby Willemssen.

11 Fredrikson & Byron has a strong commitment to provide representation to those who are not able to afford it. This assistance can be delivered directly, as in our work on behalf of Michael Wearry, or it can apply more broadly to a large group of individuals. Such is the case with a special project to assist individuals accused of capital crimes in countries outside the U.S. While our lawyers and others practicing in the United States and Europe have the benefit of significant resources developed by the American Bar Association’s Death Penalty Representation Project, many lawyers around the world, especially those in the global south, are not so fortunate.

Representing clients in countries where resources are scarce, where training is non-existent, or where this type of legal assistance is opposed by government or society, can greatly diminish a lawyer’s ability to put together a sound defense for his or her client.

More than 20 Fredrikson lawyers, law students and staff contributed to the development of a best practices manual for lawyers in these situations.

Entitled “Representing Individuals Facing the Death Penalty: A Best Practices Manual,” this work is the result of a nearly two-year collaboration between Death Penalty Worldwide (a project directed by Professor Sandra Babcock of the Center for International Human Rights [CIHR], Northwestern University School of Law), Fredrikson & Byron, the World Coalition Against the Death Penalty, practicing lawyers in at least 15 countries, and law students enrolled in Professor Babcock’s Human Rights Advocacy Clinic.

The new manual is a step-by-step guide designed to assist a legal representative through all stages of a capital case, from the moment of an individual’s arrest to their final clemency application. Because of its intended use in jurisdictions throughout the world, the manual does not address the law or standards that may apply in a particular area, but instead offers an outline of general principles and universal strategies. Written in English, the manual has been translated into French, and will be translated into Arabic and Mandarin

12 by the end of 2013. The manual was unveiled to lawyers attending the World Congress Against the Death Penalty conference in Madrid, Spain in June 2013, and will be freely distributed upon request.

n June 15, 2012, the Secretary of Homeland Security announced that people who came to the United States as children and meet several additional key guidelines may request consideration of Deferred Action for Childhood Arrivals (DACA) for a period of two years.

The consideration is subject to renewal, and, most importantly, would allow approved applicants to be eligible for work authorization. Our pro bono partner, the Immigrant Law Center of Minnesota, recruited and trained many Fredrikson & Byron volunteers to work with and process applications for eligible clients.

Christy Brusven, a lawyer in our Energy Group, assisted a young woman who entered the U.S. with her parents and sibling when she was 14, and attended middle school and high school in Minneapolis. Our client has since given birth to child with a significant medical condition.

Christy worked with the client to process and complete her application for DACA consideration, and was thrilled when the application was approved. With the approval and subsequent employment authorization, our client has now been able to find full-time work to support her daughter. She has also gained peace of mind knowing that she will be able to apply for permanent residency in the U.S., and that her daughter will be able to get the medical care she needs.

Cancer Legal Line, another Fredrikson pro bono partner, asked us to take a case referred to them by the University of Minnesota Medical Center Blood and Marrow Transplant Program. They needed help for a young woman with severe aplastic anemia who desperately needed a bone marrow transplant after her body stopped responding to non-transplant therapies. As a single mother of a rambunctious toddler, she barely had the energy to care for herself or her child. Unfortunately, her only match was her brother, who was living in Ecuador. Because he had previously applied for an immigration visa that was denied, his current non-immigrant visa application had also been denied. The only way for him to gain entry to the U.S. to help his sister was by filing a humanitarian parole application with U.S. Citizenship and Immigration Services. Despite the fact that these types of applications are not easily

granted, Ryan Johnson, and Catherine London accepted the challenge and went to work on behalf of the client. With the assistance of immigration lawyer Debra Schneider and working with Senator Franken’s office to expedite the humanitarian parole request, (which typically takes over three months for approval,) they submitted the application on April 5, 2013. The team was ecstatic to learn on May 2, 2013 that the application had been approved, opening the way for the client’s brother to travel to the U.S. to donate his bone marrow to his sister. The client was then able to begin the transplant process, and her chances of survival have increased from approximately 50% to nearly 90%. The client, along with our contacts at the University of Minnesota and Fairview Hospital, were extremely grateful for our assistance.

20 Jim Dorsey represented the foster parents of a four-year-old child in a termination of parental rights case against the child’s father, where the mother’s rights had been previously terminated. The birth parents had four other children together, but, at the time of trial, they had not had custody of any of their children for several years. Indeed, the foster parents had cared for the four-year-old since he was less than a week old. After 12 days of trial with 33 witnesses, including numerous experts in child development, parenting skills, and chemical dependency treatment, the trial court ruled that the parental rights of the father should be terminated; a decision that was upheld by the Court of Appeals after the father appealed the trial court decision. As a result of this decision, the child can stay in the only home he has ever known, and our clients can now adopt and officially welcome this child into their family. The clients expressed their feelings in an email responding to the decision:

“Hurrah! I’m in shock! After all these years, it is finally over. Thank you, thank you for your work on this. We are praising God.”

Todd Wind and Joe Cassioppi were contacted by Volunteer Lawyers Network to assist a man who had been forced out of his home in the middle of the night when his apartment building caught fire.

When he returned the next day, his landlord told him the apartment was uninhabitable, and he would need to move. Because he survives on Social Security disability benefits, does

21 not own a vehicle, and did not have the ability to move his personal items, including all of his clothing, cookware and furniture to another location, his landlord agreed to lock the apartment and hold everything until he found a new apartment. However, when he returned a short time later to retrieve his belongings, he found the apartment door open, and all of his personal items stolen or damaged. When the landlord refused to provide compensation for the loss, the tenant filed suit in conciliation court and was granted a judgment for $4,200 against the landlord. However, the landlord appealed with the assistance of his insurance company and offered the tenant a few hundred dollars to resolve the case. After contacting Volunteer Lawyers Network, the tenant was referred to Todd and Joe, who aggressively sought discovery against the landlord. Shortly thereafter, the landlord relented, and agreed to pay more than the original conciliation court judgment.

“When confronted by the daunting prospect of proceeding by himself in District Court without representation, the client may likely have been forced to settle for far less than the replacement value of his personal property, or drop his suit altogether. The difficulty of complying with court rules and scheduling orders is often beyond the capabilities of the average person who finds him or herself in a whole new world in District Court. This is a fact that does not go unnoticed by landlords and insurance companies.

Without the help of volunteer lawyers, this client may have found himself needing to start over again late in life after suffering the trauma of a fire, but without adequate funds to do so given his limited disability income. Luckily, in this case the client ultimately received a fair offer after securing the help of his pro bono lawyers, and he was finally able to move on with his life after months of litigation.� – Glen Drew, Resource Attorney, Volunteer Lawyers Network

22 Dave Marshall, Leah Janus and Haley Waller Pitts represented a mentally ill homeless woman who had lost all of her meager personal belongings after staying at a shelter that had an infestation of bed bugs. The shelter, run by a highlyrespected nonprofit, had earnestly tried to eradicate the problem, but the woman’s belongings could not be saved.

She had initiated a lawsuit in District Court demanding payment for her lost belongings, along with money for her pain and suffering. Knowing the woman was not capable of representing herself, and that, due to her mental illness, the amount of funds she was demanding was unrealistic, the Court reached out to Volunteer Lawyers Network to locate a volunteer who could assist. Dave, Leah and Haley did just that – meeting with the client, working to gain her trust so they could negotiate a realistic settlement on her behalf, and working with the shelter to ensure that the client could move forward in a dignified manner.

Steve Bergerson provided legal counsel to iTunes and Internet sensation Zach Sobiech, who at the age of 14 was diagnosed with a rare form of cancer. At age 17, and with only months to live, Zach wrote and recorded Clouds, a farewell song to his family and friends. He worked with Children’s Cancer Research Fund (CCRF) to create the Zach Sobiech Osteosarcoma Fund, and designated a significant portion of the proceeds generated by the song be contributed to his fund through CCRF. Steve, who has provided pro bono legal assistance to CCRF for more than 25 years, was asked to help draft and negotiate a music licensing agreement between CCRF, Zach and his family and Rock the Cause, a nonprofit organization that uses music to raise funds for worthy causes. Steve also assisted in drafting an agreement between

23 CCRF and The Orchard, a leading digital music distributor, and in licensing the song’s publishing rights to BMI. Between January 2013, when his music distribution began, and his passing at age 18 in May, Zach gained worldwide attention through CNN and many other news outlets. His Clouds single became the most downloaded song on iTunes, and the album of which it was also a part reached number two on the iTunes album chart. Clouds rose to the top 20 on Billboard Magazine’s Hot 100 Chart, and moved Los Angeles producer Soul Pancake to create a 20-minute tribute video, which has been viewed by over nine million people on YouTube. Proceeds from contributions, iTunes downloads and memorial gifts have raised over $550,000 for his fund, providing hope that a cure for the disease that took this talented young man will be found.

24 Tom Fraser and Erin Secord represented a mother and adult daughter who lost their home to foreclosure several years ago and had been living in hotels for more than two years. The clients filed suit in United States District Court for the District of Minnesota against a nonprofit organization that provides housing to disabled individuals. They were referred to the firm through the Federal Bar Association’s Pro Se Project, which recruits volunteer lawyers to assist low-income clients who are representing themselves in court. Our clients were making several claims under the Fair Housing Act based on the organization’s denial of their initial application in 2012. After meeting with the clients and reviewing the facts of their case, Tom and Erin determined that their primary need was permanent housing, which was not likely achievable through adversarial litigation. Instead, Tom and Erin opted to help the clients reapply for their housing. Over the course of several months, Tom and Erin counseled the clients on assembling the proper references, assisted them with submitting the application, and drafted a letter on their behalf containing the necessary supporting documents. Within a week of re-submitting their application, the family was approved for housing. Our clients were thrilled with the result.

redrikson & Byron lawyers have been working with community economic development organizations for more than 40 years, helping to build communities by working with organizations that support micro-entrepreneurs and small businesses.

On June 8, 2011, the United States Patent and Trademark Office (USPTO) officially launched the nation’s first ever Pro Bono Inventor Assistance Pilot Program in Minnesota, administered by LegalCORPS of Minneapolis.

This initiative was in response to the pronounced lack of affordable or pro bono legal services for low-income inventors. The goal of the program is to provide independent inventors and small businesses access to legal counsel for securing patents for their innovations.

Working through the program, Adonis Neblett, a shareholder and patent attorney, and Dipak Shah, a patent agent, worked with an innovator who had an idea for a unique kitchen utensil and had filed a pro se provisional patent application for her invention. The client came to the program seeking assistance with preparing and filing a much more detailed disclosure that was necessary to move her application forward. In the course of several meetings and telephone discussions, Adonis and Dipak helped educate the client about the patent process; worked with her to provide much more detailed information about her invention disclosure to better protect her product; and prepared and filed a non-provisional patent application. With the benefit of a pending application on file, the client can now actively market her product and build her business.

Lora Friedemann, a shareholder in the firm’s Intellectual Property Litigation Group, saw a newspaper article about Minnesota companies victimized by “trademark bullies,” and was compelled to offer to assist one of these companies, Bubbles by Brooks, free of charge.

The company sells handcrafted soaps that are designed to reduce skin irritation for cancer patients as they

29 go through therapy. The soaps are made by the founder and proprietor, a cancer survivor herself. Bubbles by Brooks faced an aggressive trademark opposition by high-end clothier Brooks Brothers. It is often very difficult for businesses to figure out whether or not they should put up a fight against big brands, and many businesses change their name and face a loss of name-recognition, rather than endure a costly legal battle. After nearly a year, Brooks Brothers of New York City dismissed its case against Bubbles

onprofit organizations can often times be instrumental in providing services that keep our communities safe, strong and vibrant. Whether it is a nonprofit that works to provide housing or job-training services to low-income individuals, one that provides legal assistance to veterans or an organization that supports the local art and theatre community, our communities and lives are richer for them. Fredrikson lawyers provide invaluable pro bono assistance in the communities where they work and live. By giving of their time and talent, these volunteers help ensure that our communities continue to be strong and healthy and able to attract a diverse population.

Neighborhood Development Center (NDC) works to train low-income entrepreneurs through its business development classes. Many of these businesses are located in the Mercado Central or the Midtown Global Market, two projects developed in part by NDC. This past year Brian McCool and Jeff Serum assisted NDC on lease issues, while Paul Thomas assisted the organization on a copyright matter for its curriculum. Leigh-Erin Irons serves on the board of directors.

Voyageurs National Park is considered by many as a symbol of the natural beauty of Minnesota. The Voyageurs National Park Association is an organization whose mission is to help preserve and support the park. Ann Ladd, a former board member, Bob Boisvert and Larry Berg assisted the Association with employment and real estate issues this past year. Lindsey Hemsley currently serves on the board of directors.

West Side Community Health Services is the largest community clinic organization in Minnesota, with multiple locations in the metro area. They provide multicultural and multilingual health care services and education to immigrant and low-income communities. This past year, Ingrid Culp, Norah Olson Bluvshtein and Lindsay Sokolowski provided employment-related services to the organization.

Liz Dunshee volunteered to assist ColliDe Theater Dance Company with its entity formation and tax exempt filing status. This new theater company brings artists, musicians and others together to perform original Broadwaystyle theatrical works throughout the Twin Cities.

33 The Anne Carlsen Center supports individuals with disabilities and their families throughout North Dakota. Kristy Albrecht, Brent Haase, Katie Ilten, and Nola McNeally provided assistance to this Fargo-based nonprofit this past year.

Kim Lowe and Sara Reisdorf responded to a request from Catholic Pastoral Committee on Sexual Minorities/ Catholics for Marriage Equality (CPCSM/C4ME) regarding lobbying issues related to its tax-exempt status.

Working with students from Hamline Law School’s small business and nonprofit clinic, Kim and Sara researched the issues extensively and provided detailed legal memos addressing the concerns of CPCSM/C4ME. The lawyers and students came up with a simple solution to a complex reporting problem, and CPCSM/C4ME is now able to continue to carry out its mission with fewer worries about losing its exempt-status. Kim and Sara continue to meet with the board of CPCSM/C4ME to help them structure their future activities. The entire board of directors sent each lawyer a letter, stating in part:

A COMMITMENT TO COMMUNITY It Really Can Take A Village

redrikson & Byron is committed to serving the communities in which we work and live. We do this in many ways – through the donation of pro bono time, through time serving on boards of nonprofit organizations, and through the granting of funds to nonprofits through the Fredrikson Foundation. In many instances, organizations benefit from the coordination of all three, as in the following: Children’s Law Center of Minnesota (CLC) provides legal representation to children who are either wards of the state – “legal orphans” – or have been removed from their homes because they are in need of protection.

Since 1995, CLC has trained more than 300 volunteer lawyers who have represented more than 1,300 foster children, ages 13 to 18, in the Hennepin or Ramsey County foster care system. Volunteer lawyers play a critical role before, during and after court proceedings. The volunteers work with and listen to their young clients to build a relationship of trust, to understand their wants and needs, and to help them understand the procedures and what they mean to their future.

Many lawyers, including Joe Cassioppi, Jeremy Duehr, Emily Duke, Jessica Edwards, Tom Fraser, Kent Harbison, Lindsey Hemly, Jennifer Kitchak, Sara Reisdorf, Joe Schauer and Asmah Tareen currently represent children through this important project. Fredrikson & Byron also supports CLC through direct donations from the Fredrikson Foundation; Cindy Moyer currently serves on CLC’s Board of Directors; and Loan Huynh, Katherine Ilten, Richard Kyle, and Kim Lowe provide direct legal support to the organization itself. For the past number of years, Robert Nelson and Boyd Savage have provided information technology support.

Finally, this past year, when CLC was in need of temporary offices while their own offices were being renovated, Fredrikson provided needed space and technology support for the organization.

Immigrant Law Center Fredrikson & Byron was honored as Pro Bono Law Firm of the Year by the Immigrant Law Center of Minnesota (ILCM) at their annual gala in April. The ILCM is an organization that provides quality immigration legal services, law-related education, and advocacy to meet the steadily increasing needs of Minnesota’s immigrant and refugee communities. Debra Schneider is a member of the board of directors and provides pro bono legal services to many of the ILCM’s clients. North Dakota Association of Nonprofit Organizations William Pearce, a member of Fredrikson & Byron’s Corporate and Energy Groups in Bismarck, was presented with the Walt Odegaard Leadership Award by the North Dakota Association of Nonprofit Organizations. The annual award is given to a person with a long-term commitment to leadership, volunteerism and philanthropy. Only those with more than 15 years of leadership experience are eligible for this prestigious award.

Children’s Cancer Research Fund Steve Bergerson received Children’s Cancer Research Fund’s Volunteer of the Year Award in recognition of his 25 years of pro bono service to the organization. The Butterfly Award, named after the organization’s butterfly logo, is given to volunteers who have shown exceptional interest in and enthusiasm toward CCRF’s mission, events, and programs. Steve’s work has included registering the organization’s many trademarks, enforcing its trademarks rights and assisting with various fundraising agreements, licenses and promotions. Steve has also served on the board of directors, and is currently an emeritus member.

The Associate Volunteer of the Year Fredrikson & Byron is home to many talented lawyers who are dedicated to the profession of law and to helping those less fortunate. Many give up their work and personal time to take a case or support a cause that is particularly compelling to them. Fredrikson proudly recognizes associates who have exhibited a commitment to providing legal services for low-income individuals.

Doug Kassebaum, a senior associate in Fredrikson’s Bankruptcy Group, has been a steadfast and dedicated pro bono volunteer by consistently billing 50 or more hours to pro bono work since he began his legal career in 2007. Doug takes client calls through the Volunteer Lawyers Network (VLN) intake line where he screens potential clients for bankruptcy proceedings. He also takes a number of bankruptcy cases each year, helping individuals navigate through the complex bankruptcy proceedings. Additionally, Doug has been an invaluable mentor to pro bono interns by taking bankruptcy cases and working with law students to give them hands-on experience. By taking these cases (many of which continue long past the time the interns leave), Doug increases the number of cases that Fredrikson takes through VLN. This past year, he worked with a newer associate to mentor her in Chapter 7 bankruptcies, and volunteered to supervise a summer associate who expressed an interest in bankruptcy work. Doug has also shown an unwavering commitment to serving veterans. He has been an annual volunteer at StandDown Minnesota, a day-long clinic for homeless veterans where he gives advice on credit and bankruptcy issues, and has signed up to attend our new clinic for homeless and low-income veterans at the VA Medical Hospital.

Friends of Fredrikson Program Friends of Fredrikson is a stand-alone nonprofit that was initiated, developed, and is run by employees of Fredrikson & Byron. Its mission is to foster and promote educational assistance to disadvantaged children and their families in public schools. The nonprofit actively and conscientiously focuses on supporting families and children in the Minneapolis public school system with economic and educational assistance. For more than 15 years Friends has collected, purchased, and delivered school supplies to St. Joseph’s Home for Children. During the holiday season, Friends provided gifts to poor families, ‘adopting’ families through Catholic Charities in which parents, although typically employed, would not otherwise be able to provide gifts for their families. The requests continue to startle us in their simplicity – a pair of socks, a comforter, jackets, and blankets to name a few. We also provided a carload of gifts to Jewish Family and Children’s Service to be distributed to low-income shut-ins.

All Friends’ activity is supported by employees who believe that the community is made significantly better when we are all involved in giving back, and would not have been possible without the very generous donations of cash, gifts, and time contributed by so many of our staff and lawyers. Excerpts from thank you cards received from holiday season recipients are below:

Community Service Fredrikson & Byron has a long history of encouraging community service by all of its employees. Many of our employees, both lawyers and staff, share this commitment to providing volunteer services to their communities.

These services, while too numerous to list, include such things as tutoring students in math, reading, and comprehension; serving on local community boards; fundraising for charitable events; and bringing the arts to children.

Fredrikson also supports this commitment by giving each employee paid time off to volunteer for firm-sponsored community service programs through Project for Pride in Living, Sharing & Caring Hands, and tutoring at Whittier International School.

This past year, members of our Fargo office provided the YWCA’s Unique Boutique with holiday gifts and cash for women and children living at the shelter.

The Minnesota Keystone Program The Minnesota Keystone Program identifies, encourages, and recognizes Minnesota companies that help enhance Minnesota’s quality of life by contributing two percent or five percent of pre-tax earnings in the form of time, money, or in-kind services. A proud participant since 1989, Fredrikson & Byron has been a contributor at the five percent level for the past several years, and was honored to receive the Keystone Award for mid-sized companies in 2010.

Fredrikson & Byron Minority Scholarship For more than 20 years, the Fredrikson & Byron Foundation has awarded a $10,000 scholarship as one way to affirm its commitment to promoting diversity among incoming law professionals. This scholarship program promotes the legal training of minority lawyers and encourages them to join and excel in the private practice of law with major law firms.
