Five Farms | Forage Release T&Cs | Prosperity

Five Farms – Prosperity Forage Release Request to Purchase Terms and Conditions To be eligible to purchase in the Prosperity Forage Release you must agree to the terms and conditions of the Request to Purchase Tool. External agents are excluded from purchasing in this release.

1. These terms and conditions govern your use of the Frasers Property Australia Request to Purchase Tool for registration of your interest in purchasing a property at Five Farms during the Prosperity Forage Release (“Request to Purchase Tool”). By using the Request to Purchase Page, you agree to comply with these terms and conditions.

2. For any Family Members of Prosperity members wishing to gain access to this release under the Family Share program, there are criteria that need to be satisfied to qualify for this benefit. Firstly, a referral form must be submitted by Friday 14th January 2022. This can be done here www.frasersproperty.com.au/familyshare. Secondly, sufficient certified documents to prove the relationship between the Family Member and Prosperity member, will need to be supplied by Monday 17th January 2022. Thirdly, the referral must be approved by our internal team in line with the Prosperity Terms and Conditions, which can be accessed here www.frasersproperty.com.au/Prosperity/Terms.

Family Members will be notified of their eligibility on or prior to Thursday 20th January 2022.

3. On Monday 24th January 2022, all registered Prosperity members and eligible referred Family Members will receive an email with a link to the online 'Request to Purchase' page.

4. Request to Purchase in the Prosperity Forage Release opens at 11am (AEDT) on Monday 24th January (AEDT) and closes at 12pm (AEDT) on Monday 24th January (Request to Purchase Period). During the Request to Purchase Period, you may use the Request to Purchase Tool to register your interest in purchasing a property at Five Farms (“Request to Purchase”). If you have not registered by the 12pm (AEDT) close time you will not be eligible to participate in the Prosperity Forage Release.

5. If you are successful in requesting to purchase a property in the Release, you will receive an email from Frasers Property Australia confirming your Request and reference number.

6. Following the Request to Purchase Period, you will be contacted by the Five Farms Sales Team via telephone on Tuesday 24th after the Request to Purchase Period has closed. You will be contacted in order of priority, based on the time of receipt of your Registration by the Request to Purchase page form.

7. When you are contacted by Five Farms Sales Team, you may be provided with an opportunity to purchase a property at the Prosperity Forage Release (Property).

8. If following the Request to Purchase Period, the Five Farms Sales Team is unable to contact you on your nominated telephone number, we will endeavour to leave you a voicemail or SMS, however you will lose your Registration priority and the Five Farms Sales Team will contact the next Registered Purchaser.

The Five Farms Sales Team will endeavour to contact you on your nominated telephone number a second time. Once you return a call to the Five Farms Sales Team, you will resume priority ahead of the remaining Registered Purchasers who have not yet been contacted. If the Five Farms Sales Team is unable to contact you by telephone after the second attempt and you do not contact the Five Farms Sales team before we finish contacting all Registered Purchasers, Frasers Property Australia reserve the right to forfeit your Registration and any opportunity to purchase a Property during the Prosperity Forage Release at Five Farms.

9. A holding deposit of $1,000 via Electronic Funds Transfer (EFT) will be required on the release day along. You will be required to sign a Contract of Sale by DocuSign and pay the balance of the 10% within 7 days.

10. You acknowledge that Registration does not give you a legal right or guarantee to purchase a Property, including during the Prosperity Premiere Release at Five Farms. There may be more people registering using the Request to Purchase page than there are Properties available for purchase. You agree not to make a claim against Frasers Property Australia if you are not able to purchase a Property, or you are impaired from purchasing a Property, for any reason, including the negligence or error of Frasers Property Australia.

11. You may be prevented, delayed, or impaired from using the Request to Purchase Tool for a number of reasons, including due to infrastructure failures like internet or telecommunication outages, or impairment or failure of the Request to Purchase Tool (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree not to make a claim against Frasers Property Australia if you are unable to use the Request to Purchase Tool, or if you are provided a less favourable Registration preference, due to any of the problems set out in this paragraph, irrespective of who is responsible.

12. By submitting this form, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a Property and to promote its products and services. Frasers Property Australia agrees to comply with its privacy policy in its collection of personal information, which can be viewed here https://www.frasersproperty.com.au/privacy 13. These terms and conditions are governed by the laws in force in Victoria. Reference to Frasers Property Australia means Frasers Property AHL Pty Ltd ACN 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)) and includes its officers, employees, contractors or agents.

14. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract takes precedence over these terms and conditions.
