Five Farms | Jersey Release T&Cs

Five Farms – Jersey Release Request to Purchase Terms and Conditions The Jersey Release at Five Farms will be held on Saturday 4th December 2021 and sales meetings will be held by appointment only. To be eligible to purchase in the Jersey Release you must agree to the terms and conditions of the Request to Purchase Tool.

1. These terms and conditions govern your use of the Frasers Property Australia Request to Purchase Tool for your expression of interest in purchasing a property at Five Farms during the Jersey Release (“Request to Purchase Tool”). By using the Request to Purchase Tool, you agree to comply with these terms and conditions.

2. Ensure you are a subscribed member of Five Farms prior to 5pm (AEDT) Tuesday 30th November to receive the ‘Request to Purchase’ page link on Wednesday 1st December.

3. Select your preferred property (due to high demand it is recommended that you have multiple preferences). We suggest a minimum of three preferences. However, please note only property is available to purchase per household on release day.

4. On Monday 29th November 2021, all subscribed members will receive an email with a link to the online 'Request to Purchase' page.

5. Request to Purchase in the Jersey Release opens at 11am (AEDT) on Wednesday 1st December (AEDT) and closes at 12pm (AEDT) on Wednesday 1st December. (Request to Purchase Period). During the Request to Purchase Period, you may use the Request to Purchase Tool to register your interest in purchasing a property at Five Farms (“Request to Purchase”).

6. If you are successful in requesting to purchase a property in the Release, you will receive a call from Frasers Property Australia confirming your Request. There will be a maximum of 30 sales appointments for the Jersey Release.

7. Following the Request to Purchase Period, the first 30 registrations will be contacted by the Five Farms Sales Team via telephone on Wednesday 1st December after the Request to Purchase Period closing. You will be contacted in order of priority, based on the time of receipt of your Registration by the Request to Purchase page form.

8. Expressions of interest unsuccessful in securing a sales appointment for the Jersey Release will be notified by email on Wednesday 1st December.

9. If following the Request to Purchase Period, the Five Farms Sales Team is unable to contact you on your nominated telephone number, we will endeavour to leave you a voicemail or SMS, however you will lose your Registration priority and the Five Farms Sales Team will contact the next Registered Purchaser. The Five Farms Sales Team will endeavour to contact you on your nominated telephone number a second time. Once you return a call to the Five Farms Sales Team, you will resume priority ahead of the remaining Registered Purchasers who have not yet been contacted. If the Five Farms Sales Team is unable to contact you by telephone after the second attempt and you do not contact the Five Farms Sales team before we finish contacting all Registered Purchasers, Frasers Property Australia reserve the right to forfeit your Registration and any opportunity to purchase a Property during the Jersey Release at Five Farms.

10. On Saturday 4th December, appointments are for 20 minutes, and you will be required to select your preferred property.

11. A holding deposit of $1,000 via Electronic Funds Transfer (EFT) will be required on the release day. You will be required to sign a Contract of Sale by DocuSign and pay the balance of the 10% deposit within 7 days.

12. You acknowledge that Registration does not give you a legal right or guarantee to purchase a Property, including during the Premier Release at Five Farms. There may be more people registering using the Request to Purchase page than there are Properties available for purchase. You agree not to make a claim against Frasers Property Australia if you are not able to purchase a Property, or you are impaired from purchasing a Property, for any reason, including the negligence or error of Frasers Property Australia.

13. You may be prevented, delayed, or impaired from using the Request to Purchase Tool for several reasons, including due to infrastructure failures like internet or telecommunication outages, or impairment or failure of the Request to Purchase Tool (including due to technical breakdown) or impairment or failure of your equipment, including due to viruses, hacking or other technical issues. You agree not to make a claim against Frasers Property Australia if you are unable to use the Request to Purchase Tool, or if you are provided a less favourable Registration preference, due to any of the problems set out in this paragraph, irrespective of who is responsible.

14. By submitting this form, you agree that Frasers Property Australia can use your personal information to offer you the opportunity to purchase a Property and to promote its products and services. Frasers Property Australia agrees to comply with its privacy policy in its collection of personal information, which can be viewed here https://www.frasersproperty.com.au/privacy 15. These terms and conditions are governed by the laws in force in Victoria. Reference to Frasers Property Australia means Frasers Property AHL Pty Ltd ACN 008 443 696, its related bodies corporate (as defined under the Corporations Act 2001 (Cth)) and includes its officers, employees, contractors, or agents.

16. If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, such provision is deemed to be struck out and will not affect the validity and enforceability of the remaining provisions. All information contained within the Contract takes precedence over these terms and conditions.
