Static As the coronavirus crisis was ramping up in mid-March, John Tepper remembered watching the news from his Carrollton home and wondering how hospitals were going to handle sanitizing hundreds of masks per day. The entrepreneur and medical device development consultant knew that the highly infectious COVID-19 was going to force medical workers to burn through personal protective equipment (PPE) at unprecedented levels.

“The news was already talking about the shortage of PPE, especially with masks,” Tepper recalled.

Tepper had just finished developing a device that decontaminates dermatological instruments. Surely, he thought, someone is working on something similar that can use UltraViolet Germicidal Radiation (UVGI) to decontaminate and sanitize masks. Tepper realized that what hospitals, cities, and other groups really needed was a portable, easy-to-use device that could kill pathogens on N95 respirators (the mask of choice for many medical professionals) and other medical masks.

He bounced the idea off his friend and frequent business partner Ab DeWeese, who is also a physicist. When an online search found that no such products existed, DeWeese and Tepper brought on two additional business partners, Tim Hissam and Rusty Rose, and formed Hepius Equipment. The team worked quickly to develop a prototype that was the size of a small office printer.

DeWeese and Tepper have extensive experience in developing and testing medical devices. After our online meeting, DeWeese sent me a slew of links from the Centers for Disease Control and Prevention (CDC), National Institutes of Health, and scholarly journals that basically described UVGI’s singular effectiveness at obliterating the RNA that allows the novel coronavirus to wreak havoc in the bodies of hosts.

studios and massage parlors necessitate more physical contact than bars, yet bars were put in the same category as them when referring to their reopening.

She said, “I was so curious, in fact, I sent a request to the governor’s office and asked for them to help explain it to me.”

She received the automated response: “Your request for assistance will be reviewed by the appropriate staff member.”

Little-Adams added, “Nothing really to be done except wait.”

Morgan Roberts was also disappointed that bars were not included in Phase 2. “It seems a little unfair that the bars haven’t been given the go-ahead to open up,” said the owner of The Local in Crockett Row, “while almost every other business has gotten the green light. I don’t see much difference in being able to grab a drink at a restaurant bar opposed to an establishment that just serves” drinks.

The initial N9500 order was delivered to Parkland last week, Tepper said. The N9500 has a minimum setting of one minute of UVGI radiation emission. The device is powered by a standard electric cord.

“Hepius equipment worked with our Infectious Disease team at Parkland Hospital,” Parkland said in a statement. “The N9500 met our rigorous requirements on the first try. Parkland Hospital loves the N9500.”

DeWeese and his team work with potential clients, often in consultation with the purchasing group’s medical director, to decide what the ideal setting should be.

For Parkland’s purposes, seven minutes of UVGI radiation emission was ideal, Tepper said.

Some large hospitals may have centralized decontamination capability, but those dedicated operations are labor-intensive, and many nurses and doctors would prefer to know that their personal mask is returned and not accidentally switched with someone else’s, DeWeese said.

The barely month-old business is in talks with Fort Worth economic developer Robert Sturns, DeWeese added. Mobile testing sites, police stations, fire stations, Tarrant County Jail, and Fort Worth hospitals are all potential clients for the $8,599 device.

Through a succession of executive orders issued by Gov. Greg Abbott, Texans are in the process of reopening businesses and public spaces. Reopening stores and offices will mean providing masks to employees who may have little to no knowledge on how to properly handle the PPE, DeWeese said.

“As we launch in the great reopening, hopefully, we don’t have to do it a second time” if people are properly using masks and other PPE, DeWeese said.

Tepper said that Hepius Equipment is just one of the thousands or possibly tens of thousands of small businesses in the United States that have thrown all of their resources into tackling a specific problem posed by the novel coronavirus.

“Most of us have been part of large companies,” Tepper said. “They have a lot of resources, but they also have

“They’ve put together a 10-point plan for us to follow, so we’re hoping to get news from them,” he said.

Glen Keely, co-owner of Poag Mahone’s Irish Pub in the West 7th corridor and Thompson’s Bookstore downtown, doesn’t understand why churches can place mass amounts of people under one roof, yet he can’t have 20 people in a bar to have a couple beers.

“We have the same protocols as restaurants,” Keely said, “so [the coronavirus] wouldn’t spread any more differently than it would in any of the other businesses. I’m not a scientist, though, so I can’t judge. We can only do what’s in our power.”

Keely took the governor’s plan for restaurants and applied it to his operations.

Starting May 18, office buildings, nonessential manufacturers, and gyms can reopen with 25% occupancy, under the condition that employees must avoid congregating and maintain social distancing. we did to stay within being right with the food and health department,” Keely said.

“They were normal business practices, and we can ramp that up and do more. We gave point-by-point examples on how we can do that, and we were met with the generic response from a strike force team that they got our email, thanks.”

There was no answer when Keely called the governor’s office.

Another problem Keely sees is that while restaurants can sell alcohol to go, he — and other bar-bar owners — still cannot.

“As far as the to-go [alcohol] … we can buy pre-manufactured food to sell along with our booze so that we could get out some of the inventory that we’re sitting on,” Keely said, “but [the state is] not even giving us the opportunity to save ourselves with that factor. They’re just completely freezing us out.”

Keely said that he can’t speak for others, but he is upset with Abbott’s decision and disappointed. “It is what it is,” Keely said. “At this point, we just have to keep playing their game.”

Managing partner at the upscale Near Southside cocktail lounge The Usual, Jason Pollard doesn’t believe there was any “malice” in Abbott not allowing bars to reopen as part of Phase 2. Pollard just thinks bar-bars are an afterthought to state leaders.

“We’re just not at the table,” Pollard said. “There are very large restaurant groups, but bar-bars tend to be independently owned neighborhood spots, so our voices aren’t being heard. Whether that’s to-go cocktails or when to reopen.”

Pollard has signed petitions and contacted both the governor’s and the comptroller’s offices. He believes that one of the things the comptroller could have done to “get out ahead of this” was defer the tax payments from February’s sales that were due three days after bars were told to shut down.

“For most bars,” Pollard said, “that tax payment is one of, if not the biggest line item on their budget every month, and the way that most bars are set up is that the sales in March pay for the taxes from February. And the people I talked to weren’t asking for total forgiveness but simply to push [tax payments] back until we could have revenue coming in again.

“I’ve seen a few people with some good ideas,” Pollard added, “but no one has been able to get any real traction or attention.”

Pollard said he has been racking his brain trying to figure out what a bar is going to look like when they do reopen.

“I know that all of us are looking at how to be as safe as possible, but what does that really look like?” he asked. “I think that the virus is going to spread in areas where people are not taking precautions, and that can be anywhere.”

Until Abbott releases the next phase of his plan to reopen Texas, bars are left waiting in the dark, in need of reopening their doors for business. Calls to the governor’s office and the state health department were not returned by press time. l

We’ve been giving out our private information to be able to use convenient, fun, and largely free apps, and we’re only now understanding the true costs.

Would you mind if an app that you specifically told not to use your location tracked your real-time movements anyway by pinging off nearby Bluetooth and Wi-Fi signals? What if the mobile therapy app you use for counseling told Facebook whenever you’re in a session and, without using your name, told an advertising firm the last time you felt suicidal?

Or, what if there was a global pandemic and a company you’d never heard of revealed a map of cell phone locations showing that you hadn’t been doing your part to stay away from others and slow the spread of the deadly virus? Could that become enforceable?

Could you be fined? Publicly shamed?

While most Americans say they’re concerned about how companies and the government use their data, Pew Research shows they also largely feel they have little to no control over the data that companies and the government collect about them.

Tech companies often defend data collection, noting they remove users’ names to “depersonalize” the information, but privacy experts say that’s pretty much bullshit: Location data without a name can easily be pinned to an individual when you see that pin travel between a workplace and a home address. And even if your internet activity is shared under a unique number instead of your name, the goal is to intimately understand exactly who you are, what you like, and what you’ll pay for.

The good news is, privacy advocates say that we can avoid a dystopian future in which nothing is private. But to get there will take understanding the many ways that data and technology are already used to violate privacy and civil rights. Lawmakers also will need willpower to pass strong legislation that ensures actual consent to how our information is used and penalties for those who abuse our trust. People also need to decide if the risks outweigh the perks.

“People don’t like it — they don’t like being known unless they’ve asked to be known,” said Jennifer King, director of privacy at Stanford University’s Center on Internet and Society. “Companies are banking on the fact that if they keep pushing us toward that world, we’ll just say, ‘Yeah, it is really convenient.’ ” First of All, We’re Being Tracked At this point in the digital age, many Americans realize they’re being tracked in one way or another, whether by companies or governments, even if they don’t know just how detailed that tracking is.

Seven years ago, whistleblower Edward Snowden revealed that the United States doesn’t just spy on the rest of the world.

The federal government also tracks its own citizens through the National Security Agency, which maps cell phone locations, reads people’s emails, and monitors internet activities.

Then, about two years ago, former employees of tech company Cambridge Analytica revealed to lawmakers in the United States how they used Facebook surveys to secure thousands of data points about every American voter. Even voters who hadn’t signed up for the personality tests were captured in the scraped data, which was used to create highly targeted ads for “persuadable” voters to help Donald Trump’s 2016 presidential campaign. The company focused specifically on flipping persuadable voters in certain precincts, which then helped flip a few key states in his favor, as detailed in the documentary The Great Hack.

Is Privacy Dead?

Now, as contact-tracing efforts are becoming widespread for COVID-19, the world has received its latest reminder that many companies far less recognizable than Google, Apple, Amazon, Facebook, or Microsoft are purchasing and using our location data all the time.

With much of the world sheltering in place for weeks to slow the spread of the deadly virus, people quickly turned their attention to places that weren’t taking aggressive measures. Florida, for instance, was playing host to spring break partiers in mid-March, and dozens who traveled to the beaches there later tested positive for COVID-19.

The extent of how those travelers could have spread the virus was shown in late March, when location data and mapping companies Tectonix GEO and X-Mode Social created a visualization showing how thousands of phone users who spent time on a single Florida beach traveled across much of the United States over the next two weeks.

Public reaction was mixed. Some found the map to be a helpful tool to show how easy it is for the virus to spread, underlining the importance of social-distancing measures.

Others questioned how the companies obtained the data and called it terrifying.

The companies had received consent, they replied, noting that they comply with strict data protection policies in California and Europe, but many people don’t realize that when they allow an app to use their location for the service it provides, companies can also sell that location information to third parties who use it in “anonymized” applications like the kind that enabled the mapping.

“We definitely understand the concern, but we take every effort to ensure privacy in the data we use,” Tectonix GEO responded to one Twitter user. “All device data is anonymized, and we only work with partners who share our commitment to privacy and security above all! It’s about using data to progress, not to invade!”

But users pointed out that if you can see all the stops a phone makes over the course of two weeks, it’s not truly anonymous.

Contact Tracing: Coming to a Phone Near You To help public health officials start to reopen the economy, Google and Apple have both announced plans to create opt-in contacttracing tools for Android and iPhone.

The tracing tools would use your phone’s Bluetooth signal to ping off the devices of the people you’re around at coffee shops, grocery stores, and other public spaces. Strangers’ phones would store a number that your phone sends via Bluetooth, and your phone would store the number from their phone.

The numbers, which could be generated and changed by phones regularly, would not be shared with the tech companies but stored in individuals’ phones for a few weeks.

If someone tests positive for COVID-19, they could send an alert from their phone that would ping phones that gathered their signal over the past two weeks to let people know they may have come in contact with someone who tested positive.

Without that type of tool and more extensive testing, experts warn that the only other way to prevent deaths from spiking again until there is a vaccine is to extend the stay-at-home orders that plunged more than 22 million Americans into unemployment in March and April.

While the tool could allow more people to return to their routines, the American Civil Liberties Union (ACLU) warns that cell phone location data aren’t perfect and if they were used to enforce quarantines for those who have come into contact with the virus, phones would essentially be turned into ankle monitors.

“The challenges posed by COVID-19 are extraordinary, and we should consider with an open mind any and all measures that might help contain the virus consistent with our fundamental principles,” the ACLU said in a statement in response to the proposals.

“At the same time, location data contains an enormously invasive and personal set of information about each of us, with the potential to reveal such things as people’s social, sexual, religious, and political associations. The potential for invasions of privacy, abuse, and stigmatization is enormous.”

Mobile Healthcare Currently, the United States lacks comprehensive legislation to protect the vast amounts of personal data created on our devices every day, from the type of pictures you like to the number of steps you walk.

A patchwork of federal privacy protections outlines rules for things like sharing healthcare data, banking information, and credit reports and for collecting information on children under 13. Plus, the Federal Trade Commission enforces consumer protection cases against companies using unfair or deceptive practices.

“But we don’t have what we think of as a comprehensive law, just a baseline law, that would apply to personal data, who collects it and why they collect it,” said Stacey Gray, senior counsel with the Future of Privacy Forum, a nonpartisan think tank that provides information on commercial privacy issues for policymakers.

For example, while healthcare information collected by your doctor and other healthcare professionals is protected

by HIPAA (the Health Insurance Portability and Accountability Act), the law doesn’t apply to many technologies you may use to track your health.

“People are realizing the same or similar information can be collected from your Apple Watch and other devices, which can see your health or mental state — that is not protected

by HIPAA because it is not collected from a healthcare professional,” Gray said. “There

are mobile apps that will let you track your pregnancy, your period, dieting.”

In 2019, advocacy group Privacy International published a report on periodtracker apps Mia Fem and Maya, showing that the apps were sharing information with Facebook and third parties. They shared things like whether users were keeping track of their menstruation or fertility, when they last had sex, whether they drank caffeine or alcohol, and when they last masturbated.

Even users without a Facebook account had their data shared with the tech giant, the report found.

Similarly, Jezebel reported in February that the therapy app Better Help, which is heavily advertised on Facebook and offers therapy sessions with licensed healthcare professionals, tells Facebook when users are in the app, effectively sharing when they’re in therapy sessions. The app passed along users’ intake forms by assigning them a number instead of a name — a method that’s approved by HIPAA, Jezebel notes — giving a research and analytics firm called MixPanel intimate detail on a user’s self-reported sexuality, beliefs, and mental health.

“MixPanel is the kind of startup that’s omnipresent yet mostly invisible to people who don’t work in tech; it’s used by everyone from Uber and Airbnb to BMW,” Jezebel reports. “Its basic concession is producing monetizable data out of literally any human behavior: By tracking and cataloguing people’s habits and desires, the theory goes, companies can figure out how to best

encourage their users to open an app again and again.”

The implications of health informationsharing could go far beyond the apparent desire to target highly personalized ads.

Employer health plans continue to evolve, with some offering health-tracking apps for employees, with the promise of a discount on their insurance for using the tools. However, privacy advocates warn that insurance companies could eventually charge you more based on your health behaviors, and your employer could see health details like when you’re trying to become pregnant or whether you struggle with certain health conditions.

Is My Phone Listening to Me? Many people who use social media have had the experience of opening an app and seeing an ad for something they were just talking about with their friends, followed by the odd feeling that your phone has been listening to you.

“People are convinced their microphones are being used or pictures being taken, but by and large those things generally aren’t happening,” explained Serge Engelman, the chief technology officer for App Census, a company that tests apps to see what information they collect, how they collect it, and who they share it with.

Engelman, who also directs the International Computer Science Institute research lab at the University of California, Berkeley, said that, truly, advertisers know just enough about you to direct relevant ads your way.

“It’s profiling,” he said, “mostly by persistent identifiers.”

A persistent identifier is a unique number that can be tied directly to your device, such as a number tied to your SIM card, and another known as the IMEI, or the International Mobile Equipment Identity.

You can think of that like a license plate for your phone, he said.

“By itself, the license plate number is a pretty meaningless piece of information, but if you start recording every place you see it, you can learn a lot about the user’s activities and preferences,” Engelman said. “That’s all made possible by linking that number to the user’s actions and activities. It’s the same way a cookie works.”

But unlike cookies, which similarly track your internet browsing but can be cleared from your browser history, there wasn’t an equivalent option to clear history for mobile phones until about 2013, he said. Now, Google and Apple allow users to reset their advertising ID, but if that is still collected alongside a persistent identifier like the IMEI, companies can still track your behaviors across platforms.

Through App Census, Engelman and other researchers have used Android phones to test tens of thousands of apps. What they found is that even after the changes meant to allow users to reset their temporary IDs, most apps were still sending the persistent identifiers with information they collected.

“The problem is, from the consumer standpoint, there’s no way of knowing

Are Privacy Policies Enough?

So how could people be more protected? The 2018 General Data Protection Regulation, or GDPR, in Europe requires that companies allow people to opt out of having their data shared and that companies have a legal basis for collecting information, but broad language in privacy policies often covers types of data sharing that users can’t fully comprehend, experts say.

“In the consumer area, broadly there are, like, zero restrictions there,” said King, the privacy expert at Stanford’s Center for Internet and Society. “I can track you across multiple platforms, I can track your data and sell it, as long as I tell you in the policy, which people don’t read and is not written to be read.”

The majority of Americans (79%) say they’re concerned about how companies use their data, yet the same Pew Research Center data from late 2019 showed that only about one in five Americans usually read through the privacy policies that grant companies broad use of their data.

King said she’s often asked what individuals can do to protect their privacy, but there’s very little you can do as one person to protect yourself against the biggest threats.

“It’ll probably require industry-level solutions or legislated solutions, as opposed to flipping some knobs on your cell phone,” she said. “That’s the fundamental problem.”

Plus, for users to opt out, they need to know the companies that have their data, Engelman said.

when this is happening and when it’s not,” Engelman said. “The average user is not writing their own version of Android to analyze what data is being sent.”

Companies typically defend this type of data collection — using advertising IDs or persistent identifiers — as they claim that the number “de-identifies” the information from a user’s name and therefore protects his or her privacy.

“That’s utter bullshit,” Engelman said.

“They collect these explicitly so they can augment information about you over time.

They’re using it explicitly to identify you.”

You, the single thirtysomething woman who often buys shoes and cat litter. You, the fortysomething married man who wants a riding lawn mower. You, the 60-year-old retiree with an open line of credit at a midlevel retail store who collects Coca-Cola memorabilia.

Entire companies are devoted to tying your depersonalized data with identifying information that can be found elsewhere, which many people don’t realize, Engelman said.

“The problem is, most regulatory agencies, at least in this country, are complaint-based,” Engelman said. “They rely on consumer complaints. How can you open an investigation based on consumer complaints when consumers don’t even know what’s happening?”

“The dirty secret for that is the companies themselves don’t know who they’re sharing the data with,” he said.

Advertisers collect information so dynamically, in the very moment that people are using apps, that many companies would likely have a hard time qualifying how that data was shared, he said.

It’s important to recognize the limitations that exist for consumers and push for informed consent, he said. That includes knowing the full context of how the data you choose to share may be passed on. If a consumer agrees to share his or her location with a weather app, they likely only expect that location to be used to pull up their local forecast. Any secondary use

of that location information should require consent and not just fall under an umbrella privacy policy that no one is actually going to read, Engelman said.

“What I would like to see is that people have enough information to make informed decisions,” he said.

Smart Assistants and the Internet of Things Unlike concerns about smartphone listening capabilities, if you’ve bought a smart home assistant like Amazon’s Alexa or Google Home, you likely understand that on some level, the device needs to be listening to hear its wake-up command.

To have Alexa turn off your lights, or read you a recipe, the smart speaker needs

to first catch the magic words that indicate you want her to do something, but as smart assistants started rolling out in recent years, it wasn’t initially clear just how easily those devices would accidentally pick up audio they weren’t meant to hear or that it would be listened to by other people.

After consumers complained of odd behaviors with Alexa, the most popular smart assistant, it was revealed that recordings captured by the devices are sent to Amazon, where employees listen for the sounds and phrases that may trip up the system to improve its accuracy. But as you can imagine, some recordings made in error captured snippets of private conversations and even people having sex.

Washington State passed facial recognition legislation this year that Microsoft has been pushing in other states around the country, Spivack says. The rule requires government agencies to write an accountability report before using the technology, have a policy for external information sharing, and train officers in proper use.

The rule also requires a warrant for ongoing or real-time surveillance, but all other uses are allowed, which is troubling, Spivack said. Trying to identify someone with the technology constitutes a search, he argued, and should require probable cause.

“One way to think about this is if you’re in a face recognition database, you’re essentially in a perpetual lineup,” he said.

“You’re always a suspect who could come up.

A lot will say, ‘Well, I didn’t commit a crime.’

It’s not really about that. It’s more, ‘Does an error-prone, biased technology think you committed a crime?’ Then you have to worry.”

Until the kinks in the technology are worked out and proper protections of Constitutional rights are codified, the center and other privacy rights groups are advocating that states implement a moratorium on the use of facial recognition.

Meaningful Legislation Europe’s General Data Protection Regulation, which took effect in May 2018, is the strictest data protection policy in the world. It requires companies to inform users of what data will be collected and how it will be used while also allowing editing or deletion of some types of data. On request, companies need to provide users with all the data they have on them.

Companies that don’t comply with those and other rules can be fined millions of dollars.

Many want to push for something similar or even more protective in America.

Currently, California is the only state to have passed a similar level of protection, with the California Consumer Privacy Act. This year, Washington State, home to tech giants Microsoft and Amazon, came close to passing an even more protective measure than California’s called the Washington Privacy Act, which would have required

to research by the Georgetown University Center on Privacy and Technology.

In some cases, police departments have used photos of celebrities they claim look somewhat like a suspect to search for matches. In others, departments have uploaded composite sketches, which led to matches with people who looked far different from the eventual suspect connected with the crime, the center reports.

In one case highlighted in the center’s “Garbage In, Garbage Out” report, the New York police department wasn’t getting any matches with a photo of a black man whose mouth was wide open, so the department Googled “black male model” and edited another man’s closed lips onto his face to try to find a match, said Jameson Spivack, a policy associate with the Georgetown center.

“You can see, first of all, fabrication of evidence and, second of all, the racial implications of this thing,” Spivack said.

“It’s really wild the kinds of things they’ve done.”

Importantly, face recognition gives government power they’ve never had before, Spivack said.

“In 2015, police in Baltimore County used face recognition on the Freddie Gray protesters to locate, identify, and arrest people who had unrelated outstanding arrest warrants,” Spivack said. “This is a politically protected demonstration, and without the protesters being aware of it, the police were using facial recognition to identify people with completely unrelated warrants and target them from the crowd.”

The technology also struggles with accuracy, with issues in identifying people of color, women, and younger people, he said.

With no regulations to audit systems for accuracy, errors can persist.

Some states enter driver’s license photos into face recognition databases, while others include only mugshot photos. When the Georgetown center researched how widespread databases were in 2016, they found that about 54% of Americans were included in at least one database, Spivack said.

“A majority of Americans are subjected to face recognition,” he said. “It’s very likely that has increased, but we have no way of knowing.”

Facial Recognition Americans learned of another wide-reaching privacy overreach early this year, when The New York Times reported on a company called Clearview AI. Clearview had created a massive database of photos scraped from public posts on social media and across the web to create a powerful facial recognition tool that allows users to find out who someone is, and it even links back to the original posts.

The Times reported that the tool was being used by hundreds of law enforcement agencies and was more comprehensive than any recognition tool created by the government or other Silicon Valley companies.

“The tool could identify activists at a protest or an attractive stranger on the subway, revealing not just their names but where they lived, what they did, and whom they knew,” the Times reported, noting just a few of the potential implications of such a tool.

companies to conduct risk assessments and allow people to edit or delete their data.

But the measure failed when lawmakers couldn’t agree on how it should be enforced.

One contingent wanted the state Attorney General’s office to be responsible for enforcement, while the other also wanted the right to private action.

Privacy advocates, including the American Civil Liberties Union of Washington, point out that the act was also full of loopholes, and it would have prevented local jurisdictions from passing more protective legislation.

“It was astonishing to see all the places where rights that were listed were circumvented by exemptions,” said Jennifer Lee, the technology and liberty project manager for ACLU Washington. “How can you say consumers actually have meaningful rights if they’re not enforceable and undermined by a laundry list of loopholes?”

While state legislation can fill an important vacuum in data protection laws, Washington State Senate Majority Leader Sen. Andy Billig (D-Spokane) said he thinks federal standards would better protect all citizens.

“While I think Washington is generally a leader in technology and consumer protection, and it would make sense for Washington to be a leader in this area, ultimately federal legislation would be the best, so there’s one standard throughout the country,” Billig said.

Washington politicians are also leading on the issue at the federal level. Sen. Maria Cantwell (D-Washington) introduced the Consumer Online Privacy Rights Act (COPRA) with Democratic leadership in late 2019. The act would ensure, among other things, that people around the country have the right to: access their data and see how it’s being shared; control the movement of that data; delete or correct their data; and take their data to a competing product or service. It also provides a right to private action against violators. But many who work in privacy say proposed rules like COPRA, and even the GDPR, don’t go far enough because they require people to opt out instead of opting in.

Lee said protective legislation requires two major questions to be answered: For what purpose is your data being collected, and is it collected with your consent?

“You might not know how you’re hemorrhaging your data, or who has it, but when aggregated and combined with different data sets, that can really reveal a very intimate picture of your life,” Lee said. “And if it’s not adequately protected, it can be used to discriminate against anyone in critical decisions, like our healthcare, housing, education, or loans. It’s something everyone should be worried about.” l

It would’ve been easier if Amazon had first asked people to opt in and share their recordings, explaining that they would be used to make the system better, similar to when a computer program crashes and asks for permission to send an error report, she said. Instead, the default setting remains that Amazon can use recordings to improve its service, but users now have the option to opt out.

As many other home devices become more connected, creating the so-called “Internet of Things,” other privacy risks are popping up.

Some smart TVs now include microphones and cameras that could be hacked by stalkers or the government to watch people in their living rooms and bedrooms. Less nefariously, most smart TVs collect every detail of what you watch to target show suggestions and ads.

Amazon’s Ring Doorbell security system widely shares videos with law enforcement if users agree, raising questions of how those images could be used for other purposes, like facial recognition. The company also shares user information with third parties, sending the full name, email address, and number of devices a user owns to the analytics firm MixPanel, according to a January report from the Electronic Frontier Foundation, a nonprofit that fights for civil liberties. In 2019, hackers exposed vulnerabilities in the system by getting access to the cameras and using the built-in speaker to talk to children in their homes.

While many systems offer some way to opt out of their tracking, King noted that consumers should assume their devices will default to the broadest possible sharing of their data.

Make a game out of learning their name by putting together fun, color-coded flashcards so you can kill a few hours and be productive at the same time. Do yoga or meditate with your kids In all seriousness, it’s important to make sure you and your family are taking care of yourselves. Yes, things might be nervewracking and scary right now, but yoga and meditation are effective ways of bringing yourself back into the present and escaping your worries. Yoga has been shown to help ease stress and anxiety, reduce inflammation, and increase your chances of unironically shopping at Gaiam.com.

Meditation takes some practice, but if you’re going to have the extra time to sit around your house, you might as well not think while you’re doing it. There are lots of guided meditation tutorials online, along with helpful tips and articles to start you on your path to enlightenment.

Craft your little heart out This is the scenario that Pinterest was (probably) made for. Don’t know what to do with your time but know you’ve got to do something other than spend another hour skimming your unsatisfying Netflix options? Get out the pencils and see if you still remember how to draw. Can you make a realistic reproduction of that wine glass?

Better yet, make a lightbulb vase, fairy light jar, a hazmat suit made of duct tape?

The possibilities are limitless.

Crafty people will already have crafting supplies in their homes, so this is a great time to dig through your significant other’s stash. Just be sure to ask their permission first, or they’ll get pissed.

Hacking away at weeds, digging a hole to transplant a shrub, or tilling a small plot for a vegetable garden are great ways to occupy yourself and vent frustration. If you’re patient (which, in these times you have to be), you’ll be able to see hard work pay off and maybe discover a renewed love for Mother Nature.

Those with no yards to dig up can still try their hand at growing seedlings in empty tins or jars. After all, you’ve got your tinned goods piled up in your bunker already. Might as well do something with the remnants.

Challenge (optional): See if you can grow a weirdly shaped vegetable.

Those with a brown thumb can still try out the following pastime.

Start composting If you’re going to spend more time indoors than usual, it’s safe to assume you’ll create more trash than usual, too. Composting is a great project to help minimize the waste and refuse you send to the landfill.

Basically, if you have any spots in your backyard (or even a large bin going unused), you can start composting by putting together a mixture of “brown matter” (like paper, cardboard, dried leaves, wood, and dryer lint) and “green matter” (fruit/ veggie scraps or peels, egg shells, coffee grounds, teabags, and grass clippings).

Add a bit of water and keep the compost outside making sure to give it a turn every few days. Eventually, microorganisms will break down the ingredients into a dark soil-like matter. Done properly, you’ll not only have nitrogen- and carbon-rich compost to add to your garden or potted plants, you will also cut down on the roughly 6,351 pounds of trash, according to Saveonenergy.com, that your average American family produces each year.

Sure, this suggestion wasn’t funny, but it’s still a good idea! Whaddayou want from us?

Veg out in front of the tube This is a given and probably something you’ve already done in abundance. Still, it’s also a good opportunity for you to try out some genres you wouldn’t otherwise consider. Check out some documentaries, Korean dramas, or even some gawdawful reality television. When else will you get the chance to burn off your PTO by discovering a new guilty pleasure? We won’t judge as long as you don’t start pestering us with spoilers.

Somebody Say Ramen

I heard about Kintaro Ramen and asked to review it this past winter, before the restaurant industry and much else went to Kintaro to imitate Japanese gas stations hell. The Arlington ramen shop persevered and keep small containers of these nuggets and went on with its March opening, in a refrigerator case for busy students, coronavirus be damned, so I have to say professors, and administrators to take out.

My bottle of Mio sparkling sake turned out to be like an alcoholic version of Sprite. Purists will probably blanch at this description, but I prefer my sake sweet and found it an altogether pleasant afterdinner imbibe. The bottle comes with individual chilled sake glasses, so even though it’s a single serving, it’s eminently sharable.

My return meal at Kintaro was my first proper restaurant dinner since the lockdown, and I suspect I would have been happy if they’d served me a deep-fried block of wood. I thought about why we go to restaurants: It’s not just about the food.

It’s about being freed from the tedium of kitchen prep and the sight of your own dinner table, not to mention the feeling that you’re important enough for someone to wait on. This is what many of us were missing without our restaurants. My server was wearing a face mask and latex gloves, yet as I waited for my food and let my mind wander and took in the fresh air at the one outside table, I felt for just a moment like everything was right with our messed-up world again. How do you put a price on that? l

Mean Motor Scooter Still one of the hottest tickets around, the Fort Worth rawk band returns with the new record Mr. Sophistication.

Mean Motor Scooter may be “local,” technically, but the hard-rocking and -popping quartet has fans all over, including France and Spain, where MMS has received some airplay and good press.

Now with the release of the band’s latest recording, the EP Mr. Sophistication, there’s hope that keyboardist Rebekah Elizabeth, drummer Jeff Friedman, singer-guitarist Sammy Kidd, and bassist Joe Tacke can take advantage of their newfound international profile. Too bad a

HearSay Let me start this by saying that music venues and pretty much every other kind of establishment, most notably restaurants, are two wildly different things. At a music venue, congregating is sort of the point. At a restaurant, under any circumstances but especially now, you’ll need to stay as far away from my family and me as humanly possible. None of us wants to be forced to shield ourselves from your splattering coughs or, worse, overhear your inane conversations in your outside voice inside.

We have much more exciting topics of our own we need to discuss, like Why do we wait until entire TV series are over before we start watching them? and Is getting dressed really all that important? and Why do I always have to be the one to help him with his homework?! You at least have zero patience. I have -10!

All the data indicate that most momand-pop establishments are not going to survive the lockdown, paycheck protection or not. (And it’s most likely “not.”) A restaurant at 25% capacity is, for most restaurants, about as close to closed as theoretically possible. The average bar at 25% capacity is what is referred to in the beverage industry’s esoteric parlance as “dead.”

MMS was scheduled to play the Wildflower! Arts & Music Festival this week in Richardson with Joan Jett, Loverboy, and several other vintage rock headliners, but due to the pandemic, the event was canceled. Locally, MMS was supposed to perform an EP release show on April 11 at MASS. That instead turned into a livestreamed concert from the same venue on May 1. More than 2,100 people have viewed the almost hour-long show.

The average turnout for the group’s North Texas shows is approximately 50 to 100 people on most nights, Kidd said.

While touring the West Coast in 2018 and 2019, performing in California and Oregon, sharing the stage with Alternative Tentacles’ The Darts, and meeting the label’s founder, Dead Kennedys frontman Jello Biafra, the group played in front of some pretty packed crowds, Kidd said.

“Releasing an album during the pandemic has been less than ideal, to say the least,” Tacke said, adding that he and his bandmates have been able to pivot quickly to “focus on more streaming and radio stuff.”

Mr. Sophistication was recorded in one day in Fort Worth at Cloudland Recording Studio (Pinkish Black, Ting Tang Tina, Chillamundo) and One Horn Studio (Josh & The Jet Noise, Dome Dwellers). It was engineered by Dreamy Life cofounder

Robby Rux (The Cush, The Fibs, Maestro Maya), Elizabeth, and Tacke, who also mixed and mastered it. Now available on digital platforms, including Bandcamp, Mr. Sophistication brings a high-frequency hard-rock pop sound with catchy beats crashing back and forth. It’s more than a well put together EP. Kidd’s screams accompanied by Elizabeth’s high-pitched organ match the ferocity of Tacke’s bass and Friedman’s heavy beats. On “Portals,” lyricist Kidd describes an outward universe longing for explanation, but to no avail. Instead, screeching and wailing resonate in concussive reverb-drenched waves.

Kidd said the nature of Mr. Sophistication is a characterization of the ego as someone seeing oneself in a way meaning to be good or bad or selfless or helpless, adding, “The EP relates to human form and acknowledging the dark shadows inside of us with bad and good elements and certain figures looking at the occurrences while not pretending everything is so black and white all the time.”

Kidd said MMS’ music is “a collage of a lot of different artists that we all listen to.

Besides our main influences, we try to stay connected to artists,” including William S. Burroughs and other Beat writers and filmmaker David Lynch.

Part of Mean Motor Scooter’s international profile comes from their

essentially bar-bars, and most of them are on the small side, equating to about a couple dozen people (not counting staff) to manspread in rooms built for 150-ish whenever Gov. Greg Abbott greenlights the reopening of bars/venues. For the curmudgeonly among us, the fewer walking meat bags on the stools next to us and down in front of us, the better. No pesky lines at the bar to stop the precious Bud Light from a-flowin’. No adjacent convos about messy breakups or crappy neighbors. For the venue owners and the patrons who want to rock out at a rock show, including the bands, it’s a bad scene. Being within cheersing distance of other people who want to bang their heads or two-step defines the essence of places like Lola’s Saloon, MASS, The Moon, and the White Elephant Saloon.

Livestreaming takes the ethos of rocking and rolling only so far.

There may be a way to move forward.

As the concert/ticketing juggernaut Live Nation Entertainment has begun, um, rolling out concerts at drive-in theaters, Lava Cantina (5805 Grandscape Blvd, 214618-6893) is launching “drive-in” shows.

At 8:30pm on Wednesday at the sprawling Colony-located venue/bar/restaurant, you can watch Texas Music singer-songwriter Wade Bowen perform in person, via Facebook Live, or in the cantina parking lot, a.k.a. at “the drive-in” — it’s a patchwork of designated parking spots, each with a table for up to six people separated 8-10 feet from

the next closest table. The performances inside will be broadcast in real time to a “massive” LED wall facing the tables, the cantina says, and in full sound. Concierges will serve food from the abbreviated menu and drinks and escort driver-inners to the restroom. For customers who do not feel safe leaving their vehicles to experience the performances, the shows will be broadcast on an FM station. Prices vary.

For live views inside the cantina, the area in front of the stage will be divvied up into eight “yards” — a yard is a table enclosed by bicycle racks and at least 8 feet away from the next nearest other yard. On the patio, eight tables will be spread out by 6-8 feet, and 10 tables separated by the same distance will be available on the balcony.

For stream viewing inside, a distance of 6-8 feet will separate the 16 tables in the dining area and the 10 tables on the roof.

Lava Cantina’s adherence to social distancing deserves to be commended.

Now it’s up to Bowen to make sure they are respected throughout his concert, and since he appears to be a pretty standup guy who’s unfairly maligned by Texas Music purists, I think he’ll do just fine.

This is not the future. It’s just the future for now, and it’s a positive step. In many ways, Lava Cantina’s Wednesday show predates what’s being called the first major U.S. concert since the pandemic began.

That’s on Friday, when country singersongwriter Travis McCready is scheduled

Mr. Sophistication was part of a planned double-EP release at two separate dates with a future plan to release a vinyl version with the EPs on sides A and B. “That’s what we were talking about doing,” Kidd said, “but we don’t have the funds to put it out right now.”

Kidd is happy with the band’s sound now, especially with the relatively recent addition of Elizabeth, who joined in 2016 right before MMS’ lone album came out.

Hindu Flying Machine and the 2016 singles “Naked Brunch/Such a Seducer,” a music video for “Gutterboy Blues,” last year’s TV Baby EP, and two other music videos altogether helped propel the West Coast tours.

“We have no idea what it looks like moving forward,” Tacke said. “It doesn’t look like live shows will be back in any real sense of the word for a long time.

Live shows were obviously our bread and butter. They were by far our biggest source of income, and now that’s completely dried up.” l

After the past several weeks, of pain and confusion on all levels, from the urban villages and ’burbs to the (scandalously clueless) White House, people are just ready to rock.

While drive-ins and drive-in shows are great, people are still going to have to wait for the full live-show experience. It could be over a year, based on some estimates.

“In today’s world of fear and unease and social distancing,” the Foo Fighters’ Dave Grohl recently wrote in The Atlantic.

“It’s hard to imagine sharing experiences like [concerts] ever again. I don’t know when it will be safe to return to singing arm in arm at the top of our lungs, hearts racing, bodies moving, souls bursting with life. But I do know that we will do it again, because we have to. It’s not a choice. We’re human.

We need moments that reassure us that we are not alone. That we are understood. That we are imperfect. And, most important, that we need each other.”

More Dishing Out Relief: Top Chefs and Country Musicians Join Forces to Raise Funds for Texas Restaurants FORT WORTH, Texas— Billy Bob’s Texas announces a virtual cook-a-long and music event on Saturday, May 16 at 6 PM. This event marks the second Dishing Out Relief fundraiser to provide some much-needed assistance to the restaurant industry in Texas amid the COVID-19 pandemic.

In honor of National BBQ Month, the event will feature BBQ cooking demos by several Texas top chefs as well as performances from country music artists.

Billy Bob’s is partnering with the Texas Restaurant Association (TRA), the leading business association for Texas’ multi-billion dollar foodservice industry, and Dallas-based digital marketing firm Lux214 Media Group to host the event.

All proceeds will go to benefit the Texas Restaurant Association Relief Fund, which was established in response to the COVID-19 pandemic. So far, the pandemic has resulted in 688,000 lost jobs, $80 billion in lost sales revenue, and the closure of 34 percent of the 50,000 restaurants in Texas since mid-March.

“Our objective is to provide immediate relief by getting the money to restaurants quickly,” said Dr. Emily Williams Knight, President and CEO of the TRA. “The effects

of this pandemic have been devastating for restaurants all over the state, and now we’re all coming together to help each other out.” Chefs will be presenting tips and tricks on how to make some of their favorite dishes in a series of engaging “how-to” videos.

PUBLIC COMMENT/PUBLIC MEETING You may submit public comments, or request a public meeting or a contested case hearing to the Office of the Chief Clerk at the address below. The TCEQ will consider all public comments in developing a final decision on the application. After the deadline for public comments, the executive director will prepare a response to all public comments.

The purpose of a public meeting is to provide the opportunity to submit comments or ask questions about the application. A public meeting about the application will be held if the executive director determines that there is a significant degree of public interest in the application, if requested by an interested person, or if requested by a local legislator. A public meeting is not a contested case hearing.

After technical review of the application is complete, the executive director may prepare a draft permit and will issue a preliminary decision on the application. Notice of Application and Preliminary Decision for an Air Quality Permit will then be published and mailed to those who made comments, submitted hearing requests or are on the mailing list for this application. That notice will contain the final deadline for submitting public comments.

OPPORTUNITY FOR A CONTESTED CASE HEARING You may request a contested case hearing. A contested case hearing is a legal proceeding similar to a civil trial in state district court. A contested case hearing will only be granted based on disputed issues of fact that are relevant and material to the Commission’s decision. Further, the Commission will only grant a hearing on those issues submitted during the public comment period and not withdrawn.

The deadline to submit a request for a contested case hearing is 30 days after newspaper notice is published.

If a request is timely filed, the deadline for requesting a contested case hearing will be extended to 30 days after the mailing of the response to comments.

A person who may be affected by emissions of air contaminants from the facility is entitled to request a hearing. If requesting a contested case hearing, you must submit the following: (1) your name (or for a group or association, an official representative), mailing address, and daytime phone number; (2) applicant’s name and permit number; (3) the statement “[I/we] request a contested case hearing”; (4) a specific description of how you would be adversely affected by the application and air emissions from the facility in a way not common to the general public; (5) the location and distance of your property relative to the facility; (6) a description of how you use the property which may be impacted by the facility; and (7) a list of all disputed issues of fact that you submit during the comment period. If the request is made by a group or an association, one or more members who have standing to request a hearing must be identified by name and physical address. The interests the group or association seeks to protect must also be identified. You may also submit your proposed adjustments to the application/permit which would satisfy your concerns.

If a hearing request is timely filed, following the close of all applicable comment and request periods, the Executive Director will forward the application and any requests for contested case hearing to the Commissioners for their consideration at a scheduled Commission meeting. The Commission may only grant a request for a contested case hearing on issues the requestor submitted in their timely comments that were not subsequently withdrawn. If a hearing is granted, the subject of a hearing will be limited to disputed issues of fact or mixed questions of fact and law relating to relevant and material air quality concerns submitted during the comment period. Issues such as property values, noise, traffic safety, and zoning are outside of the Commission’s jurisdiction to address in this proceeding.
