Most Difficult Situation…

This is a hypothetical, fictional series of fact patterns

designed to illustrate the legal points.

irst scenario. Agnes, a 110 pound female, applies to be a field laborer with your concrete company. She seems a little frail, so your initial reaction is to laugh and tell her there’s no way she could ever do the job. Agnes walks out. Three weeks later, you get a discrimination charge from the Equal Employment Opportunity Commission. You will lose, and you might best be served by conducting immediate damage negotiations. You cannot lawfully presume that a female applicant is incapable of performing the work.

Second scenario. Agnes applies for the field laborer position, and although you are a little skeptical, you tell her that she can start work the next day. Agnes shows up, ready for training, and although she struggles a little bit, Agnes finishes the training, so she starts work. A few days later, the crew leader comes to you complaining that Agnes is not capable of doing the job. You ask the crew leader for specific examples of Agnes’s shortcomings, but the crew leader simply responds that she cannot carry the forms or do any of the heavy lifting. You fire Agnes. Three weeks later you get notice from the Equal Employment Opportunity Commission alleging that you have discriminated against Agnes.

This situation is a little risky. You could win the discrimination charge if the investigator believes your crew leader, but this is probably unlikely.

Your crew leader cannot point to any specific shortcomings, but instead, believes that Agnes was incapable of carrying forms and performing any heavy lifting. This situation

probably leads to litigation where you, your crew leader, and perhaps others from your company will be tied up in court for days or weeks.

Third scenario. Factually the same as above, but here, when you ask your crew leader for specific examples of Agnes’ shortcomings, he pulls out a notepad and shows you documentation of numerous times over the preceding several days where Agnes dropped a form or was otherwise unable to perform her duties. You see that he has recorded the incident, date, time, and when applicable, who else was involved. In short, it is a very detailed summary of Agnes’s shortcomings.

This one is a lot better for you. By producing the crew leader’s notepad to the EEOC investigator, the investigator is faced with substantial proof that Agnes was not capable of performing the job. The likelihood, here, is that EEOC dismisses the discrimination charge and your company saves a fortune in litigation expenses.

Fourth scenario. Assume the same facts as above, but instead of terminating Agnes, you offer her a clerical position in your office. You may think that you are free and clear, but remember Agnes has a minimum of 180 days (and perhaps as much as 300 days) to file a charge with EEOC or a state anti-discrimination agency.

Therefore, your best defense is to write a memorandum recording the facts at the time of the offer to her.

Be as complete and thorough as possible, and you may want to get the crew leader’s statement.

Fifth scenario. Agnes applies for the position. With her is Wanda and they appear to be very close,

holding hands and otherwise physically and emotionally supporting each other. During the application process, Agnes says she is looking for high-paying work so she can save money to marry Wanda. You do not believe that is ethically right and you do not employ her.

Today, this is very dangerous.

Although the federal government seems to now take the position that gender orientation is not properly the subject of Title VII discrimination, state and local government is much less clear. This means that although the EEOC is not likely to entertain Agnes’ charge of discrimination, a local plaintiff’s attorney may very well sue your company, and you, alleging LGBT discrimination. This could embroil your company in extensive, and very expensive litigation. Moreover, it is not clear that you would win in some states. Therefore, it is safest to ignore Wanda completely and put Agnes to work.

Please note that these are just some of the situations a contractor may face. For example, Agnes could just as easily be Andy. Moreover, either Agnes or Andy could develop a disability in the first few days of work. No matter what happens, you should remain neutral and not make assumptions. Also, when in doubt, seek competent legal counsel.

ilis Flatwork specializes in large scale concrete pours and was the concrete contractor for a recent 40,000 square foot warehouse extension for a plastics company in Kaukauna, Wis. According to Dylan Milis, owner/operator of the company, they were ready for a successful pour. “We got here at 4:15 this morning and started pouring at 5. In total, we are going to have about 70 trucks here today, just under 700 cubic yards of concrete.”

The 70 trucks arrived like clockwork, allowing Milis and his crew to have all the concrete placed by about 1 p.m.

Throughout the pour, Milis operated his new Somero laser screed and was confident that they would achieve a flat floor. “We don’t have any specific FF numbers, but I would anticipate we will hit well over 65 for FF today. The floor will not be tested, since there are no specs, but it will be a quality flat floor.”

After we pan the floor, we run some combo blades on it, and then we finish it out with plastic blades. process. “We put down the concrete with a laser screed to get it as flat and level as possible, which definitely aids in a flatter floor,” Milis explains.

“Then, we pan the floor twice with two machines that have pans on them. After we pan the floor, we run some combo blades on it, and then we finish it out with plastic blades.

This will be an exposed floor, so we’ll put a nice shine on it.”

Luke Sevcik, Wacker Neuson product application/training specialist and ACI certified flatwork finisher and examiner, confirms that quality floors start with the right process.

“When pouring large block placements, as in the case here, laser screeds and ride-on trowels with

highly skilled operators will yield high FF numbers, even when not specified.

It’s good practice to always follow best methods every time you pour to keep your skills honed and be prepared for a job that does call for high FF numbers,” Sevcik says.

Milis uses Wacker Neuson ride-on and walk-behind trowels for this finishing work. “On this job, we have four 8-footers (CRT48) and one 6-footer (CRT36), one of them is a hydro machine that we do a lot of panning with, and the others are stick machines. We have a mixture of Kubota and Vanguard powered machines, which are both good engines. We also have a walk-behind edging machine doing the edges.

We definitely like the fuel-injected Kubota engines, those are nice. Some of the guys like the hydro machine, so if they are doing big floors like this, they don’t get operator fatigue. The hydro machine has dual settings so that’s nice depending on the type of floor you’re on and how fast you are moving. We have it set up that each machine has its process and certain operators run those machines,” Milis says.

Achieving a quality floor also depends on the quality of the finishing equipment and Milis has found confidence in Wacker Neuson’s flatwork finishing line. “Originally we bought Wacker (Neuson) because they were made locally; they are made 100 miles south of us in Milwaukee (Menomonee Falls, Wis.),” Milis explains. “We went down to the factory, toured the plant when we bought them. We saw how they were put together, the quality control, very high quality machines. And now we continue to purchase them, because we don’t have any problems with our machines. So why change? We have had minimal to no problems, they are priced competitively, and we’ve had a good experience.” Milis Flatwork purchased the trowels from their local dealer, Lincoln Contractors Supply.

of the entire concrete process. He has sent many of the staff through Wacker Neuson’s Industrial/ Commercial Concrete Floors twoday training program. “We send our guys down to the school and they get some hands-on experience, and

it also teaches them the specifics on how to make flat floors, how to edge properly, how to run equipment, things of that sort. They know what to anticipate and they know how the process works when they are doing a commercial floor.”

Sevcik leads Wacker Neuson’s concrete training program and knows the importance of welltrained operators. “The training we offer at the Wacker Neuson University has proven to be a valuable resource for both experienced and beginning concrete finishers.

Operators enhance their skills in not only finishing commercial floors, but the entire process from the pre-pour planning to curing. By training on the latest finishing techniques, following ACI recommended practices and using the best finishing products available, contractors increase

their productivity, FF and FL numbers and overall quality of their product,” Sevcik says.

Milis said that the training has helped his business. “It has improved speed and final quality of the product when we are done. It definitely improved final quality and just the whole process in general. It starts at the beginning. If everything is done right at the beginning, it eases the rest of the way through.”

As for the 40,000 square foot warehouse expansion, planning, training and the right equipment provided a quality flat floor that was finished on-time, just like clockwork.

he primary function of porous or permeable pavement is to allow water to run rapidly through the surface to a sub-layer, which allows general or directed drainage.

Permeable asphalt and concrete are gaining awareness and acceptance in the industry as good solutions in areas where drainage is an issue.

drainage than permeable asphalt or concrete can deliver. Water passes through the pervious surface of Porous Pave at a rate of 5,800 gallons per hour per square foot, allowing

stormwater to percolate down through the base below. This also means that before installation, an open-graded stone is put down to add water storage and protect the

base from deterioration.

“The permeability is really the big draw,” says Keith Brooks, P.E., sales engineer at GeoSolutions (a Porous Pave dealer). “Traditional permeable pavement has an air void percentage of seven percent, and that allows some water to flow through, but Porous Pave has 27 percent void space.

“With limited porosity, traditional permeable pavement delivers limited drainage, and it tends to clog with fines and dust particles, so there is more maintenance. Because of Porous Pave’s greater void space, water carries those particles through it,” Brooks adds. “As it gets dust or debris on it, a rain event will wash those particles straight through the pavement instead of clog it.”

binder. This will yield 16-sq.ft. at 1-1/2-in. thickness.

“A contractor would simply figure out his square footage and divide it by 16 to get the quantities he needs,” Brooks says. “On site, they’d mix it for 60-90 seconds in a mortar mixer and install it. The curing process takes six hours before it can be exposed to moisture, with 24 hours full cure for traffic.

“You don’t need to compact it or run a density test on it,” Brooks adds.

“Once it’s installed at that recommended thickness, you’re set.”

FIXING A FLOODED PATH In March 2017, Porous Pave XL was used to repair a flooded walking path at the Nature Discovery Center in Bellaire, Texas. Rainstorms would completely cover the impervious concrete pavers on the old path with four inches of water. Something had to be done to prevent this from happening repeatedly in the future.

MAINTENANCE MATTERS Unlike a traditional pavement, engineers say because of it’s rubber content, Porous Pave does not need yearly maintenance in the form of crack sealing or sealcoat applications and requires even less maintenance than a traditional permeable concrete or asphalt.

“Every few months, you have to clean a permeable pavement with a street sweeper and take some measures to maintain the porosity,” Keith Brooks says.

“With Porous Pave, periodically washing it off with water applied at low pressure from a garden hose is sufficient.”

The product is typically put down in a 1-1/2-in. application for pedestrian or bike trails, but the company recommends thicker sections up to 2-in. for applications where there will be vehicle traffic.

“If there is traffic on the product where wheels are turning over it, you can sometimes see flaking after a few years,” Brooks says. “That is the flaking of the rubber surface that’s dislodging from the binder. When that happens, contractors can order some of the original binder, thin it out and roll it on to the pavement with a paint roller or overspray it with an airless sprayer.”

However, in pedestrian applications, Brooks says it would be 10-15 years before a maintenance event like this would be required. In fact, a recent study found that only three of 13 trails that have been in place for 10 years needed this resealing.

Rainstorms at the Nature Discovery Center had completely covered the impervious concrete pavers on the old path with four inches of water and something had to be done to prevent this from happening again in the future.

“Flooding made our paver path unsafe and unusable,” Henry Owen, executive director at the Nature Discovery Center says. “The necessity of building a new permeable path gave us the opportunity to re-design it with more naturalistic curves, winding between four distinct habitat areas.”

The Nature Discovery Center and the contractor, Piper Whitney Construction, Houston, Texas, considered several permeable paving options. Stormwater infiltration performance, cost, protecting the landscape during construction

and appearance were all important considerations.

“Our site was once a pecan orchard,” Owen says. “We have 80-90-year-old pecan trees to protect. We discovered that with Porous Pave, there was no need for big trucks or heavy equipment, and the extent and depth of the required excavation were minimal.

“Porous Pave pours in place, making it easy to shape the path’s curves. The color we chose complements the granite trails in other parts of the nature park. The installation was relatively non-intrusive and the

path is now usable and safe right after it rains.”

Once the pavement selection was made, Piper Whitney began work.

The project began with a day of excavating out the old pavers and getting the site at a higher grade. The company then installed a nylon fabric that water flows through but traps dirt or silt from entering. They then installed the layer of open-graded crushed stone that also allows water to flow through it easily.

Next, the crew obtained the Porous Pave product from their dealer, GeoSolutions, Inc., and was ready for installation.

“With Porous Pave, you don’t have a big cement truck show up to the jobsite,” Michael Bratton, owner of Piper Whitney Construction says. “You mix the product onsite and immediately put it into wheelbarrows where it’s dumped and installed by hand.”

Bratton says you have about 30 minutes after mixing the product to work with it before it starts to set up.

“We’re constantly mixing,” Bratton adds. “By the time the crew has bull floated and troweled one wheelbarrow of product down, they’re ready to head back for more mix. We usually have six to seven guys on site, and that’s just to keep them from getting tired from running wheelbarrows all over.”

Crews installing Porous Pave can expect to use many of the same installation items a specialty concrete contractor would use, specifically shovels, bull floats, trowels and a mortar mixer.

On the Nature Discovery Center Trail, Bratton says the installation on the site was a bit limited where they could move and position the mortar mixer along the five-ft.-wide path without damaging plants growing along the sides. “It was a little fatiguing for workers walking back and forth to the mixer with a wheelbarrow over the 600 ft. length of the job,” Bratton adds.

Bratton says even though installation may seem more intensive, if you have a few mortar mixers on site, you

“You’d be surprised how fast you can lay down the product when you don’t need to screed or compact it,” he says. “I’ve seen several thousand square feet of this product put down in a day by hand.”

Piper Whitney Construction was able to install 2,500 Sq. ft. of Porous Pave XL on this project in just under two days.

WATER WORKS Keith Brooks says while the cost of the Porous Pave would be more than a typical asphalt pavement installation, citing anywhere from $10-$15 per square foot to install, the cost benefits could outweigh the challenges associated with building stormwater holding areas.

“When you install a concrete parking lot, that area becomes impermeable land. When I have impermeable land, I can’t discharge stormwater runoff during a rain event to the existing storm sewer. I either have to build a detention pond or put an underground storage tank in to meter that water out.

“When you use a permeable system like Porous Pave, you get to take a substantial reduction in the amount of stormwater holding you need to provide with your project, many times eliminating the need for the construction of a detention pond, helping to offset some of the cost of the more expensive permeable pavement,” Brooks says. “More than anything, that’s what drives contractors to install a permeable system, especially in a parking lot application.”

In addition to managing stormwater for erosion control and pollution, many property managers are starting to make requirements that a contractor is environmentally conscious and Porous Pave is just that. For every thousand square feet of Porous Pave that is put down, 300 tires are diverted from the waste stream.

A NICHE BUSINESS Since 1989, Bratton has operated a thriving swimming pool construction business in the Houston area.

“This area has very bad soil with a lot of clay, so we started using permeable pavement wherever possible around the pools,” he says.

From there, Bratton was looking for another type of business to get in to that he was familiar with and which aligned with his sustainability ideals. He set up a separate specialty company, installing only permeable pavement and “green paving solutions,” forgoing any asphalt or concrete installation.

“We want to make money while providing a needed service with this permeable niche,” Bratton says. “Cities across the country now require permeable pavement, and it’s only growing. We’re getting in on it when it’s new and when there’s not a lot of competition with companies that specialize in this service.”

And because the color of the rubber chips determines the color of Porous Pave, it can be customized for

color preference instead of just black or gray, like asphalt or concrete.

Bratton says his customers really like this option, especially the red fire lanes that are attractive and able to absorb both the weight and the water loads of the ladder trucks.

“As a company, we wanted to do something that would outlive us with these sustainable solutions,” Bratton say. “With these materials, we’re able to provide a longer lasting surface for the customer to have a lifetime of use out of it. Sure it might cost more for them initially, but we’re finding that we’re having better customer relations with permeable pavement because they are happy with the product and are referring other companies to us for that same experience.”

Water passes through the pervious surface of Porous Pave at a rate of 5,800 - 6,300 gallons per hour per square foot, allowing stormwater to percolate down through the base below. This also means that before installation, an open-graded stone is put down to help add water storage and protect the base from deterioration.

In recent years, the concrete industry has seen an increased emphasis on concrete dust suppression and containment, both for worker safety and jobsite cleanliness. OSHA’s new regulations for the contractor, demanding greater dust collection on the jobsite. In May 2013, OSHA issued a proposed rule for crystalline silica, which includes revised PEL limits. Will My Project Benefit from CONTROL FLOW CONCRETE? A new type of highly flowable concrete bridges the gap between conventional and self-consolidating concrete.

A new concrete category, control flow concrete, recently emerged to bridge the gap between conventional and self-consolidating concrete. Like self-consolidating concrete, control flow concrete flows and places easily, without negatively impacting stability or segregation resistance.

onventional concrete has been used as a building material since Joseph Aspdin invented Portland cement in 1824.

It works just fine for many building projects since it’s easy to produce and to deliver to the jobsite.

However, it’s not exactly an easy material to work with. Concrete requires a tremendous amount of labor (and heavy equipment) just to move, place and finish. With many

general contractors struggling to find help in a tight job market, they would certainly benefit from a concrete solution that would reduce the amount of labor needed.

Self-consolidating concrete came about, in part, to address this problem. It has high passing ability and it’s also self-leveling. This reduces the labor involved with pumping and placing of concrete. However, self-consolidating concrete is expensive to produce because it requires a specialized

mix design with high powder contents and small coarse aggregates. And it doesn’t entirely solve the labor problem, because its sensitive mix requires extra quality control by the producer to minimize batch variability.

A new concrete category, control flow concrete, recently emerged to bridge the gap between conventional and self-consolidating concrete. It offers many of the desirable characteristics of each type of concrete, without their respective negative aspect. Like self-consolidating concrete, control flow concrete flows and places easily, without negatively impacting stability or segregation resistance. It also can be placed with minimal vibration, which helps to cut costs. And as an added bonus, it doesn’t require extensive quality control to produce, so it eliminates some of the labor costs that come with self-consolidating concrete.

Furthermore, control flow concrete is manufactured using conventional mix designs, with lower powder contents and larger coarse aggregates, further reducing material costs.

CHOOSING THE RIGHT TYPE OF CONCRETE FOR THE JOB Before selecting the type of concrete for your project, it’s important to understand the flow characteristics of each, as well as the placement requirements of the project.

CREATING CONTROL FLOW CONCRETE Good slump flow retention is necessary for transportation and placement of concrete. Superplasticizers can be used to disperse the cement particles and reduce the yield stress of the concrete. However, high doses of traditional superplasticizers can cause segregation. GCP Applied Technologies introduced CONCERA admixtures that produce segregation-resistant, high slump flow concretes using conventional mix designs. Using these admixtures allows for good slump flow, without having to use high doses of superplasticizers. This means that control flow concrete can be produced relatively inexpensively as compared to self-consolidating concrete.

COMPRESSIVE STRENGTH Control flow concrete has compressive strength that is equivalent to conventional concrete. The flow properties come from the chemistry

of the admixture and not from water, so compressive strength is not negatively affected by the use of CONCERA™ admixtures.

STATIC YIELD STRESS Static yield stress is the measure of the force required to start motion in concrete at rest. This information is helpful because the less effort required to move the concrete, the lower the physical strain on staff and equipment at the jobsite. As expected, conventional concrete has the highest static yield stress, meaning it requires the most force to start this type of concrete moving. Control flow concrete requires roughly two thirds less force to start control flow concrete moving. Self-consolidating concrete moves even more easily, requiring a small fraction of the force to start it moving from a resting state.

BINGHAM YIELD STRESS Another important measurement is Bingham yield stress, which measures the effort required to stop concrete once it has been moving.

CONCLUSION Ultimately, control flow concrete shows considerable promise for reducing the tremendous physical effort—and associated labor costs—involved with using traditional concrete, without leaving concrete vulnerable to potential segregation.

For many projects requiring highly flowable concrete, control flow concrete offers the best of both worlds: Concrete that’s easy to work with, but without high concrete production costs and quality control costs.

Concrete is probably the most versatile material for making countertops. It can take any shape, be colored almost any color, have exposed aggregate that is either natural or man-made, be stained or dyed, diamond polished to a high shine or left in a more rough state. It can be cast-in-place or precasted in controlled settings.

O

ne thought about marketing favorable concrete attitudes to residential homeowners is to promote the sale of concrete kitchen countertops.

Though there is very little concrete involved, homeowners see it and use it every day. That can be either good or bad depending on the durability of the work; if a countertop is causing problems they will see that every day also. You might think countertops are in a safe environment for concrete but the reverse is true. They are regularly subjected to acid from vegetables, stains from food, efflorescence from water spillage, fat and oil attacks on sealers, scratches and heat from hot pots when they are placed on them. Contractors must be skilled and knowledgeable. Greg Hyde, the owner of Hyde Concrete in Annapolis, Md., sums it up by saying that being a concrete countertop contractor isn’t for the faint at heart. Still, when all goes

well countertops can be a creative expression, will perform as promised, and can encourage owners to want more concrete; a driveway, patio or a concrete home as the ultimate way to provide a safe environment and an energy efficient structure.

CURRENT TRENDS People like concrete countertops for a variety of reasons. One advantage is that any shape can be created—if it can be formed it can be cast. Concrete countertops can also be integrally colored, stained or tinted with dyes. That said, many design professionals still choose to leave concrete its natural gray color. A current trend continues to be mixing concrete with colored glass aggregates or special natural aggregates. Countertops can be precast or cast-in-place (CIP) although most precast them under controlled conditions. Precast counters are almost always cast upside down to take on the finish of the form

underneath. Surfaces can be diamond polished to achieve very shiny surfaces, left with the finish provided by the form, or with diamond honed finishes of 100- or 200-grit that create a more lustrous finish.

In the beginning years concrete countertops were reinforced with rebar but the current trend is to use structural fibers such as fiberglass, basalt or metallic—rebar being added to sensitive areas. Concrete mixes have changed also. There are many proprietary bagged products on the market but contractors also buy admixture packages to add to their own mixes.

Polymers are also frequently added to retain water for curing, add flexural strength and improve density.

WHAT CONTRACTORS ARE DOING Concrete Innovations. Charlie Griffasi, the owner of Concrete Innovations, located in Buffalo, New York, says he started out as a flatwork contractor, performing that

work for 30 years. Then with his son Jason they started the International Concrete Polishing and Staining Conference (ICPSC). By 2006 they decided to get out of flatwork contracting and concentrate on diamond polishing floors. Reasoning that most concrete countertops were diamond polished, they decided to do that too.

He says they do most of their marketing on the Internet which includes help from Jim Peterson’s Concrete Network website. Their business is all precast and they have a showroom in downtown Buffalo where customers can look at countertops and make selections. They use two different concrete mixes for their counters; lightweight concrete made from a prepackaged mix and GFRC concrete which they spray into their molds.

Customers in Griffasi’s service area particularly like decorative affects such as adding special aggregates and exposing them by diamond polishing, applying dyes during the polishing cycle, and imbedding glass pucks in the work.

He says the most creative work they do is commercial bar tops.

They seal their inside counters with Trinic’s H-12 urethane product.

Cornerstone Decorative Concrete.

Troy Lemon’s company is located in Fennville, Mich., located near the Lake Michigan coastline. He says that peoples desires change by the different regions he serves. “A national fixer-upper showed the installation of a rustic countertop, causing people to like the “rustic look”. One customer called me wanting that look and I achieved it with a CIP installation. I sprayed different colors of concrete into the form to achieve a worn type appearance.”

Lemon has included fiber optic lighting in his countertops but that isn’t currently something customers want. They prefer clean and simple looks now. Most of his countertops are made with GFRC by adding chopped fiberglass into his mixes.

His standard countertop thickness is ¾ inches thick, showing 2 inches on the faces. Building

counters for high-end cottage owners on Lake Michigan is his current bread-and-butter business.

Hyde Concrete. Greg Hyde says his company serves the Washington DC and Baltimore area. He says he constructed his first countertop over 10 years ago. Today it is a small part of his business but one that he wants to grow. So he is setting up a separate company to focus on this work. He is looking to develop product lines that can cast many units from the same molds and be sold at one time. He considers this custom work but thinks it is more profitable than doing a oneof-a-kind custom job that requires special forms. A goal is also to focus on being a precaster and leaving installation work to other contractors.

Here is what people want in Hyde’s region: • “Waterfall” countertops and tables. This design calls for the top to make a right angle turn and extend to the floor, becoming leg support.

in common areas.

• Customers often want large sinks for commercial and common residential areas that make a statement about the décor of the locations.

• Natural colored concrete is the clear preference but he says they are doing some work with cream and teal colored work.

• They occasionally imbed “Black Beauty” sand blasting medium on the fresh surface of the concrete to create a pronounced salt-and-pepper look.

• Exposed Mother-of-Pearl is still popular.

• On a recent project for Amtrak, the company supplied him with railroad tie spikes and crosscut sections of rails to imbed in their counters.

Hyde uses his own concrete mixes but buys admixture packages from Trinic (as well as their sealer) to control placement characteristics and add strength. Most of their countertops are GFRC and he adds post-tension reinforcement rods when counters start to get long. These rods are threaded on both ends and are inserted through a formed inset hole at each end of the form. When the concrete reaches its design strength the rods are stressed by tightening the nuts on each end of the rod. By doing this they have created counters up to 16 feet long and safely transported them.

Almost all their work is diamond honed to a 100-or 200-grit finish—a

very basic finish in the world of diamond polishing—and finished with Trinic’s sealer.

Hyde prefers not to stain their countertop pieces because they pose too many issues over time. They also don’t cast-in-place anymore because the cost/benefit ratio isn’t there. He adds, “If a customer tells me they are also looking at granite tops I tell them to buy them. The price of granite has dropped so low I can’t compete.

But if they want oversized pieces or customized creative work we can become part of the conversation— especially when they are developers.”

SEALING COUNTERTOPS Sealing countertops isn’t an option, it’s a requirement. In the past waxes, penetrating sealers, epoxies and acrylics have been used to seal indoor work and they each have their problems. Two of the contractors interviewed for this article are using two-part urethanes sealer made by Trinic LLC based in Kirkwood, N.Y. Bob Chatterton owns the company and says he started his career as a concrete contractor, forming and placing concrete. “We stained and sealed one job and the sealer failed. I quickly learned how frustrating and expensive repairs can be.” The experience became one of his motivations to start Trinic in 2010 to make a polymer admixture for GFRC concrete work. He wanted it to be a dry chemical admixture instead of a liquid and quickly learned that it wasn’t easy to achieve. Then they decided

to create a thin-film water based, two part urethane that could be used to seal concrete and the product they introduced after much experimentation is called H-12. He says that epoxy films are much thicker than urethanes and unlike epoxies; urethane are very scratch resistant and tough. They recommend four applications, each coat mixed with different amounts of water to achieve good penetration. The finish that results enhances color and provides a luster finish. Urethanes are very resistant to acids, fats and oils, scratching, and can withstand up to 400ºF temperatures—Chatterton doesn’t recommend that owners put pots from the stove onto the counter though.

Chatterton says the cost of their urethanes can be an issue for some customers but sealer applications can make or break how a job turns out and it’s a main reason for customer callbacks.

CLOSING THOUGHTS It appears there are fewer contractors making concrete countertops now and that isn’t necessarily bad.

The companies that make them are perhaps are more aware of the problems and issues. People are attracted to this product because its creative possibilities but this requires contractors with experience and knowhow to build them so that the work is resilient—that countertop may just influence owners to install concrete driveways, patios and concrete houses.

LIVING COLOR Stains and dyes as an integral part of concrete floor systems.

Integral color is part of an overall mix design and has distinct advantages over most dyes and stains from an owner’s perspective. As part of the concrete mix the integral color extends throughout the concrete slab.

T

wo thousand years ago throughout Central and South America, ancient Mayan engineers cooked limestone and created one of the first forms of hydraulic cement. That cement was the foundation of the Mayan world, and allowed the construction of walled cities. In that ancient world, local artisans crushed flowers and used charcoal and the native soil to create an astonishing array of colors to adorn the walls and buildings. These faded colors can still be seen today throughout Mexico and Guatemala.

Both the ancient Mayans and our world today can agree that plain gray concrete needs help, and that color is the key.

Fast forward two thousand years to our world today, color has become a critical portion of a beautified concrete floor and a vital component in

the concrete polishing process. As architects, owners and engineers use more polished concrete in today’s designs, choices abound for the floor contractor. The polished concrete industry and manufacturers have responded to the need for color, and there are more choices today than ever before.

INTEGRAL COLOR In new design and construction, the architects of the world will sometimes specify integrally colored

concrete. A dozen or so years ago, a very large retailer elected to use integrally colored concrete and a pad polishing system in all new construction. Integral color is part of an overall mix design and has distinct advantages over most dyes and stains from an owner’s perspective. As part of the concrete mix the integral color extends throughout the concrete slab. The most pronounced benefit lies in its ability to maintain its beauty despite the effects of extended surface abrasion. As the concrete is colored through the entire slab, imperfections have little aesthetic effect on the overall floor slab.

Owners and architects can only use integral color throughout a given floor surface, and the desired result needs to be a single color. At a minimum the specific color is required to be in each individual pour and could be separated at a construction joint from adjoining colors.

CONCRETE DYES In recent years, concrete dyes have become common place in the industry. Dyes are non-reactive and designed to penetrate the concrete floor slab, and are available in both powdered and liquid form. Having a fine particle size in comparison to other coloring mediums, dyes tend to have the deepest penetration into the concrete floor surface. As

such, dyes are the preferred coloring type in polished concrete floors.

Dyes need to be correctly applied during the later steps of a grind and polish system.

Concrete dyes are available in both water based and solvent based formulas. Each type has a specific use in the industry.

In application, the water based dyes tend to have a less monotone appearance whereas the solvent based dyes lend to a more

monochromatic look. Additionally, solvent based dyes tend to have a fuller and deeper color profile.

The biggest down side of concrete dyes is that they are not UV stable. While this eliminates outdoor use, it should also be a strong consideration in commercial buildings Acid stains can create startling effects in the hands of skilled craftsmen, however the acid stain color palette is restricted to earth tones.

CONCRETE STAINS The concrete staining world is separated into two distinct categories, acid-stain and water based.

Water based stains are much more akin to a concrete coating. As with concrete coatings, water based

stains are designed to bond with the underlying concrete. Of limited commercial use, water based concrete stains excel in the decorative concrete world. Like paint, these stains offer very long working times and are significantly more forgiving in application thus allowing the concrete artisans of the industry to create truly memorable effects on

Acid stains are more common than water based stains. In acid stains the acid reacts directly with the concrete floor surface and creates a permanent effect on the floor slab. Acid stains can create startling effects in the hands of skilled craftsmen, however the acid stain color palette is restricted to earth tones. In the world of acid staining, the acid must be neutralized after the initial reaction. This is a critical step in the acid staining process and cannot be ignored or the color profile will continue to morph over time.

Both types of concrete stains require the use of a topical concrete sealer following application. The sealer will lock in those great colors. As most topical sealers can fall victim to extended wear, reapplication as part of a comprehensive maintenance program is a must.

The significant advantage of stains over dyes is in UV resistance. Due to the very nature of the concrete stain system these products are UV stable and allow for the use of colors in exterior or high sunlight applications. This reflects the required topical sealer, and the Dyes are the preferred coloring type in polished concrete floors.

Dyes need to be correctly applied during the later steps of a grind and polish system.

Each type of concrete color has a specific application based on the advantages and disadvantages of the specific system. Careful consideration of all of these systems should be given regarding the specific project and the most desirable results. As construction continues to evolve in the world marketplace, concrete has been a constant.

Like the Mayan artisans of old, the decorative concrete craftsmen of today have a host of mediums and palettes from which to choose.

The goals haven’t changed in 2000 years, and at the end of the day people then and people today want concrete to be beautiful, long lasting, and in living color.

This column has previously presented technical issues related to the residential concrete foundation industry. In 2018, we turn to a range of topics related to OSHA regulations and their interpretations to help prepare you as an employer.

Q

UESTION: We were given a contract to start footings and foundations for a residential project.

The excavation was provided by the builder and when we arrived, on schedule, we started unloading the footing forms and sending them into the hole for layout and staking. An OSHA inspector arrived and asked if we had completed a site inspection and considered the fact that the excavation was not to regulation. We are looking at citations for several conditions including lack of site inspection, no trench protection, a non-compliant excavation and hazardous conditions around the edge of the excavation. Concerned that the builder would pull our contract, we had decided to keep going. What are we to do in such a situation?

NSWER: The immediate, or perhaps obvious answer to your question is contact the builder and explain that you can’t proceed until you know the jobsite is safe…within current regulations. If they are unwilling, as the party responsible for the excavation, to discuss and then correct the conditions, you must then walk away. Although there are certain to be readers who can’t imagine this position or those that would as soon roll the dice for either an incident or an inspection, as the employer it is your duty to protect your most valuable resource, your personnel, which includes you.

However, in order to have any conversation, whether it is a productive one with the builder or having a positive defense conversation with the OSHA inspector, you must have a command of the duties as an employer as prescribed for excavation

by OSHA. There are certainly situations where inspectors may not recognize the subtleties of residential construction and you must also be able to recognize the differences from commercial

work if your company performs both.

There are multiple regulation components found in 29 CFA 1926 Subpart P1, which is the regulation section for all excavations. In 2002, OSHA published Publication #22262, which states that the provisions of 1926.652 do not apply to house foundations or basement excavations provided they meet a set of exclusion requirements.

In general, OSHA considers excavations to be one of the most hazardous conditions for construction. At the same time, they recognize that basement excavations are large holes with greater inherent safety until the forms are erected. Together, between contractors and inspectors, this section is one of the most frequently misunderstood and perhaps abused regulations.

It appears to me that the reason why we are fielding an increased number of inspections related to excavations is due to the increased height of foundation walls in today’s market. When Publication #2226 was created, foundation walls were predominantly nominal eight-foot walls. The International Residential Code3 restricts the maximum height of unbalanced fill to within six inches of the top of the wall, which is a 7’-6” excavation in theory. Today, however, foundation walls are commonly nine-foot, many are ten-foot and we are experiencing regular constructions of eleven feet or more. Both the builders and the sub-contractors have not revisited the regulation due to the height change and are now exposed to safety concerns, not to mention non-compliance.

Here is what you should know:

OSHA PUBLICATION #2226 This document available as a PDF downloaded and as a web page. It delivers, in plain language, the excavation regulations of Subpart P. The opening sections provides a conditional exclusion for house foundations or basement excavations that become trenches by definition when constructing formwork, foundations, or walls. For this exemption to apply, all the following conditions must exist: • The excavation is less than 7-1/2 feet (2.5 meters) deep or is

benched for at least two feet (.61 meters) horizontally for every five feet (1.52 meters) or less of vertical height; • The bottom of the excavation, from the excavation face to the formwork or wall, is at least two feet (.61 meters) wide, and wider if possible; • No water, surface tension cracks, or other environmental conditions reduce the excavation’s stability; • No heavy equipment is vibrating the excavation while employees are in it; • Soil, equipment, and material surcharge loads are no closer to the top edge of the excavation than the excavation is deep.

When you use front-end loaders to dig the excavations, place the soil surcharge load as far back from the edge of the excavation as possible, but never closer than

two feet (.61 meters); • The fewest crew members possible are performing the work; and • Workers spend the minimum time possible in the excavation.

IMPLEMENTING THE REGULATION Your first responsibility on any jobsite as an employer is that of inspection, as noted at the end of this response. Publication #2226 can be made into a checklist that is completed and stored on the jobsite and in the project folder(s) for every project. You may even decide to make it part of your contract negotiation with any builder ahead of a work agreement/contract or become an inspection report to report the conditions.

It is important to know the regulations referenced by Publication #2226 as they are found in Subpart P. Not every inspector may be familiar with the residential exclusion and when

wall heights exceed normal conditions, the knowledge of how to adapt is important. In addition, a more productive conversation during an inspection visit can be achieved, and your company will be best positioned.

Subpart P consists of 1926.650, 1926.651 and 1926.652 along with Appendices A, B and C. 1926.650 is helpful since it is a definition section

with important terms that will be used in the inspection and discussion.

Those most important to the aspects of residential foundations include: • Benching – a series of horizontal levels with vertical levels that breaks down the height of the excavated wall or the depth of the excavation.

• Competent person – a person

designated by the company capable of recognizing hazards and situations that can be dangerous to employees.

• Faces (sides) – the vertical or inclined surfaces of an excavation • Protective systems – a method of protecting employees from caveins, which include support systems, sloping and benching systems, shield and other systems.

Specific requirements are established for excavations in 1926.651 (exclusion discussed previously withstanding) where systematically, the important characteristics of excavation protection are provided.

element of the employer’s competent person inspection.

All surface encumbrances that are located so as to create a hazard to employees shall be removed or supported, as necessary, to safeguard employees.

While not defined, “encumbrances” are literally anything that can be seen as a hazard to an employee in the excavation. Loose soils on the face or evidence of caveoffs would be included as well as more structural elements like root structures protruding from the excavation that could be impalement or tripping/entanglement hazards.

Contractors dealing with a basement excavation only can skip sections 1926.651(b) and (g) as they are not present in this type of work.

1926.651(c), however, is an important section to know that specifies egress from excavations. Most basement excavations choose a ladder accessible every twenty-five (25) feet of

travel distance. Although this was not mentioned as an issue for your project, your awareness of it is important.

Additionally, 1926.651(d), (e) and (f) deal with situations where vehicles or equipment are accessing or lifting near or into a basement excavation, employees are to stand back for protection and not actively work near or under these activities.

Items 1926.651(h), (i) and (j) deal with maintaining the excavation safety in light of the presence of water and loose soils, which can both be extremely hazardous to workers in the excavation as well as the impact adjacent structures may have putting pressure on an excavation. Publication #2226 mention them in the residential checklist.

These can impact the security of the excavation face leading to cave-offs.

While active water filling an excavation is not generally a condition of concern for this industry, the water certainly leads to instability of the

soil condition.

The final section, 1926.651(k), establishes the requirement for regular monitoring and inspection. The establishment of a competent person on the jobsite is the key to this and a recommendation by CFA members is to have an inspection form or checklist that can be part of the daily tasks for this competent person.

CFA is specifically working to establish greater awareness, better safety practices and more consistent inspection and regulatory decision making. In 2018, we will begin a National Alliance with OSHA with the goal of such improvements across the entire spectrum of residential foundation construction regulations with specific focus on excavations and fall protection. DEVELOP A BUSINESS PLAN Effective business planning is more than simply putting some goals out there and then making a mad scramble to reach the goals

I

f you have never developed a business plan then consider this winter season to do so. If you have a business plan, consider revising it, updating it, strengthening it to be more realistic and more useful for this next business season.

Business planning looks at the future through more quantifiable lenses. It incorporates a strategic focus, i.e. “Where are we going?”, and puts tangible steps in place.

The direction set out by the business plan should clearly state what markets will be entered or maintained, what resources will be needed to meet the market objectives including the type of workers and equipment, and what the financial requirements to secure such resources will be.

Once the direction is developed it is then critical to create action steps to bring the plans to life. This is the

tactical effort that most contractors are more comfortable committing to.

The key here is to create action steps that are believable. Believable does not suggest that the steps should be easy, but rather that the steps are justified due to the amount of experience, type of resources, and a method for deployment that the leaders all understand and are committed to.

One brief example of action steps in place might be the decision to add another service to your business. For instance, let’s look at a flatwork concrete contractor who is adding concrete countertops to their field of services. The action steps might include the following list of items: • Identify best market for concrete counter top opportunities • Review current clients with potential for concrete countertops • Determine needed expertise for forming, pouring, and finishing countertops • Determine needed tools and equipment for concrete countertops • Set realistic goals for concrete counter top revenue for first three years (determine optimum profit potential) • Purchase needed equipment and tools • Hire needed workers for selling and producing concrete countertops or train existing employees • Look at marketing strategies and needed marketing budget to support new sales The actionable steps outlined above are completely different from how most contractors make the

decision to add a service. Far too many contractors make the decision on the fly, almost as a knee-jerk response to one customer that has a need.

A final effort needed for a good business plan is to establish a method to monitor the plan. Once again it will take some very practical measurements that can be easily tracked.

While you can measure just about anything you want, consider the following targets that might signal whether or not your business planning efforts are taking the company in the right direction: • Gross Profit for each job completed • Percentage material use against estimate • Percentage hours worked against estimate • Percentage bids won against bids created • Percentage bids won against goal per market type • Overtime hours worked versus overtime hours budgeted • Customer call-backs versus customer call-back target Each target should be quantified if possible; certainly the items addressed above can be.

Effective business planning requires focused attention by owners and their senior leaders.

If you have never developed a business plan start working on developing yours as soon as possible. You will find that reviewing and updating your business plans in the future should be done in preparation for each new business year.
