INTRODUCTION On behalf of Foley & Lardner’s Sports & Entertainment Group, I am pleased to introduce our Nationwide COVIDRegulation Tracker: Roadmap to Restart for Professional Sports and Entertainment Venues in the U.S. The United States is a big country, with many professional sports teams and venues that are regulated by layers of government within a complex federal system. Consequently, it is no easy task to review and assemble under one cover a compilation of all the COVID-specific rules and regulations governing the operation of stadiums and arenas across the country as they reopen to fans for professional sports in an environment changed by the pandemic. We have endeavored to do that here with this Tracker – a compendium of such state and local COVID-related regulations for the U.S. jurisdictions where each of the following leagues have teams: Major League Baseball (MLB); National Basketball Association (NBA); National Football League (NFL); National Hockey League (NHL); and Major League Soccer (MLS). In limiting our scope to these particular leagues, we respectfully acknowledge the many other leagues and sporting events that time, space, and resources preclude us from directly covering here. We nevertheless hope that those who are a part of or interested in these other ventures – e.g., WNBA, NWPSL, NWHL, MLR, PLL, MLL, Overwatch, and minor league and college sports – will find the resources collected here useful.

The Tracker was created to help stakeholders across the sports and venue industries navigate their complex legal, operational, and consumer-related decisions at this challenging time. It covers state- and city-specific information on venue capacity limits, ticketing policies, screening procedures, and other safety and mitigation requirements, and includes direct links to state and city regulations and to the rules established by the local teams. The Tracker will be updated regularly, so be sure to check back for the latest developments.

Having looked at the entire regulatory landscape, we do have a few key takeaways:  The

Politics of COVID. Not surprisingly, from a governmental perspective, the approach to regulating live entertainment venues varies from state to state, county to county, city to city, and very much reflects the political and cultural divisions and turbulence that have marked COVID-19’s history in the U.S. For example, where California constantly tracks and uses county-by-county transmission rates to regulate capacity levels and control fan attendance in stadiums and arenas, Texas has affirmatively rejected such regulation and has none.

Undoubtedly, sports will be part of the historical debate over the merits and impact of these competing approaches.

 Uniform

Standards. Despite the variation of government regulation, a uniform industry approach to COVIDrelated venue operations has nevertheless developed and appears to be dictated by the respective league offices (e.g., teams across a league will have virtually identical COVID safety pages on their websites). Plainly, the leagues have proactively established their own regulatory standards (which apply where there may be none otherwise) and effectively have created a set of generally accepted COVID-related practices that are found in nearly every venue in each of the leagues. For that reason, we do not repetitively include them for every single state, locality, or team in the Tracker. Those practices generally include the following: 

Masks for all fans over the age of 2 (as well as all personnel), except when fans are at their ticketed seats or eating and drinking;

Social Distancing Procedures −

Ticketed areas are sectioned off and sold in separated “pods” (generally 6 or fewer people)

Entry via designated locations

Venue signage that marks distancing for queues and general flow of foot traffic

−

Plexiglas barriers to further social distancing between fans and venue personnel

−

Hand sanitizing stations throughout the venue

−

Remove or block access to furniture and other fixtures to limit places for fans to congregate

−

Limit the number of fans and personnel permitted on escalators and in elevators



Cashless transactions for food and retail



Elimination or limited use of communal food stations such as buffets or condiment stations (“grab and go” food stations reduce congestion)



No outside food or beverage permitted



No tailgating (for many, but not all venues)



Contactless parking



Discontinuance of fan shuttles



Mobile ticket entry



Advanced ticket sales only



Enhanced cleaning and sterilization procedures implemented by venue staff



Venue personnel health screenings



Fan health screening and/or temperature checks



Proof of vaccination or negative COVID test for entry or special seating sections with less restrictive social distancing requirement (so far only in very limited cases)

 COVID:

An Accelerant for the Improved Fan Experience. Notably, some of the generally accepted practices were works-in-progress or future objectives pre-pandemic as part of the industry’s long-running focus on how to improve the fan experience at live events. Before COVID-19, leagues and teams were paying serious attention to how fans were attending and consuming games, magnified in recent years by increasing competition, including streaming, HDTV and home theater, and changing spectator habits (i.e., multi-tasking with multiscreens while sitting in seats), with generational shifts, social media, and technology perhaps all playing roles.

Cashless transactions, contactless entry, digital ticketing – these were all things that were anticipated years ago, and now, accelerated by COVID-19, they are here and not likely to be going away.

 The

Challenges of Capacity & Social Distancing. As the pace of venue reopening has increased this spring, teams have scrambled for opportunities to increase capacity and get more fans into arenas and stadiums.

Interestingly, the limits of 6 feet of social distancing can cut against maximum capacity limits. For example, in California and New York, where government officials recently announced capacity limit increases to greater percentage levels, existing social distancing rules nevertheless preclude capacity at levels approaching the newly allowed limits. In some cases, teams have aggressively met the challenge by requiring that all fans show proof of vaccinated status or a negative COVID test or by creating “vaccinated only” seating sections that allow for loosening of social distancing requirements (an experiment that apparently ran into political headwinds in Miami). In these ways, teams are driving change and creating opportunity.

 Are

We There Yet? The big question: when can things get back to normal with stadiums and arenas filled to capacity with fans? While recent weeks reflect we are heading in the right direction, nothing is certain. While the NFL plans to play games in stadiums at 100% capacity, not all jurisdictions reflect the same optimism with the season only months away. It could be we are just getting started in learning to live – and return to stadiums and arenas – with the coronavirus.

CALIFORNIA Limitations on Venue Capacity Blueprint for a Safer Economy  Tier-Based

System. The state regulates venue capacity, by county in which a venue is located, based on four color-coded “Tiers” tied to the COVID-19 testing positivity rate, case rate, and a heath equity metric, which determine each county’s current COVID-19 experience: Purple (Widespread), Red (Substantial), Orange (Moderate), and Yellow (Minimal).

Venues (with assigned seating) -- Tier-Based Capacity Limitations:

Purple: Up to 100 regional fans (i.e., within 120 miles), while accounting for six feet of distancing



Red: 20% of capacity, including suites limited to 25% capacity (in-state fans only)



Orange: 33% of capacity, increasing to 67% if within 72 hours of event all attendees show negative COVID test or vaccination, including suites limited to 25% capacity (in-state only),



Yellow: 67% of capacity, including suites limited to 25% capacity (in-state only)

Purple: Closed – no fans



COLORADO Limitations on Venue Capacity  Colorado

has been using a color-coded system of levels by county – known as the "Dial framework" -- to determine venue capacity limits and COVID procedures. A county’s level is determined by the number of new cases, the percent positivity of COVID-19 tests, and the impact on hospitals, as well as local considerations.

 As

of April 16, the state no longer requires counties to adhere to the rules tied to the particular Dial Levels, but has continued to track the relevant data and assign Dial Levels for guidance purposes. In the meantime, the state has retained certain capacity limits that cover sporting events.

 Outdoor

Events: Notwithstanding the lifting of Dial requirements at the state level, outdoor ticketed, seated event venues in excess of 30,000 square feet require CDPHE approval, in consultation with the local public health agency. Existing approved variances, including 5 Star Program approvals granted by a county, remain in effect.

 Indoor

Events: When more than 100 people are gathered in a room in a public indoor space, the setting may operate at 100% capacity not to exceed 500 people, with 6 feet distancing required between parties of unvaccinated people or when vaccination status is unknown. Venues may apply to their local public health agency for a variance to exceed 500 people, to be finally approved by CDPHE

sports teams, events, athletes, and street races are required to abide by league or governing body operating plans, which must be submitted for approval to the Colorado Department of Public Health and Environment.

ILLINOIS Limitations on Venue Capacity  The

Restore Illinois plan governs the re-opening of public accommodations, including venues.

 On

May 13, 2021, Governor Brown announced that vaccinated individuals are no longer required to wear masks or maintain social distancing in most public spaces. Written guidance from the Oregon Health Authority added that masks are not required for any person, vaccinated or otherwise, if that person is outdoors. The state has implemented the same exceptions to this guidance as the CDC guidelines, which require masks to be worn, for example, in hospitals and on public transportation.
